CHS senior Tanya Sanchez wins $10,000 CEF scholarship

Tanya Sanchez, Carpinteria High School Class of 2020, has been awarded the Lynda Fairly and Richard Finkley Degree Scholarship. Sanchez, who attended Canalino, Carpinteria Middle and Carpinteria High schools, plans to study criminology, later moving into the forensic science aspect of the field.

This is the third annual awarding of what was originally called the Lynda Fairly Degree Scholarship. For 2020, Richard Finkley joined his wife’s effort, and the award amount was increased to $10,000.

“It is for any field of study for a student who attends community college, probably Santa Barbara City College for two years, and then transfers to a four-year university to complete their undergraduate degree,” explained Fairly, who retired as vice president of Adult Education at SBCC after a career that began as an elementary school teacher.

“Recipients receive the scholarship upon transferring to finance the last two years of their college career. My hope was to assist someone who might not be able to attend college without some financial assistance. I hope that this scholarship will inspire the recipient to complete their first two years knowing that the last two won’t be quite as personally expensive.”

Like Fairly, Finkley’s career was in education. He served as a professor and academic administrator at three Midwestern public universities. “I was the first person in my family to graduate from high school and attend college. Public education made my life possible,” said Finkley.

Administered through the Carpinteria Education Foundation, the scholarship is earmarked for a Carpinteria High School graduate. The first two recipients, Shaya Alexander and Sallury Hernandez, are both attending SBCC and have been very successful academically.

Retired Canalino School principal Sally Green has mentored Sanchez since the scholarship winner was a fifth grader through the Council on Alcohol and Drug Abuse/Fighting Back Mentor Program.

Sanchez credits Green as her biggest influence in helping her win the scholarship. “She has evolved into an amazing young lady,” Green said. “Tanya applied for a REACH grant three years ago; she and another CHS student received one.

She had an internship in Santa Barbara, toured Bay Area universities, and this year, hopefully, a Summer Outward Bound program where she will travel to

In her letter of recommendation, CHS science teacher Mandi De Witte, Santa Barbara County Teacher of the Year 2019, described Tanya as leading through example and a well-respected and mature student who helps to make school a better place. De Witte got to know Sanchez via the CHS Gender and Sexuality Alliance club, which she advises.

“In addition to her time spent making positive change through clubs, Tanya played JV softball and varsity golf for our school. She also participated for five years in the Girls Inc. Eureka! Program, REACH for two years, and has totaled an impressive 96 volunteer hours during her high school career,” De Witte said.

“Tanya is a great communicator and has great respect for the people around her.

She cares deeply about others and is quick to lend a helping hand whenever someone is in need. As a member of both the Youth Wellness Connection and Gender and Sexuality Alliance Clubs at school, she supports her classmates by helping

them learn more about promoting selfcare, connection and kindness towards all others.

Two years with out our beautiful Auntie Sharon. We miss everything about her. Her smile, her laugh, her stories, her HUGE heart, her selflessness, her creative hands. Anything she did she always made it look PERFECT. From the way she prepared SUCH yummy Irish dishes to making a bouquet of flowers with out even taking a second to think about it. She just laid out all her flowers and just started placing them together as if her hands and mind already knew where all the flowers must go and the final results were MIND BLOWING.

For her last birthday someone sent her a huge bouquet of flowers and the second she saw them she started pulling all the flowers apart, driving her crazy at how horrible it was arranged! Of course the way she rearranged it was so much better.

St. Joseph Church will reopen to the public on Sunday, June 7, with masses at 7 a.m. in Spanish, 9 a.m. in English and at 11 a.m. in Spanish. Doors will be open to the first 100 people and social distancing guidelines and practices will be followed. For more information, visit stjosephchurch.org.

Library to reopen

Santa Barbara Central Library is starting to offer sidewalk service and all patrons can now place book holds online that can be picked up at Central. In Carpinteria, the branch library has opened for book drops every Monday from 2:30 to 5:30 p.m.

Masons award college scholarships

The Carpinteria Mason’s Scholarship Committee selected three Carpinteria High School seniors for $1,000 scholarships: Kara Rose Chatterton was awarded the Don Groves Scholarship; Olivia I. Sheaffer was awarded the Charles Lobue Fine Arts Scholarship and Michelle Alpizar Farfan was awarded the Masonic Lodge #444 Scholarship.

A statement from the Masons read in part, “Those who applied and did not receive a scholarship are to be complimented for their good deeds and accomplishments, knowing our best wishes for a positive and creative future are in store for them… The Masonic Fraternity worldwide endorses and supports public education as one of their community pillars.”

Maintaining social distance and donning face masks, students and Masons met at the Carpinteria Masonic Lodge to be honored and recognized.

A group of Carpinteria High School students have organized a peaceful “Carp for Black Lives Matter” protest for Saturday, June 6, at 1 p.m. on all corners of Linden and Carpinteria avenues.

“We want to make this for the people and require people to wear masks and stay at some distance from each other while still being able to participate,” said teen organizers Isa Alarcon, Laura Flores, Joana Romero and Jackie Urrutia.

Scorpion Fire engulfs over 700 acres

The Scorpion Fire on Santa Cruz Island was 80 percent contained with over 700 acres estimated to have burned, as reported by Channel Islands National Park on June 1.

Overnight, 49 wildland firefighters contained the blaze to the northeast of the road that leads from Scorpion Valley to Smugglers Cove. They constructed a fire line from the road to the coast near Smugglers Cove.

A 20-person wildland fire crew from the Monterey District of the Los Padres National Forest is on standby in Ventura if additional hand crews are needed on the island. Air assets are also standing by but not expected to be deployed. No structures have been reported as damaged or threatened by the fire and there are no injuries.

The park transportation concessioner, Island Packers, has been ferrying the fire crews to the island.

What’s new at the harbor seal rookery?

Parking restrictions to further loosen

Effective on Friday, June 5, the city of Carpinteria will remove some of the restrictions placed on parking in response to state and county stay-at-home orders. Parking lots that were closed in an effort to reduce beach and downtown congestion will be reopened. These include the beach parking lots at the end of Linden, Elm, Holly and Ash avenues, as well as City Parking Lot 3 and the lot at Carpinteria Middle School.

The “no parking” restrictions temporarily implemented around the Carpinteria Children’s Project campus, on Fifth Street and on Carpinteria Avenue near City Hall also will be removed.

Two-hour parking limit zones in the Beach and Concha Loma neighborhoods and the permit-only parking areas on parts of Palm Avenue and Sixth Street will remain in place Fridays, Saturdays, Sundays and holidays until further notice.

Additionally, normal enforcement of street sweeping, and timed parking restrictions will resume on Monday, June 15, after a mid-March suspension prompted by stay-at-home orders.

Natural History Notes

Our Carpinteria population has been in decline for several years.

Data from 2004 through 2015 shows high counts averaging 384; nine years exceeded 350 and four exceeded 400. In 2016, the count was 298, then 243, 249, 230, to 200+ this year. The causes of the decline are not known, but one area within community control is the number of disturbances. Harbor seal numbers are directly affected both in the short and long term by the frequency and severity of disturbances.

Robert led a life full of laughter, music and hard work. He was a Journeymen Glazier and worked in the field for 45 years, working in San Fernando Valley, Carpinteria, Santa Barbara and Ventura.

You can drive through any of these cities and see some of his work from celebrity homes to Lion Enclosures to Santa Clauses’ glasses. He enjoyed his work and was great at it.

Robert enjoyed his beer, music and dancing. Any Friday you could catch him in his garage, beer in hand, meat on the grill, Oldies coming from the speakers. He loved his motorcycle, camping and spending time with his friends. He always had a beer and a joke ready at all times.

preventing humans and dogs from walking through the sanctuary officially ended on June 1. Although most of the babies are weaned by now, like humans, their breeding cycle is not always predictable.

Sadly, due to Covid-19, the volunteers who normally sit watch in the bluff above the sanctuary have been keeping social distance and have not been able to serve. Please do not cross the sanctuary so that this infant and remaining seals remain safe.

Dr. Susan Mailheau, a local veterinarian, is the sole person there these days and she noticed the remaining baby seal. Susan explained the plight of this infant seal.

