CRYPTOCURRENCY PROPONENTS at a City & State event in December hyped the notion that it provides more equitable access to capital and investment opportunities and has potential for creating a social benefit for people traditionally shut out from investing in the markets. Crypto, in short, was viewed as an opportunity, especially for New Yorkers who never had exposure to an asset class or had the opportunity for wealth creation. This includes unbanked people, particularly from Black and Brown communities. It sounds good, but as City & State Deputy City Hall Reporter Annie McDonough points out in her story examining crypto’s potential for social good in this week’s magazine, the digital currency is highly volatile, speculative and rife with scams and thefts. McDonough also notes “while virtual wallets may provide a way for people who are unbanked to access a system to exchange money, it doesn’t do much to help people who don’t have much excess cash to exchange in the first place.” McDonough’s reporting raises concerns that New York City Mayor Eric Adams, the city’s loudest crypto cheerleader, and other policymakers who’ve also been fast wooed by the potential of digital currency, must consider before taking the lead and converting their paychecks into bitcoin. Those at the December event concluded there must be more education around the topic, starting with elected officials. Indeed, anyone who says they envision blockchain technology used for social good really better understand how it works.

After pleading not guilty to federal charges of bribery and fraud, former Lt. Gov. Brian Benjamin has built up a legal team that may be familiar to longtime politicos. He hired the attorney who represented former New York City

Mayor Bill de Blasio when federal investigators looked into his fundraising practices. De Blasio never faced charges despite prosecutors convicting a donor of his for bribing the former mayor, so Benjamin is likely hoping for a similarly advantageous outcome in his trial. His lawyer has

already begun to offer a defense that successfully kept de Blasio out of trouble, arguing that Benjamin received no personal benefit from the alleged bribery scheme – the money he got all came in the form of campaign contributions. Prosecutors said federal investigators had issued more than

COVID-19 ON THE RISE AGAIN

The number of COVID-19 cases in New York continues to tick up after the discovery of two new omicron subvariants. Hochul warned that the state may be on the verge of another spike, reiterating the ongoing requirement to wear masks on public transit despite the recent court ruling striking down the federal mandate. She also reminded New Yorkers of the masking rules still in place at state-regulated health care facilities, jails, prisons and homeless shelters. If cases continue to rise in New York City, it may cause a change in the city’s COVID-19 risk level. Under a system implemented under Centers for Disease Control and Prevention guidelines, the city’s risk level right now is green, or low risk. But it’s not too far from a risk level of yellow, indicating medium risk. Although it doesn’t automatically trigger new restrictions, the city Health Department has several recommendations for New York City Mayor Eric Adams to consider. Both he and Hochul have expressed

reluctance to bring back onerous mandates, but have remained open to the possibility that a new spike may require them to take additional measures.

A PLAN FOR CARBON NEUTRAL BUILDINGS

In anticipation of Earth Day, Hochul and Adams joined with former President Bill Clinton to lay out a plan of action on how to make New York City high-rises carbon neutral. Although cars may come to mind first when it comes to greenhouse gases, buildings actually account for about half of the state’s carbon emissions. Reducing that footprint

will be crucial in hitting the ambitious climate goals created by the 2019 Climate Leadership and Community Protection Act. The plan invests $300 million to retrofit buildings across New York to make them more environmentally friendly. So far, over 130 buildings have signed up to go carbon neutral with help from the state, including the Empire State Building, where Hochul, Adams and Clinton made the announcement. It came after Adams unveiled a new Staten Island rooftop garden for Earth Week, one created with help from a $14 million initiative to get more green space on top of city buildings.

NYC receives first opioid settlement distribution New York City will receive $11.5 million for opioid treatment and prevention services, marking the first payment to the city from the $1.5 billion in settlements the state reached with drug companies. The money was part of $256 million the city will receive from the settlements reached thus far, including $89.9 million this year. “These funds will have an immediate impact on our communities and for individuals on the ground who are struggling with drug addiction,” state Attorney General Letitia James said while making the announcement alongside New York City Mayor Eric Adams. “This is the result of … my office’s litigation against Big Pharma for the devastation and destruction that they’ve caused, not only in New York but all across this nation.” All 62 counties in the state will receive funding from the settlement, which stems from a 2019 lawsuit filed by James’ office against the founders of Purdue Pharma, the Sackler family, along with manufacturers and distributors of prescription opioids that have fueled the epidemic. The money is required to go toward prevention and addiction services, pursuant to a state law passed in June last year. The money will be used for inpatient and outpatient treatment and counseling services

