County rejects private helipad in valley

On Nov. 7, the Santa Barbara County Planning Commission denied Pat Nesbitt’s application for two helistops on his property in Carpinteria Valley near the Polo Fields. If Nesbitt appeals, his application will be reviewed by the County Board of Supervisors.

HELP of Carpinteria named top recipient of this year’s Lions Festival of Trees

The Carpinteria Lions Club has announced that proceeds from the annual Festival of Trees fundraiser will benefit four area organizations. HELP of Carpinteria will receive $25,000 towards the purchase of a new vehicle. Carpinteria Middle School Robotics can look forward to a $12,000 donation (Lions will give $6,000 and $6,000 will be matched by CEF) to launch the Robotics Media Technology program. Canalino and Carpinteria Family schools will receive $5,000 ($2,500 from Lions and $2,500 from CEF) to build and maintain their new Teaching/Learning Garden. And, to fund their safe and sober events at Zodo’s after the prom, Parents of Carpinteria High School will receive $3,000 ($1,500 from Lions and $1,500 in matching funds from CEF).

“We want to keep the money in the community as best we can,” said Lion Mike Dawson who co-organizes the festival. “From Summerland to Carpinteria and all the people in between—helping Carpinterians is our number-one goal.”

Last year’s Festival of Trees raised over $30,000 for six Carpinteria organizations.

This year, the Lions have set their goal at $35,000.

Volksmarch is coming

Find your walking shoes and get ready for the sixth annual Carpinterian Volksmarch scheduled for Sunday, Nov. 24, at 1 p.m. to benefit the Santa Barbara FoodBank. Feet hit the streets in one of the most organized pub crawls in Carpinteria, a not-so-arduous journey clocking in around 2.3 miles in a circuit from Island Brewing Company to Rincon Brewery to the BrewLab and the Apiary and back.

The idea is simple: embrace the old German tradition for the Volksmarch, or “people walk,” and hike for fitness and fun while supporting a worthwhile cause.

This year the entry fee will be two canned items to be donated to the FoodBank.

Volksmarchers will have a “passport” to be stamped at each stop along the way. On successfully returning to Island Brewing Company, the first 100 participants will be granted a medal commemorating their efforts. Rick Reeves will serenade Volksmachers at IBC from 2:30 to 4:30 p.m.

Dine Out for Carp Kids spotlights Padaro Beach Grill

On Wednesday, Nov. 20, seven local restaurants will donate a portion of sales to the nonprofit Carpinteria Education Foundation’s Dine Out for Carp Kids. Participating eateries are Padaro Beach Grill, Jersey Mike’s, Corktree Cellars, Jack’s Bistro, Peebee & Jay’s, Rori’s Artisanal Creamery, Uncle Chen and Yo Yum Yum. Among these generous eateries is the local family restaurant, Padaro Beach Grill, where the most popular item on the kids menu is a tie between the kid’s burger and the chicken nuggets, reported William Ransone, owner of the popular establishment.

The children also seem to love the gummy burgers, which come with each kid’s meal.

“My advice to parents is to bring your kids to Padaro Beach Grill for lunch, after school, or dinner and let them play outdoors while enjoying a meal out,” said Ransone.

Padaro Beach Grill has been involved with Dine Out for Carp Kids for several years. “We are excited to participate in a local program, and to help contribute to the educational success of kids in the Carpinteria community,” summed up Ransome.

“Our inspiration is always to help people in the community when we can, especially children. Eat, drink and be merry!”

Ventura earthquakes rattle Carpinteria

Danielle Bordenave was sleeping in her Beach Neighborhood home on Friday morning, Nov. 8, when the base of her bed started rattling. A little while later she was getting ready for work and felt the whole house shake. “Oh yeah, that’s a real earthquake,” she thought.

Five kilometers off downtown Ventura’s coast, three earthquakes occurred with magnitudes ranging from 3.2 to 3.6, shaking residents in the wee hours on Friday morning (one at 4:10 a.m.). These end-of-the-week quakes, 65 in total, were part of a cluster of small earthquakes over a 48-hour period, called a swarm, originating in Ventura.

While an earthquake of any intensity may rattle nerves, a swarm is not an indication that “the Big One” is coming. But, a cluster of small earthquakes isn’t unusual, according to the VC Star who spoke with John Bellini, a geophysicist with the U.S. Geological Survey’s National Earthquake Information Center. “There is usually a lot of after and before or post shakes,” Bellini told the Star, “There is no way to say that something bigger is going to happen.”

Elizabeth Warren is an intelligent person. She released her “how I will pay for everything” plans as U.S. President. I find it difficult to comprehend why she thinks her socialist plans make an ounce of financial (or common) sense. In limited writing space, it’s impossible to elaborate much, but I encourage readers to do their own research. You have every right to disagree with me.

Medicare for all: We need to realize that Medicare doesn’t cover everything and supplemental insurance, offered by the private insurance companies she will eliminate, is a necessity for out-of-hospital expenses. Warren’s plans would cause doctors to leave the profession, medical facilities to downgrade or close entirely, and incredibly long waits for attention at any medical facility for any type of treatment. Warren would also abolish fracking on her first day in office. When it comes to natural gas and oil, the U.S., for the first time in history, is exporting more than it is importing. Do we really want to return to the days when we were dependent on unstable countries in the Middle East for energy? Warren’s Green New Deal ideas represent total disaster for the U.S. economy. I’m sure Russia, China and other less-than-friendly countries would love to see us implement them.

City takes action: E-cigarettes banned, City Bluffs Preserve acquired, Off-leash dog park approved

At its Nov. 12 meeting, City Council voted unanimously to ban the sale and use in public of all flavored tobacco products, all electronic nicotine delivery systems, and all liquids, pods, juices or other products used in electronic nicotine delivery systems. The moratorium, which took effect immediately, was approved despite pleas from retail store owners among the 14 local businesses that would be impacted by the ban. These businesses, according to their testimonies, have significant inventory in the banned products, that by law, they cannot return to manufacturers.

Heather Ballat, whose family owns City Market 15, City Market Center and Kim’s Market, expressed her regrets that the process had not been more sensitive to local business owners who would be financially impacted by an immediate ban with no runway for stores to sell their remaining product. “As a family, we do support this ban,” said Ballat. “As a current nursing student, I’m proud that Carpinteria wants to be at the forefront of preventing this epidemic. But we feel like as a small family business, our concerns have not been adequately considered.

This directly hurts 14 businesses in town, including several family businesses, with a huge financial impact.” Ballat stated that in all, her family’s three stores have $45,000 in inventory, “and we are a small family business.”

The owner of Mi Fiesta Market and Deli, Simon Maida, stated he had $23,000 in inventory. “We need time to sell this inventory,” he said, “By law, we cannot

return tobacco inventory. We need several months to sell this product.”

While Councilman Roy Lee expressed a willingness to push the ban to start on Jan. 1, 2020, allowing local markets time to sell their inventory, ultimately, he, along with the other councilmen, approved the ban, effective immediately.

“We have abundant evidence that we have an urgent problem,” said Councilman Al Clark.

Carpinteria Rincon Bluffs Preserve

City Council took historic action to unanimously approve a purchase agreement for the 21.65-acre Rincon Bluffs Preserve located on the eastern end of Carpinteria Avenue. In 2017, a campaign spearheaded by the Land Trust for Santa Barbara County and supported by the city, county of Santa Barbara and Citizens for the Carpinteria Bluffs raised $7.9 million to purchase the property and endow its long-term maintenance. Over 1,300 community members donated to the purchase.