If disturbed by humans walking through the sanctuary, the pup would likely be separated from its mother and die. She added that although the Carpinteria city law closing that beach ends on June 1, the Marine Mammals Protection Act prohibits harming marine animals and their habitat is in effect year around. Just for a minute, during this tumultuous weekend, I reflected on the quiet and peace here in our little beach town. No shouting crowds. No burning. No looting.

How thankful and safe I felt.

And then I thought a little more.

Carpinteria has a long history of racism.

Aliso School was built “for the Mexican children” so they would not mix with the white kids. (John D. McCafferty’s book details the discrimination many former students remember.) For many years, Hispanic families could not use the beach.

The Native Americans—Chumash—have long been treated badly. Ask any young man of color how he has been treated by the sheriffs.

Who owns the stores, the businesses?

What percentage are people of color compared to their part of the population?

What about our city government? At present our City Council is made up of three white guys and two Asian men, one of whom is the mayor this year. Why isn’t the rest of the city represented?

School board faces deep cuts

At its regular meeting on Wednesday, May 27, the Carpinteria Unified School District Board celebrated the retirement of several teachers before diving into the contentious issue of budgeting. The principals of Aliso, Carpinteria Middle and Carpinteria High schools read letters of thanks to retiring teachers and staff: Judy Haller, Jamie Bickford, Julie Hathoway, Kim Castagna and Gene Bisson.

Superintendent Diana Rigby began her report to the board by saying, “In short, the fiscal outlook for schools is bleak.” Referring to Governor Newsom’s state budget, which shows a reduction of school funding of over 10 percent across all districts and projections of lower property tax funds in coming years due to the effects of the pandemic, Rigby stated that there would be impacts to CUSD afterschool programs. CTE, K-12 workforce and agricultural grants are all to be reduced by 50 percent. The ACES program to help children deal with trauma will likewise lose 50 percent of its funding.

Looking to a return to campus starting in mid-August for staff, Rigby said that district schools would follow CDC guidelines, including: placing desks six feet apart and all facing forward, staggering arrival times, issuing cloth masks for staff, limited sharing of art supplies and limiting extra-curricular activities.

No mention was made of any plans to provide Covid-19 testing for staff or CUSD families, and no guidelines have yet been issued by the state of California or the county of Santa Barbara regarding schools reopening.

Assistant Superintendent Maureen Fitzgerald made a budget presentation echoing Superintendent Rigby’s assessment with the comment that the budget looks “consistently gloomy.” Citing lower projections for property tax and the unknown outlook for additional federal funding, as well as a 15 percent reduction in funds from the sale of statewide lottery tickets, Fitzgerald calculated approximately $475,000 less projected revenue

“The district,” Hotchner said, “did not, would not, and we believe, could not provide clarification because, as they said, ‘they had not gotten that far. The (food services) plan remains terribly unclear” regarding cost, logistics, numbers of staff or savings. The “union was told the district needn’t justify such behavior and action, and that it was the district’s prerogative and discretion to make decisions such as these.” Hotchner continued, “Well, that’s neither a justification or an explanation—it does suggest some sensitivity around power issues, though.”

This historical graphic novel takes us to 1916 and intersects the stories of the Irish immigrants who built the tunnels beneath Lake Erie and a black inventor who helped save some of their lives using an innovative helmet he designed. Ben Beltran (based on real life inventor Garrett Morgan) is an ambitious inventor but struggles to get a promotion for his work due to the color of his skin. His helmet allows firefighters to enter smoke-filled buildings and remain inside for long periods of time. He tries to gain publicity by going to conventions dressed as a Native American and hires a white man to play the role as the inventor. However, his stunt does not work, and no one purchases his life saving device.

Plans are in motion to build tunnels under Lake Erie necessary for the growing population. The Irish immigrant population bear the brunt of the project as they are paid very little for the necessary, intense work. Corruption is afoot and risks are ignored, culminating in what is now known as the 1916 Waterworks Tunnel Disaster, and Beltran and his helmet are put to the test. With themes that are increasingly relevant today, this book highlights the plight of the working class and structural silencing of black voices.

It is a timely reminder of the importance of personal protective equipment and the value of people’s labor. Recommended for teens and adults. The book is available on Hoopla with your library card.

From the beginning pages of “Miracle Creek,” the reader is swept into this gripping story—really more of a “whodunit” murder mystery. The story focuses on a group of people who are getting treatment, or treatment for their special-needs children, in a hyperbaric chamber that may cure a range of conditions from infertility to autism. Two patients are violently killed in an explosion in the Miracle Submarine chamber, and the evidence shows it was no accident. From chapter to chapter—each narrated from the distinct point of view of the core cast of characters—the reader will change alliances, question previous details and challenge assumptions.

Author Angie Kim had a career as a trial lawyer, which is evident in the powerful realism in the courtroom scenes in her debut novel. In addition, Kim was a Korean immigrant to America at age 12, which is mirrored in one of the main characters. All the way to the end, it is unclear who really was responsible for the death of the two victims and the destruction of many others’ lives as a result.

Most impressive is how real and relatable the characters are, and their thoughts, when expressed in each chapter, resonate deeply. The book prompts thought on ethical and moral issues through its distinct characters and relatable situations.

Focused on themes of family loyalty and protection, the challenges and joys of caring for children with special needs, the immigrant experience and the complexity of parenting, “Miracle Creek” is raw, honest, suspenseful, stunning and ultimately a very satisfying read. Highly recommend!

Planning Commission greenlights Carpinteria Skate Park

The Carpinteria Skate Park, a project 10 years in the making, was granted approval by the Carpinteria Planning Commission at their June 1 meeting. The commission voted 4-1 to support a Development Plan and Coastal Development Permit for a new public skate park facility of approximately 36,500 square feet on the east side of City Hall, 5775 Carpinteria Ave. Commissioner Jane Benefield dissented, noting her support for the skate park but her desire to see parking reconfigured to avoid needing to remove as many as 58 existing eucalyptus trees.

Plans include 19,500 square feet of skateable area, 23 new parking spaces, a 7,690 square foot picnic and plaza area, a new restroom, landscaping, fencing and lighting. The project is proposed by the city of Carpinteria, and the Carpinteria Skate Foundation will be responsible for the costs associated with building the park.

Peter Bonning of the Carpinteria Skate Foundation called the approval “the last big city hurdle” to building the skate park. “It’s been a 10-year process and Monday’s vote was the green light to build,” he said. The initiative will still require a building permit and a final review of the plans.

“The skate park is for the community, by the community,” added Bonning, “it’s been a grassroots effort and a community effort and in the end, it will be a public park that brings people together to create a dialogue about getting along and stay-

City offers Covid-19 signage to businesses

The city of Carpinteria has created signs and compiled information to help businesses reopen safely. The materials were distributed in informational packets to several businesses last week, and city staff will continue to distribute packets over the next few days.

Printed packets are also available to be picked up at City Hall, 5775 Carpinteria Ave.

Applications now being accepted for city business grants

To help small local businesses reopen their doors safely, the city of Carpinteria has launched the Covid-19 Relief Small Business Restart Grant Program. The new program will provide $1,000 grants to up to 100 local businesses seeking financial support to meet guidelines for a safe reopening. The goal is to offset costs associated with efforts such as cleaning and sanitation, purchase of face coverings, and other personal protective gear. Any business or nonprofit that meets the requirements may submit an application. The deadline is June 9.

Vision Zero: Preventing traffic fatalities CVn

the lay of the land mike wondolowski I grew up in a big family in a house filled with the energy of a bunch of rambunctious kids. I am not sure how long it was before my parents figured out that unbreakable plastic dinner plates were a good idea, but except for holidays, that’s what we used.

This past weekend when I was using my circular saw, I used it exactly as my dad had taught me for safe use – safety goggles, placement of the wood to be cut, foot position, power cord position, and more. In retrospect, I marvel at how young I was when he first let me use the tool. There were a lot of instructions, and he was very serious about them. I had to demonstrate my technique a bunch of times with the saw unplugged before he let me use it. All that teaching was kind of dull. But when he plugged the saw in and helped me make that first cut, it was possibly as fun as the first time I got to drive a car! (The chainsaw was a few years later, but boy, that one was fun too.)

My parents could have taken a different approach. They could have decided that they wanted to use china plates.

