President’s Message by: Christie Emrich

Dear Members,

I woke up this morning and found a gray hair. Right smack dab in the middle of my head. Sticking straight up, waving at me in the mirror, taunting me with its wiry smugness. I’m not saying that being president of the CCBA caused this, but I would note that when I joined the board 5 years ago, I didn’t have this problem. So, I will let you draw your own conclusions.

It’s crazy that 5 years has passed so quickly, and this is my last month as President and my last President’s message. The year was not one, that I had anticipated when I became a Trustee and it definitely wasn’t one that the Board had planned for, but we adapted functions and events to new protocols, held more virtual meetings/forums/and CLEs than we knew was possible, and planned for in person gatherings with optimism and hope only to cancel them with pragmatism and caution.

I would like to thank the board members for being willing to try new things this year and for adapting to changes in ways that left the not only CCBA financially strong, but with more members today than in all my years on the board. Thank you to Paige Spratt, who as our past president led the way by increasing communication with the Bench. Her bench updates were invaluable as COVID began wreaking havoc on our court system and have become a trusted staple in communication between the court and our members that will continue long past the pandemic. Thank you to Dan Gasperino for serving as a Trustee for the last three years. Dan was always willing to pitch in where needed, provided thoughtful feedback, and was someone I could rely on to get things done.

When I joined the Board five years ago, I had no idea how much I would come to depend on our Director Lisa Darco, or how important she would become to me. Everyone knows that she is the glue that keeps this ship together, but she is also a trusted sounding board, a generous friend, and quite frankly one of the best people I know. I am incredibly grateful for her guidance, her humor, and her ability to talk me off a ledge at a moment’s notice. She can make me laugh over lunch until tears stream down my face, understands my Schitt’s Creek references, and somehow takes my crazy ideas and makes them work. Lisa is Simply the Best.

Next month Jesse Jacobs will take the helm of the CCBA. In the next year, I look forward to seeing the growth of our membership committee as we continue to explore the issues of inclusion and diversity in our local bar. The CCBA will continue to provide helpful CLEs and be a source of information from the Court to our members. I am hopeful we will be able to enjoy some in person social events soon and on a personal note, I’m looking forward to seeing if Mr. Jacobs gets a little grayer too. 😊 ~ Christie

Superior Court Welcomes Judge Nancy Retsinas to the Bench by: Commissioner Jill H. Sasser

Judge Nancy Retsinas was sworn in as the newest Clark County Superior Court Judge for Department 1 on July 1st, 2021. She replaced retiring Judge Daniel Stahnke. She is currently presiding over guardianship/probate cases, and she also has a criminal rotation. She will work with Kim Nigg as her judicial assistant.

Judge Retsinas is a lifelong Clark County resident, graduating from Hudson’s Bay High School. She earned her law degree from the University of Oregon and her bachelor’s degree from the University of Portland. She began practicing law in 1991, and has had a broad legal career, including work in consumer protection, criminal and juvenile law. She also spent many years working as a pro tem judicial officer in Clark County Superior and District Court. Most recently, she focused her practice on collaborative family law and mediation. In 2014, Judge Retsinas cofounded a non-profit educational organization, Two Rivers Institute for Dispute Resolution, where she taught peacemaking and conflict-resolution strategies to professionals.

Community service and involvement are very important to Judge Retsinas. She recently moderated listening sessions on systemic racism, and has served on the boards of the Children’s Center, the Collaborative Professionals of Washington, Community Mediation Services, the Global Collaborative Law Council, Rotary Club of Vancouver, the League of Women Voters, SWIFT and Cappella Romana. She was recognized as a Volunteer of the Year for the Clark County Volunteer Lawyers Program three times and was recently awarded the Women of Achievement Iris Award, which honors accomplished women in Southwest Washington. She is also a contributing author to Washington Practice Manual – Family Law, a West Publication (2016), and Building a Successful Collaborative Law Practice, an American Bar Association publication (2018).

