Annual Golf Day
The Annual Golf Day continues to be the flagship event on the CCF SA’s event calendar. Held each year, we play under Ambrose Rules in teams of four. Always a sell out, golf is followed by a Presentation Lunch hosted by a high profile personality. Over 120 people, play golf and attend the lunch from a wide variety of organisations. Many are directors or owners of companies who are decision makers within their organisations. They all appreciate and actively support sponsors of the golf day and like all businessminded people, want attendees to enjoy a great day out on a world-class golf course. Terms and Conditions These Terms and Conditions together with the Event Partnership Prospectus and the Acceptance Form (“Application”) constitute an agreement between you and CCF SA. To the extent of inconsistency, these Terms and Conditions apply. By submitting an Application to CCF SA you acknowledge you have read and agree to be bound by this agreement. Acceptance and Payment 1. Acceptance of any Application is at CCF SA’s absolute and unfettered discretion. Event Partnerships are limited in number and are generally assigned in order of receipt. 2. Application’s acceptance does not imply endorsement by CCF SA of your company, service/s or product/s. 3. If the Application is accepted, CCF SA will advise you in writing as soon as practicable and issue a tax invoice with respect to the Fee payable. Payment of Fees must be made within seven (7) days of CCF SA issuing the tax invoice. 4. CCF SA will not commence meeting its obligations until the Fee has been paid in full. Event Partnership 5. The Event Partnership will last only for the duration of that particular Event, including any pre and post event promotional activities. 6. CCF SA will use its best endeavours to ensure that Event Partners are not comparable or in competition with an existing Partner. CCF SA may seek the approval from the current Partner before accepting any subsequent Partner. 7. Event Partners have a first right of refusal to continue their Partnership for the same Event in the future, provided advice is given to CCF SA no later than 15th June . 8. If the Event is cancelled by CCF SA the Event Partner is entitled to refund of the Event Partnership Fee only if the Event is not rescheduled within twelve (12) months. This clause does not apply to Partners. 9. If the Event Partner cancels its Event Partnership no refund of Event Partnership Fee is given. 10. CCF SA will not be responsible for any loss of or damage to any of the Event Partner’s equipment, material, equipment, exhibit or other belongings brought by the Event Partner’s or on its behalf to the Event, whether by fire, theft, accident, injury or otherwise. The Event Partner shall obtain appropriate insurance to cover any related loss or damage. 11. To the maximum extent permitted by law, CCF SA will not be liable for any loss (including indirect or consequential loss), expense, damage, personal injury or death incurred (whether or not arising from negligence) by the Event Partner in connection with the Event. Termination 12. Each party may terminate this agreement immediately by notice in writing at any time if either party breaches this agreement. 13. CCF SA may immediately terminate this agreement by written notice to you if you: (i) being a company, have appointed a receiver, receiver and manager, trustee, administrator, other controller or similar official over any of your assets or undertakings, you are or become unable to pay the Fee when they are due, or you are presumed to be insolvent; or (ii) being an individual, become bankrupt or enter into any arrangement or composition with your creators or propose to do so.

General 14. This agreement shall not be disclosed to any third party/s without the prior written consent of both parties. 15. You should seek independent advice in relation to any requirements or implications as set out by the Australian Taxation Office. 16. The parties will both use their best endeavours to protect the integrity and goodwill of the other party’s brand. 17. Each party shall indemnify the other against any claims arising from any breach by either party. 18. Where one party is unable to carry out its obligations under this agreement due to circumstances beyond its control or which it could not have prevented, those obligations are suspended whilst those circumstances continue, provided the other party is notified and the first party uses its best endeavours to overcome the circumstances preventing its obligations from being carried out. 19. In the event of a dispute arising that the parties themselves cannot resolve, the parties agree to refer the matter to an independent arbitrator appointed by mutual agreement. 20. The rights of either party under this agreement shall not be transferable or assignable either in whole or in part, without the consent of the other party. 21. Event Partners will not do anything or become involved in any situation which, in the reasonable opinion of the CCF SA, brings CCF SA into public disrepute, contempt, scandal or ridicule, offends public opinion or reflects unfavourably upon CCF SA’s reputation. CCF SA will be the sole arbiter in this regard. 22. The failure by a party to enforce at any time any of the provisions of this agreement must not be interpreted as a waiver of such provisions. 23. If any provision of this agreement is held by a court to be unlawful, invalid, unenforceable or in conflict with any rule of law, statute, ordinance or regulation, the validity or enforceability of the remaining provisions will not thereby be affected. 24. This Agreement will be read and interpreted according to the laws of the State of South Australia and the parties submit to the exclusive jurisdiction of the courts of that State. 25. CCF SA might change these Terms and Conditions at any time without notice to you. Those changes will apply to the provision of advertising services after the date the change becomes effective. You and CCF SA will be bound by the Terms and Conditions that are current as at the date of your Application.
