Introduction This Study is designed to consolidate the capacity of the social partners of the IMI PQ NET Romania project (governmental agencies and organizations, professional associations, etc.) to get information on the qualification recognition processes in the Czech Republic and also on the conditions under which the competences achieved by citizens by informal or nonformal learning may be certified there. We believe that this Study is an useful instrument for information on the Czech education and qualification system by creating ways allowing the mutual consultation with similar organizations in the European Union and the European Economic Area (EEA) through the internal market information system platform (the IMI platform) both for the competent authorities in Romania and for the Romanian citizens who want to work in the Czech Republic and need information for this particular purpose.

The Czech Republic is divided into 14 regions out of which the capital city, Prague, is a separate administrative entity. A very important aspect is that the recognition attestation for a national coming to the Czech Republic – as the host country – is issued by the education department in the regional authorities. Besides the city of Prague, the 13 regions are: South Bohemian Region, Zlín, Silezia Morava, Liberec, Pardubice, Ústí nad, Labem, Karlovy Vary, Plzeň, Central Bohemian Region, Hradec Kralove, Vysočina and Olomouc Region.

The structure of this Study is extremely simple and is focused on information regarding the two basic components allowing the access to work: 1.

The presentation of the Czech education system with referencing of the study

level to the International Standard Classification of Education (ISCED) developed by the United Nations Organization for Education, Science and Culture (UNESCO) and through this to the Czech Qualification National Framework and the European Qualification Framework (EQF) respectively; 2.

The presentation of the legal and institutional framework for the recognition

of qualifications achieved in other Member States of the European Union, the European Economic Area and the Swiss Confederation, along with a database including the Czech competent authorities homologous to the Romanian competent authorities – on one hand, and the list of the regulated professions in the Czech Republic with the correspondence of the 4

1. Competence certification process in the Czech Republic 1.1. Education system and degrees / certificates achieved through it In the Czech Republic the public authority in charge with the educational system organization and policies is the Ministry of Education, Youth and Sport (Ministerstvo školství, mládeže a tělovýchovy). The legislative framework for the current education system in the Czech Republic is regulated by: the Education Act no. 472/2011, setting the administrative procedures for the four levels of education: preschool, primary, secondary and tertiary; Act no.

563/2004 on pedagogical staff – regulating the requirements for the fulfilment of the teaching staff’s duties during their training and career evolution; Act no. 383/2005 regulating the requirements for the education of children and teenagers with no proper family support or with behavioural issues; Higher Education Act no. 111/1998, with current amendments and completions, regulating the activity in the higher education public and private sectors (a new act is pending elaboration); Act no. 179/2006 regulating the recognition of the competence results obtained by adults who do not attend a formal education system in order to be granted a qualification certificate.

The structure of the current education system is compliant with the four levels: a. Preschool education, from 3 to 6 years, is similar to the one in Romania and is not mandatory. b. The mandatory education starts at the age of 6 and usually covers 9 years or even 10 years for children with disabilities or special needs. c. The secondary education takes various forms: high-schools providing education for 4/6 years (including the post-secondary forms of education); the vocational or commercial secondary schools providing education for 2-3 years (Střední odborná skola, Střední Prumyslova skola); the vocational arts schools providing education for 4-6 years (konzervator). d. Higher education. As in Romania the Czech higher education system is organized according to the Bologna Convention: bachelor, master, PhD. The bachelor studies cover 6

3/4/or even 6 years, being followed by master’s programs for 1-3 years. The PhD courses last for 3-4 years.

A complete diagram of the Czech education system1 is given in Figure 1, where – as one can see – the following are presented: the durations of the education forms, the age of students who go to school, the qualification level according to the international Standard Classification of Education (ISCED), the curricular paths that can be followed for providing them with access to the next level of education [1].

If we analyze Figure 1, we notice that the mandatory education lasts for 9 years, the primary education from the age of 6 to the age of 11 and the mandatory secondary education from 11 to 15 years of age. After completing the 9 years of mandatory education, children reach the basic education level (základní vzdělání) and receive a final assessment report that is not regarded as a diploma (Vysvědčení). From the qualification level point of view, this final assessment report is consistent with Level 1 in the ISCED (International Standard Classification of Education) classification [2].