If one of us kids broke one, maybe we would only be given bread and water – don’t really need a plate for that. Or my dad could have been less directive about using power tools. He could have considered injuries from power tools somewhat inevitable. Besides, there were a bunch of us kids, and if one had a serious accident, the others would probably learn from seeing that mistake.

So, why this trip down memory lane?

Hold on… I’m getting there!

Regarding the dishes, my parents apparently figured out that we were incapable of handling them appropriately, probably breaking an entire stack of them at a time roughhousing while setting the table or emptying the dishwasher. So, they engineered a solution – unbreakable plastic plates, and throw in the plastic drinking cups while you’re at it.

I have all my fingers and toes today even after a good amount of power tool usage over the years. That is a direct result of the training my dad gave me, and then the enforcement of the rules he trained me to follow. If I used any of the power tools in an unsafe way, he immediately enforced the safety rules and stopped me. Then we went back through the training… again.

Now here’s why I bring all this up…

What’s another dangerous power tool that just about everyone learns to use in our teenage years? A tool many of us use almost every single day? The automobile. Each day, there are 3,700 deaths around the world from preventable traffic crashes. That is 1.3 million people each year. It is the leading cause of death for people 5 to 29 years of age.

Just this past February, two students were struck by a car while crossing Foothill Road to get to Carpinteria High School. Then later that month, a student was hit by a car while riding his bike to

Carpinteria Middle School. Thankfully, none of these incidents resulted in deaths, but they are still unacceptable.

There is a strategy called “Vision Zero” being adopted around the world based on the principle that all severe or fatal transportation-related injuries are unacceptable and are preventable by prioritizing safety above all other factors on our roads. It was first implemented in Sweden in the 1990s, and its success across Europe inspired adoption in major US cities, including Santa Barbara where it was adopted in 2018.

Some core concepts of Vision Zero are: Traffic deaths are not inevitable, but are preventable.

Human behavior is not perfect, so the system must integrate human failings.

Preventing fatal and severe crashes is more important than preventing all collisions.

The specific actions inspired by these principles fall in these areas: Engineering: Anticipate and reduce the effects of human error – plastic plates don’t break as easily as china; separate and protected bike paths reduce car-bike conflicts.

Enforcement: Safety laws must be followed – no sawing without goggles, stop signs mean every car and bicycle must stop every time, turn signals are not optional, sidewalks are not for bikes.

Education: We all need to know how use our transportation tool safely, whether it is a car, motorcycle, bicycle or our own two feet.

If we as individuals, taxpayers and voters base our actions on the principles of Vision Zero, and demand that our government agencies do so too, then we can achieve the vision of zero severe or fatal transportation-related injuries to us, our family members, our students, or anyone in our community.

Cate School volunteers serve Manitou House

Cate School’s Public Service Night Program consists of a group of five to seven students who volunteer weekly at several local organizations and engage in games and other enrichment activities. One of the organizations the school works with is UCP WORk, Inc’s Manitou House, where the same five men have lived together for close to 40 years—some starting there as teenagers themselves. The Manitou residents and their staff look forward to game nights and wear Cate T-shirts while playing Bingo and the game Sorry in a non-competitive fashion.

“The public service experience is more about the ritual and getting to see familiar faces,” said Director of Community Engagement Will Homes. “Our students are super grounded and are in better spirits after they leave, plus they learn to take different perspectives.”

During the pandemic, Cate students have continued their game nights via Zoom.

“The guys are more outgoing when the students come on the screen. They all perk up on game night,” said UCP WORk Life-Skills Coach Joette Demeter.

Cate Senior Finnian Whelan has been a regular volunteer with the school’s Public Service Night since her sophomore year and is one of five leaders of the program.

“I really enjoy this leadership position because it allows me to teach other students that the best way to make a difference in the local community is to give both effort and compassion,” said Whelan.

Before the stay-at-home order, the Manitou residents attended Cate›s end-of-theyear barbeque and holiday concert. Additionally, the students coordinated ongoing fundraisers to purchase essential needs and items such as a kitchen table and bed.

Most importantly, the men would get to shop with the students, further supporting UCP WORk’s goals towards independence, life-skills training and community integration for adults with disabilities.

Girls Inc. reopens clubhouse Photos by Debra herrick

By 9 a.m., on Monday morning, eight girls were in a classroom happily coloring at desks six feet apart while listening to the guided instructions of Girls Inc. of Carpinteria program leaders. GI welcomed the group of girls back to campus for learning activities and fun after staff completed a four-hour training on safety and implementing a multi-staged arrival protocol to reduce risks for staff and children.

“We’re very excited to have girls back on campus and to be able to support them through this pandemic,” said Jaime Collins, executive director of Girls Inc. of Carpinteria, “we want to be there for them emotionally and to help bridge the summer academic gap.”

When girls arrive, they have their temperatures taken from inside their cars or in front of the facility. Next, they wash their hands and are issued their own set of activity supplies to reduce the risk of cross contamination.

“When we opened this morning, we felt prepared and ready,” said Collins who greeted each girl as they arrived.

Girls Inc. is on a half-day schedule as they ease back into onsite programming.

They will also continue their virtual programming for girls.

New IBC beer supports women in brewing

By DeBra Herrick Since 2013, the international organization Pink Boots Society has been advocating for a stronger female presence in the field of craft beer by providing encouragement, education and scholarships to women in the brewing industry. One of the first members of the Central Coast Chapter was Laurie Matthews, general manager of Island Brewing Company (IBC). For the last three years, IBC has created a collaboration Pink Boots Brew.

Society members create a signature blend of hops at the Great American Beer Festival and a portion of sales of that hops benefits the society. This year the hops generated $117,807.

IBC’s 2020 Pink Boots Brew is “Worlds Gone Wild,” a hoppy pale ale clocking in at 5.6 percent abv and 25 IBUs. IBC cellarman Jamie Perkins helped with this year’s collaboration brew. Perkins started home brewing in 2017 and fell in love with the process. She joined IBC as a bartender in 2018, but within a year she transitioned into a position assisting with brews before being promoted to fulltime cellarman.

“I like how creative it can be,” said Perkins. “It’s hard work and lots and lots of learning. People always want to talk about brewing because it sounds exciting but getting in and doing it is a lot of work, but there’s a creative part and that’s where it gets fun.”

Perkins hopes to one day have her own brewery, but she says that will take time.

“It depends how quickly you learn and the opportunities you have,” she said, “It takes money, time and a solid staff is also really important.” While Perkins acknowledged that it’s a predominantly male centered career, she noted that the number of women in brewing is going up and that she hasn’t experienced any obstacles based on her gender. “I don’t know how it is in other breweries but for me working at IBC, it’s been like any other job as long as you put in the work,” she said. “Beer and the drinking atmosphere bring people together, there’s no fear or judgement.”

after work, brewer Treven yothers and cellarman Jamie Perkins talk about upcoming brews while tasting IBC’s Worlds Gone Wild pale ale. we need good people in brewing. After Laurie, Jamie is the first woman we’ve had brewing at IBC. We’ll have people a day or two, but Jamie really wanted to do it and talked it up a lot. That’s what you’re looking for. It’s competitive work sometimes and everybody brings their own perspective.”

Brewing beer is physically demanding work that can be a hurdle for all people, not just women, said IBC head brewer ryan Morrill. “I have had several male applicants and or employees who have decided to leave due to the physically demanding nature of brewing,” he said.

“It takes the right personality to want to make beer. Our industry is very male dominated. At any brewing conference I have attended, especially when I started out 10 years ago, the majority of the participants have been male. This has somewhat changed over the years, but it is definitely not 50/50.”

But Morill also noted women brewers are gaining presence in the industry with female brewers at enegren Brewing, Casa Agria, M. Special and Inglewood’s female founded Three Weavers.

Congratulations, class of 2020

lEFt, Esteban Zepata was on the yearbook staff, along with being captain of the tennis team and running cross country and playing basketball. he also played bass drum in the band, served as vice president of interactive Rotary and was a member of habitat for humanity.

