eva Theatre Center presents “Journey to the Son: A Celebration of Son House” from August 26 - August 29. This once-in-a-lifetime, four-day festival weaves together music, theatre, film, audio recordings, storytelling and lectures to celebrate Rochester’s adopted son, Eddie “Son” House.

The Grammy Awardwinner John Hammond, John Mooney and Friends, and pioneer of rap/blues fusion, Chris Thomas King (feature film Oh, Brother Where Art Thou?) will headline Thursday, Friday and Saturday nights of the festival, respectively.

Another highlight of the celebration will be the dedication of an official Mississippi Blues Trail marker on Friday, August 28 near the site where Son House resided in the Corn Hill Neighborhood of Rochester. This is the first marker of its kind in New York State and will be a lasting legacy from this event that will attract blues lovers from all over the world to Rochester for decades to come.

Theatre, film, storytelling, lectures, and of course, music (both workshops and performances) make up this 4-day festival celebration. A variety of performers, blues musicians and artists from all over the country will gather in Rochester to salute one of the world’s great musicians. The majority of events are free of charge to the public. Most of the events will be held in and around Geva Theatre Center, with hands-on guitar workshops at the Eastman School of Music, outdoor performances in Washington Square Park (weather permitting), and related blues performances at area bars/restaurants.

Eddie “Son” House was born in 1902 in the Mississippi River Delta and, as the son of a preacher, was raised to believe that secular music was the work of the devil. In 1927, he was introduced to the slide guitar and was so captivated by this new style that he bought a used guitar and developed his own blues style, a rhythmic drive with emotionally powerful vocals reminiscent of the field hollers of chain gangs. He was twice recorded by Alan Lomax for inclusion in the Library of Congress, and by Paramount Records in 1930. In 1943 he abandoned the music scene and moved to Rochester to find work. In 1964, a trio of music enthusiasts began a cross country search and found Son living in relative obscurity with no guitar in the Corn Hill neighborhood of Rochester. With their encouragement, Son picked up a guitar once again and played his unique style of music. This re-launched the next decade of Son’s career as an internationally recognized folk blues artist, performing around the world and recording several albums for Columbia Records. He was a Rochester presence, often playing at local venues and jamming with young musicians. His style influenced an entire generation of musicians including Robert Johnson, Muddy Waters, Elvis Presley, John Hammond, Bonnie Raitt, Eric Clapton, Mick Jagger and Jack White among others.

In 1976, Son House moved to Detroit where he died in 1988.

Dr. Cash had convinced just about everyone who had the opportunity to interact with him, that he was the best man for the job.

An exit poll of those who attended the public meeting at Buffalo Academy for Performing Arts last Thursday to introduce Dr. Cash to the community, was positive and a strong indication that he’d nailed it.

“I thought he was very diplomatic, honest and truthful,” said Charles Burgin, founder of Brotherman’s Progress Kultural Life Skills Youth Empowerment Project. ”He had some very powerful thoughts and ideas…I felt he really had the children at heart,” said teaching Assistant Dedria Coleman.

Teacher Mulu Belete said with his experience , successful track record, and independence, he will hopefully be good for Buffalo and the district.

“He has the right personality to deal with the Board,” observed Jackie Mimes. “his approach is 360 degrees. He’s a Millennium type of superintendent.”

Dr. Cash did ‘t go into detail when questioned during the community meeting about how he would fix the district’s struggling schools.

But He made it clear that he not only believes in his ability to bring about much needed change, he believes wholeheartedly in the children whose lives and futures have been entrusted to his care.

Fundraiser Planned for the Visit to Buffalo of Author Shahid Muhammad: “The Math Doctor”

Eva M. Doyle will host a fundraiser to help with the costs of bringing author and mathematician Shahid Muhammad to Buffalo.

The event will be held on Saturday, August 22 at the Merriweather library from 5:30 to 8:30 p.m. The program will feature three short films that include “The Boy Who Painted Christ Black.” This film is based on a short story written by historian Dr. John Henrik Clarke. “Freedom’s Song” will also be shown with scenes from the Tulsa race riot in Oklahoma and other historical events. Admission to this program is $10 for adults and $5 for children. Children will not be admitted without an adult.

