which is one thing, but he also dislikes dogs, is children averse, glows of toxic narcissism and is dismissive to anyone who does not support him in the U.S. or abroad, especially Mexicans. That’s Trumperland.

On the ranking scale of awful, Trump’s clinginess with porn stars and hookers falls to nearly the bottom of the list somehow, and Hughes never said a word about those proclivities, either. In the end, the only Utahns who seemed to share Hughes’ taste in political heroes in large numbers were the folks living in Iron and Washington counties. It only makes sense that the descendants and historical caretakers of the Mountain Meadow Massacre (launched from Cedar City) and of the wishful thinking “Dixie” crowd (in would-be cotton growing St. George) might validate their views in support of Trump and Hughes.

Hughes will surely recover somewhere. But what of Jon Huntsman Jr. and Spencer Cox? Many Utahns engaged in a large and determined effort to convince Democrats and independents to register as Republicans, then cast a vote for Huntsman hoping he’d become the primary winner (the de facto governor in their eyes). But lost in that gambit was that many switchers voted for Cox. Since primary elections are controlled by the fringes, the only hope Hughes had was to emerge from the primary as the Republican candidate, then proceed to inauguration since a centipede could win a statewide election in the fall running as a Republican. A Hughes governorship was a prospect Democrats and independents could not abide.

Had I switched parties, I would have voted for Jon Huntsman Jr. I know him as a smart, honest family man and a decent, service-minded human being. Therefore, I think that, inside, he loathes Donald Trump, the antithesis of everything Huntsman is. I understand why he didn’t break with Trump during the primary—he couldn’t. But now, he can. And here’s the deal, I don’t hope he breaks

with Trump now, I challenge him to.

So, to Jon: Democrats and independents held their noses, joined the GOP, and they voted for you because they trust you and wanted a voice and representation in Utah affairs. You can pay them back with a simple repudiation of Trump. Don’t let their hope be in vain. It is obvious that no Trump is any measure of a Huntsman. Drop him.

And to Spencer: It’s said that you were once a Never Trumper. You must do the same thing. If you don’t, you’re going to have to spend a few more million dollars in advertising explaining how it is that a wide-eyed boy with deep religious and family values coming out of his pores, can stand beside Trump who so devalues everything you say you are. This isn’t pig slop—you can’t hold your nose and say it’s just politics. That pig won’t fly. You are either a moral person or you support Trump. And if it’s the latter, try another path and send some Cox missionaries to Mar-a-Lago.

As it turns out, the Democrats have a good candidate running in 2020: Christopher Peterson. Like me, Cox and Huntsman, he has deep pioneer roots, so check that codeworded box. He’s worked with consumer agencies, he’s got government experience bona fides, has a law degree and teaches at the University of Utah. His front-page promises are to expand Medicaid, redistrict legislative boundaries to give voice to all—not voice to party, and he’s an advocate of the growing medical-cannabis industry. But there’s also this: He’s not a Trumper. His values and virtues are real.

Time to put up or shut up, Utah. There’s no policy that equates to the pain that this country is going through because no one—except Democrats and Mitt Romney—has the guts to do it, and that is: Look the elephant in the eye and spit in it. Utah doesn’t need Trump. Trump needs Utah. If you’re going to give us up, then please, Cox and Huntsman, give us up for more than a biblical harlot’s wet kiss. he primary elections are finally over. In the race to be the Republican Party nominee to become Utah’s next governor, current Lt. Gov. Spencer Cox racked up a narrow win over former Utah Gov. Jon Huntsman, Jr. There were two other candidates in that race: Greg Hughes, the former speaker of the Utah House of Representatives, and Thomas Wright, the former head of the Republican Party, but, alas in the end, hardly anyone paid any attention to them.

For Wright, it doesn’t matter much. He was never going to win. However, he most likely became positioned for a future statewide position and the only harm he did himself was choosing current U.S. Rep. Rob Bishop as his running mate. Bishop is a smurf, politically, a strange choice from the start. For Wright, it was a decent entry into the public conversation and most likely burnished his brand.

Hughes is another matter. Even his greatest detractors describe him as a friendly and fun fellow, and one that they can work with. Those same detractors note that Hughes is often at the precipice of—if not fully enveloped in—whatever financial scandal is befalling Utah at any moment.

From malfeasant UTA spending and wink-wink hiring practices to whatever it is happening at the inland port development, Hughes is always within the picture frame.

Hughes is an original Trumper. While many Republican politicians lace up next to Trump when it is expedient—to the detriment of other Americans because that’s how Trump plays—Hughes is all-aboard with Trump. That means Hughes coddles to Trump’s racism, sexism, divisive politics, phony religious practices and avoidance of responsibility, accountability or leadership. Trump wet the bed with his deadly mishandling of the COVID-19 crisis,

Two residents of Whitefish, Montana, will tell the story of how their community came together after a white supremacist website targeted three Jewish families with “thousands of hate-filled screeds directed at the families. These included death and gassing threats, and photos of the families with a yellow star on their foreheads—superimposed over the gates of Auschwitz.”

It was fueled by Whitefish resident and white supremacist Richard Spencer, but what followed was extraordinary. While the country’s governors stretch to avoid the evil “mask mandates,” all eyes have been on state epidemiologist Angela Dunn. When she didn’t appear in public for a few weeks, people began to panic that she’d been fired.

The Salt Lake Tribune’s Andy Larsen scoured social media to figure out what people really thought. They loved her, then they hated her when she mentioned the possibility of a total shutdown. That’s when people got mean. Dunn is Utah’s Anthony Fauci, and both of them take a lot of flak. In fact, other health leaders were removed from their positions when they spoke out. The governor or lieutenant governor won’t be making those hard decisions, because the truth is a dangerous thing.