The graduating class of 2020 can add nationwide unrest, fueled by generations of racial injustice, to the global pandemic that had already upended their senior year. It is their generation however, that has the opportunity to begin building new structures—economic, educational and legal—to move the United States of America towards a more perfect union. But before they tackle that job, Carpinteria’s high school seniors deserve hearty congratulations for all they have achieved thus far.

lEFt, Emily Calkins served on the board of Round square (an international network of schools in 50 countries that offer programs and experiences to develop global competence and character) through which she travelled to lima, Peru as a foreign exchange student and was a conference representative to south africa. at Cate school, Calkins served as an activity head planning school activities, and was on the alumni committee. she also participated in theater and was a photographer for yearbook. additionally, she played lacrosse, soccer and was active in the outdoors program. Emily has been active in Girl scouts since kindergarten and continued her community service in high school.

bEloW, Carlo Jacobson is a fourthgeneration Carpinterian who attended Carpinteria public schools until he had the opportunity to attend Cate school where he played on basketball, cross country, track and ultimate frisbee teams. active in the performing arts department, Jacobson was also a member of the jazz band and sang in the choirs. he was the student director of the Chorale choir this year, and represented the school as a tour guide for two years, becoming head tour guide his junior year. Jacobson also served as a teaching assistant in a sophomore seminar class.

Jacobson will graduate with a GPa over 4.3 and will attend UC berkeley in the fall, majoring in Molecular Environmental biology.

luke nakasone played varsity basketball and volleyball at Carpinteria high school, earning awards and honors for both. he was also captain and MVP of the cross country team. Drum major for the Warriors marching band, nakasone also played trumpet in the jazz/concert band. he joined Muses, was president of the interact Club and was a member of the link Crew, habitat for humanity, Jsa and FCa. nakasone was on the yearbook staff and editorial board and was named the sbaRt Chs scholar athlete of the year 2020. his favorite memories include winning league in volleyball and basketball, making the CIF Semifinals and State Playoffs for basketball and hanging out with his friends. nakasone will attend UCla this fall, majoring in neuroscience.

Rites of spring

IN THE NATUREHOOD NANCY BARON For a long time, the male Red-shouldered Hawk was alone. He would scout the neighborhood with rapid wingbeats, looking for one of his kind, screeching, “Keeah Keeah Keeah…”

He would land on the perch below our house and cry incessantly searching for a female and telling all others to stay away.

Red-shouldered Hawks are soaring hawks known as buteos. Like their larger Red-tailed Hawk cousins, their broad wings help them ride aloft on wind currents. Red-shouldered Hawks can be distinguished by their strongly barred tail, checkered wing pattern, rusty red underparts – and their loud calls.

The hawk had a prime home territory.

He patrolled avocado and cherimoya orchards looking for rats, gophers, snakes and lizards. He had a perch in the sun he could hunt from, and where he could dry after a bath in the nearby pond. All he needed was a mate.

One day she came. The male hawk advertised his real estate with more loud cries. He showed off the pond, as they bathed together. They basked in the sun on the perch my husband Ken had put up to encourage the hawk to hunt for rats and gophers in our surrounding avocado grove.

The male was older, as the tell-tale gray on his face showed. The female, as is typical with raptors, was about a third larger.

They courted and sparked. she stayed.

The pair set up nesting in the crown of a nearby Mexican fan palm. My husband (a farmer) and i (a naturalist) rejoiced.

Hawks are the farmer’s friend as they eat rats, gophers and grasshoppers that take their toll on crops. And they are fascinating to observe.

Early each morning and again at dusk one or the other returns to the perch, looking for one last meal and to preen and seemingly relax after a long day of hunting. when it is still dark, one of the hawks tears branches from the nearby pepper tree and goes back to bolster the nest. spring brings the biggest risks for these hawks, says, Kim stroud, executive director of the Ojai Raptor Center (ojairaptorcenter.org). All too often, their nest, including their chicks, are blown out of trees. Or they suffer at the hands of tree trimmers.

The nest near my house seems precarious, positioned on the side of a palm crown. During April’s most ferocious storm, i worried about the female on the nest, atop the wind-whipped palm.

Would the nest blow down? Would she abandon it, leaving the chicks exposed to the wet and cold? early the next morning i saw her on the

perch, wet and bedraggled, her wings and tail fanned to dry out. Then she was back on the nest, a faithful mother.

A female Red-shouldered incubates the eggs for about 33 days. it takes the chicks another six weeks to fledge. The male brings the food to the female and she feeds the young.

One day, i noticed a growth partially obscuring the male’s left eye. i asked bird expert Richard Cannings (dickcannings. com) if a one-eyed hawk could survive.

“Birds can be surprisingly resourceful when saddled with missing legs, eyes or other body parts,” he said. “it might reduce his hunting efficiency but he might make up for it by hunting longer each day.”

This male is older, stroud said. “He

knows the territory. His biggest risk is getting hit by a car on the blind side.”

“Red-shouldered hawks can live 15 years in the wild, if not shot, poisoned or hit by a car,” she said. “Tree trimming in spring is a big problem for the birds,” she said. “ninety-nine percent of big trees have nests in them.” she recounted a recent case where a man cut down a palm then realized there was a Red-shouldered Hawk nest in it. He built a platform and placed the nest with chicks on it. The parents are continuing to feed them.

Right now, the Ojai Raptor Center is being inundated with nestlings, including Red-shouldered Hawks. “everyone is home witnessing nature,” stroud said. “We get 30 to 40 calls a day with people finding birds on the ground.”

If you find a nestling ojairaptorcenter.org offers helpful explanations. Stroud advises taking a picture to see if the chick is far enough in the process of fledging and to look for a parent that may be feeding it.

Many chicks go through a phase called hop flying before they fully fledge. The parents hang around and feed them for a few days through this transition. “if you have a cat,” stroud said, “please keep your cat inside until they fledge.” in our Red-shouldered Hawk nest, two chicks have made it to gawky adolescence. One is ahead of the other in development. It has big eyes and a scruffily feathered head. each day i make a quick visit to see how it is progressing. it is now gazing outward, watching the world. On sunday evening it edged out onto a palm frond like a kid peering off a high diving board. soon it will begin its perilous rite of passage. it will spread its wings and fly or flop out of the nest. Hopefully its parents can help it survive.

Like so many others observing nature during this pandemic, i’ve become invested in the wildlife in my neighborhood. “i am rooting for you,” i whisper.

Public Notices CITY OF CARPINTERIA 5775 CARPINTERIA AVENUE CARPINTERIA, CA 93013 805-684-5405/www.carpinteria.ca.us ORDINANCE NO. 743 AN URGENCY ORDINANCE OF THE CITY OF CARPINTERIA AMENDING ORDINANCE NO. 741 ENACTING A TEMPORARY MORATORIUM ON EVICTIONS DUE TO NONPAYMENT OF RENT FOR COMMERCIAL TENANTS WHERE THE FAILURE TO PAY RENT RESULTS FROM INCOME L O S S R E S U LT I N G F R O M T H E NOVEL CORONAVIRUS (COVID-19), AND SETTING FORTH THE FACTS CONSTITUTING SUCH URGENCY WHEREAS, a novel coronavirus, named SARS-CoV-2 and the disease it causes has been named “coronavirus disease 2019” (“COVID-19”), causes infectious diseases and was first detected in China in December 2019 and has subsequently spread to the United States of America, including California; and WHEREAS, as of May 20, 2020, COVID-19 is easily transmissible from person to person, including from asymptomatic persons, and has spread globally to over 216 countries, areas or territories, infected over 4,893,186 people, and killed more than 323,256 individuals, per the World Health Organization (“WHO”); and WHEREAS, symptoms of COVID-19 include fever, cough, and shortness of breath; and outcomes have ranged from mild to severe sickness and in some cases death. The Centers for Disease Control and Prevention (“CDC”) considers the virus to be a very serious public health threat; and WHEREAS, on March 4, 2020, Governor Newsom declared a state of emergency to make additional resources available, to formalize emergency actions already underway, and to help the state prepare the effects of COVID-19; and WHEREAS, on March 4, 2020, in response to the Governor’s declaration, the County Emergency Operations Center (“EOC”) initiated the COVID-19 incident response for the Operational Area that includes the City of Carpinteria, and the Operational Area EOC is currently activated at Level I (“Full Activation”); and WHEREAS, on March 11, 2020, the WHO declared COVID-19 a global pandemic; WHEREAS, on March 11, 2020, Governor Newsom and California Department of Public Health officials recommended that non-essential gatherings should be postponed or cancelled across the state until the end of March, in order to implement social distancing guidelines intended to protect all individuals, particularly those who are at high risk of severe illness for COVID-19, and to slow further spread of COVID-19; and WHEREAS, on March 12, 2020, California Governor Gavin Newsom issued Executive Order N-25-20 declaring, pursuant to the authority granted in the California Government Code, that the Employment Development Department shall waive the ordinary one-week waiting period for claims for disability insurance and unemployment insurance related to COVID-19; and WHEREAS, on March 12, 2020, Governor Gavin Newsom also declared in Executive Order N-25-20 that the Department of Tax and Fee Administration shall grant up to 60 days relief to any persons unable to timely file their taxes as a result of hardship related to COVID-19; and WHEREAS, on March 12, 2020, the County of Santa Barbara (“County”) Local Health Officer declared a local health emergency exists in the County due to an imminent and proximate threat to public health, within the meaning of Section 101080 of the Health and Safety Code, by the introduction of COVID-19 in the County, and directed local agencies in the County to implement Governor Newsom’s social distancing guidelines; and WHEREAS, on March 13, 2020, the President of the United States declared a national emergency and that the Federal government would make $50 billion in emergency funding available to assist state and local governments in preventing the spread of and addressing the effects of COVID-19; and WHEREAS, on March 13, 2020, all 20 school districts in the County announced they would be closed indefinitely starting Monday, March 16, 2020 in response to COVID-19; and WHEREAS, as of March 15, 2020, the CDC and Prevention issued new guidance encouraging people to avoid gatherings of more than 50 people; and WHEREAS, on March 16, 2020, Governor Newsom declared in Executive Order N-28-20 that the economic impacts of COVID-19 have been significant and could threaten to undermine Californians’ housing security and the stability of California businesses; and WHEREAS, on March 16, 2020, Governor Newsom also declared in Executive Order N-28-20 that many Californians are experiencing substantial losses of income as a result of business closures, the loss of hours or wages, or layoffs related to COVID-19, hindering their ability to keep up with their rents, mortgages, and utility bills; and

