Welcome from Worcestershire County Council Welcome to the 2012/13 Worcestershire Care Services Directory which provides information for adults on a range of social care services that are available across the county. Some of these are provided directly by the County Council but most are provided by private, voluntary, or charitable organisations who already support thousands of adults with social care needs.

The County Council s policy is to help people live independent lives and to give them greater choice in the services they access, and how they access them. Self-Directed support is designed to help people take control of their own social care budgets, manage their own support and choose the services that suit them best using the money - a personal budget via what s called a Direct Payment - more flexibly.

Whereas previously a person may have been limited to traditional options such as visits to a day care centre, or home help, Self-Directed Support offers a wider range of options. Perhaps an individual would like to keep their independence by funding transport to the shops every week, or to visit a relative who they may have lost touch with otherwise. Or maybe a person would have a better quality of life if a course at a local college could be attended to learn a new skill, or even have some help in getting out and about to keep active.

The County Council also funds a range of care services which are delivered in a selection of settings. If you are frail, have been ill, or have just come out of hospital, the short-term support of a home care assistant could be welcome. Known as domiciliary care, it is available to those who are elderly as well as people of any age with a physical or learning disability or with a significant mental health issue. In addition Telecare services can help promote independence and help alert carers/family members in a time of need. Respite care and short stays services are available to help ensure that we can offer you the right type of care which is suitable to your individual circumstances.

For Council funded services there are eligibility

criteria which normally will be applied following an assessment. For people who can fully fund their own care, there are many of the same or similar services from the private, voluntary, or charitable sectors. This Directory is for everyone in order to help people make the right decisions for the future at the right time. Our aim is to maximise people s independence and quality of life and to support them where appropriate to make the choice of care that is right for them. The Promoting Independence Service provides up to six weeks of assessment and reablement to enable adults to live as safely and independently as possible within their own homes and to reduce the need for ongoing domiciliary care.

We are committed to working with providers of social care to raise standards and maximise the quality and choice of services that are available in Worcestershire. We work closely with providers to ensure that people s needs are met and liaise with inspectors to ensure that care providers meet appropriate standards. We wish to help people make the right decision for their care needs and to promote independent living as much as we can.

Where do I start?

Self-Directed Support Self-Directed Support is designed to help people take control of their own social care budgets, manage their own support and choose the services that suit them best using the money from different areas more flexibly. The person is at the centre of the planning process as they are best placed to understand their own needs.

Self-Directed Support is a totally different way of providing adult social care. As the name suggests, Self-Directed Support allows an individual to design and tailor their own support package to meet unique and special requirements. This is a major change in the way Adult Social Care services are delivered and we are proud to be leading the way in providing targeted and personalised services that will really help to improve quality of life for its citizens.

We have adopted a new approach to providing care services. Gone are the days of a one size fits all approach, where standard packages were the norm, and people had to choose from a set number of available options. The introduction of Self-Directed Support means, as the name suggests, that individuals can control their own care.

Self-Directed Support recognises that individuals

who use our services are the experts on their own needs and Self-Directed Support will give more choice and control over their lives. By offering the option of a Personal Budget (see page 34), a person will be able to choose the support that s needed.

Supported from the start People wishing to go on Self-Directed Support receive whatever help that is needed at every stage - from filling out an assessment form, to completing a financial assessment, writing a support plan, finding the services or activities which are fitting and, if needed, help with the management of a Personal Budget.

Self-Directed Support continued There are three options for managing a Budget: Self-Directed Budget This is when a person manages their own Budget, and chooses where, when and how to purchase their support and services. The individual will need to shop around and make comparisons between the dierent goods and services available, or they may ask a family member, friend or third party to do this for them.

Facilitated Budget We and the individual agree and share the responsibility of purchasing the support and services that have been agreed using the Budget that has been allocated to them for their support.

Fully-Supported Budget The individual requests that we purchase all their support and services on their behalf using the allocated Budget.

Entitlement to services We have guidelines (eligibility criteria) for deciding who is able to receive community care services.

The eligibility criteria are based on Government guidance called Fair Access to Care Services (FACS). The aim of this guidance is to make sure that we make decisions about who gets help in a consistent way.

