GATEWAYS MUSIC FESTIVAL “Celebrating Classical Musicians of African Descent” 2015 Program And Special Guest Musicians And Composers Announced

A

GRAMMY Award-winning string quartet from New York City and the principal clarinet of the New York Philharmonic will be featured guests at the 2015 Gateways Music Festival.

A celebration of classical musicians of African descent, the Festival will run August 11 through August 16 with nearly 100 talented musicians from 23 states and Canada performing in various venues throughout the city and suburbs of Rochester.

All of the festival events are free and open to the public.

The Harlem Quartet will be among the performers at Gateways’ two chamber music concerts: 7 p.m., Thursday, August 13, at Mt. Olivet Baptist Church, 141 Adams St. and 7 p.m., Saturday, August 15 at the Hochstein School of Music & Dance, 50 N. Plymouth Ave. Based in New York City and making its debut in 2006 at Carnegie Hall, the Quartet has performed throughout the United States as well as in South Africa, Canada, France, the United Kingdom, Panama and Belgium. Their recording of “Mozart Goes Dancing” with jazz legends pianist Chick Corea and vibraphonist Gary Burton won a GRAMMY Award for Best Instrumental Composition in February 2013.

Anthony McGill joined the New York Philharmonic in September 2014 as principal clarinet after spending 10 years as principal clarinet with the Metropolitan Opera Orchestra. He is recognized as one of the classical music world’s finest solo, chamber and orchestral musicians. McGill will be the soloist at the festival-ending Gateways Music Festival Orchestra concert at 4 p.m. August 16 in Kodak Hall at the Eastman Theatre.

The orchestra, under the baton of conductor Michael Morgan, music director of the Oakland East Bay Symphony Orchestra in California, will also perform Symphony No. 1 in E Minor by black woman composer, Florence B. Price, and La Valse by Maurice Ravel.

Other Gateways Music Festival events include a Piano Recital featuring five pianists, a Pre-concert Conversation entitled “Black Women Composers: In Recognition of Their Creative Musical Brilliance … At Last!”, an open orchestra rehearsal and the Youth Showcase Concert.

Sandra Williams Bush, Merriweather Library’s first Branch Manager, Announces Retirement

W

hen the Frank E. Merriweather Library opened nine years ago in 2006, it did so with great fanfare.

It was the city’s newest branch and the crown jewel of African American architecture in this region with its circular pod design to represent an African village, majestically designed doors and skylight.* Located in the heart of the Black community on Jefferson and E. Utica, it replaced the nearly 80-year-old North Jefferson Branch Library, and was a welcome addition to a community long neglected.

The appointment of its first Branch Manager, Sandra Williams Bush, proved to be equally significant.

For the past nine years, Sandra, belying the stereotypical image of the tradition librarian with her colorful African attire and flowing dreadlocks, her reserved demeanor and her African–centered world view, graced the space and nurtured the unprecedented spirit of community and culture that the Merriweather has grown to represent.

On Friday, August 21 after 30 years in the County’s library system Sandra Williams Bush is stepping down.

A community reception in her honor will be held at the library on that day from 4 to 6 p.m.

Retirement, she said, will simply give her the time, space and freedom to be even more active in community projects she holds dear.

“Her love for the community and her love for history is something that will be missed,” said former librarian and friend Sharon Holley, who along with her husband co-owns Zawadi Books.

“What I admire about her is her dedication….” Sharon continued. “She has continued what our former boss Bill Miles instilled in us as young librarians: service to the com-

munity and outreach; to work within the system but to see the bigger picture…of serving the community in which your library was a part of.”

It became very clear that this philosophy was working when several years ago plans were announced to remove Sandra from the branch and replace her with another manager.

The support and outcry from the community was tremendous, Holley recalls.

Sandra also reflected on that time as the most rewarding experience during her tenure.

Adding that she was surprised, and appreciative, when the community came together to protest the pending move.

“I always envisioned for this branch to be a community resource,” said Sandra, “part of a hub which included the Merriweather Library (which she referred to as her “essence”), the Apollo and the Challenger…forming a pyramid. This is a powerful space.”