No, they haven’t stopped, and they won’t until something changes. The March for Racial Equality—Salt Lake City is taking a stand against “acts of inhumane violence, discrimination of any form and political corruption” in a peaceful protest. The world feels their pain, but desperation often leads to bad results. So, it is with the coal industry—specifically Utah’s coal country. Still hoping for a safety net, commissioners say they’re ready to tap a $53 million fund to pull a group from bankruptcy over a California port project, according to The Salt Lake Tribune. The project is one that was stopped from loading freight to send abroad. It was hoped (by at least four Utah counties) that that freight would be Utah coal. No, the project’s not dead yet, but between 2007 and 2015, coal for electricity dropped 29 percent, the U.S. Energy Information Administration says. At least 28 countries have vowed to end coal by 2050. Maybe the state should invest in transitioning these counties to a more sustainable economy.

In the midst of mass hysteria, misinformation and conspiracies, the Deseret News did what newspapers should—it went to the source, asked the hard questions and interpreted a confusing issue for the public. The paper asked Lex Scott, founder of the Utah chapter of Black Lives Matter, about the chapter’s mission and background. The national movement has been criticized as Marxist in origin, violent in concept and racist on the face. Here’s what you’ll read about it in the Washington Times: “Democratic leaders, wearing the priestly garb of kente stoles, kneel in religious surrender at our nation’s capital. … Welcome to the Church of Holy Wokeness.” The Associated Press reports that social media groups are pushing a theory “that liberal billionaire George Soros is paying crowds to attend racial justice protests.” And what does Scott say? That the Salt Lake chapter is independent—what she calls a “full service civil rights organization”—that it exists simply to care about Black and brown lives, to promote police reform and to help end systemic racism in the country.

The narrative follows both Carson’s journey, as he encounters a changed and frightened America, and the attempt at a new kind of community Beatrix becomes part of, rising from the ashes of chaos. During the pandemic, many people turned to nature as a place of solace and as a way to feel less confined. The natural beauty of Utah has inspired people for generations, including artists who fell in love with its landscapes.

This summer, opening July 13, the Southern Utah Museum of Art (13 S. 300 West, Cedar City, suu.edu/ suma) presents a retrospective of artist Jimmie F. Jones’, showcasing work from both the museum’s permanent collection and pieces loaned by private collectors.

The exhibition spans the entire breadth of Jones’ life, going back as far as works on paper from his school days. The chronological presentation tracks through his Mexico period of the 1960s and 1970s, and into his subsequent focus on landscapes, most specifically those of Southern Utah and Northern Arizona (2009’s “Point Sublime” is pictured), allowing for a comprehensive study of his artistic development. “Jimmie Jones literally grew up in the national parks of southern Utah and northern Arizona, but not until he started

painting them in 1976 did he grow into a deep intimacy with the canyons and the plateaus of his native region,” Jim Aton writes in his biography The Art and Life of Jimmie Jones: Landscape Artist of the Canyon Country. “His body of work stands as a testament to his profound love for his home landscape.”

While the physical gallery is now open to the public, special programs are available in a virtual space, and there are special hours for at-risk groups 10 a.m.-11 a.m. Monday through Saturday.

Over the course of a comedy career spanning more than 20 years, Bengt Washburn has had plenty of fun at the expense of his Latterday Saint heritage. On stage, he has described the rules for being a good Mormon as including “no drinking, no smoking, no premarital sex and, of course, the most logical one: No coffee. Because think about it: No drinking, no smoking, no sex ... why stay awake? Why even bother getting out of bed, really?” And more generally: “One person doing something crazy, that’s a nut. A bunch of people doing something crazy, that’s a religion.”

The Rite Stuff Choreographer Nicolo Fonte brings Stravinsky’s revolutionary work to a new format.

everything with the dancers before I got on the scene, teaching the existing work from a basic standpoint,” Fonte says. “What I can do best is give the piece its spirit, its life. I remember counts, but more than that, I remember musicality. I strategized that Bruce and Pam would teach it for memory’s sake. Then I had a lot of fun coaching it.”

Fonte acknowledges that understanding the format in which this Rite of Spring would be seen—on a computer screen as small images, rather than on a stage—required rethinking some of the instruction he gave to his dancers. For example, he realized that the upper body movement would be more visible than the feet—especially with some of the dancers standing in grass—which led him to specify “overdoing and exaggerating the arm movements, torso movements and facial expressions.” He also had to realize that some of the spirit of the work would be left to Peterson to recreate through her editing choices, since the entire group of dancers couldn’t be moving together. “The way she played with timing, the way windows would appear and disappear, move around the screen, did capture some of the original dynamic.”

At the same time, he’s willing to note that the unique limitations of rehearsing remotely caused him to improve at least one skill set.

“On a personal level, one of the silver linings is, to rehearse remotely, you have to really develop skills to be really clear, so it’s kind of improved my language skills a bit,” Fonte says. “I had to make sure I’m super, super clear in what I’m after. … I rehearse in a way that I’m very clear when I’m doing stuff. I could see through the video that they were coming alive through my direction, and my focus and my intention.

Dancers really respond to clarity of direction. It’s what they need: ‘More more more, give us more.’ And that in turn gives me more energy.” CW

have to be only those who knew the work already from being part of the 2016 production. “At one time, [Sklute and I] talked about including anyone who wants to be involved, the entire company,” Fonte says.

“The section that was chosen, a lot of it is just phrases of movement, but a lot of it is partnering. There are enough couples in the company that work together, where even if they didn’t work on the [2016] program, they could work together in their living room or their backyard. Adam and I decided not to involve those people, just for expediency and the accuracy of the work.”

The dancers themselves then decided on the locations in which they would film— some at home, some in public outdoor locations—and worked most closely with Peterson on helpful details for how best to record their performances. “She gave very clear instructions,” Fonte says. “Don’t shoot at noon, because the light is not good; don’t wear colorful prints.”

What remained for Fonte, then, was working on the choreography itself—though Fonte is quick to credit Ballet West ballet masters Bruce Caldwell and Pamela Robinson Harris for their contribution to the project. “They got together and reviewed

travinsky’s Rite of Spring carries with it a kind of mythology, built around the often-contradictory accounts of what transpired at its 1913 Paris premiere.

What is clear is that it was a daring, revolutionary work that inspired audiences to reconsider their preconceptions about the art form they were watching—which makes it perhaps the ideal work for re-imagining in the time of a pandemic.

