A word from our

PRESIDENT As we move through to the end of the 2017-2108 Financial Year, for my business and I suspect many others, would have seen a year of increased work. This increase in work loads has changed our business focus.

Although we are still making sure our books are abundant with work, most of us have used this time looking for the next project to now looking at planning and structural changes for the future.

Looking at ways to increase our plant and personnel, and reduce costs.

The new financial year sees us come into the first time with a State Liberal Government in 16 years. With the election of Steven Marshall as Premier of our State I am hopefull that we will see effective change that will see a focus on developing our State to be the powerhouse that it once was. Seeing growth that will see a proud State prosper once more in all areas and in all regions. The CCF SA has had a long and constructive relationship with Mr Marshall and a number of his Ministers over the years, and we hope to strengthen our involvement leading into the future.

The CCF SA has been working tirelessly to help influence and direct the buoyancy of construction projects within metro and rural South Australia. It is though a constant fight. As an industry, I feel that we still need some long-term consistant work. Firstly, to help make our industry a more profitable enterprise, and secondly, to see increased employment and training for the future.

The long-term downward trend in our economy over the last 10 years has seen a lack of investment in our people. Reduced upskilling of our existing workforce and a lack of investment in the next generation of Civil Contractors have left a void in the experience of our industry. This has made it difficult for our industry to be flexible to expand quickly and adapt to the changing landscape.

This is where I believe the CCF SA, Civil Train and TrainSA will be helpful in training the next group of workers and help upskilling our current workforce. This includes white card courses through to Professional Development offered in our Forward Gears Programs.

The CCF SA has been working very hard with the State Government and the Construction Industry Training Board (CITB) in order to make the biggest change to training in the Civil Construction Industry for some time. We have been working towards the implementation of an Apprenticeship scheme for our industry. Our aim is to give kids coming out of school and others an opportunity to make a lifelong career in our fantastic industry. We want to help them achieve a qualification that will give them the experience and knowledge for the future.

To give them a direct pathway into a lifelong career. To lift our industry into a recognised trade.

Our efforts come at a good time with the State Government announcing its intention to invest millions of dollars in Apprenticeships. This investment from the State Government and a new Qualification

should hopefully see the gap in skills and personnel close up.

Investment in infrastructure by the Federal and State Governments over the last several years has been the basis of an uplift in productivity for our State. With a number of the larger projects underway and fastly approaching completion, we need some confidence in the long-term investment for our future.

We remain confused about the federal government commitment to SA with 1.8 billion dollars in infrastructure spending in SA promised prior to the last federal budget. But when the budget was delivered, we found only a small number of projects being funded. This has seen some drop in confidence. With the introduction of the Liberal State Government recently, the CCF SA and a lot of our members are confident that we can work with the State Government to help influence federal funding of a large portion of projects in the short term rather than the long term.

With the upcoming federal election within the next 9 months, we have an opportunity to gain the funding required to see the infrastructure spend that our State needs. The CCF SA also has a presence in Canberra. Chris Melham is our national CEO tasked with helping our industry gain the funding needed for the best outcomes.

Gerard Beltrame, our previous State President, is our State representative on the CCF National board.

The newly elected State Liberal Party has promised to create Infrastructure SA, an independent body that will assess and prioritise infrastructure spending within SA. Their aim is to work with Infrastructure Australia to gain funding for the most needed infrastructure funding based on need, not on political gain. Also, to find the most cost effective solutions to construction outcomes, and to drive a more consistant body of work for all our Members.

While working with the Government on plans for infrastructure spending in our State, we are still working consistently with the Industry Advocate to change the way Government projects are procured and managed. This has seen an increase in local employment opportunities.

Along with the increased local involvement, we are looking to try and influence a reduction in the amount of red tape that is involved in our work. For a long period of time in Federal, State and Local, there has been a large increase in the amount of work to both procure a job and manage it, often with little financial reward along

the way. The CCF SA, State Government and the Industry Advocate have been in discussions on the best way to help relieve some of these pressures on businesses.

Hopefully, you will see a number of changes in the way information is obtained, stored and managed in all forms of government projects.

In regards to the CCF SA, we have seen the opening of our Live Training site on Heaslip Road, Burton. We are also investigating changing the layout of CCF House in Thebarton to better utilise the space we have. This will hopefully see a better financial outcome in the future for our members.

We have seen several changes in staff at CCF SA over the last 12 months. This has given us the opportunity to make effective changes for the future. We have seen some long-term people that have sadly moved onto different places as well as some short-term changes. As with all businesses, change in staffing is a constant battle, and is seen as opportunity not as a disadvantage.

Civil Train SA is operating in Adelaide, Port Augusta, Alice Springs and Darwin, and now we will be operating in Perth WA. We were asked by CCF WA to look at delivering training in Western Australia several months ago. A business plan was developed by CCF SA CEO Phil Sutherland and CCF staff. After careful consideration from the Board, it was decided for the best interest of the CCF SA and some great opportunites for our members that we would take the opportunity head on. We will be delivering training in WA from 1 July 2018.

From a board perspective, I believe we have a good diversity of all aspects from the Civil Construction Industry. A board that is functioning well with passionate input into how the CCF SA is run. Input into advocacy and the the role the CCF SA will play well for our industry.

The current board are focused on what is best for the State and our industry.

I am confident that as a board, we effect change for the better by evolving to provide solutions to a range of issues that affect our industry. Our board members volunteer their own time for the betterment of the CCF SA and all its members.

In closing, I would like to wish all our Members the best of luck for the new financial year and look forward to seeing you at one of our many functions in the near future

WHY?...

Why do many councils, at significant cost to ratepayers, own and operate their own civil construction plant and equipment and undertake their own civil works when there are private civil contractors in their community ready, willing and able to do so?

This unnecessary overhead has contributed to the much criticised upward movement of council rates - well above CPI. We say get out of the civil construction and maintenance business and reduce this overhead and tax burden from your community.