Shahid Muhammad will speak in Buffalo at the Merriweather Library on Saturday, September 19 beginning at 1 p.m. He will also speak on Sunday, September 20 at 1 p.m. at Mosque 23 where meetings are held in the CRUCIAL Center located at 230 Moselle street. He is the author of the book “How to Teach Math to Black Students.” Known as the “Math Doctor,” Shahid introduces students to outstanding Black mathematicians and scientists.

10 Years After Katrina, the Black Poor Remains at High Risk

O

n August 29 2005, Hurricane Katrina struck New Orleans and then a nightmare unfolded. The most disadvantaged populations suffered the worst harm from the disaster. Many African American and poor individuals were unable to evacuate. Black neighborhoods were the most severely damaged. The elderly, Blacks, and the poor were the most likely to die. And, after the disaster, the black and the poor evacuees were the least likely to be able to return to New Orleans. It was a particularly bad time to be elderly, Black and poor in New Orleans.

Ten years later, the potential for a repeat of the disaster remains. The continuation of climate change means that the occurrences of strong hurricanes will increase. Hurricanes derive their strength from the temperature of the ocean. A two degree (F°) increase in water temperature more than doubles the number of Katrina-strength hurricanes occurring. Growing economic inequality and a weak economic recovery on Main Street has meant that the poverty rate, generally and among African Americans specifically, is higher today than it was in 2005. If we wish to mitigate the effects of future hurricanes and other disasters our emergency planning needs to better attend to the most disadvantaged among us.

Among the most universal household assets in the United States is a personal vehicle. However, automobile ownership reflects the race and class disparities in American society. Many faced difficulties evacuating New Orleans in 2005 because they lacked a vehicle and could not secure an alternative means of transportation out of the area.

Nearly a fifth of the poor population has no household vehicle compared to four percent of the middle-income population and two percent of the upper-income population. Even if middleclass and upper-class households do not have a car, they have the resources to obtain one in an emergency or an alternative means of transportation. Not all poor people can do the same.

Poor Whites are more likely to own a vehicle than poor nonWhites. Nationally, 14 percent of the White poor do not have a vehicle in their household. The comparable figures for the Latino and black poor are 18 percent and 32 percent respectively.

We can see evidence of this pattern in the New Orleans metropolitan area. In New Orleans, about half of the population is White, but only about three in ten of the poor is White. Of the poor population lacking access to a vehicle, only about a tenth is White. In other words, as the economic hardships increase the White share of the people facing the hardship decrease.

Julian Bond, Civil Rights Leader and Former NAACP Chairman, Dies at 75 J

ulian Bond, a lifelong civil rights leader and former board chairman of the NAACP, has died. He was 75.

Bond died Saturday night after a brief illness in Fort Walton Beach, Florida, according to the Southern Poverty Law Center (SPLC), which he served as founding president in the 1970s.

Bond was a Nashville, Tennessee, native who attended Morehouse College in Atlanta, Georgia. While in school, he co-founded the Student Non-Violent Coordinating Committee (SNCC) -- an organization that fought for and encouraged youth members to be vocal in the civil rights revolution. He led SNCC as the communications director, stood on the front lines of protests alongside several other civil rights pioneers like Martin Luther King Jr. and John Lewis, and became a leader in the 1960s protest movement.

Bond led protests and sit-ins against Jim Crow segregation policies and led campaigns to register Black voters, and was involved in the 1963 March on Washington. He and others such as current U.S. Congressman John Lewis left SNCC in the wake of the Black Power movement, when Whites were ejected from the organization.

Bond later served as board chairman of the 500,000-member NAACP for 10 years, but declined to run for another one-year term in 2010, the AP reported.

PBS, Bond discussed the success of the civil rights movement but acknowledged the progress that still needed to be made, stating, “So we won, but we haven't won...”

"With Julian's passing, the country has lost one of its most passionate and eloquent voices for the cause of justice," SPLC co-founder Morris Dees said in a statement released Sunday morning.

"He advocated not just for African Americans, but for every group, indeed every person subject to oppression and discrimination, because he rec-

ognized the common humanity in us all."

