Historic power struggle between Trump and Congress reviewed by Supreme Court in the Supreme Court’s ruling in McGrain v. Daugherty in 1927, which established that “the power of inquiry – with process to enforce it – is an essential and appropriate” aspect of how Congress carries out its legislative function.

The Supreme Court heard arguments on May 12 in two cases concerning congressional demands, known as subpoenas, for materials that President Donald Trump claims are intrusions into his private affairs and are not legitimate uses of congressional power.

Another case argued before the court at the same time involves the Manhattan district attorney’s subpoena of records from Trump’s businesses as part of an investigation of state tax law violations. Trump is fighting that one, too.

How the court will rule this summer on these three crucial cases about the limits of executive power was not clear from the questioning by the justices, who did not appear to line up along obvious ideological grounds on the issue.

Not since the “Red Scare” subpoena cases from the 1950s-1960s, where Congress conducted hearings that many called political witch hunts against alleged communists, and the Watergate era in the 1970s, when President Nixon claimed through his attorney that he was “as powerful a monarch as Louis XIV, only four years at a time, and is not subject to the processes of any court in the land except the court of impeachment,” has the Supreme Court taken up such far-reaching questions about the ability of Congress to oversee and check the president’s power.

Either Congress will be able to maintain its historic role of conducting oversight of the president and the executive branch, the president will be able to keep information secret no matter what – or the court will punt and the two branches of government will remain locked in the conflict.

government employees are required to do and whether he accepted gifts from foreign governments without permission from Congress, which is banned by the Constitution. This ban reflected the framers’ concern that no official be subject to foreign intrigue or influence of any kind – a common practice at the time among foreign sovereigns.

The first case, Trump v. Mazars, relates to those investigations. Trump is trying to stop his accountants and the bank he deals with from providing information subpoenaed by two House committees – oversight and intelligence.

Trump objected to these subpoenas on the grounds that they lack a legislative purpose and that their true aim is to obtain personal information for political advantage.

The Court of Appeals rejected this argument. It found that the records the congressional committees wanted were relevant to Congress’ legislative duties, and thus the subpoenas were legitimate.

All subpoenas from, and investigations by, Congress must have a legislative purpose. By law, Congress has the authority to pursue any “subject on which legislation can be had” as well as inquiries into fraud, waste and abuse in government programs.

The broad standard for upholding that investigative power is affirmed

Congress acted appropriately The second case involves House committee subpoenas for Trump companies’ bank records from Deutsche Bank and Capital One. As with the Mazars case, Trump has tried to stop the banks from handing over the documents.

Those subpoenas are related to reviews by the House Financial Services Committee and the Intelligence Committee of the movement of illicit funds through the global financial system and money laundering.

Deutsche Bank, which has loaned large amounts of money to Trump businesses, has already been fined US$10 billion for a money-laundering scheme unrelated to Trump.

The Court of Appeals rejected Trump’s argument and said Congress was legitimately entitled to pursue and get the records.

They wrote that the committees’ focus on illegal money laundering was not on any purported misconduct by Trump but instead on whether such activity occurred in the banking industry, the adequacy of banking regulation and the need for legislation to fix any problems – all legitimate oversight goals.

Nixon, Clinton precedents Neither of these cases involves the president claiming executive privilege – the doctrine that keeps confidential many of the communications between the president and his closest advisers. Nor do the cases involve any challenge to the performance of his official duties.

Both concern only his private business activities before he assumed office. The records from before he

was president are relevant because he refused to divest from his businesses, raising the concern of whether his official actions once in office conflict with, or appear to conflict with, his existing business interests.

Two previous Supreme Court cases will in all likelihood weigh significantly in its decisions in these cases.

One is United States v. Nixon, which took place during the Watergate scandal, when Special Prosecutor Leon Jaworski subpoenaed the tape recordings of conversations between the president and four of his advisers who had been indicted.

