1 INTRODUCTION The purpose of this Addendum to the City Rail Link (CRL) Enabling Works Contract 2 (C2) Social 1 Impact and Business Disruption Delivery Work Plan (SIBD DWP) is to ensure that activities associated with the CRL C2 Public Realm Reinstatement (PRR) works meet the requirements of the 2 conditions (designation and resource consent ) set out in Section 1.2 of the CRL C2 SIBD DWP . In achieving this outcome, this Addendum addresses the potential for social impacts and business disruption associated with the PRR phase of the construction works that are not covered in the CRL C2 SIBD DWP for C2. Where the impacts are already covered in the CRL C2 SIBD DWP, reference is made to the appropriate section(s) of the CRL C2 SIBD DWP.

1.1

SIBD DWP ADDENDUM AUTHOR

This addendum has been prepared by Matthew Kerr-Ridge Senior Planner at AECOM. Matthew has six years of experience as a planning practitioner. This includes providing consultation and stakeholder management, and/or social impact assessment for the projects including Ruatawhiri Park Sportsfield Lighting Upgrades, Fowlds Park Sportsfield Redevelopment, Brylee Drive Reserve Wetland Development and Central Interceptor (assisting Watercare Services Ltd) and CRL C2 (coauthorship of the CRL C2 SIBD DWP).

This addendum was prepared with support from Alan Howard-Smith, Stakeholder Communications Manager for the CRL for Connectus (the Contractor responsible for Contract 2 works). Alan has ten years’ experience in communications and stakeholder management on construction projects and has a Doctorate in philosophy. Alan has been fundamental in implementing the consultation and stakeholder communications process specified within the CRL C2 SIBD DWP and CRL C2 Communication and Consultation Plan (CCP) (CRL-PAT-CST-CON-PLN-001282).

This addendum has been technically reviewed by Craig Hind, Technical Practice Leader – Environmental Planning at AECOM. Craig has over 24 years of environmental and resource management planning experience. He is currently managing the planning and engineering inputs for the route protection of the Additional Waitemata Harbour Crossing project, is a member of the Technical Strategy Team for the Supporting Growth Alliance and was the planning and consultation lead on the Redoubt Road-Mill Road corridor designation. He has undertaken numerous stakeholder, community and Iwi consultation activities including for the Auckland Transport and NZ Transport Agency mana whenua forums and Iwi Liaison groups. On CRL C2 Craig is the Planning Integration Manager and has reviewed and approved all Outline Plan and associated Delivery Work Plan and Management Plan documents for the project to date. He was also the verifier and Project Director for the Burrumbeet to Beaufort Social Impact Assessment VicRoads which won a Consult Australia Awards of Excellence (2011).

2 PROJECT DESCRIPTION This section presents a summary of the PRR works to provide context to the SIBD DWP Addendum.

A detailed description of the PRR works is provided in the CRL C2 Construction Environment Management Plan (CEMP) – PRR Addendum (CRL-PAT-RME-AT-RPT-033021).

2.1

CONSTRUCTION METHODOLOGY OVERVIEW

Following the completion of the cut and cover trenched section of the CRL tunnel along Albert Street between Customs Street and Wyndham Street, Connectus will progress with the reinstatement of the public realm along and around the physical works area. Connectus anticipate that the completion of the cut and cover trenched section will be achieved progressively from south to north along Albert Street. Accordingly, as the tunnel is progressively completed Connectus will undertake the PRR works in a staged manner along the works area, readying Albert Street and surrounding works area for full public access once again.

The PRR works include the re-instatement of the road carriageway and footpaths, urban design enhancements, and landscaping within the CRL designation. The area for reinstatement expands beyond the works area for the cut and cover trenched section, reflecting a logical transition between the reinstated works area and surrounding public realm. Figure 2-1 provides an overview of the PRR works area.

