Statewide emergency measures gave way to innovative uses of parking spaces during the pandemic on downtown streets, but with the removal of those allowances, city leaders are looking for new opportunities to reclaim peninsula space from the state Department of Transportation (DOT).

Under the state of emergency, stateowned roads were given some leeway for special uses during the pandemic. One such way Charleston restaurateurs took advantage of this was the conversion of on-street parking spaces for outdoor dining — parklets. The pop-up urbanist experiments had found successes in other cities before being brought into the peninsula outside Babas on Cannon and Cutty’s on Bogard Street, both of which were well-used and enjoyed while in operation.

Now, the two parklets are gone — a result of the end of some pandemic-era safety measures levied by the state — and since the spaces they once occupied are owned and operated by the DOT, the city’s hands are tied.

Permanent parklets would be built differently from the pandemic-era temporary versions — on platforms and featuring planters for safety and aesthetics of the city’s Department of Traffic and Transportation. “It’s a large governmental list of what is allowable on their roads and what isn’t. One that isn’t is forprofit enterprises, so that automatically dismisses parklets.”

But Charleston Mayor John Tecklenburg and other local officials are looking to reclaim downtown streets and parcels for city use.

“We’ve asked for a report from Traffic and Transportation,” Seekings said. “What does it really mean for the city to take back a particular block or street? What does it cost in terms of maintenance? What is it actually costing us annually? My suspicion is that it’s a fairly small number.”

But it isn’t just about cost. Vince

Graham, a local developer whose work includes the new urbanist I’On community in Mount Pleasant, said it’s simply easier to maintain than change the way whole city blocks are kept.

“The status quo doesn’t like to be subverted and will use various tactics to maintain it,” Graham told the City Paper in an email.

“Various forms of fear propagation are usually the main tactic. Get a small group organized to say things like, ‘We can’t relinquish a few sacred parking spaces because our business will die;’ ‘It’s unsafe! A truck will run into street diners;’ and ‘Undesirables will make noise;’ and the majority of elected officials, being fickle creatures of the moment, CONTINUED ON PAGE 6

Civil rights groups prepare legal action over new congressional map The S.C. Senate on Thursday approved a new map for congressional districts that some advocacy groups and political leaders call “blatant gerrymandering,” leading many to predict federal legal challenges when districts become law.

Over the last few months, leaders in the General Assembly have reshaped S.C. House, Senate and congressional districts by drawing new lines to account for population shifts in the 2020 census.

This reapportionment of district lines is required every 10 years after the census.

Senators approved a plan on Jan. 20 that would heavily favor Republicans in six of seven congressional districts, despite a Democratic proposal to have four GOPleaning districts, one Democratic-leaning district and two competitive seats.

“This is a method of election that’s nothing new,” former congressman and current S.C. gubernatorial candidate Joe Cunningham said at a Jan. 17 press conference. “It’s called gerrymandering. Incumbent lawmakers get to draw their own district lines to their own advantage, making it virtually impossible for them to lose their elections and ensuring one-party rule.”

Senate Republicans point to similarities between the new map and current district lines as a strength of the proposal. S.C. Sen. Chip Campsen, R-Charleston, on Thursday said the

proposal with the least amount of change adheres to traditional redistricting principles by retaining constituent consistency and preserving the cores of congressional districts.

Charleston, which currently is in the 1st Congressional District, has grown more competitive in recent years, having elected Cunningham, a Democrat, in 2018, and Nancy Mace, a Republican, in 2020. But with the new map, Charleston would be removed from the 1st District and placed in the 6th District, a majority-minority district currently held by U.S. Rep. Jim Clyburn.

The shift would make the 1st District more favorable to Mace and the GOP. About 54% of voters in the newly proposed 1st District voted for Republican Donald Trump for president in 2020, about 2 percentage points higher than the district’s current makeup, according to a report from Associated Press.

The American Civil Liberties Union (ACLU) of South Carolina previously sued the state in December, citing the state’s “delayed redistricting process, which largely avoided public input and left electoral districts wildly out of proportion just months before election season” in a tweet posted Dec. 24.

Now that the congressional map has been approved by the Senate, it is one step closer to seeing legal action.

“The ACLU and the NAACP [National Association for the Advancement of Colored People] are already in court over redistricting on issues of transparency and the [S.C.] House map, which is terrible,” said Lynn Teague, a vice president with the League of Women Voters of South Carolina. “All they have to do is add the congressional map to the lawsuit Teague once it’s decided on.”

The ACLU did not respond to requests for comment.

