IIT Chicago-Kent welcomes the Oyez Project Law school is new headquarters for multimedia archive of U.S. Supreme Court cases

A vast and widely utilized multimedia archive devoted to the Supreme Court of the United States and its work has made its new home at IIT Chicago-Kent.

The Oyez Project (www.oyez.org), recently enhanced by the new OyezToday app, aims to be a complete and authoritative source for all audio recorded in the Court since the installation of a recording system in October 1955.

The site’s archive of digitized arguments enables users to search for key terms relevant to their research.

A search for a particular term, such as “strict scrutiny” or “substantive due process,” yields a list of snippets from case transcripts that link to the corresponding audio.

Founded and directed by political scientist Jerry Goldman, the site also provides written summaries of Supreme Court cases and holdings, detailed biographies and voting records of Supreme Court justices, links to written opinions, and a virtual tour of the Supreme Court building.

“No other site boasts such functionality,” said Dean Harold Krent.

“With the Oyez Project, Chicago-Kent leverages the power of the Internet to deliver a unique legal resource to students, scholars, lawyers, jurists, legislators, teachers and countless others who are interested in the dynamics of the U.S. Supreme Court.”

In the last 12 months, Oyez has been visited nearly 7 million times by 3.6 million unique visitors who accessed 26 million page-views of content and downloaded more than 10 terabytes

of data. The average user spent nearly six minutes on the site.

The new app OyezToday, established in March to complement the website, allows users to access oral arguments, transcripts and opinions on their smart phones shortly after their release. They can search key segments or share their impressions on Facebook or Twitter.

Three alumni named ISBA Laureates Three IIT Chicago-Kent alumni are among seven Illinois attorneys named as 2011 Laureates of the Illinois State Bar Association’s Academy of Illinois Lawyers. Inducted into the academy in April were alumni Peter J. Birnbaum ’83, president of Attorneys’ Title Guaranty Fund Inc. in Chicago; William V. Johnson ’66, president of Johnson & Bell Ltd. in Chicago; and John B. Kincaid ’63, partner in Mirabella, Kincaid, Frederick & Mirabella LLC in Wheaton, IL. The Academy of Illinois Lawyers was founded in 1999 “to enhance the honor and dignity of the state bar by recognizing attorneys who personify the greatness of the legal profession.” The Laureates Award is the highest honor bestowed by the Academy. Selected by the Board of Regents from submitted nominations, Laureates are required to have demonstrated a commitment to “the highest principles of the legal profession and to serving the public.”

Student windfall on “Wheel of Fortune” Jaclyn Hilderbrand ’11 put her quick wits to the test last fall as a contestant on “Wheel of Fortune,” winning a trip for two to Bali and walking away from the bonus round with $35,000. To get on the show, she powered through three rounds of auditions, including a speed round with 16 word puzzles. She plans to use her winnings to help pay off student loans and to start a college fund for her baby nephew.

A sneak preview for 23 undergrads For the 10th consecutive year, IIT Chicago-Kent welcomed a diverse group of college students to its Pre-Law Undergraduate Scholars (PLUS) Program.

Twenty-three freshmen, sophomores and juniors from 21 schools attended this year’s four-week summer session, designed to familiarize students with the law school experience and the legal profession and to help them prepare for the law school admissions process.

Professor Ron Staudt leads winning team in “Future Ed” competition “Apps for Justice: Learning Law by Creating Software,” an innovative legal education concept developed by Professor Ronald W. Staudt and a team of educators and entrepreneurs, took first place honors in a recent national contest focusing on the future of law schools.

Apps for Justice (A4J) was created as part of a yearlong “Future Ed” contest co-sponsored by New York Law School and Harvard Law School that sought innovative ideas to expand the scope of legal education, improve quality and reduce costs. Contestants were challenged to develop “operational alternatives to the traditional law school business model and to identify concrete steps for the implementation of new designs.”

The Apps for Justice concept proposes courses that engage students in creating software applications that can run the gamut from helping practitioners “work smarter” to empowering pro se litigants and others to address their own problems and opportunities.

Combined with courses in legal doctrine, ethics, history and theory, Professor Staudt says the program can also help prepare students for the economic and technological realities of practicing law as well as advance access to justice and the rule of law for others.

“Our core idea was to use law school clinics as laboratories to build A2J Author Guided Interviews for low-income people,”

said Professor Staudt. “It’s a win-win: Students learn newage core skills, and low-income people get better access to justice. We had great partners, including Marc Lauritsen from Capstone Practice Systems, Brian Donnelly from Columbia, Professor Ronald W. Staudt Larry Farmer from Brigham Young, and John Mayer from CALI.” John Mayer and his CALI team wrote the A2J Author software that makes the A4J course possible.

“Now comes the hard work of raising real money to deliver Apps for Justice clinics at law schools other than Chicago-Kent and our few partners in this proposal,” said Professor Staudt.

The Center for Access to Justice & Technology (CAJT) was established at IIT Chicago-Kent to make justice more accessible to the public by promoting the use of the Internet in the teaching, practice and public access to the law. The center conducts research, builds software tools, teaches classes, and supports faculty, staff and student projects on access to justice and technology. In 2008, the CAJT received the Louis M. Brown Award for Legal Access from the American Bar Association’s Standing Committee on the Delivery of Legal Services.

