CITY & STATE CELEBRATED its 15th anniversary at its first in-person event since the start of the coronavirus pandemic on Aug. 18, drawing more than 200 political players and insiders to Midtown Loft in Manhattan for a much-needed get-together.

Among the big names who spoke at the event were U.S. Senate Majority Leader Chuck Schumer, state Sen. Jessica Ramos, New York City Comptroller Democratic nominee Brad Lander, Manhattan Borough President Democratic nominee Mark Levine and Assembly Member Yuh-Line Niou.

These were high-profile speakers with supporters and other well-known politicians in the crowd, including Manhattan Borough President Gale Brewer and Queens Borough President Donovan Richards. Also there was Shams DaBaron, beaming with excitement, shaking hands and posing for photos – New York’s unexpected “homeless hero.”

DaBaron was housed on the Upper West Side with 240 homeless men at The Lucerne Hotel, which had been used as a shelter during the pandemic. He became a spokesperson for the residents and gave voice to all of the city’s homeless residents.

I expressed my frustration at not doing more personally to help this vulnerable population.

“But you did,” DaBaron told me. “You, the media, helped to get our message out.” He also reminded me he was named a winner on City & State’s Winners & Losers in October.

This guy wasn’t just a winner and a hero, he was a historymaker. That’s why City & State will remember him when we mark our next milestone as someone who made a difference.

Assembly Speaker Carl Heastie was criticized for not initially supporting the release of materials gathered as part of his chamber’s impeachment investigation into Cuomo.

IMPEACHMENT PROBE BACK ON

Just as quickly as Assembly Speaker Carl Heastie announced that Gov. Andrew Cuomo’s resignation would bring an end to his chamber’s impeachment probe, he reversed course.

Heastie made his original announcement bringing the investigation to a close

before the chamber’s Judiciary Committee was even scheduled to meet in the wake of Cuomo’s resignation.

But the decision was met with backlash, with both Democrats and Republicans calling to continue with impeachment even after Cuomo is gone.

As Lt. Gov. Kathy Hochul prepares to make the leap to governor, speculation abounds over who she will pick to replace her through 2022 and serve as her second-in-command.

Although she has made no commitment yet, Hochul said her pick will come from New York City, balancing out her Western New York roots.

Her choice of lieutenant governor could signal that she’s looking to have a better relationship with the city after Cuomo’s acrimonious one. Meetings with Mayor Bill de Blasio and Public Advocate Jumaane Williams point in this direction as well, although Williams said he has no interest in the lieutenant governor role despite seeking it in the 2018 Democratic primary.

The list of prospective candidates is a long one, with a number of downstate lawmakers jockeying for the role.

However, state Sens. Brian Benjamin and Jamaal Bailey seem like frontrunners, with Hochul reportedly vetting them.

The appointment will likely be her first major act as New York’s new governor.

and vote on articles of impeachment. And Heastie has not definitely committed to a time frame for the release of the report, saying in his most recent comments on the matter that the chamber would work “expeditiously” to get it out.

FINAL MOVES FROM CUOMO

In the waning days of Cuomo’s time as governor, he has refrained from doing anything too noteworthy, but that doesn’t mean he’s going out in silence. While keeping himself out of the public eye, Cuomo announced a new vaccine requirement for all health care workers in the state. Previously, he only required public health care workers to get the shot.

Cuomo also commuted the sentences of five men convicted of felonies, and pardoned five others who faced deportation because of their criminal records.

The governor signed a couple of bills, including one piece of legislation meant to aid in the conversion of commercial properties and hotels into housing.

New York City officially began its vaccine passport program that requires residents to show proof of vaccination to enter a wide variety of businesses from restaurants to gyms. It’s up to the individual businesses to enforce the requirement, or risk a fine, and many are already pushing back against the new mandates that they think will further harm struggling small businesses. The New York City Police Department is requiring unvaccinated cops to continue wearing masks. Hochul advocated for mandatory masks in schools once classes begin, a decision that until this point Cuomo has said would need to be made by each district. He said the same thing of vaccine mandates for school staff, although at least some districts are already acting. The most recent one to implement a vaccine and testing mandate is the Rochester City School District.

In New York City, customers now have to show proof of vaccination to enter a wide variety of businesses, including restaurants, bars and gyms.

Frequently they serve as propaganda vehicles to announce pork barrel member item projects or selective votes on issues. These so-called constituent newsletters are really just campaign literature used as a tool to raise the name identification of incumbent public officials and help grease the wheels

There is no real information provided as to actual votes on all bills, hours worked, campaign contributions from special interest groups, disclosure of financial reimbursements for daily meals or travel, along with the hours and amount of compensation for those holding second jobs.

Too many downstate members of the Legislature enjoy keeping what goes on in Albany a secret from their constituents. The same is true for many upstate members as well.