WHEREAS, on March 16, 2020, Governor Newsom also declared in Executive Order N-28-20 that any preemption of local police powers related to California Civil Code § 1940 et seq. or § 1954.25 et seq. are hereby suspended as it relates to local jurisdictions enacting moratoria on residential and commercial evictions; and WHEREAS, on March 17, 2020, the California Department of Public Health and County Public Health Department directed all bars, nightclubs, pubs, breweries and wineries to close immediately; and restaurants and other food facilities offering on-site dining should immediately transition to only offering delivery or takeout service as part of the public health effort to slow the spread of COVID-19; and WHEREAS, on March 17, 2020, the City of Carpinteria (“City”) Director of Emergency Services issued a Proclamation of Local Emergency by the Director of Emergency Services for the Novel Coronavirus (COVID-19) Pandemic (“Proclamation”); and WHEREAS, on March 19, 2020, Governor Newsom issued Executive Order N-33-20 instructing all individuals living in the State of California to stay home or at their place of residence, except as needed to maintain continuity of operation of federal critical infrastructure sectors; and WHEREAS, on March 22, 2020, the President of the United States approved California’s request for a presidential Major Disaster Declaration to bolster the State’s COVID-19 emergency response efforts; and WHEREAS, the Carpinteria City Council (“Council”) ratified the Director of Emergency Services’ Proclamation and confirmed the existence of a local emergency relating to COVID-19 on March 23, 2020 (via adoption of Resolution No. 5954), and re-ratified said Proclamation on April 13, 2020 (via adoption of Resolution No. 5956) and on May 13, 2020 (via adoption of Resolution No. 5969); and WHEREAS, on March 25, 2020, Governor Newsom announced support from Citigroup, JPMorgan Chase, U.S. Bank, and Wells Fargo and nearly 200 state-chartered banks, credit unions, and servicers for a 90-day grace period for mortgage payments, relief from fees and charges and a 60-day moratorium on foreclosure sales and evictions; and WHEREAS, on March 27, 2020, Governor Newsom issued Executive Order N-3720 banning the enforcement of eviction orders for tenants of a residence or dwelling unit affected by COVID-19 through May 31, 2020. Executive Order N-37-20 prohibits landlords from evicting tenants for nonpayment of rent and prohibits enforcement of evictions by law enforcement or the courts; and WHEREAS, on March 27, 2020, the United States Congress passed and the President of the United States signed the Coronavirus Aid, Relief and Economic Security Act (“CARES Act”); and WHEREAS, Section 4022 of the CARES Act authorize a borrower to obtain a forbearance for 180 days, plus a 180-day extension for federally-backed mortgage loans without accruing interest of fees, and prohibits foreclosures on all federallybacked mortgage loans for 60-days beginning on March 18, 2020; and WHEREAS, Section 4023 of the CARES Act authorizes a similar forbearance on federally-backed mortgage loans for multifamily properties, when the borrower agrees to not evict or charge late fees to tenants for the duration of the forbearance period; and WHEREAS, Section 4024 of the CARES Act prohibits landlords with a mortgage guaranteed, supplemented, protected or assisted in any way by specific federal programs from initiating legal action to recover possession of a rental unit or charge late fees, penalties or other charges to the tenants related to the nonpayment of rent; and WHEREAS, many events across the County are being canceled or postponed due to the orders and recommendations at all levels of government to stop large gatherings amid concerns over the spread of COVID-19, and these cancellations and postponements cause a loss in revenue for the associated vendors, organizations and businesses, loss of income for the people who would have staffed the events, as well as lost revenue for surrounding local businesses that rely on such events to bring patrons to their businesses; and WHEREAS, many businesses in the City are either not permitted to remain open or must severely restrict activities, causing significant adverse financial impacts. Also, state and county orders and guidance calling on residents to stay at home is resulting in a severe decline in consumer spending and tourism, which has had significant negative impacts on revenue for most small businesses in Carpinteria; and WHEREAS, the Council found these conditions warrant and necessitate a temporary moratorium on the eviction of commercial tenants suffering from economic hardship due to of a local emergency to address the COVID-19 pandemic, the state of emergency, or governmental response and enacted Ordinance No. 741 on April 13, 2020; and WHEREAS, Ordinance No. 741 enacted a a temporary moratorium intended to promote stability and fairness within the commercial rental market in the City during the COVID-19 pandemic outbreak, and to prevent avoidable hardship for local

Coastal View News • Carpinteria, California businesses thereby serving the public peace, health, safety, and public welfare and to enable commercial tenants in the city whose income and ability to work is affected due to COVID-19 to remain in their homes; and WHEREAS, although the State and County have entered Stage 2 of the Governor’ Resiliency Roadmap, which loosens some public health and safety restrictions and allows essential and lowerrisk businesses to re-open with certain protections in place, these businesses are expected to still have severely restricted activities and corresponding significant adverse financial impacts; and WHEREAS, Ordinance No. 743 would amend Ordinance No. 741 to extend its temporary commercial eviction protections until the expiration of Executive Order N-28-20 on May 31, 2020, unless the Governor of the State of California extends Executive Order N-28-20 or the effect of that order is extended by the Governor, or until the conclusion of the Repayment Period as defined in Section 4.B of Ordinance No. 741.

NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF CARPINTERIA AMENDS ORDINANCE NO. 741 TO READ AS FOLLOWS: SECTION 1. Incorporation of Recitals.

The Council hereby finds that all of the foregoing recitals and the staff report presented herewith are true and correct and are hereby incorporated and adopted as findings of the Council as though fully set forth herein.

SECTION 2. Findings. The Council hereby finds, determines and declares that this urgency ordinance adoption pursuant to Government Code section 36937 is necessary because: A.Commercial activity and businesses are essential to a vibrant and healthy c o m m u n i t y, a n d t h i s t e m p o r a r y moratorium promotes stability and fairness within the commercial rental market as businesses have been substantially impacted by orders to “stayat-home” and limitations on operations and hours; and B.Without the imposition of this urgency ordinance, there is an increased risk of a substantial impact to our local businesses, causing further disruption by delaying local economic recovery, and imperiling the lives or property of inhabitants of the city; and C.For the immediate preservation of the public peace, health, and safety, the Council finds that it is necessary to adopt an ordinance regulating commercial evictions, for all of the reasons set forth in the recitals above, which are incorporated herein by reference.