The FACS guidance expects us to assess the risks to a person s autonomy and freedom to make choices, their health and safety, their ability to manage personal and other daily routines and their involvement in family and other wider community

life. In Worcestershire, this means that if the risk to your independence is critical or substantial you will deďŹ nitely get a community care service.

We are required, under FACS, to oer services to meet care needs that fall into these two assessment categories. It is allowed to oer services that may not be the preferred option of the person receiving them if it can demonstrate that the services meet identiďŹ ed eligible needs in the most cost-eective way.

The assessment process You can contact us for information and advice by calling the Worcestershire Health & Social Care Access Service (WHASCAS) on 0845 607 2000 (8:30am to 8:30pm Mon to Fri and 8:30 am to 5pm on Saturdays) all calls are charged at local rates.

Alternatively you could write to WHASCAS, PO Box 585, Worcester WR4 4AD or visit any of the Worcestershire Hub Customer Service Centres.

If you ďŹ nd this diďŹƒcult you can ask a friend, relative or your doctor to do this on your behalf.

Following a discussion with one of the Access Service team you may be given information and advice or a referral made on your behalf to an appropriate social work team. Once contacted, a social worker or health care worker will visit you, either at home or in hospital to discuss your situation and determine your care needs. This process should only happen once, as your personal details will (with your permission) be shared with

health and housing services. There is no charge for this assessment. It will consider these personal circumstances: • How you can best be supported to live as independently as possible • Your home and how you are coping in it • Your emotional well-being • Your diet • Any health and medical treatments you need • Your ďŹ nancial status and any beneďŹ ts you may be claiming.

Once we have an understanding of your needs, the next stage is to determine what services you are eligible for and who will pay for them.

If you have been admitted to hospital and either you, your family /carers or the ward sta think you need care on discharge they may refer you to the discharge team for an assessment. The team is multi professional, made up of social workers, carers oďŹƒcers, mental health workers and housing oďŹƒcers.

The assessment process continued a plan of care developed with you and your family or carer to facilitate your discharge. Whatever services you need on discharge we will work with you and family and carers to either restart services already in place prior to admission or provide the appropriate service for discharge.

Interim care packages are set up to facilitate your discharge home and will be reassessed by the community social worker within 4 to 6 weeks. If you

need a care home we will ask our brokerage team to identify appropriate homes for your family to view. If your home of choice has no vacancies then we would like you to consider an interim place until you can move to your permanent home.

A financial assessment will be requested.

What care is available?

Care in your own home If you are frail, have been ill, or have just come out of hospital, the short-term support of a home care assistant could be welcome. Known as domiciliary care, it is available to those who are elderly as well as people of any age with a physical or learning disability or with a significant mental health issue.

These services also give valuable help and support to parents of children with disabilities and carers should they need it.

Domiciliary care services are provided by: • Worcestershire County Council; • independent agencies; • the voluntary and community sector; and • personal assistants (using Direct Payments).

All domiciliary care organisations and agencies that provide personal care must be registered with and inspected by the Care Quality Commission (CQC) who ensure that essential standards of quality and safety are met by the service and that staff are appropriately trained to do the job. Domiciliary care staff will work with you to help you regain and retain your independence. Some of the tasks they will do include: helping you get in and out of bed, dressing and toileting. For those who need it, they will help you regain confidence in tasks such as food preparation.

All staff have received specific training in areas such as moving and handling, first aid and food hygiene. All staff also have a background check with the Criminal Records Bureau. The amount of care you receive each week will be dependent on your assessed needs. We will work with you to find out how much support you need. This is called a

Community Care Assessment .

Depending on the level of help required, care assistants visits can be as short as fifteen minutes or up to several hours. Generally, visits are available between the hours of 7am and 10pm. Some people will need multiple visits per day. Night services can also be provided. The hourly rate for these types of services typically range from £13 to £17 per hour depending on the required tasks, whether the call is on a weekday or weekend, the time of day and the location of the visit.

Paying for domiciliary care You won t have to pay for any assessment or any visits or advice from your social care worker.

However any personal care that you receive will need to be paid for. The exact cost will depend on your personal finances. This will need a confidential discussion with a Benefits and Contributions Officer who will look at your income and expenditure.

