1. Introduction The City Rail Link (CRL) project comprises the construction, operation and maintenance of a 3.4 km underground passenger railway, running between Britomart Station and the North Auckland Rail Line (NAL) in the vicinity of Mt Eden Station. The CRL also involves the construction of two new underground stations at Aotea and Karangahape and a redeveloped Mt Eden Station (refer to Figure 0-1) The design and construction of the CRL infrastructure between Aotea and Mt Eden Stations is being delivered by the Link Alliance.

This Social Impact and Business Disruption Delivery Work Plan (SIBD DWP) has been prepared in relation to early works along and in the vicinity of Normanby Road, hereafter referred as the ‘Normanby Road early works’.

1.1 Overview of CRL works in Mt Eden The CRL works in the Mt Eden area involve the construction of the southern section of the tunnel structures and the tie-in to the existing NAL, including the construction of the redeveloped Mt Eden Station. The Mt Eden Active Construction Zone (ACZ) and Construction Support Areas (CSA) for the NAL Mt Eden section is generally located between State Highway 1 (SH1) to the east and Dominion Road to the west.

The works in this area include: • • • •

Construction of an underground grade separation structure near Mt Eden Station; A new Mt Eden Station building incorporating passenger linkages; Modifications to the existing Mt Eden Station platforms; Road over rail bridges at Mt Eden Road, Normanby Road and Ruru Street with sections of road realignment;

Grade separation structures and the east- and west-facing connections for the existing and new rail lines to pass-over and connect with each other; Pedestrian and cyclist bridge structures at Fenton Street and Porters Avenue; and New road linkages within the reinstated area post-construction.

Given the nature and scale of CRL works in Mt Eden, construction will be undertaken in a staged manner.

This SIBD DWP only relates to the Normanby Road early works, as described in Section 3 below.

1.2 Cumulative SIBD Effects The CRL construction works in the Mt Eden Station area are occurring in a staged manner, the scale and location of the combined construction activities do have the potential to generate cumulative SIBD effects that may be perceived as being greater than the individual works package.

In recognition of the potential cumulative nature of these impacts, the overall scope of the CRL project has been acknowledged and will be further addressed in the DWPs prepared for the construction activity related to the main works in Mt Eden.

SIBD subject matter experts (SMEs) have been cognisant of affected community feedback received for Aotea, Karangahape and Mt Eden Stations, and particularly the feedback collected for the Mt Eden early works SIBD DWP.

1.3 Purpose of the SIBD DWP This SIBD DWP has been prepared to identify measures that will be implemented to mitigate and manage the potential adverse effects on businesses, residents and community services/facilities during the Normanby Road early works. The objective of the SIBD DWP is: •

“to avoid, remedy or mitigate the adverse effects arising from disruption to businesses, residents and community services/facilities so far as reasonably practicable.”

It identifies mitigation measures that will be undertaken with regards to the following potential adverse social impact and business disruption effects: • • • • •

Disruption to access for residents and businesses; Temporary loss of street parking during construction; Disruption effects that result or are likely to result in the loss of customers to businesses as a result of the construction activities; Business disruption due to interruption in electricity and communications utilities; and Loss of amenity (as a result of potential dust, noise and vibration, and traffic impacts) for residents, community services and businesses as a result of construction activities.

This SIBD DWP has been prepared in consultation with the community, business owners, affected parties and affected in proximity parties.

This SIBD DWP addresses the requirements of CRL designation Condition 61 and will be implemented throughout the construction period. The SIBD DWP has been prepared by Link Alliance and forms part of the Construction Environmental Management Plan (CEMP) for the Normanby Road early works.

SIBD Methodology and CRL Designation Conditions 2.1 SIBD DWP Authors

This SIBD DWP has been prepared by John Daly, Hilary Konigkramer and Duncan Whyte, and has been reviewed by Kim Hardy (technical reviewer).

John holds a MA (Hons) in Sociology and a MSc in Urban and Regional Planning. He is a Chartered Member of the Royal Town Planning Institute and a member of the New Zealand Association for Impact Assessment. John has 12 years of professional experience including the preparation of Town Centre Impact Assessments, Environmental Impact Assessment Screening and Statements of Community Involvement for commercial, industrial and hotel development in London, UK; community consultation and engagement for residential development and to inform planning guidance in Scotland and London, UK. Hilary holds a Bachelor of Social Science (Honours) in Environmental Management and has practised as an environmental and social consultant for over 18 years. As a Social Impact Assessment (SIA) specialist, she is skilled in public, community and stakeholder engagement and gained extensive experience in South Africa producing SIAs in a range of sectors including infrastructure, renewable energy, mining, and industrial. Since her relocation to New Zealand in 2019, Hilary has continued her social science career by providing advisory support in the mining sector and conducting a social impact assessment for a component of the Northern Corridor Improvements Project.

Duncan holds a Bachelor of Arts (Hons) in History and Geography and a Master of Regional and Resource Planning. Duncan is a Full Member of the New Zealand Planning Institute. Duncan has 24 years of professional experience including consultation and engagement and Environmental Impact Assessment for infrastructure projects in New Zealand and Australia.

Kim holds a MSocSci (Hons) in Human Geography and Resources and Environmental Planning. She has been a practising planner for 28 years and is experienced in public and stakeholder engagement, assessing social and cultural impacts of land development and infrastructure projects. Kim completed her Masters Thesis on ‘Effective Public Participation and the Resource Management Act 1991’. She has 10 years’ experience as an Independent Hearings Commissioner and Chairperson and is an experienced statutory planning decision maker. She holds full IAP2 Australasia Certification in Engagement. Kim has been a Full Member of the New Zealand Planning Institute for 24 years and is a member of the New Zealand Association for Impact Assessment.

2.2 IAIA Guidance for Assessing and Managing Social impacts of Projects (2015) To ensure effective and robust practices the ‘International Association for Impact Assessment Social Impact Assessment: Guidance for Assessing and Managing the Social Impacts of Projects’ has informed the preparation of this SIBD DWP. This states: ‘Social Impact Assessment (SIA) is now conceived as being the process of identifying and managing the social issues of project development and includes the effective engagement of affected communities in participatory processes of identification, assessment and management of social impacts. Although SIA is still used as an impact prediction mechanism and decision-making tool in regulatory processes to consider the social impacts in advance of a permitting or licencing decision, Page 8

Social Impact and Business Disruption Delivery Work Plan equally more important is the role of SIA in contributing to the ongoing management of social issues throughout the whole project development cycle, from conception to post closure.’1

2.3 International Association for Public Participation To ensure effective communication and consultation practices the International Association for Public Participation engagement spectrum2 has been taken into account for the purposes of engagement with the affected community.

2.5 SIBD DWP Review and Updates This SIBD DWP is a live document that will be reviewed as a result of a material change to the project, or to address unforeseen adverse social impact and business disruption effects arising from construction, unresolved complaints or as an outcome from SIBD Monitoring.

Normanby Road Early Works 3.1 Overview of Works

The Normanby Road early works involve demolition of the building at 11 Water Street, establishment of a Construction Support Area (CSA), construction of a temporary pedestrian bridge across the NAL and diversion of temporary and permanent utilities (such as water, wastewater, stormwater, gas, electricity and communications) along and in the vicinity of Normanby Road.

The early works are required in advance of the main construction works to provide adequate clearance between the CRL works and network utilities to enable construction of retaining walls, the Normanby Road grade separation bridge and the realigned Normanby Road / Boston Road / Nugent Street roundabout.

The Normanby Road early works are planned to extend over seven months, between March 2020 and September 2020. Figure 2.1 shows the area of these works.

3.2 Construction Methodology The Normanby Road early works will be divided into stages as described in the CEMP and the Construction Staging Plans dated 10 October 2019 in Appendix B of the CEMP. A summary of the stages is presented in Table 3-1 below.

4. SIBD Assessment and Community Profile 4.1 CRL NOR Social Impact Assessment5 Summary A Social Impact Assessment (SIA) was submitted in support of the Notices of Requirement (NoR) for the CRL designations and is referenced in designation Condition 1. The purpose of the NoR SIA was to provide an assessment of the likely social consequences (benefits and dis-benefits) that may arise because of the CRL project as a whole.

The four key areas of potential adverse social impacts arising from construction of the CRL were identified in the NoR SIA as including: 1. Loss or disturbance of community facilities and social services as a result of the proposed works could disrupt people’s way of life and community cohesion.

