Arapahoe County voters to decide on new jail Ballot measure would raise property taxes to replace 33-year-old facility

Arapahoe County voters will decide whether to raise property taxes to build a new jail, after county commissioners unanimously decided on Aug. 27 to send the matter to the ballot this fall.

If approved, the measure would raise funds to pay for a $464 million jail to replace the current facility, built in 1986. Officials say the county jail, near the Broncos Training Center in Centennial, is worn out, overcrowded, dangerous to staff and inmates, and inadequate to host modern rehabilitation programming.

A new facility would incorporate a safer booking and release center, according to county documents, as well as more beds, new medical and behavioral units, and additional classroom and multipurpose space.

“It would be a better use of taxpayer money,” Sheriff Tyler Brown said at a special meeting of the county commissioners to approve the ballot measure.

The measure, dubbed Ballot Issue 1A, would increase the county’s mill levy by 3.4, and would increase property taxes by $19.08 per $100,000 of assessed property value, or about $68 per year on a home valued at $380,000.

The increase would still leave Arapahoe County’s mill levy — currently at 13.301 — the lowest in the metro area, according to county documents.

capacity of 1,458, through a combination of new wings and increasing the capacity of some cells from one to three. But other jail functions, including the infirmary, kitchen, and booking and release center, are all still built with the original capacity in mind, and are landlocked in the center of the facility with no room to grow.

The booking and release center in particular presents a danger to correctional officers and inmates, Brown said. Originally built to accommodate 29 inmates, it now regularly sees up to 80 at a time, and assaults are climbing.

Assaults on staff have risen 120% in the last three years in the jail overall, Brown said.

The jail also has only one classroom, according to the resolution passed by commissioners, and four small multipurpose rooms, which the resolution calls inadequate to meet the variety of educational, spiritual, mental health and addiction programs now offered by the jail.

Further, approximately 40% of the jail population has mental health needs, the resolution says, and only 20 cells are available to address severe medical and mental health needs.

The current jail’s plumbing and electrical systems are stretched beyond their limits, Brown said in a June tour of the jail, and are largely only accessible through subfloor tunnels that are filling with mud. Upgrading them would require taking large sections of the jail offline, Brown said.

The county is legally obligated to provide a suitable jail, Brown said. Of the more than 1,100 inmates in the facility on the day of the hearing, nearly three-quarters were pre-trial and had not been convicted of a crime, he said.

“The average stay in our facility is 22 days,” Brown said. “We relase upwards of 16,000 people back into the community every year. We want them to have accessed rehabilitative programming in that time. It’s a community safety issue.”

New and improved If approved, the new jail would be built adjacent to the current facility on land already owned by the county.

Though the total capacity would only increase from 1,458 to 1,612, officials say the new facility would allow far more separation of high-risk popula-

tions. The jail currently holds around 1,100 inmates at a time, said Chief Vince Line, who oversees the jail, with the extra capacity necessary to keep violent offenders apart.

Talk of problems with the jail dates back to the county’s Judicial Facility Review Committee of 2002, according to county documents. That committee also recommended a slate of judicial reforms to help reduce the jail population, which county officials say have successfully diverted offenders through alternative sentencing and improved court date notification procedures.

Long-range planning conducted by the county beginning in 2016 studied replacing the jail, as well as the adjacent courthouse and district attorney’s offices. The total price tag to replace all three, according to county documents, was around a billion dollars.

A 25-member, bipartisan long-range planning committee convened in 2019 issued a report in August expressing strong support for replacing the jail, but found more skepticism toward replacing the court and DA’s offices.

“We heard them loud and clear,” said Jeff Baker, the chair of the board of county commissioners. “If this passes, the money we’ll save through reduced maintenance of the jail could be put toward the initial phases of designing a new courthouse.”

Baker said it’s too soon to say how long it would take to build a new jail, though a master plan previously presented to the commissioners contains a 10-year timeline.

Paying for it Funding a new jail out of current county revenues isn’t possible, several commissioners said.

“We have cut everywhere we can cut,” said Commissioner Kathleen Conti. “We have deferred projects.

It took us years to catch up after the recession. The costs of equipment, construction and wages just keep climbing.”

The county has not asked for a property tax increase since 1991, Conti said, and the state Gallagher Amendment means that even as property values skyrocket in the metro area, taxing entities collect diminishing portions of that value. Voters passed a county sales tax hike in 2003.

Baker agreed that he doesn’t see another way to fund the project.

“When we started talking about this, I said a tax increase was our last resort, and that’s what happened,” Baker said. “We’ve looked under every rock and between the seat cushions.

We can’t find money to do this in what we have. It’s not there.”

Sheriff Brown said he’s optimistic about the measure.

“This is a culmination of three sheriffs’ administrations coming to a head,” Brown said. “This started with Sheriff (Grayson) Robinson, the torch was handed to Sheriff (Dave) Walcher, and now it’s been passed to me. It’s time we address how inmates are treated, and I hope we can get this done.”

District attorney tackles illegal firearm sales Brauchler calls for prison time for felons who attempt to obtain guns

When it comes to preventing gun violence, the cause hits close to home for District Attorney George Brauchler.

Brauchler has watched his 18th Judicial District endure multiple high-profile tragedies in recent years: the Aurora theater shooting; the fatal attack by a gunman at Arapahoe High School; the shooting death of Deputy Zackari Parrish; and most recently, the STEM School Highlands Ranch attack in which a student was fatally shot and eight others were wounded.

“I just remain baffled that some of these most noteworthy, most horrific acts of violence have taken place in, you know, the community I grew up in. The community that my kids are growing up in,” Brauchler said. “I know these people. They’ve been my neighbors and my community for my life, and I just don’t understand why so much of it is happening here. Why us?”

Brauchler, a Republican who lives in Parker, is trying to do what he can, he said, without getting caught up or held back by hyperpartisan, hypercon-

In the days after mass shootings in early August devastated El Paso, Texas, and Dayton, Ohio, Brauchler formed a plan to tackle gun violence in his district — but not through hotly debated approaches like an assaultweapons ban or raising the age at which one can purchase firearms.

Rather, he decided to lean on existing state laws, and he specifically sharp-

ened his gaze on the illegal sale of firearms, which is attempted thousands of times in Colorado each year.

In short, Brauchler wants diligent and early investigations into illegal firearm sales. He wants prison time for felons who try to or successfully obtain guns, instead of probation sentences laws hand down now. He wants law enforcement, firearm retailers and his office working closely together to get it all done.

Brauchler — whose district includes Arapahoe, Douglas, Elbert and Lincoln counties — said he isn’t suggesting the plan will solve mass shootings, but he hopes it will serve as a launching pad toward curbing gun violence.

Douglas County Sheriff Tony Spurlock applauded Brauchler’s call for gun-violence prevention but said the issues the district attorney is taking up make for a “huge undertaking” and will require collaboration among multiple agencies.

Arapahoe County Sheriff Tyler Brown called Brauchler’s plan “a good step.”

“This is the low-hanging fruit of where we should be starting in tackling gun violence,” Brauchler said.

Illegal sales Brown believes attempts at illegal firearm purchases are a districtwide issue.

“I think people test the waters whenever they get the chance,” he said.

“We need to make sure that convicted felons know we think this is a serious issue.”

The Colorado Bureau of Investigation operates a real-time background check called Instacheck that is conducted in the course of a firearm transaction. The vetting process takes an average of seven minutes.

A person prohibited by law from owning firearms — including felons, people dishonorably discharged from the military and those guilty of certain domestic violence crimes — are turned down.

CBI’s Instacheck Unit issued 340,816 approvals and 6,279 denials in 2018.

That was the lowest number of denials since 2014, when there were 6,068.

As of July 2019, the agency issued 185,217 approvals and 3,953 denials.

Brauchler said Instacheck numbers clearly show people who shouldn’t own firearms try to get them anyway.

CBI spokeswoman Susan Medina cautioned Colorado’s number of denials trends higher than the national average because the Instacheck system looks at more databases than the system used by the Federal Bureau of Investigation.

C-470 construction far behind schedule CDOT says contractor was misleading about progress of express lanes project

It’s like the sign says: construction ahead, expect delays.

The C-470 Express Lanes project, which will add two tolled express lanes along the busy highway, was supposed to be done this summer.

