>CONSIGLI DI POSA / AVVERTENZE / CONDIZIONI DI VENDITA / INSTALLATION INSTRUCTIONS / WARNING / TERMS OF SALE Come tutti gli elementi in pietra naturale, anche quelli proposti da Bagattini SpA hanno il pregio di essere plasmati dalla natura, quindi sfumature cromatiche e granulometria possono non essere costanti anche all’interno del medesimo lotto. Per questo motivo gli effetti cromatici, le forme e gli spessori dei campioni fotografati sono puramente indicativi. Si consiglia di provvedere alla posa alternando pezzi prelevati da diversi imballi, così da valorizzare le diverse sfumature cromatiche a disposizione.

• Pavimento Prima di provvedere alla posa è necessario predisporre il terreno per un buon drenaggio, essendo l’acqua il principale nemico di una pavimentazione. Prevedere quindi l’adeguata pendenza della superficie ed eventualmente uno strato realizzato con materiali adeguati al drenaggio. La posa a malta è simile per pietra naturale e per mattonelle; stendere un letto di non meno di 4 cm di malta di consistenza fluida su un massetto di calcestruzzo (preferibilmente con inserita rete elettrosaldata) di almeno 10/20 cm a seconda della portata necessaria e utilizzare preferibilmente sabbia fine per le fughe. Sarà necessario attendere 4 giorni per il calpestìo e non meno di 10 per la carrabilità, avendo cura che per questo utilizzo il sottofondo abbia fatto corpo unico con la pavimentazione, in modo da evitare il rischio di rotture. La posa su supporti sopraelevati in PVC, adatta solo per traffico pedonale, prevede che la mattonella rimanga sollevata rispetto al sottofondo; per questo in caso di mattonelle con lato di 60 cm o più si consiglia l’utilizzo di un supporto intermedio. La resistenza della mattonella è garantita anche senza l’utilizzo di armatura, tuttavia per maggior precauzione nel caso di utilizzo di supporti regolabili si consiglia l’utilizzo dell’armatura. La posa a secco prevede l’utilizzo di sabbia a secco con grana 3/6 mm per uno spessore di circa 4 cm. La pavimentazione si adagia sulla sabbia battuta e ben livellata. Il lavoro così realizzato è rapido ma adatto al solo traffico pedonale; inoltre il naturale assestamento può causare disallineamenti e sbeccature. La posa a colla necessita di una soletta livellata e asciutta. Utilizzando colla apposita, è opportuno verificare la perfetta aderenza alla soletta; a tal scopo si consiglia di utilizzare colla a spessore e una spatola a denti alti.

• Parete Per tutte le applicazioni assicurarsi che la superficie sia pulita e non si sgretoli. La posa su calcestruzzo richiede la preventiva pulizia con idropulitrice, specialmente nel caso di muri nuovi. Al momento dell’applicazione è opportuno inumidire la superficie con acqua. La posa su intonaco premiscelato impone di verificare che il supporto, benché ruvido, non si sgretoli. Per un perfetto ancoraggio l’intonaco deve essere inumidito prima dell’applicazione della colla, a causa della sua composizione a base di calce/ cemento. La posa su laterizio prevede uno strato di rasante che va lasciato asciugare, per poi applicare uno strato di colla apposita. Si può anche valutare di intonacare la parete prima di applicare il rivestimento. La posa su intonaco pitturato richiede di picchiettare la parete per rimuovere la pittura; poi sciacquare e applicare uno strato di colla apposita, quindi applicare il rivestimento. In caso di pittura resistente, fissare con tasselli una rete metallica elettrosaldata e quindi applicare colla apposita e rivestimento. Stesso procedimento per ogni superficie in cattive condizioni, anche all’esterno. La posa su muri interni in buone condizioni richiede solo l’applicazione di uno strato di colla apposita. Nel caso di cartongesso, dopo aver verificato la capacità di tenuta della parete, è opportuno trattarla con un isolante (Primer). La posa su cappotto impone la verifica di un perfetto ancoraggio del rivestimento isolante alla parete e la sua capacità di sopportare il peso. L’applicazione del rivestimento si fa come illustrato in precedenza con rete metallica e colla apposita.

Attenzione: non posare con temperature inferiori a 5° o con temperature particolarmente elevate; comunque in questo caso è necessario bagnare la parete e il rivestimento da applicare, per evitare l’alterazione della colla. Valutare in base al tipo di intervento da eseguire, l’eventuale inserimento di rompitratte e/o giunti di dilatazione.

Avvertenze • Merce a magazzino Prima di emettere un ordine è sempre necessario verificare la disponibilità della merce a magazzino e la corrispondenza delle quantità ad eventuali quantitativi minimi ordinabili.

