Welcome Welcome to the 2015/16 Wiltshire Care Services Directory which provides information about the range of adult social care services available in Wiltshire.

This year has seen a big reform with the introduction of the Care Act from April 2015. It modernised the law and recognised the right of people to make their own decisions about their care and support. We are already doing, or working towards, many of the things that are new in the Care Act. At Wiltshire Council we want people to maintain their independence as long as possible and enjoy the best quality of life. We are committed to supporting vulnerable adults and older people and are investing in care services which help you live independently in your own homes and communities for as long as possible.

We understand that, for some of you, living in your own homes is simply not an option and, for many of you, living in supported accommodation or a care home is your preferred choice. Therefore, this Directory contains clear, easy to understand information about care homes which will help you choose the right home for your needs and be confident that you are making the right decisions. It also provides details of services that support those of you who care for others.

Throughout Wiltshire, Celtic Care Services will provide you with a high quality personalised care and support service to help you to retain or regain your independence and enable you to stay in the comfort of your own home.

Established in 2001, Celtic Care Services is a family owned and run domiciliary care provider. We are the domiciliary care provider of choice in Chippenham, Corsham, Calne and surrounding towns and villages.

This is borne out of our customer base predominantly being made up of individuals who fund their own care or are in receipt of Direct Payments. We have also recently expanded the areas we cover to include Wootton Bassett, Swindon, Marlborough and surrounding areas with the opening of our new branch in Chiseldon.

Domiciliary care is a real alternative to a residential or nursing home. We offer a wide range of flexible services including all aspects of personal care including help getting up in the morning or accessing a bath or shower, social care including assisting you to go shopping or accompanying you to groups or social activities, and also complex care for people with more individual health care needs. These services are available to children, adults and the more elderly members of our community and can be long term or for short periods; to help during holidays or just to enable you to regain your independence. All our services are individually tailored to your preferences and are continually adapted to meet your changing needs.

First steps Wiltshire Council’s aim is to support people so they can live independently for as long as possible. The Council will work with customers, carers and care providers to make this happen.

This Directory outlines what support the Council may put in place to help you. There are also staff on hand to

discuss any support you may require. This will help ensure you have all the information so you can make the right decisions for your care needs.

Assessment If you feel you have a need for care and support and want to take the next step you can ask for an assessment of your care and support needs. Everyone is entitled to receive an assessment regardless of their financial situation.

You can be referred for an assessment by: • yourself or a relative, friend or neighbour; • a social worker or health professional such as a doctor or health visitor; or • any other agency.

You can have a carer, friend, relative or advocate with you to help put your views and wishes forward. Your doctor,

district nurse or other health professional who knows you well can also be involved if you wish. If you do not speak English, or if you use British Sign Language, the Council can arrange for an interpreter to be present.

Adult Care will meet with you so that you can explain what your needs are. The assessment focuses on what you want to achieve and you will be encouraged and assisted to contribute as much as possible. This means that the Council will talk through with you how best to meet your needs and choices.

Care and support planning Following your individual assessment, the Council will look at whether you have eligible needs and discuss with you how best to meet these. Everyone who is eligible for support will be offered the option of having a service which is paid for by the Council or by the transfer of funds which you can use to purchase your own care. This is called a direct payment (see page 44). You will be offered support and assistance throughout the direct payment process from the Wiltshire Centre for Independent Living, whose contact details are on page 53.

The Council can also help those who are not eligible

for financial support by conducting an assessment of care and support needs, with the provision of information and advice, and assistance in finding services.

National Eligibility Criteria The minimum threshold for eligibility has been set by central Government to ensure that all local authorities meet the same minimum level of needs.

The aim is to make sure all decisions on who receives help with care and support are made fairly, openly and consistently.

Eligibility criteria for adults with care and support needs As mentioned above, the minimum threshold for eligibility has been set to ensure that all local authorities meet the same minimum level of needs.

1. The needs arise from, or are related to, a physical or mental impairment or illness; and 2. As a result of those needs the adult is unable to achieve two or more of the specified outcomes: • managing and maintaining nutrition; • maintaining personal hygiene; • managing toilet needs; • being appropriately clothed;

For an adult’s needs to be considered eligible for support by the local authority they must meet all three criteria. In other words, if they are unable to achieve two or more of the above outcomes, but this doesn’t have a significant impact on their wellbeing, then they are not eligible for support.

Eligibility criteria for carers: For carers, eligibility is based on whether they are providing necessary care and are either not able to meet the adult’s needs, or not able to achieve outcomes themselves, together with the impact on their wellbeing.

A carer’s needs are eligible where they meet three conditions: 1. The needs arise because the carer is providing necessary care for an adult; and 2. The effect of the needs is that any of the following apply to the carer, namely:

deteriorating; • t he carer is unable to achieve any of the following outcomes: a. carrying out any caring responsibilities the carer has for a child; b. providing care to other persons for whom the carer provides care; c. maintaining a habitable home environment in the carer’s home, whether or not this is also the home of the adult needing care; d. managing and maintaining nutrition; e. developing and maintaining family or other personal relationships; f. engaging in work, training, education or volunteering; g. making use of necessary facilities or services in the local community, including recreational facilities or services; or h. engaging in recreational activities; and 3. As a consequence of that fact there is, or there is likely to be, a significant impact on the carer’s wellbeing.

