In a Kia commercial that began airing last fall, a man tries on a size 19 shoe.

When the saleswoman asks whether he’s not actually a size 9, he dismisses the question. The clearly oversized sneakers are a perfect fit, he insists, and he wears them out of the store.

“Just because you drive the official vehicle of the NBA,” the narrator intones as the man speeds away in a Kia Optima, “doesn’t make you an official NBA player.”

Last week, Gov. Andrew Cuomo tried out a classic Packard Phaeton used

by Franklin Delano Roosevelt. The car, which was housed at the New York State Museum, was about to be shipped to an expert so it could be put in good working order. Once it’s back, it’ll be used for ceremonial purposes, such as the opening of the new Tappan Zee Bridge next year.

But why stop there? Why not an inaugural parade along Pennsylvania Avenue to the White House in 2021? Then again, just because Cuomo drives the car of a president – doesn’t make him a president.

C&S: Why has the mayor become so adversarial with the press?

PW: I think there are certain flashpoints that erupt over a certain story or a certain mark of coverage that, of course, is frustrating. And I can relate – for example there’s a storyline that’s out there in some of the press reports and some of the chattering class that he’s lazy or he’s not a very good manager.

And these are tags that drive me, personally, crazy. And so there are moments when you want to stand up and say, “This is not right.”

C&S: In the absence of a formidable Democratic challenger, is there a risk of paying more attention to the Republican field?

PW: I think we’re able to do multiple things at once. We’re obviously going to be watching the Democratic field very closely. There are a couple folks who are actually in the field, so we’re obviously going to pay attention to those folks and run a campaign with those folks in mind and if other folks get in, then great! We’ll have that debate.

But I think that you can do dual tracks.

You can certainly pay attention and make sure that you’re doing your work for the Democratic primary but also be developing, simultaneously, long-term plans for what a general election might look like. We’re going to do it all.

C&S: Will we see Dante de Blasio appear in the campaign again?

PW: (laughs) That I cannot say. Or I won’t say, right now.

THE WAITING GAME State budget week followed its usual choreography as Gov. Andrew Cuomo, Assembly Speaker Carl Heastie and state Senate Majority Leader John Flanagan spent many hours in closed-door meetings negotiating what would and wouldn’t make the final document, due before midnight April 1. While nothing is official until it’s signed, on Friday it looked like direct care providers would get a wage boost after an aggressive advocacy campaign. The Raise the Age campaign may get a win too, with New York expected to join 48 other states in treating 16- and 17-year-olds as juvenile offenders. Cuomo called for a “cautious” spending plan to respond to the large cuts expected from President Donald Trump’s first federal budget.

THE RESISTANCE CONTINUES Cuomo teamed up with California Gov. Jerry Brown on Tuesday, vowing to lead the fight against climate change on the state level despite Trump rolling back Obama-era federal climate policies. It was another step on the national stage that’ll only fuel presidential rumors for Cuomo. And in New York City, Comptroller Scott Stringer released a report on Trump’s tax plan, calling it “written by millionaires, for millionaires.”

A TALE OF TWO RULINGS It was a big win for New York City Mayor Bill de Blasio on Tuesday as a state Supreme Court judge OK’d the two consecutive rent freezes by the city Rent Guidelines Board – a huge relief for rent-stabilized tenants.

But a Wednesday loss followed as the city Conflicts of Interest Board decided most donations to de Blasio’s legal defense fund will be capped at just $50.

FINALISTS IN THE SEARCH FOR SUNY CHANCELLOR The search for Nancy Zimpher’s replacement as SUNY chancellor – she steps down on June 30 – is down to approximately four finalists.

Two bochincheros who spoke to B&B separately – one at the Somos conference in Albany – said that there is one woman and one Latino on the short list. Neither bochinchero gave a name, since, according to both, only a very small group of people know who the finalistas are.

The search committee for the largest university system in the U.S. is chaired by SUNY Board of Trustees Chairman H. Carl McCall and has 22 members. A search firm that cost more than $200,000 was hired for the task after Zimpher made her resignation public.

“When he had a chance to make history and select a Latino to be the first (district attorney) in New York he didn’t.” The bochinchero foamed at the mouth as he roared against Assemblyman Marcos Crespo, the chairman of the Bronx Democratic County Committee.

Crespo, speaking in his role as executive committee chairman of the Puerto Rican & Hispanic Task Force at a reception hosted by state Attorney General Eric Schneiderman on March 24 in Albany, said, “We have to stop all these firsts. … We have to elect Eric Gonzalez as Brooklyn DA.” Meanwhile, another bochinchero was upset that Crespo was meddling into another county’s election.

The larger point made by a few more bochincheros that spoke to B&B is that Crespo chose Darcel Clark who, as reported by NY1 anchor Errol Louis in October 2015, did not disclose her role in the case of Kalief Browder, the Bronx teen who committed suicide earlier that year after he had been held at Rikers Island for three years without trial. “Crespo talks a lot of shit. Back then, he made good on the deal of the previous county chair,” referencing Assembly Speaker Carl Heastie, who, as Bronx county chairman, reportedly agreed to give then-District Attorney Robert Johnson a judgeship. The deal – which was denied by all parties involved – was a widely reported bochinche. Johnson, 69, is currently a state Supreme Court judge in Bronx County.

There was buzz in Albany that the “City Council bug” has bitten Assemblyman Félix Ortiz. The Brooklyn político is waiting for the state budget to be adopted – he doesn’t want his colegas to think he doesn’t care about securing his goodies – to announce his run. Bochincheros in Ortiz’s 51st Assembly District tell B&B, “Félix wants the higher salary and to get his son to take over his gig in Albany.” Whatever the reason, it appears that New York City Councilman Carlos Menchaca is perceived as vulnerable, since former Assemblyman Javier Nieves (who Ortiz defeated in 1994 for his Assembly seat) has already declared he’s going to primary Menchaca for the 38th City Council District. With two known opponents in the race, Menchaca must be muy contento since the buzz is that Ortiz and Nieves would take votes away from each other, leaving the incumbent with a path to re-election.