These works will be undertaken using standard methods for road reinstatement works, including the use of jackhammers and backhoes to remove old pavements, and rollers and compactors to prepare the base course/bedding for new paving. Pavers and curb stones will be cut as required using appropriate equipment.

Note: Parts of the PRR works area are located outside the CRL designation. Any works outside the CRL designation are not specifically considered within this DWP. If required, separate resource consents will be applied for these areas.

2.2

CONSTRUCTION PROGRAMME OVERVIEW

The PRR works will progressively follow the completion of the cut and cover trenched section of the CRL tunnel along Albert Street between Customs Street and Wyndham Street. As completion of the cut and cover trenched section of the CRL tunnel will occur south to north along Albert Street so too will the PRR works. The exception is the Lower Albert Street works which will occur first to achieve parallel construction timeframes with the adjacent Commercial Bay Development at 7 Queen Street, Auckland.

Table 2-1 provides an overview of the indicative construction staging as it relates to the PRR works.

Within each area of works there will be multiple works phases (refer to the CRL C2 CEMP PRR Addendum for further detail regarding works phasing). Table 2-1 will be updated once the final sequencing for PRR works is known.

3 CONSULTATION 3.1

CONSULTATION PROCESS AND REVIEW

Extensive consultation was undertaken in 2015 as part of the preparation of the CRL C2 SIBD DWP (detailed in Section 4.0 of the CRL C2 SIBD DWP) in order to understand the specific access requirements and specific operational requirements to then develop methods to avoid, mitigate and/or remedy potential disruption issues for residents and individual businesses/services along the route and in the general area.

A detailed review of the CRL C2 SIBD DWP was conducted by Matthew Kerr-Ridge in January 2018 to determine the applicability of the previous consultation process as it relates to the PRR works. The review of the CRL C2 SIBD DWP considered the physical and temporal scope of works already consulted on and the scale of potential and actual effects generated during works and the potential for new effects as a result of the PRR works.

This review identified that: 

‘reinstatement works’ was included in the scope of works already consulted on for potentially affected parties associated with the Cut and Cover phase of works



in general, the PRR works would not introduce any new construction activities or scales of effects which would differ from the activities already consulted on



the physical extent of the PRR works will however extend further north along Albert Street than the Cut and Cover phase of works.

Accordingly, as the Cut and Cover works area had been used to determine the extent of consultation for the CRL C2 SIBD DWP, it was identified that those parties located on Lower Albert Street (Customs Street to Quay Street) had not been specifically consulted with regards to the PRR works.

Additional consultation with those parties would therefore be needed to understand their specific access requirements and specific operational requirements in order to develop methods to avoid, mitigate and/or remedy potential disruption issues for residents and individual businesses/services.

3.2

ALBERT STREET FROM CUSTOMS STREET WEST TO WYNDHAM STREET

As outlined in Section 3.1, the consultation undertaken as part of the preparation of the CRL C2 SIBD DWP included the scope of the PRR works. Accordingly, it was determined that the information gathered as part of the existing consultation would adequately support the preparation of this addendum as it relates to the works between Wyndham Street and Customs Street. This information is summarised in the ‘Key Points Raised’ outlined in Table 4 of the CRL C2 SIBD DWP and this information has been reconsidered in relation to the PRR works to direct the preparation of this Addendum.

Broadly the key points relate to the following:      

Ensuring continued pedestrian access for business customers; Providing adequate sight lines and business visibility; Providing sufficient parking and loading availability to maintain business operations; Providing wayfinding to ensure that customers, employees and deliveries are able to navigate the area with relative ease; Managing construction related activities to ensure that construction effects (noise, vibration, dust, smell, etc.) are minimised; Understanding of key operational hours and functions of business to enable construction works to be planned in coordination with these existing requirements.

It is considered that the ‘Mitigation to address concerns’ outlined within Table 4 of the CRL C2 SIBD DWP in relation to the PRR for those works between Customs Street and Wyndham Street are adequate to mitigate these concerns. As such, no further specific consultation has been undertaken with these businesses for the purposes of preparing this Addendum.

