Although the crowds were sparse and many shops remained closed along with the food court dining area, June 11 was an important day for Colorado Mills as the Lakewood shopping center was able to welcome shoppers for the first time in nearly three months.

Colorado Mills was one of several Jefferson County locations that were able to either reopen or expand operations as a result of a variance the county was granted by the Colorado Department of Public Health and Environment on May 8, permitting several activities in Jeffco that are not yet permitted by Colorado’s Safer-atHome order.

In addition to permitting indoor shopping malls in Jeffco to reopen after getting a plan for safety approved

by JCPH, the variance also allows gatherings of up to 50% people of up to 50 people in indoor spaces and up to 125 people in outdoor spaces. That applies to facilities like gyms, which were previously only permitted to open at 25% capacity or 50 people per room, and churches.

In Lakewood, Community Resources Director Kit Newland said the city was going to be making several changes to the availability of city recreation

facilities during the week of June 15 in response to the variance.

Those changes include making sports fields once again making sports fields available to kids and adult sports leagues and allowing up to 25 people in the city tennis facility. She said the city will also be increasing the number of people who can participate in outdoor recreation activities it has been organizing to 25.

Newland said that while the variance allows for up to 50 people on fields, the city is sticking with 25 because the amount of staff available to maintain the fields is limited.

The city is also beginning to look into opening other recreational facilities, although Newland said doing so presents several challenges and those talks are in tentative stages.

“Planning for that is very preliminary and the reason is because we have a large majority of our Parks and Recreation staff out on furlough,” said Newland. “And then it also requires putting all the health and safety

protocols in place so I can’t give you too much detail on that other then to say later this summer we will have a couple of our recreation facilities open.”

The decision of which particular facilities reopen will rest on determining “who can and can’t come back right away,” Newland said.

The variance also allows graduations to take place if a plan for them is approved by JCPH. However, Jefferson County Public Schools spokeswoman Cameron Bell said there has not yet been any conversation within the district about changing plans for graduations, which are now scheduled to take place in August.

The variance also allows breweries to open in reopen in Jeffco under the same regulations put into place for restaurants. Under the Safer-at-Home order, breweries could only open if they were also serving food on-premises.

John Avenson of Westminster May Be Our Leading Teacher of Energy Efficiency The sponsors of the annual Metro Denver Green Homes Tour, which is held on the first Saturday each October, are preparing to “go virtual” in case an in-person tour is not allowed.

That will be accomplished by creating online video tours of the most notable “green” homes featured over the past 20 years. Since I’m on the steering committee for the tour and since I have the equipment and experience from creating video tours of our homes for sale, I volunteered to create all those video tours, starting with John Avenson’s home at 9988 Hoyt Place in Westminster.

If you go to my YouTube channel (jimsmith145), you can view the 41-minute tour, led by John, which I created last Friday.

Many people, myself included, have created homes which can be considered a “model” of sustainability, solar power, and energy efficiency, but John is surely the only one who has turned his home into a classroom for teaching about it. He even has pictures and diagrams throughout the house with instructional content about this or that feature, as you will see on that video I created.

He also hosts monthly Passive House meetings in his home theater which are streamed online. They can be found on meetup.com/Passive-House-Meetup-S-W -Region/ John’s house was originally built by the Solar Energy Research Institute (SERI, now the National Renewable Energy Laboratory or NREL) in 1981 using then-state of the art technology, but John has diligently, and at great personal expense, kept retrofitting his home with newer technology, which he is happy to explain to visitors and which he explains on the 41minute video.

For example, because of increased insulation and Alpen quadruplepaned windows, he was able to get rid of SERI’s supplemental natural gas furnace, installing a conditioning energy recovery ventilator (CERV) which is powered electrically. Every week night since June 1, from 5-6 p.m., a group of residents has been gathering at City Hall for a peaceful protest against racial injustice and police brutality.

The effort is one of countless protests taking place across the country in response to the death of George Floyd, who was killed at the hands of Minneapolis police officers during an arrest on May 25.

Since then, protesters like those in Arvada have been calling for a vast array of possible solutions to a pattern of racial inequality, particularly as it relates to police use of force.

In Arvada, the main solutions brought up by those who protested at City Hall June 8 included finding ways that law enforcement personnel could be held more accountable for their actions and starting more conversations about ending systemic racism.

“It’s about how we can be even better and be a model for other smaller municipalities,” said resident Jessica Scobel. “If all the small municipalities are accountable, it’ll just become a cultural norm. We’ll actively engage in a way that’s antiracist and safe for all people.”

The daily protests were first organized by resident PJ Travin and his wife, with the first protest consisting of the couple, their son and a second family that Travin’s family lives with.

“We didn’t see any action happening in Arvada and that was frustrating for us,” Travin said. “We have a black son and he’s three years old.

We wanted to see action.”

It didn’t take long for the effort to gain more momentum as Travin connected with resident Alisha Fleming, who was using Facebook to organize her own effort. Together, they have created a Facebook group called Arvadans for Equality and Social Advocacy, which had 76 members as of June 9.

At the protest that occurred June 5, Travin said more than 40 people were in attendance.

The group has included a broad range of Arvada community members, from parents to children, from those who live in Arvada to those who work in Arvada. Karey Sutton, for instance, is a Golden resident and Arvada teacher who has been attending the protests to show her students how to take action against injustice.

“We have to change what we can in the three feet around us,” she said. “It is white people’s job to fight racism.”

Resident Katie Berger agreed, thinking to the inequality of experiences based on a person’s skin color and a friend who has told her that, because he is black, he often worries about being profiled and treated unfairly even during everyday tasks

“That’s something I don’t have to deal with as a white person,” Berger said. “There’s a lot of systemic racism in this country that’s been going on too long.”

In addition to their broader cause, the protesters are going to draft a list of action items to be collaborated on with the city government. The group had plans to outline those action items by June 12.

Travin added that a friend of a friend started a similar effort in Wheat Ridge just a week after the Arvada protests began and the two groups plan to connect on their agendas.

At the time of a June 8 interview, the Arvada group was also organizing for city councilmembers to attend the protest and hear from residents, Travin said.

The Arvada protests have been set to continue through at least June 19.

But even when the protests end, protesters said they plan to continue working for tangible action in their community.

“This is about loving our neighbors,” Scobel said, “and that extends to all of our neighbors.”

Green Mountain protest to support racial justice Parenting group staged peaceful demonstration at major intersection

There was a protest at the corner of Alameda Parkway and Jewell Avenue on the afternoon of June 11. But it was also an opportunity for Lakewood parents to talk to their children about some difficult topics.