Currently, a capital threshold of £23,250 applies (this may change after April 2013). If you have less than this, a detailed calculation will determine what you pay. If you have more than £23,250 you will have to pay the full costs. You may also be offered the choice of Direct Payments (also discussed on page 34) if you are considered eligible as an alternative to receiving part or all of these services.

Home care agency checklist

These questions may be useful when considering using the services of a home care (domiciliary) provider to help you build up a picture of how your care needs will be met in your own home.

For care packages which have been arranged by us, contracts and care plans will have been completed by your care manager and the agencies used will have been accredited to work for us.

People arranging and funding their own care either privately or through Direct Payments or a Personal Budget are able to choose their own worker or care agency.

Agencies • What experience does the agency have in your particular ďŹ eld of need? Can they supply references for you to check? • Home care agencies providing personal care, must be registered and inspected by the Care Quality Commission. Ask to see a copy of their registration certiďŹ cate. • How long has the agency been operating? • How many carers would the agency assign to care for you and would you see the same one every day? If not, how does the sta rota operate and what happens if your carer goes on holiday or is sick, will you be notiďŹ ed in advance that a dierent carer will be attending? • How can you contact the agency in an emergency or outside oďŹƒce hours? • How hard or easy would it be to make a complaint and how are things then put right?

• If this is a private contract ask for a copy of the agency s contract terms and read these carefully with someone you trust. Get as much help as you can going over it and ask any questions you may have before signing anything. The Citizens Advice Bureau or Age UK (Help the Aged and Age Concern s new name) could help with this.

Carers • You should expect your personal preferences, dignity and privacy to be respected. Discuss this with the agency and ask how the most suitable carers for your particular care are chosen. Can you talk to them before deciding? • Carers should be fully trained or be in ongoing training. Ask the agency about their policies on this. • You will have a care plan drawn up by the agency which the carers will work to. Ask how often this plan will be reviewed by the agency. • Carers must be checked with the Criminal Records Bureau (CRB) and have a criminal records disclosure ‒ make sure this is the case.

Paying • If your care needs do not meet our eligibility criteria and have been arranged privately you should check carefully the fee rates charged and exactly what the payment you make covers.

Assistive Technology (Telecare) The range and diversity of equipment is growing and telecare no longer describes what is available to health and social care staďŹ&#x20AC; in supporting service users, carers and patients so Assistive Technology is the new term that covers all things technical that supports service users/patients/carers.

Telecare provides products and services that can: â&#x20AC;˘ alert a monitoring centre that something adverse has happened and ensure appropriate action is taken â&#x20AC;&#x2019; for instance alerting a family member or the ambulance service â&#x20AC;&#x2019; this is based on the call/ pendant alarms and has been used traditionally to alert someone when the person wearing the pendant has fallen but there are now other things that be monitored and elicit a response such as bed or chair leaving sensors â&#x20AC;˘ prompt, remind and inform people and their carers about things in daily life which need to be done such as taking their medication on time.

Automatic Pill dispensers are being used very successfully in Worcestershire

â&#x20AC;˘ support someone or their carer living with dementia â&#x20AC;&#x2019; simple things like calendar clocks to GPS technology to facilitate safe walking and enable the carer to know where someone is.

In Worcestershire, the range of equipment made available would be subject to an assessment of need under the Fair Access to Care Services (FACS) guidelines (discussed on page 6). If you do not meet the eligibility criteria for free issue of equipment, or if you choose to fund the equipment yourself, many of the items can be purchased directly either from a supplier, or in the case of a Telecare alarm and additional items of equipment, directly from the Call Centres that operate through the county.

Respite care and short stays Many people have an informal carer living with them, or perhaps living nearby, who provides care on a regular basis. Carers often need a break and this may be provided in several ways: it might be possible to arrange home-based respite care where another carer comes to your home or family-based respite care where you move into another family s home or you may need to go into a care home for a week or two. needs, the urgency of the situation, personal choice and cost.

Supporting carers Looking after someone whether they are family, friend or a neighbour can be very satisfying but it can also leave you feeling isolated, stressed, exhausted, resentful or angry. In Worcestershire there is help and support available from a number of sources.

Carers Action Worcestershire is a countywide information, advice and support service for carers.

This service oďŹ&#x20AC;ers a 24/7 telephone helpline where questions can be answered and information given on services and support available to carers.

Importantly Carers Action Worcestershire also provides an independent voice for carers. For further information and support please contact 0300 012 4272.

