Presentation For the fifth consecutive year, CHS Alternativo leads the preparation of the Alternative Report. A balance of Civil Society on the situation of Trafficking in People in Peru. This first five years coincides with the end of the validity of the National Plan of Action to Combat Trafficking in People (PNAT) 2011-2016, a policy instrument that, although with inconsistencies and limitations, raised for the first time the objectives and goals of the State in the matter..

As every year, the report identifies the progress as well as the pending challenges in the implementation of the Plan, now with the perspective that it is an additional input for the construction of the management instruments for the implementation of the new PNAT 2017-2021.

The V Report is published in two versions: a summarized version and a full version, containing the processing and analysis of all the information sent by 10 ministries, 3 OCAs, 20 regional governments and 155 local governments (of which 48 are provincial municipalities). ) that answered the requests for access to information by civil society (1 regional government and 35 local respondents after the deadline). This process was complemented by the invaluable support of the Ombudsman's Office, in the exercise of its constitutional powers and the diplomacy of persuasion that characterizes its work.

This document, called Principal Findings, constitutes the abbreviated version of the V Alternative Report, and its purpose is to share the most important advances of the State's action regarding the prevention of risk situations and the confrontation of structural causes, prosecution of crime, protection and assistance to victims affected by the crime of trafficking in people, as well as the budgetary resources allocated.

Some of the findings of the V Report confirm governance weaknesses shared by the State itself, as has been expressed in the conceptual model of the new PNAT 2017-2021.

However, as in each edition, several conclusions stand out that continue to contribute from civil society to improve the action of the State.

The first conclusion concerns the instability of the budget. In this period, the current government made a significant increase in the budget for 2017 (to 11 million soles, approximately), but the projection for 2018 reduces the budget to almost half (just over 5 million soles). This situation that has also been observed in previous years.

Efforts to achieve an adequate budget continue, and in spite of several advances, paradoxes remain such as: The increasing responsibilities of the actors, in the face of a decreasing budget; the efforts of some sectors to strengthen or maintain their budgets, while others do not allocate specific budgets; or, that, despite the increased responsibilities for local and regional governments, investment is largely limited and focused on awareness-raising activities.

In the interventions by axis of the PNAT, some contradictions are also worrying. For example, regarding the prevention axis there has been an increase in the number of trained teachers (more than 30,000 in this period, compared to 2,319 in the last period) and in the number of educational centers reached with prevention actions (from 745 to 4001); However, a decrease in the number of students who have been informed (from 48,000 to 31,000 students approximately) has also been detected.

In the axis of prosecution of crimes, it has been reported that these have reached 1,395 operatives or mega-operatives, but only 375 cases of trafficking in the judiciary have been registered; although it must be recognized that the impunity index has improved (6 out of every 100 defendants are sentenced). Regrettably, achieving consistency of information is still pending.

Regarding the axis of protection and attention, there is concern about the stagnation of actions against the reintegration of the victims, since the guide for the elaboration of individualized plans for reintegration nor the development of specific educational or labor programs have been approved. Again no specific information is provided on the access of victims to mental health programs.

CHS Alternativo hopes with this V Report to continue collaborating with the State, from a position of social audit of the State actions. This effort would not be possible without the renewed support of the United States Agency for International Development (USAID); from the Konrad Adenauer Foundation, from the Down to Zero Alliance and ICCO Cooperation, in the preparation and publication of this report.

Through Supreme Decree No. 017-2017-IN, the National Plan against Trafficking in People (PNCTP) was approved in June 2017 to guarantee a safe environment for people at risk of trafficking in people, the integral protection of the victims, respect for human dignity and the restoration of their rights. To this end, a series of scenarios are proposed that will make it possible to address this situation, taking into account inter-institutional work.

The National Plan against Trafficking in People 2017 - 2021 proposes a decentralized approach for the development of preventive work, highlighting the importance of the role of regional governments and municipalities as management bodies that can strategically plan actions that lead to the prevention of the crime of human trafficking in their respective jurisdictions, especially in those where there is a greater number of cases..

The former president of the Council of Ministers, Fernando Zavala Lombardi, last May, presented to the Congress of the Republic the report on the decisions of the State, the present National Plan of Action against Trafficking in People 2017-2021 and a ratification the Government's commitment to stop trafficking in people. He also endorsed the delivery of the necessary budget to achieve concrete changes that will provide the MININTER with more of 7.5 million soles.