No members of the Legislature like to openly talk about the Albany evening cocktail party circuit sponsored by the army of lobbyists and pay-for-play crowd while the Legislature is in session.

With the decline of readership and advertising revenues, newspaper content continues to shrink. The handful of brave reporters in Albany are vastly outnumbered by all the press spokespersons for elected officials, government and quasi-government state agencies, along with hundreds of lobbyists from various special interest groups.

There are still many civic activists like me who have a continued thirst for news from our state capital. I look forward to the 20th anniversary of your publication in 2026!

Who in New York’s government is coordinating earthquake relief efforts to Haiti?

It’s a concerted effort by government, both city and state. My office has been speaking to Chuck Schumer’s office.

We reached out to the lieutenant governor’s office and the attorney general’s office. We’ve been very active on Mayor Bill de Blasio’s side. He announced the Mayor’s Fund (to Advance New York City) is working with organizations on the ground. We want help for the smaller, legitimate organizations that are Haitian led.

How has your office contributed thus far?

My office has turned into a donation center. So people are just coming in. News media are coming in. I get calls every day from news outlets on this and we’re talking about what’s going on currently on the ground in Haiti. As you know, the death toll has risen. It started at 29, then it went to 300, then it went to 704, then it went to 1,300 and now it’s more than 1,900.

It’s just been climbing and it’s going to climb substantially.

What lessons did you learn from the 2010 earthquake relief effort that is helping now?

We were just all over the place and we had a lot of these big NGOs (nongovernmental organizations) come in and take over our country.

We’ve learned since then what organizations are on the ground that we can work with. We’ve also created our own way of funding. There’s a community trust, which is a fund people are donating to that goes to the organizations on the ground. We have organizations led by people who left New York or the United States, Haitian Americans who are now living and have lived in Haiti since the earthquake. They have

their organizations there. And so we’re more prepared in terms of how to organize a first responder team. We know how to get there. We know who to contact. We know what to expect in terms of supplies needed for the first responders as well as supplies needed for people who are stuck in the rubble and the injured. There were a lot of amputations and a need for orthopedic surgeries. So we’re more prepared and we’re responding more quickly.

There are other countries who are offering their help like Israel. I spoke to the Consulate General of Israel, and they are sending their people.

We have New York City Council Members Farah Louis and Mathieu Eugene, as well as three incoming council members – Rita Joseph, Chi Ossé and Mercedes Narcisse. Absolutely inevitable

Nicole Malliotakis in 2022. City & State interviewed him on Aug. 16 about why he thinks getting involved in Afghanistan was the right thing to do, why the current situation was “inevitable” and what he thinks New Yorkers should be doing about it.

This morning, we’re seeing videos of Afghans flooding the tarmac at the airport in Kabul, trying desperately

to flee the country. What’s going through your head when you see that?

First and foremost – and I’m seeing this all over my Facebook feed and text messages and calls from buddies – it’s important for us to reemphasize today, more so than most other days, how sincerely grateful and thankful we are for those who served in Afghanistan. Many of whom made multiple deployments, made incredible sacrifices. And that service wasn’t for nought. They accomplished something. It was real, in response to the greatest domestic attack this nation has ever experienced. And at

EARLY TWO DECADES after the U.S. military launched a war in Afghanistan responding to the terrorist attacks of Sept. 11, 2001, the Taliban has retaken the country. The offensive by the Islamist military organization comes amid a planned withdrawal of U.S. combat troops. Former Rep. Max Rose was once one of those troops, serving as an infantry platoon leader in the U.S. Army in Kandahar Province for 10 months, from 2012 to 2013. After losing reelection to Congress in 2020, Rose recently wrapped up a six-month stint as a COVID-19 senior adviser in the U.S. De-

a moment in history – 2001, post-USS Cole, post-embassy bombings in Africa – it was a sentiment throughout the world that America didn’t have a backbone. That America won’t respond no matter what happened. And we showed them that that’s not the case. That we do have backbone as a nation. There’s been no successful attack that has emanated from Afghanistan. And that’s directly tied to their heroic actions. With that being said though, you can’t let that gratitude and that acknowledgement of history bleed into a perpetual support for the allocation of military resources, and the sacrifice of treasure and, most importantly, blood, in pursuit of perpetuating what is an untenable situation from a geopolitical as well as from a military standpoint. Absolutely untenable.

Now, the videos that we’re seeing right now are heart-wrenching, heartbreaking, and I’m sure that a deep dive will be conducted to figure out the ways in which this process could have gone better. But with that being said though, the end of this movie was inevitable, absolutely inevitable. And the speed with which it occurred, despite 20 years of investment in the Afghan national government and military just shows and proves out its inevitability.

That is not a justification for staying there.