Joseph Carlasare wins 19th annual Rovner Competition Tournament centers on First Amendment case IIT Chicago-Kent student Joseph P. Carlasare ’12 is the winner of the 19th annual Ilana Diamond Rovner Appellate Advocacy Competition, sponsored by the law school’s Moot Court Honor Society. The competition is named for ChicagoKent graduate Ilana Diamond Rovner ’66, judge of the U.S. Court of Appeals for the Seventh Circuit.

This year, students argued Schwarzenegger v. Entertainment Merchants Association (now Brown v. Entertainment Merchants Association), a recent case before the U.S. Supreme Court. At issue was whether a state law restricting the sale of violent video games to minors infringes on the First Amendment right to free speech.

Mr. Carlasare received the Ilana Diamond Rovner Award for Outstanding Appellate Advocate and a $750 scholarship. Secondplace winner David Jorgensen ’12 received a $375 scholarship from the Edmund G. Burke Scholarship Fund.

Mr. Carlasare is a member of the Moot Court Honor Society and the Trial Advocacy team. As a member of the Chicago-Kent team that won the National Institute for Trial Advocacy’s 2010 Tournament of Champions, Mr. Carlasare won individual honors as the tournament’s best advocate. He graduated magna cum laude with a bachelor’s degree in political science and philosophy from Loyola University Chicago.

Student Margot Nikitas ’12 received the Fay Clayton Award for Outstanding Oralist and a $375 scholarship. Student Justin Hagan ’12 received the Ralph L. Brill Award for Best Brief and a $375 scholarship.

On June 27, the Court decided the Brown case, ruling 7-2 that the law violates the First Amendment and that the California state legislature was mistaken in its attempt to “create a wholly new category of content-based regulation that is permissible only for speech directed at children.”

Faculty and students champion childhood diabetes legislation Civil rights award for IIT Chicago-Kent student organizations A multiethnic coalition of four IIT Chicago-Kent student organizations has received the 2011 Sheldon H. Nahmod IIT Civil Rights Award for “continuing and selfless dedication to those in need in their communities and beyond.”

The award was presented to representatives from Chicago-Kent’s African-American (BLSA), HispanicLatino (HLLSA), Asian-Pacific American (APALSA) and South Asian (SALSA) law student associations on January 20 as part of the university’s King Day celebration.

The award was established in 2010

by IIT’s Student Center for Diversity and Inclusion to honor Chicago-Kent Distinguished Professor Sheldon H. Nahmod for his work in civil rights and civil liberties. The award recognizes the contributions and achievements of high school and college students in the Chicago area who work to fight prejudice, oppression and ignorance.

IIT Chicago-Kent faculty and students played an integral role in securing recent passage of the Care of Students with Diabetes Act. The Illinois law, which took effect December 1, clarifies the rights and responsibilities of students, parents, and school and health care personnel relating to students with diabetes who need assistance with care during the school day and at school-sponsored activities.

A chronic health condition, diabetes must be managed 24 hours a day. However, due to the dearth of nurses in Illinois schools, many children were unable to get the diabetes care they needed.

Under the provisions of the new law, volunteer, non-nurse school employees may now help students manage their diabetes during the school day. The law also ensures that someone will be present at all times to administer insulin and the life-saving medication glucagon.

In addition, the law makes it easier for Illinois schools to comply with federal anti-discrimination and disability laws, such as the Americans with Disabilities Act and §504 of the Rehabilitation Act of 1973.

Chicago-Kent students worked with Distinguished Professor Lori B. Andrews to analyze the laws in other states in order to craft a comprehensive approach for the Illinois law. Clinical Professor Edward Kraus, Professor Andrews, and law students joined existing efforts by partnering with Illinois families, diabetes advocate Suzanne Elder and the American Diabetes Association.

Faculty and students helped draft the legislation that was introduced in the Illinois General Assembly in March 2010. They also worked to educate Illinois legislators and citizens about the need for a law to protect the rights of children with diabetes.

“The Diabetes Care Act would not have been possible without the strong, bipartisan leadership of Rep. Tom Cross (R-Oswego) and Sen. Heather Steans (D-Chicago),” said Professor Andrews.

The Care Act prohibits school districts from denying access or restricting the assignments of students with diabetes. The new law also allows for designated staff to assist students with diabetes and provides training and legal protections for school personnel. In addition, the new law requires that information sheets be provided for personnel who transport students for school-related programs and activities and specifies what students with diabetes must be permitted to do to care for their health while in school.

The need for the Care of Students with Diabetes Act became apparent soon after the Law Offices at Chicago-Kent began advocating for individual families and negotiating accommodations with various school districts. Professor Edward Kraus and Legal Fellow Sarah Blenner ’11 continue to provide pro bono legal services on behalf of children who face health risks at school when their legal rights are not recognized and to ensure proper implementation of the Care of Students with Diabetes Act. “Illinois students with diabetes and their parents can now breathe a sigh of relief,” said Professor Kraus. “The Care of Students with Diabetes Act ensures that the growing number of children with diabetes enrolled in Illinois schools get the care that they need to attend school safely.”