2. Severance between communities, facilities, residents and businesses, particularly during construction, could impact on people’s way of life and community cohesion.

3. Physical impacts of construction works could impact on people’s health and wellbeing (e.g. as a result of nuisance or disturbance from construction noise, vibration or other discharges, or from the uncertainty/frustration arising from changes in accessibility for people living and working in the areas affected by the construction activity).

4. Impacts on individual tenants and landowners, resulting from issues associated with property purchase, relocation and/or displacement.

Additionally, the Traffic Impact Assessment (TIA) referred to in the SIA identified that the adverse temporary effects all relate to the management of the existing road transport network during construction. The key adverse temporary effects include disruptions or inconvenience to: •

Emergency service vehicles;

•

Bus operators and users (private and public);

•

Private vehicles;

•

Couriers and delivery vehicles;

•

Freight vehicles; and

•

Cyclists and pedestrians.

The Noise Assessment referred to in the SIA identified that the disruptive and adverse temporary effects relate to construction related noise generated in the areas where surface works are occurring, particularly when works are undertaken at night.

The NoR SIA identifies the need for the mitigation of potential adverse impacts. To address social impacts the development of a Social Impact Management Plan was recommended, in conjunction with on-going consultation with key stakeholders and communities of interest. This SIBD DWP has been prepared to address this requirement with regard to the Normanby Road early works. Wider communication will be led by the Link Alliance’s Communications and Engagement team and will align with the CCP. The TAP DWP and the CNV DWP have been prepared to address transport effects and noise and vibration affects respectively.

Social Impact and Business Disruption Delivery Work Plan The NoR SIA also identified a number of positive effects associated with CRL once the line and stations are operational. These include: • • •

Increased train capacity improving accessibility and connectivity for people, Increased commuter access stimulating economic development and enhancing commuter well-being.

Being a catalyst for inner city redevelopment, resulting in land use intensification and regeneration of central city areas. With positive effects including improved quality of environment, economic opportunities and opportunities for increased community development in the city centre area.

It is however acknowledged that these effects may not be apparent or tangible to the affected community during the construction of the Normanby Road early works.

4.2 The Impacted Community Profile 4.2.1. The SIA Description of the Social Environment A desktop scoping and profiling exercise was undertaken as part of the NoR SIA. The findings are summarised below, and a further profiling exercise was undertaken for this early works SIBD DWP as discussed below.

A summary of the NoR SIA Land Use Survey results characterised the Mt Eden area as: • •

The most commonly occurring land use identified in this area was Retail (including shops and cafes), followed by Commercial Office.

‘Other’ activities (such as educational facilities and car parks) as well as the Chinese Community Centre also featured in this area.

The NoR SIA identified social infrastructure within the Mt Eden area. On review it was confirmed that none of the social infrastructure identified lies within the area that will be affected by the Normanby Road early works. The works will not compromise access to social infrastructure for the surrounding areas.

The SIBD team undertook a further assessment to ensure the Link Alliance’s understanding of the potentially impacted community profile is accurate and specific to the location of the proposed Normanby Road early works. A desktop scoping and profiling exercise was undertaken in order to identify the affected community and to identify the social and business environment prior to undertaking face to face meetings and site visits. This desktop exercise was further refined with the findings from meetings and discussions with the business and residential community.

4.2.2. Mt Eden Local Profile The Mt Eden suburb is characterised by residential units and apartments; commercial buildings; and retail operations (including shops and cafés). The area is home to the historic Mt Eden Corrections Facility and New Zealand’s largest sports stadium, Eden Park. It is in close proximity to SH1 and public transport options (such as the western train line, Mt Eden and Grafton Railway Stations and bus routes). For businesses located in this area, convenient access to major roads supports both a local and regional customer base.

Mt Eden is an established suburb. It is attractive to residents as it is in close proximity to schools (being in the catchment of Auckland Grammar School and Epsom Girls Grammar School), close to the CBD and within walking distance of restaurants and cafés.

Social Impact and Business Disruption Delivery Work Plan Overview The area is characterised by both residential and commercial properties, with the Mt Eden Corrections Facility is located within the affected community area. With the exception of the residential apartments located at 22-24 Normanby Road and 25-27 Enfield Street, the area is predominately commercial in character.

A range of commercial and retail businesses operate within the area adjacent to the area associated with the Normanby Road early works, the larger of these include Office Max and Cory’s Electrical Head Office. There are a number of restaurants located on or accessed from Normanby Road, including Sen Vietnamese Kitchen & Bar, Wok N Noodle Bar and The Good Home.

The team noted a low number of pedestrians utilising the pavement area along Normanby Road.

4.2.3. Demographic Profile Desktop research was undertaken of the Waitematā and Albert-Eden Local Board Area Demographics Report Card 2016 and New Zealand Census data to further inform the Link Alliance’s understanding of the community profile.

The NAL forms the boundary between the two local board areas within the area where the Normanby Road early works are proposed to take place. The majority of the early works area falls within the Albert-Eden Local Board Area. As a small portion of the early works area, including a few properties identified as affected, falls within the Waitemata Local Board Area this was included in the review for completeness.

The area houses several significant facilities including Greenlane Clinical Centre, Alexandra Park Racecourse, Epson campus of the University of Auckland, UNITEC, Eden Park and St Lukes Shopping Centre.

In 2013, there were 31,815 households in the Albert-Eden Local Board area, 7% of the regional count.

As at February 2015, the area accounted for 6% of all employment and 7% of all businesses in Auckland.

The largest sector of employment is the health care and social assistance sector (20%) followed by the education and training sector (13%), professional, scientific and technical services sector (12%) and the retail sector (11%).

In comparison to the regional population, the area’s local population is slightly overrepresented in the working age population (15-64 years), with slightly smaller proportions of the younger (0-14 years) and older (65+ years) age groups.

More than a third (36%) of residents were born overseas, and of that group, 45% had been in New Zealand for less than ten years. The largest group born overseas was from the People’s Republic of China, followed by India and England.

The area houses a large tertiary and private education sector, the Ports of Auckland, the Auckland City and Starship Children’s Hospitals, Westhaven Marina, Britomart Transport Centre and a range of tourist and recreational attractions.

In 2013, there were 31,650 households in the Waitematā Local Board area, 7% of the regional count.

The area is a significant centre of employment which is mostly concentrated in the City Centre. It accounts for 24% of all employment and 15% of all businesses in Auckland.

The largest sector of employment in the local board area is the professional, scientific and technical services sector (22%), followed by the financial and insurance services (10%).

The area is under-represented in older and younger age groups and over-represented in age groups between 20 and 34 years, resulting in a median age of 30.4 years compared to a regional median of 35.1 years; More than a third (43%) of local residents were born overseas, and of that group, 63% had been in New Zealand for less than ten years, and 47% for less than five years. The largest group born overseas was from the People’s Republic of China and the United Kingdom, with smaller groups from India and Korea.

New Zealand Census data The 2018 Census data has been released which shows that the population of the Albert-Eden Local Board area has increased by 4.1% (3,927 people) to 98,622 since the 2013 census. There has been a slight increase of 180 occupied private dwellings to a total of 32,142. The median age in Albert-Eden was 34.2 years in 2018, compared with the Auckland average of 34.7 years.

2018 Census data shows that the population of the Waitemata Local Board area has increased by 5,730 to 82,866 people since the 2013 census. The number of occupied private dwellings has also increased by 2,730 to 35,007 and that the median age was 31.4 years, compared with 34.7 years in Auckland.

The Albert-Eden and Waitematā Demographics Report Card data and the available 2018 census data relates to a significantly larger area than the Normanby Road early works. The 2013 Census data was reviewed to provide a more localised understanding of the early works area and affected community. This showed that the area has a population of 411 people and 87 households with an average age of 27.9 (Table 4-1; Figure 4-1).

4.2.4. Local Community Planning The key local planning document is the ‘Newton and Eden Terrace Plan 2016-2046’ which was developed jointly by the Albert-Eden Local Board and the Waitematā Local Board.

The purpose of the Newton and Eden Terrace Plan is to provide a clear planning framework to guide how the area could grow and change over the next 30 years.

The document identifies five key moves that are integral to change in the area: 1. Establish Newton as a prominent centre for business, residents and visitors with its own unique identity.

2. Create a great place for people within Newton and Eden Terrace through the provision of good quality interconnected public spaces and community facilities.

3. Enhance pedestrian and cyclist amenity and provide for public transport movement through and within Newton and Eden Terrace.