While Bill Thompson said on last week’s NY1’s Wise Guys that “Joe Lhota is too smart to go to Washington as chief of staff to the president,” two bochincheros who know Lhota well made the argument that their former colega worked successfully with dictatorial executives like Andrew Cuomo, James Dolan and Rudy Giuliani. One of them argued: “Can you imagine any better preparation?” In other words, Lhota could handle control freak loco bosses.

Our Perspective Car Wash Workers Deserve Fair Wages

T

he boss claims that we make more tips than what we actually do. He has threatened to fire us if we don’t sign papers misstating what we earn. We need to stop all of the abuse and exploitation.”

Those words, from a car wash worker at Las Vegas car wash in Brooklyn, New York, before he and his co-workers joined the RWDSU and won a union contract, summarize the experiences of far too many employees of New York’s car washes.

Despite the progress hundreds of workers have made by winning a union contract, workers throughout the industry continue to be victims of wage theft. Numerous times over the past decade, industry leaders have paid hefty settlements to their workers in cases involving wage theft, even as recently as this year.

One of the contributing factors of this wage theft in New York is the so-called “tip

credit.” The tip credit is a part of New York State minimum wage law that allows industry operators to pay car wash workers a different, lower minimum wage. In theory, workers’ tips are supposed to make up the difference, and possibly more. And, if workers’ tips don’t raise the level of pay to at least the minimum wage, car wash employers are supposed to make up the difference in additional hourly wages.

But tip credit does not work in the car wash environment. It’s a vehicle for wage theft and contributes to systemic underpayment of car wash workers – exactly what the car wash unionizing campaign and car wash workers have been fighting against. Investigations have shown that employers don’t always make up the extra pay for workers when tips are short, and car wash workers don’t always receive the tips customers presume are going into their pockets. We shouldn’t be giving

unscrupulous employers additional incentives to underpay their workers, and that’s exactly what tip credit does in the car wash industry.

The solution: passage of legislation currently before the New York State Senate and Assembly that would require car wash workers be paid the full minimum wage. They could still receive tips, but they would also be guaranteed the state minimum wage. This would help prevent wage theft, and it would help car wash workers better predict their weekly pay.

In the current environment, immigrant workers are under increased stress. The last thing they need are the additional worries of having their wages stolen and being underpaid for their hard work. We are calling on the state legislature to protect them by doing away with the tip credit in the car wash industry, and sending a signal to car wash employees that their work is valuable, and to the industry that the state is serious about ending wage theft at the state’s car washes.

Nobody knows Manhattan better than its biggest advocate, Borough President Gale Brewer

S

HE’S HAD SOME 10,000 interns and raised 35 foster children, but now her main job is serving as advocate and cheerleader for the 1.64 million residents of New York County (and the countless others who work and visit) as Manhattan borough president. Brewer spoke with City & State’s Jeff Coltin about parades, property taxes and zippers.

The interview has been edited for length and clarity.

C&S: The “Fearless Girl” statute is here to stay! Do you buy into the criticism that it’s corporate or so-called “false feminism”?

GB: I think that she has great appeal. She is inspirational. I’ve been there quite a few times recently and I met the artist. It’s an example of art doing what reports and speeches and press conferences cannot. So I think she’s great. I love the bull too. It’s a really nice combination for our city and for young women.

You should know, of course, that I was the one who suggested to the mayor that the (U.S. women’s national soccer team), when they won the World Cup, march up (Broadway) for a ticker tape parade and I’ve never seen so many young women. Oh my goodness. So there’s something about this young girl that reminds me of the young women who were there that day. There’s a reason why it has clicked with so many people. So I hope she stays. She really is a lot of fun in a challenging world.

C&S: You’re not a fan of New York City Mayor Bill de Blasio’s plan to relocate garment district jobs to Brooklyn. Why is it bad for Manhattan?

GB: We’ve been supporting the two-hub strategy. We’re not upset with Brooklyn, but you’ve got to have a plan! What we understand is that money goes to those who want to move to Brooklyn. That’s not a plan for Manhattan. Transportation to Brooklyn is challenging. The women in the garment district are women in their 40s and

50s or older. It takes 10 years to be a master sewer. It’s a long hike from the subway to the Bush Terminal or wherever the end zone is for doing the manufacturing.

It’s a situation where maybe a few people like the strategy of just going to Brooklyn, but there are many local stakeholders who say moving won’t work for them, even if they’ve got the money. It’s this ecosystem!

You literally have to walk to get – not just a button down the street. You have to go from – OK, this manufacturer does a great job with this sample, but I really need to go to this other factory to get the sample improved. And then the theater district!

Don’t forget about them. They’re now weighing in, people who make the costumes. They have to go get a button, the zipper broke, they don’t like the dress, it has a rip in it – they’ve got to run over. It’s a fascinating ecosystem that cannot be destroyed.

C&S: There are a lot of plans out to improve the Port Authority Bus Terminal, with some even proposing moving most of it to New Jersey. What does Manhattan need out of the bus terminal?

GB: The bus terminal is needed in Manhattan. I think we’ve had good success with the Port Authority in the sense that, because of our intervention – the first description for a new bus terminal by the Port Authority, I swear they were going to tear down 100 or so buildings in Hell’s Kitchen. They were the oldest markets, the oldest buildings, landmarked church, etc.

That did not fly. Since then, we’ve had so many press conferences, meetings with the Port Authority, meetings with the people in New Jersey. I don’t know how much, if anything, should be in New Jersey, how much should be in Manhattan, but it has to be something that works for both. We understand that. We definitely need a new bus station. But my understanding is it’s actually cheaper to build the No. 7 subway under the river than to redo the bus station. I’m just saying. So all of this needs to be looked at.

C&S: We’ve been talking about the Midtown East rezoning for years and I know it’s been a slow process. Is that finally coming to fruition? Are there going to be new buildings going up around there soon?