3.3

LOWER ALBERT STREET FROM QUAY STREET TO CUSTOMS STREET WEST

As the key effects generated by the works are temporary and localised construction effects the key stakeholder potentially affected by the works are those parties located directly adjacent to the construction area. For those works occurring in Lower Albert Street between Quay Street and Customs Street a number of additional businesses (not currently affected by the cut and cover works phase) may be disrupted by the PRR works. As these stakeholders were not specifically engaged with as part of the CRL C2 SIBD DWP, these parties have now been consulted in order to understand their business, specific access requirements and any other potential disruption issues they may have.

This process is detailed in the following sections.

3.3.1

Additional Affected Area For Construction Works

Table 3-1 identifies the buildings which are in direct proximity of the PRR works on Lower Albert Street. Consultation with the identified affected buildings on Lower Albert Street was not carried out

as part of the preparation of the CRL C2 SIBD DWP. As such consultation in relation to the PRR works on Lower Albert Street was required.

3.3.2

Community Liaison Group

The CLG consists of affected parties, interested parties and the wider community. Ongoing engagement with the CLG is required as part of planning for the PRR works and has been undertaken as part of the process of preparing the DWP addendums for the works. The CLG process requires that community members are given the opportunity to provide comment on any material change to a DWP. This opportunity is provided through the distribution of the document, and presentation of the content at a specified CLG meeting. Community members are provided with at least 10 working days to provide comment. Ongoing updates and information relating to the timing of the PRR works will also be provided via at least three-monthly CLG meetings that are scheduled throughout the duration of the Project.

Table 3-2 outlines the CLG meetings which have been held in relation to the PRR works and includes a summary of the key outcomes to the DWP documents which have resulted from this process.

The comments received from the CLG which are specific to this Addendum have been documented in Appendix A. It is noted that there were no comments received during the CLG consultation process which necessitated changes to this addendum.

3.3.3

Consultation with Additional Affected Parties

Consultation with those parties owning / occupying the additional affected buildings identified in Table 3-1 above was undertaken by Alan Howard-Smith (Connectus Stakeholder Communications Manager) and Matthew Kerr-Ridge (AECOM Senior Environmental Planner) in February 2018. The purpose of the consultation was to understand their business, including to identify the type and scale of disruption, specific access and servicing requirements, and client and visitor behaviour and requirements.

In order to ensure consistency across the consultation, a series of questions were asked:

How many businesses and guests need daily access to your building entrances?

Who might regularly need building access afterhours – e.g. security firms and cleaners?

Are you planning a major fit out or alterations to your buildings between late 2018 and end2019?

Are there any other matters that we need to have regard to in terms of your business’ operation?

These questions were posed in order to initiate meaningful conversation around specific issues that may be generated through the Project. As well as informing the SIBD DWP Addendum, these conversations provide a calibration with the Social Impact Assessment (SIA) that supported the original CRL Notice of Requirement, ensuring the potential social impacts identified back in 2013 when the SIA was prepared remains valid and relevant in the Project’s current social environment.

Consultation was not limited to the above questions, but encompassed a range of access and other specific issues to the affected parties spoken with. The key issues raised by the affected parties in response to the questions are detailed in Table 3-3. This Table and responses will be updated as consultation continues.

4 IMPLEMENTATION PLAN Social Impact and Business Disruption effects will be mitigated through the suite of Delivery Work Plans and Management Plans required under the CRL designation and resource consent conditions.

These Plans have been updated, where necessary, to account for the PRR works. Section 5 of the CRL C2 SIBD DWP outlines the general mitigation measures that will be implemented for the duration of the Project. Specific mitigation of affected parties’ concerns are outlined in Table 3-2 above, while mitigation measures specific to the wider Albert Street construction area for the PRR works are outlined in the following sub-sections.

