Judges used to stay out of election disputes, but this year lawsuits could well decide the presidency challenging the governor’s executive order postponing in-person voting.

In another Wisconsin case, the U.S. Supreme Court sided with the Republican National Committee and the state party when it blocked a plan to extend the period to return absentee ballots in the primary election.

Throughout American history judges have generally tried to avoid getting involved in political questions, including litigation about elections. They followed Supreme Court Justice Felix Frankfurter’s famous advice to avoid “embroilment” in “the political thicket” of “party contests and party interests.”

This tradition began to erode in the 1960s, when courts took up cases involving legislative redistricting and gerrymandering. And since the Supreme Court’s 2000 Bush v. Gore decision, which effectively decided that year’s presidential election, political parties have increasingly turned to the courts in search of electoral advantage.

Prior to 2000, an average of 96 election law cases were brought every year in state and federal courts.

By 2004, that average jumped to 254, most of them filed at the state level.

This year, the Stanford-MIT Healthy Elections Project reports that as of Oct. 15, 365 such cases have been filed in 44 states.

Many of those cases arise from state efforts to respond to the difficulties of campaigning and voting during the COVID-19 pandemic.

Democrats generally have supported efforts to making voting easier, such as in Michigan, where they were successful in getting the courts to extend the period during which late-arriving mail ballots could be legally counted. Republicans generally have opposed those efforts.

When the voting happens This year’s election-related litigation began to emerge in the spring as states tried to cope with

the pandemic’s first wave during the political primary season.

Those cases fell into two major categories. Some were filed to try to change the date when people voted in presidential primaries. Others focused on how people voted in those primaries and the general election.

Sixteen states changed the dates of their primaries, and most did so without resorting to litigation.

Nonetheless, some states faced lawsuits over the timing of presidential primaries, filed by political candidates and public officials, including in New York and Wisconsin.

In April, Andrew Yang, then a Democratic presidential candidate, sued the New York State Board of Elections after it effectively canceled the Democratic presidential primary.

He argued that doing so was illegal since he already had met the requirements for having his name to appear on the ballot. One month after the suit was filed, a judge agreed with Yang and ordered the state to proceed with its presidential primary.

Wisconsin proved to be a particularly fertile ground for litigation over its April primary. In one case, the Wisconsin legislature prevailed in

How the voting happens In cases concerning the ways people could vote, Democrats in Kansas sued to force Secretary of State Scott Schwab to implement a law permitting voters to cast ballots from any polling station within their home county. Schwab argued that the complexity of developing necessary administrative regulations prevented him from doing do so in time for this year’s election.

A state court judge dismissed the suit but said that county officials could, if they wished, implement the Kansas Vote Anywhere Act on their own without waiting for the state to act.

In Ohio, a federal judge also dismissed an American Civil Liberties Union suit seeking to extend the deadline for absentee voting for the state’s presidential primary and move from in-person to universal mail balloting. The plaintiffs claimed that the state’s inefficient absentee-voting system would disenfranchise people through no fault of their own unless the deadline was changed and that in-person voting during the pandemic would pose a health risk.

Some of this litigation has been brought to expand opportunities to cast that kind of ballot or to ease the requirements for doing so. Other cases have been filed by groups opposing such changes and raising concerns about voter fraud.

Recent rulings in some of those cases have made voting by mail more difficult; others have made it easier.

In the first category, the U.S. Supreme Court ruled on Oct. 5 that South Carolina could require people voting by mail to have another person sign their ballot as a witness. However, over the objection of Justices Samuel Alito, Neil Gorsuch and Clarence Thomas, the court declined to invalidate the more than 20,000 ballots that had been cast prior to its ruling.

Three days later, in a victory for Wisconsin’s Republican Party, a federal appeals court upheld that state’s requirement that in order to be counted, mail-in ballots must be in the hands of election officials by 8 p.m. on Election Day. But, also on October 8, Justice Elena Kagan turned down a request from Montana Republicans to block some counties from proactively mailing ballots to voters starting the next day.

In another victory for supporters of mail balloting, a federal judge in Pennsylvania dismissed a lawsuit filed by the Trump campaign seeking, among other things, to block the use of drop boxes as receptacles for mail ballots.

Focus on mail-in ballots Many of this year’s election-related cases have focused specifically on mail-in ballots. This is not surprising given President Donald Trump’s well-publicized but baseless attacks on voting by mail.

