Springfield — Two former Illinois state senators have a “clear right” to receive portions of their legislative salaries that were withheld by Illinois Comptroller Mendoza and her predecessors, a Cook County judge recently decided.

But Mendoza said she intends to appeal the ruling, meaning this latest development is likely not the last word in the case brought by former Democratic Sens. Michael Noland, from Elgin, and James Clayborne Jr., from Belleville.

Judge Allen Walker’s decision found that Noland and Clayborne are entitled to the salaries that were withheld when the legislature passed laws to freeze cost-of-living increases and implement furlough days.

Walker’s ruling was based partly on a July 2019 decision in this case that found those laws were unconstitutional because the laws altered wages during terms for which the lawmakers were elected. “(P)er the July 2, 2019 Order, this (c) ourt held that (Noland and Clayborne) were

entitled to a clear right to receive wrongfully withheld portions of salaries, as the relevant statutes in this case are facially unconstitutional,” Walker’s eight-page ruling states.

“Therefore, the (c)ourt finds that (Noland and Clayborne) have established a clear right.”

The ruling is a victory for Noland and Clayborne, who sued the state comptroller over unpaid wages resulting from those laws, which were passed between 2009 and 2017.

Noland first sued in June 2017 and Clayborne was added to the lawsuit in May 2018.

On July 1, 2019, lawmakers’ base salaries increased to $69,464. Before that latest increase, the base salary was unchanged at $67,836 since 2008.

Noland was a member of the Senate from 2007 to January 2017, and Clayborne was a member from 1995 to January 2019. Noland is now a judge in Kane County, and Clayborne is a partner at Clayborne & Wagner LLP in Belleville.

In a written statement, Mendoza said she “respectfully” disagrees with Walker’s decision and intends to appeal to a higher court “so I can continue to defend taxpayers’ interests against this brazen money grab.”

She also noted that Noland and Clayborne voted in favor of the laws to forgo pay increas-

es prior to challenging their legality in court.

“Now that they are out of office, these shameless grifters want the courts to reverse their votes, reaching into taxpayers’ pockets to give them those retroactive raises,” Mendoza’s statement read. “Taxpayers already paid their salaries and are on the hook for potentially millions of dollars for these two men’s pensions. Greed and Gluttony are sins. The former senators should end their shameless crusade to take from taxpayers the raises they voted to decline.”

Although Walker found Noland and Clayborne can seek their withheld salary, he ruled that this finding does not apply to all members of the Illinois General Assembly whose salaries were withheld.

He based this finding on the fact that no other members of the legislature were named in this lawsuit, and both former Senators brought this case as individuals, not in their official capacity as lawmakers.

Lawyers for Mendoza argued that the lawmakers’ case was barred by the five-year statute of limitations that applies in most civil cases. They claimed Noland should have filed his lawsuit before June 2012, and Clayborne’s claims should have been brought before May 2013.

They also argued that Mendoza has discretion to determine when these salaries are to be paid and that since the potential payments could be significant, she should have discretion to prioritize the payments of the state’s debts.

Specifically, they pointed to the language in the state constitution that the comptroller “shall maintain the State’s central fiscal account, and order payments into and out of the funds held by the Treasurer.” The words “shall maintain” indicate discretion to the comptroller, Mendoza’s lawyers argued.

Walker disagreed with both points.

He ruled that the lawsuit from Noland and Clayborne is not time barred because the statute of limitations in this case began to accrue in July 2019, when the laws were found unconstitutional, and not when the relevant laws took effect.

He also ruled that the phrase ‘shall maintain’ is a “specific instruction” that is “contrary to the idea that the (comptroller) has discretion in determining when these payments are to be made.”

Michael Scotti III, an attorney from the Chicago-based firm Roetzell & Andress, represents Noland and Clayborne. He did not respond to requests for comment by deadline.

Trump, defying custom, hasn’t given the National Archives records of his speeches at political rallies

BY SHANNON BOW O’BRIEN Public figures live on within the words they are remembered by. To understand the effect they had on history, their words need to be documented. No one is absolutely sure of exactly what Abraham Lincoln said in his most famous speech, the Gettysburg Address. Five known manuscripts exist, but all of them are slightly different. Every newspaper story from the day contains a different account.

In the case of modern presidents, for the official record, we rely upon transcriptions of all their speeches collected by the national government.

But in the case of Donald Trump, that historical record is likely to have a big gap. Almost 10% of the president’s total public speeches are excluded from the official record.

And that means a false picture of the Trump presidency is being created in the official record for posterity.