Civil construction and maintenance work should all be put out to tender to give the community the benefit of competition which drives down costs and drives innovation and efficiency.

The private sector is at the heart of all successful economies and is the sustainable job creator and economic driver.

By self-performing civil construction works councils are taking work away from local business.

These comments do not apply to those councils where there are no private civil contractors in their community with the capacity to undertake the required civil works. It is appropriate for these councils to self-perform. Bravo to those councils who have made the decision to stop selfperforming civil works, but rather to use public investment in civil construction through private civil contractors to stimulate their local economy, make local business more viable, and grow local jobs.

The Marshall Government’s First Months – Richard Blandy* Five months ago, South Australians elected a Liberal Government after 16 years of Labor rule in the State.

T

he State’s economy had been doing badly under Labor. But the truth is that the South Australian economy has been doing badly relative to Australia as a whole for more than half a century, ever since the post war economic boom came to an end with the defeat of Premier Tom Playford’s long-serving LCL Government in March 1965.

Will Premier Steven Marshall’s Government resurrect South Australia’s economic fortunes so that our children and grandchildren and great-grandchildren can have a future close to us?

This is everyone’s hope.

The task is huge; and it will take a long time to entrench a political change to a successful, long-term, economic strategy.

It is very early days (only five months since Marshall and his team took over the reins of office), but there are some hopeful signs.

The latest Labour Force Survey data were released by the Australian Bureau of Statistics on Thursday 14 July.

Looking at State by State changes over the last quarter (since the election), trend employment in South Australia has gone up by 0.3% compared with 0.2% for Australia as a whole. The ABS says that trend data provide the best measure of the underlying behaviour of the labour market.

Looking at the unemployment rate of 15-24 year-olds, over the past year (no trend data are available to allow reliable comparisons over a three-month time period) the unemployment rate in South Australia has

fallen from 17.2% to 12.1%, whereas in Australia as a whole it has fallen from 12.1% to 11.0%.

What the political model in South Australia has failed to acknowledge sufficiently since Playford is that economic and jobs growth come from private business investment.

Even public sector jobs growth comes ultimately from private business investment, because business profits and wages provide the tax base that funds the public sector.

Queensland has done so well economically over the past quarter century because private business investment has increased from 13% of Gross State Product in 1990 to 21% today, whereas the share of private business investment in South Australia’s economy has increased only slightly – from 14% of GSP in 1990 to only15% today.

The reason why South Australia has not done well, economically, is that profits in South Australia are too low. Instead of cutting business’s costs to allow profits to rise generally, South Australian governments of both stripes have tried to have low profits, apart from some “winners” that the Government and its various investment-picking agencies have selected, whose expected profits have been raised sufficiently through State subsidies of one sort or another (paid for, in part, by other businesses) to induce them to invest here.

There is no need for Government investment-picking agencies if expected profits generally are high enough to provide sufficient incentive for businesses to invest across a broad front.

In any case, every member of such agencies should be required to buy (and to hold for 5 years) $50,000 of shares in each business so nominated, whether the Government should decide to offer a subsidy or not.

The new Government’s most encouraging economic policy change is that it is not going to pick “winners”. This must mean that it is serious about raising profits as a share of the South Australian economy.

To assist the Government in its reform task it is setting up a South Australian Productivity Commission.

The Productivity Commission’s objects include “to improve the rate of economic growth and productivity of the South Australian economy…, to improve South Australia’s competitiveness for private sector investment, and to reduce the cost of regulation”.

On the grapevine, one also hears that the Government is highly regarded by senior Public Servants for its rigorous decisionmaking approach, and its emphasis on receiving independent and transparent policy advice.

These are all good signs – bedrock is being built on which the rate of profit in South Australia can rise, resulting in an increase in the rate of economic growth, faster jobs growth and a faster rise in South Australians’ living standards, sustainable over decades.

LIONS 360, THE NEW EXHIBIT AT MONARTO ZOO - A CLOSE-UP EXPERIENCE FOR LIONS AND THEIR VISITORS.

MONARTO ZOO BENEFITING FROM A DOMED CAGE FOR PEOPLE THE first priority for Sarah Constructions when it went on site at Monarto Zoo to build the Lions 360 exhibit was to put an electrified fence between workmen and the lions.

T

he fence was constructed in three days, all that could be allowed because that’s how long the lions, 11 in all, could be kept in their night quarters. It extended 110 lineal metres, was 3.75 metres high and had three electric wires.

Chain mesh went 200mm below ground and back into the lion enclosure 900mm to stop them digging under the fence. This gave a work site of about 4,000 square metres. The fence was later taken down and re-positioned as a front fence, again in three days.

As a further safeguard, Project Manager Peter Golotta had another temporary fence “like they have at concerts” erected two metres back from the lion-proof fence so it stopped contractors getting too near. “The lions were always interested, running up and down and watching us all the time,” he said.

Lions 360 is basically a domed cage for people inside the lions’ 10-hectare habitat at the zoo. It is modelled on the great white shark cage diving experience at Port Lincoln. Visitors walk through a16-metrelong tunnel starting outside the enclosure with room inside for 30 people.

For 45 minutes they have the chance to feed lions through the heavy-duty mesh roof as well as view them from the cabin of an attached Jeep with bulletproof glass

windows and windscreen. Permanently fixed without engine it was supplied by Just Wrecking Toyotas.

Sarah Constructions mobilised to site on May 18 2017 and took five months to complete the build. The workforce peaked at 30 – concreters, and workers to handle structural steel, electrical requirements, plumbing, and formwork. Thirteen pre-cast concrete stormwater culverts 16 metres long 2.4 metres wide 2.1 metres high flipped upside down were used for the tunnel.

Visitors walk through a 16-metre-long tunnel starting outside the enclosure with room inside for 30 people.

A curved angled retaining wall was extremely difficult to build. It took much planning and surveying to get it right. It is three metres high with each side of the enclosure holding back soil so the lions can walk up on top of the cage. The structural engineer conducted all calculations required for weight of lions on top for every scenario.