As the sun tilted over nearby Green Mountain, dozens of protesters stood on all four corners of the Lakewood intersection, waving signs supportive of the Black Lives Matter movement, and decrying police violence and systemic discrimination, as a good number of the passing vehicles honked in support.

The protest was organized through GM Mamas parenting group on Facebook, and shared from there to other community pages.

“A lot of moms wanted to take their kids to a protest, but were nervous about going downtown,” said Jocelen Smith, a GM Mamas group member and the organizer of the June 11 event, who brought her own “Black Lives Matter” sign.

Smith said repeatedly seeing a lone woman, holding a “Black Lives Matter” sign on that same corner for

many days, and hearing about another community rally held days earlier in the same spot helped motivate her to organize her own “safe, peaceful, and close to home,” event for the other moms and families in the area to participate.

“I think it’s an important issue and I want them to learn early that it’s important to stand up for racial justice,” said Angie Anderson who brought her two children, ages 1 and 3 to the rally.

Anderson said her children were too young to learn everything, but she still showed them a Sesame Street town hall special on racism, and they had recently read a children’s book based on the life of Rosa Parks.

Anderson, and several other GM Mamas members at the protest all said the group has always been more about play dates than politics. Still Anderson didn’t see the protest a real break from that tradition.

“People are equal. That’s not really political,” she said.

Green Mountain-area mother Jennifer Morris said she came to join in the protest because she has two adopted black children, though, “even if we didn’t, it would be the right thing to do.”

Morris said she was thankful for the community protest.

“It made it really easy to have some of these conversations,” she said.

Still, the youngster said he was happy to see so many people in his community come out to the protest, “to tell the world what’s going on and how to fix it.”

Steve and Krista Frank, stood on another corner of the intersection. They had wanted to join the protests and to talk to their 6 and 8-year-old children about racial justice sooner, but said being part of the larger, and sometimes violent protests in downtown Denver, especially amid the COVID-19 outbreak seemed daunting, so the smaller June 11 protest came along at a nice time.

“They (the children) both helped put this sign together, and learn, well, who are these names?” said Krista Frank. She said the conversation that followed was uncomfortable, but meaningful.

A Lakewood mom to 5-year-old twins, Erin Lucas smiled and waved her sign, calling on white people to not be complacent. She said that over the years as more and more incidents of police brutality have been documented by cell phone technology, it just got harder for her to not try to do something.

“If your kids went to the store for Skittles and didn’t come back .... it’s an unspeakable injustice.”

Recall effort launched against four Arvada councilmembers

Six days before city council voted on contracting with a single waste hauler, two residents filed notices of intent to circulate petitions to recall councilmembers Bob Fifer, Nancy Ford, Lauren Simpson and Mayor Pro Tem Dot Miller.

The notice regarding Simpson, who represents District 2, was filed by resident David Palm. Notices regarding District 1’s Ford and at-large councilmembers Fifer and Miller were filed by city resident Jonah Hearne.

Palm’s effort to recall Simpson is not affiliated with Hearne’s notices, Palm said.

But all four notices were filed on the same day and use identical language claiming that the councilmembers are prioritizing their “own bias, agenda and special interests above the will of the voters.” Palm and Hearne have both said they feel these claims are true in regards to the issue of whether or not the city of Arvada should contract with a single trash hauler.

Out of Arvada’s seven councilmembers, Fifer, Ford, Miller and Simpson had been perceived as the most likely to vote yes on the proposed single hauler contract. The contract outlines that waste hauling company Republic Services would provide trash and recycling services to all non-HOA residents of Arvada.

Palm and Hearne say the people have voiced their thoughts and displayed that the community is split on the issue, but the four councilmembers have formed opinions based only on their own judgments and not resident comments.

The councilmembers contend that their opinions are driven by what they’ve heard from constituents.

“I always listen to my constituents who contact me, my neighbors, folks in the local grocery store and when eating at restaurants,” Fifer said. “Having an intent to recall good, honest, dedicated and hardworking city councilmembers is upsetting and disappointing.”

Fifer and Miller both cited citizens’ surveys showing a majority of responding residents want single hauler trash and more recycling options.

Ford and Simpson also pointed out

that their stances on the issue have long been well-publicized to citizens, with Simpson even incorporating her stance into her 2019 council campaign.

Simpson also highlighted her disagreement with the notice’s claim she has not well-represented District 2 over the past seven months.

“I have striven to listen to my constituents and engage them in good faith,” she said. “How do I know the recall is about organized waste hauling — an issue where I have not yet cast a vote — and not about how I have represented District 2? On June 8, I received an anonymous threat telling me that I have many decisions to make, and that if I voted in favor of this ordinance then ‘this will likely be the last.’

The single hauler issue has gained significant attention from the public and hundreds of emails have flooded councilmembers’ inboxes, with some residents in favor of the contract and some opposed.

Those in favor cite many benefits of the program, including that it will boost Arvada’s recycling rate, reduce the number of heavy trucks on the road and lower the average cost that each resident is paying for trash services. Those against the contract feel their choice in trash service is being restricted by the government and the contract would create a monopoly.

They also oppose the opt-out fee and an initial amount of more than $5 million the city will pay to purchase trash bins.

Residents have appeared evenly split to Mayor Marc Williams and in a previous council meeting, he asked the city team to explore the logistics of putting the decision in the people’s hands with a November vote.

Mayor Williams, who is not the subject of the notices, said that he feels the effort is a misuse of the recall process.

“I don’t like the use of recall over policy issues. You have the regular election cycles to make decisions about what candidates to support on policy issues,” Williams said. “I view it as an intimidation attempt to try to influence those four councilmembers.

Hearne, who says he is a 20-year resident of the city who watches politics closely, added that he and others he has spoken to feel it was unfair for the council to hold the vote June 15, when public comment and in-person participation is disrupted due to COVID-19.

Palm is a longtime Arvada resident, has run for city council on several occasions, most recently running unsuccessfully in 2019 for mayor against Williams.

Palm added that he feels a recall was the only option to get the trash issueon the ballot. To get a question about the trash hauling issue on the ballot would require petitioners to gather thousands of signatures in a shorter period of time than they will have to get signatures for a recall, making that process “prohibitive,” he said.

“If they won’t listen to us, what

other recourse do we have?” he said.

Under the city code, Hearne and Palm have until June 19 to submit petition forms to the city clerk. Councilmembers then have 10 business days to provide a statement in defense, which will be included in the petition.

Once the necessary documentation has been submitted by both sides, the petition can begin to circulate.

Petitioners will have 60 days to acquire signatures. To result in a recall election, each petition must have a number of valid signatures equal to 25% of the total votes cast in a councilmember’s race for office.