This leads to the last point, which I think is the most essential. We can’t let a movement and an effort to end what is America’s longest war, we can’t let that bleed into naive isolationism or a dangerous reduction in America’s capacity to defend the homeland and conduct counterterrorism operations abroad. There is today not a patch of ground that America cannot kinetically touch in defense of the homeland, and in response to entities that threaten the homeland, or America’s interests abroad. We have to continue to invest in that, whether that capacity will one day maybe touch Afghanistan, or tens of other nations that could pose a threat to us.

Your concern is clearly with national security. Do you think American involvement in Afghanistan has made life safer for Americans?

What about for Afghans?

Absolutely. I 100% believe that our involvement in that conflict and our resolute involvement has showed that –

for the last 20 years there has not been a direct attack that has emanated from Afghanistan. And, by the way, it has also sent a message that in the event of a significant attack on the homeland, America will respond in a resolute and fierce manner.

With that being said though, none of that is a justification for (a) perpetual warfare commitment to an untenable situation. So now we need to transition to a new stage, and that new stage is centered around our capacity to respond to terrorist threats no matter where they emanate from, Afghanistan or otherwise. And I am a firm believer in the United States of America maintaining that capacity. But also not committing an ungodly amount of treasure and harrowing levels of service members to something that cannot be resolved with our military.

Overall, do you think it was the right decision for the U.S. to start a war in Afghanistan 20 years ago?

100% I’ve seen blame placed on President Joe Biden specifically, criticism that the pullout was done irresponsible.

Do you blame any particular leader?

Is that the right perspective?

In terms of the execution of the withdrawal, there’s no doubt that the Pentagon and the National Security Council and the State Department will evaluate what could have gone better. But that does not take away from the fact that the decision itself to end this war was eminently justified, whether that’s under President (Donald) Trump, or under President Biden. And the fact that you have some people who are defending President Trump’s peace deal with the Taliban a year ago, now vociferously demonizing President Biden, just speaks to the lunacy of politics in the modern day.

I believe Rep. Nicole Malliotakis, who you ran against last year, has fully blamed Biden.

On this day especially, Nicole’s opinions are irrelevant. What matters is what is best for the long-term national security

of the United States of America, while also preserving our values and properly utilizing finite resources. That’s what matters here. On this day, more than any, you’re going to see folks taking advantage of the opportunity for retweets and sound bites. That’s not how you conduct national security. You have to conduct national security with an eye towards a global view, not being naive. You can be a naive isolationist, you can be a naive jingoist.

And we don’t have the time for either of those today. And we certainly don’t have the time for anyone taking a hyperpolitical lens on this, particularly at a moment when Donald Trump forthrightly set the table for this withdrawal in the first place.

Do you think there’s anything New York’s state and city governments should be doing about the situation in Afghanistan?

As a city that is more familiar with aiding and supporting diasporas and communities abroad more than any other – certainly any other city in America, perhaps more than any city in the world – this is not a situation that New Yorkers are unfamiliar with in terms of the opportunity to send aid abroad. But what I would say that I think is really especially important is that for New Yorkers, in terms of their civic participation, to center the conversation on how, in the era of 2021 and beyond, how do we preserve this country’s national security? With the understanding that New York City all too often, has a bull’s-eye on it. And that means that we can’t just, with a blindfold on, continue to engage the world as if it’s 2001, 2002, 2003 and continue to expend resources in that manner. (We have to be) constantly evolving, constantly reshuffling, constantly thinking about how do we make the right investments.

And New Yorkers, being the leaders that they are, they need to demand that of their elected officials, particularly at the federal level.

Do you think New York, and the United States as a whole, should be accepting Afghan refugees at this time? Should there be a limit?

Absolutely. As many as possible.

The end of the imperial governor Incoming Gov. Kathy Hochul could unwind a century of growing executive control.

T. GOV. KATHY HOCHUL faces a choice after she officially becomes the first female governor of New York on Aug. 24. She could wield her power to its maximum extent, or she could give up some of it to ensure future reforms outlast whatever time she has as governor.

There are signs already that the Western New York native – who already announced her intent to run for a full term in 2022 – might give up some power in the 16 months left in the term she inherited from the infamously heavy-handed Gov. Andrew Cuomo, who announced on Aug. 10 that he would step down in the face of impending impeachment over a litany of scandals. Hochul has said that addressing sexual harassment will be a top priority for her. Another will be giving legislators and local officials a greater voice in policymaking. “My style is very collaborative,” she told CBS News in an interview after Cuomo said he would resign. “I will listen to people (and) we’re looking forward and making sure that my reputation and the reputation of my administration is one that is completely ethical.” That is all more easily said than done.

She will enter office with immense powers under the state constitution to unilaterally dictate state spending, micromanage state agencies and control the judiciary through her appointments. A lack of term limits has meant that a litany of governors have reigned longer than Julius Caesar and Napoléon Bonaparte. “The system is fundamentally set up for the executive to have as much power as possible in New York,” Assembly Member Ron Kim of Queens said in an interview. “It also reflects one of the weakest legislative branches in the country.” Governors in other states are much less powerful by comparison, especially in more populous places like California, Texas and Florida. One 1990 study found New York governors were the second-most dominant in the nation (behind Maryland), and the office has only gained additional responsibilities since then.