and to distribute naloxone overdose reversal medication, sold under the brand name Narcan, to law enforcement officers, in addition to educational outreach about the dangers of opioids, fentanyl and prescription misuse. “There’s no dollar amount that can make up for what we’ve already lost,” James said, noting that 2020 was the deadliest year on record for drug overdoses in the U.S. No amount of money can make up for the loss of loved ones, children, parents, for individuals that have had to pray over and hold funerals all throughout the state of New York. And we need to prevent drug companies from this deception in the future and to hold them accountable.” In the first six months of 2021, more than 1,200 New York City residents died from drug overdoses, according to data released earlier this month by the New York City Department of Health and Mental Hygiene. In 2020, the Bronx and Staten Island had the highest rates of opioid deaths per 100,000 residents, according to health department data. “Every four hours, a person dies of an overdose in New York City,” city Health Commissioner Ashwin Vasan said. – Sara Dorn

Looking back on the state budget process, your union opposed the inclusion of Gov. Kathy Hochul’s proposed extension of the 421-a tax incentive, known as 485-w. Why did the union take a stand? We opposed the 485-w proposal because we felt that with $1.8 billion a year in taxpayer subsidies going towards development that it was critical that the program works so that no tenant – or worker – is left behind. Unfortunately, 421-a failed in both those missions, and 485-w was basically a carbon copy that wouldn’t serve to advance any efforts to make housing more

affordable and provide more protections for workers. These include sustainable wages that can support a family, pension and retirement benefits, health care and worker safety requirements. Tax Day this year was used by advocates and public officials, including state Attorney General Letitia James, to highlight the ongoing problem of wage theft. Please discuss how prevalent wage theft is, particularly for the construction industry, and what’s being done about it on a policy level. It’s not just bad for the

construction industry, it’s also bad for the taxpayer, because that’s money that’s being stolen from the government that can go towards funding everything from health care to more school seats. It’s a huge issue across the entire country, and when you have such widespread theft, it lowers wages for everybody, robs the taxpayer of money and allows people primarily from Black and Brown communities to be discriminated against in a way that’s just simply unacceptable in 2022. There’s legislation passed by state Sen. (Jessica) Ramos which increased the penalties for those

who commit construction wage theft, which we’re excited about, and there’s definitely pending legislation circulating that would actually criminalize it as well, which we of course support. We have come a long way, but more needs to be done. Please discuss in more detail how wage theft impacts the most vulnerable workers. This is often about the people who do not have the protection of a union, which has mechanisms in place to protect workers. Again, it’s primarily people from Black and Brown communities, and especially those who are

undocumented, who are taken advantage of. They get paid well below the minimum wage. They aren’t given the means to advocate for themselves or even understand that they’re being discriminated against. And they’re retaliated against in cases where they do speak up, which is why it’s been so critical to have policy leaders join us out there passing legislation to give people the tools they need to fight back and get the wages that they deserve, the wages that they’re owed. What Tom Suozzi believes is ‘reasonable’

dressing the controversy surrounding the Florida law. When Rosenberg began bemoaning policy “based on 3% or in some cases 1% of the population” – an apparent reference to LGBTQ-centric legislation – Suozzi quickly took the conversation in a different direction to criticize Hochul’s Buffalo Bills stadium deal. As written, the law does not explicitly prohibit the discussion of genitals nor being gay. “Classroom instruction by school personnel or third parties on sexual orientation or gender identity may not occur in kindergarten through grade 3 or in a manner that is not age appropriate or developmentally appropriate for students in accordance with state standards,” reads the section of the law. Republicans have said the law is fairly innocuous and simply serves as a means to prevent “groomers” from indoctrinating kids. The term has become a common dog whistle among the right when discussing LGBTQ issues,