With funds from three government grants totaling $947,500, the city will now complete the public acquisition by purchasing the property from the Land Trust and maintaining it as natural habitat and passive open space with public access in perpetuity. State funding is furthermore contingent on the city maintaining their stated vision for the property of “public access and habitat resources,” in line with coastal conservancy requirements.

While Councilman Roy Lee expressed a willingness to push the ban to start on Jan. 1, 2020, allowing local markets time to sell their inventory, ultimately, he, along with the other councilmen, approved the ban, effective immediately.

Parks Director Matt Roberts noted that the area was designed, filled and planned for development, potentially a resort, “but I don’t think that’s going to happen now,” he said. “It will be 100 percent undeveloped.”

The property has a $1 million endowment fund to ensure the preserve’s maintenance and enhancement. Additionally, the Land Trust will add $750,000 to the endowment on the condition that the city complete specific improvements to the property within five years. These improvements include a restroom, trails, a parking area and an acknowledgement marker.

“The foresight that this community has shown,” commented scott Van Der Karr, president of the Land Trust for santa Barbara County, “there are few things that bring this community together more than these types of grassroots projects.”

After the historic vote was recorded, Councilman Gregg Carty sighed, “oh, what a feeling.”

City says yes to off-leash dog park

In a unanimous vote, City Council approved revisions to the Carpinteria Municipal Code that will establish regulations for off-leash dog areas, paving the way for the city to designate a space for its first off-leash dog park.

The future dog park might be shared use or fully dedicated, according to Matt Roberts, city director of Parks and Recreation. “We will bring a proposal soon to City Council, but tonight’s action clears a pathway … to establish an off-leash area.”

The type of dog park and what posted rules will be required will be the topic of future public hearings. “The devil will be in the details of each proposal,” said Councilman Al Clark, “but I do welcome these proposals.” Councilman Fred shaw noted that, “Is there a dog park?” is the second most-asked question at the visitor’s kiosk, after “Can you recommend a good restaurant?”

Highway overcrosses see major advances

Construction is progressing at a number of key sites for the Highway 101: Linden and Casitas Pass project. Crews are working on several new drainage improvements as well as the new Via Real connection between Casitas Pass Road and Linden Avenue.

The new northbound Highway 101 on-ramp at Linden Avenue is open. This ramp is longer and provides more space for drivers to reach highway speed prior to merging into the northbound lanes.

The Linden Avenue overcrossing has a number of new components: the bridge structures are complete, along with the majority of the walls attached to the bridge. There is ongoing work on drainage improvements, and crews will build additional retaining walls and a new southbound Highway 101 off-ramp at Linden Avenue. There will be stop signals on either side of the bridge to link into the new southbound off-ramp and the turn into the new roundabout (also under construction).

builder by trade, and as his logo on his work shirts said, Woodworks Unlimited.

His craftsmanship in wood and other arts was truly unlimited. Mark loved cutting and polishing precious stones and rocks and working with his friend Martin to create silver jewelry. He was a successful general contractor and ran his business for over 40 years. He began his career in the San Fernando Valley and Hollywood and in the late 1980s moved to Carpinteria, where he built our wonderful family home.

Mark was happy, kind, courageous and truly genuine, with a giving soul, who cherished doing things for others.

He loved his work and his family and loved his church family as well.

Mark was preceded in death by his brother, Danny, his father, Martin, and his mother, Jeannie Johnson. He is survived by his wife, Jo Dean, and son, Matthew, his sister, Lynn (Ron), niece, Glenna (Maurice), and nephew, Todd (Kita).

Mark and Jo would have been celebrating their 41st anniversary this December.

A Memorial Service will be held at the First Primitive Baptist Church in Santa Paula on Saturday the Nov. 23 at 10:30 a.m.

Amrit Joy 12/18/1943 – 9/7/2019

Weed out the negative, plant the positive. Amrit Joy cultivated a life full of love, grace and beauty—a kaleidoscope of people, nature and art. And she encouraged everyone she encountered to do the same.

On Sept. 7, 2019, Amrit Joy (born Joy Rochelle Gould on Dec. 18, 1943) passed on peacefully at her beloved Carpinteria home. Her spirit and her energy will live on in our hearts, and we will forever be grateful for her presence in our lives.

Amrit leaves behind her sister, Elenor; sons, Scott and James; daughter, Alison; grandchildren, Maddie and Jackson; nieces, Alexa and Jordan; nephew, Erik; and many cousins, friends and of course her beloved golden retriever Peanut Butter.

A writer, teacher and artist, Amrit touched the lives of many far and wide.

And as a mother, grandmother, sister, friend, mentor and soul sister, her impact was deeply personal. If you knew Amrit, she loved you.

She believed holding an attitude of gratitude expands all the good things in life. When we realize how blessed we are, our lives become filled with blessings.

Adrianus “Art” Overgaag 6/3/1934 – 11/5/2019

Art passed away peacefully at his home surrounded by his family and loved ones after a battle with pancreatic cancer.

He was 85.

The son of Leo and Joanna Overgaag of s’Gravenzande, Netherlands, Art grew up surrounded by family: one of 10 brothers and sisters. As a young adult, he worked for his dad in the family’s greenhouses and eventually started his own flower growing business.

Art met his wife, Magda, at a local dance and was married two years later. In 1968, Art decided that he wanted a better life for his family and moved his wife and four children to the United States. Art started his own business in Carpinteria growing flowers. Over the years, Magda and his children stood by his side in his endeavors by working at the nursery and following in his footsteps. Under Art’s fearless leadership and dedicated employees, the company grew and went

beautiful Carpinteria community and her kind neighbors. She loved her morning beach walks with friends that she met over the years. She loved laughing and her garden. She loved writing articles for the Coastal View News and sharing her “Hints for Healthy and Happy Living.”

For as long as she could remember, Amrit had a keen interest in the union of form and shape, look and feel. As an interior and textile designer in New York, every day Amrit used her instinctive abilities to read spaces, notice details, and create harmony. These skills flowed naturally into her becoming a certified yoga instructor in 1976.

The first time Amrit connected with the practice of yoga, she experienced deep peace and serenity. She was hooked.

Out of her lifelong passion, she inspired so many to embrace a yogic lifestyle— whether or not you could successfully tame your “Monkey Mind,” breathe deeply or touch your toes. Not big on formality, she was more of a “come as you are” kind of yogi.

Amrit studied Hatha Yoga with Helene Vreeland and trained with Yogi Bhajan, who’s credited with bringing Kundalini yoga to the U.S. in 1969. She also studied with His Holiness Swami Vidyadhishananda Giri, a globally recognized Himalayan monk of the Vedic tradition.

Once he realized that his legacy was in good hands, he had the idea to purchase a motor home. He purchased a Blue Bird so that he and Magda could travel throughout the United States for several months at a time. They went to rallies, made new friends and took their time to visit beautiful sites.

When at home, he passionately took care of the land whether it was his own, the Lions Park or that of a friend; he was always ready to help. He was very proud to be a member of the Carpinteria Lions Club, serving the community, and he enjoyed raising money for the City of Hope which always had a special place in his heart.

