Cannabis taxes bring county needed funds for crisis relief

The Covid-19 pandemic has caused the worst economic conditions since the Great Depression. Businesses and furloughed employees do not suffer alone.

Government agencies preparing for the next fiscal year are projecting massive revenue losses now and into the future, jeopardizing public services that are desperately needed during this emergency.

In Santa Barbara County, the cannabis industry has emerged as a bright spot that will allow the continued operation of critical government services during the dual crises of a public health emergency and near economic shutdown.

Since implementing its tax on cannabis businesses in 2018, Santa Barbara county has collected nearly $20 million from cannabis farms.

State grants temporary protection to Central Coast mountain lions

Southern California and central coast mountain lions have been placed under the protection of the California Endangered Species Act (CESA) while they are being considered as candidates for permanent protection under the law. The California Fish and Game Commission approved the protections unanimously on April 16.

The Commission received more than 1,000 comments from residents throughout the Central Coast in support of a recent determination by state wildlife officials that protection under CESA may be warranted. Additional letters of support were signed by five state senators and assembly members as well as almost 100 environmental and wildlife organizations throughout the state.

The vote initiates a peer-reviewed study of these specific mountain lion populations, conducted by the Department of Fish and Wildlife, to be concluded within one year. The Commission will then host another hearing to determine whether to formally protect the mountain lions as an endangered or threatened species.

Research shows that these mountain lions, the last of the region’s large carnivores, could face extinction in less than 50 years. As they struggle to adapt to the increased frequency of wildfires and drought, populations in Southern California and on the Central Coast are being profoundly impacted by the expansion of human activity across the landscape.

What remains of their original range has been carved up by development and highways, isolating family groups on shrinking islands of habitat where they are increasingly exposed to rat poisons, poachers and vehicle collisions, and killed because of conflicts with unprotected livestock.

Protection under CESA makes consideration of the survival of mountain lions part of planning decisions for projects proposed in mountain lion habitats. It would require state and local decisionmakers to ensure that core habitats are protected and that vital connections between populations suffering from isolation are preserved or restored.

The listing would not necessarily block development in mountain lion habitat, but it would require developers to evaluate the environmental impacts of their projects and to impose measures to reduce or avoid significant impacts to lions and their habitat.

Listing under CESA would also prompt a reevaluation of the widespread sale and use of second-generation anticoagulant rodenticides in mountain lion habitat.

This can spread through the food web as other predators and scavengers eat contaminated animals. Biologists have documented the presence of anticoagulant rodenticide compounds in 21 out of 22 local mountain lions they tested, including a three-month-old kitten.

While hunting mountain lions has been illegal in California since 1990, nearly 1,800 mountain lions have been killed legally in the state over the last two decades. State wildlife officials can issue depredation permits to kill a mountain lion that has presumably injured livestock or pets.

“One of only two radio-collared breeding males in the Santa Monica mountains was killed this year under a depredation permit,” said Rebecca August, director of advocacy at Los Padres ForestWatch. “Protecting these cougars as an endangered species will provide stronger incentives for landowners and biologists to work together to avoid wildlife conflicts.”

Mountain lions have lived in California for tens of thousands of years. They are a keystone species that act as “ecosystem engineers.” They keep prey populations—especially rodents—in check and their kills provide food for scavengers like the critically endangered California condor. Their presence helps maintain diverse habitats that support a multitude of fish, amphibian, reptile, bird, mammal, insect and invertebrate species.

“In these regions, we have already witnessed the disappearance of the gray wolf and the California grizzly bear from our landscape,” said August. “Taking steps to ensure that mountain lions do not follow in their path is not only wise, it is critical.”

Non-congregate shelter will serve South County

A non-congregate shelter has opened in the city of Santa Barbara for elderly and medically vulnerable persons experiencing homelessness who do not have the ability to practice physical distancing or self-isolate. The purpose of the shelter is to protect the most vulnerable community members. Persons experiencing homelessness are more likely to have complications from COVID-19 leading to hospitalization and intensive care.

A task force including county and community partners has been working with street outreach workers and service providers to identify persons currently living in emergency shelters and who are unsheltered.

“The opening of this shelter site means that some of our most vulnerable community members will have a safe space to practice physical distancing and be protected from Covid-19 exposure” said George Chapjian, Santa Barbara County’s director of community services. “Our task force is committed to protecting the health and well-being of all people experiencing homelessness.

Working collaboratively, we have taken an important step in slowing the spread of this virus in our community.”

A note on masks

I started up Franklin trail on Monday at 3 p.m. and Tuesday at 8 a.m., trying to find the best time to practice social distancing. Since the recommendation to wear face coverings was posted, I have indeed come across hikers who use them; unfortunately, the great majority carries a mask in hand or around their neck.

This begs the question, what are they wearing a mask for? Whether to protect themselves from aerosolized Covid-19 or to protect others from their own possible aerosolized Covid-19 wearing a mask the entire time is crucial.

When mask carriers encounter another person, they lift the mask over their mouth and/or nose using their hands.

The CDC advises that, “Individuals should be careful not to touch their eyes, nose and mouth when removing their face covering and wash hands immediately after removing.” There is no opportunity to wash hands immediately while hiking. Placing and removing a mask each time one passes another individual increases the risk of infection as hands touching the mask are in close proximity to the areas mentioned.

I urge Carpinterians to wear a mask properly. Or—if they choose not to wear one while hiking—to maintain a six-foot distance between themselves and others, volunteer to step aside and turn away 90 degrees from fellow hikers.

Similarly, Covid-19 can only enter through the eyes, nose and mouth—not through skin. Gloves will not protect you from Covid-19 and are ineffective if not disposed of using surgical technique. If you are wearing gloves and then touch your mask, face, phone or wallet, the gloves are offering no added protection.

When used incorrectly, masks and gloves can be a great danger as they provide a false sense of security, and thereby pose a possible increased risk of infection.

Albertsons implements precautions

I’ve just returned from grocery shopping at the Albertson’s across the street from me, and I have to say I am impressed. I was greeted at the door by a very nice man in mask and gloves who cleaned my cart for me. Once inside, I noticed that the aisles are now marked one-way. Of course, there are a couple of people who either can’t read or choose not to follow directions, but still. And in line, another nice gentleman made sure we kept the required distance apart. You are not allowed to put your items on the conveyor belt until the previous shopper has totally completed their transaction.

All workers that I saw had on masks and gloves. The cashier, as always, was very nice, and I made sure to thank all of them for their service. Kindness matters.

Kindness, despite uncertainty

Covid-19 has brought on a level of uncertainty and has thrown us all into a “new” normal. Throughout the last several weeks, our community has practiced “shelter in place,” social-distance learning and changed how we do business. Through it all, the Carpinteria community has continued to support one another. The free flowers from local growers has brought about smiles, local restaurants share their love through their food and our local nonprofits have gone above and beyond to provide needed resources. Thank you to all of those who have stood up to help and support, we truly are all in this together.

Taurus Protection Inc. is offering free security checks to Carpinteria businesses.

Company provides free business security checks

In times of economic insecurity, minor crimes like theft and vandalism tend to rise.

A local security company has started offering free security checks to Carpinteria businesses during the Covid-19 shutdown. With most of their regular clients in hospitality, Taurus Protection Inc.’s contract load suffered a steep decline. To keep some of their security force on payroll, they decided to offer free security checks to local businesses.