On June 26, Utah Symphony and Ballet West released a video collaboration of a segment from Rite of Spring, with all musician and dancer performances recorded remotely and edited by videographer Andrea Peterson (who has worked on previous pandemic video releases by Utah Symphony). The Symphony approached Ballet West about the project, and Ballet West artistic director Adam Sklute in turn approached choreographer Nicolo Fonte, who had choreographed Ballet West’s 2016 production of Rite of Spring.

Speaking by phone, Fonte admits that he has been resistant to some of the alternate forms that performing arts have had to take to present work to audiences during the pandemic. “I’ve been holding out, thinking, ‘This can’t be the new future,’” Fonte says. “I’ve been a little reluctant to adapt and kind of change.”

Once Fonte decided to participate, he and Sklute faced a variety of challenges surrounding the way in which they would be required to prepare and rehearse the piece. One such challenge involved deciding which dancers would participate in this project—specifically, whether it would

Grill of My Dreams Five reasons to fall in love with Proper Burger Company

o borrow a turn of phrase from John Green’s The Fault in or Stars, I fell in love with Proper Burger Company (865 S. Main Street, 801-906-8604, properburgerslc.com) the way you fall asleep—slowly, and then all at once. Much like a tumultuous young adult love story, the relationship I’ve built with Proper Burger was an unexpected mix of serendipitousbut-charming interactions and tearful confrontations with commitment. This whirlwind romance concluded with the realization that even though I remain a career burger slut, I’ll always find my way back to Proper.

My feelings for Proper Burger stem from their wellrounded menu and consistent technique. Every facet of classic burger cuisine can be found by perusing their 14 offerings, which include culinary references to four cultures outside the U.S. Basically, this expertly curated and crafted menu ensures that Proper Burger has something for you, regardless of whatev-

er craving is rumbling around in your stomach. I’ve tried every one of their burgers at this point, and I can safely say that there’s not a bad one on the menu. Since I don’t have space to extol the virtues of each one, here are the top five.

The Johnny Utah ($8.49): Proper’s take on the iconic pastrami burger is always a crowd-pleaser. They make their own turkey pastra-

mi—which might seem like a slight against the pastrami gods, but hear me out. As much as I love pastrami burgers, the double team of ground beef and pastrami can be a bit of a gut bomb. Using turkey pastrami instead of beef lightens the load a little bit, and the addition of coleslaw and homemade zucchini pickles provides just the right amount of sweetness and acid to the burger. Outside of its technical merits, the Johnny Utah bears the name of cinema’s greatest action hero, which only adds to its appeal. As always, gimme two.

Proper Style ($6.99): Though this burger is much more modest than the others on the list, it sets the gold standard for what Proper Burger is. When other entries on the menu feel a bit too extravagant for a quick lunchtime jaunt, the Proper Style is always a safe bet. It consists of your basic cheeseburger fare— lettuce, tomato, American cheese and zucchini pickles—so there’s nothing not to like about this one.

The Proper Style also showcases the foundational techniques behind Proper’s large assortment—this is the “subject zero” of the mad experiments found on their menu.

Sundance Kid ($7.99): Though we tend to think of pastrami burgers as the quintessential Utah burger, the barbecue bacon cheeseburger is

just as entwined with Utah history.

Proper Burger’s variation of this classic number has all the basics— barbecue sauce, bacon, cheese and a couple golden fried onion rings— but they’ve added a Frito crumble that somehow makes this version feel even more at home to the Utah palate. The sauce perfectly complements the burger and bacon, and it’s got a welcome spicy kick that lingers after each bite.

Rising Sun ($8.49): Adding a fried egg to a burger is a lot like adding bacon: You do so at the risk of letting the addition overwhelm the thing’s basic construction. Proper Burger has solved this dilemma with the Rising Sun by adopting a “more is more” approach. In addition to a fried egg, this burger comes at you with an Asian-inspired arsenal that consists of kimchi, miso aioli, cilantro, cucumber pickles and Sriracha for something that’s one part burger, one part bulgogi and one part bahn mi. The heat of the kimchi and Sriracha pair very well with the fried egg, and the cilantro is there to ground the whole thing with a bit of herbaceous balance. If you’re careful, most of Proper’s burgers can be eaten without the aid of a napkin, but just forget about that once you dive into this spicy delight.

Flyin’ Hawaiian ($8.99): Some-

times I crave a burger that swaps the savory acidity of pickles for something sweet and citrus, which is when I turn to the Flyin’ Hawaiian. It’s a burger equipped with sliced ham—made in-house, by the way—and a pineapple ring, along with some pickled jalapeños, Swiss cheese and whole-grain mustard.

The combination of ham and pineapple alone is a fantastic burger elevator, but as is the case for most burgers on Proper’s menu, it’s the small details that really make this tropical flower sing. The jalapeños are there to make sure things don’t get too sweet, and the mustard does some heavy flavor mediation to make sure nothing hijacks the ride.

I also have good news for anyone sticking to a plant-based diet. Not only can Proper Burger’s menu be made entirely vegan—their vegan burger patty is extremely tasty—but they have the best vegan chili I’ve ever had. Hell, it might be the best chili that I’ve ever had, period. So whether you’re eating meat or not, pursuing a relationship with Proper Burger will never do you wrong. CW

Porky’s Kauai Opens in Lehi

After building up a significant amount of buzz in the Waimea region of Hawaii, Porky’s Kauai has opened its first mainland location in Lehi (785 E. 200 South, 801-803-3783, porkyskauai.com).

Porky’s Kauai has made a name for itself with its coastal hot dog and frankfurter variants that include extras like pulled pork, pineapple and grilled cheese. Any place that only offers only four menu items will always capture my attention—it typically means that the restaurant does these items better than anyone else. offer an initial mineral quality, along with white bread dough and mature but still slightly bitter herbs. Peaches enter the palate with an early fruit-driven peak, which stays till the end, but fades down slowly and consistently. The fruit itself is defined by a pleasant tartness, sweeter peach pulp and a light moldy touch along with a mild floral bitterness. It develops an almost champagne-like finish, with an astonishing smoothness of the fruits and a finely beaded mouthfeel. Once you’ve played out the flavors from the fruit and base beer, the finish takes over and smacks the palate with rum and oak. The 8.0 percent heat is slightly noticeable, but who cares; you’re

suddenly on vacation, and the bar is open.