President Richard Nixon tried to claim executive privilege, saying the recordings of conversations between him and his advisers were confidential and should not be given to the special prosecutor.

The court ruled unanimously that the need for the tapes in the aides’ upcoming trial outweighed the president’s claim of confidentiality. And although no case applying the Nixon case precedent to a congressional subpoena has reached the Supreme Court, the implication drawn from the case is that if his privilege can be overcome by a subpoena for conversations with his closest aides, business records generated before a president came to office can legitimately be subpoenaed by Congress.

“The ruling rejected what it called the notion of ‘absolute, unqualified Presidential privilege of immunity from judicial process under all circumstances,’ which has an obvious impact on any president under serious suspicion, such as President Trump,” wrote presidential historian Michael Beschloss to a Washington Post reporter in 2018.

The other case relevant to these decisions is Clinton v. Jones. The case stemmed from a sexual harassment suit against Clinton concerning his conduct before his presidency. Clinton had refused to give a deposition in the case, insisting that it would be

a distraction from his duties as president and an invitation to litigants to harass any president while in office with lawsuits.

The case description on the Supreme Court website asks, “Is a serving President … entitled to absolute immunity from civil litigation arising out of events which transpired prior to his taking office?”

The court’s answer: No. Will the court rule?

These two decisions established precedents that seem to portend defeat for President Trump in the upcoming hearing.

Were the Supreme Court to validate Trump’s position in either case, or decline to decide the cases, it would stymie Congress and force it to seek enforcement by arresting those who refused to honor their subpoenas. That’s the way the Senate enforced its subpoena in the McGrain case and how Congress frequently operated in the 19th century.

The court has asked for additional briefing from the parties on whether the cases are not suitable for judicial decision as “political questions.” That legal doctrine says some cases are so politically freighted that the federal court system should not consider them – they should be resolved by the political players.

This has fueled speculation that the court may decide not to referee the dispute using the political doctrine as it has done in other cases involving disputes between Congress and the president over war powers or the disposition of the Panama Canal.

None of this indicates how the court will decide in the cases, only that whatever it decides will be momentous in the annals of congressional disputes with the president.

Study Finds Rising Rate of Mental Health Visits Among Youth to Emergency Departments Continued from page 1 While the number of pediatric emergency department (ED) visits across the nation has remained stable over the last 10 years, visits for mental health disorders have risen 60% and the rate of visits for deliberate self-harm have increased 329%.

In a study published recently in Pediatrics, Nationwide Children’s Hospital researchers looked at the number and reason for mental health-related ED visits.

They also examined the geographic location of EDs and the overall number of children coming to each ED. Previous studies have shown that low pediatric volume EDs and EDs in rural settings are less prepared for all pediatric emergencies, and only one third of rural facilities have pediatric mental health policies or mental health transfer agreements.

Rachel Stanley, MD, division chief of Emergency Medicine at Nationwide Children’s and the study’s senior author said, “We would like children to go to their primary care provider or a psychiatrist, but EDs are the safety net for children with mental health disorders, and we need to be able to take care of them.

Over the 10-year study period, most visits occurred at non-children’s EDs in both metropolitan and non-urban settings. The study looked at children 5 to 17 years old, and data is representative of all U.S. emergency departments.

Findings showed the highest jump in ED visits was among 15- to 17-year-olds (68% increase), and while the rate grew among both males and females, it was more pronounced in girls (74% increase).

Additionally, visits for substance use disorders rose by 75%, with alcohol-related disorders decreasing by nearly 40% and substance use disorders significantly increasing (over 150%). The rate of visits for deliberate self-harm increased 329%.

“Examining the characteristics of EDs that children present to was important because outcomes have been shown to be directly linked to the volume and geographic location of the EDs,” said Charmaine Lo, PhD, MPH, the study’s lead author and senior research scientist in Emergency Medicine at Nationwide Children’s.

identify solutions that will better equip all EDs with the tools, personnel and resources to better manage pediatric cases, particularly those related to mental health. Universal screenings for suicidal ideation, a recent requirement of the Joint Commission, is one step to improving the quality of care for those being treated for behavioral health conditions.