The impending resignation of Cuomo could mark the end of a century of growing gubernatorial power in the Empire State, according to interviews with experts and legislative leaders. Hochul is vowing to pursue a more collaborative leadership style and legislators are more emboldened than ever to assert themselves at the expense of the Sec-

ond Floor. “The (state) constitution itself and court decisions interpreting it have really skewed the power dynamic in state government,” state Senate Deputy Majority Leader Michael Gianaris of Queens said in an interview. “We need to correct that.”

The extent to which Hochul might support or resist such efforts could go a long way toward determining her success as governor.

There are two constitutional amendments that lawmakers have proposed to reduce the governor’s power. The first aims to eliminate the budget powers established by the state court decision in Silver v. Pataki, which blocked lawmakers from making substantial changes to the proposed budget, beyond tweaking spending numbers.

State lawmakers could refuse to approve the budget, but the governor could then dare them to either pass one-week budget extensions or risk the political fallout of shutting down state government. Lawmakers have argued for years that this is inherently undemocratic. “Government in America is supposed to be characterized by checks and balances,” Assembly Member Richard Gottfried of Manhattan, who has sponsored the amendment in the past, said in an interview. “And in New York state, we have not had that, effectively, in a long time.” Implementing that change would require votes by majorities of two successive legislatures and approval by New York’s voters. The failure of a 2005 ballot referendum highlights how a governor thwarted such an effort by saying it would unleash fiscal anarchy by allowing legislators to have more power.

Another amendment backed by a growing group of state lawmakers would establish a new Government Integrity Commission to investigate alleged wrongdoing by people in the executive and legislative branches of government. A critical difference between this proposed ethics body and the much-criticized Joint Commission on Public Ethics, established in 2011, would be that the governor and the legislative leaders would have much less leeway to choose commissioners who might later decide on cases concerning them or their political alHochul has said she plans to institute much stricter rules as governor for her staff when it comes to ethics and sexual harassment.

She could also instruct state agencies to be more responsive to Freedom of Information Law requests or give the state comptroller more responsibility for overseeing contracts. “I want by the end of my administration for every woman to say there are no barriers, there is no longer a ceiling,” she told CBS News about battling sexual harassment.

Enacting more lasting change with new laws and constitutional amendments might mean that she and her successors lose some of the sweeping powers they acquired long ago when creating a powerful governor was all the rage in progressive politics.

Reforms enacted in the early 20th century greatly consolidated control over state government in the Second Floor. This happened as part of a wider expansion in executive powers across the country that saw the beginning of the imperial presidency, according to Gerald Benjamin, a retired political science professor at SUNY New Paltz and expert on state government. “The American system was initially designed to locate power in the legislature,” he told City & State. “The New York governor was initially stronger than most state governors in the 18th century – but still mostly an agenda-setter.” That changed in the 1920s when Gov. Alfred Smith championed sweeping changes to state government.

Progressives at the time believed that a stronger executive could better battle corruption by appointing state agency leaders, who had previously been elected, and establishing a formal budget process compared to the fiscal free-for-all among departments that had previously existed in the state Legislature. These changes created an imperial governor by design, according to a 1919 report prepared by staff under Robert Moses in his days as a good-government idealist. “The only serious argument advanced against such a proposed reorganization and budget system is that it makes the Governor a czar,” reads

Silver v. Pataki is actually shorthand for two cases that were decided at the same time: Silver v. Pataki, brought in 1998, and Pataki v. Assembly, brought in 2001. In the former case, thenAssembly Speaker Sheldon Silver sued then-Gov. George Pataki over the 1998 state budget. The Legislature had passed Pataki’s appropriations bills, but then attempted to amend how certain money could be spent and put conditions on spending through nonappropriation Then-Gov. bills also included in George Pataki won a court case the budget package. to solidify his Pataki said lawmakers budgetary power. unconstitutionally changed his appropriations bills – the Legislature can only reduce or completely cut appropriations that the governor proposed – and he rejected the changes through line-item vetoes. In the second case, the Legislature said the appropriation bills that Pataki introduced contained language, specifically around education and health care spending, that did not belong there.

So lawmakers removed the language they considered unconstitutional and entire appropriation items. But they then introduced their own bills – 37 “single purpose bills” to be exact – that appropriated the same amounts with similar purposes but different conditions and restrictions. Lawmakers argued they

were within their constitutional right to do this after passing or rejecting the governor’s bills. Although he signed them, Pataki sued the Assembly so a court could declare whether what they did was unconstitutional.