Another championship season for powerhouse Trial Ad Program Once again, IIT Chicago-Kent’s Trial Advocacy Program, ranked fourth in the nation by U.S. News & World Report, brought home a wide array of first-place victories, top placements, and distinguished individual honors from tournaments across the nation.

In 2010-11, Chicago-Kent took first place honors in the NITA Tournament of Champions and second place in the Buffalo-Niagara National Mock Trial Competition, with individual Chicago-Kent students winning both competitions’ Best Oral Advocate awards.

A Chicago-Kent student also won the National Best Advocate Award in the 2011 National Trial Competition after he and his teammate finished second in the nation in a closely contested final match. This year marked the 24th time in the past 30 years that Chicago-Kent has reached the final rounds of this highly competitive tournament.

“Few if any programs in the nation can match the talent, energy and know-how of our trial ad competitors, teachers and coaches,” said Dean Krent. “This program helps make Chicago-Kent an outstanding training ground for future trial lawyers.”

Ilana Two Diamond HarvardRovner Law profs Appellate win Advocacy competitors IIT Chicago-Kent argue violent College video of games case Law/Roy C. Palmer Civil Liberties Prize Laws, Outlaws, and Terrorists: Lessons from the War on Terrorism, by Harvard Law School Professors Gabriella Blum and Philip B. Heymann, has won the 2010 IIT Chicago-Kent College of Law/Roy C. Palmer Civil Liberties Prize.

The prize was established in 2007 by Chicago-Kent alumnus Roy C. Palmer and his wife, Susan M. Palmer, to honor an exemplary work of scholarship exploring the tension between civil liberties and national security in contemporary American society.

Professors Blum and Heymann, whose book was published in September 2010

by The MIT Press, will present their work at Chicago-Kent in August.

In Laws, Outlaws, and Terrorists, Professors Blum and Heymann reject the argument that traditional American values embodied in domestic and international law can be ignored in any sustainable effort to keep the United States safe from terrorism. They argue that the costs are great and the benefits slight from separating security and the rule of law.

Gabriella Blum has been a member of the Harvard Law School faculty since 2007. Her scholarly interests include conflict management, counterterrorism operations, laws of armed conflict, negotiation and public international law. Before joining Harvard, she was a member of the Israeli Defense Forces, where she served in the International Law Department of the Military Advocate General’s Corps.

Philip B. Heymann currently is the James Barr Ames Professor of Law at Harvard Law School. He headed the Justice Department’s criminal division during the Carter administration and was deputy attorney general during the Clinton administration. His scholarly interests include political violence and terrorism and comparative criminal law.

Benefactor Roy Palmer, a lawyer and real estate developer, is a 1962 honors graduate of Chicago-Kent and a member of its board of

overseers. He and his wife, Susan, are active in numerous civic, social and philanthropic organizations and are the recipients of the 1997 Outstanding Individual Philanthropist Award of the National Society of Fundraising Executives.

The $10,000 IIT Chicago-Kent College of Law/Roy C. Palmer Civil Liberties Prize is designed to encourage and reward public debate among scholars on current issues affecting the rights of individuals and the responsibilities of governments throughout the world.

Previous prize recipients include constitutional scholars David D. Cole and Jules L. Lobel for their book Less Safe, Less Free: Why America Is Losing the War on Terror (The New Press); Harold H. Bruff for Bad Advice: The President’s Lawyers in the War on Terrorism (University Press of Kansas); and Scott M. Matheson, Jr., for Presidential Constitutionalism in Perilous Times (Harvard University Press).

MARC KORMAN ’89 WILLIAM MORRIS ENDEAVOR, BEVERLY HILLS, CALIF.

Marc Korman ’89 took the long road to becoming an agent for William Morris Endeavor. When he started at IIT Chicago-Kent, he never intended to practice law. At the end of his second year, he took a trial class and fell in love.

“I thought I might as well be a lawyer, and I might as well be the kind you see on TV,” he says.

So he did an externship with the Cook County Public Defender’s Office and became a public defender for his first four years after graduation.

“It was a great foundational experience to become a trial lawyer,” he says. Having built that foundation, he joined the law office of Pat Boyle and Associates, which focused on class action suits, eventually opening his own practice within the confines of Boyle’s office.

“I was doing anything that came in the door,” he recalls, “I was pretty good at it, but civil litigation I found incredibly boring. It made me remember why I didn’t want to be a lawyer. Here I was seven and a half years later doing exactly what I said I didn’t want to do.”

So, in 1996, he moved to Los Angeles.

Before he left, a woman from Boyle’s office told him about business affairs jobs.

The networks, studios and producers all used them to negotiate deals. She gave him the name of her old roommate, Nancy Tellem, who was head of business affairs for Warner Bros. Television and who later became president of CBS. Tellem gave him three names, each of which led to three more, and he eventually landed a job with ABC.

Shortly after he started, the Federal Communications Commission relaxed its restrictions and allowed networks to own their programming. They also allowed studios to own networks.

“The entire landscape changed dramatically.” Having learned how television traditionally operated, he was now on the ground floor as the business was transformed. “That has been invaluable to me,” he says.

His boss one day mentioned that he would have become an agent if he had it to do over again. “He was very good at negotiating, but not very good at papering the deal, which was similar to me.”

