NLRB EXTENDS TIME FOR SUBMITTING COMMENTS ON PROPOSED RULE CONCERNING STUDENTS The National Labor Relations Board (NLRB) has again extended the time for submitting comments on its proposed rule concerning the definition of “employee” under Section 2(3) of the National Labor Relations Act (NLRA). The proposed rule would exempt from the NLRB’s jurisdiction undergraduate and graduate students who perform services for financial compensation in connection with their studies.

The original notice of proposed rulemaking was published at 84 FR 49691. The submission window will remain open and interested parties may now file comments on or before Wednesday, January 15, 2020.

Comments replying to the comments submitted during the initial comment period must be received by the Board on or before Wednesday, January 29, 2020. INC: HIGHER NUT CONSUMPTION MAY HELP PREVENT COGNITIVE DECLINE IN THE ELDERLY A recent INC-funded study, published in Molecular Nutrition & Food Research, showed that a high intake of nuts may help protect the elderly from cognitive decline.

A team of researchers examined Nuts and whether a diet high in nuts brain health. might help protect against agerelated cognitive decline over a three-year period.

Researchers found that, from 119 subjects, 38 participants experienced cognitive decline, 28 from the non-nut consumers group and 10 from the nut consumers group. Nut consumption estimated either by the dietary marker or by the urinary marker model was in both cases associated with lower cognitive decline.

After taking a lifelong Chicago White Sox fan to his first ball game at Guarantee Rate Field in August to celebrate his 112th birthday, Andrew Holmes now finds himself raising money to bury perhaps the oldest U.S. citizen.

CP Crawford died on Nov. 23, but his body still remains with Gatling’s Chapel Inc. until enough money is raised to bury him.

Andre LaNier, a spokesman for Gatling’s Chapel, said it would preserve Crawford’s body until money can be raised for a burial.

“We don’t expect this to linger on too long and we are working with Andrew Holmes to make this happen as quickly as possible,” said LaNier.

It is Holmes’ goal to raise enough money in the next two weeks.

“I’d say at least $9,000 needs to be raised to give him a proper burial,” said Holmes, a 59-year-old community activist from the South Side. “He did not want to be cremated, so while it’s cheaper than a burial, I want to honor his wishes.”

And rather than start an online fundraiser, Holmes instead is asking the

public to make donations to the Andrew Holmes Foundation at Chase Bank.

“The account number for the foundation is 262602979 for anyone who simply wants to transfer money from their bank account to the foundation,” added Holmes. “Mr. Crawford does not have any living relatives that I know about although I am still searching. He was married before, but never had any biological children.”

However, Chase Bank officials said donations should not be made in cash.

“If someone wants to make a donation in person at a Chase branch, they should not bring cash, but a check,” said Brian Hanover, a spokesman for J.P. Morgan Chase & Co., parent of Chase Bank. “Most banks do not accept cash donations for accounts setup for fundraisers and Chase is no different.

Donations to the account could also be made via wire transfer, Zelle and QuickPay.” Crawford, a former sharecropper from Jackson, MS, moved to Chicago in 1925 and worked for several years at the Southland Oil Refinery and later at the Illinois Central Railroad, according to Holmes. Crawford died at the Tri-State Village Nursing and Rehabilitation Center in Lansing where he had lived for years.

Cook County Commissioner Sean Morrison (17th) donated $1,000 to the fundraiser, said Chris Provenzano, deputy chief of staff to Morrison.

“I can confirm that Commissioner Morrison has in fact donated $1,000 to this cause and hopes that others follow suit,” he said. “The commissioner and Mr. Holmes have worked on community projects together in the past and have developed a friendship as a result.”

South Suburban Lansing is located in the 4th District and is represented by Cook County Commissioner Stanley Moore, whom Holmes said is also working with him to raise funds to celebrate Crawford’s life.

“Commissioner Moore is putting together a proclamation on behalf of my dear friend CP Crawford,” said Holmes.

“He is well aware of what’s gong on and has been working with me every step.”

Crawford was a member of Holmes’ Club 100, a seniors group he started in 2012 to honor centenarians.

“This year, the group consists of 36 members and every year around May we gather at the Salvation Army on West 69th Street [in Englewood] to celebrate them,” said Holmes. “It’s a beautiful site to see seniors, who have given so much of themselves to others, having a good old time.”

Gov. Pritzker Signs Legislation to Accelerate Implementation of Law Protecting Immigrant Youth Governor JB Pritzker recently signed legislation to accelerate the implementation of Public Act 101-0121, a law signed on July 23, which allows immigrant youth to obtain Special J visas.

“This law creates a pathway for undocumented youth who have experienced great trauma to secure residency, aligning the laws on our books with those already in existence at the federal level,” said Governor JB Pritzker.“These are children who have experienced abuse, neglect, or abandonment, children who often know no home beyond this nation.