The Senate made minimal changes to the House-proposed congressional map, so the proposal now heads back to the House for approval, but there may be another step in the process.

“I believe the congressional lines approved by the House and those approved by the Senate will most likely have to go to conference committee,” said S.C. House Speaker Pro Tempore Tommy Pope, R-York.

The committee would then hammer out the differences between the two maps and send it back to both chambers for final approval before sending it to the governor to sign. —Skyler Baldwin

State Rep. Spencer Wetmore struck a conciliatory tone Jan. 19, as the Folly Beach Democrat delivering the party’s response to Gov. Henry McMaster’s annual State of the State address.

“If you tuned in tonight, hoping for an over-the-top partisan attack on the governor, this may not be your speech,” she said as she opened her remarks.

Wetmore, 39, is a former state prosecutor and served as administrator for Folly Beach for five years before she was elected to represent the 115th District in 2020.

The first-term representative’s remarks called Wetmore on McMaster to help make South Carolina a better place for all its residents and reject partisanship.

McMaster spent much of his speech touting economic gains during the pandemic, including job growth and capital investment. South Carolina’s overall economic stability mirrors conditions nationwide, despite pronounced inflation in some sectors, as the pandemic stretches into its third year.

McMaster also gave a nod to hot-button education topics for conservatives that made headlines in recent months, including controversies over a coming-of-age graphic memoir.

The governor mentioned reforming education funding, but not through the repeal of property tax exemptions which many advocates say contribute to state schools getting shortchanged. Instead, McMaster plugged Republicans’ latest voucher reinvention, which promises to make taxpayer money “follow students directly to the classroom,” including at private institutions.

In her response, Wetmore was unequivocal on education funding.

“You can’t fix schools by defunding them, and we must reject this latest voucher bill,” she said.

“It takes money out of our public school system to fund private academies. I have no objection to private schools, but public money should be spent on public schools.” —Sam Spence

Charleston coalition seeks alternative to proposed sea wall A group of local leaders, environmental and preservation advocates, engineers, business owners and concerned citizens have formed the Charleston Water Coalition (CWC) in an effort to protect downtown Charleston from rising tides and floodwaters.

and CWC spokesperson Marie Delcioppo said much of the public lacks an understanding of what the PED phase is: a commitment of forward momentum with little adjustment to the planned wall.

The coalition, she said in a Jan. 25 press release, seeks to provide a more clear pic-

ture of what the project actually commits taxpayers to.

“As has been suggested in the Dutch Dialogues, that perimeter protection must be multifunctional and beautiful, that any perimeter protection must be logical, practical and forward looking,

and that alignments must take a multibenefit approach,” Delcioppo told the City Paper. “To advance a no-regrets approach, and before any further steps are taken regarding this single-purpose linear wall, all options must be considered and agreed upon.” —Skyler Baldwin

will fold like a house of cards.”

But Seekings said he is willing to do the work.

“I would be very much in favor of taking that one block on Cannon Street back,” he said. “If you look one block to the west, it’s city-owned, and the block where Babas is owned isn’t. It’s a checkerboard. It would be nice to have some consistency, especially in that corridor. It would give us some flexibility going forward to do other things like outdoor dining.”

And he isn’t alone on council either.

“While the overall relationship with the state DOT is a positive one, we do have some unique circumstances in Charleston where it does create some complications and challenges when it comes to making unilateral Sakran decisions about our streets and roadways,” Councilman Jason Sakran told the City Paper. “As far as the parklets are concerned, I was supportive from the onset and thought the two parklets we had in place were positive additions to our streetscape and were good for business. We should continue to explore additional outdoor dining concepts such as parklets.”

If the city is able to reclaim space from the DOT, the next step to permanent parklets on the peninsula would be consistency of regulation and design.

“Under the emergency measures we allowed some pretty relaxed requirements,” said Robert Summerfield, Charleston’s director of planning, preservation and sustainability. “Where you see these existing as permanent programs in other communities, the parklet has more substance to it — often built on platforms making them even with the curbing or on a pallet concept so they can be moved from the parking spot if necessary.”

“We aren’t looking to reinvent the wheel,” he said. “The concept of parklets have been successful in many communities, so we will probably be doing some continuing research into that and adapting it to the Charleston aesthetic.”

Seekings said that this process, while already underway, has hit a few snags due to the pandemic. Committees are understaffed, and pressure to work on other projects and from other angles has kept other city officials distracted, he said. “But this needs to go to the top of the priority list because this is important.”

“As we maneuver through the process and through COVID, outdoor dining and parklets were two positive things we did as a city, and we need to build and capitalize on those and get to a point of permanency and predictability.”