During her investiture, Judge Retsinas spoke movingly of her happy home life, including her husband, Jim and her two stepchildren, and thanked the many individuals who have assisted her in her professional career. She also stated that one of the reasons that she wants to be a Judge is that she wants to be a contributor in our community. The speakers at her investiture included longtime friends and attorneys Bruce Colven and Howard Marshack. Mr. Marshack noted that, “Nancy will be a good judge because, at her core, she is a problem solver.”

This author reached out to several individuals who worked with Judge Retsinas in her private practice.

Attorney and Divorce Coach Katie McGinley Petersen: “Judge Retsinas helped me completely transform my relationship to the law and helped me understand the attorney’s role as a peacemaker. She did this with grace, humor, and lots of energy and with the courage to show up as herself in all that she does.

I owe her unlimited lunches for all the wisdom I’ve gleaned from her!”

Long-time friend and attorney Bruce Colven: “To paraphrase Jesse Jackson, Nancy Retsinas is one of those people who doesn’t look down on anyone unless she’s helping them up. She is smart, funny and humble. A comment on Facebook posted in recognition of Judge Retsinas’ (then) 25 years as an attorney said this: 13

‘It’s because you are a fine human being that you are such a fine lawyer.’ The same will be true as to her service as a judge.”

Attorney Juliet Laycoe: “Judge Retsinas has been a friend and mentor to me throughout my career. We were in Rotary together for years and worked on various non-profit boards in the community together over the years. She introduced me to collaborative practice and helped sharpen my interest in mediation. In recent years, we’ve been opposite and alongside each other on numerous cases.

While working through often challenging divorce circumstances, we can always laugh which is a real perk. On the laughter note, I have two words that I know she’ll know what I am talking about . . . treasure map. You’ll have to ask her about that sometime.”

Attorney Crystal Lambert: “Judge Retsinas has served as one of my mentors. She has never been too busy to return my call, providing guidance while I am preparing for a trial or working through a unique fact pattern. Her guidance, like her teaching style, provides me with real life examples of similar situations, guides me towards relevant law and often helps me talk through the problem, guiding me to a solution rather than dictating a specific answer or opinion.”

How to Set the Default Transaction Date in QuickBooks Desktop By: Emanuela Sandri | Attorney Bookkeeping Services, Inc. For entry of new transactions, QuickBooks Pro, Premier, and Enterprise have two options for the default date - today’s date or last date entered. Today’s date works well unless entries are made after-the-fact or there are a lot of old transactions to enter. Default date option can be changed at any time; and if there are multiple users that access the QuickBooks company file, since setting is under “My Preferences,” each QuickBooks user can set preference as desired.

To go to default date preference: • Edit menu > Preferences > General > My Preferences tab • Look for the “Default Date to Use for New Transactions” preference

DON'T CALL US A LAWYER BAND

That is how every member of WARBALL will respond if you use that phrase.

Sure, four of us are lawyers: Jack Green (lead singer/lead guitar) of Green Ritchie and Bogar, John Terry (drums) of Morse Busby Andrews & Terry, Eli Rushbanks (rhythm guitar) of Navigate Law Group, and me, Colin McHugh (bass/backup vocals) of Navigate Law Group.

But the other two members aren’t: Todd Ouska (rhythm/lead guitar) a former collegiate left-handed pitcher at Johns Hopkins turned founder of the security technology company wolfSSL, and Geoff Cecil (trombone/ backup vocals/keys) creative director at Opus Creative in Portland. (Eli is even winding down his law practice to focus more on web design.)

And yes, we do play at the Battle of the Lawyer Bands—and other lawyer adjacent performances such as the recent Volunteer Appreciation event for the CCVLP—but we don’t think of ourselves as “That Vancouver lawyer band.”