For a carer’s needs to be considered eligible for support they must meet all three criteria.

Following a decision on your eligibility you will be assessed as to whether you need to make a financial contribution to any services provided by the Council. There are many council services which are not means-tested, including bus passes, and Blue Badges for disabled people.

TELECARE SERVICE IN WILTSHIRE

Do you think the reassurance of a monitored care response service would help you stay independent at home?

A basic telecare package consists of a simple alarm unit and pendant.

The alarm unit is a discreet box which works alongside your telephone.

Whenever you need help, you can press the pendant, which is worn around your neck or your wrists, to access care and support 24 hours a day, every day of the year.

When you call, we will automatically know who you are, where you live and who you would like us to contact in the event of an emergency.

In most cases, we will contact a carer or friend if you need help at home.

However, sometimes there is no-one available or the situation is too difďŹ cult for a carer to cope with.

In these circumstances, we can send one of our highly trained responders who will visit you in your own home if there is a need.

They can provide assistance and decide if further help is required.

Equipment for independent living If you are struggling to manage everyday tasks such as bathing, climbing the stairs, or getting up from your chair, it may be that an item of equipment could make the task easier. Medequip is commissioned by Wiltshire Council to deliver a number of services and is the current equipment supplier in Wiltshire. The organisation has a small shop and online self-help system at: www.medequip-wiltshire.co.uk to help you find the right equipment for you.

The Independent Living Centre in Semington provides impartial advice, assessment and demonstration of equipment at the centre, by appointment. More details can be found on its website: www.ilc.org.uk If you would like an assessment from the Council,

contact a customer adviser on: 0300 456 0111. A customer co-ordinator or occupational therapist will discuss your needs on the telephone or by visiting you and will assess how best to resolve your difficulties.

They may be able to suggest alternative ways of doing something which could mean there’s no need for any equipment. There is no charge for equipment provided by Wiltshire Council.

Occupational therapy An occupational therapist can carry out an assessment to identify what areas of your everyday life are causing problems. Occupational therapists can help you lead a more productive, active and independent life using a variety of methods, including the use of adaptive equipment and adaptations. They will discuss your needs with you and explain what help is available. An assessment and any advice or information they give you should be free.

Occupational therapists work in both health and social care teams. If you have a short-term condition, for example if you need support following an operation, you will be assessed by an occupational therapist through the NHS. They will discuss your needs with you and decide if you would benefit from occupational therapy.

If you have a long-term condition, such as a permanent physical disability, occupational therapy is usually accessed through your local council. Contact

the Council to arrange an assessment with an occupational therapist, or you can be referred for an assessment by: • your GP or consultant (specialist doctor); • a nurse; • another healthcare professional; or • a social care professional.

If you do not want to access occupational therapy through the NHS or Wiltshire Council, you could contact an occupational therapist directly. If you decide to see a private occupational therapist, make sure they are fully qualified. Only healthcare professionals who are registered with the Health and Care Professions Council (HCPC) are allowed to use the title of ‘occupational therapist’. You can check that an occupational therapist is registered by checking the HCPC online register at: www.hpcheck.org

Telecare and response service – keeping you safe Telecare is sometimes called ‘assistive technology’. It aims to promote your independence, improve your safety at home and provide reassurance for you and your carers. It usually consists of a base unit linked to a telephone and a personal pendant which is worn around the neck, on the wrist or attached to a belt.

Sensors automatically monitor the home environment.

These are linked to the base unit without the need for wiring and can detect potential dangers such as gas, smoke or overflowing water. When the alarm is activated, trained staff at a monitoring centre will respond and, if necessary, arrange for someone to visit you at any time of the day or night. They may also contact the emergency

services if necessary.

This call centre monitoring and response service is provided through Medvivo.

If you are interested in Telecare, Adult Care can discuss the options with you so that you can decide which sensors will best suit you. Adapting your home If you have mobility problems, you might benefit from small adaptations to your home, such as hand rails or ramps. Medequip can arrange for minor adaptations in your home. Some housing associations are also able to help with minor adaptations for their tenants.

If you need major adaptations, such as a stair-lift or level access shower, an occupational therapist employed

by Wiltshire Council will assess your needs and can refer you for a means-tested Disabled Facilities Grant to help with some or all of the cost. If you are on a low income, you may qualify for a full grant.

Home Improvement Service provided by Medequip This agency will work with you if you are receiving a Disabled Facilities Grant (DFG) for a major adaptation to your home, such as installing a stair-lift or a level access shower.

However, should you wish to carry out adaptations

privately or are eligible for a grant but would like some support managing it, for example someone to source builders/oversee the work, they can do this for you, but they will charge a fee.

Handyperson service As finding someone to do small jobs can be difficult, Medequip provides a handyperson service. The service can help with small jobs such as replacing a tap washer, tacking down loose carpeting to prevent trips, or installing a grab rail to assist you up a step. You can access this service whether you live in your own home or in rented accommodation.