They deserve all the hope we can give them – and that starts with stability.”

Passed as House Bill 1553 in the spring session, the law better enables undocumented youth to obtain visas by aligning state laws with existing federal laws. It authorizes adoption, family, juvenile and probate courts to proceed with and grant a petition for Special Immigrant Juvenile

“This legislation gives our courts the ability to make the findings required under federal law to ensure that immigrant children who have suffered abuse, abandonment or neglect can apply for a special immigrant juvenile visa without further delay,” said Rep. Jennifer Gong-Gershowitz (D-Glenview), the House sponsor of the measure. “By signing this measure today, these critical protections for our most vulnerable kids are effective immediately and no child is left waiting to access the protections they deserve.”

Senate Bill 1797 takes effect immediately.

Scriptwriter Competition Aims to Bring Real Perspectives on Criminal Justice to the Classroom Strayer University, in partnership with The Blackhouse Foundation—a leading voice working to elevate and increase the number of diverse voices in filmmaking—recently announced the launch of ScriptED, a nationwide competition to discover a talented up-andcoming screenwriter who can help bring real perspectives to Strayer’s Ethics in Criminal Justice course.

“Research tells us that the human-brain is wired to learn through storytelling. With that in mind, we created Strayer Studios—a production team dedicated to infusing course curriculum with documentary-style films to better engage students and help them grasp subject matter in more meaningful ways,” said Karl McDonnell, CEO of Strategic Education, Inc. (SEI), the parent company of Strayer University.

“Three years later, after seeing Studios content help increase student engagement and improve outcomes, we are partnering with The Blackhouse Foundation to advance this effort by discovering new voices and stories that embody the diverse perspectives and life experiences of our students.”

The ScriptED competition calls for an original concept and script that includes a compelling and authentic storyline that addresses the key principles and reality of community experiences in criminal justice; therefore, sparking debate and understanding of this topic among Strayer students.

The top five finalists will win a trip to attend and pitch their scripts to a panel of esteemed judges from Strayer University, The Blackhouse Foundation, the criminal justice field, and the film and television industries at the 2020 Sundance Film Festival, where the winner will be announced.

The winner will receive $10,000 in prize money and the opportunity to join Strayer University’s team of Emmy Award-winning filmmakers as a virtual artist in residence to develop a series of narrative episodic educational content over a six-month period.

“Storytelling is at the core of who we are as human beings, so it makes perfect sense for us tap into the power of stories through film to inspire learning,” said Brickson Diamond, chairman of The Blackhouse Foundation. “My hope is that this collaboration will help to elevate and champion up-and-coming talent in an emerging content platform while engaging students with perspectives that resonate with them and help to elevate their education to the next level.”

Judge Victoria Pratt, former chief judge in Newark Municipal Court, current Professor of Professional Practice at Rutgers University’s School of Criminal Justice, and nationally acclaimed advocate for criminal justice reform, will evaluate submissions and serve as a judge during the live pitch session.

“Criminal justice elicits passionate viewpoints, often rooted in personal experience.

Visual storytelling can create a deeper and more compassionate understanding among criminal justice students of the diverse experiences and

perspectives that exist in our society,” said Pratt.

“I’m honored to be one of the judges selecting a scriptwriter who will shape students’ engagement with the complex questions of ethics and criminal justice.”

Aaliyah Williams, executive producer of the soon to be released Netflix series, Gente-fied, and producer of the upcoming feature film Really Love starring Kofi Siriboe, will also participate in the pitch session. Williams’ production company, Just A Rebel, focuses on television and film that “shifts the culture forward”. Its slate, that primarily centers and celebrates Black women, includes the television adaptation of Marita Golden’s critically acclaimed novel, The Wide Circumference of Love. Additionally, Williams leads the “Death of the Code Switch” panel series that spotlights Black filmmakers and writers who have broken down barriers within the film and television industry through authentic storytelling.

“I am thrilled to help discover and amplify storytellers of color who can impact the complicated and important issue of criminal justice in a nuanced and fresh way,” said Williams. “I have long admired the work of The Blackhouse Foundation and look forward to joining forces with Brickson and Strayer University to harness the power of Black and Brown excellence.”

After the winner is announced, they will be recognized at a Strayer sponsored discussion at the Sundance Film Festival titled, “The Power of Storytelling in Education” that will explore the impact of film in education. Other panelists include former WNBA basketball player Chamique Holdsclaw, whose personal story of bipolar disorder and depression is featured in Strayer’s Intro to Psychology course, and University faculty member Ryan Poirier. Brickson Diamond will serve as the moderator.