• Nomenclatura prodotti Le definizioni di colori e finiture superficiali sono ad esclusivo uso commerciale per l’identificazione dell’articolo e non costituiscono riferimento vincolante per la descrizione tecnica del prodotto.

• Colorazioni Tutti i prodotti in calcestruzzo sono soggetti ad una pur modesta alterazione nel tempo a causa dell’azione degli agenti atmosferici o di condizioni d’uso particolari. Per questo motivo, nonostante le colorazioni siano ottenute con pigmenti e ossidi di primaria qualità garantendo lunga durata, nel tempo possono avvenire moderate alterazioni cromatiche.

• Variazioni nell’estetica L’utilizzo di elementi naturali e le caratteristiche delle fasi di produzione fanno sì che sia normale una moderata variazione delle caratteristiche estetiche (colore, granulometria…) anche all’interno della medesima fornitura. Il posatore dovrà avere l’accortezza di utilizzare in modo casuale pezzi provenienti da bancali diversi per valorizzare questa naturale differenza estetica. Per lo stesso motivo eventuali riordini potranno differire leggermente dalla fornitura iniziale.

• Efflorescenze Alla fine del processo produttivo, e a seguito dell’esposizione a particolari condizioni climatiche e atmosferiche, possono verificarsi alcune alterazioni cromatiche della superficie. Si tratta di un fenomeno naturale e assolutamente imprevedibile anche a seguito di una produzione eseguita a perfetta regola d’arte; tale effetto sparisce in modo naturale con la pioggia e con il normale utilizzo del prodotto. Ai sensi della norma UNI EN 1339 le efflorescenze non costituiscono difetto del materiale e pertanto non sono riconosciute come motivo per rifiutare/contestare la fornitura.

• Aggiornamento gamma Rientra nel normale programma di miglioramento della produzione di Bagattini SpA l’eventuale modifica dei prodotti, quindi caratteristiche come colori, finiture, dati tecnici, etc., possono differire da versioni precedenti. Il cliente potrà sempre sincerarsi delle caratteristiche attuali chiedendo di visionare un campionario aggiornato.

• Rappresentazione dei prodotti Tutto il materiale di comunicazione prodotto dall’azienda, su carta, video, digitale o in esposizione, è soggetto alla normale approssimazione rappresentativa offerta dal mezzo utilizzato, pertanto la resa estetica (e cromatica in particolare) è da ritenersi solo indicativa. Per un riscontro attendibile e attuale delle reali caratteristiche estetiche è necessario verificare un congruo numero di campioni di riferimento presso l’azienda, così come previsto dalla Norma Europea UNI EN 1339.

• Utilizzo dei prodotti La durata nel tempo dei prodotti è funzione non solo delle caratteristiche tecniche dello specifico prodotto, ma anche della corretta posa e delle condizioni di utilizzo. Sarà quindi cura del cliente provvedere ad una adeguata preparazione del terreno e del sottofondo, scegliendo il prodotto adeguato alle condizioni d’uso.

• Informazioni fornite dall’azienda Bagattini SpA si adopera per fornire materiale informativo chiaro, preciso ed aggiornato, tuttavia si tratta sempre di indicazioni tecniche e commerciali e vanno intese ed utilizzate come utile suggeri-

menti per la scelta, quindi non si tratta del reale “stato dell’arte”. Pertanto l’azienda non potrà essere ritenuta responsabile per perdite o danni conseguenti all’uso di tali informazioni o all’uso dei prodotti diverso da quello previsto. Condizioni di vendita • 1) Consegna della fornitura Entro il termine di 60 giorni dalla data di consegna stabilita dal contratto, Bagattini SpA non è in alcun modo perseguibile per eventuali ritardi di produzione o consegna. Nel caso sia stato stabilito il ritiro da parte del cliente, è obbligo del cliente rispettare la data stabilita. Nel caso il ritiro avvenga con un ritardo superiore ai 30 giorni (termine massimo vincolante ed essenziale), il contratto si riterrà risoluto di diritto e sarà a carico del cliente una penale pattizia per un importo pari alla metà del corrispettivo a contratto, salvo eventuale ulteriore danno.

• 2) Verifica della fornitura Al momento della consegna è obbligo del cliente l’accurata verifica della rispondenza all’ordine. Eventuali contestazioni relative a quantitativi, danni, vizi, difetti, non conformità, dovranno subito essere comunicate per iscritto prima dell’accettazione della merce. Dopo la consegna, durante o dopo la posa, nessuna contestazione verrà accettata.