The Colorado Department of Transportation, however, recently placed the project’s contractor in default after what it calls repeated delays, misleading timelines and insufficient resources to finish the work on time.

At this point, CDOT says the work could stretch into next summer.

“We certainly understand the frustration drivers feel,” CDOT spokesman Matt Inzeo said. “We’re taking every action to make sure this project is done as quickly as possible while making sure safety and quality standards are met.”

The $276 million project, which kicked off in 2016, is about 83% complete, Inzeo said.

The project includes adding toll lanes to the highway between I-25 and Wadsworth Boulevard, as well as adding noise walls, realigning curves and widening overpasses. The project is expected to save commuters up to 18 minutes during a rush hour trip along the 12-mile stretch between I-25 and Wadsworth once it’s completed, according to CDOT. CDOT formally notified the contractor, a joint entity made up of Flatiron Construction and AECOM, called F|A, that it was in breach of contract in a letter to project manager Dustin Williams on Aug. 2.

“CDOT repeatedly provided comments and expressed concerns regarding F|A’s ability to achieve the required Project Completion Deadlines,” the letter reads in part. “F|A failed to adequately address CDOT’s comments and concerns and continually misrepresented in the Contract Schedules that they were able to meet the required Project Completion Deadlines.”

Williams, who works for Flatiron, declined to comment on the matter when reached by phone, and directed questions to a company spokeswoman.

That spokeswoman initially directed questions back to CDOT, but when asked for Flatiron’s reaction, directed questions to another spokeswoman.

That spokeswoman said she would respond with a statement, but had not

done so by Aug. 29.

AECOM did not respond to requests for comment.

At this point, Inzeo said, CDOT will have to decide whether to stick it out with F|A or to find another contractor to complete the project. The project likely won’t be completed until at least December, or possibly as late as June 2020, Inzeo said.

Both Flatiron and AECOM are wellknown entities, Inzeo said, and the project’s problems are unusual.

“We haven’t placed a contractor in default in years,” Inzeo said. “This would be something that hasn’t happened in quite some time.”

Local officials said they’re thankful CDOT is stepping up to address problems.

“We appreciate that CDOT maintained timely communication with Douglas County and other members of the multi-jurisdictional C-470 Coali-

tion, as well as the public, regarding construction delays and plans for the foreseeable future,” said Roger Partridge, chairman of the Douglas County Board of County Commissioners. “We especially appreciate the public’s patience during the delayed construction period.”

The delays are disappointing, said Littleton Mayor Debbie Brinkman.

“This is really painful for the whole south side of the metro area,” Brinkman said. “The construction is pushing traffic onto surface streets, and it’s causing congestion everywhere. We’ve been tolerating this with the expectation it will end soon, and the longer it goes on, the more painful it is.”

Brinkman said she’s anxious to see progress.

“The sooner it’s finished, the sooner life can get back to normal,” Brinkman said. “Just get the dang thing done already.”

On the north side of the street where South Marion Parkway curves into East Bayaud Avenue in Denver, stands a bicycle painted completely white. The bike is under a tree, with stacks of bouquets piled next to it and a circle of electric votive candles around it.

The ghost bike stands at the intersection where Alexis Bounds was killed on July 24 while riding in a designated bike lane. In the street, someone has written “another slain cyclist” in green paint.

During July, Colorado added several of these memorial ghost bikes to its streets. Like crosses, or the blue city signs that read “Please drive safely,” followed by a victim’s name, they are a physical memorial — a testament to the lives lost on Colorado roadways.

For Brad K. Evans, the founder of Denver Cruisers, a monthly bike event organization, and former candidate for a seat on the Regional Transportation District’s board of directors, the ghost bikes are a stark symbol.

“We need a better conversation about the safety of our streets,” he said. “It’s essentially a gravestone.”

In the metro area including Adams, Arapahoe, Broomfield, Denver, Douglas and Jefferson counties, 35 pedestrians and cyclists have died so far this year, according to data from the Colorado Department of Transportation as of Aug. 20. A majority of those fatalities happened in Denver where 10 pedestrians and two cyclists were

killed. On Aug. 9, Denver also reported its first electric scooter death when Cameron Hagan died as the result of an accident earlier this month.

But it’s not just a problem in Denver, or even Colorado, said Megan Hottman, a lawyer who focuses on personal injury cases for cyclists as well as safety laws for bikes and pedestrians nationwide. This upward trend in deaths is happening across the country, Hottman said. In 2017, 52 bicyclists and pedestrians were killed in the metro area. That number rose to 60 in 2018, according to data from CDOT. Colorado officials and cycling advocates are exploring the need for new and harsher laws to prevent deaths of both pedestrians and cyclists on the road. More people are moving to the metro area, and as a result, more people are on the increasingly crowded roads.

In May, Gov. Jared Polis signed SB 19-175, a bill that deals with penalties given to drivers who seriously injure a vulnerable road user. The World Health Organization defines vulnerable road users as anyone who does not have an external shield. The bill made accidents resulting in serious injury a Class 1 traffic misdemeanor, in which the minimum penalty is 10 days in jail and/or a $300 fine.

As for cycling, Hottman also said that while car drivers bear a lot of the responsibility on the road, cyclists can be more aware as well. She said that cyclist advocates also need to be advocates for safety on the road, making sure cyclists are not using their

phones while biking and otherwise setting a positive example. Most cyclists, she said are also motorists, and should operate their bikes with the same precaution as they would driving a car. With congested streets, Hottman also said that people are stressed because they’re running late, which can lead to speeding. If people gave themselves more time to get places, it could help decrease traffic accidents.

“Frankly, we all just need to slow down a little bit,” she said.

The ‘most vulnerable’ Jack Todd, the communications and policy manager with Bicycle Colorado, a statewide advocacy group for cyclists’ rights, said the increase in cyclist deaths has been going on for a number of years.

In 2014, CDOT reported 10 bicycle deaths statewide, a decline from 12 the year before. But in 2015, 14 deaths were reported. In 2016 and 2017, there were 16 deaths reported each year.

Numbers from 2018 are still being finalized, but preliminary data shows that 22 cyclists died last year in traffic accidents. Eleven of those deaths last year happened in the metro area.

Pedestrian traffic deaths have seen similar increases over time. In 2015, 64 pedestrians were killed in traffic accidents in Colorado. That number jumped to 84 in 2016, and jumped again to 92 in 2017. Last year there was a slight decrease with 90 reported deaths, with 49 in the metro area.

Because vulnerable road users don’t t have protection, it makes it more likely they will get hurt in the case of t a an accident, Todd added.

“They make up a smaller percentage H of traffic crashes, but a much higher s percentage of serious injuries or fatalities,” he said. “Ultimately, what itq comes down to is nobody should fear s for their lives or die on our roadways.”

Biking in Centennial has a ways to go Some high points, but challenges exist for cyclists in city

Parks and trails are among the features that residents like most about Centennial, but for such an outdoorsy city, its bikeways have some catching up to do despite the long and scenic trails it boasts.

Charles “C.J.” Whelan, a former Centennial city councilmember and an avid bicyclist who owns more than 10 bikes, would give the biking system in Centennial and most of the south Denver metro area “maybe a grade of C.” “We have some nice trails, (such as) Piney Creek Trail, Centennial Link Trail, High Line Canal Trail, but beyond these few major trails, the quality of the bicycling system in Centennial fades very fast,” said Whelan, who usually rides at least four times a week. “For example, getting to these

my breath away,” he said.

Vogel was hit on July 4 near the intersection of Pine and Centennial drives in Douglas County, near Parker, and died of his injuries. The driver fled the scene and a suspect was later arrested.

Fears for safety The increase in deaths is causing more people to hang up their bikes for good, said Hottman.

She believes there is safety in numbers. When there are more cyclists, it becomes more normal for cars to drive alongside them. But that can be a hard sell for people not used to biking on the road.

“It’s hard to ask people to get on their bikes when all they see is death and destruction associated with it,” Hottman said.

Evans agreed, saying that even as someone who rides his bike frequently, he no longer feels safe on city streets.

This feeling is not limited to bicyclists either. Joanne Cdebaca, who lives down the street on West Bayaud Avenue from where cyclist Scott Hendrickson was hit on July 12, said that she won’t let her children walk in the neighborhood without an adult present. She and her father, who lives next door, frequently see drivers speed on the roadway. This concerns Cdebaca, because not only are there a lot of children in the neighborhood, they live near West-Bar-Val-Wood Park.