The superior secondary education is performed through four curriculum directions:  The vocational education including arts – music, dancing, painting, etc., with a duration of 6/8 years depending on the curriculum direction followed, which ends with the awarding of a diplomat specialist diploma DiS (diplomovaný specialista).

 The general secondary education that lasts for at least 4 years and may start following the completion of the 9 years of mandatory education. Following the completion of these studies, the students receive a maturity certificate (Maturitní zkouška, annex 1), which usually grants access to the higher education level. These programs for the training of students in the secondary education are provided in several types of education units: Secondary schools (Gymnázium), High-Schools, Secondary technical schools (Střední odborné školy - SOS) and conservatoires for education in arts. Most of the SOS programs last for 4 years and end with the awarding of the maturity diploma (Vysvědčení o maturitní zkoušce), benefiting from the same recognition as the diploma awarded after the graduation from a secondary school and granting access to the entrance examination for the higher education level [2].  The vocational secondary education is provided by vocational secondary schools (Střední odborné učiliště - SOU) for 2 – 3 years. Following their graduation, the students are awarded a general or technical professional qualification. The graduates are granted qualifications for certain technical or economic professions or positions / jobs requiring highlevel technical skills. This form of education directly prepares the young people for the labour market and the most common schools in this form of education are: business schools (Obchodní akademie), agricultural secondary schools (Střední zemědělská škola), cookery secondary schools (Střední odborná škola gastronomická), medical secondary schools (Střední zdravotnická škola), pedagogical secondary schools (Střední pedagogická škola), and commercial secondary schools (Střední průmyslová škola). In order to have access to a maturity certificate (Maturitní zkouška) the graduates from such programs have to attend two more years for completing their studies.  The vocational secondary education (Střední vzdělání) lasting for 1-2 years is provided in special schools (Odborná škola) or practical skills formation schools (Praktické školy). These training programs are designed for disabled students who have not yet completed their basic education.

The maturity diplomas awarded both by a gymnasium and by a special secondary school as well as the maturity diplomas awarded when graduating from music schools and the diploma awarded when graduating other art schools (Absolutorium) certify a Level 5 ISCED qualification.

The vocational tertiary education is provided by higher vocational schools (Vyšší odborné školy) offering a wide range of training programs lasting between 3 and 3.5 years, during which the students are trained for professions requiring technical competences that are compatible to maximum 3 years of vocational higher education in the EU states and which have this separate form of education (tertiary). This form of education is not officially states as part of the higher education. The average age for being admitted to these higher vocational schools is of 19 years. When the students graduate from this form of education they are awarded the specialist diploma – DiS (diplomovaný specialista), consistent with the educational level 5B ISCED, a diploma that does not provide however the access to a master’s course.

The higher academic education takes place in institutions homologous to the ones in Romania - universities (univerzita), academies (akademie) etc., offering bachelor’s programs (Bakalář), master’s programs (Magistr) and PhD programs (Doktor). The bachelor’s degree (Bakalář) is consistent with Level 6 EQF (European Qualification Framework), the master’s degrees or the engineer degrees (Magistr/Inženýr) are consistent with Level 7 EQF and the PhD degree is consistent with Level 8 EQF.

The titles awarded following the graduation from a higher education institution are being regulated in the Czech Republic in a way similar to the one in Romania, i.e.: - Bachelor’s Degrees – awarded after at least three or at the most four years of education (Bakalar, Bakalar umeni – in art) - Master’s Degrees – awarded after at least four but not more than six years of education in humanities, natural sciences, law, education and theology (Magistr, Magistr umeni – for art).

- In Czech Republic, the Engineer Title (inzenyr, abr: Ing.) is at the same level as the master’s degree. It is awarded in engineering, economy, forestry, agricultural machinery and military areas.

- Architect-Engineer Title (inzenyr arhitect, abbr: Ing.arch) – awarded in the architectural field.

- MD Titles (medic mediciny, abbr:. MUDr) and veterinary medicine doctor (Medic Veterinarni mediciny, abr MVDr) are titles obtained by the graduates of a medical, dental and veterinary education program without any prior PhD education.