EP. TOM SUOZZI, who is running against Gov. Kathy Hochul in the Democratic primary for governor, called a controversial new Florida law aimed at discouraging discussions about sexuality and gender in classrooms “reasonable.” Dubbed the “Don’t Say Gay” law by its opponents, Democrats and LGBTQ activists have rallied against the bill as a discriminatory attempt to prevent any LGBTQ topics from being discussed. Suozzi was asked about the law while appearing as a guest on WABC’s “Bernie & Sid in the Morning” on April 14. “I want to ask you about this Florida law, the Parental Rights Act, which prohibits teachers from talking sex, genitals, stuff like that, with kids kindergarten to third grade,” Sid Rosenberg said to Suozzi. He referenced the bill’s formal name, the Parental Rights in Education Act, as well as right-wing talking points about the intent of the law being to protect children from age inappropriate sexual discussions in the classroom. Suozzi responded by echoing the same talking points. “I think it’s a very reasonable law not to try to get kids in kindergarten to be talking about sex,” he said on the show. “I wish it wouldn’t become such a hot-button issue where people are just attacking each other – it’s just common sense.” Suozzi followed up his reply with an assurance that he is not anti-gay. “I’m very much in favor of equal rights, I’m very much in favor of treating gay people fairly and treating them like the human beings they are,” he added without directly ad-

falsely connecting them with pedophilia. On the left, most view the legislation as a thinly veiled attempt to censor any LGBTQ discussions in classrooms. The comments from Suozzi came not long after other prominent Democratic leaders in New York took strong public stances against the Florida law. New York City Mayor Eric Adams unveiled an ad campaign in support of gay New Yorkers and in opposition to the statute. Billboards reading “Loud. Proud. Still Allowed,” and “People say a lot of ridiculous things in New York. ‘Don’t Say Gay’ isn’t one of them,” will go up around the state. Hochul has also opposed the Florida law. “The ‘Don’t Say Gay’ bill that far-right Republicans in Florida are pusing through is hateful, discriminatory, and dangerous,” the governor said in a February tweet. When Florida Gov. Ron DeSantis signed the legislation in March, Hochul called it a “cruel and shameful political stunt” in

another tweet. Her campaign referred to these public statements when asked for comment. A spokesperson for the gubernatorial campaign of New York City Public Advocate Jumaane Williams – who himself had been criticized for his previous comments on same-sex marriage – wrote in a statement: “It’s dangerous for any leader not to see Florida’s Don’t Say Gay law for what it is: a direct, hateful attack on the LGBTQ+ community.” In a statement to City & State, Suozzi did not walk back what he said on the radio. “Let me be clear, as I said on the radio, I fully support LGBTQ and equal rights,” Suozzi said. “I absolutely do not support the Florida governor in most policies he supports. But I think it is reasonable that kids in kindergarten and first grade are not taught about their sexual orientation in school. … Maybe this isn’t a politically correct position but it certainly seems like common sense to me.” The statement once

again did not address the concern by many other members of his party that the law will lead to discrimination against LGBTQ students in school. Suozzi added: “It’s the far left and the crazy right who are making this a divisive issue.” Suozzi’s stance on the “Don’t Say Gay” law shocked gay Democratic lawmakers in New York. “I think his comments are bone chilling,” state Sen. Brad Hoylman, who has passed a number of prominent LGBTQ rights bills, told City & State. “I think every LGBTQ New Yorker should be put on notice that Tom Suozzi is no friend to our community.” State Sen. Jabari Brisport expressed similar outrage. “One in three trans youth have considered suicide and a queer nightclub in Brooklyn was recently set on fire,” Brisport said in a text message. “Tom Suozzi should be finding ways to support the LGBTQ+ community, not validating Ron DeSantis’ bigoted moves.”

CANARY IN THE COIN MINE Some lawmakers are trying to pause energy-intensive bitcoin operations in New York. They’re facing an uphill battle. By Annie McDonough