Getting there is half the battle: Centennial has about 24 miles of onstreet dedicated bike lanes, 10 miles of shared on-street bike lanes and 55 miles of trails.

By contrast, Arvada has 54 miles of on-road bicycle facilities and 93 miles of paved trails, according to that city’s 2017 Bicycle Master Plan.

Arvada is a similarly large city with 110,000 residents, roughly the same as Centennial’s population.

But Centennial is an unusually young city — it formed in 2001 — and no bike lanes existed before that in what became Centennial, said Allison Wittern, city spokesperson.

Within Centennial’s boundaries, 29 biking accidents have occurred from August 2017 to this August, according to Deborah Sherman, Arapahoe County Sheriff ’s Office spokesperson.

Most involved a bike and a car rather than multiple bikes. No biking deaths happened in that time in Centennial, according to Sherman.

Whelan, a longtime Centennial resident, argued the city lacks enough bike paths or lanes and that major road crossings are dangerous.

“They don’t want to wait for you,” Cdebaca said of drivers near the park.

Part of the reason Hottman believes the number of vulnerable-user deaths are on the rise is because of a lack of laws, but also because more people are driving on Colorado roads. As people have been moving to the state by the thousands, the infrastructure of the roadways has not been able to keep up, she said. It “screams for the additional need for us to have infrastructure.”

Changing behavior In Fort Collins, Todd said, the city is changing the way local governments deal with bicycle infrastructure. Tessa Greegor, the active modes manager with FC Moves in Fort Collins, said the city has seen a 22% decline in accidents overall in the last five years. FC Moves is the transportation planning department for the city. As the active modes manager, Greegor helps with planning for all types of traffic, including pedestrians and bicyclists.

She added that city government there has been very supportive of bicycle infrastructure going as far back as the 1980s. Before that, Greegor said she found archive articles of The Coloradoan newspaper from the 1960s that talked about bicycle advocacy groups fighting for safer streets.

“That’s really been growing for several decades,” she said. “Not a lot has really changed as far as what we’re working to advance.”

Fort Collins now has a “dedicated bike culture,” she said, adding that you can go almost anywhere in the city on your bike. Businesses, advocates, residents and city government all support the bicycle network.

The answer is very few. If you need to get to a destination on the other side of I-25 or Parker Road on a bicycle, it is extremely intimidating and dangerous … The same can be said to a lesser degree of some other major roads in our city such as Arapahoe

Centennial’s 2017 Trails and Recreation Plan identifies many planned bikeways that would greatly increase its overall number of bikeway miles.

“Not a great deal has been done” since that report, Whelan said.

The city pays for bike lanes with its own funds and also applies for grants from the Arapahoe County, state and federal governments when available, Wittern said.

ture, such as protected bike lanes, as something that only benefits cyclists, said Wesley Marshall, an associate professor in the department of civil engineering at the University of Colorado at Denver.

Marshall has been doing research and data studies of cities with and without bicycle infrastructure. Narrower roads mean slower speeds, he said.

“Cities with a ton of bicycling are some of the safest in the world,” he said of his research. “The gist of it is about slowing cars down and building a bigger network.”

Fort Collins is currently working to update its bicycle and pedestrian master plans, Greegor said. Projects include improving street crossing areas on major streets. Greegor said that if people don’t feel safe crossing a street, they often won’t ride their bikes or walk places.

The plans are also looking at places where the city can slow traffic. One thing that the data and all parties can agree on is that speed plays a large role in fatal accidents. The faster you go, the more likely it is that someone will not walk away from that accident, said Jill Locantore, the executive director of Walk Denver. Walk Denver is a pedestrian advocacy group.

On Aug. 7, Mayor Michael B. Hancock of Denver announced that the city would lower the speed limits on five arterial streets as a result of recent bicycle deaths. For Locantore, this is a good first step. Arterials are where most of the traffic happens.

Because they are usually more complicated streets, they also need more complicated solutions when it comes to the safety of road users.

“We’re definitely glad to see them

focusing on specifically arterials,” Locantore said.

Many of those arterials also make up what is called the High Injury Network in Denver. That’s where 5% of the streets account for 50% of the fatalities. Some of those roads include Colfax Avenue, as well as Federal and Sheridan boulevards.

Several of those roads stretch into other cities in the metro area, such as Englewood and Lakewood. Sheridan in particular is dangerous for pedestrians, Locantore said, because there’s little-to-no sidewalk to speak of. It’s also a major transit street.

“The farther away you get from Denver, the more highway-like those arterials become,” she added.

For CDOT, safety is the number one concern when building roadways, Cole said. The department uses an engineering team on new projects, as well as improvement projects to make sure that streets are designed to keep pedestrians and cyclists safe. Slower speeds, improved lighting and raised medians are some of the ways of handling that.

CDOT also has education campaigns on pedestrian safety, he said, adding “we’re not just building roads and leave it at that.”

Building a network Bicycle infrastructure can be frustrating for people trying to get from one place to another. Lanes in Denver are not well connected right now, Evans said, adding that “we haven’t really invested in creating a safe network.” Historically, street planning has all been car-first, leaving pedestrians and bicyclists to navigate their way around that.

City council candidate profile: Brian Beatty Planning and Zoning member looks to jump to council in District 2

After working to help shape development in Centennial, Brian Beatty wants to take his involvement to the next level.

“I sit on the City of Centennial Planning and Zoning Commission. For almost four years I’ve been a part of that,” said Beatty, a Centennial City Council candidate for District 2. “That has allowed me to get a whole lot of experience and exposure to working with city employees.”

He lent his time contributing to Centennial NEXT — the city’s comprehensive plan, which can set priorities for aspects such as development, housing, parks and transportation. Beatty runs the local region for a construction consulting firm.

He comes from a deep background in aviation: The son of an Air Force pilot, Beatty became a pilot himself and enjoys recreational aviation. He once managed a small private airport north of Atlanta.

“I am very sensitive to airport issues, and one might consider me an

airport proponent,” Beatty said. “I see the (economic) benefits of having a regional airport in our backyard.”

District 2 includes the part of the city north of East Dry Creek Road and mostly west of South Quebec Street. It excludes the farthest west part of Beatty town.

Here is a look at Beatty’s policy positions in his own words. Responses were lightly edited for clarity.

What’s the most important thing you want to accomplish in office?

In one word, I’ll say it’s opportunity.

My goal is to ultimately make Centennial more attractive and usable to our current citizens, while also creating an environment where companies and residents want to come make the city their home. We talk a lot about why Centennial is such a desirable place to live, but if we don’t take time to cultivate those reasons, we will lose our identity — the reasons why people move here.

‘Smart growth’ is an often-used buzzword. What does that look like to you?

First, it’s about the wise expansion on available land. District 3 has a lot of land that is available. But it’s about making smart, difficult choices about the types of buildings, businesses and residences that we want to have in the community.

(It’s also) being very real about how increases in population can affect things like roads, utilities and public services. We want to grow and grow, (but it can strain services).

My concern has been putting the right use, the right building, in the right places. In a lot of examples … development has either lagged behind around buildings or there’s nothing at all, and so it sits there.

What is your approach to transportation and “smart city” initiatives?

We need to be visionary about attempting new methods of movement — that’s a huge one.

Centennial is very unique in its layout: Having such a long and skinny layout almost requires us to look at new ways of movement from east to west. Ride-sharing, buses, bikes, the electric modes, those are all ways we can remove cars from the typical way we transport ourselves. This is really important as we try to reduce the through-traffic problem … especially along Arapahoe road.

What is the best way to maintain retail sales tax base in Centennial?

We been trending toward an increase in city expenditures because of population … that means an increase in costs, and that has to be offset in expanding our revenues.

Looking at new opportunities at attracting new goods and services for citizens is certainly going to be the

biggest challenge. We need to take a hard look at the areas that are being underutilized.

A lot of developers get into an island mentality: If we put apartments here, we can promote mixed use. … But why don’t you provide services that others, neighbors, might have interest in utilizing? You would drive a more successful site.

What issue is city council not paying enough attention to?

Smaller, lower-cost permanent housing. Condos would be my best example. We are seeing so much expansion in multi-family, single-family on the east, but virtually no development on the startup housing.