Art is survived by his wife, Magda Overgaag-Vyverberg, his children, Leo (Suzette), Ellen (Cary), Pete (Shelley) and Karin (Sean). Ten grandchildren, Ashley (Nick), Brittney (Quentin), Tony, Chris, Alex, Sam, Jake (Bailee), Robert, Katherine and John. Three great grandchildren, Jenna, Ryan and Mason. We will all miss our Husband, Dad, Opa and Friend. It was a good and wonderful life.

Rosary will be at Our Lady of Mt. Carmel Church on Nov. 15 at 7 p.m. Mass will be on Nov. 16 at noon at Mt. Carmel Church. Celebration of Life will be at the Carpinteria Lions Park starting at 4 p.m.

New foundation in Carpinteria aims to provide youth with entrepreneurial skills

The Pro Deo Foundation will hold a grand opening for their student shop Coastland at 768 Linden Ave. on Friday, Nov. 15, from 5 to 8 p.m. Below is a Q and A with CVN editor Christian Beamish and Coastland leaders Chris Pritchett and Dave Roberts.

CVN: What is Pro Deo’s vision for the youth of Carpinteria, and can you explain the program?

Our vision is that every teenager in Carpinteria would be able to imagine a future for him/herself as a contributing member of society. Our emerging programs for the youth of Carpinteria are designed to provide necessary resources for healthy adolescent development: a place where they are accepted within a safe community, guided by caring mentors to discover their passion, and given real opportunities to develop a sense of purpose.

Our program—called Pathways—is designed to give middle and high school students hands-on experience running micro-businesses in teams through the creation of handmade products made in our program space to sell at Coastland, our adjacent retail shop. Youth who participate are able to earn money from the products their team produces and sells.

Those who participate in Pathways are mentored by skilled makers and business professionals who care about kids and work to help run their businesses successfully. Participants will also have access to services that will help them succeed in life after high school. The launching of this program is taking place in conjunction with the after-school program that we are also running at Carpinteria High School, called CREW. CVN: Do you consider your work to be ministry? Also, are you operating as Coastland?

The Pro Deo Foundation is a Christian operating foundation whose mission is to help create pathways for children and youth to flourish. Historically, our work as a foundation has been among some of the world’s most destitute children, addressing both spiritual and physical needs. Recently, we have expanded our work to serve the common good in our local community.

Coastland is our first local operation.

While Pathways is our ministry program, Coastland, as a store and makers space, is simply the mechanism that will allow our Pathways participants to sell their products, test the marketplace, and learn to run their businesses.

Pathways/Coastland is a Christian ministry in that it aims to be a reflection of God’s heart for the students we serve.

Our mentors and staff operate on the core beliefs that every teenager is a beloved child of God, and is therefore not an accident, and is therefore uniquely gifted with creative potential and purpose, and therefore deserves the opportunity to flourish in a life of joyful service to the world.

We are not a church, though we serve

While we do not proselytize and while we welcome youth from any or no faith background, we aim to display what we believe to be the love of Christ as taught in Jesus’ Sermon on the Mount (Matthew 5-7), and we are delighted to talk about our Christian faith when we are asked.

Put simply, because we believe we are loved by Christ, we love kids. And because we love kids, we want to come alongside to help them in life, especially the ones who need it most.

CVN: You mention the founders in Newport Beach first ran Pro Deo as a foundation funding programs to help people internationally. Have you worked in communities in the U.S. prior to your time in Carpinteria?

While the Pro Deo Foundation historically funded programs overseas, we have expanded into an operating foundation by adding staff who bring extensive experience (over 40 years combined) working with youth and their families in California, Minnesota and Washington state, mostly through church ministry and athletic coaching. In this new work in Carpinteria, we are finding that our previous experience translates well into the work and programs we are doing.

CVN: What brought you to Carpinteria in particular?

Chris and his wife Devon are Westmont alumni (’00 and ’01) who have held a deep love and sense of gratitude for this place for over 20 years. Some of the most influential people who cared for

us during some of our most formative years are here in Carpinteria, Montecito and Santa Barbara. Partly, Chris wanted to give back to a community that helped him a great deal. Beyond that, because of the relationships we have maintained over the years (even from a distance), along with the perceived need of hidden poverty and other issues facing youth in Santa Barbara County, we felt led and drawn here.

Initially, we knew that our work would be somewhere in Santa Barbara County.

Because we live in Carpinteria, we decided to start close to home to see if there were gaps in the services and programs offered to children and youth that we might be able to address. After meeting with local nonprofits, churches and school district employees, we thought that there might be room for a program geared towards middle and high school students.

CVN: You mention that CUSD Superintendent Diana Rigby has turned over the CHS after school program to you, how many children are in the program and will there be activities all year round for them?

Adoption Awareness Month

Our job is loving: One family’s adoption journey

Sissy Ann Tschernoscha and Daniel Olvera live in Carpinteria with their three daughters, Ellie Lou, 9, Izzy Grace, 4, and Coco Rose, 2. You can’t tell by looking at them, but this family’s origin story is deeply entwined in Santa Barbara County’s multifaceted network of resource family support.

“Resource family” is the term California uses to describe families who provide out-of-home care for children in foster care. While Ellie Lou is Sissy and Daniel’s biological daughter, Izzy and Coco are biological siblings who the couple came to parent through foster care and adoption.

Sissy, an artist, and Daniel, a chemist at Avantor (formerly Nusil), met during college. Daniel and Sissy both came from families with fluid definitions of family.

Throughout their childhoods they both remember times when there were grandparents or cousins living with them, or seasons when they went and lived with other family members. They’re also from large families. Between the two, they have 22 aunts and uncles.

About five years into their relationship, still in their 20s, the couple decided that they would play a role in the manysided network of families, organizations and government agencies that help to support children and their families. In 2003, they became volunteer-advocates at Cottage Hospital, and in their church, Family Baptist Church on Foothill Road.

“We had been connected to this for quite some time,” said Sissy recalling that in high school she travelled to Mexico to do volunteer missionary work in orphanages.

By 2009, they were in the final steps towards resource family certification when they became pregnant with Ellie. Five years later, when they were ready, they reentered the resource family certification process. Standard practice is that no child is placed with a family older than the biological child in the household. So, Sissy and Daniel explored Angels Foster Care of Santa Barbara.

Dedicated to working with the county’s foster care system to place infants and toddlers in safe homes, Angels is among few organizations that eliminates home jumping, allowing children to stay with one family from emergency placement through adoption. The couple was certified in 2015, and in October of that year,

“When Izzy came, we thought she’d be with us for a week, but she was coming to us knowing that we’d be available to her forever,” said Sissy.

Because of some “complexities” involved, Izzy’s case was fast-tracked and

by December, the family had begun the adoption process. By June, Sissy and Daniel had adopted Izzy.

“The whole team wanted to complete the story as quickly as possible,” said Sissy, “it was in the best interest of the family and child.”

Two years later, on the Friday before the family left for a trip to Disneyland, Daniel said he’d been thinking about Izzy’s mom. The family prayed for her that night.

“We pray often for their mother. We look in the mirror and I’ll say, ‘look at those beautiful eye’s your momma gave you.’ We try and acknowledge and appreciate their story because as they get older and their story unfolds, they’ll have to learn forgiveness and we want that to be a loving process for them.”

That Sunday, as they unpacked in a hotel near Disney, they received a call that a baby had just been born, and it was fairly certain to be Izzy’s biological sister.

In the morning, they rushed back to Santa Barbara County. “They handed us the baby, they didn’t ask questions, we didn’t ask questions,” said Sissy. “All we knew was there was a baby who needed love.”