SECTION 3. Urgency Need. Based on the foregoing recitals and findings, all of which are deemed true and correct, this ordinance is urgently needed for the immediate preservation of the public peace, health, and safety. This urgency ordinance shall take effect immediately upon adoption in accordance with the provisions set forth in Government Code section 36937.

SECTION 4. Temporary moratorium on commercial evictions. The Council does adopt the emergency regulations relating to commercial evictions where failure to pay rent results from impacts resulting from COVID-19 as more specifically set forth below: A. A temporary moratorium on eviction for nonpayment of rent by commercial tenants impacted by the COVID-19 crisis is imposed as follows: 1.During the period of local emergency declared in response to COVID-19, no landlord shall endeavor to evict a commercial tenant in the following situations: (a) For nonpayment of rent if the commercial tenant demonstrates that the commercial tenant is unable to pay rent due to financial impacts related to COVID-19, the state of emergency, or government response; or (b) For the commercial tenant’s refusal to enter into or otherwise agree to a payment plan or agreement requiring the tenant to pay all or some of rent due during the period of local emergency declared in response to COVID-19; or (c) For a no-fault eviction unless necessary for the health and safety of tenants, neighbors, or the landlord.

2.A landlord who knows that a commercial tenant cannot pay some or all of the rent temporarily for the reasons set forth above shall not serve a notice or otherwise seek to evict for nonpayment of rent.

3.A landlord who knows of a commercial tenant’s inability to pay rent in full within the meaning of this ordinance if the commercial tenant, within a reasonable amount of time, not to exceed seven (7) days after the date that rent is due, notifies the landlord in writing of lost income and inability to pay the full rent due to financial impacts related to COVID-19, the state of emergency or government response. For purposes of this ordinance, “in writing” includes email or text communications to a landlord or the landlord’s representative with whom the commercial tenant has previously corresponded by email or text. Any medical or financial information provided to the landlord shall be held in confidence, and only used for evaluating the commercial tenant’s claim.

B. Nothing in this ordinance shall relieve the commercial tenant of liability for the unpaid rent, which the landlord may seek after expiration of the local emergency and the commercial tenant must pay

C. Enforceability 1.In the event of any violation of this Ordinance by a landlord, such a violation shall be enforceable by the individual tenant in a court of the appropriate jurisdiction in which injunctive relief may be granted, in addition to actual and exemplary damages. In any such court proceeding, the prevailing party shall be awarded his reasonable attorneys’ fees and the court, where applicable, shall be empowered to order treble damages.

2.Nothing herein shall be deemed to interfere with the right of a landlord to file an action against a tenant or nontenant third party for the damage done to said landlord’s property. Nothing herein is intended to limit the damages recoverable by any party through a private action.

SECTION 5. Violations. This Ordinance is an urgency ordinance adopted pursuant to a local, state and national state of emergency. This Ordinance grants a defense in the event that an unlawful detainer action is commenced in violation of this Ordinance. Violations of this Ordinance also shall be punishable as a misdemeanor as set forth in Chapter 1.08 of the Carpinteria Municipal Code.

SECTION 6. Uncodified. This Ordinance shall not be codified.

SECTION 7. Severability. If any section, subsection, sentence, clause, phrase or word of this ordinance is for any reason held to be invalid and/or unconstitutional by a court of competent jurisdiction, such decision shall not affect the validity of the remaining portions of this ordinance.

SECTION 8. Effective Date and Expiration Date. This ordinance shall take effect immediately upon its adoption and continue until the earlier of (1) the expiration of Executive Order N-28-20 on May 31, 2020, unless the Governor of the State of California extends Executive Order N-28-20 or the effect of that order is extended by the Governor, or (2) the conclusion of the Repayment Period as defined in Section 4.B. SECTION 9. Environmental Determination. The Council finds that the adoption and implementation of this ordinance are exempt from the provisions of the California Environmental Quality Act under section 15061(b)(3) in that the Council finds there is no possibility that the implementation of this ordinance may have significant effects on the environment. The ordinance would apply commercial and residential tenant protection measures to existing units in the City, which is solely an administrative process resulting in no physical change to the environment.

SECTION 10. Publication. The City Clerk is directed to cause this ordinance to be published in the manner required by law.

to implement social distancing guidelines intended to protect all individuals, particularly those who are at high risk of severe illness for COVID-19, and to slow further spread of COVID-19; and WHEREAS, on March 12, 2020, the County of Santa Barbara (“County”) Local Health Officer declared a local health emergency exists in the County due to an imminent and proximate threat to public health, within the meaning of Section 101080 of the Health and Safety Code, by the introduction of COVID-19 in the County, and directed local agencies in the County to implement Governor Newsom’s social distancing guidelines; and WHEREAS, on March 16, 2020, Governor Newsom declared in Executive Order N-28-20 that the economic impacts of COVID-19 have been significant and could threaten to undermine Californians’ housing security and the stability of California businesses; and WHEREAS, on March 17, 2020, the CDPH and County Public Health Department directed all bars, nightclubs, pubs, breweries and wineries to close immediately; and restaurants and other food facilities offering on-site dining should immediately transition to only offering delivery or take-out service as part of the public health effort to slow the spread of COVID-19; and

guide (“RISE Guide”) and submitted a written attestation to the CDPH to move further into Stage Two of the State’s Resilience Roadmap; and WHEREAS, on May 20, 2020, the CDPH approved the County’s attestation; and WHEREAS, on May 21, 2020, the County Health Officer issued County Health Officer Order 2020-8.2, which allows essential businesses and lower-risk business that may remain open with modified operations and social distancing to open or open more fully with selfcertification; and WHEREAS, although the State and County have entered Stage 2 of the State’s Resiliency Roadmap, which loosens some public health and safety restrictions and allows essential and lower-risk businesses to re-open with certain protections in place, these businesses are expected to still have severely restricted activities and corresponding significant adverse financial impacts; and WHEREAS, the City Council recognizes the immediate need to enact a temporary permit program (“COVID-19 Outdoor Business Permit Program”) to allow business to operate in City right-of-ways and in other privately-owned outdoor spaces to encourage social distancing and economic activity during the COVID-19 pandemic; and

WHEREAS, on March 17, 2020, the City Director of Emergency Services issued a Proclamation of Local Emergency by the Director of Emergency Services for the COVID-19 Pandemic (“Proclamation”); and

WHEREAS, cities around the State and County are either considering or already have temporarily closed their downtown streets to traffic and authorized essential and lower-risk business to utilize outdoor space to safely serve customers;

WHEREAS, the City’s Proclamation was found necessary and ratified by the City Council at its regular meetings on March 23, 2020 (via adoption of Resolution No. 5954) and re-ratified by the City Council on April 13, 2020 (via adoption of Resolution No. 5954) and May 13, 2020 (via adoption of Resolution No. 5969) in order to utilize all resources necessary to respond to COVID-19 and receive any State and Federal assistance and funds that may be available; and

WHEREAS, the City Council recognizes that a COVID-19 Outdoor Business Permit Program must be flexible and responsive to changing conditions associated with the COVID-19 pandemic, the state of emergency, or governmental response, including modifications to public health and safety directives, social distancing guidance, and business operation conditions, in order to effectively achieve the dual public health and safety and economic goals of the City during the COVID-19 pandemic.