GB: I think Midtown East is going in the right direction. The good news is a lot of stakeholders, post-Bloomberg, thanks to (City Councilman) Dan Garodnick and the City Planning Commission – obviously we had lot of meetings and people really weighed in. So I think there will be new buildings, but more importantly there will be new infrastructure. Subways, landmarks will get some funding out of this. And we hope for public realm, which really means public space, where you can have lunch and sit and relax and so on and so forth. All of that (funding style) is a really interesting new structure.

Also One Vanderbilt, which was not specifically part of this rezoning, but it was part of a ULURP (Uniform Land Use Review Procedure). The property taxes for the buildings before they were torn down were $8 million. And when One Vanderbilt is completed, it’ll be $50 million in property taxes. So you can see this area, because it doesn’t have a tax abatement, as does Hudson Yards, as does World Trade Center. So it’s an interesting need for good design (and) new buildings because of the property taxes.

C&S: You used to be a City Council member. Now there’s a new 21 in ’21 movement to get 21 female City Council members by 2021. Is that number realistic? Will you campaign for female City Council candidates even outside of Manhattan?

GB: I don’t campaign too much outside of Manhattan. I’m pretty much a Manhattan person. I think people outside of Manhattan should decide for themselves, but I’m definitely for more women in the City Council.

I’m always surprised at how few there are now. I think it’s 13? So yes, we need more women on the City Council. Absolutely.

ATASHA AMOTT, the owner of a cookware store in the Flatiron District called Whisk, denounced her $15,327 annual commercial rent tax bill as downright detrimental. The cost makes it difficult for Whisk to pay staff the wages – and raises – that reduce the rapid turnover often faced by small businesses, she said. And Whisk was socked with several years of commercial rent tax dues at once because the real estate firm Amott hired never informed her of Whisk’s obligation to pay the levy.

“Businesses consistently report this lack of awareness of the CRT. When the city finally brought it to my accountant’s attention, I had to pay the CRT for three years, and with interest,” Amott noted in testimony she submitted to the City Council for a hearing on commercial rent tax reforms

While testifying at the February City Council hearing, officials from Mayor Bill de Blasio’s administration commended Garodnick’s bill. But they said the measure must be taken up as part of larger budget discussions because it would drain the city of about $52 million in revenue.

That stance did not sit well with Jessica Walker, president and CEO of the Manhattan Chamber of Commerce, who is working with the Real Estate Board of New York, the Partnership for New York City and several local business improvement districts and chambers of commerce to implement Ga-

Many New York City Council members – 35 to be exact – have signed onto a bill introduced by City Councilman Daniel Garodnick that would shield more small businesses from the commercial rent tax, a regulatory oddity that is only applied in a portion of Manhattan. Garodnick’s measure would raise the annual rent threshold at which businesses are effectively taxed 3.9 percent of their annual lease payments by the city.

But despite widespread support from his

Walker said it was unfair for the administration to suggest that those who support the bill must come up with $52 million in savings. “This is not a huge sum of money in the context of the city budget,” Walker said of the mayor’s preliminary $84.7 billion budget proposal. “There are many other things that are in the budget that are very, very important, and they are not asked to come up with a plan for making it revenue neutral.”

Commercial rent tax relief is the Manhattan Chamber of Commerce’s top priority this year, Walker said. The commercial rent tax dates back to 1963, when the city was

approaching the state constitution’s limit on how much revenue it could extract from property taxes. As a remedy, it imposed a tax on rents, which are linked to the market value of commercial spaces. Commercial spaces in the outer boroughs and north of 96th Street in Manhattan were exempted from the tax in 1995. After the 9/11 terrorist attacks, the tax was waived for areas near the World Trade Center beginning in 2005.

Businesses complain of other regulatory peculiarities with the tax. New York City is the only large government known to charge a tax on rent outside of Florida, according to the Independent Budget Office. The tax essentially makes tenants pay twice: Most landlords pass on at least part of property tax increases to businesses through higher rents, and these tenants are then asked to pay a tax on those rents. As commercial rents have spiked in recent years, some point to the tax as contributing to supermarkets and independent shops getting priced out of lower Manhattan. Former Mayor Rudy Giuliani proposed eliminating the tax twice by phasing it out over multiple years, but was unsuccessful.

Years later, lawmakers are again pushing for reforms. One measure would exempt billboards advertising theatrical shows from the surcharge for 52 weeks; another would waive the levy for affordable supermarkets; and a third would require more reporting on revenues collected under the tax.

Under Garodnick’s bill, an exemption currently offered to businesses paying less than $250,000 in annual rent would be expanded to include companies paying up to $500,000 each year. The tax would then be assessed on a sliding scale for firms paying between $500,000 and $550,000 in annual rent.

Garodnick described the measure as a way to chip away at an unfair tax, which if fully repealed, would force the city to absorb $780 million in lost revenue. He said he would discuss the bill with other members of the City Council’s budget negotiating team and suggest ways to make up the $52 million. But Garodnick declined to share specific savings strategies with City & State.

Julissa Ferreras-Copeland, the chairwoman of the City Council Finance Committee, is a co-sponsor of the bill, but City Council Speaker Melissa Mark-Viverito has not yet taken a position on the measure, according to her spokeswoman.

“Ultimately this will be a question of budgetary priority,” Garodnick said. “I also have asked the mayor to identify savings in the city budget, which if done seriously, would more than compensate for the loss of $52 million.”

N A WEDNESDAY afternoon in February, a young Latina walked into Rep. Adriano Espaillat’s newly opened Harlem office looking for help. Greeted by two staffers, she explained in halting English that she wanted to know how her grandmother could apply for American citizenship. One of the staffers responded in Spanish, bringing her further into the office and translating for her as another staffer walked her through the immigration forms on the U.S. Citizenship and Immigration Services website. It was constituent services at its finest. And if any office is equipped to help with immigration issues, it’s Espaillat’s – he’s one of the few members of Congress to have gone through the process himself.

Helping others navigate the difficulties of U.S. immigration has been part of Espaillat’s life since he was a Dominican-American kid growing up in Upper Manhattan in the 1960s. His first job was helping out his grandmother’s brother with the three “golpes.”