California law didn’t allow for Coco to stay with the family though until their recertification was complete. However, a judge allowed for Coco to stay with another Carpinteria family, Dan and Leanne Patterson, who were certified. Sissy and Daniel, along with their daughters, would stay with the patterson family for weeks until their recertification was granted.

“Our family became fostered. We were taken in by another family,” said Sissy, “It was a wonderful experience to be able to lean into another family’s love.”

For Sissy and Daniel, who have now completed the adoption proceedings for

Izzy and Coco, the idea that fostering is rescuing children is a misconception. “We feel like they’re enriching our lives. We feel it’s a gift. Some families are facing cancer; some families are facing mental illness, or generations of trauma… These families need support and it’s a blessing to be a part of that process. My response to the “Facing Ourselves” effort evolved. Having my portrait taken caused me to pause, face my deep sadness about the consequences of immigration policies on American children, and ac-

The Arts Center’s website explained, “The exhibition is intended to spark a conversation about immigrants and the residents who welcome them into a community like ours.” Look at ourselves; face ourselves.

Patricia took my portrait for this exhibition. She took it at the end of the workday, immediately after a Carpinteria Children’s Project board meeting. Time was tight, light was fading, and I hadn’t thought to brush my hair or bring makeup to freshen up the rushed job I’d done before I left home.

But I knew this was about immigrants, not me or my fuzzy hair or worn-off makeup. I turned my thoughts to the immigrants we work with who are now afraid to seek free medical care, or healthy food for their children. Carpinteria High School Sports Boosters Club, a non-profit dedicated to supporting the student athletes of Carpinteria High School, recently hosted their first-ever One Day Mattress Fundraiser. At the November Board Meeting Dennis Echelbarger of Custom Fundraising Solutions presented the Sports Boosters with a check for $6,400. With generous community support, the Boosters continue to support the CHS Athletic Department, and over 550 student athletes participating in 18 sports on 41 teams. The CHS Boosters will hold their next mattress sale fundraiser in October 2020.

Cate School student brings 3-D printer to Howard School

Cate School student and president of the Engineering Club, Brandon Mann, spent the day with a few Howard School middle school students assembling a 3-D printer. The students were able to complete the project in one day with Mann’s help, and had to use their problem-solving skills to modify a piece that wasn’t fitting correctly. Mann said he was “impressed with the Howard student’s collaborative skills and hard work.”

Virginia McCracken returns to Porch

Santa Barbara artist Virginia McCracken will have an exhibit of mixed-media assemblages titled “This Chapter” at Porch, 3823 Santa Claus Lane, from Nov. 2 through Dec. 31, with an artist’s reception on Saturday, Nov. 16, from 3 to 5 p.m. McCracken creates small-scale assemblages inhabited by papier mache figures that are generally related to cats, dogs, rabbits and horses, but not quite, and sometimes not at all.

McCracken’s evocative habitats—some minimal and mysterious—are often crafted like stage sets or rooms. The miniature works have been described as whimsical and touching, humorous, as well as dark. The artist is inspired by make-believe, and the notion of secret interior worlds.

50th Anniversary

Bob and Pat Wingate of Carpinteria celebrated 50 years of marriage at The Ranch House in Ojai. The couple was married on Nov. 8, 1969, at First Baptist Church in Oak View, California, and moved to Carpinteria in 1986. The Wingates have two daughters, Lanell Wingate and Jen Kelly, a son-in-law Shawn Kelly, and a grandson, Elijah Kelly.

“It seemed to go by very fast, but it’s been very good,” said Pat, reflecting on 50 years of marriage. “We have a lot of love in our family and caring for each other.”

For anniversary presents, Pat knitted Bob a pair of wool socks, and Bob wrote Pat a song that he played for her on his guitar.

Making Montecito Safer – Part 2

Vowing to “keep it in the creeks,â€? a new group explores ways to permanently reduce the damage from recurrent debris ows

BY MELINDA BURNS What if the boulders and debris that obliterated whole neighborhoods in Montecito on Jan. 9, 2018 could have been captured in the creeks?

Partners in Community Renewal, a new nonproďŹ t group in Montecito, called RenewSB for short, is on a mission to accomplish that seemingly impossible task.

Drawing on experts here and beyond California, the group has embarked on a $4 million, four-year study of the geology, hydrology, topography and violent history of debris ows in Montecito. “This is my home; it’s our home,â€? said Curtis Skene, the executive director, a debris ow survivor and a co-founder of RenewSB with his partner, Kris Kirkelie. “I just feel that when you have a place that’s your home, you have to defend it; you have to rebuild it, you have to ďŹ x it.

When I got out after 1/9, I kept saying to myself, what’s the opportunity in this big problem?�

RenewSB will design a masterplan for Montecito’s ďŹ ve main watersheds, encompassing Montecito, Cold Springs, Hot Springs, Oak, San Ysidro, Buena Vista, Romero and Picay creeks, showing how and where streams and bridges can be modiďŹ ed to reduce the future loss of life and property, Skene said. The ďŹ nal blueprint will include recommendations for a number of new creek basins that can trap boulders and fallen trees, Skene said.

All of the group’s ďŹ ndings will be turned over to county Flood Control. “It’s a big undertaking; you really have to look at the entire system,â€? Skene said. “We will do the study, identify areas where we can do things, and then go after acquiring properties. All of this ends up having to be a community discussion.

RenewSB is the second local nonproďŹ t group to grapple with Montecito’s existential dilemma – a wealthy enclave of 11,000 people living in a high-hazard zone. The very ground under their feet is an alluvial fan, laid down through the millennia by massive debris ows that roared out of the canyons of the Santa Ynez Mountains, most recently on Jan. 9, 2018.

Since the disaster, another Montecito non-proďŹ t, the Partnership for Resilient Communities, has raised nearly $6 million for the installation and future cleanout of six steel-wire ring nets in the upper stretches of Cold Springs, San Ysidro and Buena Vista creeks. The last two of the six nets were installed last week. The Partnership is asking the county for a four-year extension of its ring net permit.

The county had granted a one-year emergency permit for the project; it expires on Dec. 21.

In search of longer-term solutions, RenewSB has ďŹ nished a preliminary study of San Ysidro Creek; next, it will focus on Montecito Creek, where 17 people died below East Valley Road in last year’s disaster. The actual implementation of the masterplan by the county could take 10 to 15 years and tens of millions of dollars in private and public funds, including state and federal grants, Skene said.

Early next year, he said, RenewSB will begin reaching out to landowners who lost their homes on Jan. 9, 2018; they may want to sell all or part of their creek-side properties for debris basins, instead of rebuilding in the path of danger. “It requires somebody like us to approach those neighbors,� Skene said. “The county can’t do it.�

The ďŹ re-ood cycle

Geologists say there is a higher risk of debris ows in Montecito through 2023 in the wake of the Thomas Fire, which laid waste to the mountainside in late 2017 and early 2018. Still, the community is approaching its third rainy season since the ďŹ re with a greater margin of safety than in January, 2018. Six ring nets are up, and, according to the Montecito Fire Protection District, 80 percent of the former vegetation has grown back on the slopes above town.

On Dec. 5, Montecito Fire and the county Office of Emergency Management will release a new “red zoneâ€? map showing the properties at highest risk of damage from debris ows or debrisladen oods this winter. The map will be displayed at a meeting at the Montecito Union School, beginning at 5:30 p.m.

Historical records show that seven debris ows and debris-laden oods have hit Montecito since 1914; that’s an average 15-year interval between disasters. Last year’s was the deadliest.