W

HEN THE NORTH COUNTRY city of Plattsburgh enacted a first-in-the-nation ban on cryptocurrency mining in 2018, it was because of nonstop noise and rising energy bills due to the city’s power quota. Environmental concerns about the energy demands of bitcoin mining weren’t yet on too many Plattsburgh residents’ radar. “Nobody knew, back then, much about bitcoin,” said Colin Read, who was mayor of Plattsburgh at the time. In New York today, the debate over bitcoin mining has become primarily focused on its environmental effects. Bitcoin mining is a controversial – and now closely watched – practice because of the massive amount of energy that one particular type of mining used for bitcoins, known as proof-of-work mining, consumes. In proof-of-work mining, many computers compete against each other to solve complex puzzles that allow miners to verify transactions and unlock new coins. And even just four years ago, Read said, bitcoin mining’s carbon footprint was a fraction of what it is today. That’s in part thanks to the design of the virtual currency, which becomes more difficult to mine as more people participate in mining. As the state continues to experience a boom in bitcoin mining, some state lawmakers are trying to block new mining sites at fossil fuel plants with a proposed statewide moratorium. Even New Yorkers who aren’t entirely sure what bitcoin mining is may have heard of Greenidge Generation, a converted natural gas power plant near Seneca Lake that is powering energy-intensive proof-of-work mining. Greenidge is in the process of renewing key state permits for its plant, including an air pollution control permit required for large emitters like power plants. In its decision, the state Department of Environmental Conservation must consider whether Greenidge’s greenhouse gas emissions are in compliance with the standards set by the landmark Climate Leadership and Community Protection Act. The 2019 law requires, among other benchmarks, a 40% reduction in state greenhouse gas emissions (from 1990 levels) by 2030. In initial statements, the state has said Greenidge hasn’t yet demonstrated compliance with the new law. For over a year, residents and environmental advocacy groups like Seneca Lake Guardian have protested the plant, called for the state to deny Greenidge renewed permits and advocated for a statewide moratorium on proof-of-work mining to halt more operations like Greenidge from moving into New York. Although the impending decision is a routine permit renewal, some now consider it a bellwether for New York’s tolerance for more sites like Greenidge. “We view Greenidge as the test case for how the other underutilized or decommissioned power plants throughout New York state will fall. If (the permit renewal) is denied, that would sort of cast an unfortu-

nate future for proof-of-work miners who want to resurrect old fossil fuel burning plants to mine bitcoin,” said Yvonne Taylor, the vice president of Seneca Lake Guardian. “If it’s approved, however, you’ll see facilities like Greenidge popping up all over the state.” Greenidge has noted that previous state Department of Environmental Conservation decisions have explicitly said the state’s review of one facility’s compliance with the climate law isn’t influenced by what happens at other facilities. On the last day of March, the state for a second time delayed a decision on whether or not to renew Greenidge’s permits. Advocates and lawmakers like Assembly Member Anna Kelles – who is sponsoring a moratorium bill – have cast the delay as a politically motivated decision by Gov. Kathy Hochul, noting that the new deadline is scheduled after the Democratic gubernatorial primary. (New York City Public Advocate Jumaane Williams, who is running to the left of Hochul in the primary, made a campaign stop in the Finger Lakes earlier this year to call for statewide regulation of proof-ofwork mining.) Representatives for Hochul did not respond to a request for comment, but a spokesperson for the state Department of Environmental Conservation said that it was solely the department’s decision to extend the renewal deadline in order to review additional material from Greenidge. While Greenidge may be the most high-profile bitcoin mining operation in New York, it’s far from the only one. At least a dozen such sites are operating or in the works across the state, though some are smaller operations and draw their energy from the grid, not power plants they operate themselves. Many are scattered across upstate New York, where there’s easy access

N

EW YORK CITY Mayor Eric Adams may be the most recognizable champion of cryptocurrency in New York politics, but he’s hardly the first elected official in the Empire State to extoll the potential benefits of the decentralized virtual banking system and the technology that powers it, blockchain. Long before Adams started publicly beefing with Miami over which city loves bitcoin more, a handful of state legislators were talking up the technology’s possibilities. In 2017, Assembly Member Clyde Vanel introduced a slate of cryptocurrency and blockchain-related bills, including a bill creating a task force to study how to regulate cryptocurrencies and their potential uses. Vanel, who then posted a video on YouTube touring bitcoin ATMs at bodegas in his district, and other elected officials continue to tout the economic development benefits of welcoming a burgeoning tech industry. He’s also among the crypto enthusiasts who see the technology as an economic equalizer – a tool not just for the rich to get richer, but for people who have been discriminated against by banking institutions or locked

out of investment opportunities, including people of color and low-income communities. “In order to get an account with a traditional bank, you have to be a certain type of investor. You have to have certain kinds of funds,” Vanel said. “With cryptocurrency, the bar to entry into the market is really low.” Though crypto has its rabid fans, it’s a volatile, speculative phenomenon, and one that has seen a proliferation of scams and thefts as Congress considers how to regulate the industry. Plus, while virtual wallets may provide a way for people who are unbanked to access a system to exchange money, it doesn’t do much to help people who don’t have much excess cash to exchange in the first place. Tonantzin Carmona, a fellow at the Brookings Institution, has urged mayors across the country to more carefully consider what problems they are attempting to solve with cryptocurrency before embracing it as a solution. “Contrary to what crypto proponents believe, cryptocurrency does not presently make for a good payment option,” Carmona told City & State. “Cryptocurrencies are notoriously volatile, transactions can be slow, they can also be expensive. And unlike cash, cryptocurrencies are still not universally accepted.” Roughly 301,700 households in New York City are unbanked, according to a 2021 report from the city Department of Consumer and Worker Protection, meaning that they don’t have traditional savings or checking accounts. Those households are concentrated in neighborhoods with higher rates of poverty