“Black and Proud” Growing up during the wave of the “Black and proud” era of the sixties, Sandra, a product of the Buffalo school system, attended School # 47, Woodlawn Jr. High and East High. Her parents, Willis B. and Evelyn O. Williams, provided “strong love, guidance and support” to Sandra, the eldest, and her four brothers.

Her sense of community in particular, was instilled early in life by her late father, Willis, who she described as culturally conscientious and very

pro-community. “We were always taught that it was all about family and community.”

Becoming a librarian, she admits, was not exactly a career goal. After earning her undergraduate degree from Medaille College, getting a job was foremost. The result of taking a Civil Service test landed her with a position as a library clerk under now retired Librarian William A. “Bill” Miles who went on to become Buffalo and Erie County Public Library Assistant Deputy Director.

Crediting him with further instilling in her a sense of community and working to help her people, he also encouraged her to earn a Master of Library Science Degree from UB. She was manager of the North Jefferson Library before the Merriweather was built.

Miles, an amazing visionary, did more to bring the library “to the people” than anyone in the city’s history.

He created such innovative programs as “The 3 B’s” which placed reference books and other reading material in “bars, beauty shots and barbershops.”

His signature creation, the Ram Van, a multi-media mobile library on wheels, that traversed the east side serving day care centers, community organizations and everyday citizens.

Hands Up Don’t Shoot!”: Remembering Fergueson One Year Later

year ago, August 9, 10214, most Americans had never heard of the St. Louis suburb called Ferguson until a White police officer, Darren Wilson, fatally shot Black unarmed 18-year-old, Michael Brown in the street. Witnesses say Michael had his hands up when he was murdered. Wilson was not indicted in the murder. The unrest in Ferguson that followed cost St. Louis County more than $4 million. $2.6 million was reportedly spent on police overtime, the biggest chunk of the $4.2 million bill. Another $170,000 was for damage to police cars caused by rioters. Reverend Al Sharpton and Dr. Jamal Bryant from Baltimore Michael Brown are coming back to Ferguson this weekend.The two will take part in a two day community forum and concert called “The Ferguson Report Card: Facing the Future” Saturday August 8. The concert and forum will be held at the Greater St. Mark Family Church. On August 9, Rev Sharpton will take part in an afternoon Unity March and candle light vigil at the Canfield Apartments where Brown was killed.The charity concert is intended to support local agencies and create an action plan to address joblessness, community policing, senseless murders, the power of the vote, stronger families and the better education of the youth.

Wilson, the former police officer who killed Michael Brown says he hasn’t read the U.S. Justice Department’s report detailing the city’s systemic racism and has no plan to, according to a lengthy profile of him in the New Yorker. “I don’t have any desire,” Wilson told the magazine. “I’m not going to keep living in the past about what Ferguson did. It’s out of my control.”

Wilson, 29, declined to talk about his shooting of Brown, citing the pending lawsuit. He repeated what he told ABC, saying: “I did my job that day.”

Asked if he thought about what kind of person Brown was, Wilson told the magazine, “Not really, because it really doesn’t matter at this point.” The article reveals many of the open wounds that remain in Ferguson a year after Brown’s death.

That includes his relatives, who said there’s nothing that can be done to make things right.“Anger and hatred,” a cousin, Sabrina Webb, said after being asked how she felt about Wilson.

“There’s no forgiveness.”

NAACP Launches 860-Mile Protest March: “America’s March for Justice SELMA, Alabama— An 860-mile protest march to Washington has begun in Selma, 50 years after the city’s historic 1965 march for African-American rights.

The Rev. Theresa Dear noted the magnitude of what lies ahead, but never doubted that the “40-day-and-40-night” march will be successful.

Dear told the Montgomery Advertiser just before the march began at the Edmund Pettus Bridge, “We are doing something of biblical proportions.”

Sponsored by the NAACP, “America’s Journey for Justice” is scheduled to extend through eastern seaboard states before ending in Washington, D.C., on Sept. 15.

More than 200 supporters took part in the first leg of a march that will be about 16 times the 54-mile distance covered by voting rights activists in 1965.

A $100,000 statue of satan was unveiled to cheers of “hail satan” in a ceremony at an undisclosed location in Detroit on Saturday July 25 to the sounds of prayer and protest.