Full employment for election lawyers November 3 is unlikely to end litigation to resolve election-related disputes. In fact, both the Biden and Trump campaigns have assembled armies of lawyers who will be ready to bring lawsuits in the election’s

aftermath.

President Trump already has indicated that he expects the Supreme Court to again resolve a contested presidential election.

For someone who studies the complex intersections of politics and law, the use of litigation to resolve electoral disputes that we are seeing this year is a reminder of what the famous French aristocrat and author Alexis de Tocqueville observed early in the 19th century: namely, that “Scarcely any political question arises in the United States that is not resolved, sooner or later, into a judicial question.”

Nonetheless, when courts and judges take sides in cases that shape the outcome of a hotly contested election, they open themselves up, as Frankfurter warned, to charges that they are making purely partisan decisions rather than strictly following the law. That is why public confidence in the Supreme Court took a hit in the aftermath of its Bush v. Gore decision.

Whatever decisions judges make this year, the rush to the courthouse to shape the 2020 election will pose real challenges for their legitimacy, which ultimately depends on the public’s belief that they are not simply political actors.

And if the Supreme Court again decides who becomes president, it may further weaken its already diminished standing with the American public and deepen the divide in an already dangerously polarized nation.

“Every Child Ready Chicago” Initiative Helps Children To Succeed Chicago — Mayor Lori E. Lightfoot recently announced the launch of Every Child Ready Chicago, a public-private partnership led by the city of Chicago in partnership with Start Early (formerly the Ounce of Prevention Fund).

The multi-year effort seeks to align the prenatal-to-five systems and supports serving Chicago’s children and families, creating a coordinated early childhood ecosystem that prepares every child in the city to succeed in kindergarten and beyond.

“As a city, we must ensure every child, regardless of their zip code, receives a high-quality early education, providing them the tools and opportunities they need to thrive,” said Mayor Lightfoot. “The Every Child Ready Chicago

partnership is an investment in our children, by creating a system that, before birth, ensures our youngest Chicagoans are growing and prepared to achieve great success for years to come.”

Over the past few months, COVID-19 has illuminated the lasting impact of institutional racism and structural inequality that exist in our nation and throughout our city. Those impacts are reflected in the outcomes of early learning for Chicago’s youngest — just one in three Black children (30 percent) and one in five Latinx children (20 percent) in the city are considered “ready” for kindergarten based on the most recent state Kindergarten Individual Development Survey (KIDS).

“Research proves quality early childhood

experiences can level the playing field and help children and families overcome many of the inequities that have been magnified by the pandemic,” said Start Early President Diana Rauner.

“We are excited to work with the Mayor to build a more unified, equitable and accountable early childhood system that prepares every child for success in school and life.”

This fall, Every Child Ready Chicago will convene leaders from early childhood programs and services, research and advocacy communities, parents and families of young children, and city agencies to create a shared and inclusive vision of what a high-quality early learning system looks like. Working Group will guide the city and help lay the groundwork for a multi-year strategic plan to create a strong and equitable system where all children, particularly those in under-resourced communities, have access to quality services and achieve positive outcomes.

NEWS Hilariously, Witty campaign sheds light on the arduous experiences of Black women diagnosed with breast cancer Continued from page 1 “YOU HAVE BREAST CANCER” are words nobody wants to hear. Sadly, the disparities in lack of access to care, adequate resources and support between Black and white women diagnosed with the disease are mind blowing, which is why Carrie’s TOUCH is helping drive the difficult conversation.

Through a quick-witted, hilariously written campaign video, Carrie’s TOUCH sheds light on the seriousness of the arduous experiences of Black women following their diagnoses with breast cancer.

The satirical video, ironically titled, “Breast Cancer Be Like,” pushes forward a necessary look at the gross inequalities in care, treatment and support many Black women face. “It’s time to shift the narrative and redefine what a breast cancer survivor looks like,” said Carrie’s TOUCH founder, Rev. Tammie Denyse.

In the video, viewers first meet Amy, a woman completely overwhelmed with support before being told: “YOU HAVE BREAST CANCER.” After witnessing the outpouring of love, resources and guidance Amy receives from a plethora of medical professionals, viewers are quickly faced with the actuality that Black women often don’t receive the same level of engagement.

The stories highlighted in #BreastCancerBeLike, which were written, produced and conceptualized by Black women, are based on actual events and incidents shared by Black survivors.