The main steel columns were fabricated in Mount Gambier by Krueger Engineering in

three sections, 150mm x 150mm x 6mm with a mixture of 75mm x 50mm and 100mm x 50mm purlins. They were sent to the company’s subcontractor for a three-coat protective paint system: primer, undercoat and finish. The columns were delivered separately to site for assembling.

“Doing it this way cut installation time from three to four weeks, to three days, and gave better quality control,” Peter said. “The painting had to be perfect first time round; doing it within a controlled environment ensured it was.”

Concrete formed part of the structural slab; 3-D modelling and 3-D surveying ensured the pour allowed for 39 pockets. These had to be boxed out for precise positioning of the columns and hand-rail mullions.

Some 55 cubic metres of concrete and 15 tonnes of structural steel was used and 50mm x 50mm weld mesh covers the entire structure.

“Another challenge was working inside a fully operational zoo,” Peter said. “You have kids near the site and trucks bringing in heavy deliveries. iki runs the business with older brother Con. They and younger brother Arthur started it in 1996.

“We got into this because my little brother wanted to drive trucks,” Niki says. “So we bought a truck and it went from there.

We divvied everything into who was best suited for each position. This made working together very easy for us; each of us knew our responsibilities clearly.”

“In this industry we can be very gung-ho.

You see it with so many companies that over-expand and take too many risks, increasing their liabilities. And when they reach the point of no return, doors shut and they move on leaving a trail of debt with no apologies to those they have harmed.”

The core business is civil earthworks in all facets. “We do it all – carparks, build pads, roadways, kerbing, paving, landscaping, undercrofts, bored piers and demolition. We like to take on varying sized contracts as this gives us short-term and long-term projects.”

What has this taught you? “It’s simple, never have liabilities you cannot service, have checks and balances, be responsible for your own actions and remember the basic rules in business abc123, it’s not that hard. Pick your path and be determined to succeed. Look after your business and your people, and don’t leave a path of destruction behind you.”

Arthur passed away in 2010 and Con, who was in the field, had to adapt to managing.

He is now Project Administrator. “I am very proud of the way he has conducted himself,” says Niki who handles the financial side.

All up there are 26 staff members – civil engineers, construction managers, leading hands and supervisors, operators and labourers.

How does success come? “Success today requires identifying and dealing with market shifts. It is insufficient just being operationally excellent; you have to be agile to deal with changing and diversifying. Our family-based culture sets us apart from our competitors, which is demonstrated through the solid growth of SA Earthworks’ resource base and high calibre of employees.

PLAYFORD’S FUTURE LOOKS PROMISING Infrastructure is being funded by the private sector, the council and state and federal governments, the latter through its National Stronger Regions Fund. A table published by the council lists 15 capital projects valued at $274 million to create 3,260 jobs. The strategy has three stages: infrastructure, buildings, and potential commercial development opportunities.

A first-stage milestone was reached in October 2017 when Prince George Plaza was opened. It’s a 3,000 square metre expanse of concrete with a central lawn with another 30,000 square metres of space in 12 development-ready commercial allotments for sale as restaurants and bars.

James Pollock, City of Playford General Manager, Strategic Projects and Assets, likens the plaza to Melbourne’s Federation Square. “It will be a place for recreation and a place to hang out,” he said, adding: “We can stage a caravan or camping show and invite tourism into the area, and where we have a hotel we create jobs. With the Holden closure we are making sure we have a future economy here.

“It’s a great place for people to enjoy a picnic on the lawn with friends and family.

Furthermore, it’s a real drawcard for tourists when we stage large events like Christmas markets, the Fringe or Tour Down Under festivities.”

Mr Pollock said Playford’s new CBD will service people as far north as Port Augusta and all of the Barossa Valley. It is centrally located being near the Elizabeth Shopping Centre, one of the biggest in SA, and adjacent to Main North Road which carries 65,000 vehicles per day on average.

Fremont Park, a nearby public park, has just been upgraded by Dig-It! Landscapes at a cost of $2.3 million. Lyell McEwin Hospital

in Elizabeth Vale is the second biggest in the state and part of the City of Playford health precinct. It is planning a major expansion of its emergency department at a cost of $100 million. The state government’s contribution is $52.5 million.

ACH Group is planning an $80 million development in the health precinct involving aged care, a medihotel for daycare patients, a child care centre and healthy living services. A hotel EOI has just closed and negotiations have been finalised with a private developer and operators for a 10-storey hotel.

An eight-storey office building is also proposed in stage one. It will have two levels for carparking. “We will be looking to let a contract in mid-2018,” Mr Pollock said.

“The value will be around $30 million. We will be looking for prospective tenants, which will generate around $30 million for our community.”

THE CENTREPIECE

THE FOUNTAIN FEATURE IS MOUNTED ON A PLATFORM IN PRINCE GEORGE PLAZA WITH WATER JETS AND LIGHTING MODERNISING THE SCULPTURE AND BRINGING IT TO LIFE.

BMD Constructions spent 14 months constructing the plaza on what had been a carpark. A new road, Prince Charles Street, was built between Playford Boulevard and Main North Road.

A water feature in the plaza is the refurbished fountain which Queen Elizabeth II officially unveiled at Windsor Green, its previous location, on her first visit to Elizabeth in 1963. It is mounted on a platform with water jets and lighting.

Playford has stormwater problems and a challenge of the scope was a 600 cubic metre capacity sump for capture and control of rain to prevent upwelling on road pits.

Earthworks had to be done to the levels required to create a good sub-base for the concreting that went over it.

In December, Pike Constructions began construction of a six-storey carpark at the corner of Main North Road and Philip Highway, Elizabeth. Costing $7.4 million, it will hold 360 vehicles and service the Playford CBD. Completion is expected in the last quarter of 2018.

For aesthetics, the plaza has a suspended LED lighting system. BMD laid out the allotments and in-ground services – the smart city infrastructure. “We have futureproofed with an in-ground conduit so we don’t have to dig up the streetscape again,” Mr Pollock said. “It’s a free Wi-Fi area and all the buildings will have access to the fastest internet speeds. We also have solar-power USB charging points for the public.”