“We Dominicans have the three golpes for breakfast, which is the mangú, queso frito and the huevo revuelto,” Espaillat said, de-

scribing the classic dish, strictly translated as the “three hits,” of mashed plantains, fried cheese and eggs. “The three golpes for him was the green card, a room as a boarder and a job,” Espaillat continued, laughing. “He would get that for you. He would prepare the paperwork. And he worked with this lawyer, who was the lawyer who got us our green card.”

Espaillat’s great-uncle would send him down to the lower Manhattan immigration office on Church Street to pick up the right forms to bring back to Washington Heights.

“He must have got the green card for a couple thousand people,” Espaillat said. “He worked from his apartment. He had an office in his apartment and somehow he had a public phone there!”

In a sit-down interview in his Harlem office, I told Espaillat that I had witnessed a constituent in his office earlier looking for a new “golpe” – help applying for citizenship.

His face lit up. “Oh that’s great! I feel right at home.”

Espaillat has been serving Upper Manhattan for decades, so it makes sense why it would feel like home. But upon taking office in the U.S. House of Representatives on Jan. 3, 2017, Espaillat entered a new, strange territory. He is the country’s first Domin-

ican-American member of Congress, but many in his district felt that his victory came at the expense of black political power. He is a progressive Democrat entering Washington, D.C., with Republicans controlling the House, Senate and the White House. He’s one of the first members of Congress who immigrated to the U.S. illegally, and he was elected at the same time as a president who has threatened to deport millions of immigrants who entered the country illegally.

ESPAILLAT AND HIS PARENTS first moved to New York City from the Dominican Republic in 1964, when he was nine or 10 years old (he himself is unclear on the exact date). They came for better jobs and to reunite the family – Espaillat’s maternal grandparents already lived in Washington Heights. His grandmother was a member of the International Ladies’ Garment Workers’ Union in her job at Bobbie Brooks in the garment district. His grandfather made less and traveled farther, to a job at the Ray-Ban factory in Flushing. But that job had other benefits. Adriano was the only kid on the block to have the flip-up sunglasses like the baseball players wore.

Espaillat and his parents came to the country on a tourist visa, then overstayed it.

They lived illegally in the country for a little less than a year before he and his parents acquired green cards. His parents got an affidavit from an employer, medical tests, a police background check and proof of savings in their bank account. Then came the hard part: entering a war zone.

The Espaillats had to return to their country of origin to pick up the green card that would give them permanent residency in the U.S. But in the summer of 1965, the Dominican Republic was in the midst of a monthslong civil war. The Espaillats went to Santo Domingo, the capital, and found a city divided. Espaillat remembers hearing gunshots as combatants fought over areas of the city. When they got into the consulate general’s office and received their green cards, the building was packed with people trying to leave the country, “like the fall of Saigon.”

Safely back in Washington Heights, Espaillat fell into jobs serving the community, helping his uncle with the “golpes” and being an Spanish-English interpreter for his grandmother’s friends at government offices.

“She would force me to cut into my baseball time sometimes on Saturdays, make me go to the hospital with somebody,” said Espaillat, laughing at the memory. “Helping people. After a while I kind of liked it.”

In his late 20s, Espaillat felt “a rush in my body” when he became a U.S. citizen. He stayed in Washington Heights, serving at one point as a coordinator for the New York City Criminal Justice Agency, and also as a community organizer. As spokesman for the Coalition for Community Concerns in the early 1990s, he complained about federal immigration raids in Washington Heights bodegas, according to a piece in The New York Times. By 1992, the Times was describing him as a longtime community advocate.

Espaillat ran for City Council in 1989 and 1991, losing both times. In 1996 he won a seat in the state Assembly, becoming the first Dominican-American in the state Legislature. Now in his 20th year as an elected official, Espaillat’s roots in the community are a fundamental element of his appeal as a public servant today – and of his own identity.

I asked Espaillat how he would fight back against President Donald Trump’s administration. He responded with a question of his own: “As Democrats and progressives, how do we turn the protests and the massive show of support for our points of view into actual victories? Tangible victories that could be touched by the average American?”

“That’s not an esoteric experience,” he answered. “But it’s real, it’s on the ground, it’s sweaty. That requires organizing skills.

And I think deep inside of me, besides being a congressional member, I’m really an organizer.”

IT’S A FRIDAY NIGHT in Harlem and Espaillat is talking to a crowd in a large conference room a floor below his office in the Adam Clayton Powell Jr. State Office Building about what they can do if they are

stopped by immigration officials. Democratic Congress members and elected officials all around the country have held similar events in the weeks since Trump took office promising a new era of strict enforcement of immigration laws. Espaillat kicked off the Feb. 10 event with a call for applause, saying it’s a big day because the 9th U.S. Circuit Court of Appeals blocked Trump’s “travel ban” executive order on immigrants and refugees.

“It shows if we mobilize, we win,” Espaillat says into the mic, repeating every line in Spanish. “Let’s continue this effort to make sure we resist all of Trump’s negative, draconian initiatives, especially his executive orders, that stand in opposition to who we are as Americans.”

Even though events like this have been held around the country, this one feels like it holds extra weight: Espaillat is speaking from experience. He was once one of them, worried that he and his family would get deported. Every member of Congress uses the collective “we” when addressing supporters, but Espaillat has a stronger claim on the rhetorical device, given his shared history with other immigrants.

Espaillat’s impact as a relatively powerless first-term congressman in the minority may depend on leveraging his status as “the first.” He is the first congressman of Dominican descent – a fast-growing demographic that’s gained political power in New York City over the past two decades. He is also one of the first members of Congress who immigrated to the country illegally. (He shares that honor with fellow first-term Rep. Ruben Kihuen, a Mexican-American Democrat from Nevada who overstayed a tourist visa. “It’s OK,” says Espaillat. “It’s not a race to be first. He and I are in the same place.

That’s good.”)

While Espaillat did not share his immigration story with the crowd that night, it wasn’t far from other people’s minds. The night’s co-host, state Attorney General Eric Schneiderman, said voters “have sent an important message. Not just by sending the first Dominican to Congress, but by sending the first person who came to this country undocumented.”