So Marc decided to become an agent.

Easier said than done.

“I went to all the agencies and offered to work for free,” he recalls. “They all said no.” He talked to a former public defender-turned-agent who told him to go back into business affairs and learn how to make deals. That, he said, would be attractive to agencies since a lot of agents don’t know how.

He got a business affairs job with Artists Television Group (ATG), an offshoot of a management company run by Michael Ovitz, who started Creative Artists Agency (CAA). In addition to business affairs, he explored the management side of the business and finally approached Ovitz about working as an agent. Again he offered to work for free.

Finally, he started getting job offers from other agencies. After working six years for United Talent Agency, where he was a partner, he moved to Endeavor, run by Ari Emanuel, which eventually merged with William Morris.

“ The most fun is when a writer comes into my office with an idea.”

As a partner at William Morris Endeavor, he represents writer/director/producer Brad Falchuk, one of the creators of Glee; Kevin Williamson, creator of the Vampire Diaries; as well as the executive producers of CSI, Smallville, Lost, 24 and Heroes. He works with directors Baz Luhrmann, Steven Spielberg and Robert Rodriguez on their television projects.

But his favorite clients are young writers.

He enjoys helping them get established.

“You stay with a client, you help to build their career, then you try to make the best possible deal you can.

“The most fun is when a writer comes into my office with an idea. You shape that idea into something you can sell, then you sell it and watch it get made and put on the air. To watch that from beginning to end is a pretty neat experience.”

“He was the only one who said OK,” Marc says. “I didn’t work free, but I worked cheap.”

NANCY RODRIGUEZ ’94 WALT DISNEY STUDIOS HOME ENTERTAINMENT, BURBANK, CALIF.

“I always pictured myself in the entertainment industry,” says Nancy Rodriguez ’94, senior counsel at Walt Disney Studios Home Entertainment. “In eighth grade, I wanted to be an attorney for a rock band.

By ninth grade, I realized I should probably look at my secondary interest, which was international relations.”

The latter led her eventually to IIT Chicago-Kent, where she earned a certificate in International and Comparative Law. Her favorite classes were Intellectual Property, Negotiations and International Law. “I loved being in Chicago,” says the Oregon native. “I did my homework at the Art Institute. I listened to bands in Wicker Park, and I spent a lot of time in ChicagoKent’s forward-thinking computer lab, playing video games like Doom and Tetris.”

Oddly, she says, “those were the core experiences that shaped my practice over the next 17 years.”

Moving back to Portland after graduation, Nancy became familiar with the local artists, gallery owners and musicians, and she read “every book I could find on the entertainment industry.”

“To get experience,” she says, “I would find local artists and musicians who were working on fantastic projects and work with them pro bono. It’s really hard to break into the entertainment industry without experience and connections.”

She moved to Seattle and landed a job with Miramar Productions, a record label that also handled video production and distribution. She did music licensing, copyright and trademark work. Hired by Vivendi Games to be in-house counsel for one of their subsidiaries, Sierra On-Line,

Nancy worked on computer game development and video game publishing, developed technology agreements, and did a lot of marketing and product review.

There weren’t many women in the video game industry at that point, she says, joking that her hours in the Chicago-Kent computer lab helped her land the job.

“My sick gaming skills certainly made me stand out.”

The company transferred her to Los Angeles to work with other subsidiary game companies like Universal Interactive and Blizzard Entertainment. The latter publishes World of Warcraft, a massively multiplayer online game. She worked on licensing distribution rights in China.

“The deal was very complex and very interesting,” she recalls. “There were a lot of international aspects to the licensing issues and to the business relationship that tied back to some of the international work I’d done at Chicago-Kent.”

Next, she was hired as a business development attorney at ABC, owned by Disney Studios, where she worked on digital product development and digital distribution for ABC shows. Now she works with the Disney 3-D Home Entertainment Group, which meets quarterly with 19 other companies from all over the world to push forward Blu-ray 3-D innovation and technology.

The most challenging part of doing legal work in the entertainment industry, she says, is the fact that “the quantity of transistors that fit on an integrated circuit doubles every two years.” That means computing hardware improves at an exponential rate.

“Not only can we put content in front of consumers in new ways and on new platforms every day, but consumers are getting much more technically savvy,” she says.

“It’s a true challenge to compete daily with piracy. As attorneys, we have to be agile to respond to the piracy threats and to explore the countless new opportunities.

There’s a real push to embrace change in the entertainment industry at this point.

It’s moving very, very fast. The newer the gadget, the faster you have to work.”

Nancy says she loves working for Disney.

“I get to see what’s coming next in 3-D technology before anybody else, and I get to influence how home entertainment is developing. It’s been really rewarding.”

“They all have markedly different interests and agendas and negotiation styles,” she says. “We deal with a lot of IP, antitrust, technology and marketing issues.” What she learned in her Negotiations class often comes into play. “Chicago-Kent really taught me how to balance people’s interests—a lot of good problem-solving techniques.”

“There’s a mystique about being an entertainment attorney,” says Symeon Davis ’97, a partner with Hobson Dungog Bernardino + Davis LLP in Los Angeles.