The ceremony was billed as the “largest public satanic ceremony in history.” Approximately 700 people gathered at a warehouse to unveil the monument to Baphomet, a goat-headed god who is the symbol of contemporary Satanism. The statue, which is nearly 9-feet tall and weighs about a ton, shows the figured seated on a throne, wings spread, with a pentagram carved above the goat head.

The figure’s legs end not in feet, but cloven hooves. Two children, a girl and a boy, gaze up at him.

It was originally made for the state capitol grounds in Oklahoma City, but Oklahoma’s Supreme Court banned religious displays on Capitol grounds, The Detroit Free Press reported. It eventually made its way to Detroit. but it reportedly will not stay there.

Dozens of Christian protesters gathered in Detroit, Michigan, on Saturday to denounce the unveiling “The last thing we need in Detroit is having a welcome home party for evil,” said Rev. Dave Bullock, a pastor at Greater St. Matthew Baptist Church in Highland Park, Michigan.

FAITH & FAMILY Services Set for Cynthia Theodora Kirkland

C

ynthia Theodora Kirkland of Cary, North Carolina, a Reedy Creek Middle School teacher died after a long battle with breast cancer on Monday, July 27, 2015 at UNC Rex Healthcare Hospital, Raleigh, North Carolina. She was 51.

A memorial service will be held on Saturday, August 8 at 11 a.m. at First Shiloh Baptist Church, 15 Pine Street, Buffalo.

Baptized at an early age, she was an active member of Shiloh Baptist Church in Buffalo and once she relocated to North Carolina, she attended White Rock Baptist Church in Durham, North Carolina.

Growing up in Buffalo, Cynthia attended and graduated from Holy Angels Academy in 1982. She earned both a Bachelor of Arts degree in Business and Fashion Merchandising and a Master of Science degree in Early Childhood Education/Elementary Education from the State University of New York College at Buffalo. In recent years, she continued courses in educational administration and supervision at Canisius College.

Cynthia enjoyed a career in merchandising, banking, and as a substitute teacher in the Buffalo public school system before teaching full-time at Lincoln Academy, P.S. #44; the Early Childhood Center, P.S. #61; and P.S. #3.

In 2006, Cynthia moved from Buffalo to Cary, North Carolina in search of other employment opportunities. She worked in various positions in the North Carolina school system. In 2011, she was hired as a language arts teacher for 6th and 7th graders at Reedy Creek Middle School, where she also served as a special education tutor and advisor. She remained in this position until her passing.

In 1992, she married Donald Hargrave and from that union they had one son, Joshua Jared Hargrave. After relocating to North Carolina, she met and married Sherman Wallace of Cary, North Carolina.

Survivors include her loving and devoted husband Sherman Wallace; son Joshua Jared Hargrave; loving parents, Theodore and Winona Kirkland, two sisters, Dr. Sharon Kirkland-Gordon (Patrick Gordon) of Bowie, Maryland and Adrianne Kirkland of Buffalo; a 101 year old grandmother, Brunette Washington of Buffalo; and a host of aunts, uncles, cousins, other relatives and friends. n Sunday, July 29th, Buffalo's Mayor Byron Brown proclaimed that Saturday and Sunday to be known as James 'Pappy' Martin week-end. On the surface, it means a weekend of honoring a man whose service to the community was exemplary.That's quite a compliment to his dedication to teaching youth, to church, to fitness, to family, and to his commitment to the enrichment of our lives through holding a jazz festival together for 20 years. I somehow feel that all of this leaves out at least one major thing that made him such a great person for others to emulate. He was a true friend, what a friend should be, and a role model for how to respect others.

He and I developed a friendship through our mutual love of both music and people. It took a cataclysmic event, the "Million Man March," to put some muscle into the friendship. Once you establish the mutual admiration for another person by what you see and hear, then take the time to get to know them, the natural inclination for folks who like to do things is to ask what can we do jointly to make a difference. This is where many of us don't dare go, because we know we are asking folks to go that extra mile, taxing the "trust" bank.

When he turned to me and said, "Darrell, we have to make our jazz festival happen. We have to acknowledge that Mr. Farrakhan is right.