In other words, the petition to recall Fifer needs 9,229 valid signatures; the petition for Ford, 1,102 signatures; the petition for Miller, 6,691 signatures; and the petition for Simpson, 2,170 signatures.

If petitioners use the entire 60-day time frame to gather signatures, there won’t be time to get the recall elections on the November ballot, city clerk Kristen Rush said. Instead, the city would hold a special election at a later date.

While Rush and the city do not yet have an exact prediction of how much that election could cost the city, based on recent special elections held by other municipalities, Rush estimated it would cost about $200,000.

Council votes yes on trash hauling contract

4-3 vote follows failed motion to create ballot question

After more than 30 individuals gave public comment and almost 400 emails were sent as well, two long-awaited votes on Arvada trash hauling took place June 15 — and a contract between the city and Republic Services was approved.

The motion passed with a 4-3 vote, with Bob Fifer, Mayor Pro Tem Dot Miller and councilmembers Nancy Ford and Lauren Simpson voting to enter the contract.

All others voted no.

The city will now finalize details of the contract.

Residents will be asked to pick their trash cart size in late 2020 or early 2021 and citywide trash hauling will officially begin in July 2021.

For about 18 months, the question has been if the city should contract with waste hauling company Republic Services. Under the contract, Republic would provide trash

Council was expected to vote June 15 on whether to put a question on the ballot or to vote on the issue as a council. Depending on that vote, it was also expected to vote to approve or deny the contract proposed by Republic.

Many of those who spoke at the meeting said they were in favor of a council vote, not a public vote, and wanted the contract to be approved. They cited high numbers of trash

trucks on their streets, saying some neighborhoods see up to nine trucks go by per week.

They also pointed to data showing the program will lower costs for most residents and make recycling more accessible for residents.

Meanwhile, a good number of speakers said they would like to see a public vote, with many of them also stating they were against the proposed contract. ers argued that the public hearings and surveys have not reached a large enough portion of the community to accurately represent what citizens want.

Councilmembers first discussed whether to put the issue to a public vote. Some members like Mayor Marc Williams pointed to the clear split in public opinion as a reason to hold a vote of the people.

“I do fear that there will be an effort to have a citizen initiative referred item that’s going to force it to an election anyway,” he said. “I think we should just take the step ourselves, put it to an election and that would stop kicking the can down the road.”

But others including councilmember Fifer held to the viewpoint that the contract is too detailed to be communicated through a ballot question.

“It does concern me that some folks have said that we’ve implied they’re not smart enough to understand this as a vote. It’s a complex and dynamic discussion because when we look at performance, we look at rates, we look at additional ontaking by the staff… We have

to do what is right,” he said.

“I can’t support it going to the voters. We would spend more time and energy putting it toward a vote.”

The motion failed with a 3-4 vote, with Williams and councilmembers John Marriott and David Jones voting yes and all others voting no.

Then council voted 4-3 to enter into the trash hauling contract.

Marriott said he could not vote yes primarily because multiple residents have said they feel they would be harmed, financially or by losing their choice in services, if the ordinance passed.

“Make no mistake that with the good that comes from the single hauler program and there is some good, we are doing harm,” Marriott said.

But Ford and others commented that the nature of tough decisions is to look at a broad array of facts and find the best solution for the entire city.

“There’s always going to be winners and losers no matter what major decision we make,” Ford said. “If we vote based on individuals we know who may be affected negatively, we’re not looking at the overall picture.”

How has the COVID-19 pandemic impacted how you think the Jeffco district attorney should approach their work?

The office will be facing significant budget cuts. It is imperative that we focus on hiring and retaining attorneys who can ethically prosecute violent offenders who are a threat to the community. Since I left the office in 2017 over 20 experienced attorneys have followed, leaving a dearth of experience. I am the only Democrat running who has the leadership experience to carry the office forward. I have mentored attorneys, run major units, managed support staff, developed prosecution alternatives, implemented training, advanced reform legislation and responded to emergent situations.

I know how to reform the system while promoting prosecutorial excellence.

Both you and your opponent have mentioned an interest in implementing incarceration alternatives. How will you make sure that happens as DA? As a former head of the DA’s Juvenile Unit, I have already created incarceration alternatives. As an example, I developed a program where we offered six weeks of education - without court involvement - for kids caught sexting. Because of our success I helped write successful legislation that removed the felony charge for Colorado’s kids who made a dumb choice with a smartphone.

Similarly, I worked to keep 10-12 year old children out of the schoolto-prison pipeline by offering them Support-Before-Court involvement. I have a proven record of reform.

How will you ensure laws are enforced fairly and equitably?

We must start by acknowledging that inequities exist - that systemic oppression within law enforcement has built barriers that disproportionately impact minorities and the disadvantaged. I will ensure that we recruit and employ prosecutors who reflect the community we serve, and that our prosecutors are not just adequately trained on systemic injustice, but that they seek and consider

the voices of lived experiences in their decision-making. It starts with those decisions, but it is ensured by the transparent and accountable practices and on-going community engagement.

Jake Lilly What makes you the best choice for this office?

I am a former federal, state, and military prosecutor with 17 years of experience Lilly and 136 jury trials. I am the only candidate to have been a sex assault prosecutor, a voter protection attorney for President Obama, a defense attorney, and a combat veteran of the Iraq War. My biggest priorities are getting illegal guns off our streets, treating the mentally ill instead of incarcerating them, and promoting an environment where survivors of domestic violence and sexual assault will be heard and met with belief.

Prosecuting sexual assault cases all the way to trial is the highest of these priorities and will contribute to a changing of societal attitudes towards survivors and their experiences. In protecting survivors of sexual assault and domestic violence, we must enforce our current gun laws, including enforcing our red flag law, to ensure that guns are removed from the hands of offenders.

What must you accomplish for you to consider your term a success?

I firmly believe the job of the D.A. is not just to punish people, but to actively implement policies and work with community partners to lower crime rates. My office will crack down harshly on violent criminals who would prey upon others and lift the voices of victims of sexual assault, domestic violence, and other violent crimes. We will work to prevent crime by providing the necessary mental health, public health, school, and economic resources to prevent a life of crime and work to rehabilitate those within the system who can be saved.

Colorado Legislature approves vaccination bill Senate Bill 163 is intended to boost immunization rates

Lawmakers in the General Assembly have put to bed a two-year fight to boost the state’s last-in-the-nation track record on immunizations.

A final compromise on Senate Bill 163, which formalizes the state’s requirements on immunizations, was hammered out by a legislative conference committee June 13.

The House adopted the amendments, crafted by a conference committee, on a nearunanimous vote, but it didn’t result in any votes from the Republican side, and it passed on a party-line 41-24 vote. The Senate June 13 also adopted the report and re-passed the bill on a 20-13 vote.