Bond later went on to serve 20 years in the Georgia Legislature, "mostly in conspicuous isolation from White colleagues who saw him as an interloper and a rabblerouser," the New York Times reported.

His anti-war stance and disapproval of America's position in the Vietnam War created tension for him among his political colleagues.

"When he was elected to the Georgia House of Representatives in 1965 -- along

with seven other Black members -- furious White members of the House refused to let him take his seat, accusing him of disloyalty," the Times reported.

It would take a unanimous U.S. Supreme Court ruling to confirm his seat. Denying it would be a violation on his freedom of speech, the court said. In 1986, Bond ran to represent Georgia in the U.S. House of Representatives, but was defeated by Lewis, a SNCC co-founder and fellow activist.

Bond would often appear as a commentator on news shows and became a leading voice in the media, featured on NBC's "Today" show, and in The Nation and The New York Times.

He was also a professor of history at the University of Virginia and an adjunct professor at American University.

Bond is survived by his wife, Pamela Horowitz, and five children.

Katrina continued The reverse is true for African Americans. In New Orleans, Blacks make up about a third of the metropolitan population, but nearly six in ten of the poor population. Three fourths of the poor population lacking access to a vehicle is Black. As the hardships increase, the African American share of the people facing the hardship also increases. We see this pattern for African Americans not only in New Orleans but also in the other hurricane-prone metropolitan areas of Houston and Miami.

Elmwood Franklin Sued By Parent Who Alleges School Intentionally Falsified Academic Records And Overstated Academic Standards Buffalo----Similar to cheating scandals that rocked the Atlanta and Philadelphia school districts, Buffalo’s elite Elmwood Franklin School is being sued by a parent who alleges that school officials intentionally falsified her child’s academic records and overstated the academic standards of the school.

Carolette Meadows, a parent of a former student of Buffalo’s elite Elmwood Franklin School, is suing the school to recover her cost of tuition. A hearing is set for Thursday, August 20, 2015 at 2 p.m., Buffalo City Court Building, 50 Delaware Avenue, Part 15 on the 7th Floor.

Ms. Meadows is suing on the basis the school officials knowingly and intentionally and negligently concealed her child’s below grade level academic performance while knowingly and falsely promoting that her child was performing at or above grade level.

The 127 year old Elmwood Franklin School is one of Buffalo’s oldest private schools, with tuition costs approaching $18,000 per year. The school also brands itself as having high academic standards with students being more than 2 years above grade level.

In the September 2014, Ms. Meadows moved to transfer her child from the Elmwood Franklin School. As part of an admission process at another area school, Ms. Meadows child was tested for academic proficiencies. Her test results indicated that she was performing below expected grade levels and certainly not at the academic levels officials at the Elmwood Franklin had represented to her.

Gina Davis Walking 4 Hope Brings Cancer Awareness to the Black Community According to the American Cancer Society, African Americans have the highest death rate and shortest survival of any racial and ethnic group in the US for most cancers.

In 2008 Gina Davis, after being diagnosed with breast cancer, faced the sobering reality that she could well be among those statistics. But instead of taking the diagnosis as a death sentence, Gina choose to fight for life.

She began her treatment in Buffalo before eventually continuing on to the Cancer Treatment Centers of America in Arizona. She recalled how one of her nurses in Arizona encouraged to her to come up with her own words of comfort and encouragement to get her through each day while on the road to becoming cancer free. At one point, after a deep breathing treatment, she recalls returning to her room, only to begin doodling and writing the name “Jesus, Jesus…

GINA DAVIS breath…breath…jes breathe!” She said she told herself that every day. Thus “Jes Breathe” was born.

“Jesus gives us every breath we take,” she said in a 2012 interview. “Breathing comes so naturally. That’s what we need to do: take deep breaths and get a grip. It’s all going to be all right.”

In 2009 she started the Gina Davis Jes Breathe Cancer Awareness Walking 4 Hope to raise awareness about all types of cancers, not just breast cancer.

And she choose to hold the annual event in Martin Luther King Jr. Park to bring the message of cancer awareness closer to home to the African American community. The Walk 4 Hope has grown with each year.