People go to our local schools, and then they go to get that first job, and they realize they can’t afford a place in Centennial. We have no step-up, maturing, permanent housing options.

You literally need two family incomes to buy a starter home in Centennial.

How can the city best take care of its increasingly aging population?

That’s a housing thing as well, providing aging-in-place options — making sure that retiring residents, or parents who want to move relatives closer, have options. It does come down to a zoning thing, making sure it promotes those uses … such as continuing care facilities.

Centennial Airport legal action against FAA delayed Court filing over Metroplex was ‘premature’; airport will bring case again

After a south metro airport took legal action over how carefully the federal government is evaluating the potential impacts of a flightpath rerouting plan, the airport withdrew its case on a technicality but could file it again later this year.

“Centennial Airport voluntarily withdrew the petition for review with the D.C. Circuit Court of Appeals because we were advised the filing was premature,” said Deborah Grigsby Smith, Centennial Airport spokesperson.

In its June 19 legal filing, Centennial Airport looked to take the Federal Aviation Administration to court over the agency’s NextGen Denver Metroplex project, which aims to optimize arrival and departure at local airports. That includes Denver International Airport, Centennial Airport and some others. An FAA study, called a draft environmental assessment, looked at impacts the project could have on noise, air quality, wildlife, and historic and cultural resources.

The proposed change in flight paths is expected to have “no significant impacts” on those aspects of the Denver metro area, according to the April 22 study.

The airport contends that the analysis thus far has left crucial gaps on the effects the federal plan could have on noise over south metro cities such as Littleton, Centennial and others.

Based on the FAA’s study, the lack of potential effects means a more rigorous review, called an Environmental Impact Study, isn’t necessary before the plan is put into action, according to the FAA. That’s one of the determinations and actions by the FAA at issue in Centennial Airport’s legal action, which was a petition for review in the U.S. Court of Appeals for the SEE AIRPORT, P15

Cherry Creek district test scores see little change Schools’ improvement in state ratings system a highlight, district says

The high-performing Cherry Creek School District put up numbers comparable to last year on its 2019 standardized test scores, but officials emphasized that those statistics are only one part of the story in the district’s performance.

“The test scores are one data point,” said Michael Giles, a Cherry Creek assistant superintendent. “We’re trying to develop our own internal measures as well to look at the whole child.”

In the 2019 season for the tests, called the Colorado Measures of Academic Success, the Cherry Creek district saw similar overall numbers in how many students met or exceeded expectations compared to 2018: The numbers fell by percentage-point decreases of 0.1 in math and 1.5 in science, along with a 0.5 percentage-point gain in English.

The tests mostly involve elementary and middle school students, although 11th-graders also take science.

“Basically, we’re seeing we’re maintaining — we’re pretty consistent,” Giles said. The “district went through a change in leadership. Sometimes, you

wonder how that’s going to impact our performance, but we’re not seeing a dip, we’re seeing consistency.”

The number most surprising was a downtick of 8 percentage points in high school science. But there is a trend of lower participation in the tests for older Cherry Creek students, according to data from the Colorado Department of Education.

“There tends to be more buy-in from our community to the college entrance exams — PSAT, SAT,” said Norm Alerta, Cherry Creek’s director of assessment and performance analytics.

When the state made the shift from TCAP — or Transitional Colorado Assessment Program, the old standards — to the current Common Core standards, Cherry Creek was one of the districts that pushed back against the change, which could contribute to lower participation, Alerta said.

“We haven’t dug into who’s participating and whether that contributes to drops we see,” Alerta added.

The results do show points to celebrate, though — eighth-graders posted a 5 percentage-point gain in English.

What’s more, even affluent districts aren’t putting up numbers that appear impressive on first glance: Overall, Cherry Creek saw 39% of students meet or exceed expectations in science, 43% in math and 51% in English.

But that’s still ahead by double-digit margins compared to nearby districts Englewood and Sheridan, whose popu-

lations are generally lower-income.

Studies have shown lower-income students are more likely to experience early childhood stress, less access to educational resources and less exposure to language early in life — factors linked to lower academic achievement, according to the Massachusetts Institute of Technology.

Statewide, 46% of students met or exceeded expectations in English.

Asked if the standards themselves are too harsh, Giles said: “It’s a question on many people’s minds. I won’t comment on whether they’re too high.”

“We’re trying to use the state measures as well as our own internal measures to measure success,” he added.

Looking ahead Cherry Creek district is “poised to go in a positive trajectory,” said Giles, whose position focuses on performance improvement.

“We’re always striving for excellence, which is our motto, so we don’t want to send the message that we’re satisfied with our scores,” Giles said. He added that the district “put in a strategic alignment plan to move our students’ performance to the next level.”

The district is entering its first year of implementing that strategic plan, named Future Forward, said Abbe Smith, Cherry Creek spokesperson.

In mapping out its vision, the district leaned on the support of parents, principals, teachers and district staff in meetings and conversations, the district’s website says. It plans to focus on closing disparities in achievement with “relevant learning experiences” and to invest in racially and “culturally competent” employees, among other broad strategies, the site says.

Moving up In the system of state performance ratings for schools, Cherry Creek had a lot to celebrate, Alerta said.

Colorado uses a hierarchy of “performance,” “improvement,” “priority improvement” and “turnaround” status — in that order from best to worst — to designate how well schools fare.

Priority improvement and turnaround schools are assigned plans to raise performance.

Schools and districts under those statuses have five years before “significant action must be taken” by the state, according to the state Department of Education website. That’s referred to as the “accountability clock.”

Those that don’t improve in that time frame can face a range of interventions, all the way up to closure or conversion to a charter school, according to Chalkbeat.org, a nonprofit news outlet that covers education. Ratings are largely based on the CMAS test results, but they also consider PSAT and SAT scores and high school graduation and dropout rates, among some other factors.

This year, Cherry Creek had seven more schools that were identified as performance schools — up to 50 from last year’s 43, Alerta said. It also improved to just 10 improvement schools from 15 last year. The district now has two schools that have been newly identified as priority improvement status, but it plans to appeal the rating, Smith said.

And all of the district’s four priority improvement schools from last year moved out of that status this year, Alerta added.

“That, for us,” Alerta said, “is the big celebration.”

• In 2018 and 2019, the state was to move away from PARCC, writing new test questions for English and math. The 2018 tests were expected to not be dramatically different and to still use some PARCC questions.

• CSAP, or the Colorado Student Assessment Program, functioned as the state’s testing system from 1997 to 2011.

by Instacheck include the Colorado Crime Information Center and local court records. CBI allows for people to appeal Instacheck results, Medina said, so some of these denials could have been overturned.

Quick investigations Despite the number of denials, which can indicate a person tried to get a gun illegally, those cases don’t always make it to court, Brauchler said.

In one example, he recalled learning Elbert County sheriffs deputies hadn’t investigated recent denials because they felt the law had worked — it had prevented a person from obtaining a weapon they shouldn’t have.

In some situations, Brauchler says law enforcement is strapped for the resources and manpower needed to

investigate each attempted illegal firearm purchase.

Brauchler is urging law enforcement agencies to quickly investigate when someone attempts to purchase a firearm but is denied by CBI during the Instacheck process.

“If you don’t get law enforcement early on to do the investigation necessary to put the evidence together it doesn’t come to my office as a chargeable case,” he said.

This district attorney also wants prison time for felons who attempt to obtain firearms. Today a felon can leave a courtroom after trying to buy a weapon and receive probation, he said, no matter how many times he or she does it.

The most common reason a person is denied during a background check is a conviction of a crime punishable by more than one year or a misdemeanor punishable by more than two years, according to data from the FBI’s National Instant Criminal Background Check System.

“If we are serious about upholding

the Second Amendment then we are going to be equally serious about punishing those who abuse it,” Brauchler said.

More protocols Brauchler also believes there needs to be additional protocols for how firearm sellers handle a CBI denial.

Brown envisions a checklist that they can follow, such as, make copies of all paperwork from the transaction, the individual’s identification and archive surveillance video.

“We will be working with the district attorney’s office and local firearm dealers to see how we can streamline this process and make it a little easier to have that open line of communication,” Brown said.

Josh Barton, vice president of sales and marketing for DCF Guns in Castle Rock, said there’s one more way retailers and investigators could be working more closely.