Approval of Legislative Decree No. 1323 is used to determine the penalties of deprivation of liberty if the victim was subjected to sexual exploitation, if she was forced to exercise acts of sexual for economic or other purposes, to work in conditions of slavery or servitude, through any means or against her will, to perform a job or provide a service, whether paid or not.

Approval of Legislative Decree No. 1297 for the protection of children and adolescents without parental care or at risk of losing them.

It gives access to the protection of the State and to receive its services in education, health and to be welcome at the Residential Welcome Centers.

Budget

In this period, the State budget increased by more than S/ 4'500,000.00 (comparing the budget assigned in 2016 and the current budget for the year 2017).

After reviewing the information received, we note that the MININTER (S / 7'500,000.00), the MTPE (S / 248,768.00) and the MIMP (S / 2'896,804.30) they are the only agencies that have allocated resources for the implementation of the PNAT in their 2017 budget. The rest of the ministries do not have a specific budget for the execution of activities on issues of human trafficking and migrant smuggling.

For 2018, the Public Sector Budget Bill for Fiscal Year 2018 establishes an allocation for the execution of the National Plan of Action against Trafficking in People of S / 5,658,954.00, which would mean an approximate reduction of more than S / 5'300,000.00. Only the MININTER, the MTPE and the MIMP requested specific a budget this year.

Central Government’s actions

The Ministry of Women and Vulnerable Populations began in late 2016 with the preparation of the "Guide for the Development of the Individual Reintegration Plan for those affected by the crime of trafficking in people". To date the final approval by the MIMP.

In 2016, the process of interoperability between the RETA - PNP and SISTRA (Public Prosecutor 's Office) was initiated in order to provide updated information on complaints, the victim and the purpose of the crime of trafficking in people. This process started with a pilot project (INTERTRATA), whose results are not public yet.

Ministries, regional and local governments carried out activities in the framework of the World Day against Trafficking in People and the "Corazon azul" campaign, which are organized in July of each year and are under the leadership of the Ministry of the Interior and the Multisector Commission against Trafficking in people.

The Division of Investigation and Search for Disappeared People of the National Police has been integrated into the National Directorate against Trafficking in People and the Illicit Trafficking of Migrants.

Regional and local Actions

In 2017, the Regional Government of Tacna approved the Plan of Action against Trafficking in People. Meanwhile, the Regional Government of Amazonas also approved the Regional Plan on Trafficking in People.

At the time of publication of this document and taking into account the reports sent by the regional and local governments, only the approval of the following have been reported.

In Moquegua two informative campaigns of regional character and two workshops were realized of awareness aimed at social organizations. It was organized by the MIMP and the MININTER.

Regarding the San Martín Region, in compliance with Law No. 28950, Law against Trafficking in People and the Illicit Trafficking of Migrants, the Regional Network against Trafficking in People, in coordination with representatives of MININTER and MIMP, received technical assistance for the preparation and validation of the Regional Plan in San Martin, in relevance to the PNTP 2017 - 2021.

The Budget table of the sectors and regional and local governments was not elaborated

To date, there is no budget table for the sectors and regional and local governments.

The PNAT 2011 - 2016 set itself the mission of designing a policy that integrates, in an orderly manner, the actions necessary to achieve the PNAT vision. This in addition to strengthening the State's capacities to seek commitments from government actors to fight against the crime of trafficking in people in Peru, as well as leading the concertation of actions and wills with all the actors: Government, society, agencies of international cooperation, companies and the media.

The PNAT 2017-2021 emphasizes the construction and dynamization of a model of institutional articulation. Its vision is as follows: "Peru by 2021 guarantees a safe environment for the population at risk of human trafficking and the comprehensive protection of its victims, with respect for their human dignity and the restitution of their rights."

State efforts were initiated to have a national response to trafficking in people.

It is expected that inter-institutional coordination will increase for the construction of a National System against Trafficking in People that articulates the national, regional and local authorities.

In the Amazonas they have indicated that the governorate and the Emergency Center for Women were able to access 80% of a total of 2,867 public and 78 private schools (in 2016) and 50% (in 2017). This highlights the risks of the TdP and the TIDM. In addition, they point out that in these years, 34 non-university higher education centers and three universities have been persuaded to include the issue of human trafficking in their academic offers.