Mr Pollock summed up: “After we get all the money from the developers it is not a burden on the ratepayers. The land we are developing keeps going up in value. It’s no good creating jobs down south because the unemployed are up here.

“With all this investment and development coming into the Playford CBD we are adding value to our area and providing a really positive future for our residents and businesses who wish to live, work and play in Playford.”

The list of capital projects includes a tennis centre (completed – Kennett Builders); clubrooms for Adelaide United (completed – Ausco Modular); a $40 million ice arena (awaiting state government approval at time of writing); Eyre Sports Park (Stage 1 nearing completion – AV Jennings); undercover lawn bowls complex in Elizabeth: $7 million (completion March 2018 – Romaldi Constructions); office for Department of Child Protection: $39 million (contractor to be announced); relocated Grenville Hub community centre: $20 million (contractor to be announced).

Security of Payment Landmark High Court Decisions

O

n 14 February 2018, the High Court handed down two key decisions relating to security of payment – the Probuild and Maxcon decisions. Both decisions provide further guidance on how the Building and Construction Industry Security of Payment Act 2009 (SA) (the Act) operates. The decisions have clarified two key aspects of security of payment: when an error by an adjudicator is appealable, and the legal enforceability of certain commonly used contract provisions. Both of these decisions carry potentially significant consequences for civil contractors.

Firstly, the High Court confirmed that adjudications cannot be challenged on the basis of an error of law, unless the error goes to the adjudicator’s jurisdiction.

While determining whether something is an error of law involves some complex legal considerations, the practical effect of it is that adjudicators now have far more leeway when making decisions. For example, in the Probuild matter, the Court held that even though the adjudicator had misapplied the

contract’s liquidated damages provisions (in favour of the claimant) this did not render the adjudication invalid.

Secondly, and more importantly, the Maxcon decision has wide-reaching implications on almost all civil construction contracts. In this decision, the High Court considered a fairly common contract provision that required the subcontractor to provide security in the form of ‘cash retention’, which would only be released to the subcontractor once a Certificate of Occupancy was issued (ie. project completion).

Because the release of the retention sum was dependent on the Certificate of Occupancy, the High Court found that as the payment of the retention sum was dependent on the operation of the head contract. As such, it was a ‘pay when paid’ provisions within the meaning under the Act and was rendered null and void.

This decision casts doubt on the validity of any clause which includes a mechanism to prevent or delay payments on account of, or makes payment contingent on, decisions or acts under any third-party contractual arrangement (eg. a certifier). It is likely that this will have wide-reaching implications for existing and future contractual provisions.

Changes to the Personal Property Securities Act – Are you Prepared?

There are two new issues facing the construction industry today that most are unaware of, including nearly all accountants DALE RHALL and lawyers, and they are both caused by the PPSA (Personal Property Securities Act). The introduction of the PPSA has brought with it some important changes to the way we should all do business. This includes how to prove a machine is yours and why you should protect yourself when extending credit to customers.

RISK 1: Preferential Payment Clawback The new method of liquidators dealing with a bankrupt company has left many vulnerable to clawback.

As indicated in the corporation’s act, the PPSR (Personal Property Securities Register) is the only service in Australia that can secure you as a creditor. In the past when a company or customer went under, the receivers were able to liquidate all assets and the secured creditors would get a viable 10 cents on the dollar.

The unsecured creditors generally got nothing.

Fortunately for the secured creditors, the system has changed. Now if your customer goes under, the receiver addresses the PPSR and will pay the secured creditors in order of the registration date in full.

When there is a shortfall of funds to pay the secured creditors, money may be retrieved from unsecured creditors that have been paid in the last six months.

This can be devastating to most companies if not secured.

What often happens is these unsecured creditors complete a job, get paid in good faith, or what is thought to be good faith, and then just six months later are told they must return their money. Imagine if this is you?

The only way to combat this is to become a secured creditor by having correctly written, legally enforceable terms of trade agreed to by your client and then register your secured interest on the PPSR. You

are not susceptible to preferential payment clawback if you are a secured creditor.

Considering all of your well-earned money is at potential risk, paying a small fee to register with the PPSR is a great deal.

RISK 2: Asset Seizure The PPSA has given receivers incredible powers of seizure. When shutting down a site, all equipment on the property can be seized and sold to pay off the debts of the bankrupt.

If you have equipment on site at the time then anything from a tool to a crane or from a car to an excavator can and will be seized.

There is only one defence and that is to have your interest in your own equipment registered on the PPSR. Having the purchase papers or having it registered with the road authority means nothing when it comes to secured interest. This a real and imminent risk.

ELIMINATE YOUR RISK There are a couple of ways to eliminate this risk and the first is to register your interest on the PPSR every time you take your equipment to site and remove the registration when you leave. The second is to structure your company so your assets are owned by a trust or holding company and internally lease them to the trading entity. Well, that is the way we always used to set companies up but it will no longer work. The missing piece is that the lease must be registered on the PPSR. The lease must also be written in a way that allows for the valid registration.

I know that this sounds very disconcerting but it has been put in place to help you protect yourself and as long as you get GOOD advice then all should work out ok.

The issue is getting good advice. There are currently 14 million registrations on the PPSR and 80% of them are invalid. This indicates that there is a lot of poor advice out there. The PPSR website cannot tell you if your registration is valid or not as that constitutes giving independent legal advice which they are unauthorised to do.

In most circumstances, operators working in civil construction undertake a Contract of Training to complete their Certificate III in Civil Construction whilst they are working full time, with a registered training provider, such as Civil Train. If you wish to become a supervisor you can also do on the job study at Certificate IV level.

THE 21st century already is notable for Adelaide’s renewed interest in trams. They were in vogue for 50 years until 1958 when the network closed except on the City-Glenelg route.

Adelaide reached a peak of 311 trams in 1931 operating over 133 route kilometres.