But Espaillat wants to do more than send an “important message.” In his first few months in Congress, he landed a position on the House Foreign Affairs Committee, which the committee’s ranking Democrat, Rep. Eliot Engel, had to lobby hard for, since their districts border each other.

Espaillat’s office has been putting out press releases at a furious pace, opposing almost everything the Trump administration does.

Speaking from the House floor, he claimed that “the economic ramifications” from Trump’s wall on the Mexican border “will be devastating to the entire country.” The first bill the new congressman introduced would ban the building of walls or fences on federal land near the border. It has no chance of passing.

And therein lies the problem for a freshman Democrat in a Republican government.

With little power available on the national stage, perhaps the best way to prove to your constituents that you’re an effective representative is to focus on the people back in the district – but some people in his district may be hard to win over.

ADRIANO ESPAILLAT REPRESENTS New York’s 13th District, the most densely packed congressional district in the entire country. It covers a pocket of the West Bronx and all of Upper Manhattan, from Espaillat’s home in Inwood at the island’s northern tip down through his heavily Dominican-American power base of Washington Heights and over to Harlem, the spiritual capital of black America.

Though Espaillat is widely respected in this heavily Democratic district, he’s far from universally loved. A big part of that has to do with how he challenged the powerful and well-liked incumbent Rep. Charles Rangel in 2012 and 2014 – “arguably the most popular congressman in the history of New York state,” a former Espaillat staffer admits. Espaillat, then a state senator, narrowly lost both times. In the racially charged primary contests, Rangel attacked Espaillat for relying on his ethnicity to earn votes and for being an ineffective legislator.

When Rangel retired in 2016, Espaillat’s main rival in the Democratic primary was Keith Wright, another established elected official representing black Harlem. Espaillat’s win in that race was a victory for Dominicans, but it felt like a symbolic loss for blacks in the district too.

“The real thing that was so upsetting was, for some people, was to see the decline of black political power in Harlem,” explained Cheryl Pahaham, a black resident of Inwood who ran for City Council in 2013 and is active in local Democratic politics. “And happening in this whole context where the real estate market is exploding, Central Harlem is becoming whiter and whiter. That’s very threatening for minority communities who lived there through the bad times and now are kind of being displaced.”

Pahaham praised Espaillat’s progressive policy positions. The racial tension, she explained, was about more than Espaillat being Latino. “Adriano, he can campaign or do politics in a way that will make people feel slighted, just because they are not Dominican, even though they support him,” she said. “So he sort of has that reputation.”

That reputation for racial politics was bolstered by his robust support for fellow Dominican-American Marisol Alcantara in a bitterly contested fall 2016 primary for Espaillat’s former state Senate seat. Alcantara beat out black former City Councilman Robert Jackson and the white Jewish political consultant Micah Lasher after some pointed comments from Alcantara about who could and couldn’t speak Spanish in the heavily Latino district. Alcantara’s win was seen as indication of Espaillat’s growing political influence in Upper Manhattan. But she has caused the new congressman headaches by joining the Independent Democratic Caucus, a breakaway faction that partners with Republicans to help create a majority in the state Senate. Alcantara’s move has drawn greater scrutiny thanks to Trump’s election, spurring protests in the district and fights on the state Senate floor.

Espaillat dismissed the attacks. “She’s the most progressive person in the Senate,” he told me, describing her as a “union organizer and a Bernie (Sanders) delegate.”

To fight the reputation, Espaillat has worked hard to court the majority black Central Harlem neighborhood he now represents. He issued a release slamming Airbnb’s “Harlem Experience” tours as a way the short-term lodging service profits from the historic and gentrifying neighborhood. He issued another recognizing the first black congressman in Harlem, Adam Clayton Powell Jr., and Powell’s successor, Rangel, as “African American political trailblazers.” More controversially, he tried to join the Congressional Black Caucus, which was co-founded by Rangel. The CBC deflected the issue in February, unsure of how to handle the Latino who had always identified as Dominican and was already a member of the Congressional Hispanic Caucus.

“Because I’m a Latino of African descent, I’m also a black man,” Espaillat told me. “What’s the difference if my ancestors cut sugar or they picked cotton?” As of late March, Espaillat had not been accepted as a member. Political observers speculated that even that CBC snub was political payback for challenging Rangel in 2012 and 2014.

That’s not to say the issue is entirely black and white – or black and brown. Espaillat has a longstanding rivalry with a fellow Do-

minican-American lawmaker from Washington Heights, Guillermo Linares, who beat Espaillat in a 1991 City Council race to become the first Dominican elected official in New York. The two have since run against each other multiple times. In 2012, Espaillat’s campaign mailed out a flyer accusing Linares of betraying Latinos for endorsing Rangel over Espaillat.

But lately, Espaillat hasn’t been lacking in public support. Following a tense couple of days in which Wright refused to concede the close race until all votes were counted in the June 2016 primary, he joined Rangel and Espaillat at a joint press conference outside of Sylvia’s Restaurant in Harlem to show a united front. And the speakers at his January inauguration event in New York City were a who’s who of powerful New Yorkers, with U.S. Sen. Charles Schumer, Mayor Bill de Blasio, state Comptroller Thomas DiNapoli, Assembly Speaker Carl Heastie and others making the trek to Yeshiva University in Washington Heights to toast Upper Manhattan’s most important elected official.

ONE MONTH LATER, Espaillat sits behind a huge desk in his office on the fourth floor of the Harlem federal office building.

The desk is Rangel’s, he explains. Espaillat and a staffer cleaned it up, adding a new coat of shellac. “Originally, we put too much of the stain on it.” It would turn the backside of all his papers brown. “Shows that I’m not an expert in it. But it looks better now! It was in bad shape,” he says. In this district, even the furniture is a reminder that political succession can get messy.

From the desk, Espaillat can look down 125th Street, Harlem’s Main Street, always full of people. These are his constituents, of course, but what about immigrants around the country? What about undocumented immigrants?