Here’s the origin story: Eli, John, Jack and I literally joined hands and made a pact—a legally dubious binding agreement—that we would write original songs and that we would rock. Hard. However, in about 2016, when the first iterations of WARBALL came together, we were a parody of a lawyer band. Our first gig was even played as a bit of a joke show. You may have a foggy recollection of a late-afternoon spent with an out-of-tune band, playing without a sound check, who introduced themselves with odd stage names and claimed to hail from Norfolk, Virginia. The “WARBALL Theme Song” was played. Jack even wore a fake mustache. I still cringe thinking about that mustache.

For a while we rehearsed in the basement of John’s new home in Arnada. But I don’t think his family, especially his new wife Christina Phelan, appreciated the entire house shaking for several hours every week. So, we decided to all pitch in and rent a “band room” near Portland International Airport, where at any time a dozen of the area’s crustiest, gamiest and loudest punk and metal bands were practicing.

We couldn’t hear ourselves think, let alone play along with each other.

But as all adult relationships evolve, so did we. Our familiarity and love of each other began to deepen, along with each of our respective relationships with the music. We all wanted something more. Something just a hair more mature. And we wanted more for each other.

Instead of getting together, drinking beer and telling horrible jokes, we found ourselves developing a process that was more focused. Sure, we still love to tell jokes and drink beer. But as we

rehearsed and put pen to paper, we started asking each other, “What are we writing about?” “What is the story here?” The result was a growing catalog of songs that elicited reactions like, “Wow, this song is extremely

political. And I like it!” We were embracing our separate perspectives as musicians and in turn eliciting more creativity from each other.

As the past five years had forced us through an evolution—especially with the relentless media alerts in our hands ushering us to the front row of the disaster du jour: immigration, the last presidency*, climate change, Afghanistan, the Supreme Court.

You name it. WARBALL, we found, was the perfect outlet for us to communicate with ourselves, each other, and whomever else, what we were feeling about what was going on in our lives and the world writ large. And we were able to tell these stories our way, while yes, rocking hard.

Starting in 2018 and continuing through the rise of the pandemic, WARBALL was beginning to gather some steam, not just as a lawyer band, but as a bona fide rock outfit.

We picked up opening slots for bands like Ivory Deville or the legendary 5,6,7 8s (the band that appears in Quinton Tarantino’s Kill Bill Volume 1). We weren’t rock stars, but there also weren’t any fake mustaches to be found. We went from playing at the Brick House for the Battle of the Lawyer Bands, to taking the stage at some of Portland’s better venues like The Secret Society and the Star Theatre. But when people would come up to us after a show and ask us where the CDs and vinyl were, or where to find our music or a t-shirt, we were empty handed.

It was at that point, that each of us started upgrading our gear: new amps, nicer guitars, better drums, cooler pedals… but most importantly, new recording equipment.

When one of us had a big payday or settled a case, we would ask “So what gear are you going to buy for the band?” I began to love the photos that would light up my phone of a brand new Les Paul or a ruby red Gibson 335. It was my f riends and bandmates doing a little something for themselves, but also a little something for the band.

And we began to think, “What if we built our own studio? Recorded our own record?”

So that’s exactly what we did. Led by John Terry, we framed, soundproofed, dry walled, painted, and sure, drank beer and told jokes. The result was a pristine, soundproof recording studio in the basement of Jack’s Alberta home.

Every weekend for months we were all there working on the studio. And once we were finished, we had a place of our own to practice and prepare for more gigs. But then… BOOM! PANDEMIC. Everything shut down. No one was leaving their home, much less considering seeing a show.

How were we supposed to continue playing in a band crammed in our practice space during a pandemic?

Luckily, Jack and Geoff have been playing in bands since before I was born, and they convinced their old bandmate and close f riend, world renowned bass player and producer Ian Sheridan (former bass player for Jason Mraz), to help produce, engineer, mix and master what became the first WARBALL record.