Blotter of the Week

RUNNERS UP A man smoking a pipe of weed in his car in a King Street parking garage told officers he was in town for a wedding and that he was sorry for smoking. Hey, man, we get it; weddings are stressful, but maybe next time stay in your hotel room.

A James Island woman told officers her apartment had been broken into, and her red jacket and phone had been stolen. She said it was only worth $35, but it was her favorite jacket and she would really like to have it back.

Sometimes these reports are less funny and more just sad, like this dude getting drunk and going to his ex-girlfriend’s house to beg for her back. We hear there’s a sale on ice cream, buddy.

uch of Charleston City Paper’s journalistic work, from compiling the weekly Blotter police news summary to covering the dysfunctional school board, depends on state public records statutes. Unfortunately, some local law enforcement agencies are failing to follow state law on open records. Our governments — and transparency laws that hold officials accountable — exist to protect and serve the people. All agencies must follow the law. Full stop.

The City Paper recently experienced firsthand how local police are skirting state open records laws. For months, the paper has been embroiled in an unnecessary, annoying and disappointing spat with the Charleston Police Department (CPD).

After the October 2021 retirement of the department’s longtime public information officer, CPD abruptly removed access to recent incident reports as required under the state Freedom of Information Act (FOIA).

South Carolina’s FOIA requires public bodies to disclose certain information relevant to public officials’ use of taxpayer money and resources, including meeting minutes, spending, jail logs and more.

Among the requirements is for local law enforcement agencies to make available at least two weeks of reports detailing alleged crimes. The reports must be supplied for inspection without a written request when visiting departments in person.

For years, City Paper reviewed reports weekly as the foundation for each issue’s Blotter column, which chronicles mundane and sometimes bizarre police work in the city of Charleston. In many ways, reporting on these incidents showcases the absurdities that police officers experience, which builds empathy for their tough jobs. Now and then, reporters also discover local notables accused of crimes or involved in legal disputes.

The City Paper’s Blotter is a popular humorous weekly collection of drunken antics, bumbling thieves and other weird stuff. But in reality, the Blotter is only possible because of state public records laws that allow citizens to hold public servants accountable.

“It is vital in a democratic society that public business be

performed in an open and public manner,” the introduction of the state FOIA statute reads. The law exists to “make it possible for citizens, or their representatives, to learn and report fully the activities of their public officials at a minimum cost or delay to the persons seeking access to public documents or meetings.”

To regain access to the reports, a city attorney first wanted the newspaper to sign an agreement that would have put unreasonable limits on the ability for our reporters to report. We refused.

At that point, our options were to take CPD to court and have a judge tell the department to turn over the reports, or try to reach an agreement privately. To avoid the headache and high cost of litigation, we chose the latter option. We are thankful again to be able to report the Blotter, but wish it did not come to this. In fact, CPD needs to remove the shackles it currently places on public information.

Unfortunately, CPD isn’t the only law enforcement agency ignoring FOIA. We ran into issues requesting similar reports from police in North Charleston, Mount Pleasant and Sullivan’s Island.

“Police departments and school districts routinely ignore the law,” said Jay Bender, a retired Columbia media attorney. “These situations highlight the arrogance of public officials who seem to believe they are our rulers and not our representatives.”

For some agencies, it’s an issue of time and resources. For others, it’s plain ignorance. But the law is the law, and it has been for more than 40 years in South Carolina.

“The public pays for the creation and availability of public records, and an agency committed to public service would not use cost as an excuse for failure to follow the law or a barrier to citizen access,” Bender said.

Agencies must reexamine policies to ensure public servants follow the law. To do otherwise is to break the law they’re supposed to uphold.

Be careful about fiddling with income taxes By Andy Brack The monkeyshines about income taxes are on full display again at the Statehouse. But anti-tax advocates are playing with fire, selling a dangerous brew that could hurt regular people, increase risk and help wealthier people who already get pretty favorable tax treatment.

Of the $10.9 billion in general tax revenue projected for 2022-23, just over half — $5.53 billion — comes from one source, individual income taxes.

Combined with sales taxes, which generate about $3.7 billion, 84% of the state’s overall general fund revenues are based on these two state taxes.

Most tax-obsessed politicos ignore how South Carolinians have a comparatively low tax burden, ranking 42nd in the country, according to the Tax Foundation. Most ignore there are too many exemptions for sales and income taxes, costing billions in unrealized revenues to the state. Most ignore the tax bases are too narrow, which means lots of stuff just isn’t subject to taxes.