“Yes, of course that’s my constituency,” he says quietly, choosing his words carefully. “I’m an immigrant. Across the country.” He continued, speaking louder, more comfortably. “When I speak about immigration, I just don’t speak about it from a local perspective … particularly now, when Trump has selected this issue as one of the prominent issues that will be spearheading his administration. So yes, I will be outspoken and critical.”

It’s a natural evolution for the congressman whose first job was helping fellow immigrants get green cards and establish legal residency. Espaillat says that he is leaving it up to the Democratic leadership to craft a strategic response. “But I’m a soldier. I’m on the ground.”

As the president and CEO of the Federal Reserve Bank of New York, William Dudley leads one of the country’s 12 regional Fed banks. And since New York is the center of the financial sector, Dudley is one of the Fed’s most influential policymakers. The Goldman Sachs alum took the post in 2009, replacing predecessor Timothy Geithner after a critical behind-the-scenes role propping up the economy in the wake of the financial crisis.

The economy has stabilized and gradually improved since then, prompting Dudley and his colleagues to begin raising interest rates. President Donald Trump has made a point of criticizing the Fed, which could lead to a showdown with Dudley – although he’s expected to retire in January 2019.

One of Manhattan’s most powerful sectors is finance. Just as savvy is the real estate industry. Jonathan Gray, the head of real estate at the Blackstone Group, straddles both worlds.

Gray, who joined Blackstone in 1992, has helped amass what the private equity firm describes as “the largest real estate platform in the world with $102 billion in investor capital.” The innovative investor is reportedly a potential successor to Blackstone CEO Stephen Schwarzman.

While his work is international in scope, he’s a key player locally and nationally. He joined New York City Mayor Bill de Blasio in 2015 to announce Blackstone’s acquisition of Stuyvesant Town-Peter Cooper Village. And he even caught the eye of President Donald Trump, who considered him as a potential Treasury secretary.

Orin Kramer’s hedge fund, Boston Provident, is not the largest or most well-known. Instead, it’s Kramer’s highpowered political ties that make him a key player to watch on Wall Street.

Kramer, who as a young man worked in former President Jimmy Carter’s administration, has stayed involved in government, serving on various state and federal commissions over the years. A generous donor, he also supported the presidential campaigns of Barack Obama and Hillary Clinton. In New York City, he was a key backer of Bill de Blasio during the 2013 campaign, helping introduce him to others in the business community and landing on his transition committee. With de Blasio up for re-election this fall, Kramer could be called on to help the mayor once again.

He’s also cultivated strong ties with Gov. Andrew Cuomo, bringing on former top administration aides Steven Cohen and Josh Vlasto while landing one of his own executives, Barry Schwartz, on the CUNY board of trustees.

Plenty of advisers have the ear of New York City Mayor Bill de Blasio. One of them who largely stays behind the scenes is Henry Berger, the mayor’s special counsel. The veteran election lawyer helped keep de Blasio on the ballot in his bid for New York City public advocate, paving the way for a come-from-behind victory. When de Blasio was elected mayor four years later, Berger was brought on as a special assistant corporation counsel and adviser.

Despite his low profile, he is a trusted aide. According to one report, Maya Wiley left her position as counsel to the mayor in part because de Blasio relied more frequently on Berger and the city’s corporation counsel.

And in a re-election year for the mayor, the election lawyer could be called on once again.

Capalino+Company once again landed atop the list of New York City’s lobbyists in 2016, and while CEO James Capalino deserves much of the credit, he’s always credited his team. One of those experienced team members who’s on the rise within the firm is George Fontas, who was promoted to executive vice president in 2015.

In a field largely dominated by men, election lawyer Sarah Steiner is a notable exception. The Manhattan-based attorney, who runs her own one-woman operation, has earned a reputation as an independent-minded advocate for reform. She has accused the New York City Board of Elections of making politically motivated decisions, put a spotlight on voters turned away from the ballot box and criticized New York City Mayor Bill de Blasio’s fundraising scheme to pay his legal bills.

Before she began practicing election law over two decades ago, she served as an assistant district attorney in Queens. Until recently, she chaired the New York City Bar Association’s Election Law Committee and she helps run the organization’s program on how to get on the ballot.

Some New York politicians make a name for themselves in Albany. Others build a record in New York City. Mark Weprin has made it in both places.

He then was elected to the New York City Council, where he served until 2015. At that point, he returned to Albany as deputy secretary for legislative affairs to Gov. Andrew Cuomo.

In both his governmental and nonprofit roles, he is focused on using innovative investment strategies to spur the local economy and create higher-paying jobs. And his wealth of experience – in the public, private and nonprofit sectors – is a major asset for the Economic Development Corporation. In fact, Schlein helped create EDC through the merger of existing agencies while serving as a top aide in former Mayor David Dinkins’ administration.

The Human Services Council of New York allows nonprofits to speak with one voice in the corridors of power. Allison Sesso has led the organization in campaigns for increased funding, streamlining of procurement processing and increased wages for nonprofit employees fulfilling government contracts. When Federation Employment & Guidance Service, formerly New York City’s largest human services provider, collapsed in 2015, Sesso called for more support for human services agencies and released a report showing many were technically insolvent and even more were financially distressed with no cash reserves.

With funding for most agencies coming from government sources, Sesso and HSC may have plenty of painful federal cuts to help mitigate.

Sheena Wright heads the United Way of New York City, the local chapter of one of the most well-known nonprofits in the country. It provides community services to help lowincome New Yorkers and strengthens the capacity of local nonprofits.

Wright is the organization’s first female president and CEO in its more than 75-year history. Her organization partners with corporate entities, makes grants to community organizations and helps match volunteer board members with local nonprofits through BoardServeNYC. Their program initiatives such as EducateNYC and FeedNYC bring programming and partnerships to high-need neighborhoods to help build self sufficiency and improve elementary students’ literacy rates.

It’s not for lack of a track record, including acquisitions of the Sony Building, the iconic Chelsea Hotel and the Hotel Carter in Times Square. While he flies under the radar, he has a reputation for outflanking competitors and turning a profit on redeveloped properties.