The cases made their way to the Court of Appeals, the highest court in the state, in 2004, when the panel of judges ruled on both cases. By a 5-2 margin, they found that the Legislature had unconstitutionally changed Pataki’s appropriation bills, but the final ruling

had only a three-judge plurality due to the trickier question the lawsuits posed.

Namely, what is the line that a governor can’t cross when it comes to including appropriation language that doesn’t directly relate to the budget? Although the plurality agreed that Pataki acted constitutionally, it agreed that the courts should determine a measure to figure out how far is too far. But the judges did not do this, leaving the question “for another day.” A decade later, Gov. Andrew Cuomo pushed the envelope with the amount of control he exerted over the 2015-16 budget, with many looking at Silver v.

the report. Court decisions in subsequent decades gave governors even more power on the margins, according to Benjamin, but nothing like what would happen in the early 21st century following Silver v. Pataki.

More formal power was a big boost for governors following the landmark decision, but a key challenge for them was how they balanced that with more informal means of influence. Then-Gov. George Pataki, who was the defendant in the eponymous lawsuit lodged by then-Assembly Speaker Sheldon Silver of Manhattan, declined to run for reelection after the decision because of plummeting poll numbers. His successor, Eliot Spitzer, did his best to strongarm lawmakers, but eventually resigned over a prostitution scandal. David Paterson then rose from his position as lieutenant governor under circumstances similar to Hochul’s. He too had to face the question about whether less could be more when it came to executive power. “Pataki was an imperial governor and Spitzer was on his way to being an imperial governor,” Paterson said in a recent interview. “I didn’t try to do that. You didn’t see everything with my name on it. You saw a lot of my administration leaders doing press conferences and participating more. I see Hochul continuing that, because of all the imperial governors, Andrew (Cuomo) was the super imperial governor.”

Hochul will face a multitude of challenges as governor, beyond dealing with sexual harassment, ethics and involving other elected officials in key decisions. COVID-19 cases are rising quickly again across the state, and there are no easy answers on how best to address the spike in crime. Those two issues alone could require her to assert her power in ways that could anger legislators, local leaders and voters. Democrats have left-leaning supermajorities in the state Senate and Assembly that could challenge her authority and override any vetoes from a centrist like Hochul, which could overpower her at times like they did on school funding when Cuomo had been weakened by scandals.

New York City will have a new mayor soon after Hochul takes office. The downstate voters, labor unions and Black lawmakers who helped elect Brooklyn Borough President Eric Adams as the Democratic nominee are just the types of constituencies that she will need to defeat primary challenges from prospective gubernatorial candidates like state Attorney General Letitia James.

There is a good argument to be made that Cuomo has gotten the better of de Blasio during their public rivalry. State government has a lot of power over the city, which cannot raise taxes or even install speed cameras without getting the greenlight from Albany.

Focusing on scoring points against de Blasio, however, turned a onetime political ally into an avowed enemy. Both Hochul and Adams, a former state senator, appear intent on avoiding that. They are both moderate Democrats who are reaching their political heights after spending a good part of the past eight years tending to low-level political chores like ribbon-cuttings as lieutenant governor and borough president. The first few months in office will be critical for both of them as they establish themselves. “I know Eric, and if there’s a relationship to be had, he will foster it,” said Bertha Lewis, who founded The Black Institute and supported Adams for mayor. “It is to his advantage and to her advantage.” Recent visits with de Blasio and New York City Public Advocate Jumaane Williams, who challenged Hochul in the 2018 lieutenant governor primary, underscored how Hochul has made a public show of playing nice with

Hochul will have to tackle the rising number of COVID-19 cases and how to handle the reopening of schools in her first few weeks as governor.

at will. “You can almost say Kathy Hochul is the un-Cuomo,” said state Sen. Sean Ryan, a fellow Democrat and Western New York native who has worked with Hochul for decades. “She likes to do everything right out in the open, and she’s a pragmatist.” Her knack for retail politics and gladhanding has been matched by a serendipitous ability to make friends with people long before she might need their help. This included the help she gave a 1998 congressional candidate who Hochul had just met and needed to make inroads with voters in Hamburg when Hochul was serving on the town board.

“She didn’t have to do that,” now-Assembly Majority Leader Crystal Peoples-Stokes of Buffalo said in an interview. “She did that because she is a true Democrat. It’s about values, and not a person’s color, not a person’s gender, not a person’s ethnicity.” So if legislators start pushing for transformative changes to state government, it is safe to say that they expect Hochul to hear them out and work with them to make it happen.

Hochul declined to be interviewed for this story, and it remains unclear to what extent she would support a dramatic re-

balancing of power between the executive and legislative branches, especially when it might undermine her influence on issues other than ethics or sexual harassment. Listening to others is her priority until she officially becomes governor. “I look forward to delivering an address to all New Yorkers to lay out my vision for the great state of New York,” she told reporters in her first press conference as the governor-in-waiting. That speech could say a lot about just what type of governor she wants to be.