4. Integrate new development whilst protecting the historical and cultural character of Newton and Eden Terrace.

5. Promote the City Rail Link and public transport improvements as the catalysts for new investment and growth in the area.

The Normanby Road early works are required to enable the construction of CRL at Mt Eden. The changes to Mt Eden Station and surrounds are a key part of the overall strategy for the Newton and Eden Terrace Plan 2016-2046.

4.2.5. Uptown Business Association The Uptown Business Association area is the area bounded by Mt Eden Road, Khyber Pass Road, Symonds Street, Newton Road, and New North Road. The association has some 700 businesses as members. Its stated mission is: “The mission of the Association is to preserve and enhance Uptown as a vibrant, innovative and attractive urban place. We support the success of existing and future businesses”.6 The Uptown Business Association is a partner with Auckland Council in its city-wide Business Improvement District (BID) Programme. The Uptown Business Association: • • • • • •

Promotes the precinct identity and activity through marketing activity.

Encourages business collaboration and cross-promotion with networking activity.

Advocates the interests of Uptown businesses to local bodies over major development works in the area.

Delivers enhanced security services to protect businesses and monitor/report damage to public property.

Provides a catalyst to improve the area’s “sense of place”.

Provides a link between businesses and the resident community.

4.2.6. CRL Media Coverage A review of recent news articles was undertaken in order to obtain an understanding of the issues raised in the media in respect of the CRL works, and more specifically the works in the Mt Eden area.

Concerns including depreciating property values, noise, vibration, dust, demolition and traffic disruptions were raised by affected community representatives in the Mt Eden area were reported on recently (10 December 2019, New Zealand Herald). These matters are addressed within this DWP.

5. Consultation and Engagement 5.1 Introduction Consultation and engagement were undertaken to inform the SIBD DWP, particularly the Mitigation Implementation Plan (Section 8). This engagement was structured and informed by an understanding of CRL Designation 6, the proposed works, the affected community and the early works area.

5.2 Establishing the Affected Community The methodology adopted for determining the affected and affected in proximity parties was: 1. Consideration of the construction staging plans (Appendix B of the CEMP) in order to conceptualise the proposed works in relation to surrounding properties.

2. A desktop assessment of the sites with proximity to the location of the physical works and with potential property access impacts associated with the works (these were identified as the directly affected areas); 3. A desktop assessment of the activities within proximity of the works where limitations on the road network may impact accessibility to their site (these were identified as the proximity affected areas).

4. Confirmation of the parties affected by the works occurred during the door knocking exercise.

The focus of engagement has been on the affected community as shown in the yellow areas (affected parties) and the blue areas (affected in proximity parties) in Figure 5-1 below. Refer also Tables 5-2 and 5-3 for identification of these parties.

The SIBD SMEs also undertook a site visit to the affected community, which provided an opportunity to gain an understanding of the potential impacts of the works on the resident, business or community organisations.

Further engagement with these parties for the purpose of keeping them informed of the timing, scope and progress of the enabling works progress will be led by the Mt Eden Communications and Engagement Team. Engagement will be attended by SMEs, including the SIBD DWP team. Feedback will inform the ongoing work on the Mitigation Implementation Plan and Development Response Plan (DRP) set out in Section 8.

The approach to engagement with the affected community is set out in Table 5-4 below.

Social Impact and Business Disruption Delivery Work Plan The engagement meetings where CRLL or Link Alliance had ‘no existing relationship’ were led by Hilary Konigkramer and a member of the Mt Eden Communication and Engagement Team.

Where specific areas of concern were identified such as noise and traffic, the SIBD DWP team undertook to facilitate a follow up visit with the relevant expert to address the specific issues of concern.

A summary of consultation is provided in Section 6, with more detail contained within Appendix A.

5.4 Face to face Engagement with Affected Parties The purpose of the face to face engagement (arranged meetings, door-knocking, information hub sessions, and CLG meetings) was to: 1. Establish positive working relations between the community affected by the Normanby Road early works and the Link Alliance, being the consortium delivering these early works and the wider CRL Mt Eden works; 2. Inform potentially affected parties of the early works and the proximity to their premises. This discussion and information sought to ensure affected parties understood the work prior to seeking feedback; 3. Obtain feedback from affected parties on the matters identified in CRL designation condition 61.3, i.e. the type and scale of disruption, specific access and servicing requirements, and client and visitor behaviour and requirements, and to gain an understanding of the extent of impacts the affected community may experience; and 4. Develop avoidance, remediation and/or mitigation measures to address the issues and concerns identified, as far as reasonably practicable.

To ensure a level of consistency and that the matters set out in the designation conditions were addressed during the engagement interviews, a series of questions were asked relating to the operation of the business/residential accommodation and specifically about social impacts / business disruption resulting from the Normanby Road early works.

5.4.1. Engagement Material The SIBD DWP team received a detailed brief and set of plans on the Normanby Road early works prior to commencing engagement. The team took these plans on site to brief the affected community.

Copies of the Normanby Road early works information factsheet and / or the calling cards (both attached in Appendix C) were left with each affected party, which included contact details for the Link Alliance Mt Eden Community and Engagement Team and were provided to owners/occupiers not present at the time of door knocking.

6. The Affected Community’s Feedback Feedback, via scheduled meetings and a door knocking exercise, was received from owners or occupiers (affected parties) of 25 properties within the affected community. This feedback exercise was spread across the geographical area of the works and was obtained predominantly from business owners or managers and residential property managers.

Further feedback was obtained from residents, members of the public and local businesses via the Information Hub (refer to Section 6.6), and CLG meetings (Appendix D).

In addition to meeting affected parties, an understanding of the impacts has been gained from a review of the other SIBD DWPs prepared for CRL activities and discussion with the SMEs, including transport and acoustic specialists, and the feedback received as part of the SIBD DWP prepared for the Mt Eden enabling works (October 2019).

Figure 6-1 below provides an overview of the key concerns and the location of the parties consulted.

The majority of affected parties are concerned about a combination of issues. The two most prevalent concerns were access for both staff and customers and ensuring that deliveries and servicing for business properties is maintained. Appendix A identifies the affected parties and summaries the individual feedback received.

The level of engagement is considered appropriate and enabled the SIBD DWP team to identify social impact and business disruption concerns and issues. The concerns and issues raised by affected parties are discussed further below.

6.1 Uptown Business Association The Link Alliance’s SIBD team met with the Uptown Business Association on 29 August 2019. The purpose of this meeting was to draw on the expertise and insight that the business association has of the Mt Eden area, the wider area, and the community.

Given that the Normanby Road early works are located within the Uptown Business Association area, the feedback obtained from this meeting, relevant to the works, is outlined below: •

•

Uptown Business Association members concerns relating to CRL include disruption to parking and traffic flows, and that the best support would be advanced communication and regular updates Hoardings are unlikely to be needed for wayfinding, but images and updates of what is being developed would be preferred.

The General Manager of the Uptown Business Association is a member of the CLG. The Mt Eden Communication and Engagement Team meet monthly with the General Manager to provide an update on project matters.

6.2 Mt Eden Corrections Facility The SIBD team met with the Department of Corrections representatives of Mt Eden Corrections Facility. The key issues and areas of concern raised regarding the Normanby Road early works were: • • •

Access for delivery vehicles and prison escort bus essential Loss of utilities, in particular communications, is of significant concern Importance of continued communication regarding the CRL works

6.3 Tram Lease Limited A meeting was held with Tram Lease Limited, owner of 32 Normanby Road, with the property management company (Morton Property) and tenant representatives present on the 17 October 2019.

Designation Condition 61.5 stipulates consultation requirements in respect of the site at 32 Normanby Road. When scheduling a meeting with the owner of 32 Normanby Road, their preference in respect of engaging with their tenants was established. The preference was one meeting with both the owner and tenant representatives present was held. The meeting included attendance by key CRL SMEs. Contact details were provided to facilitate direct engagement between occupiers and the Link Alliance, and further engagement will be in line with the CCP. The key issues and concerns raised during the meeting can be summarised as follows: • • •

6.4 Dilworth Trust Board A meeting was held with Dilworth Trust Board, owner of 51-63 Normanby Road, with property manager and tenant representatives present.

6.5 Residential Properties Residential properties likely to be affected by the works include: • •

22-24 Normanby Road – Normanby Mews Apartments 25 Enfield Street – Miro Apartments

Engagement to date has occurred with a property representative, typically the building managers or body corporate chairperson, and not with individual apartment residents.