Scott Rechler heads RXR Realty, a growing firm with a multibillion-dollar portfolio. But that’s just his day job. Apart from his real estate work, he’s been actively engaged in the public and nonprofits sectors.

His most notable side gig was as vice chairman of the Port Authority, in which he played a key role on the World Trade Center redevelopment. Rechler, a Gov. Google’s leadership is filled with household names: Larry Page, Sergey Brin, Eric Schmidt, Sundar Pichai.

The name William Floyd isn’t so well known, but he is in a pivotal post as head of external affairs for Google in New York, where the company has a growing presence.

In 2010, Google paid nearly $2 billion for the former Port Authority building in Chelsea, which it had already moved into in 2006. And while then-Mayor Michael Bloomberg was a major proponent of the tech sector, the friendliness has continued in the de Blasio administration.Floyd, a former staffer at Manatt, Verizon and in New York City government, was appointed by de Blasio to the board of the New York City Economic Development Corp.

Uber has earned a reputation for hiring experienced executives and officials who can drive its aggressive growth strategy. In New York, Josh Mohrer is leading Uber’s team – and getting results.

The ride-hailing company launched in New York City in 2011, and Mohrer joined the following year after several stints at various internet companies. Under his leadership, Uber went on to wage – and win – a public battle with New York City Mayor Bill de Blasio, who critics accused of siding with the traditional taxi industry.

After its successful campaign in the city, Mohrer and his team set their sights on expanding in the rest of the state, getting Gov. Andrew Cuomo to back their push for legislation to legalize operations in upstate cities.

One success story of New York City’s tech sector is WeWork, a startup that rents out shared office spaces – and bills them as gathering points where “community is our catalyst.” CEO Adam Neumann was one of three cofounders who launched the company in 2010.

It has generated plenty of interest from investors and now has dozens of locations, primarily in Manhattan.

Last month, the expanding operation signed a lease to move into a nearly 100,000-square-foot space on Hudson Street. It also has been expanding to major cities across the country and around the globe. While WeWork is Neumann’s most prominent venture, it’s not the first project for the former Israeli naval officer, who also cofounded the co-working space company Green Desk.

Many tech entrepreneurs fail to break through with even one successful endeavor. Jonah Peretti already has had two. A co-founder and CEO of BuzzFeed, the popular internet site he launched in 2006, Peretti also helped start The Huffington Post the year before.

BuzzFeed caught on quickly thanks to its viral videos, lists, quizzes and a deftness with social media. But the site has evolved in recent years, hiring new staff overseas and bringing on Politico and Daily News veteran Ben Smith to head an aggressive – and more serious – news reporting team. The growing company now has around 1,300 employees. And Peretti could be in line for a big payday, as BuzzFeed is reportedly preparing to go public next year.

NONPROFITS FIGHT TO ROLL BACK ETHICS LAW

A

LAWSUIT filed March 6 by the Nonprofit Coordinating Committee of New York and Lawyers Alliance for New York is the latest challenge to a state ethics proposal, signed into law by Gov. Andrew Cuomo in August, that requires some nonprofits who aid groups engaged in lobbying to disclose the identities of their donors.

Under Executive Law 172-e, when a 501(c)(3) makes a direct financial contribution or an in-kind donation, such as staff time or office space, that totals more than $2,500 to a 501(c)(4) engaged in significant lobbying efforts, the 501(c)(3) must then report the name of anyone who donated more than $2,500 to their organization to the Department of Law, which forwards the report to the Joint Commission on Public Ethics for publishing on its website.

501(c)(3)s are nonprofits that are granted tax exemptions for charitable purposes, are limited in the amount of political lobbying they can participate in and are forbidden from existing for the benefit of private interests. 501(c)(4) organizations may lobby as their primary activity without jeopardizing their tax-exempt status. Funds in their care are sometimes referred to as “dark money”

because 501(c)(4)s can receive unlimited contributions without making the source of these donations public.

Opponents say that while the new law is a well-intentioned effort to crack down on public corruption, its disclosure requirements are overly broad and could unintentionally create a chilling effect on donors to 501(c)(3)s who prefer to give anonymously while creating more burdensome reporting requirements for nonprofits.

The lawsuit by Lawyer’s Alliance and NPCC joined similar challenges filed last December by the American Civil Liberties Union and its New York chapter, and Citizens Union. Unlike those challenges – brought by 501(c)(4)s – this newest challenge is being brought by two 501(c)(3)s. All allege the law violates their First Amendment right to free expression.

Sharon Stapel, president and executive director of the Nonprofit Coordinating Committee of New York, said the litigants had little problem with mandating the disclosure of political speech for 501(c)(4)s – so long as it constitutes a “reasonable and legitimate interest” of the state – but it seems unjustifiable to tell nonpolitical nonprofits to disclose their donors when there’s such a tangential connection to political activity.

Later in the month, the court consolidated the most recent case with the prior joint ACLU and Citizens Union case; they’re all being heard by U.S. District Court Judge Richard M. Berman.

NPCC, a resource organization with nearly 1,500 members across the New York City area, and Lawyers Alliance hope the law is struck down; it has already changed nonprofits’ behavior. In one example cited in their joint legal filing, an unnamed community foundation that is a member of NPCC suspended its grants to a 501(c)(4) so as not to be required to disclose its donors.

In addition, Lawyers Alliance, which helps nonprofits with legal issues such as leases, incorporation documents, contracts and governance, has begun limiting themselves to providing 501(c)(4) clients under $2,500 worth of services, according to senior policy counsel Laura Abel. It would take just one qualifying interaction to require the Lawyers Alliance to reveal all of its largest donors.

“We’re not aware of any other law like this in the country,” she said.

And the changes were unexpected. The bills were introduced by state Senate Majority Leader John Flanagan and Assembly Speaker Carl Heastie on June 17, and vot-

ed on the very same day under a legislative loophole that can speed votes on measures that may otherwise require days of deliberation, Lawyers Alliance said.