And because of the narrow bases for many state taxes, our rates are comparatively high.

What Republicans in the Statehouse want to do is lower the rates without broadening the bases.

If successful, the amount of money in always poor South Carolina would likely go down or stagnate, when billions are needed to catch up on education, health care and boosting opportunities for small businesses. (Republicans often argue that “growth” will make up for lowering tax rates, but what if they’re wrong and there’s another downturn? Then a bad situation gets worse.)

“Every time the state’s economy is healthy and growing, which is never a permanent state, the tax-haters are out with their knives ready to make permanent cuts in taxes,” said retired Clemson University economist Holley Ulbrich, who has researched and written about state and local tax policies for years. “And always income taxes, because those are the taxes paid by their favorite constituents, the ones who contribute to their campaigns and hang out in the same social circles.”

She said South Carolina ranked 40th in taxes as a percent of income. And in per capita revenue, the state is poor, ranked 48th among the 50 states. People don’t want to hear it, but look at the schools, roads, bridges and other infrastructure.

“We are undertaxed and underserved relative to our peers,” Ulbrich said. “The income tax specifically takes 1.94% of personal income and yields $972 per capita. In Georgia, it is 2.37% of income and $1,108 per capita. In North Carolina, it is 2.78% or $1,215.

“You would think our very low income taxes would have given us a comparative advantage by now in attracting economic development compared to our two neighboring states, but not so.”

State Sen. Mike Fanning, D-Fairfield, believes the tax system needs to be fairer, but supports a drop of the top income bracket from 7% to 6% over five years, which the GOP has proposed.

“The goal should be to tax everybody and everyone but do it at the lowest rate possible,” he told Statehouse Report, City Paper’s sister publication.

But the smarter and fairer way to deal with taxes, he said, is to reform the whole taxing structure at one time, not make targeted cuts hither and yon.

For example, South Carolina loses more than $3 billion a year because it has about 100 specialinterest exemptions for sales taxes. And state law provides the taxing of about three dozen types of services of the 175 that could be taxed.

State lawmakers would do better to invest significant time in making comprehensive tax reform instead of risking unintended consequences from wantonly cutting income tax rates, our largest and most reliable revenue source.

But South Carolina media attorneys and the state Freedom of Information Act (FOIA) agree: Charleston Police Department is not following the letter of the law on police incident reports.

City Paper reporter usually walks into the Charleston Police Department (CPD) once a week to jot down details from recent incident reports for the next issue’s Blotter, a weekly feature that highlights some of the odd things encountered by police.

But in October 2021, our reporter was turned away — the result of some kind of apparent mix-up. But it was clear that it was more than a mix-up over the next three months, which included lots of phone calls and emails with lawyers about state public records laws until this week when we were again granted access to the reports.

All the while, the City Paper news team kept wondering:

All 50 states and the federal government have public records laws, and South Carolina’s is not much different than most.

Adopted in 1978, the law governs everything from when and how public notice must be given for meetings to what information collected by police must be made public.

Among the provisions in the S.C. law is Section 30-4-30(D), which lays out four different types of records “must be made available for public inspection and copying during the hours of operations of the public body, unless the record is exempt … without the requestor being required to make a written request to inspect or copy the records when the requestor appears in person.”

The law is crystal clear: Records must be furnished, without strings attached, to any member of the public who asks.

Those records include: the previous six months of meeting minutes, three months of jail logs, six months of documents produced by a public body and at least 14 days of criminal incident reports.

“Police reports for the previous 14 days are to be made available for inspection and copying at the police department office without the necessity of a written request when the person wishing to view the records appears in person,” said Jay Bender, a retired Columbia media attorney.

City Paper’s snafu with CPD came up after the department was reevaluating policies following the retirement of Charles Francis, its longtime public information officer — it was Francis who handed over the clipboard with a stack of

The state’s Public Official’s Guide to Compliance with the S.C. FOIA, published in partnership with the South Carolina Press Association, plainly interprets the FOIA law to mean two weeks of “records containing basic details of a crime” must be kept “ready for immediate access.”

Separate letters from Gov. Henry McMaster and Attorney General Alan Wilson advise good government must include transparency and accountability.

“As public servants, we should always endeavor to maintain the public’s trust and confidence in their government. In that spirit, I hope you will remember ‘When in doubt — disclose,’ ” McMaster wrote.

“We have an obligation not only to adhere to the letter of the law, but also live up to its spirit through compliance with every reasonable FOIA request without delay or obstruction,” Wilson wrote.

But informal checks with other local departments have yielded varying results with respect to police reports.