After presenting a thesis, the graduates of master’s programs who have been awarded a master’s degree may achieve the following academic titles, the so-called "PhD low titles" or PhD academic degrees: "Doctor in law" (doctor prav, abbr: JUDr.), in humanities, education, social sciences, "Doctor of Philosophy" (doctor filozofie, cooling: PhD.), in sciences, "Doctor of Science" (doctor prirodnich ved, abbr: RNDr.), in pharmacy "Doctor of Pharmacy" (doktor farmacie, abbr: PharmDr.), in theology - "degree in theology" (Licentiate Theology, abbreviated to ThLic.) or "Doctor of Divinity" (doctor Theology, abbreviated to.

ThDr.) [3]. The academic PhD programs take place only in universities and last for 3-4 years, and when completing these studies the students are awarded the (Ph. D) or theology (Th. D) titles.

1.2 Adults’ education In June 2007, the Czech Government adopted the “National Strategy for Lifelong Learning”, a document referring both to the initial training and to the continuous training.

The strategy started from the continuous training SWOT analysis and established the main strategic objectives for the lifelong learning development as follows: recognition / permissiveness (including the recognition of the learning process results achieved during non-formal and informal contexts); equal access, functional alphabetization, adjustment of educational opportunities to the demand on the labour market; stimulation of training demand, assurance of education and training quality and development of information and counselling services. The strategy also involves the correlation between the strategic objectives and the priorities of the operational programs for use of European structural funds allotted to the Czech Republic for the period of time between 2007 and 2013. The Ministry of Education, Youth and Sport (MŠMT), together with other ministries, institutions and social partners, decided that the year 2015 would be the year when the “National Strategy for Lifelong Learning” is going to be implemented. The national strategy implementation plan includes the following actions [4]: - for the superior secondary education – supporting the curriculum reform for increasing the students’ education level, minimizing the unequal chances for access to education, providing support for the assurance of transferability between various training programs and of the links to the continuous training, facilitating transaction from school when getting a job on the labour market; - for the tertiary education – the development of practice-oriented bachelor’s programs in collaboration with the employers, providing support for the use of programs allowing the adults to learn while working and fulfilling their obligations towards their families, removal of obstacles adults face when trying to have access to the vocational tertiary and academic education, increasing the quality of the higher education institutions’ activity, increasing the level of transferability within the tertiary education (mainly between the tertiary vocational schools and the higher education institutions); - for the continuous training (CT) – increasing the level of involvement from the continuous training institutions and supporting the investments into the CT, providing 12

support for the recognition of various directions for achieving qualifications, creating conditions for the permanent adjustment of training programs to the labour market needs, developing CT according to the citizens’ needs and providing their accessibility, improving the occupational standards of training service providers inside enterprises, developing an effective information and counselling system.

1.2.1 Activity legal framework Regarding the continuous education in the Czech Republic, at the moment there are institutions providing courses for adults but this activity is not being regulated by a special act.

The financing of the continuous education varies, meaning that both the public and the private schools (except for universities) receive subventions from the state. In terms of education continuation, the state largely finances re-qualifications and also the education provided to the state officials. According to a study conducted by the Ministry of Education, the adults’ education has been financed as follows: 45% by the students, 13% by the labour offices, 33% by companies and institutions, and the remaining percentage was covered by other financing forms. The main legislative landmarks applicable to the continuous education are: - Act no. 179/2006 regarding the verification and recognition of the forms of continuous education; it is the document regulating the methodology used for the verification and recognition of competences and knowledge achieved by study or at work. This act fully provides a new perspective on the professions, which are divided into the so-called “qualifications” and “partial qualifications”. The act allows people to obtain a recognition certificate covering a certain partial qualification based on the assessment of their knowledge and competences. The re-qualifications are focused both on the unemployed and on the employees so that these groups may either find a job or keep their current position.

- Act no. 435/2004 on the regulation of work relations. The Ministry of Labour and Social Affairs (MEAS) has to assess under this act the continuous education service providers for the accreditation of the educational institutions and of the 1st education programs. The

conditions under which the education service providers receive the accreditation are regulated by the Order No. 524/2004 issued by the MEAS Minister.

- The 2004 concept of restructuring higher education (re-updated in 2005). The main goals of the higher education reform have been: the completion and assessment of the transition towards the Bologna structure with the separation of the three higher education modules (bachelor, master, PhD), supporting the non-university higher education institutions and their assessment for increasing their visibility, development and scientific research and also their contribution to the continua learning programs.