“But most entertainment attorneys will tell you we’re doing many of the same things the real estate attorney is doing: We’re at our desks, negotiating on the phone, drafting agreements and advocating on behalf of clients who want to do deals.”

A former musician himself (trumpet), Symeon, who earned his AB at Princeton, managed a singer-songwriter before attending IIT Chicago-Kent and planned to become an entertainment attorney all along. “It was a way to combine my analytical skills with my artistic side so I could stay in touch with both.”

“ I’m excited about my clients,” he says. “They’re pretty spectacular and have a real chance of going all the way.”

But he quickly discovered that “it’s tough to be a working entertainment attorney in Chicago if that’s all you do,” he says. “The deals typically bounce out to the East and West coasts.”

He wanted to stay in Chicago, and he did a good number of music and television deals but increasingly worked on commercial real estate deals and found they were surprisingly similar.

“You’re still negotiating over property,” he says. “One is real and one is intellectual.

A lot of my skills were transferrable.”

But the real joy for him is “representing the ‘creatives’ in this business—artists, producers, on-air talent and directors in music, film and television against studios, networks and large companies.”

He currently represents a stable of singers, songwriters, actors and producers.

“I’m excited about my clients,” he says.

“They’re pretty spectacular and have a real chance of going all the way.”

Since moving to Los Angeles with his wife in 2007, his practice has flipped from 60 percent real estate and 40 percent entertainment to 85 percent entertainment and 15 percent real estate.

Symeon recently negotiated a number of music licensing deals for his client Robin, who has had three consecutive Billboard-charting dance hits. He also handles many of the merchandising and licensing deals for his firm’s client Manny “Pac Man” Pacquiao, a 10-time world champion boxer and congressman in the Philippines.

He also just secured a management deal for Isaiah Pittman V (Ip5), a young singer/ dancer/actor from the Chicago area with a “mega-manager” who represents the likes of Justin Timberlake, the Jonas Brothers and Ciara, and who managed Britney Spears, Janet Jackson, *NSYNC and other big acts.

“He now has a really great management agreement with a world-class manager,” Symeon says. “The most exciting thing for me is representing a client who thinks he doesn’t have much bargaining power against Viacom, Sony, Universal or another big company and then negotiating a deal with them that really pushes the needle in my client’s favor.”

To be an effective negotiator, he says, you have to know the law and have command of your facts and issues, but you also need to focus on style. “Anyone who is not high on style points is at a disadvantage in the entertainment business,” he says.

When he was at Chicago-Kent, all indications were that he would end up as a litigator, but he became more and more curious about the transactional side. “I wanted to be in a win-win situation,” he says, “instead of a zero-sum situation where there’s a winner and a loser.”

Chicago-Kent’s “rigorous legal writing program” prepared him well for the “tough work of both technical writing for contracts and writing that’s persuasive and effective at winning your negotiation points.”

That has come in handy over the last year as he has been representing a film production company in its efforts to acquire the rights to the last film shot by an iconic world-renowned director who died before it was finished. The film has been sitting in a vault for over 30 years,

and though many companies have tried, no one has been able to secure the rights to finish it.

“The process of negotiating with rightsholders all over the world has been very involved,” he says. “From a legal perspective, it’s been fascinating, challenging and rewarding.”

His advice to young lawyers is the same advice he received from a mentor while attending Chicago-Kent: “Pick a practice area that you’re passionate about, because being a lawyer is difficult. Being a great lawyer requires even more effort, so you’d better be in a practice area that you love.”

SANDRA CHEN ’94 UNIVERSAL ORLANDO RESORT, ORLANDO, FLA.

Sandra Chen ’94, director of legal affairs and sales and marketing counsel at Universal Orlando Resort, had experience in intellectual property law before she attended IIT Chicago-Kent.

“I was a legal assistant in a California patent and trademark firm,” she explains.

“I got to see a lot of patent prosecution, a lot of trademark litigation.”

But what brought her to law school was more personal.

“I had several friends who were involved in domestic violence situations,” she says, “and that sort of catapulted me to learn more about it and see what I could do.”

During law school, she did most of her internships and volunteer work with firms and organizations that dealt with domestic violence issues. She especially appreciated working on criminal defense cases in the Chicago-Kent Law Offices.

“I was able to employ what I learned in the classroom in a real-life setting that affected people,” she recalls. “What Chicago-Kent is very good at is teaching the practical lawyer, the one who can actually practice law. It was a good training ground.”

Her career path after graduation was not so much a logical progression as “a series of fortunate events.” She worked for The Providence Journal in Rhode Island. In addition to publishing the newspaper, the company also managed television stations across the country, enabling her to gain experience with TV series licensing, syndication rights and First Amendment issues.

The company also owned three cable networks—The Food Network, Home & Garden Television (HGTV) and America’s Health Network (AHN), which was located in Florida on a back lot at Universal.

She was hired for an in-house position with AHN and became friends with an in-house attorney at Universal, who became general counsel and invited her to join the department.

“I’ve been here almost 10 years,” she says.

In her job, she handles intellectual property licensing as well as marketing compliance with state and federal law.

“Our marketing runs from the Internet to print and media distribution. At the moment there are a lot of burgeoning issues with the FTC, the most prominent being marketing to consumers while maintaining their privacy. We look at where the legislation is going and what could potentially affect us as a business that needs to operate within those confines.”