A trip last week to Mount Pleasant Police Department to request incident reports for the previous Friday resulted in the City Paper being told to submit a formal FOIA request, a process that can take up to 40 days. When asked about provisions under the law that enable public review of recent reports, police department employees said a formal request was needed.

North Charleston Police Department officials also seemed unaware of statutes that require recent reports to be made available, giving the City Paper the runaround at city hall.

Clerks with Isle of Palms and Folly Beach law enforcement agencies provided reports on Jan. 19, with IOP emailing a PDF of recent incidents and Folly Beach providing 18 redacted reports for review inperson. In response to an email about department policies, Sullivan’s Island police officials first requested a formal FOIA, and did not respond to a follow-up email citing state law saying the reports must be provided.

A Charleston County Sheriff’s Office spokesman also told the City Paper in late October that anyone seeking reports from the past 14 days can request them at the agency’s administrative offices on Leeds Avenue.

This week is the first issue since midOctober we’ve featured all-new Blotter entries because of unclear interpretations of the state transparency laws.

As the City Paper wrote in this week’s editorial, “Agencies must reexamine policies to ensure public servants follow the law. To do otherwise is to break the law they’re supposed to uphold.”

A downtown woman reported her “Silver Phantom” stolen after having purchased it for almost $10,000 recently. Before you get excited about what sounds like an affordable sports car, we have to tell you it’s a golf cart.

Mysterious photos depicting a Black man in a white robe adorned with an “unknown symbol” appeared stapled to various trees along multiple downtown streets. On the back of the posters is the same robed man, but the symbol is printed at the top of the poster instead of on the robe.

These cults are starting to get real creative with their recruitment strategies.

A downtown man pulled over for suspected driving under the influence told officers he was “dropping bars.” We were interested in looking into his rap career, until we continued reading and found that apparently that means doing drugs — why does everything mean doing drugs nowadays?

A downtown man’s apartment was broken into, but the only item stolen was a copy of the Kama Sutra from his bedroom nightstand. Police made note in the report that the victim was the only person who regularly occupied the apartment. Ouch.

A man police were told was trying to fight people in a bar with a metal spike said he was talking to God before the altercation ensued. We had no idea our local Vampire Hunters’ Guild was so active this time of year.

A student at a West Ashley high school was reported for smelling of marijuana.

Honestly, can you blame the student here?

Have you seen what schools are dealing with?

A report of a man “playing with his genitals” in his car led to a rousing game of “Guess the Make and Model,” whereby officers scoured Google images for various cars until they found one that matched the witness’ description — a great game under normal conditions, complicated by a compelling distraction on the witness’ end.

Police stopped a man suspected of being high on narcotics, but dropped the questioning when he said he had just finished some “addaball.” What he probably meant was Adderall, guys, which is definitely a narcotic. How did this happen?

Beating the Odds

New exhibits at Gibbes and Brookgreen Gardens Fighters for Freedom: William H. Johnson Picturing Justice is on display until Aug. 7 at the Gibbes Museum.

The exhibition comes from the Smithsonian American Art Museum.

The Charleston arts scene is tentatively approaching the other side of a precarious window predicted last year in a survey from the Gaylord and Dorothy Donnelley Foundation.

The survey was a forecast to help funders communicate the necessity for action to save nonprofits in the wake of the pandemic. It also provided hard data to balance anecdotal evidence. The S.C. Arts Commission and the Donnelley Foundation published a separate survey focused specifically on arts nonprofits.

“It doesn’t look great, but it’s not surprising,” said Kerri Forrest, Donnelly’s director of Lowcountry programming.

“When you think about the arts field and just the struggle that the arts has, particularly on the nonprofit side, with getting public and private funding in a very crowded nonprofit field, it was depressing but not necessarily surprising.”

Donnelley provides funding to a variety of organizations across the coast. Some of their smallest grantees have budgets around $25,000 annually, up to Spoleto Festival USA, which runs a roughly $8 million budget. Donnelley doesn’t have a large funding pool for the Lowcountry, but the funds, provide general operating capital and resources the organizations can use as needed.

Out of 3,782 arts, culture and humanities nonprofits surveyed in the spring of 2021, roughly 48% of respondents claimed they could operate for about six months without additional revenue. At the time, most organizations were either still not producing new content or had pivoted to new avenues. All were looking to the fall arts season as a time of returning audiences and revenue streams.

The report also examined job loss among nonprofits and said the slight economic recovery of mid-2021 was a small bump in an ongoing drop for arts organizations.