So, one by one, wearing our masks, limiting who was around for each session, and eventually getting the vaccines, each of us submerged into the studio to perfect and record our part: first John, who Ian affectionately began to call “Boss Groove” on drums, then me thumping on bass, then an overture of guitars, the vocals, backup vocals, mixing, mastering. A whirlwind. And now we have an album.

This album touches on typical themes, at times juxtaposed against one another: tests on our relationships (“Heart is Not Yours”), breakups (“South of the Mountain”), our marriages (“Right Where I Want to Be”), political takes (“Gaslight”–about Justice Kavanaugh), our homes (“Get Out of Oregon”), our enemies (“Werewolf”) and our friends (“Scared”). But, more than that, this album is a monument— an everlasting and bulletproof artifact— that proclaims to each other and our friends and family that we aren’t just stiff lawyers in monkey suits. That sometimes, the big hand on our collective watch says it’s time to rock n’ roll.

So maybe we are “That Vancouver lawyer band”, but if you like good music, or want to hear what it sounds like when six friends get together and make music together in their “other lives”, go throw on the headphones and listen to WARBALL’s “Sounds Bulletproof”, available on Apple Music, Spotify and YouTube.

Volunteer of the Month: July 2021 Christie Martin Where do we even begin talking about July's Volunteer of the Month honoree, Christie Martin? As a longtime volunteer, Christie has dedicated countless hours to marginalized communities in Clark County. Whenever we are in need of a lay guardianship clinic, Christie not only gives out sound advice but almost always takes on the case to help a family get through the guardianship appointment process. If guardianship is not the appropriate route, she will connect clients with alternative options/resources. In everything that she does, Christie goes above and beyond which in turn makes everyone feel like they are her most important client. Christie, you are a one of a kind legal advocate and a true gem in the Clark County legal community. We salute you as our July 2021 Volunteer of the Month. Thank you for all that you do, Christie!

How did you get started volunteering with the Clark County Volunteer Lawyers Program? I was newly admitted in Washington and went directly to see how I could assist with CCVLP. I started in the Y clinic where we counseled women about their family law issues who were victims of domestic violence. I was lucky enough to work with a couple women who would be come mentors in my current practice, namely Commissioner Jill Sasser and Vicki Kesala.

We always love recognizing the service members in the CCBA community. Can you tell us a little bit about your time in the Air Force? Yes, I volunteered for service at the age of 17. Became a jet engine mechanic serving both domestically and abroad. I was lucky enough to work on a variety of aircraft, notably F-15E, B-52G and H models, KC-135 refueling tankers and F-4 fighter aircraft. It was the best way to “come of age,” in my opinion.

You and your law partner, Gabby Richards, are two of the most passionate elder law attorneys out there, going as far as creating your own mobile legal clinic.

Did you always know you wanted to work with this population?

I don’t’ recall having a specific passion for this particular population, but always wanted to work with vulnerable folks whom I felt needed assistance legally. I was also a product of the foster care system and brought that experience into my practice.

If you weren't an attorney, what would you do?

Everyone who knows me knows that I absolutely would run a fabulous dog rescue of course!

Law Library Navigation Tips to Make Westlaw Easier to Use You have free access to Westlaw through the Law Library homepage: (https:// clark.wa.gov/law-library) At the time of this writing, they are allowing up to 20 hours over a 14 day period per email address. Our subscription covers primary law from all states and federal, as well as many secondary sources and practice aids such as Washington Practice, Am Jur, sample pleadings, etc.

This month, I want to point out some usability features that enable you to navigate more easily and get the most out of Westlaw.

For navigation, Westlaw has several features to be helpful. Once you have a list of results and you open a document, you will see this in the bar along the top of the screen:

If you want to move to the next document in the results list, you can use the Term Navigation feature by clicking the green arrows to the left or right of “1 of 2 results” to advance to the next result or to move back to an earlier result.

