In this informative session, we will explore the regulations and best practices related to staffing in assisted livings, focusing on Minnesota’s guidelines. We will delve into the responsibilities of clinical nurse supervisors, staffing plans, daily scheduling, and ensuring resident needs are met 24/7. By the end of this presentation, you will have a comprehensive understanding of how to optimize staffing to provide quality care.

1-B: Fire safety & evacuation plans by MDH

In this session, learn the statutory requirements around fire safety and evacuation plans for assisted living facilities. One of the major items of confusion is the requirement of the fire safety and evacuation plan. MDH’s Engineering Services hopes to clear any confusion and discuss what we have found on other providers’ plans.

You may find some helpful hints for your facility.

1-C: You can’t spell healthcare without “THC”— Medical & recreational cannabis use among residents & families State law says cannabis use, possession, growing, and transporting are legal, and landlords are not supposed to unfairly restrict cannabis. Yet, federal law says cannabis is illegal and residents may be using cannabis in precarious ways to themselves, others, and even your agency. In this session, attorneys Robert Rodè and Rebecca Coffin will discuss the current state of affairs with medical and recreational use of cannabis in the AL and housing settings; including legal and clinical requirements and considerations. Rob and Becky will work with participants in reviewing and creating effective policies and procedures and offer strategies and best practices and considerations in navigating all of these issues.

2-B: Demystifying your preparedness program

Let us take the mystery out of your emergency preparedness planning. This session is emergency preparedness for the “nonemergency manager.” The presenters will review how to draft a facility preparedness plan that meets the needs of the facility without all of the emergency management jargon, complexity, or confusion.

Attendees will learn how to talk through and promote their emergency plan with surveyors, leadership, and team members. A plan template will be provided to session attendees.

2-C: Weed, privacy rights, claimed right-to-use while working & other objectional behavior by employees

Attorneys Robert Rodè and Rebecca Coffin will continue the discussion about the legalization of cannabis use focusing on employee use and your rights and obligations as the employer. The session will review drug testing requirements, including what actions may be taken short of drug testing if you suspect an employee is under the influence of any substance and what to do when an employee claims their right to use medical cannabis while on the job.

We will also review privacy rights of employees and understanding boundaries with employees for their out-of-work “activities.” Tips will be provided on employee discipline and termination, as well as accommodating an employee with a substance use disorder under the Americans with Disabilities Act. 4-C: Assisted living contract terminations—Real world stories

Assisted living providers generally don’t want to be in a situation where they have to terminate a resident’s assisted living contract.

However, sometimes this can’t be avoided. We all know there are a lot of technical requirements related to contract terminations, but what really happens when a provider goes down this road? This session will focus on the impact initiating the termination process can have on providers, residents, and their family members. By discussing different termination scenarios, this session will also address the good, and not-so-good, outcomes that can result from the termination process.

5-B: Navigating the perilous process—Assisted living contract terminations

Attorneys Ryan Usher and Grant Gunderson will review common obstacles facilities face with the assisted living contract termination process established by Minnesota Statutes Chapter 144G and Minnesota Rules Chapter 4659. The discussion will provide guidance for navigating each of the many required steps. Mr. Usher and Mr. Gunderson will also address new landlord/tenant laws and the manner in which these laws may impact the termination process.

Finally, Mr. Usher and Mr. Gunderson will discuss strategies for prevailing at the Office of Administrative Hearings or otherwise resolving disputes following a resident’s (or ombudsman’s) appeal.

5-C: Emergency preparedness—Risk management

Risk for disasters is a part of life; emergency situations occur more frequently than many people believe. After a disaster, how well a community can recover will depend largely on how well they prepared in advance. Risk management includes identifying any potential risks to a community and proactively planning to minimize the threat. Proactive organization of resources and people to respond to emergencies can mean the difference between a community’s ability to regroup and recover and minimize the potential for harm.

ACCREDITATION

The Assisted Living Summit is accredited by the Minnesota Board of Executives for Long-Term Services and Supports (BELTSS) for licensed assisted living directors, nursing home administrators, and health services executives. The Summit is designed to meet the Minnesota Board of Nursing criteria for contact hours. The Board of Nursing does not pre-approve continuing education.

While the Assisted Living Summit is accredited for continuing education by BELTSS, the summit is not a pathway to assisted living director licensure.

ELECTRONIC CEs

Tracking attendance for CE purposes will be done per session with QR codes & your smart phone. Details will be emailed after your registration.

You can check your CEs earned from Care Providers of Minnesota on the Care Providers of Minnesota website.

CANCELLATION/NO-SHOW POLICY

We understand that circumstances arise that may prevent you from attending the summit after you have registered. If you cancel on or before Friday, May 3, 2024, we will gladly refund your registration fee and retain only $50 per attendee for a cancellation fee.

We are unable to offer any refund after Friday, May 3, 2024, for canceled registrations. We encourage you to find someone to take your place if possible. No-shows are charged the full registration fee and receive the Summit materials in electronic formats.