“This is an important time to improve our immunization rates,” said Democratic Sen. Julie Gonzales of Denver, who sponsored the bill along with Republican Sen. Kevin Priola of Henderson.

Senate Bill 163 is intended to boost Colorado’s immunization rates. It continues to allow exemptions based on religious beliefs, medical reasons or personal beliefs.

It does, however, require parents who seek those exemptions for their children to either obtain a certification of medical exemption from a health care provider, sign a certificate for a non-medical exemption, or show proof they’re completed an online education module offered by

the state department of public health.

The measure also requires schools to publish their immunization rates.

The immunization bill, and another in 2019, have drawn hundreds of anti-vaccination opponents to the Capitol as well as filibusters from House Republicans. Anti-vaccination opponents have incorrectly stated the bill would require their children to be vaccinated in order to attend public schools.

Sen. Owen Hill, a Colorado Springs Republican, in advocating against the bill, said the decision on immunizations should rest with parents.

“It is our job ... to tell parents, what’s the best way to protect the health of their children, and nobody cares about the health of children more than their parents.”

This bill takes an approach that the state knows best, Hill said.

Priola told the Senate the bill “gives the power to the parent to make the decision to opt-out” or follow through with educators and schools so that other children have an opportunity to be educated in a safe manner.

As amended by the conference committee, the bill gives broad latitude to home-schooled students, including those who attend private schools part-time.

Those students who would be exempted from the bill unless the private school requires those immunizations.

As a nod to opponents, House Democrats added an amendment allowing a petition clause that could put the issue in front of voters

in 2022. But the conference committee took the petition clause out.

The votes sent the bill to the desk of Gov. Jared Polis, who at press time was expected to sign it.

According to the Centers for Disease Control and Prevention, the nationwide average of kindergartners who received their measles, mumps and rubella vaccines for the 2018-19 school year was 94.2%.

Colorado’s rate was 87.4%, the worst in the nation. The percentage of students who have received the diphtheria, tetanus, and whooping cough vaccine, nationwide is 94.6%; Colorado, at 90.3%, puts the state 49th out of 50.

SB 163 sets a goal of 95% for the measles vaccine.

Colorado last had a measles outbreak last December. It’s not only a public health concern; it’s also a expensive one: the CDC reported in 2017 the public health cost to contain two unrelated cases in 2016 was more than $68,000.

Jeffco Schools budget crisis pushed off to next year State finance decisions, government aid will help district avoid drastic 2020-2021 cuts

Jeffco Public Schools is no longer expecting the tens of millions in budget cuts it was bracing itself for in 2020-2021, instead anticipating that

government aid can cover a loss of funding, at least for this year.

Throughout the COVID-19 crisis, conversations around Colorado school finance grew increasingly unfavorable for district budgets. The trend culminated in news that Jeffco should prepare for a roughly $74.3 million decrease in state funding, district chief financial officer Kathleen Askelson told the board of education on May 13.

But on June 4, the state’s School Finance Act was introduced in the House with reductions far below forecasters’ worst fears. Jeffco is now expecting state funding cuts of only

about $35 million, or $31.5 million after a portion of the cuts is absorbed by charter schools.

As of June 10, the act still had several steps to go before final approval but “the information that we’re getting is it’s unlikely these numbers will change,” Askelson told the board at a June 10 study session.

In the meantime, smaller adjustments have also impacted the budget, leaving the district short an expected $38.7 million, with similar shortfalls likely in the years to come.

This year, however, the shortfall can be offset by government aid funding related to the coronavirus.

The district plans to use $36.5 million in aid to offset the deficit, leaving only $2.2 million of the shortfall to be covered. This could be funded through the district’s reserve fund, Askelson said, but it is likely that further grants will come through and cover the costs without the district needing to dip into its reserves.

However, Askelson highlighted that the numbers aren’t final yet. There’s uncertainty around several items, including whether there could be unexpected costs associated with starting school back up under new health regulations.

She and board members also highlighted that there is no guarantee that school districts will receive federal or state aid next year. If not, budget cuts would need to compensate for future deficits.

“This really is kicking our cuts down the road next year,” board member Brad Rupert said. “That is coming on our horizon and so that needs to inform our conversations.”

With these two caveats, the board spent a little time discussing budgeting priorities. A list of priorities was provided to the board by the district’s Community Budget Advisory Committee, which unanimously determined that a cut to central departments would be most preferable, followed by a cut to capital improvement transfer and then a cut to individual school budgets.

If cuts to teacher compensation were necessary, the committee said it would prefer furlough days to other modes of compensation reduction.

Board members agreed with many of these asks but a few board members questioned the idea of reducing capital transfer.

The transfer is “designed to maintain the condition of our buildings,” board member Ron Mitchell said, so “when we get into cutting the capital transfer, I understand their recommendation but I would say we have to do that very cautiously.”

Rupert and board president Susan Harmon agreed, saying in their experience, cuts to capital transfer are rarely restored when better economic times roll around.

The board was scheduled to adopt the budget at a special meeting June 17.

Less is more for changes to my quarantine routine ALCHEMY

I

have gray hair. There, I admit it. I didn’t always … in fact, I’ve not admitted it because every four weeks for the last 20 years or so, my hair miraculously returned to its (mostly) original shade. Now, however, after more missing more than three months of this miracle’s magic, the mirror tells me otherwise.

And I’m okay with that. Both my parents were gray early … my mother’s hair was a snowy white that I eventually hope for myself, and story in the mirror isn’t all that bad.

Seems appropriate for a 60-something. So, for the moment (until my stylist and I can confer),

it’s less color and more natural.

Which got me thinking – lots of us share what we’re doing and not doing, particularly when observing stay-at-home and safer-at home directives, and it occurred to me that I haven’t added much … unless I also took something away. And I haven’t really taken anything away unless I have something to replace it. For example – LESS: My beloved cookbooks, with their oil-spattered pages, hand-scribbles, and curling sticky notes. I much prefer the heft of books scattered around me as I happily select a perfect meal and note the recommended

ingredients (recipes, like most speed limits, are merely suggestions to me).

MORE: Downloaded recipes from the Internet. I turn to online sites now because I can search for a recipe that includes, literally, the exact two – or three, or even four – fixings I already have on hand … three different kinds of cheese, for example, a refrigerated crust, canned mushrooms, eggs (finally!), and brown-and-serve sausages from the freezer.