The next option shows your search terms. Westlaw highlights search terms in yellow, and labels this function “original terms” by default. Clicking on the green arrows on either side of this function box will take you to the next term or the previous term from your search.

If you use the Search within result feature, it will highlight those additional terms in a different color and will also relabel this box as “all terms” as shown here. If you use the drop-down arrow on the Term Navigation box, you can select whether navigating by search terms will take you to all of your terms, just your original search terms, just your Search within results terms, or hide all term highlights.

Using the Term Navigation feature is a quick way to move to the points in the document where your search terms are, and it will jump you to the next document when it runs out of terms in the current document.

On the right side of the bar along the top of the screen you have a Go to option:

The Go to option has a drop-down arrow that allows you to jump to segments of the document or to a specific page. For a case, you get the choices in this illustration to help you move quickly to the part of the case you want.

When you are done looking at your document, use the Return to list function.

Back at your results list, note that documents you have viewed show a little pair of glasses in the top right corner. This handy little feature helps keep you from losing your place, and helps you return to a previously viewed document for a closer look.

The cost of the Engage to Change CLE is being shared by District Court and the CCBA. The CCBA will give District Court the actual money the CCBA received after credit card processing fees were deducted.

Judge Fairgrieve: On the criminal side, I am continuing to meet on weekly basis with Crim Procedures workgroup – shackling issue still the focus as a result of State v. Jackson. Judge cannot see defendant in shackles until they decided that it is necessary. We are now bringing more defendants over for face-to-face.

Last week we ran into problems with our system. Issues: Jail staff shacking in the jail, so defendants have shackles while on video. Jail makes a threshold decision or shackles in video booth or in court. Motion and address about 12 factors as to whether defendants need to be in shackles. Process beforehand that we were planning to use, but now thinking about additional factors. Timing issue and problems with jail. Talking with Sgt, Wolff to coordinate efforts; complex issue. We have the Blake resentencing ongoing, large number that we need to accomplish.

State-level workgroup to handle process, about 6 – 8 thousand cases that are implicated. Unfortunately, several the stakeholders pulled out based on financial concerns. About 40 million allocated to counties to help facilitate resentencing. To my knowledge no state-level oversight, will be county-by-county. Most resentencing will be remote. Still working on it with prosecutors. We have a basic outline but need step-by-step process. i. Jury trials – anticipated increase but probably will not be the case despite ability and capacity to do-so. Jury selection back in courtroom, which has increased the number we can handle. Still masking for unvaccinated individuals, but as of Monday ALL individuals in the courtroom will require masks, following CDC guidelines.

Judge Sheldrick: New masking guidelines, basically the same as before, but exception if you are addressing the court. UD updates: Judge Gregerson working on updated order, coming very soon. Based on what I am seeing, there still is a lot of confusion with statute and governor’s proclamation (which has been replaced) with a bridge proclamation. I have been seeing notices posted that are not following recent updates. Hope there are efforts to educate the bar on the new standards and nuances – worth sitting down and reading again because so many new provisions. c.

Rachel Brooks. Our UGA form group has been putting our great forms. Want a full certification for our court visitors, offering every Tuesday from 2 – 5 pm. Attorney CLE same time. In December same format but to healthcare providers. We will be getting lay-guardian packets to be given from the bench or court website. Trust Admin basics CLE coming up. Governors long term care proclamation still in effect.

All state employees and long-term care employees must be vaccinated by Oct 18. d.

Jessi Anderson: We are hiring 3 attorney positions for UD (unlawful detainer) positions (right to counsel), one already started, and other 2 starting at the beginning of September – excited. Continuing work with Judge Gregerson for UD docket – which will have dedicated docket. Judge Gregerson waiting to hear back on a few things before it is finalized. PSA for those who practice in federal court, Judge David Estudillo from Grant County was nominated to replace Judge Ronald Leighton in Tacoma. Nomination is moving forward and expected to be confirmed within the next couple of months. h.