The Adult and Community Services Carers Unit organises training/information sessions for carers . It also provides a range of services aimed at supporting carers . These services are focused on

giving carers a break from their caring role.

Carers might also like to consider requesting a Carers Assessment* which allows carers to discuss their needs and feelings as a carer. It is an opportunity to talk about all the things carers do in their caring role and discuss services that could be provided to make life easier. It also gives carers the opportunity to consider what would need to be arranged should a personal emergency occur. There is a Carer Back Me Up Service* which provides up to 72 hours substitute care to the cared-for person if the carer has a personal emergency. Intermediate care This is provided by a range of services to promote faster recovery from illness, prevent unnecessary acute hospital admissions and support timely discharge from hospital. It is a programme of therapy and treatment, usually lasting no more than 2 weeks, designed to make you as independent as possible.

The structured programme of support may mean that you do not have to go into hospital at all, or may enable you to get home faster after you finish hospital treatment, but cannot manage independently at home. Intermediate care is

designed to rehabilitate you and to help you manage by yourself.

Community Intermediate care provided by the NHS, is free and is provided in your own home.

Adult Social Care and Worcestershire NHS also work together to support service users to recover from illness rather than being admitted into hospital providing a service in nursing/care homes when 24 hour care is necessary to be able to be monitored effectively and usually lasts for no more than 2 weeks to allow for recovery and return home.

Promoting Independence Service (PI) The Promoting Independence Service provides up to six weeks of assessment and reablement to enable adults to live as safely and independently as possible within their own homes and to reduce the need for ongoing domiciliary care. The service is available between 7am and 10pm, 7 days per week and is free of charge to service users. The team consists of team leaders, occupational therapists, physiotherapists, coordinators and PI assistants

who work closely together to help service users achieve their desired outcomes.

If it is identified during your time with the PI service that you need some continuing support, the PI team will make a request for you to be seen by one of the staff in the Community Social Work team, the service that will help you to develop a support plan to meet any outcomes that have been identified with you.

Continuing care Continuing care is care provided over an extended period of time to a person aged 18 or over to meet physical or mental health needs which have arisen as the result of disability, accident or illness.

If you need continuing care, your care needs will be complex, substantial and ongoing, caused by a disability or chronic illness, or following hospital treatment. Continuing care is also commonly known as long-term care.

Continuing care is provided by:

• healthcare services from the NHS, and/or • social and community care services from your local authority.

Health services are provided through NHS organisations such as Primary Care Trusts, NHS Trusts and Mental Health Trusts.

Continuing care services may be provided by the NHS or your local authority in various places, for example, in hospital, in a care home or care home with nursing, in a hospice, or in your own home.

Continuing care continued NHS Continuing Healthcare If your main need for care relates to your health, the NHS is responsible for providing for all your needs.

NHS Continuing Healthcare is a package of continuing care arranged and funded solely by the NHS. It s also sometimes known as fully funded NHS care.

To be eligible for NHS Continuing Healthcare, your primary need must relate to your health. Your needs will be assessed to decide if you re eligible.

If you re eligible, you re likely to have complex healthcare needs that require a lot of intense care and support; you may also require highly specialised nursing support. Someone approaching the end of their life may be eligible, if they have a condition that is rapidly getting worse and may be terminal.

NHS Continuing Healthcare may be provided in any setting, for example: â&#x20AC;˘ in your own home - the NHS will fund all the care required to meet your assessed healthcare needs within resources available, or

â&#x20AC;˘ in a care home or care home with nursing - the NHS will make a contract with the care home and pay the total cost of your placement.

If you have a disability, or if you ve been diagnosed with a long-term illness or condition, this doesn t necessarily mean that you ll be eligible for NHS Continuing Healthcare.

NHS-funded Nursing Care If you qualify for NHS-funded Nursing Care, the NHS is responsible for arranging and funding nursing from a registered nurse in a care home which is registered to provide nursing care. This nursing care cannot be provided by local authorities. The NHS funds this nursing care through a payment called the Registered Nursing Care Contribution (RNCC).

Currently this amount is ÂŁ108.70 per week and is paid directly to the home.

Your needs will be assessed to decide if you re eligible for NHS-funded Nursing Care.