LETTERS TO THE EDITOR Shame for lack of coverage Shame on you, Arvada Press, shame on you Colorado Community Media! There is literally no mention of Black Lives Matter in your June 4 paper. The biggest social protest movement in 50 years is rocking our nation, and according to you, the most important news of the week is that restaurants are open. Really? You call yourselves journalists? Yes you ran an article about a black man’s experience, but it was on page 11. While it was a good read and I salute Gregory L. Moore for sharing his story, running an op-ed autobiographical piece in no way makes up for failing to cover, or even mention, the Black Lives Matter movement, or the protests that have been rocking our state, our nation, and our world. Shame on you. Black people live in Arvada. Black people are my neighbors. My children have black friends at Arvada schools. The only reason Arvada City Hall hasn’t had angry crowds amassing in front, lifting our signs and marching, is because Denver is so close.

Arvada residents care about black people. And your failure to cover the struggle for racial justice is both a failure of journalism, and more importantly, a moral failure. As the protest signs say, silence is violence and by failing to print news of the movement, you actively

participate in the racist system that has oppressed people of color for so long.

Opportunity within all this deep disruption

ohn Adams once said that every problem is an opportunity in disguise. I think he might have said that shortly after discovering that grapes don’t grow so well in the northHITTING east, and thus, we have that problem to thank for HOME a line of beers bearing his family’s name.

Is it possible that we are missing out on a huge opportunity of our own right now?

The problem at hand is, of course, the coronavirus pandemic. I know, I know, there are a lot of other things rather starkMichael Alcorn ly in the news these days dominating our attention.

But, in reality, the problem that effects more of us at this moment is the pandemic. And not because we’re sick, and not because we’ve lost loved ones, though that can’t be said for everyone, sadly.

And not just because the billionaires in charge of Major League Baseball can’t get their act together long enough to make a deal with the millionaires who play for them to get a stinking season underway!

But that’s a rant for another day.

No, the pandemic is effecting us because it has literally changed our lives. Baseball, for one thing. Schools talking about a variety of crazy scenarios to re-open in the Fall. Sporting events with no crowds; no youth sporting events. Our major entertainments not in production at all.

More people working from home than ever before, emptying office buildings.

And nobody taking vacations.

These are problems. All of the things that give structure, in whatever way,

to our civic life had been ripped from our lives overnight. And if you don’t think that had something to do with the size and virulence of the protests and riots over the last three weeks (where, mysteriously, the virus apparently can’t survive), then I don’t think you’ve been paying attention.

But, come to think of it, is that really how we would have designed our civic life to look if we had had the chance design it with intentionality 100 years ago?

I’ve long felt that the American education system is a creature of inertia—it exists on the momentum created for it 125 years ago. If we were to design the system from scratch right now, we would never follow an agrarian calendar; we would never build in an eleven-week break from learning, when memory bleed begins at five weeks; we would never base the entire system around the social advancement model we now use; and, I submit, we would never design anything with the same factory-spec, cookie-cutter outcomes agenda that we’re in the midst of recovering from these days.

Well … Wouldn’t now be a decent time to take a serious look at how we do things and design something smarter? A fourday week, where the fifth day is devoted to teacher training and student enrichment?

That’s only something we’re doing now because we were forced to in March. But, it’s Brilliant! Let’s keep doing it! Online learning—not so great for socio-emotional outcomes, which we all feel are critical for child growth, but it is pretty solid for both development and evaluation of skillsbased outcomes. Can we adopt it into the new environment to make schools more

Remembering my dad this Fathers Day

D

ear Dad, It’s almost Fathers Day and I wondered if you knew after you died of Parkinson’s Disease, that Mom finished your book Bail Out? It has a photo on the cover of you with your Mary McFerren squadron.

Stobie It is a terrific book!

You talk in the book about your experience as a navigator for a B-24 called the Fyrtle Myrtle. It was World War II in the South Pacific and evidently many men on your crew had pregnant wives.

On a bombing mission, your pilot, John Farrington, nicknamed “Mother” stayed in formation even though the hotshot pilot in your group hung around the target of nickel mines after the bombs were dropped.

You wanted to “get the hell out of there” before the “Japs” would attack, but “Mother” held formation for the hotshot pilot. It cost “Mother” his life and nearly yours when the Zeros buzzed in like hornets. Fyrtle Myrtle was shot down by the Japanese Zeros.

Pilot John Farrington and half your crew were killed instantly and the survivors had to bail out with parachutes.

Here I will insert Mom’s introduction in your book, Bail Out. “When that motorcycle pulled up in our gravel driveway, I felt a terrible apprehension it was bringing something I wouldn’t like. When the dogs barked, I had only a few seconds left in my happy world before being plunged into unmitigated grief. The messenger handed me a Western Union envelope and roared off into the night.

MISSING IN ACTION! Her world fell apart. She said you were very resourceful, very smart.

“I always told Bill he was the smartest man in the world. I was convinced that if he hadn’t been killed outright he would have been in one of those 5 or 6 parachutes reported by the military.”

Dad, your stories about prison camp are etched in my mind, such as the Japanese guard whispering to you, “My wife is in Los Angeles do you

think she’s OK?” (probably referring to internment of Japanese Americans during WWII in prison camps.) You made friends with everybody, didn’t you?

Mom didn’t know if you were dead or alive for 23 months. How stressful that must have been with baby Bill growing up never having met you.

Late on the afternoon of September 8, l945, Mom was preparing dinner with Marion Minger, a visitor, and they were startled by a racket out front. Pat Guilland, mom’s contact (because my mother didn’t have a phone) screamed, “Bill’s in Manila, he’s in Manila!”

Mom stared in disbelief. “Is it really true?” She cried.

Dad, you were close to death, weighing only 100 pounds. The Japanese moved you to another camp for those about to die, Ofuna. But with your friendly nature, you even got along with British jewel thieves. They crawled up and down ducts and brought you crab and sugar which saved your life.

A Japanese official hit you so hard with a baseball bat in your back it damaged your kidneys. After the war you forgave the Japanese. “Their people were suffering too,” you said.

Then after the war when we moved from San Francisco, California to Golden, Colorado you met Bill Hosokawa, Denver Post Editor, who wrote Nisei about the Japanese Americans who were interned in the United States. You two Bills became friends.

Your forgiveness of the Japanese impressed me.

Dad, you could have given up on life and died in prison camp like so many others. But you came back to Mom and your toddler son, Bill. Then in a brilliant move, you became a father to a daughter, me!!

Happy Father’s Day, I miss you.

Yeah, we have problems. BOY do we have problems. But if that’s all we see, then maybe we’re missing the chance to fix things.

And, beyond schools, wouldn’t we rather find a way to divert some of our entertainment dollars away from petulant celebrities who, it turns out, we can live without, and, instead, pay nurses and paramedics and (whispers in fear) police what they deserve?

And as to the intersection of the moment and the education system: if we could do it all over again, would we ever create the linkage between school funding and property values?

television, especially news. I am bombarded by the news from every direction, daily, so I have broken my long-standing routine of taking in the evening broadcasts.