One of the hottest issues is behavioral marketing through the Internet, which tracks “what consumers look at on a website, using cookie information,” she says. “You look at what interests them in order to better serve them by providing content that’s relevant.”

She notes, “There’s a huge dichotomy between how I started pursuing a law degree and where I am today, but one theme that runs throughout is that I’m always advocating for someone, whether it be protecting an individual or protecting the various rights that belong to a company. I’ve been very lucky in each opportunity as I transitioned into corporate IP law. It’s been very fulfilling for me.”

And sitting on the board of the Universal Orlando Foundation, a public charity, she has been able to stay connected with her interest in advocacy for women and families through the various organizations served by the foundation.

“This company is a wonderful place,” she says. “It’s like another extended family here.”

“ We’re like a mini-city. Every day you get all sorts of questions that you didn’t anticipate at the start of the day.”

The federal government is considering ways to give consumers a choice about whether they want to be tracked. “If the legislation makes it more challenging,” Sandra says, “you have to find solutions that allow you to meet your business objectives while working within the law.”

She describes Universal as “a very busy complex. We’re like a mini-city. Every day you get all sorts of questions that you didn’t anticipate at the start of the day.

This place really works my mental agility, and it’s a lot of fun. Not only do you walk into the middle of a theme park each day, but you’re handling legal issues that are so varied. You’re never bored.”

JOEL WEISMAN ’69

WTTW CHANNEL 11 AND THE LAW OFFICES OF JOEL WEISMAN PC, CHICAGO, ILL. Joel Weisman ’69 is best known in Chicago as the host and senior editor of Chicago Tonight: The Week in Review, airing Friday nights on WTTW Channel 11.

But among his colleagues in the media, he’s equally well-known as a media attorney who is a tough contract negotiator.

When he started at IIT Chicago-Kent in the mid-1960s, he was a rookie reporter for the Post-Tribune in Gary, Ind. Later, he worked at the Chicago American for “a very nice boss who gave me all the time off I needed to study for law school.”

After he graduated, Joel worked for the Chicago Sun-Times, then opened the first Chicago bureau of the Washington Post.

He also joined Channel 11 as a political commentator on a short-lived newscast that eventually morphed into Chicago Tonight: The Week in Review, with Joel as host from its inception. Thirty-four years later, the Emmy-winning program is the longest-running show on Channel 11. Joel also worked simultaneously as a political commentator at WGN-TV in the 1980s and early 90s.

In 1976, he opened a full-time law practice with a childhood friend who was a former assistant U.S. attorney.

“This was a time,” Joel recalls, “when a lot of people were changing television stations, so there was a need for new contracts.” Competitors and colleagues started coming to him for help with their contracts.

“Dick Kay of Channel 5 was the first person who hired me,” he says. “I’d never done a contract. I asked him, ‘Why do you want me?’ He said, ‘You’re a good reporter. You’re a tough guy.’”

As word of mouth spread about his legal and negotiating skills, Joel gained clients in many other cities. He loved the work.

“It was a way to vindicate my own worth,” he says, “because I felt I had been taken advantage of by some of my media employers in the past. In every one of these contracts, I feel like I’m negotiating for myself, not only my clients.”

The majority of his work involves contracts for people in television. He has about 30 clients in Chicago, including weatherman Tom Skilling, anchors Allison Rosati and Cheryl Burton, and sportscaster Mark Giangreco, and approximately 120 other clients around the country. He also represents “a handful” of authors, columnists and radio personalities.

“It’s a fairly specialized area,” he says.

“Only two or three others do it in any volume in Chicago.”

He does some intellectual property, trademark and copyright cases as well. Once he represented a nationally syndicated columnist who specialized in foreign policy and had just published a book on Fidel Castro. When a character popped up on a TV sitcom who happened to be a foreign correspondent with a recent book about Castro, he says, “we did some work in the area of misappropriation of persona.”

With contract negotiations, “It’s all about mobility,” he says. “You have to be careful when negotiating. The contract’s pretty all-encompassing. You not only look at the job, but how your client gets out of the job and goes to the next position. You have to make sure the contract is written with as much specificity as possible so the employer doesn’t have loose grounds to terminate or exploit the client without additional pay for extra duties or job promotion.

“Our job is to get the most dollars, the most exposure and the most flexibility for our clients. Their job is to get the most work for the least dollars in the most restrictive situation. That’s the perpetual tug of war.”

To be a good negotiator, he says, you have to know the client’s true market worth, and you have to nail down the details.

But that’s not all. “You have to like people.

You have to know who they’re accountable to. A good negotiator puts himself in the shoes of the other side. Figure out what motivates them, then address those motivations.”

“They were juggling more balls in the air,” he says. Joel was reporting, taking classes (nights and days) and working on the Commentator, the school newspaper.

“It taught you how to juggle things. At a practice like ours, we’re juggling all day.”

“ A good negotiator puts himself in the shoes of the other side. Figure out what motivates them, then address those motivations.”

When he was at Chicago-Kent, he especially admired the students and the teachers who were also working in the real world.