WHEREAS, the Proclamation invokes in the City all powers and mechanisms set forth in the California Emergency Services Act (Government Code sections 8550, et seq.), CMC Chapter 2.40, and all other applicable federal and state laws, and City ordinances and resolutions, to be used by authorized City personnel; and

N O W, T H E R E F O R E , T H E C I T Y COUNCIL HEREBY RESOLVES AND ORDERS THAT:

WHEREAS, on March 19, 2020, Governor Newsom issued Executive Order N-3320 instructing all individuals living in the State of California to stay home or at their place of residence, except as needed to maintain continuity of operation of federal critical infrastructure sectors and additional sectors as the State Public Health Officer may designate as critical to protect health and well-being of all Californians (“essential businesses”); and WHEREAS, many events across the County are being canceled or postponed due to the orders and recommendations at all levels of government to stop large gatherings amid concerns over the spread of COVID-19, and these cancellations and postponements cause a loss in revenue for the associated vendors, organizations and businesses, loss of income for the people who would have staffed the events, as well as lost revenue for surrounding local businesses that rely on such events to bring patrons to their businesses; and WHEREAS, many businesses in the City are either not permitted to remain open or must severely restrict activities, causing significant adverse financial impacts. Also, state and county orders and guidance calling on residents to stay at home is resulting in a severe decline in consumer spending and tourism, which has had significant negative impacts on revenue for most small businesses in Carpinteria; and WHEREAS, on April 13, 2020, the Council found these conditions warrant and necessitate a temporary moratorium on the eviction of commercial tenants suffering from economic hardship due to of a local emergency to address the COVID-19 pandemic, the state of emergency, or governmental response and enacted Ordinance No. 741; and WHEREAS, on May 4, 2020, Governor Newsom issued Executive Order N-60-20, which is incorporated herein by reference, to allow re-opening of lower-risk business and spaces (“lower-risk businesses”) in Stage Two of the State’s Resilience Roadmap subject to certain limitations; and WHEREAS, on May 8, 2020, the County Health Officer issued Santa Barbara County Health Officer Order (“County Health Officer Order”) 2020-8.1, which further clarifies the lower-risk businesses eligible to be open for limited operations within the County; and WHEREAS, the State’s Resilience Roadmap provides for county variances where counties meeting certain health metrics published by the CDPH may submit a written attestation to the state that allows a qualifying county to progress further into Stage Two; and WHEREAS, on May 18, 2020, Governor Newsom and the CDPH announced modified health metrics to submit a written attestation; and WHEREAS, on May 18, 2020, the City Council enacted Resolution No. 5977 establishing City requirements for wearing face coverings at certain places and in certain circumstances as an additional health protection measure in response to the COVID-19 pandemic in order to protect the public health and safety of members of the public; and WHEREAS, on May 19, 2020, the County Board of Supervisors approved the Reopening in Safe Environment – RISE

Section 1. Incorporation of Recitals.

All the recitals set forth above are true, correct, and valid, and are hereby incorporated and adopted as findings of the City Council as though fully set forth herein.

Section 2. Findings. The Council hereby finds, determines and declares that this Urgency Ordinance adoption pursuant to Government Code section 36937 is necessary because: A.Commercial activity and businesses are essential to a vibrant and healthy community, and this COVID-19 Outdoor Business Permit Program provides flexibility to local businesses to re-open while protecting the health, safety and welfare of members of the public; and B. Without the imposition of this Urgency Ordinance, there is an increased risk of a substantial impact to local businesses, causing further disruption by delaying local economic recovery, and imperiling the lives or property of inhabitants of the City; and C.Carpinteria Municipal Code (“CMC”) Chapter 12.08 and Downtown “T” Encroachment Permit Guidelines establish a permit program for local businesses within the Downtown “T” District to apply for and receive an encroachment permit to conduct certain business operations in the City’s rightof-way that provide a framework for the portion of the COVID-19 Outdoor Business Permit Program applicable to the City right-of-way and other privatelyowned property, but require certain modifications to streamline the approval and implementation of permits with all due speed during the COVID-19 pandemic.

D.CMC Chapter 14.64 establishes a temporary use permit to allow businesses to engage in temporary uses on privately-owned property that provides a framework for the COVID-19 Outdoor Business Permit Program applicable to privately-owned property, but requires certain modifications to streamline the approval and implementation of permits with all due speed during the COVID-19 pandemic.

E.The City Council recognizes that— to encourage the return of robust economic activity with social distancing measures in place during the local emergency due to the COVID-19 pandemic—the COVID-19 Outdoor Business Permit Program may require that certain temporary exceptions to the requirements of CMC Chapter 12.02, the Downtown “T” Encroachment Permit Guidelines and CMC Chapter 14.64 may be necessary, as determined by the Director of Emergency Services through additional rules and regulations, as described in Section 6.

F.For the immediate preservation of the public peace, health, and safety, the Council finds that it is necessary to adopt an Urgency Ordinance authorizing implementation of the COVID-19 Outdoor Business Permit Program, for all of the reasons set forth in the recitals above, which are incorporated herein by reference.

Section 3. Urgency Need. Based on the foregoing recitals and findings, all of which are deemed true and correct, this Urgency Ordinance is urgently needed for the immediate preservation of the public peace, health, and safety. This Urgency Ordinance shall take effect immediately upon adoption in accordance with the provisions set forth in Government Code section 36937.

S e c t i o n 5 . Te m p o r a r y C O V I D - 1 9 Outdoor Business Permit A. Use of City Owned-Property. The City Council directs the Director of Emergency Services to establish a COVID-19 Outdoor Business Permit Program and process COVID-19 Outdoor Business Permit applications for locations within the City right-of-way consistent with the requirements of CMC Chapter 12.08 and Downtown “T” Encroachment Permit Guidelines that are not in conflict with this Urgency Ordinance. The Director of Emergency Services shall process COVID-19 Outdoor Business Permit applications on the City’s Encroachment Permit form or other application form developed pursuant to Section 6.

B. Use of Privately Owned-Property.

The City Council directs the Director of Emergency Services to establish a COVID-19 Outdoor Business Permit Program and to process COVID-19 Outdoor Business Permit applications for locations on privately-owned property consistent with the requirements of CMC Chapter 14.64 and the applicable provisions of CMC Chapter 12.08 (such as CMC 12.08.130(A)) and the Downtown “T” Encroachment Permit Guidelines that are not in conflict with this Urgency Ordinance. The Director of Emergency Services shall process COVID-19 Outdoor Business Permit applications on the City’s temporary use application form or other application form developed pursuant to Section 6.

COVID-19 Outdoor Business Permit applications on privately-owned property shall include a writing signed by the property-owner authorizing the essential or lower-risk business to pursue said application.

C. General Requirements The COVID-19 Outdoor Business Permit Program shall include, but not be limited to, the following requirements: 1) Only essential and lower-risk businesses authorized to be open under the County Health Officer Order 2020-8.2, as may be amended, and as listed Attachments A, which may be amended as specified in Section 8, may receive a COVID-19 Outdoor Business Permit.

2) All essential and lower-risk businesses must follow social distancing measures, including the completion of RISE Guide selfcertifications.

3) All applications shall include copies of the essential or lowerrisk businesses RISE Guide selfcertification and Social Distancing Protocol as specified in Attachment E to the County Health Officer Order 2020-8.2, as either may be amended.

4) Members of the public and workers shall wear face coverings consistent City Resolution No. 5977 and County Health Officer Order 2020-10 (except while eating), as either may be amended.

5) Access required under the Americans with Disabilities Act shall be maintained at all times.

6) Fire hydrants must remain unobstructed.

7) All businesses must comply with all City noise regulations.

8) Businesses that produce waste, such as food service establishments, must provide conveniently located outdoor waste and recycling receptacles for customers, and the receptacles must be emptied, serviced, and maintained in a manner that does not permit overflow of the receptacle or litter.

9) Smoking is prohibited in the all areas covered by a COVID-19 Outdoor Businesses Permit.

10) Live music and amplified sound m u s t b e p e r m i tte d th r o u g h a n Entertainment License as described in CMC Chapter 5.40.

11) In the event that the Department of Alcohol and Beverage Control (“ABC”) permits a license holder to expand on-site consumption to the portion of privately-owned property covered by a COVID-19 Outdoor Business Permit, the permittee shall comply with all ABC requirements. Alcohol consumption in the area covered by the COVID-19 Business Permit and by the ABC license shall be permissible pursuant to CMC Section 9.08.040(A)(1).

12) At the sole discretion of the Director of Emergency Services, the City may temporarily waive enforcement of commercial property owners’ conditions of approval (such as parking requirements) that would otherwise conflict with implementation of this Urgency Ordinance.

13) The City shall not charge a fee to process a COVID-19 Outdoor Business Permit.

D. Revocability. Notwithstanding CMC Chapters 12.08, 14.64 or the Downtown “T” Guidelines, a temporary COVID-19 Outdoor Business Permit is revocable at any time by the Director of Emergency Services in accordance with Section 11; if a permit is revoked, the permittee, at its own expense, shall remove all facilities and equipment, and shall restore the public right-of-way and/or privatelyowned property to its condition prior to installation.