R

ejuvenation began in 2006 with the extension of the Glenelg to City tramline down King William Street to the Adelaide Railway Station and on to City West. The tramline was further extended in 2009 to the Adelaide Entertainment Centre.

The latest addition, the City Tram Extension Project, came into service the end of March 2018.

It’s a one-kilometre dual-track extension along North Terrace, from King William Street to East Terrace with three new stops: Museum, Art Gallery and State Library – Adelaide University and University of South Australia – East End. There’s also a 350 metre dual-track extension north along King William Road to a new stop, Festival Plaza.

The project has a design life of 40 years with a requirement for routine maintenance during that life.

Inserting a right-hand turn for trams on North Terrace so they can travel to the East End from king William Street was not incorporated in the design; pre-design examination showed it would clog traffic at an intersection currently catering for 60,000 vehicles a day. It would require a major excavation and remodelling of the existing intersection, and cost an estimated $37

million the Parliamentary Budget Advisory Service (PBAS) has been told.

A direct service to the East End from the Railway Station tram stop will allow more frequent services to the East End, ensuring the best service frequency for the overall network that services not only the East End but also Glenelg and the Entertainment Centre.

Downer York Joint Venture, a consortium of Downer EDI Works and York Civil, delivered the project at a total cost of $80 million.

This included the purchase, transportation and modification of three trams from Spain for use across the tram network. They are identical to the Citadis 302 tramcars currently in service. The fleet now numbers 22 trams.

Lachlan Roberts, DPTI Senior Project Manager, Infrastructure Delivery, said the trams were modified to suit rolling stock conditions here – air-conditioning and a traction power upgrade from a slightly different voltage.

DPTI ran an early contractor involvement (ECI) process for the project and through a procurement process engaged with the consortium. Aurecon was the design partner

for the designing/construction activities.

From March to July 2017 the design was developed and construction started on North Terrace in August.

The project was split into five stages. To minimise disruption to traffic and businesses within the precinct a strategy was adopted of undertaking works on a 24-hour basis seven days a week. Stages two, three and four had these components, each lasting two weeks.

Up to 120 workers – a mix of civil, rail and electrical crews – were on site during the project. The works required 6,588 metres of new rail, 83 poles to support overhead wires, 3,600 metres of overhead wires, 4,197 cubic metres of concrete and 24,986 square metres of asphalt resurfacing.

HOW IT WAS DONE Stage one was run between August and October to complete road widening and service relocation works. Stage two was installation of the rail along North Terrace during the October school holidays. Traffic restrictions gave space to excavate the centre of the road plus concreting in of the new tram rails.

Lachlan said the track slab was designed to crack at regular intervals as it was not fully reinforced concrete – typical for all tram networks. He added that original timber sleepers of 600mm spacing under North Terrace were removed in October. They were milled out by a road profiler and went for recycling.

Stage three was the installation of 350 metres of rail along King William Road between the last week of October and the first week of November. Stage four works in the first two weeks of January required the full closure of the North Terrace/King William Road intersection to remove existing tram tracks, excavate the existing road, place and concrete in the new rail sections. Overhead wiring in that area was upgraded to service the new tramline.

Stage five works completed the remaining infrastructure followed by testing and commissioning in February. Test trams ran on the new network the same month.

Lachlan said the most challenging aspect of the project was achieving compliant rail geometry for the proposed tram movements at the North Terrace/King William Road intersection.

“It has been critical to ensure that trams can safely navigate through that intersection upon completion of the works,” he said.

“This has resulted in geometry that has very little fabrication and construction tolerance.

of the city, and the first stage of EastLink line which will travel up through Norwood to Magill, and ProspectLink which will travel through North Adelaide to the inner northern suburbs.

Downer has capability in delivering tram projects in Queensland, NSW and Victoria – it is currently involved in operation of the Yarra tram network in Melbourne – “and we drew on this expertise”. Expertise from Aurecon and GHD also was relied upon for ensuring the design was fit for purpose.

At the time of writing, DPTI was finalising a planning study of the works involved.

Lachlan is hopeful the latest project will reinvigorate a passion for tram travel that will see future stages of the proposed tram network expansion being funded in the short to medium term.

All rail work for the intersection was set up on hurdles to the expected levels in a test fit area of 300 square metres in a shed at Angle Vale that was used for the South Road Superway Project. This was “to ensure everything fits together and we achieved the required tolerances stipulated in the design”.

It was ironic that these two great achievers, credited with forming a united Federation would sadly pass away within a few months of one another.

Once again RMG extends their sympathies to Claudette Renfrey, Kathy Huett and families.

Maintaining the Federation’s History The RMG Division recently completed the task of identifying and separating records of historical importance to the South Australian Branch and the National Federation as a whole. These included meeting minutes, hundreds of photographs and newsletters dating back to 1964, when the Association was first formed. The next step will be cataloguing and filing the documents in an orderly fashion for future use.

A reminder to new and existing members that this history is detailed in our two published history books, ‘Earth – A Moving Story’ and ‘Civil Achievements Unearthed’ available for purchase from the CCF SA Branch.

CCF SA Remembers Kevin began working with heavy equipment as a sales cadet at an equipment dealership in SA. He later said in an interview: “I basically went through all the corridors of a construction equipment dealer. I understood from a dealer’s point of view how to buy machinery, own it, operate it, maintain it – that traineeship gave me a great opportunity to observe all aspects of the industry and how best to manage equipment.”

In those early days, Kevin saw increasing potential for the use of the excavator which was gaining favourable recognition in the 1970s. In 1974 he decided to set up his own earthmoving business and bought the eighth privately owned excavator in SA. His first contract was with the West Lakes development, working with excavators which he himself operated for four years.

He saw that their usage would be increased by a variety of attachments, including one for hydraulic rock breaking. Rock breaking was to play an important part in his chosen field.

He is survived by his widow Claudette and children Emma, Kate, Jessica and Nathan.

Kevin enjoyed his regular morning swim.