Both the owner and building manager for Miro Apartments had no significant concerns regarding the early works. The only concern that residents were likely to have was regarding noise associated with night works.

The body corporate representative for Normanby Mews did not want to discuss the early works.

The preferred method for distributing information to apartment owners and tenants was discussed during engagement with the property representative. Further engagement with these parties for the purpose of keeping them informed of the timing, scope and progress of the enabling works progress will be led by the Mt Eden Communications and Engagement Team. Engagement will be attended by SMEs, including the SIBD DWP team. Feedback will inform the ongoing work on the Mitigation Implementation Plan and DRP set out in Section 8.

6.6 Noise and Vibration Sensitive Receptors One of the key SIBD issues identified for the properties affected by the Normanby Road early works is the potential noise impact.

The acoustic team have confirmed that Site Specific Construction Noise Management Plans (SSCNMP) and Site-Specific Construction Noise and Vibration Management Plans (SSCNVMP) have been prepared for the following residential and commercial / retail properties: • • • • • • • •

Face-to-face engagement took place with the above listed properties, with the exception of 71 Boston Road and 22-24 Normanby Road.

The Mediaworks site at 71 Boston Road was identified by the SMEs as it is considered a ‘notable receiver’ (due to the television recording activities undertaken at this property) within 100m of the Page 31

Social Impact and Business Disruption Delivery Work Plan designation footprint. As the SIBD and noise and vibration teams had recently engaged with Mediaworks extensively, email communication with Mediaworks was undertaken, with an offer of further consultation if required.

Numerous attempts were made to engage with the body corporate of Normanby Mews, the residential apartments located at 22-24 Normanby Road. The body corporate advised they did not want to discuss the early works. Further engagement with residents will be led by the Mt Eden Communications and Engagement Team in line with the CCP. Engagement will be attended by SMEs, including the SIBD DWP team. Feedback will inform the ongoing work on the Mitigation Implementation Plan (Section 8) and SIBD Monitoring Plan (Section 10) The SSCNVMP and SSCNMP’s identify the ‘best practicable option’ for managing construction noise and vibration in relation to these properties, taking into account the specific activities undertaken on each property.

6.7 Open Information Sessions The Link Alliance held information sessions as part of its wider engagement strategy. These sessions were held initially at 16 Nikau Street and are now taking place at 97K Mt Eden Road. The SIBD DWP team provided details of the information sessions as part of its door knocking exercise and freestanding signage was displayed to attract passers-by. The information sessions were promoted by the Mt Eden Communication and Engagement Team to local stakeholder by email and on the CRL website and social media channels.

The information sessions were held between 5:00pm and 7:00 pm on a Wednesday evening over the SIBD DWP engagement period. These sessions continue to be held by the Link Alliance.

The feedback received from the information sessions was largely positive. The local community was primarily interested in understanding more about the broader programme of works for Mt Eden, rather than specifically concerned with the Normanby Road early works. No concerns or comments were made in respect of the Normanby Road early works. SIDB representatives were present at some of the information sessions and were available to discuss SIBD implications of the broader project.

6.8 Community and Business Liaison Group The Mt Eden CLG consists of members from a cross-section of the community, including residents, property owners, businesses and interest groups. This group is concerned with all aspects of the CRL Mt Eden works.

The CLG has the following role: • • • •

an avenue for local community representatives to understand and share what’s happening in their area during construction. monitor and give feedback on the effects of construction on their community. provide input into the preparation of the CEMP, DWPs and MPs designed to help manage the impacts of construction. reviews of the CEMP, DWPs and MPs, including this SIBD DWP.

A CLG meeting was held on 25 November 2019 to provide an opportunity to discuss the Normanby Road early works and present the summaries of the DWPs. Hilary Konigkramer attended this Page 32

Social Impact and Business Disruption Delivery Work Plan meeting to listen first hard to the issues raised by members of the CLG in relation to the potential SIBD impacts, and to provide a summary of the outcomes of the SIBD DWP. The CLG meeting commenced with an introduction to the CRL team members in attendance and a presentation was provided which covered the following: •

Users of street parking on Normanby Road: it was suggested that if used by employees of businesses on Normanby Road, AT could provide complimentary HOP cards for the duration of the disruption Clarification on the duration of street parking loss: parking will be removed in sections as work progresses, which each section affected or 2-3 weeks at a time.

Auckland Transport to consider offering resident parking permits to owners and occupiers affected by the CRL works.

Clarification on why the Flame Tree is classed as ‘notable’: specified in the Unitary Plan.

8. Mitigation Implementation Plan 8.1 Introduction Social impact and business disruption effects will be mitigated through the suite of DWPs and MPs required under the CRL designation and resource consent conditions.

This section of the SIBD DWP summarises the mitigation actions to be implemented in relation to the Normanby Road early works These have been informed by the feedback from the affected community. Additionally, mitigation of the specific concerns raised by individual affected parties is set out in Appendix A.

8.2 Roles and Responsibilities The key Link Alliance personnel responsible for the delivery of the actions and recommendations in this SIBD DWP are identified in Error! Reference source not found. below. Refer to the CEMP for further detail on roles and responsibilities.

To ensure the commitments made through the proposed mitigation measures, key staff will be informed of their obligations and responsibilities.

In addition, all site personnel including subcontractors are responsible for implementing the requirements of this SIBD DWP. Table 8-1: Roles

8.3 Compliance with Designation Conditions The Link Alliance are required to comply with all relevant designation and resource consent conditions. This will be achieved via the implementation of the CEMP, DWPs and management plans that form part of the Outline Plan for the Normanby Road early works.

The Planning section of the website includes explanations of key planning terms, the designation and resource consent decision notices and consent documentation for each station area.

The Mt Eden Communications and Engagement Team promotes the website as a key source of information for the public to keep up to date with the project’s progress.

8.4 Continuous Up to Date Engagement The need for early, continuous and up to date engagement was raised by a number of parties. This will be undertaken by the Mt Eden Communication and Engagement Team including: a) Courtesy visits and /or email updates to businesses and residents to check in with parties regarding the Project. The purpose being to obtain feedback on any issues of concern and identify pathways for their resolution in liaison with the appropriate team. b) Progress meetings with businesses and residents, to confirm the programme of the early works and when scheduled works will take place. c) Providing advance notice to businesses and residents on the scope of works on a regular basis. This is necessary to ensure businesses can plan ahead and advise customers in advance of their arrival. d) Engagement with the affected community, via: • Works notification letters • Local drop-in sessions • Monthly email newsletters • On-site signage for key traffic shifts • Digital communications including website updates and social media updates • Advertising and campaigns for major traffic shifts • Regular CLG meetings • Regular meetings with key stakeholders

8.5 Development Response Plan (DRP) A range of DRP measures are set out in Appendix E and the responsibilities of the Development Response Manager are set out in Appendix F. The DRP measures will be implemented alongside the construction works, where appropriate and practical, to mitigate SIBD impacts on affected parties.

The DRP will link to the DRP for the Mt Eden early works were practicable.

The DRP measures have and will continue to be developed in consultation with the affected community.

8.6 Contractor Briefings The Construction Manager will brief all contractors prior to their arrival on site and ensure they are fully aware of the project obligations to stakeholders within the area of the construction works (refer to the CEMP for further details regarding inductions and training). This will include a requirement to treat adjoining businesses as ‘project neighbours’ and ensure that, as far as practicable, the contractor’s day to day actions around the periphery of the site and their interface with the public areas is as considered as possible. This includes, for example, staging work to Page 37

Social Impact and Business Disruption Delivery Work Plan minimise disturbance, that works are co-ordinated on an area basis and that re-work and consequential additional disruption is not required.

The Contractor Briefings will be updated to respond to feedback from the continuous engagement with the affected community.

8.7 Noise and Vibration Disruption Construction noise, including night noise, and vibration will be managed, monitored and mitigated through the Construction Noise and Vibration (CNV) DWP prepared for the Normanby Road early works. Mitigation measures are set out in Section 7 of the CNV DWP and include the following: • • • • • •

Training Contractor hours Mechanical plant selection General mitigation measures Noise barriers and enclosures Measures identified specific to concrete and paver cutting, concrete and rock breaking and piling activities

The SSCNMPs and SSCNVMPs provided in Appendix C of the CNV DWP will be implemented as required. Refer to the CNV DWP for parties requiring a SSCNMP or SSNVMP to be prepared.

Affected parties will be provided with advance notice of construction works commencing and an understanding of noise levels. This engagement will be led by the Mt Eden Communication and Engagement team in conjunction with the noise and vibration SMEs.