4.1

NOISE AND VIBRATION

Construction noise and vibration is managed, monitored and mitigated through the CRL C2 Construction Noise and Vibration Delivery Work Plan (CNV DWP) (CRL-PAT-ENV-CON-PLN000903). In addition a Site Specific Construction Noise and Vibration Management Plan (SSCNVMP) (CRL-PAT-RME-AT-RPT-033020) has been prepared for the PRR works phase.

AIR QUALITY

With the exception of cutting of pavers and curb stones, the CRL C2 Air Quality Delivery Work Plan (AQ DWP) (CRL-PAT-ENV-CON-PLN-000899) provides sufficient construction management protocols to manage the PRR. The AQ DWP Addendum (CRL-PAT-RME-AT-RPT-033017) provides the appropriate management protocol for the cutting of pavers and curb stones which are the only ‘new’ activities proposed as part of the PRR works phase. In summary the key mitigation measures which respond to the PRR works are detailed in Table 4-2.

TRANSPORT, ACCESS AND PARKING DISRUPTION

The CRL C2 Transport Access and Parking Delivery Works Plan (TAP DWP) (CRL-EWG-RME-ATRPT-005655) provides the general transport management protocol which is applicable to manage the PRR work. Specific details relating to the PRR works on Albert Street (between Wyndham Street and Customs Street) and Lower Albert Street (between Customs Street and Quay Street) are provided in the TAP DWP Albert Street Addendum (CRL-PAT-RME-AT-RPT-033015) and TAP DWP Lower Albert Street Addendum (CRL-PAT-RME-AT-RPT-033019), respectively. The key mitigation measures which respond to the PRR works are detailed in Table 4-3.

Foot access to all properties will be maintained at all times as per the CRL C2 SIBD DWP and designation conditions 27.1 (h). All traffic access to properties and businesses on the western side of Lower Albert Street is provided by the service lane between the Precincts Property New Zealand (+5 others business on the road level) and M Social Hotel.

The phasing configuration for the Lower Albert Street PRR works has been developed in collaboration with the developers of the Commercial Bay development. A key consideration has been the provision of access to future retailers along the eastern (Commercial Bay) street front of Lower Albert Street as these retail spaces are completed. Service vehicle access for future retailers shall be provided via the basement accessed from Lower Albert Street. The construction phasing has been developed to provide vehicle access to the basement area as the retail space becomes ready for occupation. Pedestrian access shall also be maintained to these retail spaces as they become operational.

Crossings at the signalised intersection of Quay Street / Lower Albert Street and Lower Albert Street / Customs Street will be maintained and operated as in accordance with the existing condition described in section 3.0.

Fixed signage with agreed messaging of the change in traffic layout will be placed on the approach of the Customs Street. Indicative key temporary works signs and messaging is noted in the summary diagram presented in Appendix C of the CRL C2 SIBD DWP; and will be confirmed in conjunction with the Auckland Transport Corridor Access Request team during submission of the Traffic Management Plan. Signs will be installed as described in the CRL C2 TAP DWP .

Way finding signage and pamphlet will be distributed on the network to remind passengers the temporary changes during this construction period.

DISRUPTION TO BUSINESS VISIBILITY

It is a recognised potential impact that customers who cannot clearly negotiate their way to or see a business, assume that it is closed or seek a more readily accessible alternative, even if that alternative is further away. Therefore, where the visibility of or access to adjacent businesses is impacted by the Project works, signage advertising the location and ongoing operation of these businesses will be provided. The signage will be erected in conjunction with the Project site set up and be maintained for the duration of the works. Feedback will continue to be sought from affected businesses with regard to the particular visibility and access requirements of the business over the course of the Project.

The Project Stakeholder Manager will liaise with the CRL Street Response Manager regarding the following CRL business support and business promotion initiatives to assist information provision between the CRL Street Response Manager and affected businesses as well as facilitate/participate in event planning and delivery: o Business Support Programme (Business Pac).