We can't just keep complaining and doing nothing," he knew he was crossing that line. I never hesitated, not just because I knew he was right, and not because I know many others have tried, but because I had taken measure of the man, knew he was coming from the heart, and entrusting me greatly to even share this with me.

For the next 3 years, I stood side by side as we annually delivered excellence in entertainment to Buffalo, with a lot of help. No doubt, without the help of Steve Porter, Councilman Byron Brown, and Council President James Pitts, among many, we would not have been successful.

I was further enriched as I

got to enjoy Pappy's friendship even more so. Perhaps it was his Master's degree in psychology, but he held me in check when we faced adverse conditions, and managed to make things go anyway. He comforted me during some of my personal trials, and he opened up his world to me in bits and pieces, and we really enjoyed all those times. I then moved out of state for four years, and am I ever thankful he had his daughter to work with, although he and I stayed in touch. Never did a festival year go by where we didn't share notes and ideas. Finally, in 2005, when I left the country, he was doing it all, and as we all know, doing it well. We started out bringing tremendous talent to Buffalo in the Sundays of July, and he continued it so well, that he passed on a brilliant torch to his hard working, committed daughter to take to the next level.

down, big time! I was commended and lauded for being there in the beginning, but my highest honor will be in having enjoyed some great moments with a great man, and enjoying being his friend.

Mr. Keith Wiley, highly acclaimed mathematician in the city, works with the youth on improving and mastering math comprehension skills. Ms. Danielle Collier, a Buffalo Public School teacher, works with the children of ELA. All youth actively participate in Mayor Brown’s Reading Program and read for 30 minutes daily . For the younger children attending camp, various board members come and read stories from the recommended list provided by Mayor Brown. Jenee Glover Accepted to the Knowledge Exchange Institute to Study Abroad in Thailand

enee T. Glover, the granddaughter of Prince Hall Mason Lamont Glover Sr., has been accepted to the Knowledge Exchange Institute (KEI) for study at Mahidol University International College in Bangkok/Salaya, Thailand. The program, which runs from September 2015 to March 2016, combines courses, experimental learning and cultural excursions to enhance students’ understanding and appreciation of Thai society and culture, as well as academic excellence and scholarship.

Jenee, a senior Biology Pre-Professional major and Spanish minor at Norfolk State University, has participated in the marching band, dance theatre and as a volunteer at the local Children’s Hospital. She previously studied abroad in Argentina, where she volunteered to help underprivileged children in the community of Villa Martelli. A Call for Accountability

OPINIONS Rally for John Walker August 8:

I

n a busy week that included a radio interview during which he tried to defend and excuse the racial slurs made by Joe Mascia about several African American political and civic leaders, Carl Paladino also had time to dash off a few inflammatory emails to Board of Education President Jim Sampson and myself.

On July 29th, Paladino angrily responded to an email request I sent to the Interim Superintendent. Accusing me of ordering the Superintendent to take action on an item, he wrote: “Your order was phrased as a question. Time for you to answer to the community for your maligned and arrogant attempts to destroy the charter system which serves over 9,000 Buffalo kids with a quality education that they would never get in the BPS. If you were really about the kids you would advocate to disassemble the BPS and give every kid a voucher to choose where he or she would be best educated. But no, you won’t because that would not sit well with your pledge of loyalty to Crystal Barton and Phil Rumore both of whom endorsed and supported your election. The charter schools have long waiting lists of applicants. Those parents have the wisdom to not be led blindly by people like you, Cottman, Thiggs (sic) and the other thug activists who seek to protect the unions and maintain your empowerment.

There is no other logic to your position.” Paladino ended this ridiculous attack with a sophomoric insult. “Who ties your shoes for you?”

Barbara Seals Although disrespectful and nonsensical the contents of this email pale Nevergold in comparison to one(s) that were sent the following day to Mr. Sampson.

The call for a special board meeting to address the required Office of Civil Rights response and the transportation issue for the Charter School for Applied Technology, elicited the following tirade: “Jim, I will not attend that meeting because I will not vote on either issue until we have appointed a Superintendent and Deputy Superintendent and replaced you with Larry Quinn as President of the Board so as to closely monitor the new Superintendent.”