1.2.2 Five priorities on the adults’ education in the Czech Republic a) Analysis of the effects generated by the reform in the adults’ education sectors [4] The low level of people’s participation in the continuous education involves a slow increase in the provision of educational activities and it is believed to be the result of a low level of motivation in attending the continuous education both on the employees’ part and on the employers’ part as well and also a relatively low contribution of the education level in the society.

The Government has used European funds for regulating the institutional framework and various successes occurred: the referencing of the Qualification National Framework; the development of a new law on the recognition of the continuous education results (Act no.

179/2006), allowing the adults to renew their skills and competences by non-formal education and learning. b) Implementation of quality management systems in the continuous training [4] For the continuous training to become professional and institutionalized it is extremely important to approach the assessment of the adults’ education system through the quality assurance segment. At the moment, only the bachelor’s programs are assessed as far as the compliance with a quality system is concerned.

The Czech Republic is at the beginning of the phase involving the implementation of the quality assessment and quality standard development systems for the institutions providing continuous training programs.

c) Assessment of accessibility obtaining a higher qualification with at least one level [4] At the moment the preparations for the projects designed to develop the key competences of the adult Czech population have started. These preparations are focused on: the transformation of certain schools into continuous training centres (for adults with low skills or unemployed), the supporting of disadvantaged citizens’ education (for providing financial incentives for the economic and social supporting of disadvantaged people). The flexible and customized learning ways in the Czech Republic have been developed by the legislation mentioned above, which was adopted in 2006, which allows the achievement of “partial qualifications” for the professions that can be used as actual qualifications on the labour market.

For promoting the development of the key competences among the migrant / bilingual adults who are granted asylum or who benefit from complementary protection, the Ministry of Education, Youth and Sport coordinates an integration program offering even free of charge courses in Czech. d) Assessment and recognition of non-formal and informal learning [4] Based on the common principles adopted in 2004 by the EU Member States, the Czech Republic has implemented since 2007 a legal framework for the creation of the non-formal and informal learning validation system. The legislation generated a uniform, transparent and objective way of validation for the recognition of the skills and competences achieved in nonformal and informal contexts. The qualifications have been levelled according to the National Qualifications Framework in the Czech Republic.

As the staff training differs from one EU country to another, in the Czech Republic there are no special requirements for the education or training of the staff providing validation of non-formal and informal learning.

The verification and recognition processes are provided by “authorized persons” who are authorized to verify – through the methods defined by the qualification relevant assessment standards – whether or not a candidate has the professional competences necessary for him/her to practice the qualification he/she wanted to be examined for.

e) Improvement of the adults’ education sector monitoring [4] Based on the success of the primary education, which is an educational process considered to be monitored in a satisfying way, it has been found that the continuous training shall need to be monitored in the future so that the necessary improvement options would be available for this process.

1.3 Assessment and certification of professional qualifications achieved in informal and non-formal contexts 1.3.1 National Institutional Framework

The institutional framework for the certification of non-formal and informal learning in the Czech Republic is focused on the processes explained in Table 1 [5].

For the validation and certification of the informal and non-formal learning for the partial or complete qualifications, several categories of duties are found in the Czech Republic and they are divided into levels.

At national level: - the harmonization of the national legislative framework; - the elaboration of the qualification standards (including the assessment criteria and methods – i.e.: oral presentation, case study, hands-on demonstration, etc.); - the issue / cancellation of the license for the assessment and certification of authorized persons / institutions; At regional level: - the regional authorities have not been granted yet a clear duty specifically related to the verification of the legislation in the informal and non-formal learning assessment and certificate fields; however, they have significant competences in related fields such as – to reupdate the European inventory for the "Validation of the country report for non-formal and informal learning in the Czech Republic";

- the regions are in charge with the education and training infrastructure (they decide on the number of schools, the qualifications granted, etc.); - the regions may offer incentives to the schools involved in lifelong learning activities (including certification); - at the moment there is a national project designed to develop the regional networks of vocations and training schools so that they are more capable of providing continuous training, guidance and recognition of education achieved by adults in non-formal or informal contexts.