Sheltered (or retirement) housing This is a practical step if you would like more security and companionship but don t need to move into a care home.

In a sheltered (or retirement) housing scheme you would live independently in a ďŹ&#x201A;at or bungalow built especially for older people within a larger complex, sometimes around a garden or communal facility and linked to a central control centre for security.

Some schemes have access to a resident or nonresident manager who provides support, advice and a link to services for older people. After your needs have been assessed, you will still be able to receive care in the home if required.

Types of care homes All care providers must be registered with the Care Quality Commission (CQC). Home listings start on page 38 in this Directory. All services are inspected by the CQC, who report on their findings. These inspection reports are available from the service or from the CQC. There are two types of care home:

The Worcestershire LINk Worcestershire LINk oďŹ&#x20AC;ers a means for the local community, especially care home residents and their families/carers to give feedback on how well care services are delivering care. Based on the information we receive, we use trained LINk volunteers to visit services to get a feel for how the service is run and to identify any areas which need improvement.

LINk s role extends to all health and adult social care - not just care homes - and includes monitoring and holding to account the NHS and the Council for the quality of services - this includes powers to Enter and View .

We pay particular attention to person-centred care. We report on and make recommendations concerning any issues which are discovered as needing attention. We also follow up on this to ensure that remedial action has been taken and improvements made.

In April 2013 the LINk service is due to be replaced by a new body called Healthwatch Worcestershire. Additional information will be made available when this project reaches a more advanced stage.

Out of county care homes You may wish to choose a care home outside Worcestershire, for example to be closer to family or friends.

If you are eligible for state funding from us towards the cost of your care home place, we will contract with the care home you choose. We must be satisďŹ ed that the care home is suitable for your assessed needs, so it is important to seek its advice before making a ďŹ nal decision. Subject to this we will normally contribute an amount equivalent to the amount which the local authority in which the care home is located would normally contribute.

If you will be fully funding the cost of the care

yourself you have the freedom to choose whichever home you wish. However you may still wish to seek further advice about which home to choose details of some organisations that can oďŹ&#x20AC;er advice are listed on pages 32 and 33. If, at some point in the future you become eligible for state funding, you will need to contact the local authority in which your care home is located, as you will no longer be a resident of Worcestershire.

Learning disability If you are considering moving out of your family home, there are a number of options that could be explored before considering a care home. You may be able to have your own ďŹ&#x201A;at with support. There is also the option of supported living, where you can share a property with other people with support

provided for all. Either of these options can often give you greater independence and choice than care homes may be able to oďŹ&#x20AC;er. There are other alternatives too such as Adult Placement or Shared Ownership schemes that could be considered and these can be set up through a social worker from Adult and Community Services.

Many adults with learning disabilities can live in their own homes in their local communities with support but there may be times when an individual has specialist health care needs or behaviour that is particularly challenging when a care home may be

Care homes for people with learning disabilities often specialise eg homes for people with autism and challenging behaviour or dementia. A good home will provide opportunities to learn and maintain skills and opportunities to take part in enjoyable and stimulating activities. Care managers, social workers and community nurses from Adult and Community Services, who specialise in learning disability will be able to give you information to enable you to make the right choices.

Physical disability Following an assessment of your needs, you may be eligible for help from us, including occupational therapy, adaptations to your home, supported housing or help for the person caring for you.

The support you require if you have a physical disability must be tailored to your specific needs and can be provided by the independent and notfor-profit sectors as well as by us. Help at home with personal care is available during the day and night, seven days a week. There are also private agencies offering help at home with personal care and housework. See page 7 for more information.

Adult mental health Your local Community Mental Health Team (CMHT) should be your first point of contact if you have mental health issues that require specialist secondary services. Your GP will be able to refer you to this service.

These teams are multidisciplinary and can offer both health and social care interventions and support, focusing on the needs of people experiencing a severe and/or enduring mental illness. The services are recovery focused and work

Dementia People with dementia can expect to have the quality of their lives improved by person-centred care provided in care homes. Person-centred care ensures that people are recognised and treated as an individual, taking into account their own unique history and life story. Care should then be tailored to meet each person s needs with an emphasis on their interests, likes and choices.

Care homes offering person-centred dementia care should also provide a range of activities which promote a sense of well-being and purpose for the residents on a day to day basis. The home should provide a homely and comfortable environment which allows residents freedom of movement within a safe garden.