• 3) Vizi e difetti Il cliente è consapevole di essere il solo decisore della scelta d’acquisto, avendo verificato personalmente le caratteristiche dei prodotti in base alle proprie esigenze. Il cliente è altresì consapevole che le caratteristiche estetiche dei prodotti sono soggette a limiti come evidenziato alla voce “AVVERTENZE”, pertanto non possono essere oggetto di contestazioni eventuali scostamenti cromatici, efflorescenze, differenze di peso e dimensione. Inoltre non sono da considerare vizi o difetti eventuali rotture dovute ad errata posa o utilizzo. Eventuali contestazioni dovranno essere inviate per iscritto alla Bagattini SpA e, per avvalersi della garanzia, il cliente ha l’onere di provvedere ad un accertamento tecnico preventivo ai sensi dell’art. 696 c.p.c. e 1513 c.c. entro 30 giorni dalla data della contestazione. In ogni caso la fornitura è da ritenersi conforme anche se presenta fino al 3% di prodotto non conforme.

Il cliente è consapevole del fatto che i prodotti definiti di “seconda scelta” non possono essere utilizzati per gli scopi previsti dalle relative normative di marcatura CE, dal momento che non rispondono alla norma di riferimento.

• 4) Responsabilità civile Bagattini SpA è sollevata da ogni responsabilità nel caso di danni diretti e indiretti subiti dal cliente e da terzi, a seguito dell’acquisto, dell’uso o del mancato uso dei prodotti da lei forniti, compresi danni derivanti dal crollo dei locali sia che esso dipenda da difetti dei materiali sia che dipenda da altra causa. In ogni caso l’eventuale responsabilità di Bagattini SpA nel caso di materiale difettoso, comporta esclusivamente la sostituzione dello stesso.

• 5) Riserva di proprietà In caso di pagamento rateale Bagattini SpA conserva la proprietà dei beni fino al totale saldo della fornitura.

• 6) Foro competente Si conviene che per ogni eventuale controversia o per la risoluzione del contratto, il solo foro competente sarà quello di Bergamo.

Like all natural stone elements, even those proposed by Bagattini SpA have the characteristic of being shaped by nature, so shades of color and grain size may not be constant even within the same batch. For this reason, the color effects, the shapes and thicknesses of the samples are purely indicative. It is advisable to lay pieces taken from different packages in order to exploit the different shades of colors available.

• Floors Before laying the material it is necessary to prepare the ground for good drainage, because water is the main enemy of floors. Therefore we suggest to provide the proper slope of the surface and possibly a layer made of materials with adequate drainage. The mortar laying is similar for natural stone and tiles; lay a bed of no less than 4 cm of fluid mortar on a concrete slab (preferably with inserted welded steel mesh) of at least 10/20 cm, depending on the load rate required and preferably use fine sand for the joints. You will need to wait 4 days for the trampling and not less than 10 for the drive-over, making sure that the substrate has made one body with the pavement to avoid the risk of breakage. Installation on PVC raised supports, suitable only for pedestrian traffic, makes that tiles remains raised above the ground; for this reason, in case of tiles of side 60 cm or more, we recommend the use of an intermediate support. The resistance of the tile is guaranteed even without the use of armor, but for extra precaution when using adjustable brackets we recommend the use of armor. The dry laying involves the use of dry sand with grain size 3/6 mm to a thickness of about 4 cm. The floor lies on the compacted and leveled sand. The work carried out this wat is quick but is only suitable for pedestrian traffic, in addition the natural adjustment of soil can cause misalignment and chipping. Glue laying requires levelled and dry backing. Using suitable glue, you should ensure perfect adherence to the slab and for this purpose we recommend using glue thickness and a notched trowel high.

• Wall cladding For all applications, make sure the surface is clean and not crumble. Laying on concrete requires prior cleaning with a pressure washer, especially in the case of new walls. Just before application is advisable to wet the surface with water. Laying on pre-mixed plaster requires checking that the media, though rough, does not crumble. For a perfect anchoring the plaster must be moistened before application of the glue, because of its composition based on lime / cement. Before laying on clay it is recommended a layer of skim coat that must be dry, and then apply a layer of a suitable glue. You can also plaster the wall before applying the cladding. Laying on painted plaster requires to tap the wall to remove the paint, then rinse and apply a layer of suitable glue, then apply the cladding. In case of resistant paint, fix with screw anchors a welded steel mesh and then apply suitable glue and cladding. Same procedure for each surface in poor conditions, even outdoors.

Laying on interior walls in good condition only requires the application of a layer of suitable glue.

In case of gypsum board, after verified the load resistance of the wall, it is appropriate to treat it with a primer. Cladding on insulation requires the verification of a perfect anchorage of the coating insulating the wall and its ability to bear weight. The application of the coating is done as shown above with wire mesh and special glue.

Warning: do not perform installation at temperatures below 5° or with high temperatures, however in this case it is necessary to wet the wall and the cladding to apply, to avoid alteration of the glue. Evaluate according to the type of intervention to be performed, the possible insertion of expansion joints.

