BACKGROUND PROJECT DESCRIPTION: Eric Carter requests approval of a home business permit to operate a Short-Term Rental at 2818 S. RD Mize Road.

PROPERTY HISTORY: The single-family residence, located at 2818 S. RD Mize Road, was built in the 1980’s. It was built as a single-family residence.

PHYSICAL CHARACTERISTICS OF PROPERTY AND PROPOSAL: The 2,192-square foot, beige, two-story, single-family residence lies on a 1.34-acre lot. The house has a living room, kitchen, breakfast and dining room, laundry room with a ½ bathroom and two-car garage on the main floor. On the top floor, the residence has three bedrooms (one with its own bathroom), an office, bathroom and a mechanical room. The basement has a family room, a fourth bedroom with exterior entry and a furnace room. There is a wide driveway accessing the two-car garage.

The applicant would like to use this property as a Short-Term Rental to be listed on AirBNB, Vrbo and Booking.com.

CHARACTERISTICS OF THE AREA: The surrounding single-family neighborhood features houses constructed mostly prior to the applicant’s property. The property does not have frontage on S. RD Mize Road; but access to a shared gravel driveway located in an unimproved right-of-way across a narrow strip of property. The applicant will need to pave the existing driveway on site; however, the applicant does not need to make improvements to the driveway in the right-off-way or the adjacent narrow strip of land.

PARKING: In addition to the two-car garage, the house has a wide driveway fanning out from a shared gravel driveway in the city right-of-way. There is room to park more than four cars.

UNRULY GUESTS/SECURITY: First, no tolerance notifications will be sent out before booking. Second, no under “4-star review” guests will be accepted. Third, stays will be a minimum of three nights to avoid potential parties. The owner lives in the area and will be available to address any issues.

Noise monitoring – The applicant will be using a noise monitoring system called Minut.

Trash Removal - Trash pick-up will likely be scheduled with Ted’s for a weekly pickup.

Property listing - The property will only be listed on AirBNB, Vrbo and Booking.com.

Business operations/security – The Property will be operated as a short-term rental in a manner similar to our other properties (Prairie Village, Westwood and two in Manhattan), each of which has a “5-Star” rating on Airbnb. Consistent with our operating model, these properties are all family-friendly, dog-friendly, non-smoking homes and each specifically prohibits parties.

City’s Short-Term Rental checklist – The form was completed by the applicant covering licensing, future inspections, insurance, onsite information posting, and so forth.

Fire safety – A fire evacuation plan had been submitted along with floor plans of the house. The fire escape plan must also be posted per Code requirement.

City inspection - The property shall pass the Initial Short – Term Rental Fire and Life Safety Inspection.

There are no other Short-Term rentals within 500 feet, therefore this application follows the density limitations of the City Code.

The building code requires egress to the exterior to be a maximum of 42 inches from the floor and the opening must provide 5.7 square feet of open area, which must be a minimum of 20 inches wide and 24 inches high. As such, the bedroom in the basement cannot be utilized.

Recommendation Staff recommends approval of this Short-Term Rental with the following Conditions: 1. The Short-Term Rental shall obtain a business license in accordance with the City Code and comply with Article 3, Chapter 5 of the City Code. The occupation license number shall be listed on all advertisements and online platforms.

2. The business must comply with all safety and other standards established by Section 14-424 of the Unified Development Ordinance.

3. The maximum occupancy of the premises shall be limited to six (8) adults and ten (10) persons. Only four (4) of the bedrooms may be used.

4. The noise monitoring system shall be installed and activated in a central location in the house, the Good Neighbor Guidelines, evacuation plan and other notices must be properly posted, prior to approval of the business license.

5. Pave the driveway onsite and any expanded driveway or parking areas.