Quarantine Desirability Rating: High to Smeagol. You’ll find yourself caressing the attractive champagne style bottle after each sip; whispering “my precious” to the tart and fruity elixir. Keep it away from your fuzzy-footed pals. They wouldn’t know what to do with this beast anyway.

It was fun trying these Nic Cage-evoking flavor bombs. They might be too intense to enjoy one after the other, but what else have you got to do now that cloistering is back in fashion? Each is sold at their respective breweries, and I’ve seen a few venture out into restaurants and bars as well. Both are worthy of your time. As always, cheers! CW

f Nicholas Cage was a beer, I’m sure he’d be one or both of this week’s selections.

One is definitely Raising Arizona’s H.I. McDunnough, and the other is leaning towards Con Air’s Castor Troy. I’m not going to tell you which one is which; you can figure that out as you enjoy this week’s intensely over-acted craft ales.

2 Row’s Honey Habanero: The good-toabove-average appearance features a nice, deep honey/orange color with a light head, and decent lace retention as the pour settles. An interesting aroma offers the sweetness of a blonde ale initially, but quickly becomes overpowered by the smell of fresh chilies.

The first sip is a similar experience, with moderate honey-malt sweetness giving way to a moderate chili kick. The pepperiness keeps the beer dry, which follows the honey theme of the ale, and offers a pleasing contrast to a lingering yet far-less-po-

tent taste of the honey pretzel thing from the base beer. Moments of sweetness jump out amid the chili flavor towards the finish. Mouthfeel is nothing crazy, and less heavy than a good blonde ale. The first few sips and swallows can be tough for those who don’t like chili or aren’t into hot stuff.

Getting through the bottle seems to offer a fluctuation between the intensity of the first few sips and a bit of adaptation to the minimal amount of heat. It’s one of those beers that creates its own drying/quenching loop.

Quarantine Desirability Rating: High to “Zoom Cosplay.” If you’re looking to attract the heartier version of your preferred gender, look no further. After a few swigs of this bad boy, I immediately found myself enslaved by Chun-Li from Street Fighter fame. I was shooting for Princess Leia, but … meh, the hair is close enough.

Saltfire’s Mobius Trip (Utah Peaches): Pours a slightly hazy golden-peach color with a fizzy, small head, which immediately diminishes to a small coating. It smells of leafy ripe peaches, offering a bright fruitiness which comes close to the experience of actually cutting a peach in half and enjoying its aromas. This whiff inherits not only the fruit’s pulp, but also its velvety skin, adding a soft soothing quality to the spritzy, slightly perfume-y and floral fruits.

Doing so will not make their lives any worse, but it will improve the lives of others who deserve an equal and legitimate chance at opportunity. However, it was also among the most racially segregated cities in the U.S., which precluded the opportunity for racial understanding among its residents. Having lived in Utah since 2001, I’ve found it much less hostile than my hometown environment but also much less informed about diversity and people of color.

I’ve always spoken on these matters. This “trend,” for some, has been a fight my entire life. I was raised by a single mother of six in Salt Lake City.

I’ve lived in many communities across the valley.

Although the environment and people were different, the hate they give is all the same. Being an artist with a growing platform, I must vocalize my experiences and educate others on the plight that’s been silenced in our country. I have family, friends and neighbors who don’t have the resources to be heard.

The day my son told me he doesn’t want to be Black was the day I chose to do my part in eradicating the white nationalism that thrives in police departments across America. I can’t march every day or create police reform. However, I can pick up where those before me left off and use my voice— it’s my most powerful weapon.

s a candidate for Salt Lake City mayor in 2019, my main issue was that of police brutality, killing and lack of accountability.

Recent events have clearly shown the complete impotence of the police to deal with the violence and anarchy on the streets of Salt Lake and other major cities resulting mainly from the brutal treatment of minor offenders by law enforcement while typically avoiding contact with real criminals who pose a more credible threat.

I’d like to suggest a few structural changes to prevent these injustices from occurring again and again and to insure the restoration of a proper balance between police power and the constitutional rights of our citizens.

1. The police must be demilitarized.

Get rid of SWAT teams, strike forces, vice squads, undercover cops and all the other quasi-military paraphernalia and jargon. Dump the bulletproof vests, weapons belts and the big guns that are mostly used to kill innocent people.

2. Change rules of engagement so that deadly force is used only when an officer is confronted by credible, deadly force. The current subjective rule of “feeling threatened” essentially gives police a license to kill. We’ve seen the sad outcome of this policy many times now. Extrajudicial killing by police cannot be tolerated in a democratic society.

In Germany, police must justify each and every shot they take. Every bullet is stamped with an identifying code, so officers are held personally responsible.

3. Re-educated police so they understand they are agents of the people, not agents of and for the benefit of the state.

No-knock warrants and civil forfeiture have no place in our constitutional republic. The “War on Drugs” has been a colossal failure costing society trillions of dollars, hundreds of thousands of lives and the loss of our civil rights while having no effect on drug abuse at all.

4. Reduce the size of the police force by half with the remaining agents being given a raise in pay to attract more qualified people to the job. We have far too many police, which leads to over policing and the manufacture of crimes. The savings should be applied to the reduction or elimination of many excessive taxes.

5. End the police culture of “us vs. them.” Currently, police are trained to look at every citizen as a potential

“perp.” They have become our overlords, not our servants.

6. Stop aggrandizing the police as “heroes.” They are just people doing a job for which they are paid, like anyone else. No one is forced to become a police officer. If these people are unwilling to accept some risk for the benefit of those they are sworn to protect, then they should find another occupation. By the way, convenience store clerks have a higher chance of being killed on the job than police do. And they don’t get huge taxpayer-funded processions and ceremonies.