In a recent study, the U.S. Geological Survey estimates that 888,000 cubic yards of mud, rocks and trees were deposited in Montecito during the Jan. 9, 2018 debris ow. Adding in the debris that was removed from Montecito’s four existing debris basins, and the mud that owed offshore, the total volume comes to about 1,004,000 cubic yards.

For comparison, that’s enough mud and debris to cover 23 miles of Highway 101 three feet deep – all six lanes from Casitas Pass Road in Carpinteria to Storke Road in Goleta.

On Jan. 9, 2018, the existing debris basins on Montecito creeks captured only nine percent of the total ow. Is it even possible to trap all the boulders and trees that would come down in a similar disaster?

Larry Gurrola, project manager of RenewSB, believes it is. He is a Santa Barbara geomorphologist who studies landforms, or the physical features of the earth’s surface.

In addition to siting potential new debris basins, Gurrola said, the group will

identify where creeks could be dredged or contoured to slow down the momentum of a debris ow, while letting the mud ow downstream. “As they come down, debris flows build up a snout of boulders, logs and trees that can be quite high,â€? Gurrola said. “There would be structures in the creek to break up the ow and reduce the height. I’m looking at it as an opportunity to bring in techniques used in other states and countries – Switzerland, Austria, Canada, Japan – and apply them here.â€?

During last year’s disaster, a number of bridges in Montecito quickly clogged with debris, effectively pushing battering rams of boulders into residential neighborhoods. Some of these bridges could be elevated or modiďŹ ed with hydraulic engineering to help “keep it in the creeks,â€?

Gurrola said. “It’s well-known these bridges are under-designed for debris flows,â€? he said. “They were designed for clearwater ows.â€?

Two-time survivor

On Jan. 9, 2018, Skene witnessed the destruction of his childhood home at 1709 East Valley Lane as he took refuge in his backyard patio. “A foot over there or over here and I would have been a statistic,� he said.

Nearby, four people died when the river of mud, boulders and debris jumped the banks of San Ysidro Creek above Randall and East Valley roads. Throughout Montecito, 23 people perished.

During a massive debris laden ood in 1969, Skene had witnessed a river of mud rising outside his home as a boy of 12. After his narrow escape in 2018, he said, “I was saying to myself, ‘What the hell was I doing there? I saw this in ’69.’â€?

In the weeks after Jan. 9 last year, Skene came up with the concept of a new debris basin on San Ysidro Creek at Randall and East Valley. He got the county and eight landowners on board, and the $20 million, eight-acre project is on a fast track.

It will hold 80,000 to 100,000 cubic yards of debris and will be the second-largest debris basin on the South Coast. The Santa Monica Creek debris basin above Carpinteria can hold 200,000 cubic yards of debris.

The new basin on San Ysidro Creek is expected to be in place by the fall of 2021, paid for in large part by the Federal Emergency Management Agency.

Seeing those results, Skene said, Montecitans from other neighborhoods asked him, “ ‘Would you consider a broader initiative?’� The result, he said, is RenewSB; the group has raised $2 million in pledges from individuals and private foundations to date, money that was targeted but is no longer needed for the Randall debris basin. In all, Skene said, the group will need to raise $2 million more to complete its watershed masterplan.

Skene and Kirkelie have been so busy, they only recently got around to demolishing Skene’s wrecked house. It was the last to come down on their block. “We can take this traumatic disaster and turn it into a model for other communities not to overbuild, but to rebuild and renew,� said Kirkelie, a home designer who volunteers her time for RenewSB. “We’re looking for long-term solutions to historical problems.�

Will they keep streaming at Rincon?

IT’S ALL SURFING CHRISTIAN BEAMISH Some notable developments have occurred since my last, admittedly impassioned, column about the Surfline company’s camera trained on the Rincon from somewhere in La Conchita. My position remains unchanged: I view the camera as an imposition on our community, and, by extension, the wider surfing community in California.

Someone (who wished to remain anonymous) got in touch with me, explaining that they’d found the camera affixed to a home in La Conchita. The person confirmed it was the Surfline Rincon cam by positioning themselves in the view-line with an orange flag held aloft, then checked the Surfline site and, sure-enough, saw themselves and their orange flag on the Rincon-cam feed.

This person knows and likes the man who is apparently hosting the camera, and was very clear that they did not condone vandalism of the man’s camera or harassment of the man himself, which I completely and unequivocally agree with. However strongly I or members of the Rincon community feel, we must remain civil.

Which brings me to the phone call I received from Ross Garrett, president at Surfline. Naturally, he does not agree with my point of view on the issue of the Rincon cam, and, in the language of bureaucrats and politicians everywhere, he systematically laid-out the ways in which Surfline makes surfing better for everyone.

Mr. Garrett took exception to my use of the word “surveillance,” which, to be fair, is more suggestive of the totalitariancapitalist regime in China than it is the surf-forecasting company from Huntington Beach. But on the other hand, doesn’t a camera trained on a place held sacred to the people who live there, controlled and operated by a distant corporation against the wishes of the local community, sound rather totalitarian?

Mr. Garrett also said it wasn’t true that Surfline was operating here without local support, and named a beloved native son of Carpinteria, who he said told him that a

Rincon camera wouldn’t pose a problem.

I respect and admire the man Mr. Garrett referred to, and I don’t pretend to have deep roots in this community (despite many beautiful connections here). Indeed, another born-and-bred Carpinterian who I also respect and admire, said that Rincon is so crowded that a camera trained on the place doesn’t matter anyway. And if the two surfers I’m referring to happen to read these words and recognize themselves, I think they can accept that I simultaneously respect and admire them and disagree on the significance of a Rincon camera.

I’ve written elsewhere about my deep ambivalence regarding 21st-century technologies. Not only are our brains and relationships with one another and the natural world transformed by digital networks, we have virtually no say in whether or not we will participate in (and pay for) this new mode of existence. To be an effective person in the year 2019 is to be fully invested in a system controlled not by a government “of the people, by the people, and for the people” as Abraham Lincoln said at Gettysburg, but one created and controlled by technocratic oligarchs.

No, the United States of America has not fallen, thank God, (and to complete President Lincoln’s line from the Gettysburg Address, may it never “perish from the Earth”), but corporate/technological dominance is something very much worth pushing back against—whether it be Mr. Zuckerberg allowing disinformation to flourish on his platforms, Mr. Bezos driving-out small business, or Mr. Garrett placing his camera in a community where it is not wanted. (Not to mention the taxes these corporations should be paying.)

During our conversation, the Surfline exec suggested that my anti-cam opinion, and my ambivalence about the digital age, placed me in an old and therefore irrelevant demographic. In other words, the kids aren’t worried about screen time or cameras—they just want their convenience, their “content.” I don’t know if that’s true, though. I haven’t surveyed the area youth, but my younger surfing

friends always surprise and inspire me with their nuanced thought, and I suspect they’re of many different opinions. And anyway, the suggestion that older people’s concerns are irrelevant is but another troubling aspect of a movement towards ever-greater speed and convenience.

But I am as enmeshed in and mesmerized by the digital age as I am wary of it. I advertise my surfboard business on Instagram and run a website too. I have long contributed articles to Surfline, the very company I am railing against.

Perhaps the greatest irony, or, hypocrisy, is that less than a year ago Surfline ran a nice profile on me, complete with multiple photos and kind words about my approach to surfing. I also look at Surfline, and yes, check the cam at California Street in Ventura (among many other forecasting services available online).