8.8 Transport Access and Parking Disruption Disruption to transport, access and parking will be managed, monitored and mitigated through the Transport, Access and Parking (TAP) DWP. The TAP DWP includes a detailed assessment of transport related effects and the mitigation measures as summarised in the sections below.

In addition to the mitigation measures that are set out in the TAP DWP, ongoing and proactive communication will be maintained to inform the affected community of traffic management changes and to allow them to plan ahead for works. Communication will also be key to avoiding or reducing uncertainty about the nature of the traffic management changes.

8.8.1. Vehicular Access and On Street Parking A key transport mitigation method will be the development of a number of temporary Traffic Management Plans (TMPs) which will be implemented for the works, with evolving traffic management requirements and lane configurations as required.

During consultations it was confirmed that two-way vehicle access will be maintained to all business accessways as far as possible. Access will be maintained for deliveries and customers.

During all stages of the works, all existing traffic movements between public streets will continue to be available. Traffic management provisions proposed will ensure that vehicular access will be maintained as far as practicable.

Social Impact and Business Disruption Delivery Work Plan Kerbside parking on both sides of Normanby Road (approximately 180m) will be temporarily removed for the installation of the permanent south sewer line. The majority of this parking demand will be displaced to neighbouring roads.

The affected community and the Uptown Business Association will be given advance notice of the traffic management and car parking measures prior to their implementation.

8.8.2. Pedestrian and Cyclist Access Pedestrian and cyclist access will be maintained throughout the construction area at all times. In accordance with Condition 30.1(o), a 1.8m wide footpath will be maintained on the northern side of Boston Road. Safe temporary pedestrian crossing facilities will be provided at either extent of the Boston Road works.

Where works will occupy the footpath on one side of the road, then pedestrians will be directed to the footpath on the opposite side of the road. Appropriate sign-posting and crossings will be provided.

8.8.3. Public Transport Neither Normanby Road or Boston Road serve as a bus route. The nearest bus route is Mt Eden Road. The construction traffic movements for the Normanby Road early works are not anticipated to generate any noticeable adverse effects on public transport services and facilities on Mt Eden Road.

8.8.4. Transport Disruption Communication Plan Link Alliance will implement a Disruption Management Communications Plan for the Mt Eden Station closure (not directly associated with Normandy Road Works, but it is recognised that the closure will be concurrent to the works). The Plan will clearly identify and effectively communicate how disruption will impact on all stakeholders, such as public transport users and motorists, businesses, residents and visitors to the area.

Link Alliance will work with Auckland Transport to develop and implement proactive communications for all transport users notifying them of the disruption and planned mitigations, including details of ATs accessible travel7 and travel plan8 resources. These measures will also help mitigate the loss of on street car parking.

Wider communication and engagement will be led by the Mt Eden Community Manager with input from SMEs as appropriate. This includes regular meetings with employers to ensure that they are aware of the works and the impact on the traffic network and can pass this information on to staff, visitors and employees.

8.8.5. Construction Traffic Construction related vehicles for the early works are anticipated to be less than 40 vehicles per day.

Most of the construction traffic relates to travel of site personnel and the delivery of materials to site, both of which are planned to occur outside of commuter peak hours.

Social Impact and Business Disruption Delivery Work Plan The potential effect on the operations of Normandy Road, Water Street and Mt Eden Road are considered to be very minor and communication on the timing and nature of track will build knowledge within the community (and as such mitigate any uncertainty in the affected community around construction traffic levels).

The existing Mt Eden Station will be closed to commuters from June 2020 while works are completed in the rail corridor and the redeveloped Mt Eden Station is constructed. Consultation with AT is underway regarding the operation of the public transport network.

8.9 Utility Disruption Minimising impacts on Network Utility Operators’ services will be achieved through collaboration with the local community, regarding the installation of the respective new networks and switch over from old to new.

Supply outages have the potential to have a significant effect on people and their ability to conduct business. Therefore, advanced communication of planned network service suspension or outages needs to be advised to the affected community, so that backup arrangements can be put in place e.g. water storage.

Network Utility Operator procedures for utility disruption will be followed in the event that an unplanned utility disruption occurs as a result of the Project.

8.10 Air Quality An Air Quality (AQ) DWP has been prepared by the Link Alliance for the Normanby Road early works.

This identifies that due to the proximity of pedestrians, sensitive receptors, and businesses to the works, all locations within 100m of the early works are considered sensitive9 to the effects of dust that may result from the works.

In order to minimise and avoid impacts on the surrounding community, dust and odour mitigation measures are recommended in conjunction with ongoing monitoring and engagement with the community. The measures are set out in detail in the AQ DWP.

8.11 Amenity Ongoing compliance and the implementation of the CEMP and DWPs, alongside the engagement measures outlined in Section 8.4 will ensure that the amenity impacts of the enabling works are managed, and that the affected community understand the nature, scale and timing of works.

8.12 Community Safety The proposed Normanby Road early works will take place over an estimated seven months and are not anticipated to have an impact on the safety of the community. Crime prevention, however, will be ensured through the following: • •

Provision of barrier within construction areas and security lighting in the CSA as appropriate; Replacement of street lights with temporary lighting wherever impacted;

The MfE has defined the sensitivity of different land uses in its Good Practice Guide for Assessing and Managing Odour in New Zealand. These definitions apply equally to the effects of dust, with both high density residential and commercial/retail areas considered to have high sensitivity.

Clear identification of entry/exit points for work areas and Construction Support Area at 1122 Boston Road; Ensuring work areas are well managed to discourage antisocial behaviours, defacement or vandalism of construction areas (such as through graffiti) or crime; Providing well-defined and well-lit pedestrian routes with clear sight lines to promote convenient and safe movement within and adjacent to the area of works; and Providing legible and informative wayfinding signage within and around the works area as appropriate to the construction staging.

Further detail on the above is provided within the CEMP.

8.13 Health and Wellbeing It is recognised that the social impacts and business disruption resulting from the enabling works could affect the health and wellbeing of the affected community with concerns also raised by some parties during the door knocking.

The Link Alliance will support businesses by providing pro-active communication on construction timing and scope of work to minimise risk of anxiety and stress around uncertainty. This will be a key action for monitoring and review to understand what may need to be updated during the enabling works and inform the preparation of subsequent SIBD DWPs and DRPs. Link Alliance will provide information on how to contact practical help agencies - including external helplines, local mental health services, counselling and support agencies. This information will be made available in pamphlet form using multiple channels such as info@cityraillink.govt.nz, the CRL project website, and local project information centres.

Link Alliance will continue to work with the affected community, and through the CLG it will offer workshops for affected parties to address topics such as coping with stress, resilience, staying positive through difficult times, looking after self, and strategies for managing challenging situations.

These workshops would be facilitated by appropriately qualified professionals such as counsellors, psychologists, and business advisors.

8.14 Business Disruption Potential loss of trade was raised as a concern at the meeting with Dilworth Trust and their tenants.

Construction activity and traffic management measures may reduce the visibility of some businesses and result in the loss of through traffic and customer street parking.

The Link Alliance are preparing a DRP, in conjunction with SIBD DWP specialists and other SMEs, the Uptown Business Association and affected businesses (refer to Section 8.5 and Appendix E). This plan will address the issue of visibility and actions to be undertaken to enhance visibility for the duration of the works.

The NoR SIA stated that the CRL Project will generate both economic opportunities and impacts. The Assessment of Environmental Effects for the CRL NoR process prepared in 2012 stated that “a key purpose and driver of the CRL is to make the city centre more accessible, resulting in an anticipated increase in economic performance, and create changes in land use, development opportunities, and intensification (particularly around stations)”.

Social Impact and Business Disruption Delivery Work Plan Whilst the CRL project will in the longer term generate positive outcomes both locally and regionally, the businesses consulted to date have identified a number of concerns with the impacts of the construction works on them. These concerns are set out in detail in Appendix A. The mitigation identified is set out above. A summary of these concerns is set out in Table 8-2 below together with the recommended actions.

SMEs, including the SIBD DWP team will be consulted for input to answer public queries as appropriate.