Section 6. Rules and Regulations.

A.Given the changing circumstances surrounding implementation of the Governor ’s Executive Orders and State’s Resilience Roadmap, California Department to Public Health guidance, County Health Officer Orders, and local businesses’ needs, the City Council authorizes the Director of Emergency Services to promulgate administrative rules and regulations, including but not limited to: application forms, signage requirements and inspection procedures, to effectuate the purpose of this Urgency Ordinance consistent with state and County directives. The Director of Emergency Services may promulgate rules and regulations that allow for temporary modifications of the requirements in CMC Chapter 12.08, the Downtown “T” Encroachment Guidelines, and CMC Chapter 14.64 to promote social distancing measures and to encourage economic activities consistent with the purpose of this Urgency Ordinance.

B.The City Council directs the Director of Emergency Services to coordinate with the County Sheriff’s Office and Carpinteria-Summerland Fire Protection District in the development of Rules and Regulations and for the implementation of this Urgency Ordinance.

Section 7. Appeal. In the event the Director of Emergency Services denies a temporary COVID-19 Outdoor Business Permit, or the applicant for the COVID-19 Outdoor Business Permit disagrees with the rules and regulations prescribed by the Director of Emergency Services, the applicant may appeal to the City Council within ten (10) days after Director of Emergency Services action by filing a written notice with the City Clerk.

Section 8.Amendments to List of Essential and Lower Risk Businesses.

Given the changing definition of essential and lower-risk businesses under state guidance and County Health Officer Orders, the City Council authorizes the Director of Emergency Services to update and amend Exhibit A consistent with amendments to the County Health Officer Order 2020-8.2 or related County Health Officer Orders.

Section 9. Enforcement and Violations.

Violations of this Urgency Ordinance constitute a threat to public health, safety, and welfare, and may result in (1) an immediate revocation of a business’ COVID-19 Outdoor Business Permit, (2) an immediate business license suspension and mandatory closure for the duration of the Urgency Ordinance, and/ or (3) citation for misdemeanor offense as set forth in Chapter 1.08 of the Carpinteria Municipal Code.

Section 10. Severability. If any section, subsection, sentence, clause, phrase or word of this Urgency Ordinance is for any reason held to be invalid and/or unconstitutional by a court of competent jurisdiction, such decision shall not affect the validity of the remaining portions of this Urgency Ordinance.

S e c t i o n 11 . E f f e c t i v e D a t e a n d Termination. This Urgency Ordinance shall become effective immediately and shall continue until the earlier of: (1) it is terminated by the City Council or (2) the conclusion of the local emergency or (3) thirty (30) days after the State of California enters Stage Four of the Resilience Roadmap.

Section 12. Scope. This Urgency Ordinance does not expand the definitions of essential or lower-risk business under County Health Officer Order 2020-8.2, as may be amended. All essential and lower-risk businesses and persons also shall comply with all social distancing measures and directives.

Section 13. Environmental Determination. The City Council finds that the adoption and implementation of this resolution are exempt from the provisions of the California Environmental Quality Act (“CEQA”) under CEQA Guideline section 15061(b)(3) in that the City Council finds there is no possibility that the implementation of this resolution may have significant effects on the

environment. The Urgency Ordinance would apply a COVID-19 Outdoor Business Permit process, similar to existing permit processes, which is solely an administrative process resulting in no change to the environment.

SECTION 14. Publication. The City Clerk is directed to cause this Urgency Ordinance to be published in the manner required by law.

Valley Villages

In “La Carpinteria” (1960), Georgia Stockton writes that early Carpinteria Valley residents lived in villages. She uses the term, villages, in the way that one might think of the Chumash or Canalino peoples living in the Valley predating California statehood. But Stockton’s usage is for the settlers after statehood, both the “Americanos” and the “Californios” who were homesteading or buying into the Valley.

By the 1880s, the Carpinteria Valley from the Rincon to Ortega Ridge was like one big village made up of clusters of smaller villages. There were the settlers in the Casitas Pass and Rincon areas to the east. There was a settlement called La Serena to the west, founded and named by Milton Smith who with his brothers, Frank and Solon, built a wharf that permitted commerce in and out of the Valley. The middle of the Valley was called “la llana grande,” the big plain, with its population mostly concentrated near Santa Monica Creek. This area had a strip of shops along a road described as the top edge of the salt marsh. There were blacksmith shops, barbers, saloons, dry goods stores, and a cemetery in this stretch.

Unfortunately, no pictures of this shopping center are known to exist. The Thurman saloon and dry goods store, established in 1875, was particularly important. It was a multi-story red brick structure that also housed the Carpinteria Post Office and served as a stagecoach stop. This led Stockton to write, “Thus, Old Town became the center for all the Valley, both Spanish and American” (p.

58). About 10-15 years later, Summerland was added to the list of villages, the population lured by Spiritualism, and jobs aplenty thanks to the discovery of natural gas and oil deposits.

The settlers’ villages within the bigger overall village had identifying markers.

Each had an elementary school: The Rincon School (1874) along Carpinteria Creek; the Carpinteria School (1858) adjacent to Santa Monica Road on Upson Road; the Ocean View School (1873) in La Serena; and, Summerland School (1890) in Summerland. Each had the legal services of a judge: First, there was Solon Smith in La Serena; Melvin Snow in Summerland; and, a variety of men from la llana grande to the Rincon. Ultimately, some of the villages had a claim to be the main township in the Carpinteria Valley. For example, La Serena had the commercial shipping center, and Summerland, the best grade of Black Gold, the oil.

Regarding Serena, Albertina Rodriguez writing in the Carpinteria Herald (Jan. 30, 1969) had this to say, “They thought Serena might become the main town at one time and so a post office was built there. When the railroad came through, it changed everything.” Indeed, the Southern Pacific Railroad coming through Carpinteria and stopping at the train station built at the foot of Linden Avenue (1887) changed everything for

It is interesting to consider that Summerland, a community that at various points of its history tried to incorporate itself into Carpinteria, may have had the best claim for becoming the main township in the Valley. When Summerland struck oil, it became the wealthiest village. Every amenity that Carpinteria had, Summerland acquired in the 1890s, even a regular newspaper that also served Carpinteria. The Courier was based in Summerland. A souvenir edition in February 1900 by The Summerland “Advance-Courier,” fully illustrated, is one of the best historical Carpinteria Valley references up to that point in time.

Carpinteria villages, in contrast, did not have a regular newspaper until 1911, when the Carpinteria Valley news was established.

After the county issued the greenlight to hair salons and barbershops to reopen, Yudith Salon customers rushed to make appointments to freshen up their dos. With stylists and customers wearing face coverings throughout the salon, Carpinterians have been keeping Yudith stylists busy providing quarantine trims.

Traveling Pants toy and clothing store has reopened with regular hours Tuesday to Saturday 11 a.m. to 5 p.m. “We have plenty of gently used clothing for the growing kiddos,” said Susan Solano, store owner, “We also have a nice selection of used books, puzzles and other educational items.”

Summer clothes, swimwear and beach toys are all available at Traveling Pants. The shop’s toy section is bigger than ever before, featuring Melissa and Doug and Toysmith new toys and customers can gift wrap their purchases at no extra charge. “Our handcrafters have provided us with a fresh supply of super-cute handmade items,” said Solano. “We’re happy to be back and looking forward to seeing everyone soon.”

Island Packers Cruises relaunches public boat transportation

Island Packers, the authorized boat transportation concessionaire to Channel Islands National Park, has resumed limited public transportation to the Channel Islands for all landing and nonlanding trips.

On June 1, Island Packers began offering public boat transportation to Santa Cruz, Santa Rosa and Anacapa Islands for both day visitors and campers from Ventura Harbor Village and Oxnard Harbor with three-hour island wildlife trips and six-hour whale watching trips. Although reservations are being accepted, current conditions necessitate that all transportation plans could be subject to change.

In response to health concerns, Island Packers has revised several procedural protocols designed to keep visitors to the Channel Islands safe and comfortable.

These revisions to their office and vessel operations including limiting passenger loads to under 40 percent capacity; health screening employees and passengers; sanitization of vessels; and PPE for all staff.