7. We need balance and accountability. It is legal for police to lie and bully the accused while it is illegal for citizens to lie to the police, who have become very comfortable with abusing this power. Judges are complicit because they take the word of police without question, especially in issuing search warrants. Police are known to lie in order to obtain search warrants, essentially nullifying the constitutional prohibition against unreasonable search and seizure. The balance between police power and our constitutional rights has been reversed in recent years. The Constitution gives

primary power to the people, not the police. Eliminating police unions would go a long way toward restoring balance and accountability. Not only do they feed the “us vs them” mentality, but they make removing problem officers virtually impossible.

8. End arrests for “lifestyle” crimes. We don’t need to arrest people for these nonviolent crimes such as solicitation and drug possession—matters that could be handled with citation and a fine, if it’s necessary to torment citizens for nonviolent crimes at all. This kind of harassment disproportionately harms the poor and lower middle class.

9. Reform criminal courts and jails. Judges often issue search warrants without even reading them. I know of one case of a judge issuing a warrant in 30 seconds at 2 a.m. People in jail are treated very badly, especially those who can’t make bail. Most of these people have not been convicted of any crime but are incarcerated in deplorable conditions for long periods, sometimes waiting years for a trial.

10. Investigate police shootings using an outside agency, one completely

11. Utah Legislature: Stop criminalizing so much of normal human activity, which is the root cause of police abuse. There are so many laws and crimes now that the police can literally stop anyone at any time and find a reason to

fine or arrest them. The primary enforcement seat-belt law, however well intentioned, gives the police power to pull over anyone, anytime. With our bloated police force, they can target anyone they wish or just go fishing to pass the time.

Consider the famous words of Joseph Stalin’s chief of the secret police, Laventiy Beria: “Show me the man, and I’ll show you the crime.” How far we have traveled on this path is amply illustrated by Harvey Silverglate’s book, Three Felonies a Day, in which he aptly describes how the average citizen commits three felonies every day without realizing it.

Why not have an “un-legislative” session where, instead of passing 550 new laws, we eliminate 550 laws?

The current unrest could be just the tip of the iceberg if we don’t make major changes to a criminal “justice” system that has become corrupt and self-serving. We can take the seemingly painful measures now to restore balance and justice, or we can wait till the next outbreak of violence that will be truly catastrophic. No one will win when this happens. The suggestions listed above will not be easy or popular to implement, but they will normalize the power balance between police and the people they serve thereby restoring the confidence and trust that vanished long ago.

Police have been absolved in the majority of shootings, including in the deaths of several African American men shot in the back as they were fleeing. Because of this, police have lost all credibility in rendering impartial justice. They have demonstrated there are indeed two kinds of justice, one for the ordinary people, which is harsh and immediate, and a second for government agents which is lenient or nonexistent. I recommend that the FBI investigate all police shootings as they all constitute inherent civil rights violations. We cannot allow low-paid civil servants to act as judge, jury and executioner.

When a deranged killer is given the death sentence, we allow 20 years of appeals just to make sure that every legal formality has been followed to the letter.

Yet, when a Black man is running away, we see no problem in allowing a bully with a badge to apply this process in two seconds.

Something is very wrong here.

F

reedom of speech is not only the hallmark of a free people, but is, indeed, an essential attribute of the sovereignty of citizenship.

You have a constitutionally protected right to engage in peaceful protests.

Where can I protest?

Public forums: You have a constitutionally protected right to engage in peaceful protest in public forums such as streets, sidewalks or parks. You may also be able to protest in front of government buildings and the Legislature.

Salt Lake County has designated protest zones, areas that are specifically designated for public demonstrations and protests. There may be restrictions on the time, place and manner of how your exercise your free speech rights.

However, these restrictions must serve a substantial government interest (like traffic safety), and they must be narrowly tailored to serve that interest. They also may not unreasonably limit alternate avenues of expression.

Finally, the government may not place greater restrictions on anyone because of their point of view.

Non-public forums: In other venues, your rights are less clearly protected. For example, reasonable restrictions may be allowed at military bases, airport terminals or the entrance to a post office as long as they do not favor one side of an issue over the other.

Private property: In general, private property owners may set rules limiting your free speech. If you disobey the property owner’s rules, they can order you off their property (and have you arrested for trespassing if you do not comply).

Courthouses: Under Utah law, you may not picket inside or near a court with the intent to block access to the court or affect the outcome of a case that is pending before that court.

What can I say and do?

In addition to verbal and written speech, the First Amendment covers all forms of expressive conduct, including music, film, dance and clothing. The government may not restrict your right to protest because your views are controversial, unpopular or offensive.

The government may place certain restrictions on the time, place and manner of how you exercise your free speech rights. You should look up the local ordinances in your area before you plan a protest. For example, there may be restrictions on volume or playing music, or the route of a march.

You are entitled to approach pedestrians on public sidewalks with leaflets, flyers, newspapers, petitions and solicitations for donations as long as the pedestrians have room to pass. You may set up tables on public sidewalks if there is enough room for pedestrians to pass. You may not purposely physically detain pedestrians.

You are entitled to picket on public sidewalks, but you must picket in an orderly, nondisruptive fashion so that pedestrians can pass. You may not block entrances or exits to buildings.

You can advocate government overthrow or taking over the streets, so long as your speech is not aimed at inciting listeners to imminent lawless action or encouraging people to commit violence.

Do I need a permit before engaging in free speech activity or public protests?

If your march or protest is held on the sidewalk and obeys traffic signals, that activity is constitutionally protected even without a permit. But local governments may require a permit in the following circumstances: • If your march or protest will not stay on the sidewalk, or if it will require blocking traffic or street closure.

• A large rally requiring sound amplifying devices • A rally at certain designated parks or plazas. Many areas require organizers to get permits in advance for large demonstrations, and some charge processing fees.

For groups of more than 50 people in Salt Lake County, you should submit an application to the permits section

at least 30 days before the event is scheduled. However, the First Amendment prohibits advance notice requirements from being used to prevent rallies or demonstrations that are rapid responses to unforeseeable and recent events. In Salt Lake County, political events are exempt from fee requirements.