9.2 Queries and Complaints Process Anyone can make a general enquiry via the CRL email info@cityraillink.govt.nz and freephone 0800 CRL TALK (275 8255). Additionally, parties affected by the works will be able to make enquiries via the mteden@linkalliance.co.nz email which was provided during the consultation exercise undertaken for this SIBD DWP. A record will be kept of queries and complaints received to inform the review of this SIBD DWP. It will capture additional impacts identified. It will also ensure documentation of mitigation measures undertaken to address issues arising from the project on affected parties, and that alignment is achieved with other DWPs. This record will include: −

A description of the complaint;

The issues of concern to the complainant;

−

Remedial actions undertaken in response to the complaint;

−

Who is responsible for mitigation of the complaint;

−

Timeframes for addressing the complaint, including when the complaint is resolved; and

− Any affected parties.

In addition, an update meeting will be held with the CLG at least every three months, through which social impact and business disruption concerns can be raised with the SIBD DWP team and other SMEs (refer to Section 6 of the CCP).

9.3 Disputes Resolution Disputes may arise where a stakeholder affected by an issue considers their complaint has not been resolved. In the context of this SIBD DWP, disputes may arise relating to: • •

Social impacts and business disruption Claims of financial loss due to construction effects on businesses in proximity to the works

With respect to SIBD related complaints/disputes these will be handled in line with the complaints process set out in Section 7 of the CCP.

9.3.1. Public Works Act 1981 Financial compensation under the Public Works Act 1981 is outside the scope of this SIBD DWP, however any claims received by the Link Alliance will be forwarded to CRLL. A claim for financial compensation under the Public Works Act 1981 is a possibility for affected parties who are significantly affected by the project. The Public Works Act entities affected parties to compensation for ‘substantial injurious affection’, which may include damage to property or losses to a business.

10. Reporting 10.1 SIBD Monitoring Plan Whilst the early works will take place over a limited timeframes, the works will be monitored to allow for relevant changes and updates to be made to the mitigation plan.

The Link Alliance will monitor SIBD impacts throughout the construction process through ongoing engagement with the affected community, via the CLG, business forum and direct engagement, and from a variety of primary and secondary sources as detailed in the SIBD Monitoring Plan (Appendix G).

SIBD Monitoring will be undertaken to: • • • •

Monitor the affected communities experience and perception of SIBD impacts Monitor the effectiveness of the identified Mitigation Measures.

Monitor for any changes in the community profile of the area.

Complaints and Public Enquiries Monitoring

10.1.1. Community and Business Liaison Group Reporting The CLG will meet regularly, at least every three months, over the course of the construction works and will be an opportunity for the CLG member to ask question or to raise social impact and business disruption concerns.

SIBD SMEs will monitor feedback received at CLG meetings to measure SIBD impacts and the effectiveness of the mitigation measures. Mitigation measures will be reviewed in light of CLG feedback.

10.1.2. Regular Engagement Regular engagement will be carried out in line with the CCP but will include the Business Forum and the weekly drop-in information session and ‘meet the project team’ events. These events will provide an opportunity for the affected community to comments on the construction works and the mitigation measures.

In addition, the Development Response Manager and Mt Eden Community Manager will liaise

with affected parties on a frequent basis in relation to the DRP and wider mitigation and will seek to resolve issues with the construction team.

An SIBD focused engagement exercise will be carried out to inform the annual report. This will collect feedback from the affected community on their experience and will for the experience and perception of SIBD impacts to be measured against the feedback received as part of the engagement for this SIBD DWP.

10.1.3. Data Sources A range of primary sources will be reviewed to monitor for changes in the profile of the affected community, the extent of impacts and the effectiveness of the mitigation measures. These measures include: • • Page 45

10.2 Monthly Reporting to Auckland Council The Link Alliance will provide monthly reporting to Auckland Council, demonstrating how the works continue to be undertaken in accordance with all the relevant management plans and CRL consent conditions. If issues raised are significant and require a revision to this SIBD DWP, including the mitigation implementation plan, the DWP will updated and submitted to Auckland Council for approval.

10.3 Annual Report The SIBD SMEs will prepare an annual report on the identification, monitoring, evaluation and management of the effects outlined in this DWP, along with a summary of any comments or complaints raised by the community, including how these have been addressed.

The annual report will be informed by the SIBD Monitoring Plan and this will be made available on the CRLL website.

Appendix D: Record of CLG, Independent Peer Review and Auckland Council Feedback D1. CLG Comments A CLG was held at 97 Mt Eden Rd on the 25 November 2019. An overview of the key social issues identified from consultation with affected parties, and the mitigation identified to address these, was provided. The importance of ongoing communication was reiterated and will be provided in line with the CCP. No SIBD specific concerns were raised.

D2. IPR Comments Independent Peer Review Comments Consistency with CEMP 1) On pp.56-57 of the CEMP the SIBD DWP is well summarised. Section 6.8 of the SIBD DWP outlines the key issues raised and this is consistent with the CEMP. However, the CEMP states that “engagement with residents, communities and businesses located adjacent to and in proximity to the Normanby Road early works area was carried out between September and November 2019” (p.56). This is not reflected by the SIBD DWP which states in Section 5.3 that affected parties were engaged between 10-17 November 2019 and feedback received from the CLG meeting of 25 November 2019. The correct engagement dates should be clarified and amended in both of these documents.

Early Works Project profiling (Section 3) 2) As noted in the above comment, compared to previous SIBD DWPs (for K Rd and Aotea Stations) the SIBD DWP under review provides only a high-level summary of the proposed works for the Normanby Road Early Works. It does not include any detail of the construction methodology, hours of operation, or construction workforce. These are essential details that shape social and business disruption impacts (positive and negative) on the affected community, but are absent from the SIBD analysis and assessment. Whilst the SIBD states “refer to the CEMP for a detailed description of the works” (p.14), I feel it imperative that detailed description of the work methodology is better summarised so as to reflect the type and hours of the proposed work. I only received the CEMP on 6th December 2019.

3) Firstly, not being to review the CEMP until the last minute is a concern to the peer reviewer as the CEMP provides a detailed description of the works that is to impact the affected community and should drive the identification and planned mitigation and management of the SIBD effects. Secondly, I have had to rely on a review of the TAP DWP and CCP as a means to better understand the detail of the proposed early works until the CEMP was made available (5th December). The TAP DWP provides a comprehensive overview of the proposed works, and I do not understand why the SIBD DWP does not reflect such an adequate level of detail too, given that effects are upon people living and working and commuting within the project area, which will inform traffic management mitigation strategies. I suggest that a more detailed summary of the proposed early works Page 63

Response Section 5.3 of the SIBD DWP has been amended to reflect that SIBD engagement took place between September and November 2019.

In order to avoid duplication between the CEMP and sub-plans the approach has been amended to fully detail the works in the CEMP and summaries for the works within the sub-plans.

Table 3.1 within Section 3 provides a detailed summary of each of the stages associated with the Normanby Road early works, including timeframes and duration of activities.

Refer to 2) above.

Social Impact and Business Disruption Delivery Work Plan must be included in the SIBD DWP so that the profile of the project is comprehensive and thoroughly outlined so as to enable a more logical understanding of potential effects.

4) For example, from the TAP DWP, I note there will be night works undertaken to construct the “installation of the temporary utility and pedestrian bridge across the NAL between the hours of 9:30pm to 5:30am in late July 2020” (TAP DWP, p. 16). As far as I can understand, this work will continue throughout at least 5 of the 7 months of the early works and will likely have an impact on resident’s in particular, but is not mentioned in the SIBD DWP (nor the CEMP), even though night works are listed as a concern among some affected party feedback. Section 8.7 of the SIBD DWP notes that construction noise and vibration will be managed, monitored and mitigated through the CNV DWP and associated SSCNMPs and SSCNVMPs. However, I have not been able to review the CNV DWP and am unable to verify whether the impact of night works on residents has been identified and will be appropriately managed. As I note below, residents (Normanby Road and Enfield Street) do not appear to have been adequately engaged and, therefore, perceived effects of the night works noise and vibration upon them has not been identified and assessed in this SIBD DWP. Hence, there is also no cross-referencing to a mitigation and monitoring plan of the impacts of this particular issue in the SIBD DWP, presenting a significant gap in analysis. I suggest the issue of noise and vibration impacts on residents be clarified and their management and mitigation and monitoring be appropriately assessed and cross-referenced in the SIBD DWP.

Isolated night works are required for the Normanby Road early works. These are limited to 1 night for the sewer tie in (March/April); 1 night for installation of stormwater lines at 32 Normanby Road (March/April); and 1 night for lifting the bridge span into place (with contingency made for a second night for each of the activities listed).

The noise effects, including night noise, have been considered and mitigated within the CNV DWP and associated SSCNMPs which has been subject to review, including Independent Peer Review.