She could take unilateral actions to show that the types of scandals that ultimately led to Cuomo’s downfall (a few examples are sexual harassment allegations, a reported cover-up of COVID-19 deaths among nursing home residents, alleged self-enrichment through a $5.1 million book deal that was completed using state resources) will not reoccur under her watch. She could add permanency to any changes by supporting new laws and constitutional amendments. Actions like that could show that Hochul is intent on dismantling a system of power that has allowed governors to reign over the Empire State as relative im-

perial sovereigns for nearly a century. Yet, the realities of politics have already shown how self-professed reformers like Cuomo can end up resisting changes that undermine their own positions. “It is my experience that executives, if they have explicit powers within a constitution, aren’t particularly gung-ho at reducing the amount of power they have,” state Sen. Liz Krueger of Manhattan said in an interview.

There is a risk though that the first woman to be governor of New York could become the victim of outsized expectations. “You’ll notice a narrative is already developing around her: OK, the bad governor is gone, what is the new woman governor going to do to fix Albany? And let me tell you in no uncertain terms: thinking like that is setting Kathy Hochul up to fail,” Assembly Member YuhLine Niou of Manhattan said in an Aug. 18 speech at a City & State event filled with legislators, lobbyists and political watchers.

“There will be powerful voices who argue that it is because of her failure, or that no one can ever fix these problems, or that our system, and the environment it breeds, cannot change.” Whether or not this happens, the current honeymoon period that Hochul will enjoy early in her tenure will not last forever.

The upcoming legislative session and budget season will likely feature many political battles, and Hochul will have to choose how best to invest her political capital.

Ending the era of the imperial governor will take time. Laws take months to pass and amendments to the state constitution take even longer. While a full term in office would be necessary for Hochul to see this process through, she would need to get going as soon as she takes power. “Her opportunity to advance structural change is now,” Blair Horner, executive director of the New York Public Interest Research Group, said in an interview. “The longer she (is) in office, the harder it will be.” Yet, even if she only serves the remainder of Cuomo’s term, she will already have accomplished something significant – even if legislators and good-government activists alike are hoping Hochul’s ascendance represents something much bigger.

“Andrew Cuomo was a tyrant, and Kathy Hochul will certainly do better,” Gianaris said. “(But) I’d like to see her do more than just that.”

A new law will help the government respond to elder abuse by cutting through red tape.

N OLDER WOMAN was sitting in her southern Brooklyn home a few months ago when the telephone rang. The person on the other end told her that she could finally get her computer repaired. All she had to do was print a form with instructions on how to pay. She then took that to her local bank where she asked the teller to wire a five-figure amount to a guy in Thailand. The teller said this was just not pos-

sible, so she went to a more obliging branch nearby. She sent additional money the following day, but there was no computer repair coming – certainly not one worth the $50,000 she had wired. It took her a little while to realize that, according to state Sen. Roxanne Persaud of Brooklyn, who relayed her story to City & State. The most her staff could do at this point was help the woman secure her financial information.

The incident came to mind in early spring when Persaud learned about a bill

that would make it easier to help people like her elderly constituent. Identity thieves have snookered many other people. Additional seniors have been physically, mentally or financially victimized by their own relatives. This problem has only gotten worse during the coronavirus pandemic with many older adults stuck behind closed doors. Identifying clues of abuse can be hard, but a new state law could make it easier for local and state authorities to investigate cases and bring perpetrators to

justice with the help of these wonky things called elder abuse enhanced multidisciplinary teams.

The basic idea was to bring people from government agencies, social services nonprofits, police departments and other entities together to investigate a case rather than have them work individually. Hospitals and child welfare agencies are examples of places where such teams have been deployed for years, but state laws blocked how they could tackle cases of elder abuse. A hypothetical

example might be how a bank serving that woman from southern Brooklyn may not be legally allowed to tell law enforcement that it suspected some guy in Thailand was bilking her out of thousands of dollars. An enhanced multidisciplinary team might be able to get hospital personnel and a sheriff’s deputy together to discuss how someone with a criminal history might be abusing their elderly relative. The bill signed into law by Gov. Andrew Cuomo on July 1 reduced the legal barriers to such cooperation.

“It just takes away any type of ambiguity about the agencies sharing information, so it’s a smoother process,” Bill Ferris, state legislative representative for the AARP, said in an interview.