But after collapsing during a dip in April 2016 he and Claudette decided that it was time for him to retire. As Managing Director he had been running his company, Renfrey Plant Hire Services based in Wingfield for 42 years on civil construction, marine, mining, pipeline and other projects across Australia.

THE Civil Contractors Federation of South Australia wishes to pay tribute to Kevin John Renfrey, a stalwart of the CCF SA and the state’s civil construction sector, who passed away suddenly after his morning swim at Glenelg beach on 22 December 2017. He was 69.

Our Lady of Victories Catholic Church at Glenelg was packed for the funeral service on 8 January, testament to a great man who will be missed by friends, neighbours, colleagues and the civil and mining industry.

The company was a National Code Compliant hire provider of heavy earthmoving equipment and skilled operators. The auction of equipment – there were more than 350 items to sell – was held later that month.

Kevin spent 22 years on local and national CCF Boards, including being National President from 1992 to 1995. He, along with former National Executive Director, the late Doug Huett, was responsible for establishing a truly national organisation from individual state bodies. Kevin was also prominent in forming the state’s first regional division in the South-East. He was awarded CCF National Life Membership in 2010 and was inducted into the SA Civil Construction Hall of Fame in 2012.

On 8 April 2004, Kevin was in a meeting at his office when he was interrupted and asked to go around to the front entrance – immediately. Waiting for him were assembled staff and a limestone rock weighing nearly a tonne. On it was a plaque reading: Renfrey Plant Hire. Congratulations Claudette and Kevin. From past and present employees. Without his knowledge, Penrice quarry had donated the rock to mark the 30th year almost to the day when Kevin started out as a plant hire contractor. Kevin himself was a great foundation stone for the now very successful Civil Contractors Federation.

Klay lived on the Lefevre Peninsula and was a Port Magpies and Power supporter. He enjoyed travelling with his family, was a keen fisherman and at any opportunity would head to the Yorke Peninsula to go fishing in his boat. He is survived by his widow Tara and children Thomas and Lucy.

Tara, who did administrative work for the company, said it was in the process of being retired. “Klay had a very strong work ethic and took great pride and care in the quality of his work,” she said. “He had a strong reputation for excellence and precision workmanship.

It is with great sadness that we inform CCF members of the passing of Doug Huett on Sunday, 26 November, after a sudden illness.

THE Civil Contractors Federation of South Australia notes with regret the death of Klay Matson, Director of Earth & Civil Services Pty Ltd who passed away at his Semaphore home on 5 October 2017 after a short illness. He was 51. Five hundred people attended the funeral service in the Queenstown Chapel of Harrison Funerals.

DOUG HUETT

Doug was employed in 1988 as joint Victorian and National Executive Director of AERCF (which would later change its name to Civil Contractors Federation). In 1992, he became full time National Executive Director, which was a role he kept until 2002.

In 1988, the Federation was struggling to consolidate as a fully functioning National body. Doug had the passion and commitment to see the organisation become a Federation, and accepting its responsibilities as a registered body with the Industrial Relations Commission. This further developed the involvement of all States and consolidated the Federation as it is today.

Bringing the States and Territories together, and holding them was and still is a very difficult task. Doug managed to work with all the individuals and personalities of the membership and office bearers.

After the National Executive Director role, members will know of the many stories and features he penned for the Earthmover and Civil Contractor Magazine, and his role as chief judge for the National Earth Awards right up until last year.

He was good fun to be with, well liked and respected amongst members and industry persons in all States and Territories. He will be missed by all.

We thank Doug for his extraordinary service to the Civil Contractors Federation.

KLAY MATSON

“Klay created many friendships within the earthmoving industry and became good mates with his regular builders and suppliers. We were very fortunate; we did not have to advertise, it was all word of mouth and repeat clientele.”

Klay started a 36-year career in earthmoving when he joined the family business, Matson Constructions, owned by his late grandfather, Jack Matson, in 1981. Klay worked alongside Jack, his father Ken, his uncles and older earthmovers, learning his trade long before computerisation and modern technologies were introduced to the industry.

The time he spent in the bitumen gang taught him the use of boning rods, a common technique in those days for establishing levels. It was a technique that Klay continued to apply on latter day civil projects. His great, great grandfather, Thomas Matson, was the first tar paver in South Australia in 1898.

In 1988 Klay left Matson Constructions to work in his father’s business, Pavement Constructions, and rapidly refined his skills in bitumen work and in operating plant and equipment. He took on a supervisory role.

When Ken retired from the business, Klay worked for Davison Earthmovers for about 18 months. In 1995 he bought his first grader and worked as a solo grader operator. He started his own business, Earth & Civil Services Pty Ltd, in 1998.

Top tips for having a successful health and wellbeing program in your workplace.

Most businesses understand that having healthy staff will result in improved productivity, lower rates of absenteeism, lower injuries and higher staff morale. But running a successful workplace wellbeing program can seem like a lot of hard and frustrating workwhat do you do when no staff turn up for your company's paid yoga sessions or how do you make sure you don’t end up with mouldy oranges left in work’s free fruit bowl?

I’ve written down some of my tips for getting the most out of your work wellbeing program. I hope you find this advice practical and that they help bust the myth that wellness needs to be complicated and time consuming. Remember that I’m available to help you and your workplace with your health and wellbeing program so don’t hesitate to get in touch with any questions!

Consult with your staff This sounds very obvious but you’d be surprised how many workplaces fail to do this. Engaging your workers from the start and bringing them along for the journey will help them take ownership over the initiatives that you run. Surveys, discussions in staff meetings or conversations with individuals are all effective ways to learn more about what your workers actually want – and

therefore what they’re much more likely to actually participate in. Do things with people, not to them and you’ll get much better buy in.

Get some quick wins on the board Go for the low hanging fruit for some easy wins that will help build excitement and momentum for your wellbeing program early in the piece. Do you already offer some benefits (EAP’s, vaccination programs, City to Bay team etc.) that could be added to with some small giveaways or programs to make it seem like an exciting new initiative?