Saving the records In 1957, the National Historical Publications Commission, a part of the National Archives that works to “preserve, publish, and encourage the use of documentary sources … relating to the history of the United States,” recommended developing a uniform system so all materials from presidencies could be archived. They did this to literally save presidential records from the flames: President Warren G. Harding’s wife claimed to have burned all his records, and Robert Todd Lincoln burned all his father’s war correspondence. Other presidents have had their records intentionally destroyed, such as Chester A. Arthur and Martin Van Buren.

So the government collects and retains all presidential communications, including executive orders,

announcements, nominations, statements and speeches. This includes any public verbal communications by presidents, which are also placed as public documents in the Compilation of Presidential Documents.

These are part of the official record of any administration, published by the Office of the Federal Register, National Archives and Records Administration on a weekly basis by the White House press secretary. In most presidencies, the document or transcript is available a few days to a couple of weeks after any event. At the conclusion of an administration, these documents form the basis for the formal collections of the Public Papers of the President.

As a political scientist, I’m interested in where presidents give speeches. What can be learned about their priorities based on their choice of location? What do these patterns tell us about administrations?

For example, Barack Obama primarily focused on large media markets in states that strongly supported him. Trump went to supportive places as well, including small media markets like Mankato, Minnesota, where the airport was not even large enough to fly into

with the regular Air Force One. Presidential speeches often give a very different perception of an administration. Without all the pageantry, you can quickly get to the point of the visit in the text.

In speeches that President George W. Bush gave in the 2002 midterm election period, he made the same joke more than 50 times as his icebreaker.

He would apologize that audiences had drawn the “short straw” and gotten him instead of Laura. His commitment to that joke gave a glimpse of his desire to try to connect to an audience through self-deprecating humor.

I found something odd when I began to pull items from the compilation and organize my own database of locations for the Donald Trump administration. I was born and raised in Louisville, Kentucky, and I pay attention to my home state. I knew that on March 20, 2017, Donald Trump held a public rally in Louisville, where in a meandering speech he touched on everything from Kentucky coal miners to the Supreme Court, China, building a border wall and “illegal immigrants” who were, he said, robbing and murdering Americans.

But when I looked in the compilation in mid-2017, I couldn’t find the Louisville speech. No problem, I thought. They are just running behind and they will put it in later.

A year later, I noticed the Louisville speech was still not there.

Furthermore, other speeches were missing. These were not any speeches, but just Trump’s rallies. By my count, 147 separate transcripts for public speaking events are missing from Trump’s official presidential speech records. That’s just over 8% of his presidential speeches.

What’s in, what’s out The Presidential Records Act, first

passed in 1978, says administrations have to retain “any documentary materials relating to the political activities of the President or members of the President’s staff, but only if such activities relate to or have a direct effect upon the carrying out of constitutional, statutory, or other official or ceremonial duties of the President.”

An administration is allowed to exclude personal records that are purely private or don’t have an effect on the duties of a president.

All public events are included, such as quick comments on the South Lawn, short exchanges with reporters and all public speeches, radio addresses and even public telephone calls to astronauts on the space shuttles.

But Trump’s large public rallies, and what he said at them, have so far been omitted from the public record his administration supplied to the Compilation of Presidential Documents. And while historians and the public could get transcripts off of publicly available videos, that still does not address the need to have a complete official collection of these statements.

Federal law says that presidents are allowed to exclude “materials directly relating to the election of a particular individual or individuals to Federal, State, or local office, which have no relation to or direct effect upon the carrying out of … duties of the President.”

The law has been interpreted to mean an administration could omit notes, emails or other documentation from what it sends to the compilation. While many presidents do not provide transcripts for speeches at private party fundraising events, rallies covered by America’s press corps likely do not fall under these exclusions.

Why does it matter?

Government documents are among the primary records of who we are as a people.

These primary records speak to Americans directly; they are not what others tell us or interpret to us about our history. The government compiles and preserves these records to give an accurate accounting of the leaders the country has chosen. They provide a shared history in full instead of an excerpt or quick clip shown in a news report.

Since 1981, the public has legally owned all presidential records. As soon as a president leaves office, the National Archivist gets legal custody of all of them. Presidents are generally on their honor to be good stewards of history. There is no real penalty for noncompliance.

But these public documents, which I work with constantly, have so far always been available to the public – and they’ve been available quickly. Internal presidential documents like memos or email have a rigorous archival procedure that lasts years before they are even accessible. I have a record of every presidential speech from 1945 to 2021 – every president since Clinton has all their public speeches available online. Until President Trump, there have been no missing public speeches in the permanent collection. By removing these speeches, Trump is creating a false perception of his presidency, making it look more serious and traditional.