But before you throw down your newspaper in disgust, or delete me from your computer or smartphone screen, allow me to elaborate.

While it may seem arrogant, or at the very least ungrateful, to turn around and criticize a company whose services I use and whose success has provided me professional opportunities, I cannot sit by when I see something taking place that isn’t right. It’s true that I took full advantage of the offer to appear on the Surfline site, but I did not request the feature—they came to me. As for checking the cam at California Street, I suppose you can chalk that up to an unhealthy indulgence. The cam is already there, but as Mr. Garrett himself told me, Surfline’s goal for the Rincon cam is to eventually have it streaming full time (it

currently provides a 10-minute feed each day, and is only available to “Premium” subscribers.)

One of the two companies I called on to pressure Surfline in my previous column got in touch with Mr. Garrett, offering to match the revenue Surfline receives from its Premium subscribers in exchange for quietly taking down the camera. Mr. Garrett declined. His view is of progress and of making surfing better. I asked him how Surfline makes surfing better, and he told me that his company provides surfers with the information they need.

And I will concede an important point worth considering: Let’s say it is hordes of surf-hungry surfers we fear, coming up from Los Angeles to devour “our” beloved waves at Rincon. Some of them may check the Rincon cam and for any number of reasons decide not to make the drive, thereby saving a tank of gas and the impact on the atmosphere—that’s the one upside to the camera that I can see.

The imposition on the community here is my main objection, and a single well-liked local surfer cannot speak for everyone on the issue. Moreover, we cannot gauge who will or will not come to Rincon based on the camera. As I wrote last time, they’re all welcome as far as I’m concerned (though I would appreciate some etiquette). Mr. Garrett did say that the cam would come down if he received overwhelming local resistance.

Maybe I’m wrong, maybe the surfers here (beyond my core group) don’t care about a Rincon camera.

On the heels of the previous season’s CIF-Southern Section and State Regional titles, last year’s Warriors boys soccer team had a tough act to follow. Nevertheless, Carpinteria High notched a memorable victory with a 1-0 triumph over Channel League foe, Santa Ynez, in a CIF-SS Wild Card game (though they later fell to Valencia in the first round).

“It was a tough loss because I believe that last year’s team was just as talented as the team from two years ago that went all the way,” said coach Leo Quintero. The 2018-19 squad finished 9-8-3 overall and 5-3-2 in the inaugural season of the Citrus Coast League.

This season, the Warriors are expected to once again be solid on the backline on defense. Sophomore Brian Garcia returns as the goalkeeper with a wealth of experience.

As a freshman, last year, Garcia played the majority of games in goal. Senior Gabriel Perez, who played on the JV team last year, will be Garcia’s “right-hand man” at fullback according to Quintero, and Emilio Perez is set to help out at fullback.

Caesar and Vincent Rinaldi, who joined the team late last season, will return. Enrique Gutierrez will be back for his senior year as one of Carpinteria’s most experienced players, playing both halfback and fullback.

a season-long process. It’s not going to happen overnight, but that’s the vision right now.” Up front, junior Christian Flores returns to the fold to provide leadership and some scoring punch.

Other returning players are Isaac Benitez, Julian Contreras, Ivan Espinoza, Adrian Gonzalez, Rafael Lopez and Steven Zermeno.

Still, coach Quintero readily points out that, “we have a lot of new faces, the team’s brand new.”

In the Citrus Coast League, Carpinteria will face off against Hueneme, who last season finished undefeated in league, Fillmore, who finished second place, and Santa Paula, who finished just behind the Warriors in fourth.

Nordhoff and Malibu will present challenges as well. “Nordhoff, you can’t sleep on them,” cautioned Quintero, “and Malibu, you definitely can’t sleep on them at their house. ”Carpinteria, as always, will play a tough non-league schedule, including a visit from Golden Valley of Bakersfield. The Warriors will be tested right away in the season opener when Rio Mesa comes to town on Nov. 20.

Other non-league opponents include: Channel Islands, Dos Pueblos, Ventura and crosstown rivals Cate School and Buena. However, matches this year, except one against Dos Pueblos, will be on the Warriors’ home pitch.

“We’d like for the community to come out and show support,” said Quintero.

“Like any other sport at the high school, we embrace the community when they’re behind us, coming out to Valley Memorial Stadium.” The start of the season is less than a week and kicks off at 6 p.m. on Nov. 20 at Valley Memorial Stadium.

Winter Sports Parent Meeting scheduled The Winter Sports Parent Meeting is scheduled for Thursday, Nov. 14, at 6 p.m. in the CHS cafeteria. CHS athletics asks that at least one representative of each participant in boys and girls soccer, boys and girls basketball, and girls water polo attend this meeting. A brief whole group meeting will be followed by sport specific breakout sessions.

November 5 - The Carpinteria High School girls tennis team lost in a CIF Wild Card game at Oxford Academy, 15-3. “We never gave up, and I do want to highlight one of our players, Emma Lapidus who was the epitome of that,” said Warriors coach Charles Bryant. “She was down 0-5 in the first round and was looking a bit dejected as she could see all of her teammates scorecards (not in our favor) but we talked a bit on the changeover and you could now see a new spark and a stronger determination.” Lapidus pulled ahead 6-5 and prevailed 13-11 in the tiebreak. The Warriors other point came from Jeannette Carrillo/Zahra Porinsh. “We will lose seniors, Emma Lapidus, Sydney Endow, Lexi Persoon and Jeannette Carrillo, they have been the backbone and glue of our team all season,” explained Bryant. Carpinteria finishes the year, 11-9 overall and 7-3 in the Citrus Coast League.

Riverside, as they finished in fifth and sixth place, respectively. The girls team was in fourth place with 92 points behind Fillmore and Nordhoff. Hueneme was the overall team winner with 47 points. Savannah and Shayla earned All-League First team honors. Kate Cooney, Monse Alpizar and Sydney Morente were Honorable Mention selections. The boys team finished in fifth place with 131 points. Fillmore was the overall team winner with 21 points. Luke Nakasone was Carpinteria’s top boys runner, finishing in 15th place with a time of 17:49.37. Nakasone, Esteban Zapata and David Celio were Honorable Mention selections. Top Carpinteria girls finishers were: Savannah Alvarez in 20:56.52, Shayla Alvarez in 20:57.06, Alpizar took 24th in 23:17.29, Cooney, placed 25th in 23:17.61, Sydney Morente was 32th in 24:02.58 and Belen Herrera finished 38th in 25:49.81. The top Carpinteria boys finishers were: Nakasone in 15th in 17:49.37, Hugo Alvarado took 22nd in 18:18.46, Celio placed 25th in 18:39.41, Zapata captured 34nd in 19:54.61, Steven Bengry grabbed 35th in 19:58.94 and Fernando Barahona finished with a time of 21:26.10.

November 6 - The Cate School girls tennis team fell to Calabasas in CIF Division One play, 10-8, getting beat for the first time this season. “After two rounds, the match stood at 6-6, but Cate got an absolutely dominant performance out of senior team captain Grace Fuss, who defeated her three opponents 6-2, 6-1, 6-0,” said Rams coach Trevor Thorpe. Two of those wins came against nationally-ranked players, with Lauren Sebastian ranked as high as 452 in the country in 2019 and Ellina Ivanova currently ranked 529 in the country for her class.