MORE: Movies, concert videos, documentaries. We don’t subscribe to most of the streaming services, but we’ve had success accessing some of what we enjoy with my laptop and a large monitor. We recommend “The History of the Eagles,” Parts 1 and 2.

LESS: Jeopardy! My favorite quiz show – and source of new knowledge – is a victim of my TV news boycott, because it occurs during the same before-prime-time dinner hour. I do have 37-and-counting episodes to enjoy before my DVR is full, though, so maybe I’ll be shouting answers/ questions from my living room chair again soon.

MORE: Gin Rummy. I grew up play-

ing cards with my family, although we would drive Dad to distraction with my mom’s “Romanian rules.”

Family game nights – when we have them again – always include cards.

With the TV off, and in my current situation of only two players at home, Gin is the game of choice. If you know of other one-on-one card games, please drop me a line.

MORE: Sunscreen. It’s summer in Colorado … ’nuff said.

I also find that, instead of commercial radio, I turn to my own curated playlist. Instead of my slow-cooker, I relish using my years-long collection chef-grade pots and pans. Instead of a travel mug and a rushed goodbye in the morning, we enjoy coffee together on the patio.

It’s been said before, and I’m saying it again now with my most hearty appreciation: less really is more.

Ethel Arlene Parker Ethel Arlene Parker, nee McGarry, passed away in her sleep on April 1, 2020. Ethel was born November 22, 1922 to Fred Ivan and Florence Mae McGarry (nee Ousley) in Wadena, MN. She was a graduate of Wadena High School in 1940 and went on to attend junior college. Ethel went on to marry Karl Parker June 28, 1947 and they had three daughters. In the mid -1950s, the family moved to Arvada, Colorado where Ethel volunteered at her daughters’ schools, eventually working for Jefferson County School District until she retired in the early 1980s. During her retirement, Ethel was an active member of her local PEO chapter, a Marshal for the US Women’s Open, active in her HOA at Forest Springs, and an active member of Rolling Hills Country Club where she

enjoyed many golf games and bridge tournaments.

Ethel was preceded in death by her parents, her husband, and her sister Olive. She is survived by her 3 daughters; Karla (Jim) Flora of North Carolina, Debra (Don) Schartz of Colorado, Diane (Daryl) Hise of Colorado, 4 grandchildren; Lindsay (Wes) Barry of North Carolina, Janet (Chris) Finan of Nebraska, Matthew (Lindsey) Schartz of Colorado, and Katelin (Mike) Roering of Minnesota. She was also blessed with 7 great-grandchildren. Olinger Crown Hill Mortuary of Wheat Ridge, CO is handling arrangements; however, at this time, a memorial is postponed. arrests and in custody. I’ve had the chance to watch our officers interact with people who are intoxicated or belligerent and their patience and professionalism is amazing. We have the best police force in the metro area and we can be proud of the men and women of the Arvada Police Department. Thank you, Arvada PD! Susan Doak, Arvada A problem for poor downtown areas Now I’m a 67-year old white guy that grew up in Colorado during the 60’s and 70’s so I’ve seen a number of these big city race riots over the years. I am sick and tired of being called a racist by a bunch of downtown BLM members and young, white apologists. I have traveled all over these United States and have met any number of black and brown folks working in various industries that work alongside white folks with no problems. They go to lunch together, barbecue together, tell jokes together and all around get along fine. In my experience, racism, while it does exist but not to the extent portrayed, originates in poor, downtown areas and is being completely overhyped for political purposes. Nothing good paying jobs won’t cure like was happening before Covid hit us. I, like most people I know (black and white), divide the people that we meet in this world into two categories, 1) Good people that you would like to go to lunch with and, 2) Jerks that you don’t want anything to do with. My question to those BLM members and to those white apologists is, which are you?

Steve Schurman, Arvada Scary stuff As a young man, I worked in a machine shop in Detroit, where the union rule on the shop floor was, “Right or wrong, we got to stick together.” Solidarity about all else.

It seems police unions follow the same dictate.

Witness recent events in Buffalo, NY. A film shows two cops on an Emergency Response Team (ERT) shoving a 75-year old peaceful protester to the ground. The man falls

backwards, cracks his head on the sidewalk, and lays motionless with blood oozing from his ear as lines of ERT head crackers march by him to tangle with other peaceful protesters. Then the police lied about the incident, claiming the old guy tripped and fell. Eventually, the two cops were suspended and charged with assault.

In support of the two offenders, all 57 cops on the ERT resigned from the team, demonstrating that above all else, some cops will place protecting their own above protecting citizens.

Right or wrong, they’ll stick together.

Rather scary, isn’t it?

Now Donald Trump is peddling the baseless suggestion that the old guy was a member of Antifa, a “terrorist” group in Trump world, which excuses the “bad apple” cops. Our “law and order” president apparently believes the law only applies to protesters, “thugs” in his book, not the police.

Even scarier, isn’t it? It is to this old man.

Peter F Munger, Arvada A student’s point of view The rising challenges of Covid-19 are affecting lives around the world, to this day many uncertainties and unique challenges are still to come…

From a student’s point of view, I can vouch that many normalities have become foreign and abnormal.

For example, the simplest action of brushing my teeth every morning has become irregular and hard to complete on a normal time schedule.

Throughout this time I have developed many questions and received differing answers. I have learned that everyone in this world is going through similar experiences, but also very different things. We are not alone in this pandemic; we are united by the same situation, fears, doubts, questions, and hopes of an ordinary future once more. To fill my time, I am constantly looking for ways that I can ensure my long days will be as close to ordinary as possible. This consists of spontaneous hikes around nearby bodies of water, hoping to get as close as possible to the sensational rush of finishing a daily workout with my swim team; or throwing the softball around with my dad to feel like I am still apart of a determined team that has a driving goal to improve after every summer softball game. That being said, each day is a different challenge for almost

everyone you meet, during these unpredictable times I have learned that it is most important to resemble hope for yourself and others, but also to remain humble and kind even in the darkest of times.

Spencer Blosser (incoming freshman at Arvada West HS), Arvada Lilly for DA I wanted to write about a democratic candidate whose story resonated with me recently. Jake Lilly is running for District Attorney, and I think he’s the person for the job.

These days, all too often, I’m disappointed by civic leaders everywhere I look in the U.S. I’m tired of being let down, and instead, I want to be encouraged I agree with Jake’s policies. He’s a proponent of Red Flag Laws, reform to treat mental health/drug addiction, and equal pay for equal work. He also has tons of endorsements (Phil Weiser and Joe Neguse, 60+), a long trial career (focused on domestic violence) and supports ending the death penalty.