Taurus Protection owners Tom Roberts and Shane Quartaro said they wanted to keep their team employed and do something that would help the community. Roberts has a military background and Quartaro is a retired Los Angeles deputy sheriff with 30-years’ experience in the security industry. The two started Taurus Protection last year.

Patrol checks are conducted daily, usually in the evening when businesses are closed. Officers create a detailed report after each check, including photos, and send those to clients by email.

The company checks that doors are secure and lighting appropriately fixed. If lighting is out and its dark, they let clients know. They also check for suspicious cars around the property.

Natural History Notes

In 1993 and 1994 about 21 pups were attacked and killed at night in the rookery. Fearing it was a dog, several Sealwatchers spent nights on the bluff hoping to stop the attacks. Forensic studies at the Santa Barbara Museum of Natural History established a coyote, rather than a dog, was responsible, at which point there was debate whether to let natural events occur. In fact, there’s reason to think this was unusual behavior, since there are many coyotes around and we know of no other coyote attacks before or since.

Disturbances

On at least two occasions the seals were stampeded to the ocean by beachwalkers. A man taking photos on the beach ran away when confronted; Sheriff’s deputies were called. .

Schoolboard meets online, addresses pandemic impacts and plans for the future

Observing social distancing mandates, the Carpinteria Unified School District School Board met online on Tuesday, April 14. Superintendent Diana Rigby began the meeting with a report of school responses to stay-at-home orders, and updated the board on Measure U projects.

The superintendent thanked the entire CUSD community—parents, teachers and staff—for their patience and perseverance through the initial weeks of Covid-19 impacts, and reported that more than 500 lunches had been served by cafeteria staff since schools were closed on March 16. Rigby also acknowledged the Carpinteria Education Foundation for donating funds to provide internet hotspots and computers to students who needed them, and expressed appreciation for the recently established 93013 Fund.

With California Governor Gavin Newsom recommending school closures for the remainder of the academic year, Rigby laid out the plan of instruction for each grade level for the balance of the school term. All classes will be held online each weekday for grades three through 12.

Students in TK/kindergarten through second grade will get weekly packets to work on at home.

Counselors and START therapists will provide remote counselling, and the district will continue using Parent Square to communicate with parents and guardians on class details via email. Rigby stated that district operations would be “continuous,” including weekly grounds maintenance. Office workers and IT personnel will be on call, and Instruction Assistants will receive professional development. The district has a new coordinator for food service, Rigby announced, and library/media tech staff will provide support to teachers.

The superintendent said she planned to notify employees of any changes to her plans of action as conditions change. She also noted that custodians have cleaned and disinfected the schools, and that they will likely not return until schools reopen. CUSD has provided staff with expanded sick leave under Covid-19 relief legislation.

Internet hotspots and laptops provided

Fifty families have been provided internet hotspots and laptops, and 50 more are to be coming online. Rigby said the district is working to connect families with Cox Communications for free internet, but there remain challenges implementing this program through Cox. The district has also collaborated with Carpinteria Children’s Project on weekly food distribution with over 750 grocery bags given out to approximately 500 families.

Board member Michelle Robertson asked if online attendance has been an issue, and the superintendent replied that administrators are keeping track of who isn’t participating in Zoom classes, identifying families who have internet connectivity issues and who need assistance with hotspots. “We’re working as hard as we can,” Rigby said, “to ensure that everybody can participate.”

Board member Rogelio Delgado asked how many students were using hotspots, and Rigby said “Right now we have 50, and we have 25 to 30 who need hotspots.”

The superintendent added that there are

varying levels of tech experience among the teaching staff, but that teachers are collaborating by grade level to help each other. “Principals are observing lessons,” Rigby said, “and providing feedback.

Parents should contact their principal or myself if there is a problem.”

Continuing her report, the superintendent said, “We’re in week number five, and we do have nine more weeks to go…”

Pre-March 13 grades won’t drop

Delgado then asked about the impact the Covid-19 restrictions will have on grading. “We’ve been discussing grading, especially at the high school level,” Rigby replied. “We will hold harmless students for their grades as of March 13,” Rigby stated. “In other words, whatever grade you had on March 13… you can’t get a lower grade.”

The superintendent went on to say that students can elect to receive credit/no credit for their classes, or stick with letter grades. “Students will have until the summer to earn the credits,” Rigby said.

“There is no reason why,” she continued, “that in a school of 615 that any student should be receiving no credit for a class.”

Regarding Carpinteria Middle School, the superintendent said more students struggle to participate online than at the high school or elementary level: “Which doesn’t surprise us, because middle school is where we have our challenges during the regular school session.” Rigby said “research bears this out—the students who are performing at a high level will do fine with online learning. For those students who struggle, and remember 48- to 50 percent of (middle school) students struggle to be at grade level, they will struggle with online learning.”

Rigby offered her appreciation for Aaron LaPlante, “our fabulous IT director.”

She added that in terms of online security, “what has changed with Zoom is that we’ve used a ‘locked’ Zoom protocol.”

The pandemic has reduced the number of daily school lunches served from 1,100 to 150, which will represent a loss to the food service program of “close to $300,000 by the end of June,” according to Assistant Superintendent Maureen Fitzgerald.

Moving on to Measure U updates, the superintendent said that a slight silver lining to the pandemic is that work at Aliso School and CHS on “Phase-two” modernizations will be completed by the 2020-21 school year opening date of Aug. 19.

Board member Jayme Bray asked what the district planned to do to recognize the senior class of 2020, and the superintendent said that the district is currently looking to delay the graduation ceremony until late July or early August. “I feel like Covid-19 has stolen their senior year,” Rigby said, “and I want to make sure that we celebrate—this is a major milestone in their life and it’s a way for our community to make sure they know how proud we are of each and every student.”

Assistant Superintendent Maureen Fitzgerald then presented the board with a resolution authorizing the district to borrow funds for cash flow, an increase of $6.5 million, funded by the sale of bonds. As reported from the school board meeting on April 14, students at Carpinteria High School will not receive a grade lower than what they had earned as of March 13, the last day of on-campus instruction before shelter-in-place orders took effect.

Covid-19 exposes social inequities

Q & A with Eder Gaona of Future Leaders of America

Eder Gaona is the executive director of Future Leaders of America (FLA), an organization dedicated to youth empowerment through leadership training and peer-to-peer mentoring, with the goal of helping youth access their full potential. FLA is part of a coalition of grassroots organizations in Santa Barbara and Ventura counties that form the 805 UndocuFund—a fund established in 2018 to provide emergency relief to immigrant families facing the impacts of disaster with no access to federal assistance programs. Goana spoke with CVN about the UndocuFund and his organization, Future Leaders of America.

CVN: On Wednesday, April 22, the New York Times reported that the Education Department will prohibit colleges from granting emergency assistance to undocumented students, even those currently under federal protection. Thousands of students who attend college under the Deferred Action for Childhood Arrivals—or DACA—program, an Obama-era policy that protects hundreds of thousands of undocumented immigrants brought to the United States illegally as children, will be barred from receiving assistance from the more than $6.5 billion that Education Secretary Betsy DeVos ordered higher education institutions to distribute.

Gaona: With Covid-19, what we’re seeing is that folks with a four-year degree are able to work from home, whereas low-income workers have to risk their lives to earn a living. Covid-19 is exposing the fallacy that everyone has equal opportunities—it’s exposing the flaws and inequities and how the most vulnerable community members in our county don’t really have a safety net to fall back on, whether that’s housing, health care or income.