Residents and carers should be involved in the planning of care, with relatives still able to continue to be part of the care process as they wish. Residents should have a wide choice of food which promotes and maintains their continued good health.

Specialist care services continued We have initiated a program of quality improvement and training to support homes in providing person-centred care.

The Care Services Quality Team (CSQT) is supporting care homes to speciďŹ cally improve the standard of person-centred dementia care, and has been involved with developing an observational framework for measuring the lived experience in a care home. See

page 23 for further information on CSQT. We have commissioned specialist dementia training which can be accessed by all care homes and the CSQT provide support for them to make any changes.

MANAGER / HEAD OF HOME A manager who is caring as well as eďŹ&#x192;cient can make all the diďŹ&#x20AC;erence to a home. â&#x20AC;˘ Does the manager have a knowledge of dementia and can they deal with diďŹ&#x192;culties that may arise in an understanding way? â&#x20AC;˘ Is there a full assessment at home before a resident is admitted?

Essential information Inspection and registration of care services All care providers must be registered under a system introduced by the Health and Social Care Act 2008, which brings adult social care, independent healthcare and the NHS under a single set of essential standards of quality and safety for the ďŹ rst time.

The Care Quality Commission (CQC) is the independent regulator of health and social care in England. They regulate care provided through a

Comments, compliments and complaints All organisations need to know how they are performing. They are happy to receive your feedback on their service whether they are compliments or complaints. Feel free to tell them what you think and your comments can be used constructively to improve the service.

If you or your relative s care is being funded or part funded by us then you can complain directly to us about aspects of the care provision that you are unhappy with. It is expected that you would initially have complained to the manager of the service first, however, if you do not feel that they have fully dealt with your concerns then you can contact our Consumer Relations Officer, Adult Social Care Services on 01905 766365, or write to Consumer Relations Unit, PEP, County Hall, Spetchley Road, Worcester WR5 2NP. If you do need to make a complaint you should feel able to complain about any aspect of your care which affects your happiness or comfort. This could

be about the way you are treated by a staff member or the quality of the food you are served. You can also make comments and suggestions about possible improvements to your surroundings and the services provided.

Providers are required under essential standards of quality and safety to have a simple and easy to use complaints procedure which they will be happy to give you. If you are concerned about the care that you, a friend or a relative is receiving, it makes sense to speak to the manager before you take any further action. The problem may be resolved quite easily once they are made aware of it.

However, if you need to make a formal complaint, you should initially contact the registered owners of the service. They have a duty to respond to any complaints made.

If your complaint is about a breach of regulations, contact your local office of the Care Quality Commission, see above for contact details.

Safeguarding vulnerable adults A vulnerable adult is: someone over 18 years of age who might be unable to protect themselves from significant harm or serious exploitation because of a physical or mental disability, age or illness (No Secrets, Department of Health 2000).

Abuse is the violation of an individual s human or civil rights by another person or people.

It can take many different forms, such as: • physical abuse: being hit or restrained, misuse of medication • sexual abuse: being harassed, teased or being forced to have sex without consent • neglect: not getting adequate care, food, medication, heating • psychological abuse: bullying, threats, verbal abuse

• discriminatory abuse: ridicule or threats because of race, gender, disability, age, sexual orientation • financial abuse: theft, fraud, exploitation, pressure to change a will, misappropriation of property and possessions • institutional abuse: mistreatment by an organisation or individual where care is provided.

Abuse can happen anywhere and by anyone, including relatives, friends, neighbours, paid care workers, volunteers, professional staff and strangers.

How solicitors can help A solicitor can give you impartial advice about wills, making gifts, estate planning and Powers of Attorney. Some can also oďŹ&#x20AC;er guidance on immediate and long-term care plans, ensuring (if applicable) the NHS has made the correct contribution to your fees.

Lasting Powers of Attorney (LPA) allow you to appoint someone you trust to make decisions about your personal welfare, including healthcare and consent to medical treatment, and/ or your property and ďŹ nancial aďŹ&#x20AC;airs. An LPA is only valid once registered with the OďŹ&#x192;ce of the Public Guardian. It allows for a person of your choice to make decisions on your behalf at a time when you may be unable.