It is also recognised that management of noise via the CNV DWP alongside proactive communication is key to managing SIBD effects resulting from construction noise.

The SIBD DWP references the CNV DWP in respect of mitigation and monitoring of noise impacts (Section 7 and 8). Reference to the type of mitigation measures identified in the CNV DWP has been added to Section 8.7 of the SIBD DWP. In addition, the Link Alliance will proactively communicate the timing and nature of noise works.

5) It would also be advisable for this SIBD DWP to clarify its relationship to other CRLL works happening in the Mt Eden project area. I have referred above to general comments about the closure of the Mt Eden Station as a significant SIBD effect of the CRLL Project. The closure of the station at the time of the Normanby Road enabling works will impact on volumes of traffic, parking requirements and pedestrian movements within the affected area of the Normanby Road works, as commuters living and working in the area will have to Page 64

I acknowledge that closure is not part of the scope of this SIBD DWP, but it will likely have significant impacts upon residents and businesses, as well as workers, visitors and patrons of businesses and residents in the Normanby Rd and Mt Eden construction support areas (CSA) and active construction zones (ACZ). There is a need for the CEMP and SIBD DWP to acknowledge this closure as part and parcel of the overall project and clarify how it might impact residents and businesses as part of the scope of these Normanby Rd works and whether the SIBD DWP will address these and/or why not.

6) Similarly, I note that references to the cumulative nature of the project impacts, stated in other SIBD DWPs (MT Eden Enabling Works, Aotea station enabling works and K Road enabling works) has been removed from this SIBD DWP. As per Designation Condition 19.1 “The objective of the CEMP and DWPs is to so far as is reasonably practicable, avoid, remedy or mitigate any adverse effects (including cumulative effects) associated with the City Rail Link construction.” I contend that the cumulative nature of works that are and will occur in the Mt Eden area are significant, particularly as the construction zones at Normanby Road and west of Mt Eden Road are in very close proximity to one another. Despite, the CEMP statement in Section 3.3 that “Methods to address cumulative effects are outlined for specific activities within the relevant sub-plans. Most notably these include construction noise and vibration; transport, access and parking disruption; air quality (dust) effects; and social impacts and business disruption. Monitoring includes methods so that the effects from the construction activities are well understood”, the SIBD DWP fails to acknowledge that residents and businesses in-between and in proximity to both of these construction zones will be affected significantly by the cumulative works. It is erroneous to assume that the Normanby works exists in vacuum, separate and distinct from the Mt Eden Enabling Works, including the station closure. The community will unlikely see these projects as separate and distinct; they will be subject to impacts from both regardless of the CRLL’s project management boundaries. The existence of cumulative impacts is demonstrated in

However, the wider works and cumulative effects are acknowledged within this SIBD DWP refer to: • Section 1.2 for an overview of the approach to cumulative effects and how these will be further addressed in the SIBD DWP for main works in Mt Eden.

• 8.5 which sets out that the DRP will link to the DRP for the Mt Eden early works were practicable, and • Section 8.8.4 for an overview of the Transport Disruption Communication Plan for the wider works.

The CRL works in the MT Eden area are being taken forward in a staged manner, however the scope of the early work packages are limited in terms of the scope and timeframe of the works.

The Affected Community identified for the Normanby Road works reflects the scope of these works and the nature of the impacts that will be experienced in the early works construction period. However, the SIBD SMEs are cognisant of the feedback received as part of the preparation of separate SIBD DWPS, including for the Mt Eden early works.

The SIBD DWP for the Mt Eden main works will consider the nature and extent of impacts and the extent of the affected community for those works. The independent peer reviewer’s comments will assist that exercise.

Social Impact and Business Disruption Delivery Work Plan the comments of a small number of parties engaged (listed in Appendix A) who have raised concerns with previous/ ongoing CRLL works. Whilst businesses on Mt Eden Road have been engaged as part of the Mt Eden Enabling Works, their lack of inclusion in this SIBD DWP process for Normanby Road works is problematic. I find this situation to be a significant failing of the SIBD DWP that must be remedied.

7) On p.7 of the SIBD DWP it states this “SIBD DWP only relates to the Normanby Road Early Works, as described in Section 2 below”. The project works profile is summarised in Section 3 of the SIBD DWP. Please amend to refer to the correct section of the SIBD DWP. Community Profiling 8) As I have commented before, for good practice and consistency purposes, I feel that the profile of the affected community is somewhat disappointing, relying too heavily on outdated statistics, and should be improved to describe the local context – business types and patronage, property ownership and lease data, how people get around, where residents work and commute to, how employees travel to work in the area, its look and feel, cohesion and sense of ‘community’, and ongoing development and change. My site visit on 1st December 2019 revealed that this is an area in process of multiple developments, gentrification and change as enabled by the Unitary Plan and other local development programmes. It is this local context that the Normanby Rd enabling works are being undertaken in and should be reflected in the SIBD DWP. A more comprehensive approach and understanding of the local community profile is required.

9) Firstly, I note that the Normanby Road works is located within walking distance (some 2060m east) of the Mt Eden Demolition and Enabling works and create a second construction site by which the businesses and residents along Mt Eden Road (between Boston Road and Enfield Street) in particular, are now surrounded by. Water Street will provide access to construction traffic into the CSA. However, properties and businesses on the corner of Boston, Mt Eden Rd and Water street have not been identified as affected parties. For example, the furniture business on the corner of Boston and Mt Eden Road has closed down, and whether or not this decision is an impact of the cumulative works is not acknowledged in any of the documentation. The exclusion of businesses along Mt Eden Road between Boston Road and Enfield Street from the list of directly or in-proximity affected parties is not explained in the SIBD DWP and needs to be.

The profile of the affected community was developed from a number of sources of information, including site visits to the area and engagement with the affected community. Insights into the local context were collected as part of the doorknocking engagement which has informed the development of the SIBD DWP. Section 4.2.3 has been updated to include reference to the 2018 census data.

The affected community for this SIBD has been informed by an understanding of the nature and scope of the Normanby Road early works and the associated construction impacts.

The SIBD DWP for the Mt Eden main works will consider the nature and extent of impacts and the extent of the affected community for those works. The independent peer reviewer’s comments will assist that exercise.

Social Impact and Business Disruption Delivery Work Plan 10) Secondly, residents and businesses along the north side of Boston Road (between Mt Eden Road, Burleigh Street and Nugent Street) are also now adjacent to these two construction zones. The draft SIBD DWP, however, does not consider these areas as part of the affected community, which I feel is an error, particularly when 71 Boston Road, 5-7 Water Street, and 8, 10, 12 Boston Road premises have been selected as affected or in proximity parties.

71 Boston Street was identified as an affected party given the nature of the property (recording studio) being a notable receiver. The other properties listed (5-7 Water Street and 8, 10 and 12 Boston Road) were identified on there is the potential for noise and associated amenity effects as a result of minor sewer works to take place within these properties. The properties adjacent were not identified as likely to experience noise and vibration effects.

11) Thirdly, my site visit identified that there are affected in-proximity parties (residents and businesses) on both sides of Enfield Street (from Mt Eden Road to Normanby Road) that should be included in the scope of the SIBD DWP. This issue was also raised in feedback (Appendix A), but not addressed in the SIBD DWP. The SIBD DWP draws a boundary to include residential properties along the north (rail) side of Enfield Street as affected inproximity parties, but does not include new residences and businesses on the southern, opposite side of the street, nor the Horse and Trap pub. The SIBD DWP should preferably include these parties within the community profile or qualify why they are omitted from the scope of the analysis.

This SIBD acknowledges that during the Normanby Road early works there will be disruption to customers, visitors, and commuters. Strategies have been identified to ensure that people moving through this area during the early work have clear signage and wayfinding to ensure they are able to access the businesses and properties without too much inconvenience.

The impact of access to the prison has been identified to be minor within the TAP DWP.

12) There are also stakeholders and affected parties who are not resident or business owners, such as office staff, workers, visitors, commuters, patrons, suppliers, shoppers and clients of the few cafes, restaurants and bars who will be impacted by the project. These are affected parties and should be acknowledged and the mitigation strategies in place be reviewed to ensure they are informed and can access the businesses and residents in the project area. For example, whilst I note that SIBD DWP engagement with Mt Eden prison has taken place, the draft has not noted the impact of the works on visitors by car, bus and rail to the prison.