With undocumented immigrant communities specifically, currently there is no access to stimulus help.

For the longest time, they’ve been the backbone of our economy (in agricultural and service industries). Now you have thousands of people unemployed without any real safety net.

CVN: How does the UndocuFund help the immigrant community?

I realized I was undocumented, as a low-income Latino—an undocumented immigrant in Santa Barbara—a lot of doors closed on me really fast. Part of me felt like I was living two lives: one at school getting good grades, and one at home essentially fearing deportation, and having that realization that I don’t belong here. High school was great, I had great mentors, but when I started engaging in conversations about higher education and said that I was undocumented, the doors were closed. There were staff members at my high school who said, “Well, you’re undocumented, this is it for you.”

Gaona: In the past two years, we’ve distributed over $2.5 million to 1,700 families between South Santa Barbara and West Ventura counties. But Covid-19 is so unprecedented. We’ve had 5,500 signups in both Ventura and Santa Barbara counties from individuals who are seeking financial assistance. CVN: You mentioned education inequalities. How would you reply to someone who says, “Public schools are open to everyone—try hard, do your homework and you can get an education”?

Gaona: Well, that’s a loaded question, but I’ll do my best.

I was born in Mexico, raised in Santa Barbara. I came to this country undocumented when I was four. For the longest time, I grew up thinking I belonged here. But when

CVN: What effects do you see in Latino communities?

Gaona: These educational disparities lead to health disparities, and lead to income disparities, and there are a lot of studies that say they also lead to mental health and wellness disparities. These decisions that are being made for kids at a young age definitely follow them through life—and that’s the educational system. In our county, there’s a difference between the haves and the

have-nots. That’s still the same in 2020.

CVN: How does Covid-19 exacerbate those disparities?

Gaona: Right now, with Covid-19, you have students who might live in a crowded home, they might not have a place to actually do their work, or be on a computer doing the distance learning, or might not have access to broad-band internet to do the distance learning. All of this is playing out right now. We have students in Carpinteria, Santa Barbara, Oxnard, Ventura with similar stories—their homes are crowded, maybe multiple families in a household… and unfortunately, it haunts them in their grades and it follows them in their high school schoolwork.

And Latino kids aren’t always portrayed in the most positive light. Either they’re told they’re lazy, they’re not good enough, or their gangsters. In reality there might be more underlying issues that might be affecting them, including poverty. Instead of being provided support, they’re portrayed in a negative light—I’m not saying that everyone does that, but that’s a general stereotype and it definitely hurts low income Latino students, both men and women.

I feel like that’s part of the issue. On top of not having adequate support or the resources to be able to meet Latino students where they’re at. They’re learning a second language a lot of times, they live in poverty, their parents didn’t go to a four-year school, the parents are barely making it, so there are a lot of barriers stacked against them. If we don’t provide the necessary resources and adequate support systems, then there are definitely going to be cracks that prevent them from fully realizing their potential. Not to mention the institutionalized racism that exists in our systems that add additional barriers.

CVN: Do you have any additional thoughts?

Gaona: I don’t think that it’s fair that undocumented families have to figure out how they’re going to be paying for rent and food just because our government does not want to recognize them as full on residents and citizens of this country, even though they’re investing not only their time, their health, but also their tax dollars into this country. It says a lot about us as a society when we stay silent even though we’re seeing undocumented families, immigrants, struggling to just get by. Covid-19 is going to have long-lasting effects. Cities have eviction moratoriums where tenants are allowed to not pay rent because they’re laid off. But that doesn’t mean they don’t have to pay that money back. It’s scary to think that if our cities don’t take action… there will possibly be a lot of evictions.

County counts five deaths from Covid-19

Five residents of Santa Barbara County have succumbed to the novel coronavirus according to a statement from the county’s Public Health Department on April 21. The most recent fatality was an individual residing in North County who was over 70 years old without underlying health conditions. As of today, there are 429 confirmed cases of Covid-19.

“Our deepest sympathies go out to the family and friends of the individual who passed away. We continue to battle the spread of Covid-19 in our communities and it is imperative that we continue wearing face coverings and keeping physical distance when outside our homes,” said Dr. Henning Ansorg, Santa Barbara County Public Health Officer.

The South County communities of Montecito, Summerland and Carpinteria have 21 confirmed cases of Covid-19.

Countywide, Public Health has tested 2,285 individuals. Negative results were received 1,853 times and three times the tests were inconclusive. The largest demographics currently with diagnosis are 30- to 49-year-olds (152) and 50- to 69-year-olds (150). Nineteen children under 17 have tested positive.

Of the 429 patients, 178 are recovering at home, 42 are recovering in a hospital—13 in an Intensive Care Unit. One hundred and eighty-three patients have fully recovered and 21 are pending an update.

While most cases of Covid-19 exhibit mild or moderate symptoms, the county’s growing case numbers and first deaths from Covid-19 underscore the urgent need for all residents to take extra steps to protect those who are particularly vulnerable to developing more serious illness, including elderly persons and those

chef Randy Randy GRaham Our son, Robert, made a wonderful bowl of miso soup with braised tofu from scratch the other day. No recipe.

No prior thought given to how to make it. He just did it and it was amazing.

I’ve tried to reconstruct it from memory, and I think I got fairly close. I grill the tofu rather than braise it in a pan. I like the grill marks and the slightly charred flavor. I hope you will too!

Ingredients:

12 to 14-ounce block firm tofu 1 cup hot water + 5 cups water 10 tablespoons white miso paste 2 green onions (sliced) 3 ounces shiitake mushrooms (trimmed) 1 medium carrot (sliced thin) 2 cloves garlic (peeled and sliced thin) ½ teaspoon ground ginger 4 large eggs, poached (optional) Crushed red pepper flakes (as a condiment at the table)

Directions:

Preheat grill to high heat (about 550 degrees). Spray or wipe grill with vegetable oil to keep tofu from sticking.

Remove tofu from container and rinse

under cold water. Slice in half horizontally. Place slices on paper towels, cover with more towels and put something heavy on top to help absorb excess moisture. I place a cutting board on top with a couple of cans of crushed tomatoes on top of that for weight. Let sit for 20 minutes so towels absorb as much moisture as possible.

Remove tofu slices from towels. Grill tofu for five minutes per side. You should have nice grill marks by now.

Remove from grill and cut each slice into quarters. You should have eight square slices of grilled tofu (two for each bowl).

Set aside.

Add miso paste to a medium bowl with one cup hot water. Whisk to mix thoroughly. Set aside.

Add green onions, mushrooms, carrots, garlic, ginger and tofu to a medium saucepan along with five cups of water.

Cook on medium heat for seven minutes. Remove from heat and add miso mixture. Stir to combine.

Spoon soup into four bowls. Add poached egg to the top of each bowl (if using). Bring bowls to the table along with crushed red pepper flakes on the side.

Chef Randy has been a vegetarian for over 40 years and eats local and organic grain, fresh fruit and vegetables as much as possible.

He is known locally as the “Healthy Chef.”

With the support of the 93013Fund, Girls Inc. of Carpinteria was able to bring their goal of getting school supplies to children during the Covid-19 era to life. On April 21, volunteers met at the Girls Inc. campus to pack school supply care packages for 500 students. Girls Inc. staff organized the shipments and deliveries and the boxes of basic school supplies should be arriving this week to CUSD students.