“Nobody in the nonprofit sector knew this was coming,” Abel said.

The restrictions affect 501(c)(4)s that spend more than 3 percent of their expenditures and $15,000 a year on lobbying.

Progressive groups urged the state to crack down on the flood of unchecked money flowing into races on behalf of candidates, saying

that it allows wealthy or connected donors to unduly influence politicians and elections.

But people generally give to nonprofits for less suspicious reasons, advocates say. “(There) are as many different reasons that donors would want to be anonymous as there are anonymous donors,” Stapel said.

Reasons can include privacy, donors not wanting their network to know about their wealth and donors not wanting employers, friends or family members to know about their support for a particular cause.

“The bigger thread here is that we as a society ... have decided that when people donate their money to nonpolitical organizations, they have the right to do that in any way they’d like, whether they want a ticker tape parade or whether they want to remain anonymous,” Stapel said.

A spokeswoman for the state Attorney General’s office said it was reviewing the most recent filing, but couldn’t comment on any details surrounding the rule.

SHARING PRECIOUS SPACE IN NYC

THE NEW YORK FOUNDLING, a nonprofit serving the developmentally disabled, recently “adopted” fledgling nonprofit She’s the First through a partnership dubbed Adopt a Cause that hopes to match larger organizations with smaller ones that need affordable space in New York City’s costly real estate market.

She’s the First is a relatively young group with a $1.5 million budget and a handful of employees working to help young women in developing countries become the first in their families to attend college. It has operated in co-working spaces and even in coffee shops, but since January 2016 it has enjoyed the stability of occupying a sizable space on the 13th floor of The Foundling’s Chelsea offices.

Bethany Lampland, The Foundling’s chief operating officer, said the partner-

ship was seeking to create an ecosystem to connect nonprofits that have extra space with others who need it.

“This is not about She’s the First or The Foundling,” Lampland said. “We’re a great first test case of something that needs to be much bigger. Because not for profits are desperate for support in this area and they really can’t flourish without a home.”

The organizations launched a website and campaign, and opened it to other organizations. The aspirational Adopt a Cause network currently exists as a LinkedIn group with 27 members and a website with a case study and testimonials from the two nonprofits.

The partnership developed partly by chance. In 2013, The Foundling completed a renovation of its Chelsea headquarters, which it has occupied since the mid-1980s, according to The New York Times. The new open office plan left some desks vacant on its 13th floor. In 2015, Tammy Tibbetts, founder and CEO of She’s the First, and Lampland met at a Forbes women’s summit where they were connected by mutual colleagues.

The “bridge real estate” arrangement allows She’s the First to use the space as a free business incubator. As the group requires a bigger footprint and gains resources, She’s the First will look for its own space.

She’s the First had spent two years working in turnkey business rental spaces and in the offices of startups before collaborating with The Foundling. When it had to leave one space before the other was ready, its staff spent a month working in friends’ conference rooms or coffee shops, Tibbetts said.

“Panera never knew that they were, like, our temporary office, but those days especially make us all appreciate how nice it is to come into a very calm, stable office environment,” she said.

FUNDING FAIR FARES SHOULD BE A CITY RESPONSIBILITY

ON MARCH 19, the Metropolitan Transportation Authority increased fares on its monthly and weekly passes, with a monthly MetroCard now costing $121. While the transit system remains a bargain for most New Yorkers, regular fare hikes in recent years have increased the strain on low-income New Yorkers. The Fair Fares proposal to subsidize fares for lowwage workers is worth enacting, and the costs of providing this subsidy should be borne

by New York City.

The MTA’s recent fare hike is necessary to maintain an extensive public transit network that operates 24 hours a day, seven days a week. The scope of operation and frequency of service allow New Yorkers, commuters and visitors to get to work, visit friends and enjoy cultural and recreational activities – without the cost of car ownership or the frustration of sitting in rush hour traffic. And even with biennial fare hikes in recent years, the price of a MetroCard swipe has grown more slowly since 1996 than other New York essentials, like a pizza pie.

For most New Yorkers, the cost of a

monthly MetroCard is well below 15 percent of income, the threshold for affordable transit costs established by the U.S. Department of Housing and Urban Development. But for low-income residents, the cost of a monthly MetroCard is a large slice of their household budget: It adds up to $1,452 annually, approaching the unaffordability benchmark for a single worker with earnings at the federal poverty line.

The Community Service Society of New York and the Riders Alliance have proposed half-price fares for working-age adults who have incomes at or

below the federal poverty line to support their ability to work, go to school and take other steps to advance economically. The Fair Fares proposal is a reasonable measure in line with mayoral priorities to promote work, increase job training, reduce income inequality and generally make New York City more affordable for all.

New York City Mayor Bill de Blasio has stated that he supports the measure, but the city should not pick up the tab, which is estimated to be $212 million in foregone fare revenue.

FAIR FARES City & State’s editorial board is partnering with the Community Service Society of New York and the Riders Alliance to support the Fair Fares campaign, an effort to convince the New York City Council and Mayor Bill de Blasio to fund subsidized MetroCards for low-income New Yorkers. First, alternative funding sources are not appropriate. Subsidizing services to the poor with higher fares for other riders makes little sense; a broad tax base that draws resources from all wealthier New Yorkers, not just those relying on the subway, should back the commitment to broader opportunity. Moreover, the state should not bear the cost by giving more of its tax revenue to the MTA because the beneficiaries are limited to New York City residents and do not include those in other parts of the state.

Second, there is precedent for city-subsidized fare reductions to meet larger policy goals. The MTA provides discounted MetroCards to students and senior citizens, which costs the city $100 million a year. The city also subsidizes paratransit for users who are disabled and unable to fully access subway and bus services at a yearly cost of $130 million. In total, the city provides $1 billion in annual operating funds to the MTA, an amount that is substantial and

recognizes the importance of the transit network to the city’s economy and way of life.

At $212 million, the Fair Fares proposal represents less than one half of one percent of de Blasio’s proposed $84.7 billion operating budget. If the mayor sup-