Whether you are a cancer survivor, currently undergoing treatment for cancer, or have a family member, friend or loved one either battling this dis-ease or has made the transition as a result of it, you are invited to come out to MLK Park this Saturday, August 22. For the 6th Annual Jes Breathe Walking 4Hope and cancer awareness event. Registration for the Walk 4 Hope is free.

Events will include guest speakers, a 2.5 motorcade, and the ECMC Mammogram Bus which will offer free mammograms in the park from noon to 4 p.m.

Two male cancer survivors will be the guest speakers; one of them battling cancer now for the 4th time.

The event said Gina, is the organization’s annual fundraiser.

Although there is no fee for the Walk 4 Hope, Jes Breath Tee Shirts and baseball caps will be sold to raise funds. The 30-minute Walk 4 Hope – designed to accommodate all walkers – will begin at 2 p.m. Gina’s experiences have reinforced her conviction that anyone who is battling cancer needs to be courageous, informed, and willing to be proactive in his or her own care “We’re going to be celebrating lives!” said Gina in reference to Saturday’s gathering.

Janelle Monae Leads Protest in D.C. Janelle Monáe proved to be an artist who isn’t just about talk on the heels of releasing her new song dedicated to the Black Lives Matter movement.

The Teen Awareness Group (TAG) at GROUP Ministries, Inc. completes its 20th year of Programming Buffalo STEP co-founder Asia Redd (far right) with proud students.

BUFFALO STEP WRAPS UP SECOND SUMMER SESSION!

The Buffalo Science and Technology Enrichment Program (Buffalo STEP) just wrapped up it’s 2015 summer STEAM camp. This summer, children in the Buffalo area were selected to participate in the program that covered varying elements of computer science. The camp was held at the Delavan-Grider Community Center.

The session celebrated it’s kick off with an appearance from local celebrity chef, Bobby Anderson of “F-Bites.” Anderson, a Niagara Falls native and season 4 finalist on the popular television show “Hell’s Kitchen” with Chef Gordon Ramsey, shared his original “Rocket Torte” dish, a nutritious yet delicious, frittata styled-dish. He spoke with the participants about team work, professionalism and the importance of being willing to try new things.

Camp presenter and video game developer, Ethan Redd, shared his recent independent video game release, “Rad Road Rally” to demonstrate STEAM at work and provided a real life example for where the skills taught could lead to.

“This year, I wanted to stress to the kids that just because something is labeled as ‘hard’ doesn’t mean that it’s impossible.

Anything is possible with a little hard work and dedication.”

The kids spent the rest of the week exploring the insides of computers and learning the basics of Java, a programming language used to create computer applications. They participated in a group activity creating a “Pong” styled video game using Java. The second week was comprised of learning some 3D modeling and animation. The campers used a combination of their new found skills and their imagination to create their own projects and learned the basics of web programming languages HTML and CSS to build their own individual websites.

The session ended on Friday, August 7 with a celebration of the children’s accomplishments. Each child received a certificate of completion for their hard work throughout the session. Asia Redd, camp co-founder and director was very proud of each participant. “This year was a great experience for us. It was so rewarding to see the kids finally get concepts that they struggled with and put them to practice.”

GROUP Ministries, Inc., in partnership with MAD DADS, the Homicide, Education and Prevention program and the Erie County Youth Bureau, completed its Primetime Summer Mentoring Program on Saturday, August 8th. The closing ceremony was held at the Frank E. Merriweather Library and was attended by all the TAG students, their families and the workshop presenters.

TAG Mentoring is a life awareness program designed to educate the youth in our community who are at risk. TAG addressed some of the issues that currently plague our community such as bullying, gang violence, homicide, low self esteem, substance abuse, HIV/ AIDS, teen pregnancy and the struggle of interaction with law enforcement.

The mission and ultimate goal of TAG is to provide our youth with the necessary tools to assist them in making healthy decisions and choices now and Congratulations Teen Awarness Group! in their adult lives.

The Carousel of Disrespect

There’s Accountability and then there’s Accountability

wo weeks ago I wrote a column entitled “A Call for Accountability”. The article focused on a letter from the Minority members of the Board to New York State Commissioner, MaryEllen Elia requesting the removal of Carl Paladino from the Buffalo Board of Education.