“We realized immediately that many parents don’t have basic school supplies that students will now need to conduct activities at home,” said Jamie Collins, executive director of Girls Inc. “We sent out books and worksheets to over 200 families the first week we were closed. We reached out to CARP Growers with the idea to send out supplies and stem kits and the 93013Fund quickly responded with support to drive the idea forward.”

Girls Inc. is still accepting donations to support stem kits to send to families in the district. To donate, contact jamie@girlsinc-carp.org.

City closes beach parking

Beach parking is now closed in the city lots at the end of Linden, Elm, Holly and Ash avenues, as well as in the diagonal parking spaces on Linden Avenue south of the railroad tracks.

By limiting parking, the city hopes to discourage beach crowding. If beachgoers can maintain social distancing then Carpinteria beaches will remain open, according to City Manager Dave Durflinger.

Code Compliance officers are monitoring City Beach and Jelly Bowl Beach to document daily beach use. The city may adjust temporary ordinances based on their observations.

Parking areas will remain closed until further notice, and the signs simply state “Covid-19” at the end-date section.

Many are beginning to feel the strain of life under quarantine, but residents of Silver Sands mobile home park are keeping their spirits up with occasional socially distanced glasses of wine in front of their homes and a shared fire pit. Sands resident Gregory Perea’s neighbor is the muralist Ernie Merlan of the nonprofit Muralism, and Perea asked the artist if he would do a chalk drawing of a sword slicing through the dreaded Covid-19 virus.

“Everyone is quarantined,” Perea said, “and I asked him if he would do it.” Merlan agreed, and Perea shared that he and the other neighbors recently enjoyed another glass of wine together-at-a-distance, watching “Ernie do his thing.” Working as a fire protection specialist prior to caring for his grandmother and mother, Perea said of his Silver Sands community: “We’re keeping everyone’s spirits up.”

A pandemic of beauty and hope sweeps Trillado Street

When Zoe Iverson recently noticed that her Trillado Street neighbors Bob Cochrane and his wife Terri Bowman had put up a light display of a heart and the word “Hope,” she thought she would answer with an artistic gesture of her own by “yarn-bombing” (wrapping an object in yarn) a tree in her front yard.

Iverson learned the technique a couple of years ago, having suggested yarn-bombing the Carpinteria Arts Center courtyard. After wrapping the tree, she moved on to the lamppost out front. She then asked her neighbor Kim Fults across the street if she could wrap a tree in her yard. Clearly on a roll, Iverson then asked the contractor Erik Olson, who also agreed to a yarn-bombing of a tree in his yard.

Using about two skeins of yarn per tree, Iverson brings a splash of color and whimsy to her neighborhood in what are otherwise worrisome days. A number of friends have donated left- over balls of yarn towards the project, including her neighbor Sharrin Cumming, who tied together lengths of unused yarn for the lamppost project. Someone else out there likes what she’s doing as well, because Iverson found a bag of various yarns left in her yard—there was no note, but the intention is obvious: keep going!

Garcia turns paint into food

Pre-pandemic, lety Garcia was focused on painting agaves and urban images both in her home studio and at the linden Studios gallery, as well as teaching an ongoing class to 10 students. Everything has changed over the past six weeks of course, as it has for everyone, everywhere, and Garcia wondered, “How can I be helpful in this time?”

Garcia had previously volunteered with Foodbank of Santa Barbara, and knew firsthand that many children throughout the county get a significant portion of their nutrition from school. “I wanted to help keep the kids fed,” Garcia shared, “and keep the parents’ nerves from being rattled.” So, with completed paintings on hand, Garcia has held three weekly auctions via her Instagram account from which she donates 50 percent to the Foodbank and puts 50 percent towards canvases and supplies for ongoing paintings.

New works are posted each Wednesday, and bidding starts at $275. Garcia has raised $1,000 thus far. “We’ve all been upended…” Garcia said, “but I encourage my students to keep working, and I am going to keep working too—it’s the only thing we can do in this time.”

Postal workers carry on

Despite the pandemic and rampant store closures, postal workers in Carpinteria have been hard at work delivering mail and parcels for their nine routes throughout the city and neighboring rural areas.

The town was abuzz with worry when a sign appeared on the Carpinteria Post Office window on Thursday afternoon, April 16, stating that the location was closed until further notice. The closure was only for a few hours due to understaffing.

Carpinteria’s post office reopened Friday morning promptly at 9 a.m. and has maintained its regular hours since. In need of a break, Carpinteria staff were relieved by clerks from the Goleta Post Office for a few hours on Friday.

Carpinteria’s postal crew includes two clerks and 13 carriers, most of whom continue to work during the stay-at-home order. Mail flow is generally high in Carpinteria where there are no big box stores and many residents make large purchases from Amazon or other online stores. With stimulus checks coming in, residents are making more essential purchases that need to be delivered.

“We’re doing great this week,” said Donette Hicks, postal carrier for one of Carpinteria’s downtown routes. “Our community is so wonderful and generous, they have supplied us with gloves, masks, hand sanitizer, and we get ‘thank yous’ that we don’t usually get outside of Christmas. People are actually coming out and thanking us.”

Hicks said she was happy to be working, especially with her team at the Carpinteria Post Office, “I’ve never worked with better people.” The hardest part of the pandemic for Hicks, like for so many others, “is not being with (her) loved ones.”

The Carpinteria Post Office is open Monday through Friday, 9 a.m. to 5 p.m. and Saturday, 9 a.m. to 1 p.m.

FFA farm animals find temporary homes off campus Story and photoS by debra herrick

When Carpinteria High School closed last month because of Covid-19, not only students were impacted. The school’s dozens of FFA farm animals needed to find temporary shelter where students could continue to care for them. Within days, FFA’s four steers, five sheep, five goats, seven pigs, 20 bunnies and 11 ducks were moved to family farms throughout the Carpinteria Valley.

There are 21 students in the high school’s FFA program that are raising animals this semester. Students purchase the animals with their own money, care for them, and sell them at auction at the Ventura Fair each spring.

When the school let them know that they could no longer be housed on the school farm, they were devastated, according to Sal Lopez, FFA faculty advisor.

“But the students were ambitious that we could carry on and that there were community members who would show up to support them,” said Lopez.

Several local families offered to help the FFA students, and the animals ended up housed nearby at different locations in the community. Rene and June Van Wingerden took the steers to a facility they have on their property for horses.

The goats and sheep found a home on Andy and Kathy Sheaffer ’s land and Frances and Janel Brand took in the pigs.

However, for the Sheaffer and Brand families to house the animals, students had to build their animals facilities from the ground up.

“Building pens for the pigs was probably the most labor intensive,” said Lopez. “It was just a patch of grass and an open field with nothing there, and we only had two days to build the facilities.”

It was just enough time for Lopez and his students, along with parent volunteers, to build a facility with several pens out of dozens of wood pallets that the crew gathered for free from different businesses in the area.

For Lopez, this was a real-life situation that gave students the opportunity to use the skills they learned in school. “It was a lot of labor,” said Lopez, “But my favorite part about building these facilities was that I had taught the students a lot of these carpentry and plumbing skills

And this show of strength and skill is a good sign for these kids and their future, noted Lopez. “Imagine all the industries that will have to adjust to all these changes. These students are also adjusting to these changes and they’re getting prepared.”

This year’s Ventura Fair might not take place, but there’s talk that if the fair is canceled students will be able to complete their projects by selling their animals in an online auction, said Lopez. “Competing in the Ventura Fair is the culmination of their FFA projects,” he said. “Even though there’s uncertainty about the county fair, we’re still striving for the end goal and students will learn from this.”