A business support package is being offered to businesses in the PRR works area. The package consists of a range of free services (e.g. business mentor, advice hot line) available over the course of the CRL construction. This initiative is supported by Heart of the City, the Auckland Chamber of Commerce and Business Mentors New Zealand. o Albert Street Businesses Promotion (e.g. Cheap Eats / Restaurant Month).

Both the Project Stakeholder Manager and the CRLL Street Response Manager will be liaising directly with businesses throughout PRR works to ensure any new ideas for developing business mitigation options are considered. CRLL is always looking for new and helpful ways to support businesses.

Wayfinding will be used to direct pedestrian traffic along both Albert Street and Lower Albert Street.

4.5

AMENITY IMPACT

Amenity in relation to visual impacts for the Project pertains to the views of the construction from the surrounding properties and the local streets. The building typology of multi-storey units which directly adjoin Lower Albert Street, means that the construction site will be overlooked by activities located on the higher levels of these adjoining properties.

The extent and appreciation of the visual effect of the construction area will vary between people.

Some will find the view interesting while others will see it as visually unpleasing.

An unsightly works site will impact on the amenity of the surrounding area and has the potential to impact on its vibrancy and the patronage of adjoining businesses.

To manage any actual or potential visual amenity impact from the works, site cleanliness and upkeep needs to be managed and maintained, and interesting visual screening which promotes a consistent look and feel reinforcing a sense of place needs to be provided.

To manage social impact and business disruption effects, with respect to amenity and sense of place in the Lower Albert Street area, the following mitigation will be implemented: a. Daily work site maintenance implemented, consisting of: I.

Rubbish cleared from works area.

II.

Construction materials appropriately stored / stockpiled.

Screening of works area with construction hoardings or scrim panels to fencing injecting colour, creating vibrancy and a sense of place. This will be in place from site mobilisation/set up and maintained for the duration of the works.

5 ONGOING IMPLEMENTATION There is no change to the method for ongoing implementation outlined in Section 6 of the CRL C2 SIBD DWP.

For brevity’s sake, for the reasons I have stated in this peer review, I don’t agree that the decision not to consult with affected parties south of Customs Street West to Wyndham Street reflects good SIA practice.

There is no available evidence to suggest whether information specifically about the PRR stage was explicitly part of any earlier consultation activity that has informed the CRL C2 SIBD DWP.

The reinstatement works were part of the scope of works consulted on during the preparation of the CRL C2 SIBD DWP. The effect generated from the PRR works south of Albert Street are generally consistent with the effects generated from the cut and cover tunnel works, as well as the effect previously anticipated for the reinstatement works.

To remedy this lack of clarity and to ensure all affected parties (businesses, residents, property owners and other relevant stakeholders) receive the same information about the PRR works on which to identify and assess potential SIBD effects upon them, I

Whilst I agree with the comments made by James Baine’s regarding CRLL’s responsibility to assist affected businesses seek compensation for a loss of revenue, I will not repeat these sentiments here. I do, however, note that the establishment of a Street Response Manager for the CRL development and a series of business support initiatives (Business Pac/Cheap Eats/ Restaurant Month) are welcome, additional and supportive measures.

I recommend that these initiatives should be referenced in the SIBD and CCP Addendums as an update of both the CRL C2 SIBD DWP and CRL C2 CCP. This should include details regarding the roles and responsibilities, and the relationship with CRLL, Connectus, and CLG, as well as contact details of the Street Response Manager. This should also include an interrelated process of updating and reviewing the pedestrian counts so that actual changes in pedestrian behaviour are revealed. These data will be important and relevant indicators of the significance of actual effects and the measures to address them.

13) Section 4.4 ‘Disruption to Business Visibility’, should be reworded to explain that these additional control and mitigation measures apply to all affected businesses along Albert Street within the PRR plan.