A wide variety of data highlights how elder abuse has gotten worse in the past year or two. One in 10 adults over the age of 60 experience some form of maltreatment, federal officials said in 2018. A May 2020 study by researchers at Weill Cornell Medicine and NewYork-Presbyterian Hospital found that double-digit percentage increases in elder abuse were possible in New York City based on past disasters. “Throughout the pandemic, we have seen an uptick in reports of elder abuse, raising the alarm for the need to adopt legislation that better responds to cases of abuse,” Katelyn Andrews, director of public policy at LiveOn NY, which is a membership organization representing 100 senior advocacy groups, said in a June press release supporting the legislation. That adds up to a lot of people in a state of 20 million, especially given the substantial aging population in the Empire State and how long social distancing restrictions have remained in effect. That is why the state Office for the Aging drafted the bill and requested that legislative leaders pass it as soon as possible, a spokesperson for the office confirmed with City & State.

Persaud, who chairs the state Senate Committee on Social Services, said she volunteered to sponsor the bill and approached Assembly Member Catalina Cruz of Queens to introduce the bill in her chamber. “(COVID-19) brought out some really ugly things,” Cruz said in an interview. “When it comes to seniors, especially in communities of color, you have folks (like in) my district who are often the target of these crimes by people they love.” Advocacy groups like

LiveOn NY and the AARP threw their political weight behind the bill, which passed both the state Senate and Assembly before the last scheduled day of the legislative session on June 10. That was a pretty fast pace in a state Capitol rocked by a litany of gubernatorial scandals and more than a little infighting among Democrats.

This legislation passed the state Senate unanimously, as did other bills targeting elder abuse with a long list of legislation affecting seniors. While the Assembly did not pass all of them, it did pass the bill helping the state Office for the Aging expand the enhanced multidisciplinary team it established years ago, along with reducing the bureaucratic morass for local governments to investigate elder abuse within their jurisdictions. “The team breaks through the silos that too often make (a) response more challenging and by sharing resources (to) overcome limitations that may exist within any partner independently responding,” Dutchess County Executive Marc Molinaro, a Republican who is president of the New York State County Executives Association, said in a statement. “The team really magnifies our ability to more successfully prevent and intervene in abuse and exploitation.” So add elder abuse to the seemingly short list of issues where Republicans and Democrats can still work together.

The big question moving forward is how enhanced multidisciplinary teams might curb elder abuse like that which affected that older woman in southern Brooklyn months ago. Public awareness about the problem will be key, according to Persaud, so that more bank tellers, health care professionals and others can identify potential cases and refer them to the proper authorities. An enhanced multidisciplinary team should be able to take things from there.

While it can’t do much at this point to help that woman recover the money she lost, many of her peers could be saved in the future. Additional benefits could be proven with time, according to Persaud. “It will deter some of these unscrupulous people from targeting the seniors,” she said. So these teams might be able to score some serious points against elder abuse in the long run. Not bad for a relatively short piece of legislation that became law with little fanfare and zero controversy months ago.

The other side of quarantine How living in isolation for the past 15 months has harmed New York’s seniors.

While seniors distanced from others during the pandemic, isolation has had unintended consequences.

such as going back to senior centers and visiting their vaccinated family members.

Other seniors, however, have deteriorated both physically and mentally due to their time in isolation.

As the coronavirus began to rapidly spread throughout New York more than a year ago, people were barred from visiting nursing home residents. Senior centers closed. While the city and state acted in accordance with CDC guidance, some health care experts have begun to examine the harm that was also done by keeping seniors completely isolated.

“When we look back on this in the years to come, I imagine there’s going to be a lot of Monday morning quarterbacking around whether it was a good idea to blockade older adults in their nursing home rooms for eight, nine, 10 months out of the year without letting them have access to their families,” David Grabowski, a health

care policy professor at Harvard University’s medical school, told The Atlantic in January. “I think we’re going to look back and say, ‘What the hell were we doing?’”

ELDERLY NEW YORKERS, like seniors across the country, had already been more prone to feelings of loneliness and isolation due to retirement, cognitive or physical issues and shrinking social circles, which were then exacerbated considerably because of the pandemic. While those residing in nursing homes had different experiences than those living at home or in a retirement community, both populations faced similar challenges: a lack of personal connection with those around them.

In January, Beth Finkel, who is the state director of AARP New York, told NPR that “being isolated is equal to smoking 15 cigarettes a day.” Loneliness has, in fact, been cited as the cause of premature mor-

HROUGHOUT THE PAST year and a half, New York’s older adults, perhaps more than any other group, have been encouraged not to leave their homes over concerns that they may contract the coronavirus and get very sick.

Even in the early days of the COVID-19 pandemic, older individuals over 65 were warned of the serious threat that the virus posed to them. As of January 2021, 8 in 10 coronavirus-related deaths were among seniors, according to the Centers for Disease Control and Prevention. Fortunately, vaccination efforts in New York have largely been a success among older adults. Nearly 82% of people ages 65 and up in New York have been fully vaccinated against the coronavirus.

Despite the state’s precarious future with the spread of the delta variant, many older adults are able to return to some of the pre-pandemic activities they enjoyed,

tality, higher rates of heart disease, stroke and dementia, as well as an increase in depression and anxiety.