Study authors say telehealth services can also provide an avenue for increasing access to behavioral health specialists who can provide

screening, assist with acute interventions, and support connections to continued care within the community, thereby avoiding long distance transfers, transportation costs and delays in care.

After the outbreak of COVID-19, they’ve become an integral part of everyday life and likely will remain so for the foreseeable future.

Experts claim that people will likely have to wear them until there’s a vaccine, which may take up to a year.

The shift from the world we knew to one where we have to stand six feet apart in line at the grocery store was sudden. So it’s perfectly understandable if you don’t know everything there is about how to navigate in our new normal say the experts at BlackDoctor.org in a news release.

With wearing face masks becoming more of a requirement than a suggestion, we’re here to tell you everything you need to know about doing so in the most effective way.

Here’s a guide on wearing face masks during the COVID-19 outbreak.

How wearing masks helps The most common way the coronavirus is spread is through respiratory droplets that are produced through coughing, sneezing or other acts in person-to-person contact.

The primary reason that wearing masks is so effective against spreading the disease is that they prevent these droplets from escaping and coming into contact with anyone else.

This is the case for medical masks, cloth masks or anything else that covers the mouth and nose This is especially important because a significant number of people who are positive carriers of the coronavirus are asymptomatic—meaning they show none of the listed symptoms—and totally unaware of their status.

A recent study from the University of Hong Kong and the University of Maryland found that people infected with a viral illness leave droplets in the air 30 percent of the time after breathing while not wearing masks. On the other hand, all participants who wore masks blocked nearly 100 percent of the droplets.

Face masks are being recommended (or required) as a way to keep the wearer from infecting anyone they come into contact with.

This doesn’t mean that wearing a mask makes you invulnerable to being infected by someone who isn’t. So it’s essential that everyone still practices social distancing and other measures, mask or no mask.

How to wear masks and how NOT to wear them To be used effectively, face masks should be worn so that they cover both your mouth and nose. If either of them are exposed, that largely defeats the purpose of wearing one in the first place.

Tip: You should always wash your hands before applying or removing a mask to avoid the spread of germs.

Because face masks are new and can sometimes feel inconvenient—for example, when they fog up glasses—people tend to try and find shortcuts. You may have seen—or done— these yourself.

As tempting as they may be, do your best to avoid using these methods. And, whatever you do, don’t cut a hole in your mask because it’s “hard to breathe.”

Where to get masks You may be wondering where everyone’s been getting face masks to begin with. After all, if buying one is something you never thought about before no one can blame you.

Wearing masks will likely become the norm as governments work to lower the number of COVID-19 infections and could even become a mandatory part of everyday life as people get back to work in the future. Hopefully, this guide taught you more about how effective masks are and how to access them so that we can all work together towards a healthier, safer future.

Contemporary Art Inspires Students In Chair Design Competition The principles of contemporary art was the theme that inspired students at Ryerson School of Interior Design to design and build chairs for the 16th Annual Wilsonart Challenges Student Chair Design Competition.

Beyond basic form and function, each design was also informed by how students used expressive and stylistic contemporary elements such as movement, proportion, contrast or balance.

When creating their chairs, students used patterns from the Wilsonart® Laminate Collection.

Wilsonart, a world-class innovator of next generation engineered surfaces, created Wilsonart Challenges, which is both a sponsored class and a competition. During the year-long program, students learn how to design and build a one-of-akind chair, as well as how to prepare for a major trade show.

Each year, a different design school hosts #WilsonartChallenges.

This year, Wilsonart worked with The Ryerson School of Interior Design and with the University’s Creative Technology Lab at FCAD, an advanced technology-based workshop that supports creative research, specialized curriculum and entrepreneurship activities across all nine FCAD Schools and Ryerson Zones. It is the first year Wilsonart Challenges has been held at a school in Canada.