The email continues with an assault on Mr. Sampson’s leadership competency and his failure to keep Mr. Paladino informed. Paladino asks, “Where did you ever get the idea that you could tell me what to do or ignore me.” The subject of a new Superintendent candidate, Dr. Kriner Cash, is raised several times throughout this email. “I am willing to hear Cash out only because he comes highly recommended and only if he is agreeable to the appointment of Eberle as operating Deputy and an immediate restructuring of the executive staff as guided by the Board majority. The idea of bringing in a black only to pacify the black minority on the Board is abhorrent to me……If Kriner Cash is acceptable he can be Superintendent only with Eberle appointed as Deputy Superintendent in complete charge of day to day operations of the district with the Weimer team for the non-receivership schools with Cash responsible for the receivership schools and the implementation of our reform agenda. If Cash is not acceptable, then Eberle must be appointed as Superintendent with the Weimer team.”

The substance of these emails is troubling, particularly the one to Mr. Sampson. Mr. Paladino is clear that (1) he intends to force the hiring of his hand-picked Superintendent candidate. He is even willing to negotiate the hiring of Black man to be a figurehead if necessary (2) he wants the current executive team fired, immediately and replaced by a group he calls the “Weimer Team”.

There’s no concern about the destabilization resulting from the abrupt removal of staff, who are currently working on all the plans for school turnaround and initiating a new school year. There is no consideration of the havoc these changes would create for our students. The Paladino demands and ultimatums should be viewed further from several vantage points: (1)They reflect an arrogance and disregard for the legal limits of the authority of an individual Board member: per Board By-Laws 1110 (Education Law Sections 2551-2554): Members of the Board of Education have legal authority for the conduct of the District schools only when acting as a body, by majority vote, in a properly convened session.

Board members acting as individuals have no authority over school affairs or school personnel. The Board will not be bound in any way by any individual’s statement or action unless the Board, through adopted policy or by majority vote, has delegated this authority to the individual member.

(2)They constitute a pattern of intimidation and bullying of individuals, which have culminated in numerous law suits, instituted by Mr. Paladino or against him. These legal cases predominantly impact Black women. The District has and continues to spend hundreds of thousands of dollars in legal fees.

(3) The pattern of intimidation, however, now extends to anyone who refuses to agree with Mr. Paladino or follow his directives. Mr. Ogilvie, for example, experienced similar intimidation when Mr. Paladino confronted him and ordered him to submit his resignation.

(4)The exclusion of the minority board members from governance responsibility is deliberate and serves to disenfranchise them and their constituents This email is also a stunning example of privilege. Otherwise, who would include State Education Commissioner MaryEllen Elia and Dr. Kriner Cash as recipients of an email that proposes

Still No Justice…Still No Peace!

A

t a time when the relentless, unjust treatment of Black Americans by law enforcement officials is being exposed by video evidence, John Walker wants us to know that he is still fighting the injustice of 1976. He wants us to know that he continues to spearhead the drive to overturn Indictment #41413, and will be hosting a rally for that effort on this Saturday, August 8th in Niagara Square, from 12 noon – 2pm.

You remember John Walker, of the “Buffalo Five,” wrongfully convicted of the murder of an elderly white man along with Darryn Gibson and Darryl Boyd when they were just teens. You remember that one of the 5 friends, Tyrone Woodruff, was frightened into confessing to the crime and testifying against the others, and that this “confession” was what secured their convicSabirah tion, despite glaring evidence of their innocence. You will also remember that attorney McLeod, now a sitting judge, used police evidence to acquit his Muhammad client, Floyd Martin.

In an interview with John Walker this week, he expressed his frustration with the effort to get a hearing on the evidence that will prove his innocence, end parole for him and Darryl Boyd, and in his words, give him a chance…to just live.

“We gave them 40 years now. 40 years for me, 40 years for Darryl Boyd, 34 years until Darryn Gibson died. We gave them over a hundred years, and all we’ve been asking for all this time is 1 day in court. Look at the Jeffrey Basil (Molly’s Pub) case that just happened.

They convicted him of murder. In less than 2 months, they reexamined his case, and found that one of the jurors lied about army service. The case was overturned and brought down to manslaughter. I don’t envy his deal… good luck to the man. What I’m saying is how can some cases be heard in less than two months, and in 15 years, I can’t even get a hearing?”

