How Congress could decide the 2020 election

If the the 2020 U.S. presidential election is contested, both campaigns are preparing to take the matter to court. But the Founding Fathers meant for Congress to be the backup plan if the Electoral College did not produce a winner.

Generally, the framers sought to avoid congressional involvement in presidential elections. They wanted an independent executive who could resist ill-considered legislation and would not care about currying favor with members of Congress, as James Ceaser explained in his definitive 1980 text, “Presidential Selection.”

That’s why they created the Electoral College, assigning to state legislatures the responsibility for choosing “electors” who then determine the president.

But the framers could foresee circumstances – namely, a fragmented race between little-known politicians – where no presidential candidate would secure an Electoral College majority. Reluctantly, they assigned the House of Representatives to step in if that happened – presumably because as the institution closest to the people, it could bestow some democratic legitimacy on a “contingent election.”

Tied or contested election The founders proved prescient: The elections of 1800 and 1824 did not produce winners in the Electoral College and were decided by the House. Thomas Jefferson was chosen in 1800 and John Quincy

Over time, the development of a two-party system with national nominating conventions – which allows parties to broker coalitions and unite behind a single presidential candidate – has basically ensured that the Electoral College produces a winner.

Though the Electoral College has changed significantly since the 18th century, it has mostly kept Congress out of presidential selection.

As a professor who has taught courses on presidential elections for two decades, however, I can see scenarios in which Congress gets involved in the 2020 election.

A tie in the Electoral College remains a possibility, however remote. There are 538 electors, so a minimum majority to win is 270.

The website 270toWin lists 64 hypothetical scenarios in which both Joe Biden and Donald Trump could get 269 electors. That would throw the election to the House.

Though the House has a Democratic majority, such an outcome

would almost certainly benefit Trump.

Here’s why: In a concession to small states concerned their voices would be marginalized if the House was called upon to choose the president, the founders gave only one vote to each state. House delegations from each state meet to decide how to cast their single vote.

That voting procedure gives equal representation to California – population 40 million – and Wyoming, population 600,000.

Currently, this arrangement favors the Republicans. The GOP dominates the delegations from 26 states – exactly the number required to reach a majority under the rules of House presidential selection.

But it’s not the current House that would decide a contested 2020 election. It is the newly elected House that would choose the president. So the outcome depends on congressional races.

One more caveat: Split decisions are considered abstentions, so states that cannot reach an agreement would be counted out.

Congressional commission Another way Congress could become involved in the 2020 election is if there are disputes about the vote totals in various states. Given the spike in mail-in voting during the pandemic, threats of foreign interference and controversies over voter suppression, uncertainty after Nov. 3 seems likely.

Perhaps the most relevant precedent for that scenario is the 1876 election between Democrat Samuel

Tilden and Republican Rutherford B. Hayes. That election saw disputed returns in four states – Florida, South Carolina, Louisiana and Oregon – with a total of 20 electoral votes.

Excluding those 20 disputed electors, Tilden had 184 pledged electors of the 185 needed for victory in the Electoral College; Hayes had 165. Tilden was clearly the front-runner – but Hayes would win if all the contested votes went for him.

Because of a post-Civil War rule allowing Congress – read, Northern Republicans worried about Black voter suppression – to dispute the vote count in Southern states and bypass local courts, Congress established a commission to resolve the disputed 1876 returns.

As Michael Holt writes in his examination of the 1876 election, the 15-member commission had five House representatives, five senators and five Supreme Court justices.

Fourteen of the commissioners had identifiable partisan leanings: seven Democrats and seven Republicans.

The 15th member was a justice known for his impartiality.

Hope of a nonpartisan outcome was dashed when the one impartial commissioner resigned and was replaced by a Republican judge. The commission voted along party lines to give all 20 disputed electors to Hayes.

To prevent the Democratic-dominated Senate from derailing Hayes’ single-vote triumph over Tilden by refusing to confirm its decision, Republicans were forced to make a deal: Abandon Reconstruction,

their policy of Black political and economic inclusion in the post-Civil War South. This paved the way for Jim Crow segregation.

Bush v. Gore The 2000 election offers the only modern precedent for contested vote returns.

George W. Bush and Al Gore argued for a month over Bush’s slim, 327-vote advantage in Florida’s second machine recount. After a lawsuit in state courts, this political and legal battle was decided by the Supreme Court in December 2000, in Bush v. Gore.

But Bush v. Gore was never intended to set a precedent. In it, the justices explicitly stated “our consideration is limited to the present circumstances.” Indeed, the court could have concluded that the issues presented were political, not legal, and declined to hear the case.

In that case, the House would have decided the 2000 election.

The Electoral College must cast its ballots on the first Monday after the second Wednesday in December – this year, Dec. 14. If disputed state vote totals are not resolved by six days prior to that date, Congress can step in, under the 1887 Electoral Account Act. This could have happened in 2000, and it is an imaginable outcome in 2020.

The best bet for American democracy, history shows, is a clear and decisive victory in the Electoral College, as the framers intended.