Among others, the project provides training courses for the schools’ staff members and they are trained to use the qualification and assessment standards for the certification of adults’ learning in non-formal or informal contexts (such as for the development of adult education programs). The regions select the VET schools that would be part of the project outside the areas with demographical needs. In a similar way, courses have been organized in Romania for competence assessors and trainers.

At institutional level: - the receipt of the recognition applications from trainees, the development and communication of the assessment procedure and of the assessment itself; - the actual assessment and the certification decision; - the issue of the certificate.

1.4 The Czech National Qualifications Framework compared to the European Qualification Framework At the moment three qualification sub-systems are implemented in the Czech Republic and they are interconnected and provide a limited rate of transfer, because all the descriptors refer to the results of the learning process. Compared to the Czech Republic, Romania is undergoing a qualification referencing process.

At this moment (March 2013) we believe that this process ended only in the higher education area and the National Authority for Qualifications (NAQ) established the National Register for Higher Education (RNCIS).

Therefore, through the National Education Act no. 1/2011[8], the referencing of the higher education in Romania at the European Qualification Framework (EQF) has been done as follows: the academic bachelor studies are consistent with a number of transferable study credits (ECTS = European Credit Transfer and Accumulation System) between 180 and 240 and are completed at Level 6 in EQF; the academic master studies cover the 2nd academic study cycle and are completed at Level 7 in EQF – they usually last for 1-2 years and are consistent with a number of transferable study credits between 60 and 120; the academic doctoral studies represent the 3rd academic study cycle and allow the attainment of a 21

qualification at Level 8 according to EQF – they are provided based on the academic doctoral study code [8].Regarding the level of the pre-academic education qualifications, they are pending referencing at the European Qualification Framework, and at this moment they are classified into four classes:  Level 1 (attained only before 2010 through the arts and crafts schools – worker in the field), 

Level 2 (attained following the graduation from the vocational school),



Level 3 (following the graduation from high-school),



Advanced Level 3 (attained following the graduation from a post-secondary school) [9].

2. Professional qualification recognition process in the Czech Republic 2.1 The legal and institutional framework for the recognition of qualifications achieved in other Member States of the European Union, of the European Economic Area and of the Swiss Confederation The recognition of the professional qualifications and the list of the necessary documents are being regulated in the Czech Republic by Act no. 18/2004. Just as in Romania, in the Czech Republic there is an information centre for information on the recognition of professional qualifications – the Professional Qualifications Recognition Centre similar to the National Centre for Recognition and Equivalence of Diplomas in Romania [10].

The Centre provides information on the recognition of professional qualifications and on the regulations applicable in the Czech Republic based on Directive 2005/36/CE. The Centre coordinates the activities of the recognition authorities and represents the Czech Republic at the European Commission. The Centre contact details are: the Ministry of Education, Youth and Sport, the Professional Qualifications Recognition Centre, the Department for “Adults’ Education”, Karmelitská 7, 118 12 Praga 1, tel.: + 420 257 19 33 76, e-mail: qualifications@msmt.cz, web: www.msmt.cz. The Centre manages the databases including the regulated and non-regulated professions in the Czech Republic. For each profession there are qualification requirements, specific recognition commissions and legal regulations applicable to that profession in the Czech Republic. The database specific to the type of profession also includes information on the recognition procedure (fig. 3) [6] and the application form for the recognition of a professional qualification [7] (translated in Annex 1). In the case of the regulated professions, the contact point may rather be the Ministry of Industry and Commerce due to the fact that it is relevant by the highest number of regulated professions under its supervision. Commerce are: Na Františku 32, 110 15 Praha 1, Tel.: + 420224851111, Fax: + 420224811089, E-mail: posta@mpo.cz, web: www.mpo.cz Just as in Romania the regulated professions are recognized only by the relevant competent authorities3 through the submission of an application accompanied by the related documents: the application form in Czech, the personal identification, a document certifying the candidate’s nationality, the proof of his/her formal qualifications and the receipt confirming the payment of the administrative fee amounting CZK 2000 [6].

The recognition authority shall examine whether or not the application and the attached documents include the necessary information for the qualifications to be attested and for a decision to be made. If necessary, the competent authority shall ask the candidate for additional information. After the qualification recognition commission receives the file, it is obligated – according to Article 24, paragraph 5 in Act no. 18/2004 – to make a decision within maximum 60 days. In the complex cases, the authority may exceed this timeframe but it is still obligated to make a decision within maximum 90 days [3].