CHS parents rally to acknowledge seniors’ achievements

With their students facing the loss of milestone events like prom and the ceremony of graduation, Thia Runsbak and other parents of Carpinteria High School seniors wanted to do something to honor their children’s achievements.

“We want to find a way to recognize our seniors anyway we can,” Raunsbak said, whose daughter Kelsey is a CHS senior who participates in theater and cheer, and is looking forward to college in the fall.

Reaching out to fellow CHS parents via Facebook, Raunsbak hatched a plan to have yard signs printed as a first step towards providing some recognition of the long years of academic and athletic effort that Carpinteria seniors have put in.

Bill and Cherie Dayka at Rockwell Printers—whose daughter Karina and son Cameron are also CHS seniors— printed the signs for parents at cost.

There are two versions of the signs in

the CHS colors of red, white and black, each emblazoned with the school’s slogan, “Warrior spirit never dies,” and the words “Carpinteria High School Senior 2020,” or simply “CHS Senior 2020,” respectively.

Runsbak stressed, “everything we are working on is a group effort made possible by a number of parents. When I started the Facebook group, almost everyone asked, ‘How can I help?’” Parents formed a Facebook group “Parents of CHS Class of 2020,” and Runsbak said, “We’ve got more ideas coming—the yard signs were the fastest thing we could do.”

Approximately 70 signs have been distributed so far, and there are 146 CHS seniors. Signs are available for purchase via traunsbak@yahoo.com or through the Facebook group. “We want the seniors to know that we recognize what they are missing out on,” Runsbak said.

Kaela Kelly has been a member of the Homecoming court and a star on the basketball court as well. The pandemic has slowed everyone down, but there is no dimming her future.

Cannabis workers get lunch, restaurants get boost

Within a week of the stay-at-home order and the dine-in service prohibition, CARP Growers member farms had devised a plan to help a handful of their favorite local eateries “keep the lights on.”

Participating farms started a regular lunch order for hundreds of workers on their cannabis facilities.

Twice a week, a dozen CARP Growers farms offer a free catered lunch to their workers from The Food Liaison, PeeBee & Jays, Rincon Brewery or Delgado’s.

“The program, called “Keep the Lights On” P SUEY (KTLO) is to support restaurants and was motiCKEN vated mainly by hearing stories of the immense CKEN struggles restaurants faced,” said Peter Dugre, CKEN executive director of the nonprofit organization CARP Growers. “The plug was pulled on busi1025 PASS RDand nesses overnight, andCASITAS it was heartbreaking RD distressing.”

In an interview with filmmaker Larry Nimmer for the city of Carpinteria, Jessica Clark, owner of PeeBee & Jays, said that KTLO had saved her business. Jason Steffenauer, general manager of Rincon Brewery, agreed that the impact of having a regular order has been monumental. “It’s been great having that guaranteed business before we even open for the day,” said Steffenauer. “It’s a good starting point to get the day off and running and put some money in the bank.”

Immediately following the shutdown order, Rincon Brewery had to lay off most of their employees. Overnight the Carpinteria brewhouse went from 50 regular staff to just two. With the help of KTLO, they were able to bring back 10 employees. “It’s been helpful to allow us to keep moving and get some of our people back working,” said Steffenauer.

unpredictable wilderness chuck graham She chirped defiantly at the aerial assault. A low-flying American kestrel had a bead on her kits, a couple of cheeky, tiny, and unaware Nelsons antelope ground squirrels.

The mom appeared like the savvy grassland stalwart that she was. Her cheeks were full of seeds and shards of grasses, her tummy was full of milk, evident by her 12 exposed black teats as she stood tall and unwavering when the kestrel swooped in near her burrow.

I had crawled to within 15 feet of their maze of burrows, and watched as the squirrel stood with nary a flinch while the kestrel buzzed over her. It was late in the afternoon and other than an aerial predator seeking out ground-dwelling prey, all was quiet on the Carrizo Plain National Monument. I was well into my second day on the grasslands, a peaceful place to be during an uncertain pandemic.

I’d arrived the morning before, not sure what to expect on the Carrizo Plain, which is as good a place as any to social distance. However, I was surprised to find folks hunkering down, some looking like they were there for the long haul.

There were the unsavory, the fearful and some searching for spring wildflowers—a sign of hope during what sometimes I’m sure feels for some like hopelessness.

Padrone Spring

The 3-mile-long dirt road serpentines west from the grasslands, reminding

Nelsons Antelope Ground Squirrel kits stay close to home. me the National Monument possesses more than the sweeping veldt. Mountain ranges east and west border either side of the Carrizo Plain, and they were proving to be safe havens for anyone seeking refuge from the pandemic. Virtually every dirt pullout someone was car camping.

Fortunately, the road narrowed all the way to the rear of the threadlike canyon and its spring. The last car I saw was a mile behind me, so I backed my truck into the canyon where it dead ended. A grand view of the foothills and mountains of the Temblor Range unfolded before me. Behind me I heard a gurgling spring, recent spring rains filling open book-shaped ravines. Prevalent birdsong also hung in the air, the flowing spring perpetuating a lifeline for feathered dwellers.

A quick hike up the canyon beckoned.

Game trails meandered in all directions, but most trailed closely to the spring that ebbed between eroding badlands. The water tasted good as I swiftly scrambled atop the badlands and onto a rolling plateau. I was instantly stunned by the wildflower display. It was midafternoon and some wildflowers are only open then such as California poppies, but this time it was cream cups, maybe the best splash of that grassland flora I’d ever seen on the Carrizo Plain. The cream cups were also enhanced by carpets of goldfields, stands of owl’s clover and curling fiddleneck.

The diversity of the National Monument was also in abundance. Gazing to the east were rolling foothills, broad valleys, vast grasslands, the daunting San Andreas Fault and Temblors. Patches of goldfields accentuated the rugged landscape, the vertex of Padrone Canyon proved to be the ideal stage to marvel at all the varied contours of the National Monument.

Slowing down and relaxing didn’t hurt my birding opportunities either. Yellowrumped warblers, house finches, western bluebirds, Le Conte’s thrasher, northern harrier, ravens and a covey of quail were hustling to forage and tend to active nests hidden in the junipers and coyote bush.

Wildlife Wary

The first half of the next day began slowly. Either I was thoroughly unlucky and/or everything was bedded down in the cool air. Camera and binoculars were in my lap as I poked along in my truck on unsung dirt roads.

It wasn’t until 3 p.m. that I started to see some of the Carrizo Plain’s inhabitants move around. There was a solitary pronghorn antelope that played chicken with my truck before it walked around to the right within arm’s reach. There was a small band of tule elk way out on the eastern horizon already bedded down. There

was a pair of red-tailed hawks, one pinning down a desert cottontail on an old wooden post, the other raptor wondering when its turn would come. Black-tailed jack rabbits, coyotes and a ferruginous hawk also swept the afternoon away.

However, it was the Nelsons antelope ground squirrel and her steely poise that did it for me. I sat there for a good hour until she galloped off. I could see her 50 yards away still feeding and watching.

Then one of her kits popped out of their burrow but only momentarily. I didn’t see any threat, but its mom belted out a piercing chirp and the ping pong ball-sized kit dove back into its burrow.

I pitched my tent not far from where their burrow lay hidden in the grasses.