But the fall return of audiences and patrons to art spaces and theaters seems to have helped. As of December 2021, no Donnelley grantees had reported closing up shop. The challenge now is how much longer the groups can survive. With the federal government giving no indications of additional assistance, companies are working to return

Artistic director for PURE Theatre, Sharon Graci, said the pandemic shakeup in the local arts scene is continuing the affect audience numbers to pre-pandemic financial states.

Redux Contemporary Art Center has been a Donnelley grant recipient for many years. The company has been hosting arts events for much of 2021, but it isn’t quite out of the woods yet.

“We’re getting close to our pre-pandemic financial state, but that only partially has to do with the returned audience,” said Cara Leepson, Redux’s executive director.

“That also has to do with the massive relief funding that was avail- Leepson able throughout 2020 and 2021.”

PURE Theatre is another of Donnelley’s local grantees and has been for many years.

The company returned to full productions with audiences in September, but had to navigate delta variant spikes.

“If you’re not able to be nimble at this time, I don’t know how you make another year of uncertainty,” Forrest said.

Part of that uncertainty was on full display this fall, as performance spaces opened doors to audiences at reduced capacity.

“PURE’s earned revenue is down approximately 44% from pre-pandemic numbers, and the steady growth that PURE has enjoyed has been arrested, simply due to the fact that people are out of practice when it comes to seeing live theater,” said Sharon Graci, PURE’s artistic director.

The omicron surge continues to shift production plans — PURE recently delayed its opening of Richard Strand’s Ben Butler by two weeks.

“Audience demographics and logistics such as, ‘In order to participate, I must sit in close proximity to strangers,’ versus, ‘I can experience this exhibit socially distanced and solely within my own party’ affect the degree to which organizations are rebounding,” Graci said. “Additionally, new ways of experiencing or consuming art are still developing, and require long-term commitments and resource allocation to ensure that they have a chance at becoming meaningful forms of engagement and viable, sustainable revenue streams.”

In response to some of the findings and to strengthen the arts scene, Donnelley and the S.C. Arts Commission worked together to provide training to organizations to prepare for best- and worst-case scenarios moving forward.

The hope is that people will realize the importance of a thriving cultural scene, and will take a more proactive approach in directly funding Charleston’s incredibly vibrant arts community, either through philanthropy or just buying a ticket.

“You know that the nonprofit sector is back when the arts are back, because the arts were hit so hard,” Forrest said. “And I think just having somebody, a third party, be able to really articulate, ‘We’re not making this up. We do serve a purpose here, and we’re really taking it on the chin’ was good validation.”

Restaurants recalibrate (again) amid COVID surge

By Michael Pham Charleston restaurants continue to feel the impact of omicron, with more than 10,000 new cases confirmed Jan. 21.

Staffing shortages are still an issue, and the rise of COVID cases have made it even harder. Indoor dining remains open for many eateries, but at the cost of shifting business hours or running with a small team.

“I’ve never seen anything like it,” Babas co-owner Edward Crouse said in an email. “Overnight (or in the course of week) restaurants’ schedules across the city were gutted.”

Early Bird Diner, for example, started posting daily hours on Instagram “due to being short-staffed.”

On the other side of the Ravenel Crouse Bridge, Little Miss Ha shifted back its opening to 12 p.m. daily to “allow [its] very hard working and small staff to better serve you when [it] is open.”

In the worst cases, restaurants had to close completely.

Jackrabbit Filly on Jan. 6 announced via Instagram that it will close for the day, and on the next, offered only takeout orders “due to high concerns amongst [its] staff.” But on Jan.

Jackrabbit Filly was one of several local restaurants that temporarily closed amid the omicron variant 8, the restaurant announced, “We have made the hard decision to close for the rest of the weekend.”

“Talking to the staff, they felt uncomfortable working,” coowner and chef Shuai Wang told the City Paper. “You don’t want to force your employees to work if they’re not comfortable to work in this environment.”

“It’s a privilege that most employees don’t realize — that they don’t ever have to make the hard decisions that Corrie and I have to make,” he added. “You just try to do your best, and hopefully you’re making the right decision.”

“I never learned how to react during a pandemic in culinary school.”

Fortunately, the restaurant reopened the following week, continuing normal hours and operations, including its popular Sunday dim sum brunch.

Babas had been fortunate enough to not close its doors or shift its hours. And according to Crouse, it was the busiest

two weeks of the year.

“We are fortunate that we’re a small operation and worse comes to worse, we can power through with a lean team,” Crouse said. “But some of these big operations, I can’t imagine.”