In Cajamarca, in 2016, various activities were carried out. These include the First North East Meeting Against Trafficking in People in Jaén - San Ignacio a training workshop on police procedures for intervention in cases of human trafficking; a training session on the Inter-Sectoral Protocol for the Prevention and Persecution of Crime and the Protection, Attention and Reintegration of Victims of Trafficking in People; the 2nd Meeting against Trafficking in People and Prevention of Pregnancy in Adolescents; a training session on trafficking in people; and the First Meeting of the Permanent Forum on Trafficking in People in the Region Border Peru - Ecuador.

- Also, in Madre de Dios, through the articulation with institutions that are part of the Commission, actions against trafficking in people have been carried out, such as: - The 3rd Regional Forum on Human Trafficking Advances in the region.

- Informative workshops on child labor exploitation, forced labor and trafficking in people (Regional Labor Directorate).

- The launch of the campaign "Without customers there is no trafficking" (CEM).

- Talks with groups of males (two days per month).

-Social communication campaigns in different parts of the city and periphery.

The regional governments of Amazonas, Loreto and Madre de Dios have reported more activities on prevention, persecution and assistance to victims during 2016 and 2017, with Loreto standing out among the three. The regions that have had the fewest actions in this period are Áncash, Pasco and Lima

The municipalities that defined their participation in the request for information

by Transparencia indicate, in most cases, the deployment of training activities and control campaigns; as well as, dissemination actions in educational institutions and public spaces, and police operations. This is the case for the provincial municipalities of Huancané (Puno), Chupaca (Junín), Del Santa (Ancash), Lambayeque (Lambayeque), Atalaya (Ucayali), Pacasmayo (La Libertad), Trujillo (La Libertad), San Martín (San Martín), Jaén (Cajamarca), Canchis (Cusco), Chivay (Arequipa), Yauli - La Oroya (Junín), Virú (La Libertad), Huarmey (Ancash), Ocros (Ancash), Caylloma (Arequipa), Huamanga (Ayacucho) Picota (San Martín) and Paruro (Cusco). Meanwhile, among the provincial municipalities that responded to the request made by the Ombudsman's Office are Páucar del Sara Sara (Ayacucho), Mariscal Ramón Castilla (Loreto), Palpa (Ica), Pataz (La Libertad), Jauja (Junín), Islay (Arequipa), Chepén (La Libertad), Aija ( Ancash), Cajamarca (Cajamarca), Chota (Cajamarca), Huacaybamba (Huánuco), El Dorado, San José de Sisa (San Martin), Ica (Ica), Concepción (Junín), Chachapoyas (Amazonas) and Coronel Portillo (Ucayali) 2 .

Annual State budget for the fight against trafficking in people

El The specific budget allocated by the ministries, Constitutionally Autonomous Bodies (OCA) and regional and local governments for the implementation of PNAT during the year 2017 reached S/ 11,000,035.00, which represents 0.0077% of the General Budget of the Republic assigned this year.

If a comparison is made with last year in relation to the allocated budget, according to the sectors and the regional and municipal governments, that figure represents an increase of the amount by 197%. This shows progress in the fight against trafficking in people, especially if the amount foreseen by MININTER in 2017 is taken into account, as well as regional and local governments.

This shows the commitment to the prevention and care of this crime; However, we are concerned about the sustainability of the budget because, according to the inquiries, what would be allocated for 2018 would be a lower budget, which constitutes a setback and goes against the current offer by the former president of the Council of Ministers, Fernando Zavala.

This year’s 2017 budget for PNAT actions has been assigned by four ministries (MININTER, MIMP, MRREE and MTPE). Most sectors have indicated not to count on a specific budget allocation.

MININTER and the MIMP are the ones that report each year a greater budgetary allocation, due to the fact that, according to the PNAT, they are responsible for the responsibility and functional competencies in three areas of intervention, in accordance with the Regulations of the Trafficking in People Law. However, other sectors such as MINSA and MRREE have a lower budget allocations even though they also intervene in the 3 axes.

MININTER informed that S / 499,115.00 was requested for the current year and S / 4,372,791.00 was assigned, which represents an increase of 876%. This budget is currently being executed.

To this figure we must add what the MININTER transferred to the PNP, which was just over three million soles. This is an achievement, since in November of last year, through the Law of the Budget of the Public Sector for 2017, it was assigned the sum of only S / 602,115.00.

The MIMP reported that in 2016 it requested S/ 310,406 for the implementation of PNA, and was assigned S/ 2,887,345. Of this amount, they executed S/ 2,896,804.3, achieving an execution of 100.32%.

It should be noted that the majority of the budget reported by the MIMP corresponds to INABIF (S / 2'607,145.00 in 2016 and S/ 2'013,143 in 2017) and refers to the maintenance of their three Residential Care Centers.