Amy Yan won the 2020 competition with her design “THE NOT LOVESEAT.” Her chair is a playful commentary on the dualistic nature of both human relationships and architectural volumes. The two curved seat backs appear to be under significant tension as though the chair is being stretched apart by the sheer volume that make up the

two seats.

The resulting image could be a heart or viewed as a peace symbol suggesting that the chair embraces the dualities of love and peace along with the notions of splitting and separation. Amy’s chair poses a fundamental question; can these seemingly opposing notions exist together? Going a step further, can they even exist without each other as conflicting as they may seem?

The judges noted that Amy’s chair was the perfect dialog between art and design.

“Ryerson emphasized hands on knowledge of materials more than any other school we have ever seen.

The result is the outstanding quality in craftsmanship of the final chairs,” noted Grace Jeffers, design historian and Wilsonart Challenges program director.

Northern Trust Provides $100 Million in Small Business Support Northern Trust Corporation (Nasdaq: NTRS) recently announced that it is providing $100 million in low-cost funding to assist Community Development Financial Institutions (CDFIs) as they provide loans to small businesses and non-profit organizations under the federal Paycheck Protection Program (PPP).

“This funding in response to the COVID-19 pandemic will help meet urgent demand among small businesses and non-profit groups,” Chairman and Chief Executive Officer Michael O’Grady said. “Since 1995, we have provided capital to CDFIs with flexible terms and low rates to facilitate lending in underserved communities,” O’Grady continued in a news release.

Under the CARES Act, the PPP facilitates bank loans to small businesses guaranteed by the Small Business Administration to help cover payroll and other expenses during the COVID-19 pandemic. CDFIs provide loans, investments, financial services and technical assistance to

underserved populations and communities.

“These investments facilitate the rapid deployment of PPP loans to small businesses and non-profit organizations by providing low cost capital to bridge the timing between the making of loans and reimbursement by the Small Business Administration,” said Connie Lindsey, head of corporate social responsibility and global diversity, equity & inclusion. “In turn, the funds will assist the small businesses that form an integral part of our communities.”

For those small businesses that are not able to access PPP loans, Northern Trust is investing in CDFIs that provide small business loans through state COVID19 small business loan pools, such as the Illinois Small Business Emergency Fund and the San Francisco Hardship Emergency Loan Program.

This investment is aligned with Northern Trust, donating $3 million to support organizations serving those directly affected by the pandemic.

State Rep. Justin Slaughter, D-Chicago, is encouraging students who are interested in seeking higher education to apply for the Illinois Legislative Black Caucus Foundation (ILBCF) Scholarship.

For over 15 years, the ILBCF scholarship has served as a gateway to higher education for countless young adults who may have not been able to attend without it.

The deadline for the 2020 ILBCF Scholarship has been extended from Monday, May 1 to Thursday, June 4. The scholarship awards recipients $1,000 to use toward furthering their academic careers. The application is open to students who are Illinois residents and have been accepted or are currently enrolled at a community college, university or vocational school. HEROES Act voted on in the House, awaits Senate

On May 15, the United States House of Representatives voted in favor of a bill, introduced by House Democrats that would provide one trillion dollars in funding to state and local governments.

The bill H.R 6800, called the HEROES Act, was lauded by Democrats and was the fifth relief package for Americans in the wake of the COVID-19 pandemic. Previous legislation included the Payment Protection Program and Health Care Enhancement Act, the Coronavirus Aid, Relief, and Economic Security Act, Families First Coronavirus Response Act and Coronavirus Preparedness and Response Supplemental Appropriations Act. The HEROES Act would include a $200 billion Heroes’ Fund for essential workers, $75 billion for testing, tracing and treatment, extend the $600 weekly federal unemployment payments through next January, as well as protect people losing their employer-provided health insurance with COBRA subsidies and create a special enrollment period in the Affordable Care Act exchanges for uninsured Americans.

