NEWS briefly EDUCATION USPTO TO EXPAND LAW SCHOOL CLINIC CERTIFICATION PROGRAM The United States Patent and Trademark Office (USPTO) is expanding its Law School Clinic Certification Program by admitting additional schools into the program. Founded in 2008, the program currently includes 59 law school clinics and offers patent and trademark applicants access to pro bono services. It also gives law students, who are strictly supervised by a faculty clinic supervisor, experience in practicing intellectual property law before the USPTO. The program is administered by the USPTO’s Office of Enrollment and Discipline (OED). OED is responsible for registering attorneys and agents to practice before the USPTO and for developing and administering the registration examination. Participating clinics must maintain the requirements for USPTO certification in order for students to practice before the agency.

Submissions from interested law school clinical programs will be accepted on a rolling basis through May 31, 2021. Details of the program expansion and application materials are available on the Law School Clinic Certification Program page of the USPTO website.

Chicago Mayor Lori Lightfoot and Illinois Governor J.B. Pritzker announced a relief fund for artists which will provide financial assistance.

Arts for Illinois Relief Fund is a partnership between the city, the state, as well as other philanthropic entities. The goal is to meet the needs of creatives during COVID-19. With the stay-at-home order extended until April 30, theaters, art galleries and museums remain closed. Those actors and artists and docents are out of work.

“This fund was created to support our artists and broader cultural community who have been the most directly impacted by the economic fallout of this crisis,” said Lightfoot.

“Though cities and towns like Chicago will be supporting this fund, we’re also calling on individuals, of all stripes, large and small, to step up by visiting artforIllinois.org.”

Applications for the grants opened on April 1. Arts for Illinois Relief Fund will be administered by 3 Arts and Arts Work Fund, in partnership with Arts Alliance Illinois.

3Arts is a nonprofit organization that advocates for Chicago’s women artists, artists of color, and artists with disabilities who work in performance, teaching and visual arts and provides them with cash awards, project funding, residency fellowships promotion and professional development.

The Arts Work Fund is a collaborative fund launched in 2007 by a group of foundations that seek to help small arts and culture organizations develop sustainable structures to meet their artistic missions. It shifted its grantmaking to support arts and cultural organizations struggling with lost revenue and expenses due to COVID-19.

The funding will be unrestricted and is open to all arts organizations regardless of size. The grant size depends on the organization’s budget and extent of lost revenue.

Organizations must hold 501(c)(3) status from the federal government. Festivals, religious-based activities, as well as standalone publications, websites or films and videos are not eligible for the funding.

More than $4 million has been committed from public and private sources. The City of Chicago’s Department of Cultural Affairs and Special Events contributed $1

million to the effort. Gifts also have been received from Walder Foundation and John D. and Catherine T. MacArthur Foundation.

Chicago First Lady Amy Eshelman and Illinois First Lady MK Pritzker will cochair the fundraising activities.

“The arts and cultural community is deeply embedded in the fabric of Chicago.

Our cultural institutions – from [the] one room artist studio to the 1,500-seat theater – employ artists, back office staff, ushers, curators, ticket takers and others,” Lightfoot and Eshelman said in a press release.

“Many artists supplement their work by providing arts education in our schools.

All of these individuals contribute to the City’s vibrant arts and cultural sector, which has been temporarily halted.”

Artists and artisans, including stage and production members, will be able to apply for a one time $1,500 grant,which will be distributed by 3Arts. Organizations will be granted $6,000-$30,000 based on their demonstrated financial need. Grants will be awarded through a lottery system.

Adult-use marijuana sales remain high at $35.9 million in March Stay-at-home order appears not to have major effect as total sales top $100 million

Springfield — More than $109 million of marijuana products were purchased in Illinois in the first three months of legalization, and the third month of sales was on par with the first two despite a stay-athome order being in place for

11 days in March.

Preliminary numbers show statewide adult-use cannabis sales in March totaled $35.9 million, according to a news release from the Illinois Department of Financial and Professional Regulation.

Dispensaries across the state sold more than 812,000 items over the 31-day period. The March sales topped February’s

When will the impact of coronavirus hit state budgets like Illinois’?

Some effects could come soon, but policymakers face significant long-term uncertainty

State officials nationwide fear that a substantial decline in tax collections as a result of the coronavirus pandemic will throw their budgets into turmoil. But they will have to wait for the first hard data on how big the decline might be.