I’m reading his bio and see that after graduating from Cornell Law, Jake goes straight into the Army. With all the opportunity of an ivy league education and a law degree, joining the Army would be about the last thing on my mind. But off Jake went to fight in Iraq! He volunteered to lead teams that liberated death camps. He was a prosecutor in JAG. He didn’t do what would make him rich or powerful. He did what he thought was right.

I don’t see that enough in our leaders.

Right now, attention is being divided in a lot of directions, and I want a District Attorney who’s going to focus on Jeffco. Someone who stands up for what they believe in and knows the issues that need fixing in Jeffco.

Jake Lilly does that. I believe Jake has what it takes.

Cottrell, Jefferson County King for DA As a career prosecutor (Senior Deputy DA for Boulder County), and someone who spent the vast majority of his career in the Jefferson County District Attorney’s Office, I heartily recommend Alexis King as Jeffco’s next District Attorney. I had the pleasure of working with Alexis for nearly a decade. She knows what it takes to be a DA – the right combi-

nation of compassion, intellect, and toughness.

I encourage my fellow Jefferson County residents to review the experience and principles of the candidates.

I am confident that they will see Alexis is the right choice in this race.

Alexis has dedicated her career to Colorado — as a deputy district attorney, a magistrate, and as a lawyer and advocate for victims. She is in this race for the right reasons – to protect our community, to preserve the rights of citizens, and to lead an office filled with experience and integrity.

Whether it is as leader in juvenile justice reform, working to eliminate human trafficking, or fighting for all victims, she works tirelessly to do the right thing. Christian Gardner-Wood, Arvada What’s “conservative” about science denial Although I am progressive, I have reason to respect opinions of Republicans like Dwight Eisenhower, Nelson Rockefeller, Barry Goldwater, Ronald Reagan, and John McCain. Richard Nixon, despite his faults, created the Environmental Protection Agency by executive order. Reasoned discourse between opposing views on what is best for our country is required for our democracy to work. But I fail to understand what is “conservative” about science denial. Then there is voter suppression, which is occurring in Georgia and other states under Republican administration. Under the guise of the straw man “voter fraud,” Republicans oppose voting by mail (fraud must be rife in Colorado, because we have voted by mail for years) because they believe that universal voting is bad for their party.

Perhaps that is true. But if the most sacred hallmark of our democracy, voting, is bad for a political party, instead of disenfranchising voters, its members should work hard to reform its objectionable policies, like science denial.

Communities get creative with Independence Day events amid pandemic

ndependence Day is still on the calendar for July 4 -- but this year’s holiday marking the nation’s birth won’t look like past celebrations.

Many of the usual community Independence Day celebrations have been canceled across the Denver metro area due to the state’s public health orders banning large gatherings of 10 or more, among various ongoing precautions to prevent the spread of COVID-19.

For that matter, communities have canceled most large events scheduled through the end of summer.

Some remain hopeful late-summer events will return by August.

But that doesn’t mean that Independence Day will fizzle this year.

Here’s what to expect on the Fourth in several of the area’s communities, with plans subject to change on short notice.

Northglenn: Cool Car Cruise While the bulk of Northglenn’s July 4 celebrations will be virtual – from

Mayor Meredith Leighty’s 8 a.m. flag raising ceremony on the city’s Facebook page to the virtual bike, tricycle and wheelchair parade leading up to the holiday – the city will continue making classic automobiles a big part of the day.

Northglenn Police and the North Metro Fire Rescue will lead a phalanx of antique and classic autos on a winding tour of the city, with visits to each of Northglenn’s four wards, beginning at 10 a.m. The route will be listed on the web at www. northglenn,org/july4th.

For the bike, tricycle and wheelchair parade, residents are asked to decorate their wheeled conveyances and take picture or videos riding around their neighborhood and then send them to the city.

They’ll be posted to web on the holiday.

Arvada: Porch Fest The City of Arvada is working with the National Porch Placemaking campaign, an effort encouraging people to decorate the fronts of their houses during the COVID-19 pandemic.

The city is asking residents to adorn their front porches and driveways with patriotic decorations.

Residents can compete in an online competition using the hashtag #ArvadaPorchFest on social media or by emailing neighborhoods@arvada.

org. The winner will be awarded a prize.

Golden: Virtual festival Golden lost this year’s edition of its beloved, longstanding Buffalo Bill Days due to the COVID-19 pandemic, but the Golden Lions Club is determined to hold its annual Fourth of July Festival — albeit virtually.

The Golden Lions announced via Facebook it will be holding a Facebook Live event to give residents a show from the comfort of their homes.

The virtual Fourth of July Festival will begin at 9 a.m. Lions Club members will talk about projects they’ve done in the community over the years. Live bands will play and those tuning in can participate in virtual contests.

Local participating restaurants will be serving special dishes and Lions Club members will be at those restaurants handing out items for kids. The all-day affair ends with a recorded firework show from a previous year.

Lakewood: Porch Fest The city canceled its annual Fourth of July parade, which marches down Lake Avenue and culminates in a day-long party at Lakewood Park. But Lakewood is SEE FOURTH, P17

very city’s music scene is made up of extremely talented musicians that don’t make it big for a variety of reasons. But that certainly doesn’t mean their art isn’t worth celebrating and preserving.

That’s the goal of Denver Jamgrass, a 501(c)(3) arts and culture group that provides low-to-no-cost promotion for Colorado bands. And it’s made a new effort in that aim with June 26 release of its first annual Stone Soup compilation album.

The release features COMING like ATTRACTIONS musicians Meadow Mountain, Thunder and Rain, and That Damn Sasquatch.

“We have such an amazing folk and acoustic scene here in Colorado, and we wanted to archive and preserve the music for contemClarke Reader porary and future consumption,” explained Max Paley, Denver Jamgrass executive director and album producer. “We gave groups an hour in the studio and received some enthusiastic responses. So, we were able to get pieces from some of our favorite bands.”

The album was recorded at Swallow Hill Music in South Denver, and Paley said the hope is this will become an annual project, allowing Jamgrass the opportunity to share new talent every year.

As Paley explains it, Jamgrass was founded by Kirk Hubbard in 2014 out a fandom of musicians like the Grateful Dead. The organization started out recording shows at Cervantes and sharing information about upcoming performances on its Facebook page.

Eventually their efforts grew to include a podcast that features local bands, and is now up to about 23 episodes. Most recently Jamgrass started an assistance fund for musicians who have lost income due to the COVID-19 shutdown.

“The thing that most surprises people about the scene here in Colorado is the variety and diversity of musical styles, which really came through on the album,” Paley said.

“The album really shows all the Jamgrass is, which is not one particular genre or style.”