I question whether all affected businesses, residents and property owners have been provided with the same levels of information, and whether the intent, role and functions of the CLG (as set out in Condition 7) are being played effectively by the CLG. I suggest that a review of the role and functions of the CLG should be undertaken by the Requiring Authority that meaningfully engages its actual and potential members in an evaluation conducted by an independent specialist to ensure it is meeting its obligations under the designation conditions, and how it might improve on this purpose and function.

It is recommended that the wording on p.19 of the SIBD Addendum, (“specific mitigation of affected parties’ concerns are outlined in Table 3-2 above, while mitigation measures specific to the wider Lower Albert Street construction area for the PRR works are outlined in the following sub-sections”) needs to be reworded to reflect that these implementation measures apply to the entire Albert Street PRR construction areas, and where they do not this should be noted.

It is recommended that the SIBD Addendum reflects and appropriately crossreferences to other DWP and associated plans where social and business disruption-related effects are being managed by other DWP teams. In particular, and as far as I am aware from the available documentation, the issues relating to urban design, pedestrian access, traffic, and noise and vibration. Again, having a central control document that collates all environmental effects issues would be a useful addition.

There is a need to clarify what is meant by ‘communication’ and ‘consultation’, particularly in the CRL C2 CCP, and in relation to defining the important difference between general public liaison/communication activities and specific SIA consultation with regard to engaging stakeholders and affected parties on the identification and management of potential social and business disruption impacts.

I recommend the opportunity for the CRL C2 CCP to adopt and implement international standards such as the IAP2’s Public Participation Framework to guide and define its consultation and communication activities for the CRL Project.

It is recommended that the results of the annual evaluation of the communications and consultation performance and the changes they effect to the CCP are made public, potentially on the CRL project website for purposes of openness and transparency on decisions relating to communications and consultation.

It is recommended that the CCP (Revision 3 and the Addendum for the PRR works) should also be amended to include the five new, additional property/ business owners on Lower Albert Street that have been consulted in preparation of the SIBD DWP Addendum.

To comply with Designation Condition 15.6, the CCP should also be amended to include a summary of the communication and consultation undertaken between the requiring Authority and parties, including any outstanding issues or disputes raised by parties. Again, I suggest this could be remedied by a central point of public reference that documents all consultation, feedback and mitigation measures and responsibilities for managing them.

At the very least evidence should be provided explaining how all affected parties have been directly or indirectly notified/consulted/ informed specifically of the PRR works and the comments and inputs that have been received from affected parties about the PRR works. This information should be provided in the Addendum to satisfactorily meet the conditions set out in 61 of the CRL Designation Conditions.

Table 2 of the CCP Addendum needs to be completed and/or updated to reflect CLG and Mana Whenua engagement regarding the PRR works and process, and further detail regarding what is meant by ‘more regular’ and ‘specific communication with businesses’ during this construction phase. I recommend that this engagement is specifically part of recommendations 3 and 10 above. The wording should be amended to reflect the need to engage with residents and property owners, not just businesses.

Appendices C and D of the CRL C2 CCP appear to be incomplete and provide no useful function in this state. These appendices need to be updated and used as decision making tools. I would suggest they might be better placed in the SIBD DWP, particularly Appendix D on risk mitigation. I suggest that such a tool is reinstated and properly used for the entirety of the Project in relation to, but not limited to SIBD impacts.

The CRL project website requires updating to a) include all CLG minutes since 2015/16; b) to comply with Designation 12, to include the updated 2017 versions of the CEMP, DWPs (including SSCNVMPs, SSCNMPs and SSCVMPs) and CCP.

The July 2017 revision of the CRL C2 CCP should, in my mind, be updated to reflect the roles and responsibilities of CRLL, rather than AT CRL as it is now legally responsible for the CRL Project. Any changes in contacts, roles or responsibilities of relevant staff should also be updated to reflect their association with CRLL, AT, Connectus and other contractors.