When the economy struggles, state tax revenue usually suffers too. States’ two largest sources of tax revenue are the personal income tax and the sales tax. If employers lay off workers or reduce their hours, workers earn less income and pay less in income taxes. If consumers scale back purchases, sales tax revenue drops. These declines are likely to play out over the course of months because there’s always a lag between changes in a state economy and changes in revenue.

As a result, policymakers are facing considerable uncertainty as they seek to maintain balanced budgets in the current fiscal year— and develop budgets for the next one. With these challenges in mind, Congress is providing financial relief to states, most substantially through a $150 billion fund for states and localities that was part of the stimulus bill signed by President Donald Trump on March 27.

However, some governors have warned that the aid won’t be enough to prevent dire budget challenges.

Some of the first signs of trouble are likely to emerge in income tax withholding payments.

Although taxpayers file their income taxes once a year, employers withhold a portion of each paycheck based on estimates of what the total bill will be, so withholding payments represent a large share of state income tax revenue.

If workers’ paychecks shrink, the withholding payments will shrink too, and states will see the effects in a matter of weeks.

An economic slowdown will affect sales tax collections nearly as quickly. Although consumers pay sales tax when they make a purchase, businesses don’t remit those dollars to states immediately. Instead, they are typically required to make monthly payments that are due toward the end of the month after the one in which the purchases are made. As a result, consumer spending

declines that began in March will begin to affect state revenue in late April.

Accounting for fiscal year calendars Most states begin their fiscal year July 1.

With key revenue sources at risk of decline starting in April, their current year budgets could fall out of balance in the final few months of the fiscal year.

Adding to that risk, many states have announced extensions of their income tax filing deadlines past the end of their fiscal year, complementing the federal government’s decision to push its deadline from April 15 to July 15.Mirroring the federal extension will provide relief for state tax filers and reduce the potential for a confusing and complex filing process. But it also means that a portion of the taxes these states expected to collect this fiscal year will be delayed until next fiscal year instead, compounding the strains on current budgets. Although states receive income tax revenue throughout the year via withholdings, April is the month when they typically collect the most revenue.

Closing midyear budget gaps always poses challenges for states, and many of the strategies that they typically use—such as leaving vacant

positions unfilled—provide less in savings if the problem occurs in the final months of the year.

Although the potential for a severe and rapidly developing economic downturn means that significant gaps could develop quickly, two factors may provide some help. Most states were enjoying reasonably strong revenue growth before the start of the coronavirus pandemic, creating some cushion to keep this year’s budgets balanced. Plus, states now have more money in reserve than at any time in at least two decades, thanks to effort by policymakers to strengthen rainy day funds after the Great Recession. Because states, unlike the federal government, cannot engage in routine deficit spending, reserves play a crucial role in helping them balance their budgets in times of fiscal stress.

An economic slowdown caused by coronavirus also poses significant risks to states’ budgets for the 2021 fiscal year, which begins July 1 in most states. Depending on the severity and length of a downturn, sales tax collections and income tax withholdings could continue to be depressed in fiscal 2021.

Other revenue sources may see effects that develop slowly, with the bulk appearing in that next fiscal year. For instance, stock market losses could take a big bite out of capital gains tax revenue. Although taxpayers with large capital gains often must make payments quarterly based on estimates of how much they will ultimately owe, experts predict that the largest decline in payments will not begin until fiscal 2021.

The economic upheaval comes at an awkward time for states’ upcoming budgets. Generally, states determine how much money they can appropriate for the year based on revenue forecasts that are completed in January or February. This year, however, those forecasts may be far too optimistic, given that they predate the onset of the pandemic in the United States.

A handful of states have already finalized their fiscal 2021 budgets, while others were deep into drafting them before most legislatures started modifying or suspending operations in recent weeks to slow the spread of the virus and protect lawmakers.

Because of the COVID-19 pandemic, designated caregivers are allowed to pick up medical marijuana for the patients they care for, and dispensaries can sell marijuana to medical patients or caregivers on a public walkway or curb adjacent to the dispensary property. Dispensaries are not permitted to deliver medical cannabis to a home, however.

The exemptions, which are extended until April 30 along with the stay-athome order, do not apply to recreational marijuana sales. Those must still take place inside the limited access area of the dispensary.

“Three straight months of consistent

adult use cannabis sales show there is – and will continue to be – strong support and demand from consumers,” Toi Hutchinson, Pritzker’s senior advisor for cannabis control, said in the news release. “To ensure medical users are able to access the product they need during the ongoing COVID-19 pandemic, curbside pickup will remain an option for medical patients through April 30.”