What activity is not protected?

Defamation: Under Utah law, you can be sued for purposely making false statements that were intended to damage a public figure’s reputation. But you cannot be sued for statements of opinion, parodies, jokes or discussions of public controversies.

Fighting words: The government may restrict speech that is personally abusive and very likely to provoke a violent reaction.

But the fact that certain speech angers some people does not necessarily mean that the government may restrict it.

Obscenity: In Utah, local governments may restrict speech that uses obscene or profane language but only in situations involving a breach of the peace.

Intentionally inciting another to crime Picketing a targeted residence, outside a selected person’s home (except the governor of Utah’s home).

What to do if you are stopped by the police

In Salt Lake City, you can be charged with disturbance of the peace if you refuse to comply with an order of the police. If you are stopped by the police, remember to do the following:

• Think carefully about your words, movement, body language and emotions.

• Don’t get into an argument with the police.

• Remember, anything you say or do can be used against you.

• Keep your hands where the police can see them.

• Don’t run. Don’t touch any police officer.

• Don’t resist, even if you believe you are innocent.

• Don’t complain on the scene, tell the police they’re wrong or that you’re going to file a complaint.

• Ask for a lawyer immediately upon your arrest.

• Remember officer’s badge and patrol car numbers.

• Write down everything you remember ASAP. Try to find witnesses and their names and phone numbers.

• If you are injured, take photographs of the injuries, but also make sure to seek medical attention as soon as possible.

• If you feel your rights have been violated, file a written complaint with the police department’s internal affairs division or civilian complaints board. ** Note: This advice is not intended to deter you from cooperating with law enforcement.

The First Amendment’s protections are not limited by one’s immigration status

First Amendment: Rights of immigrants and refugees during protests Every person has a constitutional right to engage in peaceful protest. The First Amendment’s protections are not limited by immigration status. However, for persons that are not U.S. citizens, interaction with the police during a protest may pose different risks.

You have the right to protest in public forums such as streets, sidewalks or parks. The government can regulate the time, place and manner that you protest, but it cannot unreasonably restrict it.

Free speech is more than words. It includes clothing, music and conduct that expresses yourself. Under Utah law, it does not include defamation, words to encourage a violent reaction or committing a crime, obscenity or targeting a specific person’s home.

Police have the right to intervene in a protest only in certain situations. If police issue orders during a protest, it is important that you calmly follow them. You can be arrested for disturbing the peace if you fail to follow police orders.

If arrested, you have the right to remain silent and ask for an attorney. In Utah, you only have to provide your name, date of birth and address if arrested. You have the right to ask why you are being arrested. Exercise your right to remain silent and ask for an attorney.

Stay calm. Do not argue, complain, run, touch or push an officer. There can be criminal consequences for resisting arrest, assaulting a police officer or disturbing the peace. Remember that anything you say or do during an arrest can be used against you in criminal and immigration court.

Do not discuss your immigration status with anyone but your lawyer. Do not lie about your immigration status or present false documents. This can have serious immigration and criminal consequences.

Some county jails in Utah honor ICE detainers. If taken to jail, you have the right to remain silent and ask for an attorney. Exercise this right. If you are a citizen of another country, you have the right to call your consulate.

You have the right to make a local phone call. If this phone call is to an attorney, it cannot be recorded.

If an ICE officer visits you in jail, do not say or sign anything without consulting an attorney. You have the right to say, “I wish to remain silent.”

What if I’m charged with a crime? Do not sign any plea agreement without talking to an attorney. You have the right to know the immigration consequences of any criminal conviction. Even misdemeanors may have immigration consequences. Speak to an attorney before signing or accepting any plea deal.

If ICE stops you at a protest, you have the right to remain silent. ICE officers cannot search you without your

consent. They cannot detain you without specific facts about you to make them believe that you are in violation of immigration law. Your race, ethnicity and choice to remain silent are not enough for ICE to arrest you.

You have the right to record and take pictures during a protest as long as it does not interfere with police activities. Disable face and touch ID to unlock your phone before a protest. The police cannot force you to unlock your phone, delete or turn over any photos, videos or recordings on your phone without a warrant signed by a judge.

Streams from the Station Jazz at the Station finds a way to continue bringing “survival music” to the public.

“E

verything keeps spinning out of this,” says Caril Jennings one morning during a conversation with City Weekly about, mostly, the conversion of the long-running program Jazz at the Station to a new online format. In a fittingly jazz-like fashion, her use of “everything” is not just one thing, but many moving parts. The conversation is halted by the phone cutting out due to her pacing around her home, which is followed by her fervent apologies. But she keeps pacing, radiating the kind of restlessness you’d expect of a jazz player—even though she isn’t one herself. She’s a self-proclaimed “wonderful audience member,” or a “vampire” who feeds off the “twitterpated” enthusiasm of Jazz at the Station’s younger performers.

Most of all, she’s one dedicated person responsible for helping to carry on the jazz tradition in Ogden, to both honor its history and to open it up to more people.

In 1998, pretty much the only places to see jazz music locally were the 21+ clubs— which presented a problem for students in the jazz appreciation program at Weber State University, who were required to see a handful of shows per course. Jennings, then the marketing director for the WSU Department of Performing Arts, knew this impediment had to change, and so the Jazz at the Station concert series was born.

Blessed on it’s very first night by a performance from the godfather of the Ogden jazz scene, the sadly late Joe McQueen, the series quickly earned legitimacy in the local jazz circuit.

The series has since continued, despite the loss of funding from WSU and a new reliance on its alumni and help from the Union Station Foundation to fund the program and pay the professional performers.

For 22 years, Jazz at the Station has featured one show every second Wednesday of the month, plus special events like the Heritage Jazz Festival featuring junior and high school student ensembles.

Of course, the pandemic has put a halt to performances as usual. But with the help of one of the very students who found an outlet in the program, Jazz at the Station is finding a new home online. “Jazz is something that has a very prominent history in Ogden,” says Ogden musician DeSean Bryant, “especially [related to] the late, great Joe McQueen, and I feel as though we cannot let that die just because we are in a pandemic. Jazz music is survival music, and it’s music that’s good for the soul.”