We cited actions and behaviors by Mr. Paladino that have systematically demonstrated blatant disregard for education law governing individual board member authority and a lack of respect and civility that contributes to dysfunction and low morale in the District. There is no scarcity of documentation regarding these actions as they have been thoroughly reported in the media and in Mr. Paladino’s own publications. We have been joined by others, who have also written letters to the Commissioner as well as a grassroots group that has called for Mr. Paladino’s removal.

Yet, officials, community leaders, fellow board members and others have remained silent and ignored a growing body of egregious acts.

We live in an era of accountability and a culture that brooks “no excuses”.

Does being accountable, however, only apply to some and not others? Take our schools, for example, and by extension our students, who are judged by accountability measures that determine categories labeling them, “failing, priority, focus, or good standing.” Recently these labels changed to include “persistently struggling and struggling”. For Buffalo schools, the “good standing” ones are in the minority. And just within the last few months nearly half of our schools have now been identified as “struggling” and “persistently struggling”. These designations are based on several years of accountability data that purport to identify long-standing lack of achieveBarbara Seals ment in these schools.

Nevergold Last week the State Education Department released the results of the ELA (English Language Arts) and Math standardized tests that are the holy grail of accountability for our schools. These tests are given to students in grades 3 – 8. With few exceptions all students regardless of special education needs or English Language fluency take the same exams. Since the 2012-13 school year these tests have been aligned with the new Common CORE Learning Standards. Educational experts have raised many questions about these high stakes tests; they are developmentally inappropriate, some of the answers are designed to “trick” test takers, the exams are not diagnostic so teachers can’t use individual results to customize lessons to address a student’s specific needs, some children are stressed and demoralized by the hours-long testing experience, teachers are being pushed to teach to the test leaving less time for art and music, for example and tying test scores to teacher evaluations is being contested as not valid.

Opposition to use of these tests has been growing in the State. This year over 200,000 students, appropriately 20 percent of the student population in the State, refused to take these tests for the foregoing reasons. As a result, we should question the validity of these tests even more. (I encourage readers to take a look at these tests. Sample tests are available on the EngageNY website.)

Further, the test results over the last three years should raise questions about their use as the accountability measure determining the fate of our schools. For comparison, the ELA tests resulted in the following statewide percentage of students who scored proficient (level 3 or 4) on the tests.

•2012-2013 - 31.1 2013-2014 – 30.6 2014-15 – 31.3 According to a press release from the State Commissioner, “overall, students statewide have made incremental progress in ELA and Math since 2013, the first year assessments aligned to the more rigorous learning standards…..” Note, however, that the 2015 score represents less than a 1 percent gain. Math scores ranged from 31.1% in 2013; 36.2% in 2014 and 38.1% in 2015, about a 2 percentage point increase.

Buffalo’s scores on these exams for the same periods are as follows for ELA: •2012-2013 -11.5 2013-2014 – 11.9 2014-15 – 11.9 Our math percentages were: 2012-2013 – 9.6 2013-2014 – 13.1 2014-15 – 15.1 I am not making “excuses” for these scores as I know that we have a literacy problem in our schools that is serious and must be addressed urgently, but if the State Education Commissioner can describe the statewide scores as showing “incremental progress” then why can’t Buffalo be cited as showing “incremental progress” given the challenges that we face? Why are we the poster district for schools in crisis when Rochester’s School District posted ELA results: •2012-2013 – 5.4 2013-2014 – 5.5 2014-15 – 4.7 Carol Burris, recently retired award-winning New York state high school principal, also writes that statewide “Only 4.4 percent of all English language learners and 5.7 percent of students with disabilities were proficient in English Language Arts.”

Given the numbers of students who opted out of these tests, the question being asked is whether this year’s results can even be considered valid. Burris writes “Three years of data make it crystal clear that the New York State Education Department is giving inappropriate tests, which are, for most students, a prolonged and arduous exercise in multiple guess.” The validity question is particularly relevant to Buffalo as these tests have been used to determine the fate of our 25 struggling and persistently struggling schools. They will be managed by the Superintendent Receiver this year and next and must show “demonstrable progress” doing that period to avoid the appointment of an outside receiver by the State.