As in previous years, prevention activities focused on informing and generating knowledge about the problem of trafficking in people in Peru4.

In the 2011-2016 Plan, six goals were established that State entities, including the Constitutionally Autonomous Organizations (OCA) and regional and local governments, had to adopt and execute according to their established responsibilities.

On the other hand, the PNAT 2017 - 2021 includes four objectives and twelve concrete actions that should show results by 2018. For example, it states that "at least 30% of teachers in the national education system are trained to deal with trafficking in people and their forms of exploitation and to replicate that knowledge in regular basic education programs". How can this goal be met if the Education sector does not report a specific budget for its fulfillment?

Although prevention and awareness actions have been increasing in recent years by public entities and local and regional governments, it has not been possible to define a specific number of actions and a total number of beneficiaries, since not all subnational governments reported their progress uniformly.

The most worrisome is that prevention continues to apply to a wide range of publics, without prioritizing those at risk that could be identified based on the regions, formal or informal economic sectors, transfer routes, among other information detected by the authorities dedicated to prosecuting the crime.

The Blue Heart campaign is the most important activity in the prevention field of trafficking in people and is promoted by the Multisector Commission. In the period 2016 2017, 23 activities were carried out, including multisector information fairs, walks, parades, marches, awareness campaigns and other similar events, with a reach of more than 65,367 people, belonging to 24 regions. Of these, five focused on important districts to approach contexts of risk of human trafficking: San Román (Puno), Inambari Mazuko (Madre de Dios), San Martín (San Martín), Paruro (Cusco) and the district of Miraflores (Lima).

Generation of specialized information

The National Institute of Statistics and Informatics (INEI) drafted the technical report "Citizen Security Statistics" that consolidated statistics on complaints, investigations, identifications and sanctions of trafficking in people, with information provided by State entities every two months. However, inconsistencies have been detected in the processing of the information presented, as opposed to the one previously published by the same competent institutions.

Also, in many cases the information is not renewed, as is the case of the number of victims of human trafficking, which remains unchanged since 2014. Persecution The axis of persecution of the crime of trafficking in people has been considered within

the PNAT as an important action because it involves the investigations of the cases and the planning of the intervention and prosecution of those responsible, as well as the identification of cases outside of the country and effective collaboration. Despite its importance and the time that has elapsed, it is still necessary to strengthen various aspects of the persecution, especially the information that is published.

Eleven concrete actions and four verifiable objectives form the axis of Persecution and Control in the PNAT 2017 - 2021. The main groups responsible for its execution are MININTER, PNP, Public Ministry, Judicial Power, SUTRAN, SUNAFIL, regional governments and local governments, among others.

According to information obtained, in 2016, 96 complaints were registered to line 1818, option 1, and 56 in 2017 (first semester). This shows a tendency to reach a figure similar to that of the previous reported period. Of the regions, Lima is the one with the most complaints, with 50 and 32, respectively. In 2017, 160 complaints were reported, although there were no cases from the same number of regions as the previous year. Regarding the implementation of the new common system INTERTRATA, initiated in May 2016, the MININTER indicated that it is in the first stage of the adaptation and technical improvement of the RETA and SISTRA systems for their interconnection. The National Plan of Action against Trafficking in People 2017 - 2021, approved this year, establishes the maximum interconnection period of the RETA and SISTRA systems for the year 2020. For this, the previous step is the reformulation of both systems by 2018.

The PNP identified 427 perpetrators of trafficking in people in 14 cities in 2016 (no information is given on the entire region) and 119 in 2017; while the DIRCTPTIM informed that in 2016 it carried out 33 operations against the smuggling of migrants, in which 417 victims, 356 men and 61 women were rescued and seven suspects of TIM6 were arrested. During 2016, 337 police officers were specially highlighted in the fight against trafficking in people. This year, the number of police increased to 380. Of these, 44 police officers have access to the RETA - PNP system, although it has been repeatedly mentioned that the system should be accessible in all the police stations of the country for the registration of cases.

In this regard, in 2016, 09 deconcentrated units have been trained in human trafficking investigation and access codes to the RETA system have been delivered. Regarding the perpetrators of trafficking in people, the PNP reported that it identified 546 alleged traffickers nationwide (427 during 2016 and 119 in the first semester of 2017).

During this year they have managed to capture five wanted criminals for the crime of trafficking in people thanks to the rewards program. These aprehensions occurred in the regions of Piura, Lima, Callao and Puno. The capture of a wanted foreign criminal was also achieved.