Pritzker also recently signed an executive order extending the deadline for applications for cannabis infuser, craft grower, and transporter licenses to the Illinois Department of Agriculture from March 30 to April 30. The department will award up to 40 infuser and craft grower licenses each, and an unlimited amount of transporter licenses,

fiscal challenges and may have no choice but to revise their revenue forecasts and adjust their fiscal 2021 budgets accordingly. In New York, which is the only state that starts its fiscal year April 1, the state comptroller recently estimated that the state would collect at least $4 billion less than forecasters expected just weeks earlier. But the comptroller also acknowledged that those estimates came with a huge amount of uncertainty.

In Illinois, a commission that advises the General Assembly on revenue and economic issues is warning that a slowdown of business activity caused by the COVID-19 outbreak is likely to bring about a recession that could cause a 20 percent drop in state revenues, spread out over a number of fiscal years.

The Commission on Government Finance and Accountability, or CoGFA, gave that warning as part of its three-year budget forecast, which it is required to make annually. Those forecasts include an analysis of potential threats and opportunities to the state budget.

“While the certainty of the country, and world, plunging into recession seems to grow each day, attempting to value the impact of COVID-19 on state revenues is virtually impossible,” the report stated in the section dealing with economic threats. “With that caveat, it seems reasonable to offer a scenario with more devastating impacts on revenues in the near-term than even the ‘Great Recession.’ As a result, should revenues experience a peak-trough decline of 20 percent, a revenue reduction of over $8 billion would be experienced, although likely spread over multiple fiscal years.”

That uncertainty is common across the country. Not only do states not yet have data on the revenue impact of the slowdown, but they also are only just beginning to receive early data quantifying the economic disruptions that will ultimately reduce tax collections. With that in mind, leaders will need to be flexible in the coming months and be prepared to respond to fast-changing conditions to balance their budgets once the picture becomes clearer.

According to The Road to Zero Wealth report published far before the impact of the current Coronavirus event, by Prosperity Now and the Institute for Policy Studies in 2017, the median wealth of black Americans could fall to zero by 2053.

King is seeking fast and deliberate measures to mitigate what he foresees as a fallout that would take decades to recover from.

“Financial giants like Bank of America and Wells Fargo have the means to provide the resources we seek. They have already set in place grants benefitting homeowners in marginalized communities. We are asking for similar efforts for our business owners,” explains King.

“We are publicly imploring financial institutions in the private sector, along with the government, for aid that is critical to our long-term survival.

“Historically, since the Emancipation Proclamation, African American businesses have suffered a uniquely disadvantaged position in this country, from predatory lending and discriminatory banking practices to racism and bigotry.

After our experience as slaves in servitude to this country, our climb back into respectful positions

in society has been deliberately challenged by our very own government, government agencies, elected officials and law enforcement leaders,” adds King. “Now with the onset of the COVID-19 crisis, the Chamber is urgently engaged in seeking immediate solutions.”

SBA and Treasury Begin Public-Private Mobilization Effort to Distribute Funds Following President Trump’s signing of the historic Coronavirus Aid, Relief, and Economic Security (CARES) Act, SBA Administrator Jovita Carranza and Treasury Secretary Steven T. Mnuchin recently announced that the SBA and Treasury Department have initiated a robust mobilization effort of banks and other lending institutions to provide small businesses with the capital they need.

The CARES Act establishes a new $349 billion Paycheck Protection Program. The Program will provide much-needed relief to millions of small businesses so they can sustain their businesses and keep their workers employed.

“This unprecedented publicprivate partnership is going to assist small businesses with accessing capital quickly. Our goal is to position lenders as the single point-of-contact for small businesses – the application, loan processing, and disbursement of funds will all be administered at the community level,” said Administrator Carranza.

“This legislation provides small business job retention loans to provide eight weeks of payroll and certain overhead to keep workers employed,” said Secretary Mnuchin.

The loans will be forgiven as long as the funds are used to keep employees on the payroll and for certain other expenses.” The new loan program will help small businesses with their payroll and other business operating expenses.

It will provide critical capital to businesses without collateral requirements, personal guarantees, or SBA fees – all with a 100% guarantee from SBA. All loan payments will be deferred for six months. Most importantly, the SBA will forgive the portion of the loan proceeds that are used to cover the first eight weeks of payroll costs, rent, utilities, and mortgage interest.