“Can you also imagine that with all that going on, the city decided it was time to get rid of our parklet? It was nuts,” Crouse added.

In mid-January, city officials ordered the owners of Babas and nearby Cutty’s to dismantle their outdoor parklets, reportedly after state transportation officials said it was time for the experiment to end on Cannon Street, a state-owned road.

Nearby at Chubby Fish, owner James London has taken precautionary measures to prevent a closure of his popular seafood establishment.

Established in April of 2021, Charlottebased 5th Street Group launched its “Tip the Kitchen” initiative, a program created to help address the wage gap between front- and back-of-house staff in restaurants.

With its Tip the Kitchen initiative, a second line was added on each receipt, giving customers the opportunity to not only tip their servers, but also the backof-house staff. Across its six restaurants in Charleston, Charlotte and Nashville, the restaurant group reached $1 million for back-of-house staff. The restaurant group also matched up to $500 in collective tips daily to each restaurant, contributing $450,000 to the initiative.

to get tested at least once a week, he said.

“It takes a lot of time and money. Those rapid tests aren’t cheap,” London added. “But it’s better than shutting down for a week.”

Chubby Fish hasn’t had to shut down due to COVID concerns since receiving the rapid tests, and London says if one of his staff is showing symptoms, they’re told to stay home and get tested.

“We run a really London tight staff, so if we lose two people, we’d have to shut down,” said London. “We put out a certain product we stand behind and don’t want to put out anything less than that.”

Those are just a handful of restaurants in the city being Larson affected by COVID. Pay It Forward, a nonprofit organization dedicated to helping workers in the food and beverage industry, has seen applications for assistance increase 400% since December 2021.

“Folks are struggling right now,” said executive director Carrie Larson. “I think COVID is tearing through restaurant communities. Whether someone is sidelined due to COVID exposure, a positive test or restaurants having to close due to staffing shortages, it’s kind of created this perfect storm of need and instability within the industry.”

Pay It Forward provides emergency assistance to food and beverage industry workers.

To apply, individuals must work a minimum of 30 hours per week and have been working in the industry for at least six months in Charleston. Once those two requirements are verified, the individual is qualified to receive an average of a $250 grant. Workers in need of assistance can apply to receive a grant twice.

“For the most part, folks can apply and expect a quick turnaround for the assistance,” Larson added. “And we’re seeing most of our applicants coming through needing assistance based entirely around COVID, whether they, a dependent or parent has been sick or missed hours due to restaurants having to adjust their service hours.”

With the increase in applications for workers needing assistance, Pay It Forward is “on track” to distribute $10,000 a month, said Larson.

“We really want to be well positioned to help everyone that applies, so we see ourselves this winter really pushing for contributions and for our community members who are able to donate to support those in need.”

High Water Festival 2022 is actually happening April 23 and 24 after a two-year pause, so City Paper just had to check in with its curators, Cary Ann Hearst and Michael Trent of Charleston’s acclaimed folk duo Shovels & Rope, to hear just how excited they are. And bonus, S&R dropped two new songs, “Bleed Me” and “The Show,” on Jan. 19.

As usual, the High Water lineup ranges from rock to rhythm and blues to Americana, with Jack White and My

Morning Jacket headlining. Part of the well-rounded lineup this year is California garage punk quartet Shannon & the Clams and the illustrious Mavis Staples bringing all the soul we can handle. All systems are go.

“It’s a treat for us to even be involved in something like this — we get to pick the artists and kind of curate the vibe, you know, like what we would want to have at a festival,” Hearst told City Paper last week. “It’s come to fruition three times, and we’ve had to take a couple years off, but I’m looking forward to that feeling again — standing

there with Michael and people are coming in and it’s all going tickety-boo.”

“We didn’t want it to be overcrowded, and we didn’t want bands to be playing at the same time,” Trent said of their must-haves when it came to conceptualizing what an ideal festival looks like, and that’s been the blueprint for High Water since its 2017 debut.

Also essential to High Water’s format is bringing lesser-known acts to town along with bigger names so they can build audiences and get in with the Charleston music circuit.

“We’re not the young band in town anymore. We are like the old-timers,” Hearst said. “It’s our job to make sure that we are doing something to check in on our music scene and for us that means getting a few acts that might not necessarily have come our way, but maybe will come now.”

Trent and Hearst kept making records pretty prolifically when the music world got upended in 2020, releasing another Busted Jukebox installment last spring and compiling Manticore — a follow-up album to 2019’s By Blood — set to release Feb. 18.