The Commissioner is now looking for ways to punish school districts that have large numbers of opt-outs. Of course the justification for any sanctions will be to enforce accountability. So,

ver 50 years ago, in our Public School System, a book titled “Little Black Sambo” was part of the curriculum plan for reading. For African Americans, particularly the children, this book was debasing, humiliating and embarrassing, not for the story content but how the Sambo was illustrated.

Sambo was very Black in skin color, with exaggerated buffoonery wide eyes, thick nose and very red lips.

This image of Black Sambo caused much consternation, causing many African American children to be ashamed and embarrassed about themselves, not that they looked like Sambo, but because they felt this was the perception of how some of White society viewed African Americans.

The images on the Ontario Beach Carousel (Rochester), created 110 years ago, depicts a small female Black child confronted by a seemingly angry rooster. She has the stereotypical buffoonery look of fear with exaggerated wide eyes, unkempt hair, wide nose and very red lips; while another Black child illustrated the same way peers from the side of the building. Both of the children are similar illustrations to the little Black Sambo character.

The picture on the Ontario Beach Carousel is offensive, humiliating and racist to African Americans today as was the little Black Sambo character which was banned from schools and bookshelves in America nearly 50 years ago. The depiction of the two Black children represents a time in this country, 110 years ago, when African Americans were treated worse than second-class citizens. Slavery of 300 years had ended only 60 years when this illustration was done. During this time African Americans were segregated against, men and women murdered with no consequences, denied decent housing, education, employment and most of the amenities needed to exist.

Therefore the question raised with serious concern is how these characters can be used as a teachable moment, unless these moments reflect the aforementioned atrocities and the sting of racism that still exists to this day as exhibited by the resistance to remove these illustrations from public view.

These images serve no other purpose at this time than to denigrate, abase and humiliate African Americans and insult their children.

When the little Black Sambo book was banned and removed, African Americans no longer had to view or read about an unflattering caricature portrayed as African American or remember a time that is better forgotten by all Americans.

This should be the case with the carousel caricatures.

groups. In emergencies, the poor, the nonwhite -- particularly African Americans, and the elderly will require extra attention and resources because they are the least likely to be able to help themselves survive a disaster.

American communities are highly segregated by race and ethnicity. There are also differences in groups’ media choices and communication networks. In our segregated society, a universalistic approach to outreach and education about natural disasters will not be as effective as an approach that acknowledges American spatial and social divisions.

In the short-term, effective planning and targeted outreach can mitigate the effects of future disasters. In the longer-term, we need to significantly reduce race and class inequality, and to address climate change.

Getting the schools back on track all starts with the correct mindset he continued.

“It starts with a mindset… what you believe about the children…every child has promise,” he declared. And although we may not be able to control a child’s socio economic condition, he said “we can control how we believe in these children…You have to change your mind about the children and what can happen.”

He acknowledged that “there is a lot of good here and “we will celebrate it.”

He said he will continue to talk to as many people as he can to get an adequate assessment of the situation, but assured : “My goal has never been to be well liked …but to be well respected and to get the work done for the children…”

He added that he was about “the whole child – not test scores only.” And that he is in search of “good schools period” and delivering top flight services.”

“I’m in support of strategic initiatives that match the needs of the children.”

Cash’s position on the role of parents was also encouraging.

He is not a “blame placer.”

Parents care, he said.