When a person’s background check is completed, it comes back as approved, denied or delayed, which

means CBI needs to verify more information before making a determination.

But there’s a fourth way someone’s ability to buy a gun can be decided — through a dealer denial, Barton said.

There are instances in which a gun store decides against selling someone a weapon. Maybe the individual smells of drugs or alcohol. Sometimes customers make comments suggesting they plan to harm themselves or others.

Or, “any reason my staff feels uncomfortable,” Barton said, DCF Guns rarely issues a dealer denial, Barton said, estimating it happens a couple times a year. Still, he thinks letting law enforcement know when gun stores encounter concerning people who weren’t necessarily denied by background checks could help deter gun violence.

“That’s kind of where I think there’s an opportunity between dealers and local law enforcement,” he said.

“We’re just saying somebody should talk to you and make sure you’re OK.”

Neighborhoods to ask voters to mend fences Willow Creek, Foxridge take separate tacks with improvement questions on ballot STAFF REPORT

Residents of Centennial’s Willow Creek 1 and 2 neighborhoods will vote in November on whether to form a general improvement district to build and maintain fences, while voters in the city’s Foxridge neighborhood will decide whether to increase the mill levy for its general improvement district to replace the neighborhood’s fence.

A general improvement district is a local taxing entity created for the purpose of constructing, operating or maintaining specific public improvements or certain services in the district, according to a news release from Centennial.

Residents of the Willow Creek 1 and 2 homeowners associations petitioned the city to form a general improvement district to replace the aging fence on certain arterial roads along the community, according to

These questions are on the ballot, in part, due to the Taxpayer’s Bill of Rights, a 1992 amendment to the Colorado Constitution.

TABOR requires voter approval for a government to: (1) impose new taxes; (2) increase a tax rate; (3) incur multi-year debt; and (4) retain revenues. TABOR specifies the language that must be included in ballot questions. TABOR questions generally appear on the ballot during November coordinated elections.

The first TABOR question asks voters to authorize the formation of the district and allow the district to: • Impose taxes for operations and maintenance up to $33,000 starting in 2020 based on a 0.75 mill levy; • Avoid decreases in revenues from changes to the residential assessment

rate; • Be exempt from the 5.5 percent statutory limit on revenue growth; and • Retain revenues of the district as a voter approved change under TABOR. The second TABOR question asks voters to authorize the district to: • Incur debt up to $4,340,000 for new fencing; • Impose up to $285,000 in taxes per year to repay that debt; and • Retain revenues from the debt, taxes and interest earned on those amounts as a revenue change.

The Foxridge community is looking to replace the aging fence in the community. The board of directors referred a TABOR question to voters to obtain financing for a fence replacement project. The question asks for voter approval for the district to incur debt up to $1,955,000 for new fencing and impose up to $160,000 in taxes per year to repay the debt. The question also authorizes the district to retain the revenues from the debt, taxes and interest earned on those amounts as a revenue change so that the district’s existing budget for operations and maintenance is unaffected by the fence project.

South Metro Fire names assistant chief of operations Jon Adams to oversee, supervise operations for department STAFF REPORT

Jon Adams has been name assistant chief of operations for South Metro Fire Rescue. He will oversee and supervise operations in areas including emergency medical services, firefighters and several specialized special teams.

South Metro Fire Rescue provides service to 540,000 residents covering 287 square miles, according to a news release. The department has 716 employees, 558 of whom are line personnel now supervised by Adams.

“It is a tremendous honor to be given the opportunity to lead the men and women in the operations division here at South Metro,” Adams said in the release. “Continuing South Metro’s mission and vision to take care of citizens in our district like they are family is something that carries tremendous value — especially during a time of growth and expansion of our district. I very much look forward to taking on this role and the responsibilities that come with it.”

Adams was hired in 1995 as a dispatcher for the City of Littleton.

He then started with the Castlewood Fire Protection District in 1996 as a supply runner. Adams has served as firefighter, paramedic, lieutenant, captain and bureau chief. He was a member of Colorado Task Force 1 and responded to the World Trade Center in 2001 and to Hurricanes Adams Katrina and Rita in 2005.

Most recently, Adams held the position of South Metro’s chief of training. During his time at South Metro, Adams has received multiple awards, including a medal of honor.

Adams has an associate’s degree from Arapahoe Community College in general sciences, a bachelor’s degree in fire sciences from Columbia Southern and a master’s degree in organizational leadership from Columbia Southern.

VOICES You only get one life, but hey, no pressure

“S

eptember Song” is a song. While the title has always been perplexing to me (why wasn’t it called “September”), the metaphor implied in it never has been, although when I first understood that it was a metaphor, it was, QUIET metaphorically, DESPERATION March.

The song was written in just a couple of hours for actor Walter Huston to perform in a 1938 musical, “Knickerbocker Holiday.”

Huston, you may remember, was the oldest of the three Craig Marshall prospectors in “The Smith Treasure of the Sierra Madre,” a 1948 film directed

by Huston’s son John.

John Huston asked his father to portray Howard without teeth.

Walter Huston reluctantly complied.

Father and son both won Academy Awards.

Walter Huston was 65 when the film was released. He died two years later.

Walter appeared in numerous other films when he was much younger, but his performance in “The Treasure of the Sierra Madre” is the one I first noticed, and by then he looked like an old man.

My grandmother looked old to me the first time I was cognizant of her, but, in fact, she was much younger than I am now.

Age is both a fact and an illusion.

It says exactly how old I am on my driver’s license, and I believe it. But I am still wearing shorts and T-shirts in the summer, just like I did in high school.

I still listen to some of the music I listened to in college.

And I still have my own teeth.

The song goes, “The days grow shorter when you reach September.”

Yes, they do. It seems like I have two birthdays every year now. I just turned around and I was 50. Then I turned around again and I was 60.

However, I have never tried to look, act, or sound younger.

I never conclude a sentence with the word “man,” man.

The last time I said “cool” was when it was cool.

I don’t wear a ball cap backwards, and I don’t wear my sunglasses in my hair.

The idea for this column occurred to me when I read about the people I grew up with who have headed for the exit.

Frank Robinson starred for the Reds when I was in high school (and lived in Cincinnati). Bart Starr starred for the Packers when I was in college.

Peter Fonda, Dr. John, Doris Day, Toni Morrison and I.M. Pei, rest in peace.

There always seems to be a push to speed things up. Ceramic Halloween

pumpkins were placed for sale in front of my grocery store in August.

I am fortunate now to be able to avoid rush hour. Most of the time.

But when I cannot, it is a reminder that the highway is a ribbon of unbridled recklessness.

Last week a Cadillac zoomed by me.

I said to myself, “Perfect.”

In 1956, the Cadillacs released “Zoom,” a classic doo-wop song. I was a kid when I heard it for the first time. Now when I hear it, I get a little wistful, just like I do when I remember absent friends.

One of them used to say, “Age is a thief.”

What’s the alternative? A portrait that ages in the attic instead of you?

As for me? I am going to appreciate September like there is no tomorrow.

Hope — a strategy and a tactic in the pursuit of success

I

s hope a strategy that can drive success? Is hope a tactic we can put into practice to help us achieve our goals and dreams?

Is being hopeful a character trait that when fully developed can lead us to even greater heights? I believe the answer to all three questions is yes.

Let’s start with the first one. Is hope a strategy?

There are many of WINNING us who have been WORDS taught that hope is not a strategy, there is actually a very popular book by Rick Paige called “Hope is Not a Strategy.” And I agree with the author’s point of view in the context in which he wrote the book.

Michael Norton If we rely on hope alone, and we do not carefully plan for our success, and then diligently execute against our plan, hope becomes more of a tactic as opposed to a strategy.

When we plan to win, prepare to win, and expect to win, we do typically include hope as part of that strategy. Just think about this for a moment, if in our planning, preparing, and expecting we were thinking that we were going to lose instead of win, hope would not be a part of our strategy. Instead, we would be looking at contingency plans for what happens after we have lost. And we all know what happens when we go into a contest of any kind, any match, any sales call or meeting, and we expect to lose, we lose.

The truth is we lost before we even entered the playing field because we didn’t have hope as part of our strategy.