and ones that are predominately Black and Latino. The unbanked and underbanked are who crypto enthusiasts often refer to when outlining the currency’s benefits. Bitcoin and other virtual currencies can be exchanged through virtual wallets, forgoing the need for an individual to be approved to open a traditional account. Those wallets have also been touted as a way for immigrant families to send money back to relatives in other countries, as an alternative to traditional money transfer services like Western Union. “To send $100 to Haiti, certain places charge us $10 to $11,” said Vanel, whose parents immigrated from Haiti. “The transaction fees are fractions of what traditional money transfers are,” he said of cryptocurrency. Cleve Mesidor, executive director of the Blockchain Foundation, said it wasn’t just the unbanked or underbanked who could potentially benefit from cryptocurrency. “The Black community – yes, it’s the unbanked people who never had a bank account. But it’s also professionals like myself with advanced degrees, who are upper middle class, make six digits, but who never had the attention of wealth managers,” Mesidor said. “They gave us high interest mortgages, while our white contemporaries got reasonable mortgages that would not put them in debt.” Mesidor, who also founded the National Policy Network of Women of Color in Blockchain, said this history of discrimination was part of why people of color were attracted to cryptocurrency.

Data from Morning Consult published last fall showed that 35% of Black and 37% of Hispanic adult respondents were likely to invest in crypto, compared to 30% of white adult respondents. A separate Morning Consult poll found that cryptocurrency ownership was disproportionately high among Hispanic adults in the United States. “There would not be a cryptocurrency industry without Black and Latino communities,” Mesidor said. Some state lawmakers see potential in cryptocurrency and blockchain – but not necessarily in the way it’s being used now. Assembly Member Ron Kim and state Sen. Julia Salazar sponsored a bill that would create a public virtual banking system, also referred to as “public Venmo.” The free, publicly run system would allow New Yorkers to exchange currency for goods and services,

and also provide a way for the state to pay benefits and tax credits. The legislation has not advanced since it was introduced in 2019, but Kim pointed to a local currency initiative in the Hudson Valley aimed at encouraging buying within the community as an early template for how public Venmo and the idea of community currencies could work. Still, Kim doesn’t believe the social benefits of cryptocurrency will be automatically realized. His vision for embracing crypto technology involves the public sector creating free tools for citizens, rather than just encouraging private cryptocurrency exchanges to grow. “They’re still extracting a fee, monetizing the technology,” Kim said of the existing exchanges. “But if we create 100% free public Venmo, potentially low-income immigrants can exchange and they can transfer their monetary

value without paying anything,” he said. While Adams has championed New York City as the next crypto hub, he hasn’t spoken in detail about possible uses for how cryptocurrency could benefit underserved communities and those who have been locked out of traditional financial opportunities. “When we hear ‘cryptocurrency,’ we think of former Goldman Sachs people trading crypto on an exchange. And that’s the stereotype,” Kim said. “That’s also, unfortunately, the type of image I think (Adams) is promoting, because he’s not really deep-diving into how the technology behind crypto could be used to benefit the public sector. I look forward to having a conversation with him, because anyone that has an open mind, I’m willing to sit down with.” – Annie McDonough

to plentiful hydropower. The actual number of mining companies operating in New York is unknown. Kyle Schneps, director of public policy at Foundry USA, a Rochester-based company and the largest “pool” of bitcoin miners in the U.S, told City & State that 13% to 14% of its mining in the country happens in New York. Mining pools are network that allows individuals or private companies – as opposed to large companies that run their own plants – to collaborate on mining bitcoin together and share revenue. CHEAP POWER AND ABANDONED INFRASTRUCTURE LURES MINERS The locales chosen for bitcoin mining have a few things in common; they’re often situated on the banks of plentiful sources of water, frequently set up in abandoned factories and power plants with connections to the grid, and in former industrial towns where mining companies can make a convincing case for job creation. Greenidge said that it employs 50 people and has grown even through the COVID-19 pandemic, paying salaries of an average of approximately $80,000 a year. Critics argue that job creation is paltry. “They’re not a driver of jobs,” Read, the former Plattsburgh mayor, said of bitcoin mining companies. “We had a plastics company that was using half the power and generating 400 or 500 jobs.” A cluster of bitcoin mining operations can be found in and around Niagara Falls. Crypto miners are relying on the natural wonder of the Falls as much as the area relies on it for tourism revenue. One such company is Blockfusion, which bought and converted a former fossil fuel plant into what it calls a