The Court of Protection can issue Orders directing the management of a person s property and ďŹ nancial aďŹ&#x20AC;airs if they are incapable of managing their own aďŹ&#x20AC;airs should they not have a LPA. The Court procedure is presently very slow and the fees are quite expensive so preparing a LPA is always advisable, providing you have somebody suďŹ&#x192;ciently trustworthy to appoint as your attorney.

An advance directive allows you to communicate your wishes in respect of future medical treatment but it is not legally binding. You may instead wish to make a living will, properly known as an advance decision setting out treatment that you do not want to receive in speciďŹ ed circumstances, which would legally have to be followed, even if you die as a result.

Any proposed Gift out of your estate needs careful consideration of the beneďŹ ts, risks and implications, particularly on any future liability for care costs or tax liability.

Long-term care: whether you remain in your own home or move into sheltered accommodation or a care home, you may qualify for ďŹ nancial assistance in the form of social care and NHS-funded care and welfare beneďŹ ts.

Paying for care Direct Payments If a person chooses to take a personal budget as a Direct Payment this means that they have the money paid directly to them to arrange their own services that meet the outcomes identiďŹ ed through the assessment and support planning process.

Direct Payments should be oďŹ&#x20AC;ered to everyone who is eligible to receive them, as the preferred way in which the personal budget can be taken. The Government is really keen that personal budgets should be managed by the individual through a Direct Payment.

Why? This is because they oďŹ&#x20AC;er the most ďŹ&#x201A;exibility and independence to manage support needs. This means a person can choose who provides support; when support is delivered and how the support is delivered. A person may want to employ their own personal assistants or they can go directly to a provider which means the contract is between the individuals concerned. This gives far more control over how support is delivered.

When taking a personal budget as a Direct Payment, you will be given enough money to meet your outcomes; but the services you buy must not cost more than they would if they were provided directly by us. You may be asked to contribute towards the cost of your services and a ďŹ nancial

assessment may be required.

Direct Payments are paid directly into a bank account that you must open speciďŹ cally for this purpose. You will be asked to sign an agreement, a bit like signing to agree to the rules of having a Direct Payment. You will also be asked to keep records and receipts to show that the Direct Payments have been spent on care to meet your needs. The ďŹ nances will be looked at as part of the annual review of the budget.

One of the key elements in encouraging people to use Direct Payments is to have good support and advice available. We have a support organisation that provides information and advice services to people thinking about or using Direct Payments. This includes advice on how to recruit and employ personal assistants and support workers. Penderels Trust can be contacted on 01299 253225. Personal Budgets A Personal Budget is the weekly amount of funding following an assessment and identification of eligible social care needs. It is the way in which an adult social care service is now offered at every new assessment and at review. The amount of the Personal Budget depends on the eligible needs identified in the assessment The assessment looks at what is working well and what isn t working so well in a person s life and then allocates funding where more support is required to meet the eligible needs. A Personal Budget will only be finally agreed once we have worked with the person to ensure they have achieved as much independence in their life as possible. Once the amount of the Personal Budget is agreed the aim is that the person will have greater choice and control and flexibility in the way they receive services and are supported.

There are three main ways in which the Personal Budget can be taken; each individual has a choice to: • Take a Direct Payment ‒ take the money allocated and purchase services directly

• Have the budget fully supported ‒ ask the Local Authority to manage the budget and purchase services • Combined ‒ A bit of both.

The advantages and disadvantages of each option will be discussed with them (or the person representing them).

If a person needs support to manage the Personal Budget they can get this from: • Family members • Trust/financial services • Deputy/Appointee • Suitable person • Provider who can provide an individual service fundhold the money, which can be drawn on when required • The local authority.

A person may be eligible for a Personal Budget if they have a learning or physical disability, mental health needs, are an older person, or are a carer. The amount identified will depend on the results of the assessment.

Third party payments If the home you choose costs more than the rate we usually pay for someone with your needs, you will have the choice to ask someone else to make an additional payment.

If there is no-one available to supply the extra payment, you can ask us to find you another placement at the rate we would normally expect to pay. If, however, you do decide to live in the more expensive home and you have someone who is able to make an additional payment for you, they will have to pay the difference between our rate and the amount the home charges. This additional payment is often referred to as a top-up or third party contribution .