The most recent batch of singles from the upcoming album were written before COVID, although the worn-out piano tale on “Bleed Me” and disassociated romance on “The Show” could be mistaken for quarantine tunes.

“We’ve been making a joke that all these intense songs were already written because we were already that messed up going into the pandemic,” Hearst said.

“The Show” is painfully tenderhearted as it observes the expanse wanderers will cross looking for each other, with Hearst and Trent’s bare harmonies traipsing between the glam rock refrains. And while “Bleed Me” sounds like one of those sad songs you hear in a movie when someone gives last looks, it’s actually written with their children in mind.

“It’s a love letter to our kids and about how it takes a lot of yourself to parent,” Hearst said. “Sometimes you feel like there’s nothing left, and then you dig down and find a little more. Then they fill you back up, and then they drain you again, and on it goes.”

Pulse Colour of Music Festival returns for 9th showcase Charleston’s ninth annual Colour of Music Festival takes place at various locations downtown Feb. 2-5, featuring leading Black classical artists from the U.S., France and Colombia, South America. The performances across the four day festival encompass a variety of compositions from noted Black composers as well as standard canon works.

“It’s a great way for folks to learn about composers that are outside of the European tradition and bring awareness to the fact that these pieces exist,” said local violinist La Toya Patterson, the sole Charlestonian in a slate of classical musicians featured at Colour of Music Festival this year.

Heyrocco returns for February performance After getting started in Charleston, pop rock trio Heyrocco relocated to Los Angeles and have since gained a fourth member and traded in the teenage grunge for a more polished sound.

To kick off the new year, the group released two new songs Jan. 11.

Guitarist/vocalist Nathan Merli, bassist Chris Cool, drummer Tanner Cooper and guitarist/vocalist Pat “Tex’’ Mertens have unearthed recordings that diverge from Heyrocco’s earlier garage days, solidifying a fresh concept heard on the latest releases, “Hollywood” and “Do Your Worst.” —CG

Bennett Coleman drops debut single Local singer/guitarist Bennett Coleman’s debut single “Nothing To Do With Me” is one of those upbeat songs with sad lyrics, a cross between country rock and soulful Americana.

“I wrote about the situation that everybody goes through being in a relationship — someone acts a certain way and you don’t realize the negative toxicity that person has until it’s too late, but then you decide to distance yourself from them and move forward,” he said.

The single release party for “Nothing To Do With Me” will be at Port of Call from 6-9 p.m., Feb. 15, on Market Street. —CG

That all-over-the-place love for music made its way into what Impulse Control Disorder does.

“Whatever came out, it was like putting my brain out onto a record,” he said. “I skip around a lot, so the record is going to skip around a lot. That might be jarring, but that’s just what came out.”

Regardless of the style, Retroject will make electronic music fans nostalgic for the sounds of yesterday, and that’s at least partially because Svornotten has been sitting on the songs for a while.

“The reason I called the album Retroject was that a bunch of those songs I had written like 15 years ago,” he said. “I never released them, and I always wanted to get them out, and then with the time I had during the pandemic, I was like, let me clean these things up and get them out, even if for no other reasons than a sense of completion.” —Vincent Harris

Retroject, the new album by Charleston’s Impulse Control Disorder, starts off with a fairly consistent sound. The first three tracks are hardcore industrial techno, the kind that bands like KMFDM and Ministry made back in the 1990s and 2000s. They’re chock-full of overdriven, harsh-textured synths, heavy beats and horror-show vocals.

After those opening tracks, “W.H.A.T.,” “Necessities” and “Icarus Wings,” you might think you’ve got the album pegged, but then Frank Svornotten, the man behind Impulse Control Disorder, throws a serious curveball into the mix.

The fourth track, “Mysterious Angel,” lightens things up considerably with a cheerful, ironically simple keyboard riff and pure eighties beats. Even Svornotten’s vocal tone changes, going from a grungy howl to a dead ringer for Depeche Mode’s Dave Gahan.

From that point on, the album alternates a heavy industrial sound with poppier elements. “Train Song” in particular, is a neat throwback dance pop tune that recalls early New Order, right down to the pulsing bass line and heart-on-the-sleeve vocals.

Svornotten says that the album’s range of electronic styles comes from his own varied musical tastes.

“I have the fortunate or unfortunate fact that I listen to a lot of stuff,” Svornotten said. “I was never fully drawn to any one genre. I like metal, like Slayer and Sepultura, but I also love the Violent Femmes and Depeche Mode, and that’s why I had a hard time picking a lane to stay in. That’s why I called the band Impulse Control Disorder, because it’s kind of like