Following the examination of the application filed by the candidate, the competent authority has to make a decision pursuant to one of the following circumstances: - the professional qualification is recognized, or - it informs the national on the compensatory actions either as a probation stage or as a skills test to be taken by the candidate, or - the application for the professional qualification recognition is rejected.

The recognition commission takes compensatory actions only if there are substantial differences between the application’s certified competences and the ones required for the practicing of the profession in the Czech Republic.

During the probation stage, the candidate provides regular services under a professionally competent person’s supervision. Another training stage might be included in this period. The duration of the adjustment period cannot exceed 3 years.

The skills test usually consists in a written test and an oral test. It is usually taken in Czech before a recognition commission that is representative for the respective qualification, a university or another institution taking into account the national’s specialization. The 3

examination is meant to establish whether or not the candidate has the knowledge and competences necessary for the practicing of the profession and which have not been included in the candidate’s previous training (the examination costs CZK 5000 at the most). The decisions made by the recognition authority commissions may be challenged within maximum 15 days since being communicated. Moreover, the inconsistent decisions may be challenged in court through a civil action (Article 72 and Article 247 in Act no. 150/2002) within maximum 2 months since the referral of the decision to the file assessment commission.

The NARIC CZ Centre, a member in the UE ENIC network since 1997, provides information on the higher education qualifications in the Czech Republic and the EU countries, facilitating this way even the recognition of the professional qualifications attained by the Czech citizens having left the country to work abroad. Moreover, the National Institute for Technical and Vocational Education and Training (NUOV) is a consultancy centre for elementary or higher education qualifications. Upon the request received from the competent authorities, NUOV provides expertise on the level of education attained by a national or the contents and scope of his/her education for the requested qualification, so that there is no doubt that the national has the competences required for him/her to practice the regulated profession in the Czech Republic. NUOV cooperates with similar institutions abroad.

2.3 IMI PQ statistics on regulated professions registered in the Czech system compared to the same system in Romania According to the data posted on the website put at our disposal by the European Commission [13], following the accession of Romania to the European Union (January 01st, 2007 – 2012) the applications on recognition of qualifications have fluctuated, Figure 4 - (718 in 212, 4059 in 2011, 5489 in 2010, 4411 in 2009, 4933 in 2008 and 2048 in 2007 respectively).

The total number of applications for qualification recognition has been – over the period of 5 years following the accession of Romania to the EU – of 21658, the top of the professions and host countries being shown in Figures 5 and 6 and the country report in Table 5.

Regarding the use of the IMI platform, in order to receive information on the regulated professions in the year 2012, the European Commission published the following data [14]: For the recognition of professional qualifications: - number of applications sent Romania 33 1.1% of the total number, the Czech Republic 27 0.9% of the total number of applications at EU level; - number of applications received in Romania 470 15.2% of the total number, the Czech Republic 85 2.7% of the total number of applications at EU level;

CONCLUSIONS The statistics demonstrate that the Czech Republic has not been one of the Romanians’ favourite country for relocating for a job, which could be explained by the fact that in order to have the right to work and to live in that country they have to be granted a blue card (given them access to a vacant workplace) or at least a work permit.

The written data may indicate that both for the education system and for the qualification system there is no room for interpretation and they very accurately establish the level of education, qualification and equivalence for qualifications at EU level.

The determination of the correspondence between the regulated professions in the Czech Republic that have not been correlated (Table 4) with the occupations in Romania provides the proper tool for the recognition between similar qualifications in compliance with the regulations laid down in Directive 36/2005.

The evidence of the professional qualifications and of other competences has to be translated into Czech if they are not issued in the Czech Republic or if the international treaty ratified by the Czech Republic does not stipulate other conditions.

The evidence for the other attached competences cannot be older than 3 months, except for those certifying the effectiveness of financial management.

According to the current legislation, i.e. Act No. 634/2004 Coll., in the Tax administration, an administrative fee of CZK 2000 is collected for the recognition of the professional qualifications. If there is another recognition authority, e.g. the professional chamber, an internal regulation of this chamber shall establish the value of this fee.