A half-moon and my headlamp lit up the immediate expanse. Just after dusk, nocturnal creatures came out of their burrows, mostly a platoon of giant kangaroo rats, but also a couple of kit foxes. Despite the ruckus I easily dozed, never a problem in the wide-open expanse.

What the Carrizo Plain lacked in activity during the first half of the day, it more than made up for well into the early evening, allowing me to drift away from the pandemic that seemed in the moment so far away.

CHS alum shine in Ventura College football

With the April NFL draft and its array of college stars on display, another group of talented Carpinteria High School alumnus have also been shining in recent years at Ventura College. Back in February of this year, it was announced that Michael Garibay (class of ‘17) had accepted an academic and athletic scholarship to play football at Howard Payne University in Brownwood, Texas. “If you play football, you know that’s what Texas is known for, if you want to call yourself the best, you have to play with the best,” said Garibay, who dreamed of playing in the Lone Star state.

Garibay, nicknamed “Mikey” in high school, played both basketball and football for the Warriors. He played four years of football at Carpinteria at the defensive back position, where as a sophomore he helped the JV squad become co-champions of the Tri-Valley League with Bishop Diego and Fillmore. Garibay played quarterback for the varsity team his junior and senior years, but early in his senior season, coach Henry Gonzales took him aside one day and “he just said at the next level with your height and skill set, you’d be playing more of a receiver-likecorner(back) position, how about we move you (from quarterback),” explained Garibay.

At the time, he was unhappy with the decision, but it proved to be a good move.

He gained experience playing running back and lined up in different positions on the offense and special teams to take advantage of his speed. Garibay never looked back, and then headed down to Ventura College where he played one year at cornerback. He missed the 2018 season because of an injury, but was a part of the Pirates team that went all the way to the State Football Championship game.

After beginning the spring semester at the Texas university, Garibay went back to Carpinteria to see his parents during break.

While he was home, the Covid-19 virus was beginning to spread throughout the country, and his flight back to Texas was canceled. But Garibay, who’s studying Athletic Training, still receives instruction online, and is also involved with football training through Zoom sessions. “People from Carpinteria, being a small town, sometimes can feel like they’re stuck in their little bubble, but if you work hard enough, you can make your dreams a reality,” said Garibay.

While playing quarterback for the Warriors, Garibay often threw to class of 2016’s Brandon Jordan who played at wide receiver. Jordan decided on Ventura College as well, playing football for the Pirates the year before Garibay came aboard. “Jordan had a really good freshman season there, I’d go to the games, and after we’d end up talking, and that’s how I ended up going to Ventura,” said Garibay.

And, in December of 2018, Jordan was a key member of the squad that played for the state championship. The sophomore receiver caught three touchdowns in the game, as the Pirates came up short in a 40-35 loss to Laney College. Two weeks earlier, Jordan led his team to the Southern California Football Association Championship, earning MVP of the game honors in a 31-21 win over Riverside. Around that time, he received offers to play football at Fresno State, Iowa State and Louisville.

CHS class of 2019’s Alberto Arroyo and Brady Sturdivan also chose Ventura to continue their football journey at the next level.

Arroyo made a huge impact last season, being named All-American as a placekicker, while setting a single season scoring record at the college. Sturdivan sat out last season, but this year he could be the next Warrior to don the Pirate colors.

COASTAL BUREAU OPERATIONS APRIL 12 – 18

Monday, April 13

7:04 p.m. / Trespassing / 4000 block 9th Street

A woman requested that a report be taken to document an unknown subject that was found on her property without her permission. The subject fled when confronted.

12:25 a.m. / Hit and Run / 500 block Linden Avenue

Deputies responded to a convenience store for a report of a hit and run. Upon arrival, severe property damage was observed in front of the business along the sidewalk. Deputies followed oil marks to an address in the 5000 block of El Carro Lane, where the suspect’s vehicle was located with oil leaking and severe damage parked in the middle of the street.

Outside the vehicle, several shoe prints in oil led into the residence. A man was located inside the residence and determined to be under the influence of alcohol and a controlled substance. He denied driving the vehicle but admitted to drinking alcohol earlier in the evening. The man’s girlfriend, who lives at the El Carro address, confirmed the shoes belonged to the man, and that the vehicle matched the description of the one he is known to drive. The man consented to a blood draw and was transported to Cottage Hospital. He was then transported and booked at Santa Barbara County Jail.

Tuesday, April 14

10:26 a.m. / Trespassing / 5000 block Carpinteria Ave.

A manager located a subject inside a room without permission. The suspect fled the area towards Arbol Verde. Deputies checked the area but were unable to locate the suspect. Deputies were contacted and advised of the suspect’s identity.

5:51 p.m. / Stolen Property / 1000 block Casitas Pass Road

A man located his stolen bicycle outside a pharmacy on Casitas Pass Road. He provided receipts with the bicycle’s serial number listed. The man also provided his initial case number for the stolen bicycle report. Deputies used bolt cutters to remove the bicycle lock attached. The bicycle was subsequently returned to the man.

Wednesday, April 15

5:21 p.m. / Vehicle damage / 900 block Concha Loma

A man called to report vandalism that occurred between April 14 and 20 at an unknown time. The man’s 2008 GMC Sierra had minor damage on the driver and passenger side door. Suspect information is unknown.

Thursday, April 16

8:42 a.m. / Prowling / 5000 block Alvarado Street

A caller reported that upon receiving an alert from his Nest security camera, he discovered a male subject had been walking around the backyard. The suspect removed the tarp from a motorcycle, looked around and then left. The suspect was wearing a hat, plaid jacket, shorts, black socks and an N95 mask. A deputy saw the video and immediately identified the suspect. A report will be sent to the DA’s Office.

9:48 a.m. / Stolen Scooter / 4800 block El Carro Lane

During the evening of April 15, a caller observed a suspicious subject in front of his residence. On April 16, the man discovered his Vespa scooter missing from in front of the residence. The caller reviewed his security cameras and discovered a subject take the Vespa in the direction of Franklin Creek. He checked the area and found the Vespa under some plywood. The caller observed a white BMW he thought was related to the incident and followed it. The plate relates to an Audi out of Northridge and has not been reported as stolen. The caller provided a picture of the suspect vehicle and it was confirmed to be a BMW with the noted plate.

10:31 p.m. / Under the Influence / 4900 block Nipomo Drive

Deputies responded to a residence regarding a subject running around his backyard swinging a knife. Deputies contacted a man at the address, but he did not have a knife. However, the man was under the influence of a controlled substance and deputies arrested him and transported the man to Santa Barbara County Jail.

Friday, April 17

1:30 p.m. / Suspended License / Santa Claus Lane

A man was stopped for a vehicle violation. He was cited and released for driving on a suspended license.

3:21 p.m. / Drug Sales / 5400 block Carpinteria Avenue

A man was stopped due to his vehicle having a false registration tab. The man admitted his California driver license was suspended and only the energy drinks in the truck belonged to him. The first bindle of cocaine was found in his sock and an additional six bindles were found in two coin purses under the back seat. Based on the current Covid-19 situation, the man was cited for the violations and the vehicle was towed.

Saturday, April 18

10:04 a.m. / Forced Entry / 5400 block 6th Street

A teacher called to report that an unknown suspect had entered a childcare facility sometime between April 13 and April 18. Forced entry was observed on one of the back doors, but nothing was taken from inside the school. No suspect information was obtained. The caller requested frequent patrol due to the secluded location of the school and because they are currently closed.