In a call with reporters, U.S. Congressman Bobby L. Rush, D. Dist 1, along with Congressman Mike Quigley, D. Dist. 5, spoke about the importance of the bill and how it would benefit residents in his community.

“As Chairman of the Energy Subcommittee, I am also proud to see that this bill provides relief to ensure that millions of American[s] are able to keep their water running and their lights on during this pandemic, including $1.5 billion in additional funding to LIHEAP, the largest energy assistance program in the country,” he said.

Other provisions in the HEROES Act include contact tracing, something Rush said is necessary in stopping the spread of COVID-19 in black and brown communities, which have been hardest hit by the virus.

“I am admittedly concerned that the provisions included in the HEROES Act – specifically, the contract tracing provisions – do not go far enough to protect African Americans and other communities

that are being most impacted by the virus.

However, I remain committed to working with leadership to strengthen these policies, which are fundamental to safely reopening the economy,” he said.

On May 1, Rush introduced H.R. 6666, the COVID-19 Testing, Reaching and Contacting Everyone (TRACE) Act. This bill would establish a grant program run by the Centers for Disease Control and Prevention to mobilize testing and contact tracing efforts.

Intended grantees would include Community Health Centers, School Based Health Centers, academic medical centers, non-profits, as well as other entities who would hire and train individuals to operate mobile testing units, as well as do outreach in hot spots and

medically underserved areas.

Quigley said he supported the HEROES Act because it provides the assistance workers and families are currently in need of.

“We know that essential workers can’t afford to wait for support and families can’t afford to wait to put food on their tables.

While Republicans say they feel no urgency, House Democrats have presented an ambitious path forward in our fight against coronavirus and are providing a lifeline to impacted families and individuals,” he said.

“I’m proud of how members of my community have stepped up to support each other and do their part to stop the spread. Passing the Heroes Act would show the American people that Congress is doing our part, too.”

Illinois Health Facilities Required To Allow Support Persons For People With Disabilities The Illinois Department of Public Health (IDPH) recently released new guidance to help families support their loved ones with developmental disabilities. Persons with disabilities can rely on reasonable accommodations in Illinois hospitals during their treatment, which is more important than ever during the COVID-19 pandemic.

Friday’s announcement from IDPH clarifies and strengthens a previously issued bulletin on non-discrimination in health care.

Hospitals and health facilities should allow individuals with intellectual and developmental disabilities (I/DD) to be accompanied by a support person, such as a guardian, family member, caregiver, or paid support worker during their time in the hospital.

“It’s critical that individuals with intellectual and developmental disabilities can effectively communicate with healthcare workers when they are in hospital settings,” said IDHS Secretary Grace Hou. “Although serious social distancing and other COVID-19 related precautions are still in effect, people with disabilities deserve access to excellent health care, which often requires a support person.”

“This guidance brings protection for patients with disabilities and their families during this critical time,” said Allison Stark, director of the division of developmental disabilities at IDHS. “I hope many people can now sleep a little bit easier knowing they have this support in these uncertain times.”

Without effective communication between medical providers and people with intellectual and developmental disabilities, medical providers risk substituting misplaced assumptions and potential biases about the person with a disability for verifiable information and medical history.

In addition, effective communication leads to better transparency in process and protocols, which helps to ensure that the medical provider and the person with a disability understand each other and agree.

The IDPH guidance asks hospitals to establish a protocol that allows at least one support person to be present with any individual with I/DD in a hospital emergency room and to accompany individuals admitted to the hospital.

For hospitalized patients, especially those with prolonged hospitalizations, the individual or legal guardian should be allowed to designate two different support people.

The support person should always adhere to hospital policies and wear a designated identification tag provided by the hospital.

Specifically, support persons must wear hospital-provided Personal Protective Equipment, as directed, and comply with all hospital infection control procedures.