The law says that you are not allowed to make this additional payment yourself, except in limited circumstances. Therefore, the additional payment

has to be made by someone else, for example, a family member or charity.

Before anyone agrees to make additional payments on your behalf they should be aware that the amount could change, usually increase, once a year and they need to be confident that they can sustain the payments for as long as they are required. If the additional payments stop being paid for any reason, then you should seek help and advice via the Access Centre on 0845 607 2000.

Once it has been established that someone is willing and able to make these payments they will be asked to sign an agreement to formalise the arrangement.

Because the financing of care is a complex area it is advisable to contact the social worker who is arranging your placement with you or the Access Centre to ask for advice and individual guidance.

Care funded by the council Do I qualify for local authority financial assistance?

If you have been assessed as needing a care home place and your capital is below £23,250 you should be entitled to financial support from your local authority.

If you have capital below £14,250 you will be

entitled to maximum support contributing your income less £23.50 per week retained for personal expenses. If you have capital between £14,250 and £23,250 you must pay a capital tariff of £1 per week for each £250 between these two figures. Capital >>

Care funded by the council continued >> includes the value of your former home unless it s occupied by your partner, or a relative who is aged over 60 years or incapacitated, or a child under 16 years who you maintain or a separated partner who is a lone parent.

Do I have a choice of care home if the Council is paying?

Yes and it can even be in a diďŹ&#x20AC;erent county. The home you choose must be suitable for your assessed needs, comply with any terms and conditions set by your local authority and not cost any more than they would usually pay for someone with your needs.

What if a home costs more than the local authority is prepared to pay?

The local authority will allow a third party to top-up as long as they are able to do so over the long term.

You are not allowed to top up the fees yourself from capital below ÂŁ23,250.

My partner needs care, how does this ďŹ nancially aďŹ&#x20AC;ect me?

Your local authority will take into account 50% of any joint savings therefore, to accelerate ďŹ nancial help, it is better to have separate single accounts meeting care costs paid from the account of the person in the care home.

Paying for your own residential care Self-funding If you are self-funding your care because you are not eligible for local authority funding there are other forms of ďŹ nancial assistance you may be entitled to: Will the local authority pay my fees whilst I am selling my former home?

If, apart from your property, your other capital is below ÂŁ23,250 the local authority will help with the costs during the ďŹ rst twelve weeks of permanent care. Beyond that period any ďŹ nancial help will be charged against the value of your former home and recovered from the eventual sale proceeds.

Do I have to sell my property?

No, your local authority can lend you the money to pay for your care charged against your property value. However, they may limit how much they will pay and it could adversely eďŹ&#x20AC;ect your welfare beneďŹ t entitlements.

Do I have to pay Council Tax on an empty property?

If you move into a care home and your property is left empty then you should receive full exemption from Council Tax until it s sold.

Is there any ďŹ nancial help that is not means tested?

Attendance Allowance is a non-means tested, nontaxable allowance paid at the lower rate of ÂŁ51.85 for those needing care by day or night and, at a higher rate of ÂŁ77.45 for those needing care by day and night.

Whether your stay is temporary or permanent if you receive nursing care in a care home you may

be entitled to an NHS Registered Nursing Care Contribution (RNCC) towards the cost of your nursing care, paid directly to the home at ÂŁ108.70 per week.

If your needs are primarily health care needs, you may be entitled to full funding from your local PCT following an assessment under their continuing care eligibility criteria. This ďŹ gure applies to England only.

What happens if I move into a care home independently and run out of money?

Once your capital reduces to ÂŁ23,250 you should seek local authority assistance. However, if the home costs more than the local authority usually pays and won t reduce its fees you could be in the diďŹ&#x192;cult situation of either ďŹ nding a source of topup or seeking less expensive accommodation.

If there is a likelihood of running out of money it s important that you arrange an assessment of your care needs with us to ensure we will step into help. Also check if the care home owner can continue to accommodate you at our funding rates or will require a third party top-up.

What can I do to avoid this situation?

There are ways of meeting care costs for as long as you need care whilst using up only part of your capital. For example, the use of Immediate Need Care Fee Payment Plans can contribute towards capping the cost and, as so many older people wish, enabling an inheritance to be left for the family.

The important thing is not to try to do it alone, always seek professional advice.