“nearly carbon free” hydropower operation. Blockfusion is one of several sites in New York that either currently relies on renewable energy or plans to transition to it. In an op-ed in The Buffalo News arguing that its reliance on renewable energy is an example of bitcoin mining done right, CEO Alex Martini wrote that the site employs more than 55 “area residents.” Another company, Digihost, boasts two locations in Western New York. One of its sites is in North Tonawanda, outside of a natural gas power plant. Digihost has a deal to purchase the plant – and use it to power its mining work – but is awaiting approval on the sale from the state Public Service Commission. The company has said that it plans to convert the plant to produce “renewable natural gas” before fully transitioning to renewable energy. Though the growing cryptocurrency mining industry is not uniform, environmental advocates said they are concerned with all proof-of-work mining operations, even ones relying mainly on renewable energy. “New York state has a climate law with a goal of obtaining 70% renewable energy for the state within the next eight years,” Taylor, the vice president of Seneca Lake Guardian, said. Though Taylor noted that New York State Energy Resource and Development Authority – which along with the state Department of Environmental Conservation is tasked with developing a framework to achieve the state’s climate goals – has said the state is on track to meet the renewable energy goal, she said bitcoin mining could make it more difficult to achieve. “If more crypto miners start si-

phoning those renewables off and take them away from the public, it makes it much more difficult for the public to access those renewable energy resources, and it becomes more costly as well.” Greenhouse gas emissions have become a top concern, but noise complaints about the computer mining rigs haven’t gone away. Deborah Gondek, a resident of North Tonawanda, is among the locals who have complained about the “buzzing-humming” noise coming from Digihost’s testing of its equipment outside the power plant it aims to take over. Gondek and several others filed a suit to halt the project, but it was dismissed. “Hundreds of people, people up to a mile away, could hear it during testing,” Gondek said. “That was just running a few units, they’re not fully up and running yet.” Digihost did not respond to a request for comment, but the company said in February that the outdoor testing of its equipment is temporary and

will be moved into more insulated pods. Other mining sites are nondescript, like operations run out of roadside shipping containers in Massena, a town on the state’s northern Canadian border. Plattsburgh still has at least two companies conducting proof-of-work mining, including Coinmint, which houses its equipment in shipping containers in Plattsburgh’s Skyway Plaza strip mall. Coinmint and another company called Zafra were both in Plattsburgh before the moratorium and were allowed to operate – but not expand – while it was in place. After less than a year, Plattsburgh lifted its moratorium on mining in 2019, with a new regulation in place that requires the extra costs incurred by the city going over its power quota to be passed on to miners. A PATCHWORK OF LOCAL REGULATIONS Coinmint, which, according to its website was founded to benefit “exclusively high

net worth private clients,” now runs a much larger operation out of a former aluminum smelter in Massena, and the company is in the midst of its own moratorium battle. Though Plattsburgh was the first to implement a temporary moratorium, several other localities – including Niagara Falls, Massena and the Village of Sherburne – have followed. Massena, a former industrial town on the state’s northern border with Canada, recently extended a moratorium on any new operations until the end of April as it considers regulations on mining. Read said that Plattsburgh’s moratorium gave the city time to petition for and receive a rider from the Public Service Commission that passes power overage costs on to miners. Though he’s no longer the mayor, Read said he didn’t see much interest from miners after the regulation went into effect. “We have not had any applications to speak of since then,” Read said. “It stopped it right in the bud.”