10:57 p.m. / Warrant Citation / 4400 block Carpinteria Avenue

A deputy observed a man walking at the entrance of a residence on the 4400 block of Carpinteria Avenue. The man is known to be on probation and was contacted. He admitted that he was holding a baggie with meth and couldn’t discard it on the deputy’s approach, so he sat on it when told to sit on the push bar of the patrol car. The meth was recovered, and the man was cited for a local misdemeanor warrant. He was told to report to Ventura County Probation to handle his probation violation warrant.

Due to the controlling charge being narcotics related (a non-violent crime), no action was taken on the Ventura warrant.

CITY OF CARPINTERIA 5775 CARPINTERIA AVENUE CARPINTERIA, CA 93013 (805) 684-5405/www.carpinteria.ca.us ORDINANCE NO. 741 AN URGENCY ORDINANCE OF THE CITY OF CARPINTERIA ENACTING A TEMPORARY MORATORIUM ON EVICTIONS DUE TO NONPAYMENT OF RENT FOR COMMERCIAL TENANTS WHERE THE FAILURE TO PAY RENT RESULTS FROM INCOME L O S S R E S U LT I N G F R O M T H E NOVEL CORONAVIRUS (COVID-19), AND SETTING FORTH THE FACTS CONSTITUTING SUCH URGENCY WHEREAS, a novel coronavirus, named SARS-CoV-2 and the disease it causes has been named “coronavirus disease 2019” (“COVID-19”), causes infectious diseases and was first detected in China in December 2019 and has subsequently spread to the United States of America, including California; and WHEREAS, as of April 6, 2020, COVID-19 is easily transmissible from person to person, including from asymptomatic persons, and has spread globally to over 211 countries, areas or territories, infected over 1,279,722 people, and killed more than 72,616 individuals, per the World Health Organization (“WHO”); and WHEREAS, symptoms of COVID-19 include fever, cough, and shortness of breath; and outcomes have ranged from mild to severe sickness and in some cases death. The Centers for Disease Control and Prevention (“CDC”) considers the virus to be a very serious public health threat; and WHEREAS, on March 4, 2020, Governor Newsom declared a state of emergency to make additional resources available, to formalize emergency actions already underway, and to help the state prepare the effects of COVID-19; and WHEREAS, on March 4, 2020, in response to the Governor’s declaration, the County Emergency Operations Center (EOC) initiated the COVID-19 incident response for the Operational Area that includes the City of Carpinteria, and the Operational Area EOC is currently activated at Level I (Full Activation); and WHEREAS,on March 11, 2020, the WHO declared COVID-19 a global pandemic; and WHEREAS, on March 11, 2020, Governor Newsom and California Department of Public Health officials recommended that non-essential gatherings should be postponed or cancelled across the state until the end of March, in order to implement social distancing guidelines intended to protect all individuals, particularly those who are at high risk of severe illness for COVID-19, and to slow further spread of COVID-19; and WHEREAS, on March 12, 2020, California Governor Gavin Newsom issued Executive Order N-25-20 declaring, pursuant to the authority granted in the California Government Code, that the Employment Development Department shall waive the ordinary one-week waiting period for claims for disability insurance and unemployment insurance related to COVID-19; and WHEREAS, on March 12, 2020, Governor Gavin Newsom also declared in Executive Order N-25-20 that the Department o Tax and Fee Administration shall grant up to 60 days relief to any persons unable to timely file their taxes as a result of hardship related to COVID-19; and WHEREAS, on March 12, 2020, the County of Santa Barbara (“County”) Local Health Officer declared a local health emergency exists in the County due to an imminent and proximate threat to public health, within the meaning of Section 101080 of the Health and Safety Code, by the introduction of COVID-19 in the County, and directed local agencies in the County to implement Governor Newsom’s social distancing guidelines; and WHEREAS, on March 13, 2020, the President of the United States declared a national emergency and that the Federal government would make $50 billion in emergency funding available to assist state and local governments in preventing the spread of and addressing the effects of COVID-19; and WHEREAS, on March 13, 2020, all 20 school districts in the County announced they would be closed indefinitely starting Monday, March 16, 2020 in response to COVID-19; and WHEREAS, as of March 15, 2020, the CDC and Prevention issued new guidance encouraging people to avoid gatherings of more than 50 people; and WHEREAS,on March 16, 2020, Governor Newsom declared in Executive Order N-28-20 that the economic impacts of COVID-19 have been significant and could threaten to undermine Californians’ housing security and the stability of California businesses; and WHEREAS, on March 16, 2020, Governor Newsom also declared in Executive Order N-28-20 that many Californians are experiencing substantial losses of income as a result of business closures, the loss of hours or wages, or layoffs related to COVID-19, hindering their ability to keep

WHEREAS, on March 16, 2020, Governor Newsom also declared in Executive Order N-28-20 that any preemption of local police powers related to California Civil Code § 1940 et seq. or § 1954.25 et seq. are hereby suspended as it relates to local jurisdictions enacting moratoria on residential and commercial evictions; and WHEREAS, on March 17, 2020, the California Department of Public Health and County Public Health Department directed all bars, nightclubs, pubs, breweries and wineries to close immediately; and restaurants and other food facilities offering on-site dining should immediately transition to only offering delivery or takeout service as part of the public health effort to slow the spread of COVID-19; and WHEREAS, on March 17, 2020, the City of Carpinteria (“City”) Director of Emergency Services issued a Proclamation of Local Emergency by the Director of Emergency Services for the Novel Coronavirus (COVID-19) Pandemic (“Proclamation”); and WHEREAS, on March 19, 2020, Governor Newsom issued Executive Order N-33-20 instructing all individuals living in the State of California to stay home or at their place of residence, except as needed to maintain continuity of operation of federal critical infrastructure sectors; and WHEREAS, on March 22, 2020, the President of the United States approved California’s request for a presidential Major Disaster Declaration to bolster the State’s COVID-19 emergency response efforts; and WHEREAS, on March 23, 2020, the Carpinteria City Council (“Council”) of ratified the Director of Emergency Services’ Proclamation and confirmed the existence of a local emergency relating to COVID-19; and WHEREAS, on March 25, 2020, Governor Newsom announced support from Citigroup, JPMorgan Chase, U.S. Bank, and Wells Fargo and nearly 200 state-chartered banks, credit unions, and servicers for a 90-day grace period for mortgage payments, relief from fees and charges and a 60-day moratorium on foreclosure sales and evictions; and WHEREAS, on March 27, 2020, Governor Newsom issued Executive Order N-37-20 banning the enforcement of eviction orders for residential tenants affected by COVID-19 through May 31, 2020. Executive Order N-3720 prohibits landlords from evicting tenants for nonpayment of rent and prohibits enforcement of evictions by law enforcement or the courts; and WHEREAS, on March 27, 2020, the United States Congress passed and the President of the United States signed the Coronavirus Aid, Relief and Economic Security Act (“CARES Act”); and WHEREAS, Section 4022 of the CARES Act authorize a borrower to obtain a forbearance for 180 days, plus a 180-day extension for federally-backed mortgage loans without accruing interest of fees, and prohibits foreclosures on all federallybacked mortgage loans for 60-days beginning on March 18, 2020; and WHEREAS, Section 4023 of the CARES Act authorizes a similar forbearance on federally-backed mortgage loans for multifamily properties, when the borrower agrees to not evict or charge late fees to tenants for the duration of the forbearance period; and WHEREAS, Section 4024 of the CARES Act prohibits landlords with a mortgage guaranteed, supplemented, protected or assisted in any way by specific federal programs from initiating legal action to recover possession of a rental unit or charge late fees, penalties or other charges to the tenants related to the nonpayment of rent; and WHEREAS, many events across the County are being canceled or postponed due to the orders and recommendations at all levels of government to stop large gatherings amid concerns over the spread of COVID-19, and these cancellations and postponements cause a loss in revenue for the associated vendors, organizations and businesses, loss of income for the people who would have staffed the events, as well as lost revenue for surrounding local businesses that rely on such events to bring patrons to their businesses; and WHEREAS,many businesses in the City are either not permitted to remain open or must severely restrict activities, causing significant adverse financial impacts. Also, state and county orders and guidance calling on residents to stay at home is resulting in a severe decline in consumer spending and tourism, which has had significant negative impacts on revenue for most small businesses in Carpinteria; and WHEREAS, the Council finds these conditions warrant and necessitate a temporary moratorium on the eviction of commercial tenants suffering from economic hardship due to of a local emergency to address the COVID-19 pandemic, the state of emergency, or governmental response; and WHEREAS, this ordinance is a temporary moratorium intended to promote stability and fairness within the commercial rental market in the City during the COVID-19 pandemic outbreak, and to prevent avoidable hardship for local businesses thereby serving the public peace, health, safety, and public welfare and to enable commercial tenants in the city whose