In truth, John is certain he knows the reason: the ability of Timothy Drury, who prosecuted him, and who is now a State Supreme Court Justice to sabotage that hearing. “ If they expose what was done,” he says, “it would John and his son. open up Pandora’s box. Anyone who was prosecuted by him could have a claim to a reexamination of their case.“ Over the years, there have been positive signs and much progress on the road to demonstrating the men’s innocence, but John Walker is right about something else. At this point, there’s so much evidence that proof of innocence isn’t even the point anymore. The problem is getting into court with that proof. He’s also frustrated with black elected officials, many of whom have voiced support and whispered: John, we believe you, but have done little else. “Why can’t they get together and demand a hearing to see what they did to some young black men in 1976?” he says. He goes on to describe how difficult it’s been to watch other former inmates set free from the ordeal of parole. “In 5 or 6 years, people who’ve admitted to heinous crimes have been released. I’ve been on parole for 18 years, with no violations. All the time we were locked up, they wouldn’t let us out, because we wouldn’t admit to the crime or show remorse. But we weren’t able to, because we didn’t do it.”

There’s no doubt that what’s happened to John Walker and Darryl Boyd is an ongoing, vindictive persecution. That was proven several years ago, when Boyd, who had moved to California was found fit to be released from parole by the jurisdiction in that locale. New York officials got wind of it, and actually sent officers to California to take him into custody, bring him back to New York and force him back into the system. John Walker is sure the intent is to hold them indefinitely. “They want us to serve the rest of our lives on parole. If I don’t get a hearing, that’s exactly what they’re gonna do to me…make me live the rest of my life on parole. That means I’ll never be able to go nowhere. I was born and raised here, ain’t never went nowhere, and I’ll end up dying here.”

In addition to the support of a sitting judge (McLeod), numerous elected officials, clergy and community activists, The Buffalo Five have even had the support of former District Attorney Frank Clark. Even he requested of the courts in April of 2007 to bring a motion on their behalf, just as they did for Anthony Capozzi, wrongfully convicted of rape in 1985. Capozzi was freed and exonerated in 2007, by the same process that would free Walker and Boyd.

The community is being asked to come together again, to stand with them on Saturday, to call attention to this continuing injustice. We have walked with them, rallied with them, and cried

Section 2. The Legislature of the County (the “Legislature”), hereby authorizes the refunding of the Bonds To Be Refunded of the County, more particularly described and referred to in the Recitals hereof, and appropriates an amount not to exceed $35,000,000 therefor to accomplish such refunding. The plan of financing said appropriation includes the issuance of not to exceed $35,000,000 Refunding Bonds and the levy and collection of a tax upon all the taxable real property within the County to pay the principal of and interest on said Refunding Bonds as the same shall become due and payable. Bonds of the County in the maximum principal amount of $35,000,000 are hereby authorized to be issued pursuant to the provisions of the Law. The proposed financial plan for the refunding in the form attached hereto as Exhibit A (the “refunding financial plan”) prepared for the County by Citigroup Global Markets Inc. (“Citigroup”) is hereby accepted and approved.

The Legislature acknowledges that the final refunding financial plan may vary from that set forth in Exhibit A depending upon market conditions at the time of the sale of the Refunding Bonds.

Pursuant to Section 3 hereof, the Comptroller, the chief fiscal officer of the County, is authorized to approve the final details of the refunding financial plan not contained herein.

The refunding financial plan includes the deposit of all the proceeds of the Refunding Bonds (net of underwriter’s discount) with an Escrow Holder pursuant to an Escrow Contract as authorized in Section 9 hereof, the payment of all costs incurred by the County in connection with said refunding from such proceeds, and the investment of a portion of such proceeds by the Escrow Holder in certain obligations, the principal of and interest, together with the balance of such proceeds to be held uninvested, shall be sufficient to pay (1) the principal of and interest on the Bonds To Be Refunded becoming due and payable on and prior to each applicable Redemption Date and (2) the principal of the Bonds To Be Refunded to be called for re-

demption prior to maturity on the Redemption Date.