“It would blow your mind to learn how many Black women had similar experiences to the

woman in the video. I’m one of them. That’s MY story,” Rev. Tammie added. “That’s why Carrie’s TOUCH is unapologetic about sharing our truths, it’s our season.”

Breast Cancer Awareness Month is a global effort to increase awareness about breast cancer, but for Denyse, discussing disparities in different communities around the world should be an ongoing conversation. “Our research efforts are first, about humanizing the Black woman,” Rev. Tammie explained. “Then, and only then are we able to bring equity to her experience with breast cancer. We are moving beyond discussions, we are developing pathways that are culturally aware, culturally competent and culturally sensitive.”

STATISTICS: Though Black women are diagnosed with breast cancer at a slightly lower incidence rate (3%) than white women, Black women are 42% more likely to die of breast cancer than white women. This is an astounding number and indicative of a variety of factors, many reflecting racial disparities.

Breast cancer is the most commonly diagnosed cancer among Black women and an estimated 33,840 new cases are expected to be diagnosed by the end of 2020. An estimated 6,540 deaths from breast cancer are expected to occur among black women in 2020.

Higher death rates among Black women reflect the following: l Historical tragedies such as The Tuskegee Syphilis Study has traumatized the Black community since 1932. Fear and trauma are major factors causing lack of trust in the Black community with medical professionals, even today. l Lack of awareness, education, access,

Goodwill Receives SNAP E&T National Partnership Grant From USDA The U.S. Department of Agriculture (USDA) recently announced that Goodwill Industries International, the largest nonprofit workforce provider in North America, is one of four national nonprofits that will receive a new grant to strengthen Supplemental Nutrition Assistance Program Employment and Training programs (SNAP E&T).

This grant will significantly increase the reach and capabilities of these programs, which help SNAP participants build economic self-sufficiency.

The USDA is providing more than $6.7 million in SNAP E&T national

partnership grants to four leading nonprofit organizations — Goodwill Industries International, the National Association of Workforce Boards, the American Public Human Services Association and the Roberts Enterprise Development Fund — to help enlarge program capacity to serve SNAP participants.

While 92% of black women agree breast health is important, only 25% have recently discussed breast health with their family, friends, or colleagues. And, only 17% have taken steps to understand their risk for breast cancer. l Black Women are more often at an advanced stage upon diagnosis. l Black women may not have access to sufficient health care or health insurance, and may have lower frequency of longer intervals between mammogram screenings. l Because they may not have insurance, Black women may not follow up on abnormal mammogram results because they can’t afford the diagnostic testing. l Black women often do not receive the same level of high quality treatment compared to white women. l Black women are two times more likely to be diagnosed with Triple Negative Breast Cancer, a type of breast cancer that often is aggressive and has higher recurrence rates after treatment. Triple Negative Breast Cancer has the highest mortality rate and is the only breast cancer subtype that does not have a targeted therapy to prevent recurrence. Black women, younger women and women diagnosed at later stages are more likely to be diagnosed with Triple Negative Breast Cancer.

amaZing The Citizens Utility Board (CUB), a nonprofit utility watchdog in Illinois, is urging consumers who are having difficulty paying their utility bills to contact their utility companies to take advantage of unprecedented consumer protections.

CUB to Consumers Struggling with Their Bills: Contact Your Utility The Citizens Utility Board (CUB) is urging Illinois consumers who are having difficulty paying their utility bills during the pandemic to contact their utility companies to take advantage of unprecedented consumer protections available to them.

“Anybody struggling to pay their bills during the pandemic should immediately contact their utility to find out what protections are available, and to set up a plan to prevent disconnection,” CUB Executive Director David Kolata said.

“These protections are available for a limited time, and only for customers who call their utility and say they are experiencing financial hardship because of the pandemic.”

In June, the Illinois Commerce Commission (ICC) approved landmark consumer protections negotiated by a coalition of consumer advocates and these major utilities: Ameren Illinois, Aqua Illinois, ComEd, Illinois American, Nicor Gas, North Shore Gas, Peoples Gas and Utilities Inc. Kolata stressed that the following protections are available only to customers who call and state they are experiencing hardship due to the pandemic: A moratorium on disconnections. The utilities have agreed to extend the moratorium through March 31, 2021 for all consumers who qualify for the Low Income Home Energy Assistance Program (LIHEAP) OR those who call the utility and say they are financially impacted by COVID-19. (Note: For most utilities, this is not a blanket moratorium. It will only be given to individuals who call.)