Hope fuels passion, passion drives purpose, purpose ignites performance, and performance delivered equals results. Leaving hope out of our strategy never allows us to fully tap into the power of hope as a tactic. And hope as a tactic is incredibly important whenever we are planning for success or attempting to make a change in our lives personally or profession-

ally. Alfred Adler says it this way, “Hope is the foundational quality of all change.” If there is no hope, there is typically no change. John Maxwell says that, “If there is hope in the future, there is power in the present.” Meaning that if we have hope, we can leverage that hope as a strategy and a tactic to take the action today that is necessary for our success tomorrow.

And when we add the character trait of being hopeful, we are engaging our positive attitude, we are letting go of any negativity and pessimism as we look forward with great anticipation to the success we desire. We allow others to encourage us along the journey, we encourage ourselves in the pursuit of our own success and we remember what Zig Ziglar taught us, “The doors of hope swing widest on the hinges of encouragement.” Being hopeful means, that we are hopefilled.

Now having hope, living with hope, and recognizing just how powerful hope can be doesn’t mean that we live with blinders on either. As

stated earlier, we must take the time to plan to win and prepare to win, if we expect to win. We must look carefully at our win strategy and game plan for each initiative, every endeavor, and in whatever arena it is where we are trying to put a win on the board. We need to take all factors and challenges into consideration, including the risks. Balancing those challenges and risks with the right amount of hope is the key.

From city to city, this is also a problem. Those bike networks don’t translate as the street flows from Denver into other metro area cities.

“There’s no program for Englewood to draw off what Denver has,” he said as an example.

Englewood recently added a painted bike lane to Dartmouth Avenue. The lane goes from Inca Street to South University Boulevard. University is on the border of Denver and Englewood.

Evans added that in Denver, there is no advocate group specifically for cyclists. BikeDenver recently merged

District of Columbia Circuit. In the June filing, the Arapahoe County Public Airport Authority — the government body that oversees the airport — asked the court to review the FAA’s study, its determination that an EIS isn’t needed and its proposed changes in flight procedures.

Agency spokesperson Allen Kenitzer has said the FAA does not comment on ongoing litigation. The court formally dismissed the case Aug. 16, according to federal records.

The airport withdrew its legal action because it could only be filed when the FAA issues a finding of “no significant impact,” Grigsby Smith said, which doesn’t happen until its analysis is final.

“The FAA agreed to notify the airport when the environmental assessment is no longer a draft in exchange for our withdrawal,” Grigsby Smith said. “We will refile as soon as that happens, possibly as soon as September or October of this year.”

The airport’s filing also had requested a look at whether the FAA can carry out the Metroplex plan before completing studies required by the FAA Reauthorization Act of 2018, a law passed by Congress.

It also comes down to providing options for getting around, whether through buses or other transportation needs. The other important thing we have is a bike trail system … there are some cities that can’t even claim that.

How can the city best address high housing costs and the regional issue of homelessness?

With the influence of the Denver metro, we can’t control in the city what happens to our housing prices. But we have to take creative steps to providing a wide array of housing options … I

with Bicycle Colorado in May. When that happened, Evans said it created a vacuum, and Denver lost a voice working for change.

For Evans, it doesn’t do people on either side any good to “demonize” drivers, cyclists or pedestrians. Their efforts would be better spent focusing on getting cities to make changes in how they build roadways.

Taking action One of the keys to success in Fort Collins has been having funding specifically for these bike projects, Greegor said. The city passed a sales tax initiative that pays for projects.

Through grants, the city is also able to have dedicated staff on its bicycle program.

The city also created a complete street standard that requires new

streets or upgrade projects to consider the safety of all modes of transportation. “(New projects) have to meet these standards in order to build those developments,” Greegor said.

For a long time, Evans said he had been avoiding the ghost bike memorials. But when Scott Hendrickson, an avid cyclist and friend, was killed, Evans stepped in to help, painting an old bike of Hendrickson’s for the memorial placed in West-Bar-Val-Wood Park.

“This one kind of hit home when it was with Scott. It was one of his first road bikes,” he said of the bike he and Scott’s daughter Madison painted.

While Evans believes that the plans created for Vision Zero Denver are a great in theory, he feels that the city

has been slow to implement it. He also added that 2011 plans from Denver Moves have also not been implemented quickly.

Locantore agrees.

She also added that although lowering speeds is a good first step, it is just that: a step. Roads like Colfax may have a posted speed limit of 35 mph, but they are designed so that drivers can go 10 or even 20 miles over that.

Wider streets also make it hard for pedestrians to safely cross. These designs, Locantore said, often “put people in conflict with each other.”

“It’s the environment itself that’s causing those unsafe behaviors. We fundamentally need to redesign our streets,” she said. “There’s only so much you can do to protect yourself as an individual.”

of aircraft noise on communities; the relationship between noise and health impacts such as sleep disturbance and elevated blood pressure, as well as the effect on businesses located under certain flight paths; and whether 65 decibels and up remains an acceptable FAA standard for significant noise exposure, according to a June 5 letter from the airport to the FAA. The airport’s executive director, Robert Olislagers, has said that the results of those studies could significantly impact the Metroplex project, as well as the FAA’s conclusion that it would cause no significant impacts to the metro area.

The airport has also argued that the FAA didn’t consider the impact of the part of flight that occurs below 3,000 feet above ground, and that leaves unclear how much communities could be affected. Littleton, Centennial, Cherry Hills Village, Lone Tree, Castle Rock and other nearby cities could experience notable effects, Olislagers has said, although it is unclear how much.

The FAA contends that most proposed flight paths in the Denver area closely follow what are being flown today.

Legal action has been initiated against the FAA regarding Metroplex implementations in Phoenix, as well as in the Los Angeles area and the Baltimore-Washington, D.C., region, according to the airport’s letter.

There have not been any significant impacts found to be expected by any draft — or final — environmental as-

sessment for the 11 active or completed Metroplex projects in the country, according to Kenitzer.

dergone the more rigorous EIS review.

All projects have been reviewed as environmental assessments to this point, Kenitzer said.

I’m a huge proponent of supporting businesses and entities that provide job training, food assistance and temporary housing …Having potential starter jobs available, we have to do that through businesses. Some cities have programs that put homeless to work with the city public works department. I think that’s a great potential option.

Adaptive recreation offers options for wide range of participants

ust about five years ago, Dan Boozan, killing time after his shift, struck up a conversation with a bartender who encouraged him to take up rock climbing.

Boozan’s response was automatic: “I can’t go climbing, I have a disability.”

Several years earlier, in 2011, a bicycling accident left a 29-year-old Boozan with a brain injury and nerve damage in his right shoulder. The injury restricted his ability to move his arm apart from limited movement of his hand and bicep.

But the bartender insisted that Boozan, who’d formerly been active outdoors, look into Paradox Sports.

The nonprofit offers adaptive climbing classes and opportunities, which make climbing accessible for individuals with physical disabilities.

Boozan, who is now 37 and lives near Boulder, still had his doubts. After all, “disabled climbing seems kind of oxymoronic,” he said, laughing.

But he decided to give the sport a try and realized that wasn’t the case: “You can choose to embrace your disability and, really, you can still do everything you want to do.”

Soon, Boozan was climbing three to four days a week, going on weeks-long climbing trips alone and with friends, and becoming an ambassador for the nonprofit. Today, he is among those in the adaptive sports and activities community working to raise awareness

about the opportunities available for individuals with disabilities.

“Recreation is vital to everybody’s quality of life, and people with disabilities don’t always have those resources or know they have access to them,” said Leah Huffer, senior recreation supervisor for Denver Parks & Recreation.

Huffer helps oversee the department’s Adaptive Recreation division, which runs a host of recreational and cultural programs for individuals with disabilities — martial arts, cycling, camping and water-skiing, to name just a few.

The division also works with individuals to provide necessary preparations, such as strength training and adaptive equipment, for classes that run through the general Denver recreation department.

Throughout the metro area, cities and communities put on similar programs, including Lakewood Therapeutic Recreation, Aurora Therapeutic Recreation and South Suburban Therapeutic Adaptive Recreation (STAR).

Centennial resident Rick Lorie, who has cerebral palsy, became involved with STAR three years ago. Since then, the 31-year-old has spent almost every Saturday morning bowling with the STAR group, which invites those with intellectual and physical disabilities to participate.

“I love to bowl, and I’ve got a lot of friends here,” said Lorie, who often attends the weekly event with his room-

mate, Tommy, and Lorie’s girlfriend, Elaine.