Bryant, the drummer for the jazz band Metro, played the very first virtual concert on July 8, and was also the one who came to Jennings with the idea and ability to move Jazz at the Station online. “An online platform would allow that escape to the world of music and a world of togetherness,” Bryant says. “Streaming Jazz at the Station will be a new step in the direction of reaching people all throughout Ogden and even all of Utah. A live event is always an amazing experience, but with the times we are in we still want to keep people connected to jazz in any way they can while offering that same live experience.”

His point is echoed by Jennings who admits that, though viewing music online isn’t her preferred entertainment experience—especially as a woman in her 70s who is less comfortable with technology than younger collaborators like Bryant— moving Jazz at the Station online offers the

Union Station in Ogden chance for more young people to see it and be moved by it.

The way the two worked together to address the problem represents the generational diversity within the Jazz at the Station community, and in jazz music as a whole. As Jennings puts it, “different ages and experience kind of fall by the way, it just kind of depends on how well you know that tune.”

Besides bridging age gaps, Jazz at the Station’s companion project—the travelling art exhibit Jazz from the Station— closes any gaps in public memory about jazz’s role in ending segregation in Ogden clubs. The aforementioned Joe McQueen, besides being one of the West’s great jazz legends, was instrumental in ending segregation in clubs around Ogden. As his popularity grew, he demanded that the white clubs that wanted him so badly let his black fans into the white-only clubs.

McQueen grew his popularity and craft at the Porters and Waiters Club, a hotel, restaurant and lounge on historic 25th Street, just steps from the Union Station where black railroad workers could go to rest, eat and enjoy performances from greats like Fats Domino, BB King and Marvin Gaye.

The exhibit focuses on this time in Ogden’s history, and the planned fourth installation will feature in particular tales of the Porters and Waiters Club’s owner, Anna Belle Weakly. Jennings, who became good friends with Joe McQueen, cites his last wish to her being that Weakly’s role in creating space for the Ogden jazz scene to grow and thrive should not be forgotten.

Though the art show will not return until 2021, the accompanying sounds of jazz in Ogden will still be loud and clear thanks to Jennings and Bryant—and, of course, the tradition of Jazz at the Station. Bly Wallentine The Purpose of Dancing

Love and Dancing with Bly Wallentine

One of Provo’s finest multi-instrumentalist solo artists and owner of Studio Studio Dada, Bly Wallentine, has had love on the mind lately—which isn’t something we can all say in this doom and gloom world. But it’s not the kind of cheesy, “stay positive!” bullshit that is often spewed in pop realms; rather, it’s a certain genuine fascination with the shapes, forms and mysteries of love. Wallentine explores them both on the new, July-released album the purpose of dancing and the late June EP i don’t know what to do (besides love). The latter features a cover of an Of Montreal song, “Feminine Effects,” which matches up with the compelling title track, where Wallentine narrates the confusion that comes with unexplained ill-will towards you, and deciding to meet it resiliently with love anyways.

Wallentine has often leaned into swirly spiritualism and poetic introspection, and here it especially feels comparable to the way Linda Perhacs pulled it off with her moving folk hymns in the midst of ’70s hippie-mania. The ear-wormy track glitters with synths and punchy back-beats, and when listened to back-to-back with the singles on the purpose of dancing, it becomes clear that though Wallentine has dabbled in various genres—stripped-down folk, riffs on choral and hymnal traditions, straight-up indie rock (2017’s shoulder devil is notable)—they’ve found a real sweet spot in this whimsical pop aesthetic, weighted as it is with Wallentine’s emotional and well-crafted lyricism. Mask Mandate Goes Swimmingly at Graywhale

While for some the new mask mandate put in place in Salt Lake and Summit Counties recently may present a new complication to going out in public, for others it’s just a validation of what we’re already used to. This is the case for businesses taking on the new mandate, too.

While videos of angry customers trying to storm into grocery stores have swept the internet, City Weekly decided to check in with one local record store to see if they’ve had any such experiences.

“As with any new restriction or entry criteria, there’s a fear that it will cause a loss in business from people that are either unable or unwilling to comply. But in reality, we’ve had very few issues, and on the whole, people have been understanding and accommodating,” says Zane Pendleton of Graywhale Entertainment. The business has put out signs explaining the rules, which take into account age and medical exemptions. And while they considered providing masks at the door for those without, Pendleton notes, “the consensus was that wearing a mask is an issue we take seriously, and if after months of living with the COVID-19 outbreak someone hadn’t taken wearing a mask or facial covering seriously until now, it was their own responsibility to provide one. Some people won’t change until it becomes too inconvenient or painful for them not to.” Luckily, they haven’t seen much resistance to masks—which is a good sign for everyone, whether or not you frequent record shops. They plan to keep up the same rules of operation moving into late summer and fall as they roll out their Record Store Day releases, which are being staggered to make it easier for participating shops to control crowds.

It’s not just record stores in SLC that have adopted ingeniously to the new challenges of selling records during COVID-19, but also Ogden hotspots like Lavender Vinyl.

The shop stocks new vinyl releases as well as used records, which they accept via purchase or donation. Whether you want to visit the shop—which has softly re-opened with a request for folks to wear masks—or do pick-up, Lavender Vinyl can and has been easily accommodating all kinds of purchase needs. It’s time to clean out your car’s console finally, and gather those gently-used CDs and neglected records to donate to that great record store in the sky—or rather, donate them to KRCL in anticipation of their Annual Record and CD Sale, which relies on donations to raise funds for the radio station. Events Manager Eric Nelson says, “As of now, we will be kicking off our Record Sale season with an online virtual sale highlighting the best of the best of what we’ve gathered over the past year. After the virtual sale, we will be setting up the record sale in KRCL’s parking lot the following two or three Saturdays. The sales will be appointment-based (to stagger crowds), with a very easy online sign-up which will be found on our website.”