Coastal View News • Carpinteria, California income and ability to work is affected due to COVID-19 to remain in their homes; and WHEREAS,this ordinance is temporary and shall expire no later than May 31, 2020, unless extended by the City Council following a lawful extension of Executive Order N-28-20 or related Executive Order as may be ordered by the Governor of the State of California.

NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF CARPINTERIA DOES ORDAIN AS FOLLOWS: SECTION 1. Incorporation of Recitals.

The Council hereby finds that all of the foregoing recitals and the staff report presented herewith are true and correct and are hereby incorporated and adopted as findings of the Council as though fully set forth herein.

SECTION 2. Findings. The Council hereby finds, determines and declares that this urgency ordinance adoption pursuant to Government Code section 36937 is necessary because: A. Commercial activity and businesses are essential to a vibrant and healthy community, and this temporary moratorium promotes stability and fairness within the commercial rental market as businesses have been substantially impacted by orders to “stay-at-home” and limitations on operations and hours; and B. Without the imposition of this urgency ordinance, there is an increased risk of a substantial impact to our local businesses, causing further disruption by delaying local economic recovery, and imperiling the lives or property of inhabitants of the city; and C. For the immediate preservation of the public peace, health, and safety, the Council finds that it is necessary to adopt an ordinance regulating commercial evictions, for all of the reasons set forth in the recitals above, which are incorporated herein by reference.

SECTION 3. Urgency Need. Based on the foregoing recitals and findings, all of which are deemed true and correct, this ordinance is urgently needed for the immediate preservation of the public peace, health, and safety. This urgency ordinance shall take effect immediately upon adoption in accordance with the provisions set forth in Government Code section 36937.

SECTION 4. Temporary moratorium on commercial evictions. The Council does adopt the emergency regulations relating to commercial evictions where failure to pay rent results from impacts resulting from COVID-19 as more specifically set forth below: A. A temporary moratorium on eviction for nonpayment of rent by commercial tenants impacted by the COVID-19 crisis is imposed as follows: 1. During the period of local emergency declared in response to COVID-19, no landlord shall endeavor to evict a commercial tenant in either of the following situations: (a) for nonpayment of rent if the commercial tenant demonstrates that the commercial tenant is unable to pay rent due to financial impacts related to COVID-19, the state of emergency, or government response; or (b) for the commercial tenant’s refusal to enter into or otherwise agree to a payment plan or agreement requiring the tenant to pay all or some of rent due during the period of local emergency declared in response to COVID-19; or (c) for a no-fault eviction unless necessary for the health and safety of tenants, neighbors, or the landlord.

2. A landlord who knows that a commercial tenant cannot pay some or all of the rent temporarily for the reasons set forth above shall not serve a notice or otherwise seek to evict for nonpayment of rent.

3. A landlord who knows of a commercial tenant’s inability to pay rent in full within the meaning of this ordinance if the commercial tenant, within a reasonable amount of time, not to exceed seven (7) days after the date that rent is due, notifies the landlord in writing of lost income and inability to pay the full rent due to financial impacts related to COVID-19, the state of emergency or government response. For purposes of this ordinance, “in writing” includes email or text communications to a landlord or the landlord’s representative with whom the commercial tenant has previously corresponded by email or text. Any medical or financial information provided to the landlord shall be held in confidence, and only used for evaluating the commercial tenant’s claim.

B. Nothing in this ordinance shall relieve the commercial tenant of liability for the unpaid rent, which the landlord may seek after expiration of the local emergency and the commercial tenant must pay within one hundred and eighty (180) days of the expiration of the local emergency or termination of this urgency ordinance (“Repayment Period”). Nothing in this ordinance shall prohibit the landlord and the commercial tenant from negotiating for the partial payment of unpaid rent, in which case the commercial tenant must pay the balance of unpaid rent within the Repayment Period. A landlord may not charge or collect a late fee or interest for rent that is delayed for the reasons stated in this ordinance; nor may a landlord seek rent that is delayed for the reasons stated in this ordinance through the eviction process until after the Repayment Period.

C. Enforceability 1. In the event of any violation of this Ordinance by a landlord, such a violation shall be enforceable by the individual

tenant in a court of the appropriate jurisdiction in which injunctive relief may be granted, in addition to actual and exemplary damages. In any such court proceeding, the prevailing party shall be awarded his reasonable attorneys’ fees and the court, where applicable, shall be empowered to order treble damages.

2. Nothing herein shall be deemed to interfere with the right of a landlord to file an action against a tenant or non-tenant third party for the damage done to said landlord’s property. Nothing herein is intended to limit the damages recoverable by any party through a private action.

SECTION 5. Violations. This Ordinance is an urgency ordinance adopted pursuant to a local, state and national state of emergency. This Ordinance grants a defense in the event that an unlawful detainer action is commenced in violation of this Ordinance. Violations of this Ordinance also shall be punishable as a misdemeanor as set forth in Chapter 1.08 of the Carpinteria Municipal Code.

SECTION 6. Uncodified. This Ordinance shall not be codified.

SECTION 7. Severability. If any section, subsection, sentence, clause, phrase or word of this ordinance is for any reason held to be invalid and/or unconstitutional by a court of competent jurisdiction, such decision shall not affect the validity of the remaining portions of this ordinance.

SECTION 8. Effective Date and Expiration Date. This ordinance shall take effect immediately upon its adoption and shall automatically expire at midnight on May 31, 2020, unless extended by the City Council following a lawful extension of Executive Order N-28-20 as may be ordered by the Governor of the State of California.

SECTION 9. Environmental Determination. The Council finds that the adoption and implementation of this ordinance are exempt from the provisions of the California Environmental Quality Act under section 15061(b) (3) in that the Council finds there is no possibility that the implementation of this ordinance may have significant effects on the environment. The ordinance would apply commercial and residential tenant protection measures to existing units in the City, which is solely an administrative process resulting in no physical change to the environment.

SECTION 10. Publication. The City Clerk is directed to cause this ordinance to be published in the manner required by law.

The Clarks have also offered to ship items and gift certificates.

Whimsy’s Linden Avenue store windows often tell the story of the season and the Clarks are keeping that going.