Strayer University—a leader in educating working adults for more than 127 years— launched Strayer Studios in 2016 to bring online education courses to life and improve the satisfaction, engagement and continuation of students who are often juggling school with other responsibilities, including work and childcare. Since then, Strayer faculty has found that Studios content increased students’ online class attendance, completion of assignments and participation in class discussions. Initial data found that 10% fewer Strayer students dropped courses that incorporated Studios content.

Strayer Studios and the ScriptED competition are part of a series of initiatives by the University and SEI to support working adult students, including the implementation of cutting-edge AI technology and other programs to deliver student services and support persistence towards degree completion.

Family Caregivers Provide $470 Billion in Unpaid Care as Role Becomes More Complicated Approximately 41 million unpaid family caregivers provided an estimated 34 billion hours of care — worth a staggering $470 billion — to their parents, spouses, partners, and friends in 2017, according to the latest report in AARP’s Valuing the Invaluable series.

The report also explores the growing scope and complexity of caregiving, including an aging population, more family caregivers in the paid workforce, and the increasing amount of medical and nursing tasks entering the home.

“It’s encouraging to see greater recognition of the emotional, physical and financial struggles that caregivers face,” said Susan Reinhard, senior vice president, AARP Public Policy Institute.

“But the demands on family caregivers are not just a family issue and we must continue to push for meaningful support and solutions.”

Justice Department Issues Business Review Letter to the GSMA Related to Innovative eSIMs Standard for Mobile Devices The Department of Justice’s Antitrust Division recently announced that it has completed a nearly two-year long investigation into the standard-setting activities of the GSM Association (GSMA), a trade association for mobile network operators.

The Antitrust Division’s investigation revealed that, in recent years, the GSMA used its industry influence to steer the design of eSIMs technology in mobile devices.

In response to the investigation, the GSMA has drafted new standard-setting procedures that will incorporate more input from non-operator members of the mobile communications industry.

According to a news release, the new standard-setting process will have a greater likelihood of creating procompetitive benefits for consumers of mobile devices; it will also curb the ability of mobile network operators to use the GSMA standard as a way to avoid new forms of disruptive competition that the embedded SIMs (eSIMs) technology may unleash.

According to the Antitrust Division’s investigation, the GSMA and its mobile network operator members used an unbalanced standard-setting process, with procedures that stacked the deck in their favor, to enact an RSP Specification that included provisions designed to limit competition among networks.

The GSMA expressed its intent to adopt the new procedures in a request for a business review letter from the Antitrust Division. After completing

its investigation, the division recently issued a business review letter that expresses concern about the past procedures and some of the resulting provisions in the standard.

The letter concludes, however, that the proposed changes appear to adequately address those concerns.

In light of these planned changes, the Antitrust Division has no present intention to bring an enforcement action against the GSMA or its mobile network operator members.

“I am pleased that the GSMA is ready to use its standard-setting process to create a more consumerfriendly eSIM standard,” said Assistant Attorney General Makan Delrahim.

“The GSMA’s old procedures resulted in certain eSIMs rules that benefitted only its incumbent mobile network operators at the risk of innovation and American consumers.

The new procedures proposed going forward significantly reduce that risk and should result in new innovative offerings for consumers.”

The mobile communications industry has begun to migrate away

from traditional SIM cards—a removable plastic card that is preprogrammed to connect to a single mobile network—and toward innovative eSIMs, which perform the same function as a SIM card but are soldered into the device and capable of being remotely programmed and re-programmed to connect to different operators’ mobile networks.

The mobile industry refers to this process as Remote SIM Provisioning (RSP).

According to the Antitrust Division’s investigation, the GSMA and its mobile network operator members used an unbalanced standard-setting process, with procedures that stacked the deck in their favor, to enact an RSP Specification that included provisions designed to limit competition among networks. When standardsetting organizations are used in an anticompetitive manner, the division stands ready to evaluate that conduct under the antitrust laws and take whatever action is necessary to restore competition.

The GSMA is a non-profit association with its headquarters in London, United Kingdom, and additional offices throughout the world, including offices in Atlanta, Georgia, and San Francisco, California. The GSMA is a trade association representing mobile operators worldwide, including more than 750 operators and over 350 companies in the broader mobile

ecosystem. GSMA’s membership includes all of the major mobile network operators worldwide, including the major, national carriers in the United States.

Under the Department of Justice’s business review procedure, an organization may submit a proposed action to the Antitrust Division and receive a statement as to whether the division currently intends to challenge the action under the antitrust laws based on the information provided.

The department reserves the right to challenge the proposed action under the antitrust laws if the actual operation of the proposed conduct proves to be anticompetitive in purpose or effect.

The song was written by group member Karen Clark Sheard and her son J. Drew Sheard (who also produced it).

B.J.T. Ledet is a retired Hurricane Katrina survivor who worked at Tulane University in New Orleans.