A Legendary Teacher Remembers Professor Ralph Brill looks back on five decades as teacher, role model, mentor and champion nonpareil of IIT Chicago-Kent students

In September, Professor Ralph Brill will celebrate 50 years on Chicago-Kent’s faculty. Already he has taught more than 8,500 Chicago-Kent students, with another 130 fortunate first-years lined up for next fall. Professor Brill has graciously agreed to share some reflections about his years at the law school and his storied approach to teaching.

Fifty years at Chicago-Kent!

Amazing, even to me! I would say that I remember those first days as well as I remember yesterday’s events, except I’m not sure I remember yesterday’s events very well.

I joined the Chicago-Kent faculty in September 1961. I was very young. I accepted the offer in spite of the fact that, frankly, Chicago-Kent was not highly regarded among law schools in the country. Thus, I was advised by the dean of the University of Michigan Law School, where I was teaching Legal Writing, that I would never be able to leave Chicago-Kent for a better school.

He was right! I never have been able to leave Chicago-Kent—though clearly not for the same reasons that motivated his advice.

Chicago-Kent in 1961 was a completely different place from today’s school. It was a private, stand-alone law school, with no university affiliation. It did have a great mission—to provide the opportunity, at very low cost, to obtain a legal education. Qualifications for admission were minimal. One could be admitted based on 90 hours of C or better grades in undergraduate school. The LSAT was not required.

Tuition was $20 per credit hour, with an LLB awarded upon successful completion of 80 credit hours—a law degree for $1,600!

Two hundred and fifty students, divided equally between the day division and the evening division.

Only seven full-time teachers. The dean and librarian also taught classes, and there were three adjunct teachers. While the catalog listed 53 courses, more than half of them were required courses, so electives were not taught every year. In fact, the dean issued specific sched-

ules for every student, and one had to come in to see him to request a modification of his choices—few attempted to argue with him!

My salary was a whopping $5,280 per year, compared to the dean’s $9,500. For that huge salary, in the fall semester I taught day and evening sections of Property I, day and evening sections of Agency, and a day section of Legal Writing (approximately 68 students). In the spring I taught day and evening sections of Property II, a day section of Statutes, and an evening section of Legal Writing (about 50 students).

That meant classes every day and two evenings per week, and I rarely went to sleep before 1 a.m. after preparing for class or marking up Legal Writing papers.

Now you might justifiably ask, in light of these facts, why in the world did I stay? After all, the school was basically a throwback to the way Chicago-Kent operated when it began in 1888. The main factors for me were (1) I fell deeply in love with teaching; (2) since I was about the same age as most of the students, I understood their frustrations and feelings; (3) I became personal friends with most of them; and (4) I decided that I personally had to do something to try to bring the school into the 20th century.

“ Each class was different. Each developed different personalities, and I had to adapt to the changes or not succeed. I guess it is like what professional actors face—material taught many times before has to be differently presented for each new audience.”

Change was going to be difficult!

The dean was basically an eccentric tyrant. He made all admissions decisions himself. He typed dismissal letters himself. He computed each student’s GPA, by long division. He personally physically pulled students out of class if they had not yet paid all of their tuition. He personally cut locks off of their lockers at the end of the semester. He even physically threw out the occasional bum who came in from the street.

Luckily, with the help of others — faculty, trustees, students — I was able to help get some needed changes in a relatively short time.

By 1969, when we merged with IIT, the dean retired, and for about five years, my dear colleague Fred Herzog and I took over management of the school as deans. By 1974, we had hired some great teachers.

Some are still here—e.g., Howard Chapman, Phil Hablutzel, David Rudstein, Richard Conviser and

Lew Collens (later to become dean and then IIT’s president). We hired the first women faculty members and the first minority faculty members.

I personally raised sufficient funds to begin the clinical program, staffed by three lawyers — at that time working on poverty law cases in conjunction with the Cook County Legal Assistance Foundation. The Trial Advocacy Program began when we hired Judge Warren Wolfson. The first placement office was opened.

I earmarked funds for the first faculty research budget to aid faculty scholarship. Distinguished faculty visitors — including Jon Waltz from Northwestern, Quintin Johnstone from Yale, and John O’Byrne, the dean at Northeastern — taught summer classes.

We completely revamped the curriculum into a modern system — required first-year courses, with only one or two advanced required courses, leaving real opportunity for students to elect courses and seminars. We leased three floors in a nearby building and built out more classrooms and student spaces, setting in motion the ultimate purchase in 1976 of a more modern law school building at 77 S. Wacker Drive.

Subsequently, in 1977, then Dean Collens asked me to develop a plan for the Legal Writing curriculum.

I proposed a unique-in-legaleducation, three-year, five-course program. Surprisingly, the faculty adopted it fully. It became the model for programs throughout the country to emulate, both in the number and content of the courses and for the ultimate staffing method.

About the same time, I took over as adviser to the Moot Court Society.

Almost immediately, we began reaching championship rounds and winning many, a record continued and greatly enhanced by my successors. I helped Professor Ron Staudt institute one of the first computers-in-legal-education programs in the country. We taught students the fundamentals of computer use to organize materials, do legal research, and draft memos, briefs and other documents.