Congregate senior programs, such as at senior centers or community centers, are incredibly important to older adults as they have been shown to mitigate the effects of loneliness and isolation, according to Tina Sadarangani, an assistant professor at New York University’s Rory Meyers College of Nursing, who has been studying older adults who make use of senior centers. “Whereas you and I go to work to be productively engaged, an older retired person may lean on these types of resources for productive engagement (or) just (as) a reason to get up and go somewhere in the morning,” Sadarangani said.

While many senior services tried to put their offerings online, some older adults had difficulty accessing them and adapting to using Zoom and other video confer-

encing services to maintain connections with friends and family. About one-third of adults ages 65 and older said they did not feel confident using digital technology in a Pew Research Center study in 2017.

Some elderly people even found it more frustrating to use digital means of communication than going without any social contact at all during the pandemic, according to a study published in July. “It’s surprising that virtual contact is associated with greater loneliness and mental distress than no contact, but then again, not so surprisingly, a wide array of research did document the digital burden, stress and reluctance experienced by some in the aging population,” Yang Hu, one of the study’s authors, told CNN. The New York City Department for the Aging worked to bridge the technology gap among the city’s older population by providing tech training services and 10,000 free internet-enabled tablets to seniors in New York City Housing Authority developments. Nonprofit organizations have partnered with the city to offer virtual programming during the pandemic that included everything from magic shows and exercise classes to educational offerings.

“I think we’ve provided a lot of different pathways to engage in ways that are meaningful to them, and we made significant inroads to address the digital divide,” Jocelyn Groden, associate commissioner of the department’s Bureau of Social Services and Direct Services, told City & State. “There’s definitely more to do and we very much intend to do more. That said, the silver lining of this awful period of time is that we have broken down, to some degree, the digital divide among older adults. And as the world continues reopening, we plan to offer hybrid solutions, where we continue to engage older adults through these virtual platforms, while also offering that in-person option.”

Still, nearly all experts on elder care agree that in-person socializing has proven to be the most beneficial for the physical and mental health of seniors.

WHILE SOME SENIORS have been able to bounce back relatively unharmed by months of being stuck in pandemic limbo, others have not.

“I think many caregivers feel (the reopen-

ing of senior centers is) too little too late, that there’s only been so much we could have done to sustain (older adults) over the last 18 months and now the level of care they require is just too great (to participate in activities they once enjoyed),” Sadarangani said.

“I did alternatively have a patient with dementia who went back in his program and he was so happy, he didn’t look back, he walked right back in (to his senior center) after 18 months and happily stayed there for four hours. So that’s amazing, stories like that, but I just think it’s highly variable.”

Some older people have seen a decline in their physical mobility due to a lack of exercise from not leaving their homes, while others’ cognitive functions have decreased and some have become more fearful of reentering society. There are also some older adults whose mental capacity may have deteriorated to the point where it would no longer be appropriate for them to return, Sonja Shute, senior director of Presbyterian Senior Services’ Circle of Care program, told City & State.

“Folks that used to be eligible for their social adult day care programs have deteriorated to a point that that’s not appropriate support for them. So now they are more qualified for an overnight respite program or something with more individualized care,” she said.

However, now that senior centers are opening up again – after being closed for well over a year – elder care experts are hopeful that seniors will be able to maintain a healthy level of social engagement and that the lessons learned at the darkest moments of the pandemic will be taken to heart. This includes the importance of bridging the tech gap for older adults and learning the value of social interactions for this vulnerable population.

Groden also said she hoped more people will take the initiative to reach out to the seniors in their life – no matter if they’re a close family member or a neighbor you pass in the hallway – and check in on them or engage them in conversation, albeit in line with up-to-date COVID-19 safety precautions. “I think we should all become agents in looking at the potential for older adults who are isolated, or maybe are being aided in this moment, and reaching out for help, or pointing older adults to things like older adults centers, geriatric mental health-friendly programs,” she said.

The sun will go on to shine another day over the Brooklyn Botanic Garden and its President Adrian Benepe. The New York City Planning Commission intends to oppose the construction of a massive apartment tower project in Crown Heights that would have cast a shadow across the renowned garden.

Cuomo has granted clemency to 10 felons. Half received pardons, while the other five got shortened sentences.

For some of the beneficiaries, such as James Pamphile and Ivelisse Castillo, the pardon removing their convictions will help allow them to stay in the U.S.

CARL HEASTIE The Assembly speaker caught a lot of flack after saying there would be no impeachment of Cuomo after all or even a public report of whatever juicy intelligence the Judiciary Committee unearthed. Too bad all that public outrage made him beat a hasty retreat a few days later. A final report is going to get issued, but critics still fear Heastie might not be done yet shielding the governor from trouble.

The state Legislature passed the bill after it was dropped from the budget over disagreements on specifics with the governor.