Consultation and Feedback (Section 5) 13) In light of my comments above, it is a significant concern that not only the affected community profile is limited, but that residents within the affected community profile (Miro Page 67

Potential impacts or effects have been based only on comments via liaising with the body corporate/ residential managers. On the one hand, the residents of the 48 Normanby Mews Apartments (a complex comprising of four x four story buildings) have been disenabled from participating by decisions of the body corp representative. On the other hand, 94 households within the Miro Apartments, Enfield Road (who are largely owners, rather than renters) have not yet been engaged. To have not engaged and provided the opportunity for some estimated 140 households to understand the project and identify their particular concerns or issues about the social impacts of the works is a significant failing of the SIBD DWP, which raises a number of concerns about the adequacy of this SIBD DWP to meet the objectives and requirements of the CRL designation conditions, namely, 61.3. It is my expert opinion that the CLG and CCP and the expertise of the persons employed by the Alliance to consult and engage throughout the implementation of the Normanby works should not replace the SIBD in its purpose under Designation Conditions 61.1, 61.2 and 61.3.

Whilst I understand that CRLL/ Link Alliance are endeavouring to meet tight time-frames, I strongly suggest that an engagement process with residents is necessary to inform this SIBD DWP before it is implemented.

14) The above concern is related to issues I have with the quality of the engagement process and methodology for the preparation of this SIBD DWP, which appears to have been limited by the fact that it was undertaken over seven days (10-17 October 2019) – a time-frame too short to enable full engagement and follow-up door knocking, face-to face meetings and best use of the infohub engagement method. It would appear as if the CCP for Normanby Road will become a proxy for this lack of engagement with potentially affected parties not yet engaged at the expense of the SIBD DWP understanding, identifying, assessing, mitigating and monitoring the concerns and potential impacts of these parties from the outset.

SIBD DWP - Roles and Responsibilities 15) The SIBD DWP does not yet identify who is responsible for developing, delivering and monitoring the DRP for Mt Eden. As I have mentioned before this is a crucial mitigation and management measure. The person responsible would best be a local or someone with knowledge, connections and relationships in the Mt Eden area (as we have learnt from what

SIBD SMEs attempted to engage with the property owners/occupiers or a building representative directly during the door knocking exercise. However, the SIBD SMEs also provided additional opportunities for the affected community to provide feedback, via four information sessions. These sessions were aimed at the community as a whole and were attended by local residents.

On the basis of the feedback received from door knocking and the information sessions it is considered that the level of engagement is sufficient to understand the issues and concerns of the affected community.

Each SIBD DWP has been informed by a robust engagement exercise which is detailed separately in each DWP. The same approach will be adopted on future SIBD DWPs. Appendix F presents the roles and responsibilities of the DRP Manager and the Mt Eden Station Manager.

It is also essential that this person works closely with the SIBD DWP team and CCP team so that DRP measures and ways of monitoring these activities are tailored to the effects outlined in the SIBD DWP. Until that role is filled, it would also be beneficial if the SIBD DWP lists the interim contact details for a contact in the project team who will be available to talk to interested stakeholders about developing the DRP. 16) It is good to note that the SIBD technical lead is listed as being responsible for SIBD monitoring. However, as I have consistently noted in previous peer reviews the monitoring roles and responsibilities need to be clarified and presented in this SIBD DWP as an implementation measure.

Identification and management of impacts (Sections 6-8) 17) Given my concerns raised above regarding both the inadequate profiling of and engagement with the affected community it is difficult to clarify whether or not all potential impacts have been adequately identified and mitigated in this SIBD DWP. There is significant (and justifiable) risk that resident’s, in particular, could challenge the adequacy of the SIBD DWP and CEMP and their failure to meet the objectives of the Designation Conditions.

Again, I strongly recommend that engagement with residents to identify and address their concerns and issues (particularly around works and cumulative effects of the project, including the proposed night works) is necessary before this SIBD DWP is implemented.

Development Response Plan 18) I repeat earlier comments made that the Development Response Plan (DRP) remains a list of potential activities in the appendix – a cut and paste from other SIBD DWPs for works in Aotea and K Road station areas. As an essential mitigation strategy this DRP should be more advanced and should be a reflection of the needs and issues particular to the Mt Eden community. Whilst I note that the Uptown Business Association is wishing to help develop this Mt Eden DRP, the SIBD DWP does not yet identify who is responsible and what resources will be required for moving this work along.

19) I am of the opinion that the preparation of the DRP requires immediate attention and should be developed in conjunction with the SIBD DWP team, communications and engagement team, CLG and interested parties such as the Uptown Business Association.

Again, the DRP as a mitigation strategy needs to be specific to the context of the project Page 69

However, it should not be assumed that this replaces the need for an adequate SIBD DWP and monitoring plan in the first place.

Section 10 outlines the approach to reporting.

A SIBD Monitoring Plan, consistent with the other SIBD DWP’s, has been included in Appendix G.

21) I continue to repeat the importance of SIBD monitoring (and opportunity to adapt and improve) the effectiveness of all the mitigation measures outlined by the SIBD, CCP and other DWPs. Section 10 does not go far enough to explain the processes and mechanisms for monitoring – what will be monitored, by whom, when and what will be done with the data gathered, and how it will inform ongoing community engagement and the next stages of the Mt Eden station project works.

22) I repeat that Section 8.5 of the SIBD DWP states “consumer spending and footfall data will be used to inform the development and ongoing implementation of the DRP”. Whilst welcome, this requires clarity on how and when this data gathering will occur, who is responsible (see comment above regarding roles and responsibilities) and what process or methodology will be used. Please remedy as part of the immediate work needed to develop, implement and monitor the DRP measures, with particular attention to how this is done in collaboration with the SIBD team.

Role of the CLG 23) It would be beneficial if the membership of the CLG, their stakeholder interests (invited and those who attend) are included in the SIBD DWP and CCP. From a peer review perspective this group is established by the Designation Conditions to perform and important role in the preparation and implementation and monitoring of this and other plans.

There is no evidence to clarify who is represented on the CLG (particularly residents who are absent from this SIBD DWP), how many reps attend the CLG meetings, and whether these members have a broad outreach to people in the local area. These contacts should be listed in the SIBD DWP and CCP in ways that protect people’s privacy but should be held on the CLM database.

24) It is my opinion, repeated on numerous occasions that a review of the role and functions of the CLG (including that in K Rd and Aotea station areas) should be undertaken as a matter of ongoing improvement to ensure its relevance and performance as a deliberative forum now and through the implementation and monitoring stage.

The SSCNMP for 22-24 Normanby Road states that the anticipated construction noise effects are predicted to be typically acceptable, but with the potential for short term disturbance.

It is considered that sufficient engagement with the affected community and the acoustic SME has allowed the SIBD SMEs sufficient understanding of the potential noise impacts and concerns.

It is recognised that management of noise via the CNV DWP / SSCNVMP alongside proactive communication is key to managing SIBD effects resulting from construction noise.

The Link Alliance will carry out the construction works in accordance with these documents and the relevant noise conditions.

Trader Directory An online directory promoting businesses to the 1600+ CRL workers expected at peak construction, encouraging them to shop local and to use local services and facilities. Also accessible by Auckland’s wider community. The Trader Directory will be printed and available at all construction sites, handed out to cruise ship passengers and will be promoted using established social media channels. It is free to list local businesses and Link Alliance has received strong interest in the Trader Directory already.

Business may register by emailing the City Rail Link at traders@cityraillink.govt.nz.

Meet the Neighbours Series CRL Ltd has started a ‘meet the neighbours’ series which profiles local businesses providing insights into business owners and the challenges and opportunities that exist neighbouring the CRL project.

The series is included in the project newsletter ‘CRL Connection’ which is disseminated to more than 4000 people. The profiles are also promoted on CRL’s social media channels and disseminated to the local community through Link Alliance’s regular email newsletters.

Street cleaning and maintenance Link Alliance will work closely with council contractor cleaning services to prioritise construction areas with regular cleaning, that is often more regular and thorough than the businesses have normally.

Business advertising Link Alliance will work with businesses to include their advertising where possible on hoarding structures.

Additional Wayfinding Signage Link Alliance will display wayfinding signage at key points to help pedestrians navigate their way through diversions.

Activations and events Link Alliance will work with the Uptown Business Association to leverage key events and festivals and promotional opportunities.

Affected Community Involvement The Link Alliance will identify opportunities for Uptown Business Association and the affected community to be consulted on and to make decisions with regards to the DRP, and it will continue to support community information sessions.