MINJUS has a case tracking system in which public defenders of victims' defense send their monthly reports to the General Directorate of Public Defense and Access to Justice (DGDPAJ), in which they report cases of trafficking in people that were taken care of.

In 2016, 70 public defenders of victims' defense participated in 390 sponsorships of human trafficking, of which 192 were minors and 198 adult victims. Amongst the localities served are Amazonas, Áncash, Ayacucho, Callao, Cañete, Cusco, Huánuco, Ica, Junín, La Libertad, Lambayeque, Lima, East Lima, North Lima, South Lima, Loreto, Madre de Dios, Moquegua, Piura, Puno, San Martin, Tacna, Tumbes and Ucayali.

From January to August 2017, 394 sponsorships were registered. This means that more than twice as many cases have been sponsored in the first semester than in 2016.

It should be noted that 100% of these cases have received free legal attention, no matter what status they are in, which is positive. However, the question arises as to why it is still not possible to provide legal assistance to 100% of the victims, whether those identified by the PNP or the Public Prosecutor's Office.

The Judiciary developed processes in the crimes of trafficking in people and other related crimes in 33 judicial districts during 2016.

 The GR of Madre de Dios has carried out five surprise operations in those sectors with the highest incidence of trafficking in people (La Pampa, Zorro Valencia, Deltas, Boca Colorado, Guacamayo, Pacal, Mazuko, etc.) and has carried out two mega-operations in the targeted areas of the region, but without indicating the places.  The GR of Piura reported that two awareness-raising operations were carried out in the city of Piura, as well as in El Cercado, against child labor and begging. Information received at the close of the edition After the closing date of the edition of this document, on September 12th, CHS Alternativo received information on activities against trafficking in people and migrant smuggling through regular and electronic mail from a regional government and 23 provincial municipalities. (Of which one had already been received previously).

Also, through the Ombudsman's Office, documents were received with information from 35 provincial municipalities, of which 17 had already been collected. The analysis of these documents will be considered more extensively in the V Alternative Report.

However, it can be mentioned that the Regional Government of Ica announced that in 2016 the amount of S/1,907.00 soles was assigned and executed to carry out anti-trafficking activities, while in 2017 they had only S/1,000.00 soles, of which S/800.00 was utilised. In addition, they indicated on the carrying out of preventive activities in the locality such as campaigns, forums, virtual course and 23 coordinated operations with the PNP and SUTRÁN. Among the provincial municipalities that reported on budgetary allocation is San Ignacio (Cajamarca), which during 2016 indicated that it had utilised S/1,520.00 soles and in 2017, that had an allocated budget of S/2,200.00 soles. Yunguyo, in Puno, reported that during 2016 no budget was assigned, but in 2017 they were assigned S/4,758.00, of which S/ 2,985.00 were utilised and Luya, in Amazonas, reported that they had requested and were assigned the amount of S/1,500.00 in 2016 and in 2017, S/1,600.00, of which they have utilized S/900.00. in the first semester.

The provincial municipalities that reported having carried out prevention activities against trafficking in people include, San Ignacio (Cajamarca), Angara (Huancavelica), Huancavelica (Huancavelica), Lampa (Puno), Pisco (Ica), Yunguyo (Puno) , Luya (Amazonas), Carabaya (Puno), Yungay (Ancash), Kimbiri (Cusco), Palpa (Ica), Mariscal Ramón Castilla (Loreto), Jauja (Junín), Cajamarca (Cajamarca), Chota (Cajamarca), Caylloma ( Arequipa), El Dorado, San Jose de Sisa (San Martin), Concepción (Junín), Chachapoyas (Amazonas).

Among the provincial municipalities that submitted documentation to CHS Alternativo informing that they did not allocate budget or carry out preventive activities on human trafficking in these last two years include: Manu (Madre de Dios), Huayopata (Cusco), Marañón (Huánuco), Andahuaylas (Apurímac), Contumazá (Cajamarca), Purús (Ucayali), Melgar (Puno), San Bartolo (Lima), Oxapampa (Pasco), Condorcanqui (Amazonas), Antabamba (Apurímac) and Churcampa (Huancavelica). Also, Páucar del Sara Sara (Ayacucho), Pataz (La Libertad), Islay (Arequipa), Chepén (La Libertad), Aija (Ancash), Huacaybamba (Huánuco), Ica (Ica) and Coronel Portillo (Ucayali).
