Le Règlement 43-101 est la norme la plus adéquate/complète de l’industrie disponible pour effectuer un rapport sur l’état d’avancement d’un projet. Le Règlement 43-101 a été développé à la suite du scandale BRE-X. Ce Règlement établit les normes de divulgation publique d’information scientifique et technique sur des projets miniers. Ce type de rapport englobe des informations sur l’exploration, la géologie, les ressources, les réserves, les méthodes, les procédés, les marchés, les autorisations environnementales et les impacts communautaires, les coûts, l’économie et les propriétés adjacentes.

The National Instrument 43-101, the most comprehensive reporting standard employed by the industry. NI 43-101, developed in the wake of the BRE-X scandal, established reporting standards for public disclosure of scientific and technical information on mineral projects, capable of encompassing exploration, geology, resources, reserves, mining method, mineral processing, recovery, markets, environmental permitting and community impact, costs, economics and adjacent properties.

Cependant, une révision effectuée en 2013 a permis de constater une déficience persistante dans la manière de rendre compte des risques environnementaux et sociaux. Le bris du barrage de Mont Polley qui a eu lieu en 2014 n’a fait qu’accentuer le besoin de revoir le processus de la divulgation d’information sur l’environnement et le social.

However, a 2013 review revealed a worrying frequency of deficiencies in reporting environmental and social risks. The 2014 Mount Polley dam failure further emphasized the need for better environmental disclosure.

L’ICM a adopté en mai 2016, en collaboration avec l’ACM et la PDAC, la proposition de créer un groupe de travail sur la divulgation d’information relative à l’environnement, au social et à la gouvernance (Règlement 43-101) afin d’améliorer les pratiques de l’industrie minière.

In May 2016, CIM Council adopted a proposal put together with MAC and PDAC to create a working group on environmental, social and governance disclosure (especially NI 43-101) to improve the environment, social and related governance disclosure practices for the minerals and metals industry.

Technical reports are usually the Preliminary Economic Assessment (PEA), the Pre-Feasibility Study (PFS) and the Feasibility Study (FS). The disclosure rule 1 under NI 43101 requires that companies provide technical information that is: § Signed off by a professional person (QP) who takes

La rubrique 20 « doit décrire les renseignements disponibles

concernant les permis et les facteurs environnementaux et sociaux ou les facteurs liés à la collectivité se rapportant au projet » , ce qui comprend: a) un résumé des résultats des études environnementales effectuées, le cas échéant, et une description des questions environnementales connues susceptibles d’avoir une incidence importante sur la capacité de l’émetteur d’extraire les ressources minérales ou les réserves minérales; b) la liste des besoins et des plans en matière d’évacuation des résidus et des stériles, de surveillance du site et de gestion de l’eau, tant au cours de l’exploitation qu’après la fermeture de la mine; c) la liste des permis requis pour le projet, l’état de toute demande de permis et toute exigence connue quant aux cautionnements d’exécution ou de remise en état à déposer; d) une description de toute exigence ou de tout plan en matière sociale ou concernant la collectivité se rapportant au projet et, s’il y a lieu, de l’état des négociations ou des ententes avec les collectivités locales; e) une description des exigences et des coûts liés à la fermeture de la mine (réhabilitation et remise en état).

Chapter 20 : ‘ Discuss reasonably available information on environmental, permitting, and social or community factors related to the project. Consider and, where relevant, include: a) a summary of the results of any environmental studies and a discussion of any known environmental issues that could materially impact the issuer’s ability to extract the mineral resources or mineral reserves; b) requirements and plans for waste and tailings disposal, site monitoring, and water management both during operations and post mine closure; c) project permitting requirements, the status of any permit applications, and any known requirements to post performance or reclamation bonds; d) a discussion of any potential social or community related requirements and plans for the project and the status of any negotiations or agreements with local communities; and e) a discussion of mine closure (remediation and reclamation) requirements and costs.

Moment de diffusion de l’information auprès des Autochtones / Timing of disclosure to Indigenous Peoples Investors come first when it comes to disclosure of information.

That NI 43-101 is made for investors. How do we do to meet interests of land users if the norm is made /design for investors?

Indigenous peoples feel that, too often, they learn what the company is doing/planing quite late on; too late to allow for dialogue.

Indigenous peoples with or without treaty are involved only when it comes to the impact assessment stage… wich is too late.

Hence, open opposition often the only way to restrain the company from doing things that Indigenous belieive prujudicial or wrong.

Why should Indigenous be ‘party’ to that norm if they are already against the mining project!

Land users could help if they knew what was going on.

Strong consensus that the only reliable description of the relationship between mining project and community comes from the community itself (Ex. community report on the relationship signed by the full leadership)

Communities without treaties often do not have specific environmental and social impact processes related to a consultation obligation

General undesrtanding that NI 43-101 reports are large, expensive ‘set-piece’ exercies carried out infrequently led to the suggestion that the ‘community’ section become an adendum that can be updated more frequently. (avoiding out of date and misleading information to investors and others

Verification that the mine developer refers to the Indigenous mining policy

Would like to see a full description of how the relationship between mining project and community has evolved over time be part of NI-43-101

Recognition of the territory where Indigenous live

Probable scenarios for water and waste management: more particularly where water would be taken from and discharged to; what form of tailings management are contemplated and where tailings might be placed.

Probable and possible cumulative impacts, including other mines or exploration projects in the area that would be reliant on/impacting the same water sources or the same waste disposal zones.

Concepts for a post mine scenario. The core question being; what is going to be left after the mine is over?

• Deep concern that First Nations, as rights-holders and stewards of their traditional lands, come behind shareholdes in the disclosure of information.

• Same as Vancouver

• Frustration that poor disclosure practices become a source of community-company conflicts.

• Important for the Indigenous to unite and continue the dialogue on what would be an Indigenous mining policy, including information disclosure.

• Sharing experiences is a powerful way of identifying common concerns and how to better respond to problems of disclosure.

• Potential for education on the geological aspects

• The Indigenous group proposed that Indigenous of all nations think about the issue further and then develop a network. This information-sharing (Focus group) exercise is necessary and must continue.

1. This preliminary discussion with Indigenous focus groups has revealed a number of significant aspects of disclosure that are of immediate relevance and common concern