Pursuant to the provisions of the Local Finance Law, constituting Chapter 33-a of the Consolidated Laws of the State of New York, as amended (the “Law"), and to the provisions of other laws applicable thereto, $5,655,912.55 bonds of the County, or so much thereof as may be necessary, are hereby authorized to be issued to finance the cost of a increase and improvement of facilities of the Erie County-Southtowns Sewer Treatment Agency, consisting of the reconstruction and/ or rehabilitation of approximately 20,000 feet of sanitary sewer and the upgrading of sewage pumping stations, all as more fully described in the report and estimate of costs approved by the board of County managers of the Southtowns Sewer Treatment Agency on April 29, 2004 and filed with the County Legislature pursuant to Section 268 of the County Law of the State of New York. The estimated maximum cost of said specific object or purpose, including preliminary costs and costs incidental thereto and to the financing thereof, is $9,000,000. The plan of financing includes the issuance of $3,344,087.45 of bonds authorized and issued prior to the date hereof pursuant to the provisions of the Original Bond Resolution and the issuance of $5,655,912.55 of bonds herein authorized and any bond anticipation notes issued in anticipation of the sale of such bonds, and the levy of a tax to pay the principal of and interest on said bonds and notes, the said principal and interest to be reimbursed to the County by the assessment and levy on the real property in (i) Erie County Sewer District No. 3, (ii) the Town of Hamburg on behalf of the Hamburg Master Sewer District, Amsdell Heights, Locksley Park, Cloverbank, Benz and Taylor Road Sewer Districts being Sewer District Nos. 21, 7, 10, 5, 4, 8, and 11 of the Town of Hamburg, (iii) Wanakah Sewer District No. 3, (iv) Mount Vernon Sewer District No. 2, and (v) the Village of Hamburg, each in accordance with their respective proportionate shares of equivalent dwelling units in their service areas, as determined pursuant to the Southtowns Agreement.

Section 2. The period of probable usefulness for the specific objects or purposes for which said $5,655,912.55 bonds herein authorized to be issued, within the limitations of Section 11.00 a. 4. of the Law, is forty (40) years.

Section 3. Current funds are not required to be provided as a down payment prior to the issuance of the $5,655,912.55 bonds authorized herein, or any bond anticipation notes issued in anticipation thereof, pursuant to Section 107.00 d. 3. of said Law. Section 4. The County intends to finance and the Comptroller of the County is hereby authorized to advance such amounts as are necessary to pay the costs of said improvements, prior to the issuance of the bonds or bond anticipation notes herein authorized, out of any available funds of the County on an interim basis, which respective amounts are reasonably expected to be

reimbursed with the proceeds of debt to be incurred by the County pursuant to this Resolution, in the respective maximum amounts of bonds herein authorized. This Resolution is a declaration of official intent adopted pursuant to the requirements of Treasury Regulation Section 1.150-2.

Section 5. Subject to the provisions of this Resolution and of the Law, and pursuant to the provisions of §21.00 relative to the issuance of bonds having substantially level or declining annual debt service, §30.00 relative to the authorization of the issuance of bond anticipation notes or the renewals thereof, and of §§50.00, 56.00 to 60.00 and 168.00 of said Law, the powers and duties of the County Legislature relative to authorizing the issuance of any notes in anticipation of the sale of the respective amounts of bonds herein authorized, or the renewals thereof, relative to providing for substantially level or declining annual debt service, relative to prescribing the terms, form and contents and as to the sale and issuance of the respective amounts of bonds herein authorized, and of any notes issued in anticipation of the sale of said bonds or the renewals of said notes, and relative to executing agreements for credit enhancement, are hereby delegated to the Comptroller of the County, as the chief fiscal officer of the County.

Section 6. Each of the bonds authorized by this Resolution and any bond anticipation notes issued in anticipation of the sale thereof shall contain the recital of validity prescribed by §52.00 of said Local Finance Law and said bonds and any notes issued in anticipation of said bonds shall be general obligations of the County of Erie, payable as to both principal and interest by general tax upon all the taxable real property within the County. The faith and credit of the County are hereby irrevocably pledged to the punctual payment of the principal of and interest on said bonds and any notes issued in anticipation of the sale of said bonds or the renewals of said notes, and provision shall be made annually in the budgets of the County by appropriation for (a) the amortization and redemption of the notes and bonds to mature in such year and (b) the payment of interest to be due and payable in such year.

Section 7. The validity of the bonds authorized by this Resolution and of any notes issued in anticipation of the sale of said bonds, may be contested only if: (a) such obligations are authorized for an object or purpose for which the County is not authorized to expend money, or (b )the provisions of law which should be complied with at the date of the publication of this Resolution are not substantially complied with, and an action, suit or proceeding contesting such validity, is commenced within twenty days after the date of such publication, or (c) such obligations are authorized in violation of the provisions of the Constitution.

Section 8. This Resolution shall take effect immediately upon ap-

proval by the County Executive.