At this point, roughly four months into the pandemic that effectively stalled all activity in the city, especially for musicians and nightlife people, it’s almost easy to forget that those people are still out of work. But luckily, in addition to getting crafty themselves, larger entities like the Park City Institute have been lending a helping hand. City Weekly covered PCI’s introduction of their Locals Live virtual showcase series, and we’re happy to report that it’s still going strong—this time around with sponsor support

Highlights of Utah Film Center’s 2020 virtual Damn These Heels Queer Film Festival

U

tah Film Center’s annual Damn These Heels Film Festival might not be taking place in its traditional home at the Rose Wagner Center, but make no mistake—it’s still taking place. The showcase of 19 LGBTQ-themed documentaries and narrative features from around the world has moved to a virtual space for 2020, beginning 10 a.m. Friday, July 10.

Here’s a look at a few of the titles that were available for preview; visit utahfilmcenter. org/damntheseheels/dth2020 for additional program information.

Dog Valley: Director Dave Lindsay’s documentary digs into an infamous 1980s Utah true-crime narrative in a way that’s so thorough, it’s almost hard to find the central idea. In November 1988, Gordon Church—a 28-year-old gay Southern Utah University student—was murdered in what appeared to be a hate crime, with suspects Michael Archuleta and Lance Wood both pointing fingers at the other as to which one actually killed Church. Dog Valley doesn’t really attempt to answer that question, though Lindsay explores the respective lives of Archuleta and Wood with plenty of detail. The combination of dramatized re-creations, interviews and police recordings provides a grim portrait of the crime itself, and Church’s friends allow him a chance to emerge as a person aside from his sad end. With so much ground to cover—the differing legal fates

of Archuleta and Wood; the history of hatecrime legislation in Utah; Wood’s amazing ability to woo multiple women while imprisoned—Lindsay finds plenty of individually fascinating threads, even if the way in which they’re woven together doesn’t always tell one cohesive story.

Jules of Light and Dark: The title character is actually the least significant of the three central players in writer/director Daniel Laabs’ story: Maya (Tallie Medel) and her girlfriend Jules (Betsy Holt) are found by Freddy (Robert Longstreet) when Maya’s car crashes and leaves both of the women injured, beginning a series of events that changes all of their lives. The two storylines of Maya and Freddy run mostly parallel for much of the running time, which feels like a missed opportunity to explore the potential connection between them—Maya estranged from her parents after coming out as gay, and Freddy still living mostly closeted while estranged from his grown children. But both of the central performances are terrifically understated, capturing people whose loneliness comes from still trying to figure out who they are. Emotional catharsis isn’t on the agenda here, as much as watching people wrestle with what they need in their lives to feel whole.

Same-Sex Attracted: If co-directors Maddy Purves and Zoie Young had made just another documentary about being gay in a conservative culture, it would have felt rote and predictable. Instead, they explore their subject—LGBTQ-identifying students at LDS church-run Brigham Young University—with a complexity that might leave you feeling both encouraged and infuriated.

The focus is on a handful of students over the course of the 2017-2018 academic year, many of them involved in BYU’s un-sanctioned LGBTQ support group Understanding Sexuality, Gender and Allyship (USGA), at a time when the university was exploring allowing some form of official LGBTQ group.

Along the way, the filmmakers capture a sense of progress at openly gay and openly trans people even being possible at BYU, while still conveying the pain inflicted by an Honor Code that treats same-sex couples holding hands as the immoral equivalent of an opposite-sex couple having sex.

Transkids: An Israeli television reality series gets edited for feature length in director Hilla Medalia’s profile of four transgender teens in Israel: three trans boys (Noam, Ofri and Liron) and one trans girl (Romy).

the subject matter, whether it’s the complicated emotions of parents trying to come to terms with their child’s transition—including a father who bluntly suggests that he might have wanted to have his trans son aborted if he’d known what was coming— or the nuts-and-bolts of teens preparing for surgeries and hormone therapy. It’s much more interesting, however, when dealing with topics specific to the Israeli setting, like how these youth approach the challenge of the country’s required military service, or making peace with their faith.

Medalia’s straightforward approach bypasses most overt drama—leaving aside Romy’s participation in a beauty contest— to tell simple but affecting stories of young men and women becoming the people they’ve always known they were. CW

Despite the growing COVID-19 cases in Utah, people are moving here, and they need places to live. We are down in housing inventory and developers aren’t able to keep up with the demand.

Imagine a cartoon version of yourself flying up on a jet pack with a birds’ eye view of the north end of Salt Lake Valley in and around the airport. You’ll see Delta Airlines’ new hub and the all-new terminals that will open this fall and be finished next year. To the west of the airport is the new site for Utah State Prison and to the west of that will be the Inland Port. Those three facilities alone could employ around 60,000 by the time they are built, and all of those people need a place to call home.

I predict Magna and Tooele, Stansbury and even Grantsville will be the new “hip” places to live and will bear the brunt of growth. Ivory Homes, Utah’s most prominent home builder, can’t work fast enough to build homes. What used to be a sixmonth build process for prospective home buyers has become a nine-month wait due to demand and a dire lack of a labor force.

Oh, and can you hear the yowls from the Nimbys in Salt Lake’s upper avenues? Ivory is attempting to build 25 new homes at F Street and 13th Avenue with each lot having ADUs (apartments, accessory dwelling unit), making it a total of 45 residences in an area zoned for single-family dwellings.

If built, these ADUs could be affordable housing options among some very expensive homes, providing housing for grandparents, caretakers, nannies, students, families and low-income folk. Neighbors against the zoning change and increased density proposal have created a Facebook page called Preserve Our Avenues Zoning.

Ivory Homes is arguing that the proposed development “can further materialize the objectives stated in the (SLC) Five Year Housing Plan” and that the first goal in that plan adopted by the city “recognized the need to increase the diversity of housing types and opportunities in the city… that integrate and can break down social and economic segregation, thus building a city for everyone.” Also, the rezoning request narrative states: “Salt Lake City has had an abundance of single-family homes and multi-story apartment buildings for decades. While both types of housing are critical, the ‘missing middle’ housing types have been squeezed out … and would provide solutions for a wide variety of family types and structures.”