Waiving deposits. Until Dec. 26, utilities must waive deposits connected to late payment or non-payment, arrearages, or credit-related

issues for customers experiencing financial hardship. Also, utilities will not report late payments and nonpayment for active customers to credit bureaus and reporting agencies.

Consumer-friendly payment plans. Until Dec. 26, utilities are required to offer longer Deferred Payment Arrangements (DPAs)— plans that help people pay off debt with a utility. DPAs for customers who are LIHEAP-eligible or express financial hardship will not require a down payment and will be extended to 24 months.

Reminder: No documented proof of hardship is required to qualify for these consumer protections. But people must call their utilities and state they are experiencing hardship.

The utilities also have set up a Bill Payment Assistance Program that offers a certain amount of debt forgiveness for eligible utility customers who apply. Each utility’s program will differ in terms of available funding, the amount allotted to each customer and the way it is administered. CUB urged consumers to ask their utility companies about the Bill Payment Assistance Program.

$5 Million Settlement With Community Health Systems For Data Breach Attorney General Kwame Raoul recently announced a $5 million settlement with Community Health Systems Inc. (CHS) resulting from a 2014 data breach that impacted approximately 6.1 million patients nationwide.

Attorney General Raoul, along with Tennessee Attorney General Herbert Slatery III and Texas Attorney General Ken Paxton, led a bipartisan coalition of 28 states that reached the settlement with CHS and its subsidiary, CHSPSC LLC. In 2014, CHS confirmed that its computer network was the target of an external cyber attack that allowed hackers to gain access to patient names, birthdates, Social Security numbers, phone numbers and addresses.

More than 339,000 impacted patients were Illinois residents. Raoul

recently filed a lawsuit and a settlement requiring CHS to pay states $5 million, more than $611,000 of which will go to Illinois.

CHS has also agreed to implement and maintain a comprehensive information security program to safeguard personal information and implement policies to quickly identify and address future breaches.

“When patients provide sensitive personal information such as Social Security numbers and birthdates, they are trusting that it will be kept safe and confidential,” Raoul said.

“This settlement requires CHS to enact procedures to better protect patients’ information, and to develop plans to react quickly if another breach occurs. I will continue working to hold companies responsible for not doing enough to protect consumers’ personal information

from data breaches.”

The settlement requires CHS to take a number of steps to prevent future breaches, such as developing an incident plan so that the company will know what to do if a breach occurs. The settlement also requires CHS to employ additional policies to protect sensitive patient information, such as: Developing and implementing a written information security program.

Developing a plan to ensure that any needed software patches are detected and applied in a timely manner to avoid allowing security gaps.

Maintaining strict control over access to CHS’ accounts and network, and implementing measures such as multi-factor authentication to limit access only to authorized

individuals.

Providing regular security and privacy training for all employees who handle or come into contact with sensitive patient data.

Developing and maintaining policies and procedures to encrypt sensitive data when appropriate.

Conducting an annual risk assessment of the CHS network, and developing a plan for addressing those risks and protecting data.

Requiring any third-party companies that provide services to CHS involving the handling or storage of sensitive patient data to agree to take certain precautions to protect the data.

Implementing and maintaining policies to track and protect all company computers, phones and other devices that have access to or transmit sensitive patient data.

Engaging a third-party assessor to evaluate CHS’ compliance with the terms of the judgment and the handling of sensitive patient data.

Privacy Unit Chief Matt Van Hise, Consumer Fraud Bureau Chief Beth Blackston, and Assistant Attorneys General Carolyn Friedman and Ronak Shah handled the settlement for Raoul’s Consumer Fraud Bureau.

Joining Attorneys General Raoul, Slatery and Paxton in the settlement are the attorneys general of Alaska, Arkansas, Connecticut, Florida, Indiana, Iowa, Kentucky, Louisiana, Massachusetts, Michigan, Mississippi, Missouri, Nebraska, Nevada, New Jersey, North Carolina, Ohio, Oregon, Pennsylvania, Rhode Island, South Carolina, Utah, Vermont, Washington and West Virginia.

Travelers that test positive should contact a doctor as soon as possible, prior to canceling their trip. The doctor can provide documentation that will be required when travelers file a claim.