For the group of friends, the Denver area has provided countless opportunities, he said, with the bowling club as one of his favorites. “Anybody who wants to come would love all of this,” he said.

Other recreational opportunities exist through organizations like Paradox Sports, which provides climbing adaptations such as seated harnesses or ropes for climbers to grab onto instead of the wall, local program manager Amy Bannon said.

“Any person of any ability is invited,” she said. “Even if you’ve never tried rock-climbing, it’s still an option.

You take away a hobby that provides confidence, and the community is like glue.”

Golden resident and Paradox Ambassador Jess Sporte agreed.

Sporte, 32, competed in wheelchair tennis in the area before finding Paradox in 2015. Shortly after, she began climbing competitively.

But for her, the highlight is the community around the sport: “My main reason to climb is the social aspect. Being able to help others into the world of climbing — no matter the limitation — is great.”

Boozan, too, is inspired by the way the sport pushes its athletes to set new expectations for themselves.

“This,” he said, “is for anyone with a disability who wants to try something new and change their own perception of what they can do.”

Diana Ross’ powerful musical career is the focus for a new show developed by Mary Louise Lee and the Mary Louise Lee Orchestra — and it’s booked for Sept. 21 at Lone Tree Arts Center. Lee will lend her strong voice to recreate this story of Ross, the Supremes and Motown for a 2019 audience.

Lee’s “Tribute to Diana Ross” program will bring a focus to the lead singer of the Supremes, a Detroit native, who continued an active role as a performer after she left the Supremes in 1970 and launched into a solo career with million-plus-selling albums/gold records.

Other members of the Supremes were Mary Wilson and Florence Bullard, whom she met as a young member of a Baptist church gospel choir. The group was increasingly popular in the 1960s across the nation and internationally. Ross is still active at 75.

Since 2006, when the Mary Louise Lee Band was formed, Lee has delivered R&B, soul, contemporary jazz,

Lee, who plays another distinctive role as Denver’s first lady, started performing at an early age — as a senior at Thomas Jefferson High School in Denver, she was cast in a show at the Garner Galleria at Denver Center for

the Performing Arts.

She has since performed for overseas troops, in countries around the world and at home in Colorado: for the Governor’s Inaugural Gala, Democratic National Convention, First Ladies of Jazz concert with the Colorado Symphony Orchestra, Winter Park Jazz Festival, Capitol Hill People’s Fair, Cherry Creek Art Festival, the Clock Tower in Denver and in many,

many more venues.

Audiences at Town Hall Arts Center in Littleton enjoyed her presence in the cast of “Ain’t Misbehavin’” in the spring of 2018, which brought us music by Fats Waller and others.

In July 2019, Lee received the Henry Award as Outstanding Actress in a Musical from the Colorado Theatre Guild for her performance as Caroline, a black maid who worked for a Jewish family in 1963 Louisiana, in the play, “Caroline, or Change” at the Aurora Fox. The role required considerable acting skills as well as a fine singing voice. Lee’s involvement undoubtedly brought extra attention to the play and to the Aurora Fox. “Caroline, or Change” was written by Tony Kushner, with music

by Jeanine Tesori. The director was Kenny Moten.

Lee actively supports the Bringing Back the Arts Foundation in Denver, which offers added opportunities for schoolchildren and others to experience a wide variety of art forms in the area. Art programs for Denver Public Schools are a particular foundation focus.

Story of Negro League baseball coming to Lone Tree President of museum returns for second straight year

The story of the Negro Leagues is one of America at its best and worst, said Bob Kendrick, president of the Negro League Baseball Hall of Fame in Kansas City. Kendrick will be returning to Lone Tree for the second year in a row to give a special presentation on the story of the Negro Leagues at the Lone Tree Arts Center Sept. 13.

The presentation begins at 7 p.m. and will be accompanied by a free exhibit in the arts center lobby.

Colorado Community Media spoke with Kendrick ahead of his visit to talk about the significance of this exhibit.

We almost de-emphasize the players in lieu of the story. It’s a very powerful, compelling story about strong-willed individuals who forged a glorious history in the midst of an inglorious time in American history.

It’s really all about how their love for the game of baseball would change our sport, but more importantly change our country.

IN THEIR BUSINESS Brewery wins medals Lone Tree Brewing Co. earned the Heavy Medal gold honor after winning seven medals at the Colorado State Fair Craft Beer Competition, the most of any brewery.

Lone Tree Brewing earned three gold medals — in the American Lager category for its Mexican lager; in the Irish Red Ale category for its red ale; and in the American IPA category for Hoppy Little Trees.

Silver medal winning beers were its pale ale in the American Pale Ale category; its double IPA in the Double IPA category; and its Belgian blonde in the Belgian Blond Ale category.

The brewery’s pilsner took bronze in the German Pils category.

Experts struggle to gauge potency of cannabis edibles Chocolate obscures true reading for reasons not yet clear to scientists

How much marijuana is really in that pot brownie? Chocolate can throw off potency tests so labels aren’t always accurate, and now scientists are trying to figure out why.

In states where marijuana is legal, pot comes in cookies, mints, gummies, protein bars — even pretzels.

These commercial products are labeled with the amount of highinducing THC. That helps medical marijuana patients get the desired dose and other consumers attune their buzz.

But something about chocolate, chemists say, seems to interfere with potency testing. A chocolate labeled as 10 milligrams of THC could have far more and send someone to the emergency room with hallucinations.

The latest research on chocolate, presented in a recent gathering in San Diego, is one example of chemistry’s growing role in the marijuana industry. Besides chocolate’s quirks, chemists are working on extending shelf life, mimicking marijuana’s earthy aroma and mak-

ing products safer.

The marijuana business is at a crossroads in its push for legitimacy.

The federal government still considers marijuana illegal, yet more than 30 U.S. states allow it for at least medical use. Even in those states, there are no recognized standard methods for testing products for safety and quality.

Chemists working for marijuana companies and testing labs are developing those standards and some are legally protecting their ideas.

Scores of cannabis-related inventions have received U.S. patents, said Boston attorney Vincent Capuano, who holds a doctorate in organic chemistry. Inventors have patented ways of putting cannabis into milk, coffee pods, ice pops and chewing gum.

“There’s a lot of flash and hipness, snake oil and marketing. But there’s still a lot of real chemical advance happening,” Capuano said of the industry. “It’s right in center field for chemists.”

Complicated blend Marijuana contains hundreds of chemicals, including cannabinoids such as THC and CBD, a trendy ingredient with unproven health claims. Some pose challenges when they’re processed. Chocolate is a good example.

“The chocolate itself is affecting our ability to measure the cannabi-

noids within it,” said David Dawson, chemist and lead researcher at CW Analytical Laboratories in Oakland, California, which tests marijuana.

The more chocolate in the vial, the less accurate the test results, he found. He thinks some of the THC is clinging to the fat in chocolate, effectively hiding from the test.

Dawson’s research was presented recently at the American Chemical Society meeting in San Diego. The conference included 20 presentations about marijuana’s technical challenges, said Markus Roggen, a Vancouver, British Columbia-based chemist organizing the program.

That’s a big change from a few years ago when presenters didn’t get much beyond the basics such as: “This is THC. This is CBD.” Some in the marijuana industry hold “a mythical belief in the goddess of cannabis,” Roggen said, but chemists view marijuana more objectively. For its part, the industry is learning to accept the “new guard of scientists with a different approach to the plant,” he said.

Another focus of research is a group of chemicals called terpenes that give the marijuana plant its pungent aroma. Many terpenes get lost or changed in the process of making a THC or CBD extract. But users want a certain smell and taste, said chemist Jeffrey Raber.

Raber heads the Werc Shop, a Los Angeles company that mixes terpenes from lavender, oranges, black pepper and other plants to mimic the flavor and scent of cannabis varieties. The mashups are sold to companies who add them to oils, tinctures and foods.

Monica Vialpando, a San Francisco chemist, is working to prevent drinks with CBD and THC oils from separating into unappealing layers while sitting on the shelf. The oils don’t dissolve in water, a problem for companies trying to create new drinks.

“We’re fighting against the true nature of the THC,” Vialpando, who came to cannabis from the pharmaceutical industry.

Chemists solve the problem by increasing the surface area of the A oil particles and adding ingredients, called surfactants and emulsifiers, to prevent separation.