According to information provided

by Paley, the name Stone Soup was suggested by Jamgrass founder Kirk Hubbard after “a folk story that emphasizes community and encourages all parties to share a little of what they have for the betterment of the group as a whole.”

In a Facebook post, event organizers encourage residents to do nice things for each other and dress up in their favorite patriotic outfit. Residents can enter in the contest by using the hashtag #LakewoodTogether for a chance to win a virtual medal and be featured on the city’s social media platforms on July 4. Those feeling especially patriotic should dress up, the city says.

Highlands Ranch: Virtual 5K The annual Highlands Ranch Community Association Independence Day 5K has gone virtual.

The HRCA canceled the 5K for in-person running due to COVID-19, but currently registered participants have the option to be credited.

Those interested in participating in the virtual race can sign up through the HRCA website. Once signed up, participants can print out their race bib and run the race whenever they want, within a twoweek window of the July 4 race.

Runners can choose to run on a treadmill, outdoors, on a trail or in a circle around their house. Participants are asked to take photos and use the hashtag #HRCA4TH on social media or @HRraceseries on

According to a June 8 post on the town Facebook page, Castle Rock still plans to stage a fireworks show on July 4 at about 9:30 p.m., weather permitting.

The town website says the fireworks will be launched from Santa Fe Quarry Mesa, located south of The Meadows, above Red Hawk Ridge Golf Course.

“This year, we recommend viewing the fireworks from your home or neighborhood if possible,” the website says. Full details are at crgov.com/fireworks.

That makes Castke Rock an outlier in the metro area.

According to a list compiled by KUSA-9News and updated June 11, these area communities have canceled their usual July 4 fireworks shows: Arvada, Aurora, Boulder, Broomfield, Denver, Englewood, Greenwood Village, Highlands Ranch, Lafayette, Lakewood, Littleton, Lone Tree, Louisville, Northglenn, Parker, Thornton, Westminster.

Streaming style - ‘The Death of Stalin’ Many of our politicians these days are doing a laughably poor job are providing much in the way of leadership during these extraordinary times.

Instead, it’s all power-jockeying and influence collecting. Which makes Armando Iannucci’s (creator of the bitingly funny television shows “The Thick of It, “ and “VEEP”) darkly hilarious “The Death of Stalin” the perfect comedy for these days.

The film takes audiences to Moscow 1953, where the infamous dictator has just died. Everyone in the government’s upper echelons, and Stalin’s own family, are fighting to take his place. What ensues is utterly funny, but not so much so that it lessens the sting of the connections to modern times. Thanks to a bulletproof cast, you feel every comic punch.

The film is available for streaming on Netflix.

Colorado Ballet Academy’s summer classes go virtual STAFF REPORT

The typical summer programs offered at Denver’s Raydean Acevedo Colorado Ballet Academy will take place virtually this year, according to a news release.

Academy staff reduced tuition, modified programs to ensure an optimal virtual experience and opened the

Summer Intensive program to give dancers across the nation the opportunity to train, regardless of their original audition status, the release said.

To elevate this summer’s virtual Summer Intensive, Colorado Ballet’s artistic leaders, including artistic director Gil Boggs and ballet mistresses Sandra

Brown and Maria Mosina, will teach alongside John Gardner, Amanda McKerrow and Colorado Ballet staff to provide a special training experience for all students.

Young Dancer Workshop students can take levelspecific classes in ballet technique, pre-pointe, creative choreography, jazz and conditioning for dancers.

Surprise guests will make appearances for career talks and interactive virtual conversations.

“Everyone at CBA has worked very hard to ensure our students have a joyful and uplifting virtual experience with us,” Colorado Ballet Academy Director Erica Fischbach said in the news release. “We are dedicated to

Take note: Coronavirus prompts changes to retirement taxes

J

ust before the pandemic hit this country, I published an article here about the newest retirement tax laws (called the SECURE Act), and I warned that tax law is written in pencil.

In other words, keep yourself updated, but expect that the laws GUEST will change.

COLUMN I can’t say I foresaw the speed in Fran Coet which those changes would occur.

That’s what a pandemic can do.

The SECURE Act lifted the age for Required Minimum Distributions (RMDs) from 70½ to 72. It allowed you, in some cases, to continue making IRA contributions beyond age 70 and inhibited the ability to “stretch” distributions from inherited retirement plans.

Now Congress has pulled out a blue-lead pencil with a great big eraser and included MORE tax changes to retirement accounts in the CARES Act, signed into law in March.

A cyclone instead of a rainy day As a CPA and Certified Financial Planner Practitioner, I encourage my clients to take advantage of tax deferrals whenever possible, and I advise clients to maximize their contributions into retirement vehicles - IRAs, SEPs, SIMPLES, 401(k)s.

“Make a commitment to save as much as possible,” I counsel my clients, “and take advantage of the tax

laws to your benefit. I know tax rates may go up in the future, but they are plenty high enough TODAY, and we’ll deal with the distributions when they are required.”

It’s called saving for a rainy day with the government’s assistance, right? It seems financially that “rainy day” has reached cyclone proportions in the form of a virus.

In some cases, it has lifted us off our financial foundations. Many of us are unemployed. Several of us have temporarily shuttered or — worse permanently closed our businesses. The problems compounded for many people when they took their required minimum distributions based on high investment values as of Dec. 31 and then watched their retirement portfolios deflate by 20- and 30 percent.

Tax-defered borrowing The CARES Act addresses many of these concerns with modifications to rules governing retirement plans. The IRS does a good job of updating this kind of information on the IRS.gov website, so check it out if you want to conduct more research. But here’s a recap: Minimum distributions from retirement plans are not required for 2020. If you have received your RMD in 2020, you have 60 days from the date of the distribution to “rollover” the funds, hoping they will

grow tax-deferred for an additional year.

The IRS will waive the normal 10% penalty for a distribution out of a retirement plan or IRA during 2020 if you are a qualified individual (basically, one impacted by the pandemic) on distributions up to $100,000.

AND you have three years to PUT THE MONEY BACK into the retirement plan — without tax consequences!

You may include the distribution as income on a pro rata basis over three years. For example, if you took a distribution of $90,000 as a qualified individual, you could elect to include $30,000 as income in 2020, and again for 2021 and 2022. If you replace all $90,000 in 2022 and you had included $30,000 in 2020 and $30,000 in 2021, you can amend to recoup the tax.

These provisions offer many opportunities for planning and accessing cash which would otherwise be very costly. However, before you withdraw a large chunk of your retirement funds, think about how long it took you to build the account to begin with.

Never access more than you need. After this financial storm passes - and it will - there will be clean-up, triage, and opportunities. Better days are in front of us.