“Cate came into the match understanding that with usual Number-two singles player Aminah Hill still sidelined by injury, they would have to win the match through the doubles side of the scoresheet,” explained Thorpe. Carol Cai and Mia Foster combined to make a senior pairing at the Number-three position and came up with a 6-2 win. Sophomores Julianna Forry and Maesa Vongkusolkit continued their winning ways, following up a 17-3 Tri-Valley League record with a 6-3 victory over the Calabasas Number-two team. “Yuki Kobayashi is getting closer to cracking the tournament level as a singles player and freshman Ellie Tunnell totally outperformed expectation this season,” added Thorpe. Senior captains and Cai and Foster will play in the CIF Regional Individuals event held at Cate and Carpinteria on Monday, nov. 25.

WHEREAS, in 2009, the federal Family Smoking Prevention and Tobacco Control Act banned the manufacture of flavored cigarettes, but preserved an exception for menthol cigarettes and flavored non-cigarette tobacco products, such as smokeless tobacco and liquids used in electronic nicotine delivery systems (ENDS); and WHEREAS, on September 6, 2019, the Centers for Disease Control and Prevention (CDC) issued a Health Advisory regarding cases of lung disease in people who use ENDS products; and WHEREAS, as of October 29, 2019, there were 1,888 cases of e-cigarette or vaping product use lung injury reported to the CDC nationwide. The CDC has not been able to identify “the specific compound or ingredient causing lung injury” and recommended “the only way to assure that [individuals] are not at risk while the investigation continues is to consider refraining from use of all e-cigarette, or vaping, products”; and WHEREAS, the Food and Drug Administration (FDA) has not reviewed ENDS products that were launched prior to 2016 and has given manufacturers until May 2020 to retroactively apply for authorization. The FDA, however has not released the dates for when the reviews will be completed nor guidance for the timelines for removal of non-compliant products from the market; and WHEREAS, the Surgeon General’s Advisory on E-cigarette Use Among Youth states, “many e-cigarettes also come in kid-friendly flavors” and increases the likelihood of youth use; and WHEREAS, in February 2019 a National Institutes of Health report emphasized that “exposure to nicotine during youth can lead to addiction and cause long-term harm to brain development”; and WHEREAS, both the state of California and the Trump Administration have not yet initiated plans to pull youth-friendly flavored ENDS products and e-cigarettes from the market during the FDA’s review, despite announcements to do so; and WHEREAS, over 40 local jurisdictions have restricted the sale of flavored tobacco and/or ENDS products; and WHEREAS, pursuant to the City of Carpinteria’s (“City”) police power, as granted under Article XI, section 7 of the California Constitution, the City Council of the City (“City Council”) has the authority to enact and enforce ordinances and regulations for public health, safety and welfare; and WHEREAS, pursuant to its police powers, the City has authority to regulate the sale of tobacco

products, ENDS, and prohibit ENDS use in public areas of the City; and WHEREAS, on February 14, 2011, the Carpinteria City Council passed an ordinance to expand the smoking prohibitions in outdoor areas open to the general public in order to protect public health from the effects of second-hand smoke; and WHEREAS, on May 13, 2013, the City Council amended the regulations to require that all retailers obtain a license for the sale of cigarettes, tobacco products and smoking paraphernalia in order to reduce the incidence of sales of tobacco products to minors; and WHEREAS, it is imperative that the City maintain local control over all ENDS products and flavored tobacco products to the fullest extent allowed by law. The City anticipates that flavored tobacco and ENDS products may encourage youth addiction and expose the general public to unstudied and unknown diseases and illnesses. The Municipal Code does not currently address the sale of ENDS products and flavored tobacco or the scope of allowable use in public spaces of ENDS products; and WHEREAS, the adoption of an ordinance that prohibits the sale of all flavored tobacco products, all electronic nicotine delivery systems, and all e-liquids, pods, e-juices, or other products used in electronic nicotine delivery systems in the City, and the use of all ENDS in public spaces within the City, will take time and careful consideration and will require input from various community stakeholders, the general public, and guidance from state and federal authorities and public health agencies.

Until that process is complete, an interim urgency ordinance is necessary to protect the public health, safety, and welfare; and WHEREAS, ENDS products and flavored tobacco present health, welfare, and public safety issues for cities, in particular the youth. Flavors have been shown to increase first-use of tobacco products, and increase the likelihood that an individual will become a long-term tobacco user. ENDS products contain addictive nicotine which increases the risk for future addiction to other drugs especially in children, and potentially expose both the users and bystanders to other harmful substances, including heavy metals, volatile organic compounds, and ultrafine particles that can be inhaled deeply into the lungs; and WHEREAS, it is reasonable to assume that the negative impacts as reported in the 1,888 cases of ENDS related-lung illnesses and deaths could also be experienced in the City if commercial ENDS product sales and flavored tobacco — particularly those which have not yet been approved by the FDA — were allowed to continue without proper regulations in place; and

WHEREAS, it may be necessary to adopt regulations on ENDS products, flavored tobacco and use to protect the public against potential negative health, safety, and welfare impacts, and these interim regulations are necessary to ensure the orderly and effective implementation of any regulations the Council may adopt.

NOW, THEREFORE, THE CITY COUNCIL HEREBY ORDAINS AS FOLLOWS: SECTION 1. Recitals Incorporated.

The above recitals are incorporated herein and are each relied upon independently by the City Council in its adoption of this Ordinance.

SECTION 2. Declaration of Urgency.

The City Council of the City hereby finds and declares that, for the reasons set forth in the above Recitals, there is a need to adopt this Ordinance establishing interim regulations that will prohibit the sale of all flavored tobacco products, all electronic nicotine delivery systems (ENDS), and all e-liquids, pods, e-juices, or other products used in electronic nicotine delivery systems in the City of Carpinteria, and the use of all electronic nicotine delivery systems in public spaces within the City. City staff requires time to study issues, including evolving state and federal guidance and health impact studies, so that it can propose appropriate regulations ensuring that the effects of ENDS and flavored tobacco product sales and use on the health, safety and welfare of the residents and businesses of Carpinteria are adequately addressed.

SECTION 3. Interim Urgency Regulations.

In accordance with Government Code section 36937, and pursuant to the findings stated herein, the City Council hereby: (1) finds that there exists a current and immediate threat to the public health, safety, and welfare requiring this interim Urgency Ordinance; (2) finds that this Ordinance is necessary for the immediate preservation of the public peace, health, and safety as set forth herein; and (3) declares and imposes interim regulations for the immediate preservation of the public health, safety and welfare as set forth below: A. The sale of all flavored tobacco products, all electronic nicotine delivery systems (ENDS), and all ENDS products in the City of Carpinteria is prohibited.

B. The use of all ENDS in public spaces within the City is prohibited.

C. For purposes of this Ordinance, the following definitions apply: 1. “Electronic nicotine delivery systems” (ENDS) are noncombustible tobacco products. These include, but are not limited to, vapes, vaporizers, vape pens, e-cigarettes and e-pipes.

2. “ENDS products” includes, but is not limited to, the e-liquids, pods, e-juices, or other nicotine containing cartridges that are used with ENDS which are heated to create an aerosol for inhalation.

3. “Flavored tobacco products” are products that contain or derive from tobacco or nicotine and impart a “characterizing flavor.”

4. “Characterizing flavor” shall mean the definition as used by the U.S. Food and Drug Administration and the California Department of Public Health to refer to products that have a taste or aroma that can be distinguished from the taste or aroma of tobacco during consumption of the product, or that are marketed as having such a characteristic.