This not only will help you raise awareness of the services your business already offers for staff, but it doesn’t take a lot of extra resources either.

Partner with the experts With all the other things that you have to juggle in your everyday working life; you’re not expected to be a master in health and wellbeing. So call in the assistance of people whose job is to be the experts in this area. You might be surprised to know that there are lots of free and low cost services available through government and notfor-profit organisations that can help you through providing resources, guest speakers, consultancy and programs to help you run your workplace wellbeing program. Your Healthy Worker Advisor is just one of these services!

Another option is to call your insurance provider. Chances are that they will have a person that specialises in prevention that they would be happy for you to work with.

After all, a healthy workplace saves them money too!

Do a few things at a time, instead of everything at once Change is an uncomfortable thing for most people – big change especially.

So introducing small changes a few at a time (such as including a green salad and some wholemeal bread options at the staff barbeque) will be much more acceptable than overhauling the entire process in one fell swoop. Once the new change has been normalised, you can move forward onto the next stage of the process.

Too many initiatives being run simultaneously can also cause less participation in each. With busy schedules and work demands, one thing at a time is often the best way to get people to commit.

Pick your top priorities and sort them into short, medium and long term goals – then take it one step at a time!

Utilise your champions and early adopters Do you have a staff member who is a great cook or loves their fitness? Perhaps you have a worker who has recently given up smoking or cut back on alcohol? Making use of their passion by having them ‘champion’ your health and wellbeing initiative is a great way to build enthusiasm and encourage others to get involved.

Having them lead the staff stretching, share recipes or offer support for others on their quitting journey will have more impact because of the champion’s personal experiences.

Remember to show these champions and your first adopter’s gratitude and give them recognition for their involvement – this will ensure that they feel valued and their enthusiasm will inspire more people to join in.

Share the load Forming a wellbeing committee (or having wellbeing as a standing agenda item for another group such as your safety committee or leadership group) will ensure that the responsibilities of health initiatives in your workplace don’t fall on one person’s shoulders. This will mean that health programs will survive staff changes and you’re also likely to have more ideas when people can put their heads together. As the saying goes, ‘many hands make light work’ and it also means that health initiatives will be supported by multiple people rather than having the same person feeling like a broken record trying to encourage everyone else’s participation.

This qualification reflects the role of employees such as production operators in an open cut mine or quarry, who perform tasks involving a broad range of skilled applications in a varied work context, using some discretion and judgement in selecting equipment, services or contingency measures.

COURSE DURATION

This program is delivered over 18 months.

Formal training may be completed in a shorter amount of time. It is also available as a Contract of Training.

ENTRY REQUIREMENTS 



  

Mining Train will conduct a Foundation Skills entry assessment at a level required to successfully complete the qualification and work in the industry at the level required for this qualification. Potential clients who are identified as not meeting course entry requirements will be assisted with referral to appropriate support services.

In general, participants will need to be physically fit due to the nature of the work.

Mining Train will conduct a suitability interview prior to enrolment.

Entrants will be required to be employed in a surface extraction operations role Entrants may be required to have a White Card prior to starting training on the qualification.

DELIVERY AND ASSESSMENT

There are theory and practical training and assessment components to the course. Skills will be trained and assessed through a mixture of off-the-job and on-the-job training and assessment.

Credit Transfer

Credit transfer involves assessing a previously completed course or subject to see if it provides equivalent learning or competency outcomes to those required within the current course of study.

Recognition of Prior Learning (RPL) and Recognition of Current Competency (RCC)

Recognition of Prior Learning (RPL) and Recognition of Current Competency (RCC) provides students with an opportunity to have their current skills and competencies recognised. These skills and competencies may relate to units that they are about to commence and as a result may exempt them from studying these units.

Aboriginal Engagement Recently the Civil Contractors Federation, with the support of the Department of State Development, held a Cultural Awareness training session and panel discussion around Aboriginal Engagement.

Those who attended were privileged to have Jack Buckskin present Cultural Respect Program for Managers and Supervisors of Aboriginal People. Jack Buckskin is a proud Kaurna and Narungga man who has dedicated his life to learning and passing on his knowledge and language of the Adelaide Plains to future generations of Kaurna people.

An open panel discussion with Intract Australia’s General Manager John Briggs, Department of State Development’s Bill Wilson, Port Adelaide Football Club’s Powerful Futures Co-ordinator Braedon Talbot and Office of the Industry Advocate’s Sue Panagaris, gave the attendees the chance to ask questions around sustainable Aboriginal Engagement.

VET in Schools – Alice Springs Following the success of the VET in Schools pilot in 2017, in partnership with the NT Department of Education and Yirara College in Alice Springs, Civil Train NT was invited back, this time to devise a program for an all-female cohort.

You will recall from the last edition, that Civil Train NT delivered an innovative accredited program at Yirara College, with the students achieving amazing results.

Civil Train was delighted to hear that following the successful outcome of the pilot, a group of female students had been inspired to put their hands up for the next program.

THE PROGRAM Mathematics was again the core focus of the program; to build confidence and competence in workplace mathematics through the context of civil construction and simulators.

All students had a realistic introduction to workplace safety through a simulated live site including hazard identification, risk assessments and SWMS. The students took part in the planning of various simulated, civil workplace scenarios involving measurements and calculations, using perimeters, volumes, areas and grades, and utilising various pieces of equipment including laser levels.

The students logged hours on plant (excavator and loader) simulators, completed written assessments and gained practical experience on a real 1.5 tonne excavator. They developed basic operating techniques and an important understanding of plant safety.

ACHIEVEMENTS All students who completed the program have been issued the following nationally recognised units of competency: • RIICCM201D Carry out measurements and calculations • RIIWHS201D Work safely and follow WHS policies & procedures • RIICOM201D Communicate in the workplace • RIIBEF201D Plan and organise work • RIISAM204D Operate small plant and equipment • CPCCWHS1001 Prepare to work safely in the construction industry (White Card)

A CCF Duty of Care Excavator ticket was also issued to the successful participants.