A newly release study shows that fewer dentist nationwide were found to be COVID-19 Continued from page 1 Although assumed to be at high risk for COVID-19, fewer than one percent of dentists nationwide were found to be COVID-19 positive, according to a first-of-its-kind report in the U.S. based on data collected in June 2020. The result is far below that of other health professionals in the U.S. In addition, 99 percent of dentists are using enhanced infection control procedures such as screening protocols and enhanced disinfection practices when treating patients. The report, published online ahead of print by The Journal of the American Dental Association, is the first large-scale collection and publication of U.S. dentists’ infection rates and infection control practices related to COVID-19.

“This is very good news for dentists and patients,” said American Dental Association (ADA) Science and Research Institute Chief Executive Officer Marcelo Araujo, D.D.S., M.S., Ph.D., the senior author of the report. “This means that what dentists are doing – heightened infection control and increased attention to patient and dental team safety – is working.”

Dr. Araujo added that the authors of the report, researchers from the ADA Science and

Research Institute and Health Policy Institute based in Chicago, are continuing to collect and will report infection rate data on dentists and have added hygienists to their ongoing survey, in collaboration with the American Dental Hygienists Association.

This report focused on nearly 2,200 dentists in June, finding that 82 percent of dentists were asymptomatic for one month prior to the survey and 16.6 percent reported getting a COVID-19 test. Those who tested positive were not clustered in any particular geographic region.

Among those not tested, less than one percent (0.32) were given a probable COVID-19 diagnosis by a physician. The authors weighted the results to align with U.S. dentists demographically and geographically and found an estimated prevalence of less than one percent (0.9) with a margin of error of 0.5 percent.

“Understanding the risks associated with COVID-19 transmission in the dental setting is critical to improving patient and dental team safety,” said Dr. Araujo. “This study brings us another step forward in understanding what works. Dentists are following ADA and U.S. Centers for Disease Control and Prevention (CDC) guidance, and it’s helping

to keep the dental team and their patients as safe as possible.”

In March, The New York Times listed dentistry as one of the professions at highest risk of COVID-19 based on data from O*NET, a database maintained by the U.S. Department of Labor. It was presumed that virus transmission could occur because of the close proximity between dental professionals and patients and because many dental procedures generate aerosols that may contain viral particles from infected individuals.

This newly-published report, with the extremely low rate of COVID-19 infection among dentists, supports the effectiveness of the recommendations from the CDC and ADA in preventing virus transmission.

The ADA’s guidance calls for the highest level of personal protective equipment (PPE) available—masks, goggles and face shields.

The ADA’s interim guidance also calls for the use of rubber dams and high velocity suction whenever possible and hand scaling when cleaning teeth rather than using ultrasonic scaling to minimize aerosols.

“In light of the revelations from this groundbreaking ADA study, there is no better

time than now to encourage patients to schedule a visit,” adds Illinois State Dental Society President Dr. Alice Boghosian. “Resuming regular dental visits is important because treatment, as well as prevention of cavities and other issues, helps keep people healthy.”

“The fact that dentistry was named one of the most at-risk professions for infection, but has a far lower prevalence of infection compared to other health professions, is not a coincidence,” said Chief Economist and Vice President of the ADA Health Policy Institute Marko Vujicic, Ph.D. “The profession has taken this issue extremely seriously, and it shows. We will continue to track the rate of COVID-19 among dentists and other facets of the pandemic affecting dentistry so it can help inform the dental profession and other industries as well.”

The report is set to be presented at the ADA FDC Virtual Connect Conference, a joint meeting of the ADA and Florida Dental Association, held Oct. 15-17. Don’t Risk A Ticket. Avoid Parking In Spots Reserved For People With Disabilities NAPSI — In the harried competition for close-in spots, normally courteous drivers engage in all kinds of parking taboos, many involving the use of parking spaces designated for the more than 30 million Americans with mobility-impairing disabilities. Fortunately, there are people doing something about it and you can help.

Who’s Doing What Through the nonprofit Accessible Parking Coalition (APC), established by the International Parking and Mobility Institute, a national effort is underway to eliminate disabled placard abuse and make accessible parking more accessible.

What You Can Do Here are seven reminders for every driver: 1. Remember that marked accessible parking spots are for people with

disabilities (the term “handicapped” is outdated and offensive to many).

2. Unless authorized, never park in an accessible parking space—not even for a minute.

3. Never infringe on van-accessible parking spaces, which are designed for ramp- or lift-equipped vehicles. They are marked by signs that say, “Van Accessible” with the international symbol for accessibility. Many drivers using wheelchairs have nightmarish examples of waiting hours for the owners of a car parked too close to return so they could get in their vehicle.

4. Never park, block or leave a shopping cart in the cross-hatched, access aisle zones next to accessible parking spots.

5. Don’t borrow others’ disabled parking placards or use yours after it has expired or is no longer truly needed.

6. Follow the rules, but don’t be

a parking vigilante. If you suspect illegal use of a spot, take a photo of the license plate and contact local law enforcement.

7. Remember that not all disabilities that affect mobility are apparent.

Don’t assume someone is parking in an accessible spot illegally. A person with a respiratory or other ailment that makes walking difficult, for example, may be entitled to a disabled placard.