Section 3. The Bonds To Be Refunded referred to in Section 1 hereof are the aggregate unmatured outstanding balance of the Series 2005D Bonds originally issued pursuant to a bond resolution of the County adopted on July 12, 2001 authorizing the issuance of bonds to advance refund the Original Bonds. In accordance with the refunding financial plan, the Refunding Bonds have been allocated to the component issues of the Bonds To Be Refunded, and shall mature in amounts and at dates to be determined. The Comptroller, the chief fiscal officer of the County, is hereby authorized to approve the final details of the refunding financial plan not contained herein.

Section 4. The issuance of the Refunding Bonds will not exceed the Refunding Bond Amount Limitation. The maximum period of probable usefulness (“PPU”) of each issue comprising the Original Bonds, commencing at the date of issuance of the first bond anticipation notes issued in anticipation of the sale of said bonds, is set forth in Schedule A attached hereto.

Section 5. The aggregate amount of estimated Present Value Savings as set forth in the proposed refunding financial plan attached hereto as Exhibit A is $2,170,259.68. The Legislature acknowledges that the actual Present Value Savings may vary from that set forth in the refunding financial plan depending upon market conditions at the time of the sale of the Refunding Bonds.

Section 6. The Refunding Bonds shall be sold at private sale to Citigroup and the Comptroller, the chief fiscal officer of the County, is hereby authorized to execute a purchase contract on behalf of the County for the sale of the Refunding Bonds, provided that the terms and conditions of such sale shall be approved by the State Comptroller; and the Comptroller is hereby further authorized and directed to take any and all actions necessary to accomplish said refunding, and to execute any contracts and agreements for the purchase of and payment for services rendered or to be rendered the County in connection with said refunding including the preparation of the final refunding financial plan referred to in Section 2.

Section 7. Each of the Refunding Bonds authorized by this resolution shall contain the recital of validity prescribed by Section 52.00 of the Law and said Refunding Bonds shall be general obligations of the County payable as to both principal and interest by a general tax upon all the taxable real property within the County without limitation as to rate or amount. The faith and credit of the County are hereby irrevocably pledged to the punctual payment of the principal of and interest on said Refunding Bonds and provision shall be made annually in the budget of the County for (a) the amortiza-

tion and redemption of the Refunding Bonds to mature in such year and (b) the payment of interest to be due and payable in such year.

Section 8. Subject to the provisions of this resolution and of the Law, and pursuant to the provisions of Sections 21.00, 50.00 and 56.00 of the Law, the powers and duties of the Legislature relative to providing for substantially level or declining annual debt service, prescribing the terms, form and contents and as to the sale and issuance of the Refunding Bonds, and to executing any arbitrage certification relative thereto, as well as to executing the Escrow Contract, are hereby delegated to the Comptroller, the chief fiscal officer of the County.

Section 9. Prior to the issuance of the Refunding Bonds, the County shall contract with a bank or trust company located and authorized to do business in this State, for the purpose of having such bank or trust company act as the Escrow Holder of the proceeds, inclusive of any premium from the sale of the Refunding Bonds but net of any underwriter’s discount, together with all income derived from the investment of such proceeds.

The Escrow Contract shall contain such terms and conditions as shall be necessary in order to accomplish the refunding financial plan, including provisions for the Escrow Holder without further authorization or direction from the County, except as otherwise provided therein, (a) to make all required payments of principal and interest to the appropriate paying agent with respect to the Bonds To Be Refunded, (b) to pay costs and expenses incidental to the issuance of the Refunding Bonds, including the development of the refunding financial plan, and of executing and performing the terms and conditions of the Escrow Contract and all of its fees and charges as the Escrow Holder, (c) at the appropriate time or times to cause to be given on behalf of the County the notices of redemption authorized to be given pursuant to Section 12 hereof, and (d) to invest the moneys held by it consistent with the provisions of the refunding financial plan.

The Escrow Contract shall be irrevocable and shall constitute a covenant with the holders of the Refunding Bonds.