The doctrinal faculty and their excellent scholarship likewise grew like Topsy. The times were very exciting—the law school moved from what would have been the bottom of any ranking system in U.S. News & World Report to its listing in an early issue as the “Top Up-and-Coming Law School in the Country.” And in the ensuing years, the law school SUMMER 2011 CHICAGO-KENT MAGAZINE

I learned that, as a teacher, I had to be both strict and sensitive—forcing them to “think like lawyers” but understanding that I would need to gently force them to do many retakes. Thus, teaching has been very challenging. I constantly have been forced to change with the times.

has achieved a level of distinction beyond any reasonable contemplation by the Michigan dean 50 years ago.

The best part of these 50 years has been the students, and my attempts to teach them. I have often analogized that incoming students are like infants—newborn. I told them they would be exposed to new (to them) forms of teaching, of studying, of thinking. I emphasized that they would be frustrated, and the process would take much time and patience. I said that, at most, at the end of the first semester they might be toddling, trying to find and maintain their balance, that the “lightbulb would go on at different times” for each. But eventually they would be running at full speed.

Students learn in so many different ways. Some are aural learners and need to hear things stated or restated in two or three different ways. Some are visual learners, necessitating me to become technologically adept, using PowerPoint slides containing pictures and videos as well as words and sounds. Some need to be made to write or speak ideas in their own words in order to master them. So I couldn’t rely merely on lectures but had to ask questions, give quizzes,

analogize to current cultural images, use humor and sometimes be a shoulder on which they could cry.

Each class was different. Each developed different personalities, and I had to adapt to the changes or not succeed. I guess it is like what professional actors face— material taught many times before has to be differently presented for each new audience.

I look back on the 50 years with great pride and personal satisfaction. I have played an important role in the growth of a great school. But most of all, I fondly look back at the students I’ve taught! I have gained the friendship of literally thousands of former students. My reward has been to see former students, who may have struggled in the first year in my Torts or Legal Writing classes, excel as practicing lawyers, possibly using the knowledge and skills that I helped inculcate in them.

It’s been a great 50 years!

It is we, the alumni of Chicago-Kent, who have the ability to shape the future of the law school in the same way that we shape world events. It is up to us to spread the word about the excellence of our law school. This year will mark my seventh year of service on the Alumni Board of Directors. In that time, I have felt privileged to watch the growing excitement and stronger community within the alumni ranks. As your new president of the Alumni Board, I am honored to represent you and to continue to do everything possible to remind you of the pride that comes with being a graduate of Chicago-Kent College of Law. One recent piece of news reminds us of the effort that everyone at the law school puts into making Chicago-Kent even better than we remember it. The 2012 U.S. News & World Report law school rankings increased Chicago-Kent 19 spots to number 61, a mere 11 spots away from the top tier of law schools in the nation. Alumni who have remained connected to the law school will find this as no surprise. Chicago-Kent alumni selected for leadership positions at IIT and Chicago-Kent Two Chicago-Kent alumni were selected to serve on the Illinois Institute of Technology Board of Trustees. Robert J. “Bob” Washlow ’70 is currently manager at Bay West Management LLC in Northbrook, Ill., and is a 2009 recipient of the Chicago-Kent Distinguished Service Award.

Formerly, Bob was chair and CEO of Lawson Products Inc. until his retirement in April 2007. Thomas A. Demetrio ’73 is a founding partner with Corboy & Demetrio, a personal-injury law firm in Chicago.

Both began their positions on the board in spring 2011.

The Chicago-Kent Board of Overseers recently welcomed three new members from the Chicago-Kent community. Penny T. Brown ’79 currently serves as president of the Kendall College Charitable Trust and was a litigation partner with Much Shelist for more than 18 years.

Lewis “Lew” Collens, IIT president emeritus and Chicago-Kent professor of law emeritus, served as dean of the law school from 1974 to 1990. Victoria L. “Vicki” Noonan ’84 is currently regional leasing director for Tishman Speyer’s Chicago portfolio, a position she’s held since 2000.

The Oyez Project @ Chicago-Kent (www.oyez.org) is a multimedia archive devoted to the Supreme Court of the United States and its work. Over the years, hundreds of lawyers have brought their time and talent to arguments before the Court, which have been historically preserved in audio recordings and case logs.

To enhance the website with more information about past cases and to populate individual Advocate profiles, the Oyez Project is reaching out to attorneys who have argued before the Court. Profiles of Advocates of the Court are linked to the cases that the attorneys argued, as well as to the audio recordings from that day.

Chicago-Kent alumni sworn in to the U.S. Supreme Court Bar On Monday, May 23, 28 alumni and three Chicago-Kent friends were sworn in as members of the Bar of the U.S. Supreme Court. The group, moved for admission by George Zelcs ’79, enjoyed a reception after the swearing-in, where Chief Justice John Roberts and Associate Justice Ruth Bader Chicago-Kent alumni pose outside of the U.S. Supreme Court building after Ginsburg stopped by being sworn in to the U.S. Supreme Court Bar. to address the group.

Later that day, some of the applicants and guests were treated to a special tour of the Senate chambers, took an official U.S. Capitol tour, and watched a vote from the Senate gallery. On Tuesday morning, members of the group spent a few minutes with Peter J. Roskam ’89 and Randy Hultgren ’93, who currently serve in the U.S. House of Representatives.