Warning • Goods in stock Before issuing an order it is always necessary to check the availability of the goods in the warehouse and the correspondence to minimum order quantities.

• Products nomenclature The definitions of colors and surface finishes are exclusively for commercial use related to the item identification and not to be relied upon as technical product description.

• Discoloration All concrete products are subject to a modest alteration in time due to the action of atmospheric agents or particular conditions of use. For this reason, despite the colorations are obtained with pigments and oxides of primary quality ensuring long duration, in time moderate color changes may occur.

• Changes in aesthetics The use of natural elements and the characteristics of the production steps make normal a moderate variation of the aesthetic characteristics (color, grain size ...) even within the same supply.

The installer must be careful to use random pieces from different pallets to enhance this natural aesthetic difference. For the same reason any re-orders may be slightly different from the initial supply.

• Efflorescence At the end of the production process, and following exposure to particular climatic and atmospheric conditions, there may be some discoloration of the surface. It is a natural phenomenon and absolutely unpredictable even as result of a production performed in a workmanlike manner, and this effect disappears naturally with the rain and the normal use of the product. In accordance with standard UNI EN 1339 efflorescence are not considered as defects of the material and therefore are not recognized as valid reason for refusing / challenging the supply.

• Range Updating Possible changes to the products, such as colors, finishes, technical data etc are part of Bagattini SpA standard improvement program. This implies that characteristics may differ from previous versions. The customer can always make sure of the current characteristics by asking to see a sample update.

• Product displays All communication material produced by the company, on paper, video, or digital display, is subject to the normal approximation offered by the medium used, therefore the aesthetic (and color in particular) is to be considered purely indicative. For a reliable and current feedback of the actual appearance you need to check an adequate number of reference samples at the company, as required by the European Standard EN 1339.

• Use of products The durability of the products is a function not only of the technical characteristics of the specific product, but also the correct installation and usage conditions. It will be then upon the customer to provide adequate soil preparation and the substrate, choosing the right product to the conditions of use.

• Information provided by the company Bagattini SpA strives to provide informative material clear, accurate and up to date, however it is always technical and commercial information and shall be intended and used as useful tips for choosing, then it is not the real "state of the art." Therefore the company can not be held responsible for any loss or damage arising from use of such information or use of the products different from the one suggested. Names and trademarks mentioned in the text are generally trademarks or registered by the rightholders. Bagattini SpA is not liable for any printing errors or transcription. All rights to the material for the presentation of the range are reserved according to law. It is forbidden the reproduction, even partial, of photos, drawings and texts by any means, including photocopying, without written permission of Bagattini SpA .

Terms of sale • 1) Delivery of the supply Within a period of 60 days from the delivery date set by the contract, Bagattini SpA is not in any way liable for delays in production or delivery. If it is established to the withdrawal by the customer, the customer is obliged to respect the due date. If the withdrawal occurs with a delay of more than 30 days (term maximum binding and essential), the contract will be determined by law and will be charged to the customer a penalty for an amount equal to half of the value of contract, subject to any further damage.

• 2) Supply check Upon delivery, the customer is obliged of an accurate verification of compliance with the order.

Any disputes involving quantities, damages, defects, faults, not compliance, shall be immediately notified in writing prior to acceptance of the goods. After delivery, during or after installation, no dispute will be accepted.

• 3) Defects and faults The customer is aware of being the only decision maker's purchasing decision, having personally verified the characteristics of products to suit his needs. The customer is aware that the appearance of the products are subject to the limits as shown in the "WARNINGS" and therefore can not be disputed any color differences, efflorescence, differences in weight and size. They also are not to be considered flaws or defects breakage due to incorrect installation or use.

Any complaints must be submitted in writing to the Bagattini SpA and, to make use of the warranty, the customer has the responsibility to provide a technical assessment quote pursuant to art. 696 Code of Civil Procedure and 1513 of the Civil Code within 30 days from the date of the complaint.

In each case the supply is to be considered compliant even if it has up to 3% of non-conforming product.

The customer is aware that the products defined as "second choice" can not be used for the purposes envisaged by relevant regulations of the CE marking, as they do not meet the standard of reference.

• 4) Civil responsibility Bagattini SpA is relieved of all responsibility in the case of direct and indirect damage suffered by the customer and third parties, following the purchase, use or non-use of the products provided, including damage caused by the collapse of the walls either if it depends from defects in materials or it depends on other cause. In any case, the possible liability of Bagattini SpA in the case of faulty material, involves only the replacement of the same.

• 5) Retention of ownership In case of payment by installments Bagattini SpA retains ownership of the goods until the total balance of the supply.

• 6) Jurisdiction It is agreed that any dispute or termination of the contract, the sole place of jurisdiction will be that of Bergamo.