Section 10. The proceeds, inclusive of any premium and net of any underwriter’s discount, from the sale of the Refunding Bonds, immediately upon receipt, shall be placed in escrow by the County with the Escrow Holder in accordance with the Escrow Contract. All moneys held by the Escrow Holder shall be invested only in direct obligations of the United States of America or in obligations the principal of and interest on which are unconditionally guaranteed by the United States of America, which obligations shall mature or be subject to redemption at the option of the holder thereof not later than the respective dates when such moneys will be re-

quired to make payments in accordance with the refunding financial plan. Any such moneys remaining in the custody of the Escrow Holder after the full execution of the Escrow Contract shall be returned to the County and shall be applied by the County only to the payment of the principal of or interest on the Refunding Bonds then outstanding.

Section 11. That portion of such proceeds from the sale of the Refunding Bonds, together with interest earned thereon, which shall be required for the payment of the principal of and interest on the Bonds To Be Refunded, in accordance with the refunding financial plan, shall be irrevocably committed and pledged to such purpose and the holders of the Bonds To Be Refunded shall have a lien upon such moneys and the investments thereof held by the Escrow Holder. The pledge and lien provided for herein shall become valid and binding upon the issuance of the Refunding Bonds and the moneys and investments held by the Escrow Holder shall immediately be subject thereto without any further act. Such pledge and lien shall be valid and binding against all parties having claims of any kind in tort, contract or otherwise against the County irrespective of whether such parties have notice thereof. Neither this resolution, the Escrow Contract, nor any other instrument relating to such pledge and lien, need be filed or recorded.

Section 12. In accordance with the provisions of Section 53.00 of the Law, the Legislature hereby elects to call in and redeem all of the Bonds To Be Refunded which are subject to prior redemption according to their terms on the Redemption Date. The sum to be paid therefor on the Redemption Date shall be the par value thereof and the accrued interest to the Redemption Date. The Escrow Holder is hereby authorized and directed to cause notices of such call for redemption to be given in the name of the County by mailing such notice to the registered holder at least thirty and not more than sixty days prior to the Redemption Date. Upon the issuance of the Refunding Bonds, the election to call in and redeem the Bonds To Be Refunded subject to prior redemption and the direction to the Escrow Holder to cause notice thereof to be given as provided in this Section shall become irrevocable and the provisions of this Section shall constitute a covenant with the holders, from time to time, of the Refunding Bonds, provided that this Section may be amended from time to time as may be necessary to comply with the publication requirements of paragraph a of Section 53.00 of the Law, as the same may be amended from time to time.

Section 13. This resolution shall take effect immediately upon approval of the County Executive.

I have all of the proof; not only that we did not commit this murder, but that Timothy Drury was aware of the fact that we did not commit this murder, and he still prosecuted us. 2015 “Putting The Neighbor Back In the Hood” Awardees

asjid Nu’Man’s 18th annual “Putting the Neighbor back in the Hood” has named the following award recipients for 2015. They are: former Councilman Demone Smith; Reverend James Giles of Back to Basics; Murray Hollman and Arlee “Joop” Daniels of “Stop the Violence” ; Patricia Elliott and Linda Freidenberg, CAO Rafi Greene Center; Detective Sergeant Marvin Sanford Buffalo Police Department; Leslie Thomas business owner, “One Man’s Junk is another Man’s Treasure” and Challenger editor and publisher Alnisa Banks.

The organization is adding a theme this year, “Jail Ain’t no Good,” to point out the major pitfalls in getting involved “catching a case/record in the criminal justice system.”

“We want to help get the word out to everyone especially youth about the difficulties of trying to function once you are convicted of a felony crime. Buffalo Bills Line Backer Motivates Boys to Aim for Success On Thursday, July 23, Line Backer for Buffalo Bills player Jimmy Gaines, 22, visited male students participating in the Shifting Gears leadership program sponsored by True Community Development Corporation. Gaines, along with Sean McKinnie, Buffalo Fire Investigator, coached the boys about how to set goals and get ahead in life. “Set a goal,” Gaines said, “do research; study up and learn about people who have accomplished what you want to accomplish.” Gaines explained that giving motivational speeches like this is a way for him to give back and be an inspiration to young people in the area. “[It] gets them exposed to different people, different people of influence…it’s important for young men to see success.”During his speech, Gaines discussed his football career at the University of Miami to getting drafted by the Bills. Gaines is a Buffalo native and attended Canisius High School. After the presentation, Gaines showed the boys exercises and skills he does for football training.