5.“Public spaces” shall mean any public or private place open to the general public regardless of any fee or age requirement, including, for example, streets, sidewalks, parking lots, parking garages, plazas, bars, restaurants, clubs, stores, stadiums, parks, playgrounds, taxis and buses. For the purposes of the provisions of this chapter, a "public place" does not mean a private residence except for (a) residences used as a child care, health care, board and care, or community foster care facility as such terms are defined by the state Health and Safety Code or (b) the common areas of multifamily dwellings, such as apartment buildings and condominiums, consistent with the definition in Carpinteria Municipal Code section 8.52.030.

SECTION 4. Effective Date and Duration.

This Ordinance is an urgency ordinance enacted under Government Code section 36937. This Urgency Ordinance is effective Nov. 12, 2019.

SECTION 5. Amendment of Ordinance.

The City Council by ordinance after notice of public hearing and by the affirmative vote of at least fourfifths (4/5) of the City Councils may modify, amend, delete or add to this Ordinance upon a finding that such action will implement and enforce the goals, policies, and purposes of this Ordinance.

SECTION 6: Publication.

The City Clerk is directed to certify this ordinance and cause it to be published in the manner required by law.

SECTION 7. Study.

Staff is directed to study and analyze issues related to the health and safety risks associated with ENDS, ENDS product use, and flavored tobacco use amongst the general public and youth, including but not limited to, evaluating conflicts in state and federal law concerning the validity of the legislation, the potential impacts of such activities on businesses and public health, safety and welfare of the community, the desirability of such activities in various zones, and the extent of regulatory controls, if any, to impose on such activities.

SECTION 8. Interpretation and Severability.

This Ordinance is intended to be consistent with state and federal law, and is not intended to regulate in any area preempted by state or federal law. If any section, subsection, sentence, clause, phrase or word of this Ordinance is for any reason held to be invalid by a court of competent jurisdiction, such decisions shall not affect the validity of the remaining portions of this Ordinance. The City Council hereby declares that it would have passed and adopted this Ordinance, and each and all provisions hereof, irrespective of the fact that one or more provisions may be declared invalid.

SECTION 9. CEQA Exemption.

The City Council finds that this Ordinance is not subject to the California Environmental Quality Act (“CEQA”) pursuant to the CEQA Guidelines, California Code of Regulations, Title 14, Chapter 3, sections: 15060(c)(2) (the activity will not result in a direct or reasonably foreseeable indirect physical change in the environment); 15060(c)(3) (the activity is not a project as defined in section 15378); and 15061(b)(3) (the activity is covered by the general rule that CEQA applies only to projects which have the potential for causing a significant effect on the environment). Because there is no possibility that this Ordinance may have a significant adverse effect on the environment, the adoption of this Ordinance is exempt from CEQA. L I S A O ’ R E I L LY We’ve all heard stories about the Mayflower and the First Thanksgiving—how the colonists left England in September of 1620, spent an arduous 66 days crossing the Atlantic before arriving at Cape Cod, suffered the loss of half the original passengers during that first disease-ridden winter, and persevered to the point of being able to prepare a feast to celebrate an abundant harvest with the native Wampanoag tribe the following autumn.

But have any of you discovered that your ancestors sat at that table?

A few years ago, I struck gold while researching a client’s family tree, when a branch led me to Pilgrim John Howland.

Born in Fenstanton, England, in 1595, Howland boarded the Mayflower as an indentured servant to John Carver, who was a deacon and one of the organizers of the voyage. As a signer of the Mayflower Compact and one of the founders of Plymouth Rock, Howland etched his name into the history books, but he alone held a distinction none of the others attained.

He was the only one to fall off the ship during the crossing.

How now?! The leader of the Plymouth Colony, William Bradford, wrote in his journal, “Of Plymouth Plantantion,” the account that took place during a wicked storm. “…in one of these storms the winds were so fierce and the seas so high as they could not bear a knot of sails, and a lusty young man called John Howland was thrown into the sea, but it pleased God that he caught hold of the top-sail halyards which hung overboard… He held his hold, though he was sundry fathoms under water, til he was hauled up by the same rope to the brim of the water, and then with a boat hook and other means got into the ship again, and his life saved; and though he was something ill with it, yet he lived many years after and became a profitable member both in church and commonwealth.”

I took great pleasure in sharing this tether to the past with my client and presenting to her a book entitled “The Boy Who Fell Off the Mayflower, or John Howland’s Good Fortune.” Good fortune, indeed—for John and his millions of descendants (including several U.S. Presidents, writers, and celebrities)—that a rope was trailing in the water and he held fast!

Now back to that first feast. I came

Girls Inc. of Carpinteria held their annual “She Votes” mock election on Election Day, Tuesday, Nov. 5. The “She Votes” program is a non-partisan initiative that teaches girls of all ages about civic engagement and the democratic process. Girls learn how legislators make decisions at all levels of government, and how those decisions impact the girls’ lives.

Trained staff expose girls to the excitement of government and running for office through relevant activities, speakers and field trips. Through these experiences, girls gain the skills and confidence to be future voters, candidates and leaders in their community. This year, the girls voted on propositions created by second through fifth grade girls to address on-campus issues.

All propositions passed with a majority of 70 percent. Girls also voted on their choice of a special snack. (Popsicles won in a landslide over pizza, chips and fruit.)

across a record I had not seen before, and share it here as it’s the only documented eyewitness report of what transpired during those days. It is a letter written by colonist Edward Winslow in December of 1621, and reads in part as follows: “We set the last spring some twenty acres of Indian corn, and sowed some six acres of barley and peas, and according to the manner of the Indians, we manured our ground with herrings or rather shads, which we have in great abundance, and take with great ease at our doors. Our harvest being gotten in, our governor sent four men on fowling, that so we might after a more special manner rejoice together, after we had gathered the fruit of our labors; they four in one day killed as much fowl, as with a little help beside, served the company almost a week, at which time amongst other recreations, we exercised our arms, many of the Indians coming amongst us, and among the rest their greatest King Massasoit, with some ninety men, whom for three days we entertained and feasted, and they went out and killed five deer, which they brought to the plantation and bestowed on our governor, and upon the captain, and others. And although it be not always so plentiful, as it was at this time with us, yet by the goodness of God, we are so far from want, that we often wish you partakers of our plenty.”

Far from want in this land of plenty.

Maritime Museum Director Greg Gorga recently spoke at Morning Rotary and shared 13,000 years of local nautical history. Starting with the discovery on Santa Rosa Island of the oldest human remains in the western hemisphere, and continuing up to the state of the art diving equipment developed and still made in Santa Barbara, Gorga shared the rich history of this region. Using the tall ship “Spirit of Dana Point” fourth graders from Santa Barbara County schools have the opportunity to become immersed in early California history while working with a variety of dynamic historical characters from “Two years Before the Mast,” by Richard Henry Dana, Jr. Students gain skills in cooperative learning, teamwork, and communication as they hoist cargo, row long-boats, raise sails, stand night watch, swab the decks and sing sea shanties. Gorga shared, “The best view of Santa Barbara Harbor is from the fourth-floor patio deck free and open to all.”

Carpinteria Morning Rotarians and friends participated in “Hike to End Polio” in the month of October, raising over $5,000 towards immunizing children all over the world against the devastating disease. The Gates Foundation matched the money raised 2:1 to help over 15,000 children worldwide.