Eighty percent of people with parking placards agree accessible parking fraud is widespread.

Disabled placard abuse and illegal use of accessible parking spaces are crimes that carry penalties. Many jurisdictions are cracking down, increasing fines—some more than $1,000 per violation—and setting up sting operations to catch offenders.

More Than a Vote: King James Leads Plans to Increase Poll Workers

An effort by pro athletes called More Than a Vote is working to increase the number of poll workers in Black electoral districts has amassed 10,000 volunteers since it began.

State elections officials in many cities have sounded the alarm regarding a shortage of poll workers to handle in-person voting. The ongoing coronavirus pandemic has caused an unexpected problem for local officials. The problem is a bigger issue in Black communities that have far longer wait times to vote than polls in white communities.

The specific plan to increase workers at the polls is called We Got Next. The efforts will include a partnership with the NAACP Legal Defense Fund and was focused on during the first game of the NBA Finals between the Miami Heat and the Los Angeles Lakers. As the national anthem was played for game one, players on both teams knelt and wore shirts with the word “vote” on them in large letters.

The cities that will be focused on feature thousands of Black voters and include Birmingham, Montgomery, Jackson, Houston, Charlotte, Cleveland, Detroit, Flint, Milwaukee and Philadelphia.

A second phase of the initiative would be even more targeted and will be aimed at 11 cities, “where significant poll worker shortages remain.”

Black Art Rising Fund Through the Black Art Rising Fund, LIFEWTR is committing $50,000 to help increase the number of diverse voices speaking their truth through art.

Creators who share their creations using #BlackArtRisingContest and tag @LIFEWTR could be selected by LIFEWTR and special guest judges, including Tobe Nwigwe now through Friday, October 27. Those selected will receive a $500 stipend from the $50k Black Art Rising Fund to finance art supplies for their next great creation, and to be recognized on TheBlackArtRising.com.

Black Art Rising Digital Gallery The gallery, launched recently, is on TheBlackArtRising.com with the prolific expressions of creators: Tobe Nwigwe: a hip-hop artist whose lyrics and tone of music tell the story of a difficult upbringing as a first-generation Nigerian kid in the Alief neighborhood of Houston, TX. He has a singular goal in life: “to make purpose popular.”

Temi Coker: a multidisciplinary artist whose mix of vibrant colors and textures come from his upbringing in Nigeria and love for the African Diaspora. His style focuses on evoking emotion through color, patterns and storytelling.

Reyna Noriega: a visual artist, author and educator who works across a variety of mediums, from graphic design, to painting, digital illustration and photography. Her multidisciplinary practice is devoted to highlighting

and uplifting women, as she tells stories inspired by her culture and experiences, in which women can recognize themselves, feel represented and empowered.

Thomas Evans (a.k.a. Detour): an allaround creative specializing in large scale public art, interactive visuals, portraiture, immersive spaces and creative directing. A born collaborator and “military brat,” he pulls from every conceivable experience that shapes his landscapes and perspectives.

Shae Anthony: founder of “She Is This,” a way to inspire girls and women of color to not just embrace their skin, but celebrate it and everything it comes with through the power of her illustrations. Whether chocolate, vanilla, freckles, moles or anything in between, she reminds others of how amazing their brown skin truly is.

Dr. Fahamu Pecou: an interdisciplinary artist and scholar whose works combine observations on hip-hop, fine art and popular culture. Pecou’s paintings, performance art, and academic work addresses concerns around contemporary representations of Black men and how these images impact both the reading and performance of Black masculinity.

Max Sansing: a fine artist and talented muralist. His distinct aesthetic fuses the color-drenched dynamism of street art with the technical elegance of photorealism. Born and raised by two artistic parents, he found passion and creative gifts early. Involved with several graffiti crews, he taught himself oil painting before completing formal training.

Lauren (Lo) Harris: a digital artist who specializes in illustration and motion design.

Through bright palettes and relational compositions, she creates work that champions vibrance, confidence, humanity and celebrations of a more just and kind world.

How did Lonely Planet rank the 500 best places in the world?

The long list was compiled from all the highlights found in every Lonely Planet guidebook over the years. Each attraction and sight recommended by Lonely Planet authors was included, before being whittled down to a shortlist. Everyone in the Lonely Planet community was then asked to vote on their 20 top travel experiences. With hundreds of votes cast, they ended up with a score for each entry and a definitive ranked list of the top 500 places to see around the world.

Did you take into account those places managing tourism sustainably?

During the scoring process, Lonely Planet used the Sustainable Destinations Top 100 list and cross referenced the site or destination against it. If it was recognized on that forum, the nomination received

bonus points. Additionally, Lonely Planet maintains an in-house list of over-touristed places and sites and any places on that list had a percentage subtracted from their total.

“After seven months of staying at home, now’s the perfect time to start thinking about where and how to travel once normality returns,” Pickard said. “In putting together this book, we were excited by changes in both the ‘where’ and the ‘how’. We added 200 new entries into our list of the world’s Top 500. And we were both surprised and reassured by just how many of the Top 500 are working hard to create more sustainable visitor experiences.”