However, of most value was seeing the personal journey each of the participants accomplished as they engaged in the program, including: • A reinforcement, or in some cases a realisation, that what first appears to be complicated, intimidating and confusing, once explained and demonstrated in a tangible context can not only be easily understood but can also be interesting and even fun!

• An appreciation that being punctual, applying yourself and staying focused on a given problem is half the battle of solving it • Growth in self-confidence and overcoming fears and preconceptions.

• Developing a mature attitude towards learning • Building empowerment and raising aspirations for their future careers

A pat on the back to the team at Civil Train NT, especially Peta Horan (administration support) and Matt Schaftenaar (Trainer) for his uncompromising determination in achieving outstanding results for all the students he has trained, mentored and advised. Well done!

Students attending Yirara College face many challenges, attending a boarding school and being away from family and country. Our aim is to offer all students education and training that leads to real employment options.

Working closely with Civil Train Manager, Mark Hopkins and Trainer Matt Schaftenaar, a group of young women have successfully completed a skill set in civil training that opens pathways to employment in industries that may not have been considered due to traditional cultural beliefs and gender. Well done to all involved.

TRAINING

Certificate II Civil Construction CIVIL TRAIN SA has recently delivered two RII20715 Certificate II Civil Construction WorkReady programs.

One of the groups were given the opportunity to undertake live works training with CCF SA Member Action Linemarking, installing stormwater drainage and paving around the building for their new premises at Lonsdale.

The second group undertook their practical training at the RSPCA in Lonsdale.

Participants were asked to remediate a paved area where a mix of constant high pressured washing and no adequate drainage had caused deterioration. (See photo.) As the area didn’t have the best access and was not as straightforward as most paving projects, participants had to undertake more difficult measurements and calculations for the planning of the works.

Participants also levelled and compacted an area which was earmarked for a new transportable building at the facility.

Participants were tasked with measuring, setting out, and planning the works by using the skills gained in the theory components of their training. They then provided the quantities of materials required to complete the project to Action Linemarking.

Civil Train SA would like to thank CCF SA Members Action Linemarking, and also the RSPCA at Lonsdale for providing participants with live work projects which are invaluable when undertaking training for the industry. Civil Train SA takes great pride in delivering quality training and live works experience which suitably prepares the future workforce for the industry.

Once the materials were delivered, they set to work. Daily pre-starts and weekly toolbox meetings became the participants’ new habit, making sure that safety is everyone's priority.

Participants in both groups undertook work experience as part of the project. In addition, they also completed daily timesheets, and kept a daily work diary to track the work that they had done.

2018 PRESIDENT'S LIFETIME ACHIEVEMENT AWARDS

INDIVIDUAL ANDREW YOUNG CCF Board 2003-2015 Executive Committee 2005-2015 Honorary Treasurer 2005-2015 After a stint in the building and construction industry, Andrew’s civil career commenced with Boral Construction Materials in the quarry division. He later became a Concrete Plant Manager and QMR for Boral Resources for SA covering quarries and concrete.

Andrew then took up a role with SEM Civil under Harry Wauer as a Project Manager and later became Administration Manager for the organisation. Ultimately, he then took the position of General Manager with Topcoat Asphalt in 2001 which rounded out a career in civil, combining raw material supply and project work.

Andrew was Deputy Vice Chair of the Civil Skills & Technology Centre (CSTC) from 2006 and worked on the merger of CSTC with CCF SA (Civil Train) in June 2007. It was during his time on the Executive and as Honorary Treasurer that CCF SA moved branch offices from Woodville to Thebarton in 2009.

CCF SA applied for and received an $8,200,000 EIF Grant from DEEWR in 2010. The grant from the Federal Government was used for fitting out the Thebarton building for training.

Andrew was a member of the Project Steering Committee for building works from Jan 2011 to June 2012. He was tasked with selecting the builder for the refurbishment of the Thebarton building and achieving balanced expenditure in accordance with the conditions of the EIF Grant.

The ‘Centre of Excellence’ was completed in June 2012. The facility was opened by the then Prime Minister the Hon. Julia Gillard on 11 May 2012.

CORPORATE ER SILVA PTY LTD ER SILVA Pty Ltd dates back to 1936 when the founder, Norman James Leane-Silva, established a business at Port Road, Albert Park, known then as N.J. Silva Fuel and Fodder Merchant.

The original business between 1936 and 1950 progressed successfully with fuel, fodder, ice vending, and hardware supplies.

1945 saw a name change to N.J. Silva and Sons.

Norman and his wife Emily had four sons (Stanley James, Raymond Keith, Clive Maurice and Lionel Colin) and four daughters (Lillian Rose, Muriel May, Doris Mary and Daphne Annie).

Another change occurred in 1950, when the business was changed from fuel and fodder to earthmoving and contracting, which operated from Selth Street, Albert Park, next to the family home. The sons contributed to this change which proved to be a successful venture.

Norman passed away in 1953, leaving his wife Emily continuing to operate under the name ER Silva. The business was managed

by Raymond with assistance from Lionel and Clive.

In 1960, the business was moved to Murray Street, Henley Beach, with Stan becoming involved until he passed away in 1964.

The company ER Silva Pty Ltd was formed in 1965, with Emily as Governing Director, Raymond as Senior Director, Clive as Company Director and Lionel as Company Secretary.

Raymond was a Founding Member and on the original committee of the S.A. Branch of E.C.A. Being a family business, Emily and her children were the shareholders of this company. After Emily passed away in 1972, the business continued at Henley Beach until 1980, when lack of space caused the move to 348 Cormack Road, Wingfield.

In July 2008 ER Silva Pty Ltd relocated to premises north of the CBD at 12 Angle Vale Crescent, Burton SA. With the passing of Raymond in 1987 and Clive in 1997, Lionel is the only original family member still surviving.

The present Board of Directors are: Lionel Leane-Silva, Senior Director Christopher Leane-Silva, General Manager, Director/Secretary Gavin Leane-Silva, Director.