She said consumers should be skep- N tical of outrageous claims for edibles C and beverages, including that all the THC or CBD in a product will be absorbed. Some potency will always be lost in the digestive system before A it hits the bloodstream, she said.

N Lack of testing creates enigma But for now, exactly what happens R in the human body with most of these products is unclear, Vialpando said, because there’s been very little safety testing of cannabis emulsions C in animals, much less in humans.

In Ottawa, Ontario, a Canadian government lab is working on a sensor to help police identify stoned A drivers. The goal is to detect cannabinoid molecules in saliva or breath N droplets, using light and nanoparticles. Still years away from roadside use, the technology might someday C also be used by marijuana growers to determine the peak time to harvest, A said chemist Li-Lin Tay, who leads the work for National Research N Council of Canada.

To do his work with chocolate, Dawson grinds a THC-infused chocolate bar in a commercial food processor, weighs samples, adds solvent to R the material (“It starts looking like C chocolate milk,” he says), before measuring the THC potency. He’s tested cocoa powder, baking chocolate and white chocolate to try to determine what ingredients are hiding A the THC during testing.

Mishaps with cars result in broken wings, ruptured eyes and other injuries for great-horned owls, according to a news release from Denver Audubon. Many of the birds cannot fully recover and become animal ambassadors for Denver Audubon, allowing for upclose encounters with the nocturnal hunters.

Community members will get a chance to see the owls during the Audubon Nature Center’s annual HOOTenanny Owl and Music Festival.

The 2019 festival has been extended to five days, starting Sept. 17 with a variety of events and nocturnal wildlife hikes throughout the week leading up to the main event, from 10 a.m. to 2 p.m. Sept. 21.

Flashy band brings hard rock to final SouthGlenn summer concert

With the sun setting on The Streets at SouthGlenn — and starting to set on summer — an ‘80s-themed band brought crunchy guitar tones and an energetic performance to keep the night lit up.

Well-known rockers such as Michael Jackson’s “Beat It,” Queen’s “We Will Rock You” and Guns N’ Roses’ “Welcome to the Jungle” got dozens in the crowd on their feet, delivered by That Eighties Band, a Denver-based cover group.

The final, free concert of the season at the SouthGlenn outdoor mall was the first for Scott Arnson, a Centennial resident.

The crowd stretched far beyond the park area at The Streets at SouthGlenn, spilling onto the street and around the fountain at the outdoor mall.

“It’s allowing people to become more engaged with each other in the community and experience that fellowship through music and dance,” the 54-year-old said. “It’s a great way to bring people together.”

T

he end of summer means it’s harvest time at the Littleton Museum, where volunteers maintain authentic 19th-century farms.

In the museum’s 1890s-style garden, historical interpreter Kathie Owens-Tucker has lots of work to do, processing and preserving the garden’s loads of organic heirloom produce.

“I don’t need to go to the gym,” Owens-Tucker said as she harvested ears of corn. “I get all my weightlifting, balance and isometric exercise right here.”

Gardening in the late 19th century was a real point of pride for people in Littleton, OwensTucker said, as the pioneer lifestyle gave way to a suburban one, and people who commuted to jobs in the big city wanted to maintain their connection to the land.

“We could stand to maintain that connection now,” OwensTucker said. “We’re part of nature, and it’s part of us.”

The Littleton Museum, at 6028 South Gallup St., will host its free annual Harvest Festival from 10 a.m to 3 p.m. on Oct. 13.

Owens-Tucker holds the fruits of her labor, all heirloom varieties grown organically.

t seems like Schuyler Wilcox is burning the candle at both ends.

The Eaglecrest senior is taking three Advanced Placement courses this year, and he’s taken several already. He’s an AP Scholar with Distinction. He’s in the National, Science and French honor societies. In a couple weeks, he’ll be performing weekly service through a local church program, which teaches “life lessons and life values,” he said.

But under such a tight schedule, he seems to be

thriving as one of Eaglecrest’s team captains. He picked up tennis in his sophomore year and has played baseball since his freshman days. He plans to do baseball in college and was recently practicing for a tryout with the Colorado School of Mines — he’d like to go into mechanical engineering.

But he says tennis offers a kind of competition that he lives for.

“You hold yourself to a higher standard,” Wilcox said. “It’s a gentleman’s sport — you can’t outlash when you make a mistake.

You’ve got to be calm, cool, collected … it’s one point at a time.”

COACH’S TAKE: ‘He brings a positive attitude every day. I don’t know if I’ve ever seen him get to a negative place with teammates, with teachers — with really anyone I’ve seen. When he plays someone, it’s like they’re best friends after the match.’

Q&A with Wilcox Who’s your favorite athlete?

DJ LeMahieu. I wish he had stayed in Colorado. I can see a bit of me in him. He shows that you don’t have to just be humongous and muscular to succeed — you can be consistent and just keep playing what the game’s about.

What would be a perfect performance in tennis?

A 6-0, 6-0 win, but there’s always something you can improve on. Perfect would be you keeping your calm and your composure and recover and maintain your integrity, even if you fail one shot.

What’s your favorite class?

Basics of manufacturing, right now. Learning how precise things can be made — you really get deeper into the process.

What do you like to do away from sports and school?

It’s hard to find time away from sports, trying to go far in both tennis and baseball. When there is some free time, I play video games with people I’ve found through classes, through baseball and tennis.

People who you never thought that you’d be doing things to connect with.

Is there something about tennis people seem not to know about?

How much really small things can make a difference and how hard it truly is. You can’t learn it in one day. When balls are coming in at 80 mph … the precision you need is something people don’t notice.

ic Fangio of the Denver Broncos isn’t the first longtime assistant in the area to finally get a head coaching job.

Fangio, a 40-year coaching veteran as an assistant, welcomed the chance to finally become a head coach — but new Highlands Ranch head coach TJ Rubley wasn’t seeking the head position after 11 seasons as an assistant at Mountain Vista and Highlands Ranch.

“I didn’t want to be a head coach, that’s not my deal,” said Rubley.

“Just the way Douglas County OVERTIME is structured, budgeting and all that stuff, you are a fundraiser, not a coach anymore, and I want to coach kids.

“Our kids are working so hard and they need Jim Benton somebody to be here for them and that’s why I accepted the job and agreed to do it.”

Rubley, whose son Jake is a junior quarterback for the Falcons and whose youngest son Luke is in middle school, is the fourth Highlands Ranch head football coach in four seasons.

“There’s a lot more logistical you have to deal with, you are talking about hiring, transportation, equipment and that kind of stuff,” he said. “That is taxing and not the fun part at all. As an assistant you are worried about game plans.’’

Rubley kept some of the assistants from last season’s staff and hired many newcomers for the defensive staff and lower-level aides.

“Our assistants are absolutely essential,” added Rubley, who was a quarterback at the University of Tulsa, was on the roster and played with three NFL teams, the Rhein Fire of the WLAF plus Winnipeg and Hamilton in the CFL. “We have a great group of assistants. They are qualified with varying backgrounds. We have guys that have been in the NFL, guys that have played a lot in college and guys that have been coaching in high school. Some guys that are just coming out of youth football. We are not a typical staff in the sense we are just a bunch of teachers. These are football guys.

adjustments. Problem is our offensive guys are out there playing on defense so it’s hard to communicate to them.”

“I shared with them my visions and shared with them my expectations and how we do things. They all fit very well. At the end of the day I don’t want to fight with my coaches just to get something done. We have to all go in the right direction but they still have to be free thinkers.”

Rubley and his staff have will have to do a good job of preparing the team since the Falcons have one of the toughest schedules in the state. Six of the 10 games on the schedule are against teams ranked in the top 10 in the CHSAANow.com Class 5A preseason poll.

“It is a tough schedule and everybody asks: `Where did that come from?’” said Rubley. “I’ve never gotten a straight answer yet. I don’t know where the schedule came from, I just know we have 41 varsity players and it is going to take all of our players to pull the rope in the same direction. We have some good talent.

“We want to win. We played the majority of our season last year against the same schedule and we had five sophomores and a freshman on offense. We’re still young but we are experienced.”

Rubley is still the offensive coordinator.

“We have so many guys playing both ways, we have to use tempo,” he said. “Sometime we will go fast and sometimes we will slow it down.