Environmental advocates are seeking more than local moratoriums. A proposed statewide two-year moratorium that is moving through the state Legislature would block new sites that look like Greenidge from setting up shop in New York going forward. The bill, sponsored by Kelles and state Sen. Kevin Parker, would also require a general environmental impact statement on proof-of-work mining. But the moratorium bill wouldn’t ban the practice of proofof-work mining or require existing sites to pack up their whirring supercomputers and industrial sized cooling fans. It would only restrict the state from approving any new or renewed permits for fossil fuel burning plants being used to power behind-the-meter proof-of-work mining. It would not keep miners from setting up operations in roadside shipping containers, for example, but advocates call it an important first step. An earlier version of the bill failed to progress last session, in part due to opposition from construction unions whose members could benefit from the creation of new mining sites. Kelles said she feels confident about the legislation’s chances this session. “We have worked closely with unions, we have worked closely with environmentalists and scientists, legislators,” Kelles said. “I feel very confident in the version that we have. And it’s moving.” Cryptocurrency companies have become a lobbying force in Albany, and the legislation still faces opposition from IBEW Local 840. The electrical workers union said in an emailed press release that the moratorium would hamper the growth of the technology sector. “New York should be embracing emerging technology, financial security and the job opportunities for our members and new apprentices in construction and operations AND the high-tech jobs this industry brings to communities throughout the state,” the release read. Despite bitcoin mining gaining increased attention in the state Legislature this year, Hochul has been mum about the idea of a moratorium or other crackdowns on the practice. Environmental advocates and Kelles, however, have made no secret of their belief she’s stalling on weighing in on the issue until after the primary. “It just so happens that the new deadline is two days after the primary,” Kelles said at a press conference reacting to the delay of a decision on Greenidge’s air permit. “It feels very political.”

As the real estate industry’s premier trade association, the Real Estate Board of New York plays an influential role in backing measures to revitalize construction in New York. James Whelan heads its efforts to get favorable policies passed in Albany and New York City. A report from the trade association in January revealed that construction in the five boroughs saw a major boost recently, but also highlighted the need for even more housing development.

Louis Coletti has been a goto advocate for New York’s construction industry for decades, having headed the Building Trades Employers’ Association since 1997. His association has highlighted the various challenges facing contractors during the COVID-19 pandemic, which has caused a $9.8 billion loss for the broader industry. Coletti has called for policy changes to the procurement processes of both New York City and New York state to revitalize business in the area.

After having had his name floated as the next head of the New York City Economic Development Corp., Carlo Scissura is instead staying on as head of the New York Building Congress. He continues to focus on advocating for government leaders to more effectively direct federal infrastructure funds and on efforts to keep the construction industry thriving. One recent proposal Scissura has backed: using federal dollars to tear down the Brooklyn-Queens Expressway.

Thomas Foley spent more than two decades at the New York City Department of Design and Construction before becoming its acting commissioner last year. Now leading the agency in a permanent capacity, Foley plays a key role overseeing all of New York City’s capital construction projects. Under his oversight, the city established its first floodgate to protect the Lower East Side from coastal flooding and has moved ahead on plans to build new borough-based jails to replace Rikers Island.

Having spent about two decades at the New York City School Construction Authority, Nina Kubota became the first Japanese American woman to lead the agency when she assumed the position of president and chief executive officer last year. Kubota will see 12 new buildings open this year, along with additions to seven centers for prekindergarten and three-year-old students. Kubota, who has been at SCA since 1998, is also overseeing a $178.9 million school building project in Woodside that will be the largest facility the agency has built to date.

The heavy civil construction industry has a staunch advocate in Robert Wessels. He serves as executive director for the General Contractors Association of New York, advocating for members’ needs before local and state governments. The association has consistently backed calls for government leaders to invest in the Gateway Program. And luckily for the group, a vital component of the plan, the Hudson Tunnel Project, is finally on track to begin construction.

Its projects include providing a fresh paint job to the New York State Pavilion and a new coating system for the Brooklyn Bridge. As part of its responsibilities, the organization also negotiates with the union for painters and other members’ workers.

MAX ROSE Endorsements don’t win elections, but sometimes, they come in handy. For former Rep. Max Rose, who is seeking to regain his Staten Island congressional seat, support from New York City Comptroller Brad Lander is certainly welcome news considering his primary opponent. The New York City Department of Correction finally found a way to get one of its officers to show up consistently for work. According to the Daily News, Officer William Aviles called out sick 160 days last year, amid a humanitarian crisis on Rikers Island, caused, in part, by understaffing. But since Commissioner Louis Molina appointed Aviles as his personal driver on Dec. 31, he has had a perfect attendance record, according to the News, including possibly taking his boss to the auto show.