And by the way: That 2017 Louisville speech is still missing from the records in 2021.

NEWS Redefining ‘Summer School’: How Year-Round Learning Can Shape K-12 Education

(NAPSI)—Each day, as people across the country wake up and check their phones, turn on their morning news broadcast, or unfold their local papers, one clear message stares back at them: the COVID-19 pandemic is changing the trajectory of education. Fortunately, whether that change is for better or for worse can be decided by families and students themselves—and year-round learning is one trending approach that may be here to stay.

Year-round learning is not a new concept in K-12 education and the benefits are noteworthy.

Students who stay academically engaged over the summer can get ahead in challenging subject areas, explore or expand upon their interests and build the confidence that they need heading into a new school year.

As the nation recovers from a global pandemic and the subsequent shockwaves it sent through the education system, these benefits are particularly compelling: many students need an opportunity to catch up, reengage or solidify critical skills that may have been jeopardized during the academic fallout of the COVID-19 crisis.

Kelsey Lichtenstein, founder of Aspen Learning Lab in Los Angeles, Calif., has been serving families in Southern California and throughout the United States for nearly 20 years. Lichtenstein noticed widespread concerns about learning loss due to the pandemic but she is confident that summer learning opportunities can serve as one solution for many students and families.

“In some places students have not gone back to school in person yet,” Lichtenstein said. “As a result, many students need to catch up, or for younger students, get extra help building key foundational skills in reading and math.”

Engaging students as they build those early skills in reading and math is paramount: they provide the foundation for the rest of a student’s academic career and shape them well into their adult lives. Lichtenstein says that the primary challenge for educators is generating that engagement in the first place, and finding a program with a wide variety of courses and engaging content is crucial to achieving that goal.

“Engagement comes in many forms, and one of the ways we engage students is through content and connection. We have to ask ourselves, ‘How does this curriculum relate to real life?

How does it connect?’,” Lichtenstein said.

For students in middle school and high school, year-round learning can also help them overcome unique academic gaps. Angela Ling, 16, of Rockville, Md., is a junior at Laurel Springs School who enrolled in the school’s summer program because she had recently moved to the United States from Canada. The curricular differences between the two countries meant she was technically behind in the areas of science and math.

“In Canada, science and math classes are taught generally, rather than by topics such as biology or calculus,” explained Ling. “As a result, in 10th grade, I was behind in a few courses in the U.S. curriculum. Thankfully, I had the ability to take

Honors Geometry and Honors Chemistry over the summer, and I caught up for 11th grade.”

For other students, the opportunity to get ahead in their studies drew them to summer learning. Mia Hanflig, 16, of East Falmouth, Mass., is an emerging performing artist who aspires to become a professional dancer. Through her year-round approach to learning, Hanflig aims to graduate early.

“I can work at my own pace and complete additional courses in the summer to get ahead before the next school year,” said Hanflig. “By taking summer classes, I have the potential to graduate early while still finishing all the mandatory credits. The extra time I have gained from being a student at Laurel Springs let me more easily attend prestigious intensives and competitions furthering my performance experiences in preparation for a career. ” Encouraging students like Hanflig to pursue their passions and interests is a cornerstone of Laurel Springs’ philosophy and another unique benefit of year-round learning as a whole: exploring new subject areas, especially through electives.

“We are always trying to spark curiosity and foster discovery, which is a huge benefit of learning over the summer,” said Lichtenstein. “It provides students with opportunities to explore other subjects and interests that they might not be exposed to during the traditional school year, keeping things fresh in their minds, engaging them in their learning and encouraging discovery, which are all very important. It doesn’t necessarily have to be geometry or physical sci-

ence: There are other ways to stay academically engaged and continue learning, and that’s what I’d like to inspire in students.”

As year-round learning becomes a more common practice following the pandemic, students may also find it helps them foster self-advocacy and important social-emotional skills that will help them both in school and in their professional lives.

Olivia Manson, 14, of Chicago, Ill., says: “Online school allowed me to grow more independent and responsible for my work ethic and the accelerated summer courses I took last year helped me with time management. By making my own decisions, I feel a great sense of achievement.”

Incorporating summer courses into the larger picture of K-12 education should no longer be seen as a punishment or remediation effort but as an opportunity to stay academically engaged without sacrificing the rest, relaxation and recreation that normally accompanies the summer season. With a strong foothold in their coursework and ownership of their learning as they venture into the next grade level, students may find that learning beyond the traditional school year will let them adapt to, and advance in, a swiftly changing educational landscape.