There is a charge for this service, but if you receive low

income benefits you may be entitled to the labour costs free of charge up to a certain amount, but there is always a charge for materials.

Care in your own home If you are finding it difficult to manage with everyday tasks you could consider using the services of a care and support or domiciliary care provider. These service provider companies employ staff who can help you with bathing, washing and dressing, as well as practical support with shopping, laundry and cooking meals.

Staff will be trained in personal care and safety procedures, moving and handling, hygiene, infection control and first aid. If you need nursing care at home, many of these care providers employ registered nurses.

These companies can also help with shopping, cleaning and preparing your house for you after a stay in hospital.

Agencies providing care at home are monitored by the Care Quality Commission (CQC) which regularly inspects agencies and produces reports on their findings which can be found on the CQC’s website: www.cqc.org.uk/ See page 41 for more information on the CQC. Supporting you to live independently in your own home underpins the Council’s Help to Live at Home (HTLAH) programme. Wiltshire Council has commissioned

four care providers: Somerset Care at home, Leonard Cheshire Disability, Mears Care Ltd and MiHomecare to deliver services developed by local people, care providers and front-line staff. This ensures that the services it provides are focused on what you need and want.

Domiciliary care agencies – some things to consider: • What experience does the agency have in your particular field of need? Can they supply references for you to check?

• How many carers would the agency assign to care for you and would you see the same one every day? If not, how does the staff rota operate and what happens if your carer goes on holiday or is sick? Will you be notified in advance that a different carer will be attending?

• If you’re not happy, how easy is it to make a complaint?

• Home care agencies providing personal care, must be registered and inspected by the Care Quality Commission. Ask to see a copy of their registration certificate.

• If this is a private contract, ask for a copy of the agency’s contract terms and read these carefully with someone you trust. Get as much help as you can going over it and ask any questions you may have before signing anything.

This could be because they are ill, frail, or disabled, or have mental health or substance misuse issues. Anyone can become a carer. People with mental health conditions The initial point of contact if you are experiencing mental health difficulties is usually your GP. Your GP can initiate and maintain your treatment, and/or signpost you to other groups/organisations which can help you, including primary care psychology, otherwise known as LIFT. LIFT offers a variety of services for people who are experiencing anxiety/depression or are looking to improve their wellbeing. The psychological care interventions include psycho-educational courses, selfhelp materials, online computer packages and individual sessions.

Your GP may want to seek more specialist input and refer you to Avon and Wiltshire Mental Health Partnership NHS Trust (AWP). AWP can provide advice to your GP or refer you onto specialist mental health services which can help you to find the best way to recover and stay well, based on your individual need.

Working alongside AWP there are two specialist mental health social work teams in adult social care (Wiltshire Council) who provide support for adults with severe and enduring mental health conditions. The teams are based in the north (Monkton Park, Chippenham) and south (Fountain Way, Salisbury) of the county. The teams are responsible for completing assessments when packages of support, supported living or residential/nursing home placements are required. They work very closely with housing providers and other local organisations/voluntary sector groups who can assist with employment and

vocational activity.

The mental health social work team is also responsible for co-ordinating assessments under the Mental Health Act 1983 (amended 2007).

Dementia care If you are worried that you or someone you know may have dementia, it is important that you talk to your GP as soon as possible. They will be able to rule out any other illnesses or conditions that may have similar symptoms to dementia, including depression and infections.

Once your GP has checked for any easily treatable causes, they will then be able to talk to you about having an assessment. They can then request a specialist assessment from the memory service if necessary. The memory service is for people who are concerned about their memory and think it is affecting their day-to-day life. An assessor will talk with you about your memory difficulties, complete some further checks and discuss the impact of any problems or issues.

The memory service encourages the person with memory issues to take someone, such as a family member, with them so that everyone can be involved where appropriate.

Residential dementia care checklist

The implications of a diagnosis will be discussed, with information and advice being given, and there will be the opportunity to discuss any possible medication and support that may help the person to manage the situation.

Sometimes getting a diagnosis can take time, but this should not put you off.

If you do not feel confident about talking to your GP, there are local charities you can talk to. Alzheimer’s Support and Alzheimer’s Society have a Dementia Adviser Service that offers personalised information and signposting for people with dementia and their carers – see page 52 for contact details.

This offers a list of things to look for in care homes specialising in dementia. Please use it in conjunction with the care homes checklist on page 42.

RESIDENTS The best indication of a good home is that the residents appear happy and responsive.

ACTIVITIES Residents should be stimulated without feeling stressed.

 Are there rummage boxes around the home to stimulate residents?

 Are residents able to compile memory boxes?

 Are residents taking part in activities?  Are residents talking to each other, staff and visitors?  Do residents look well dressed and groomed?  Do residents get to choose their clothes every day?  Are people supported to stay independent and do things for themselves e.g. getting dressed, making food etc.?

ACCESS If the person with dementia needs, or is likely to need, equipment or adaptations you may want to check that:  there are adequate signs and cues for different parts of the home such as dining room and bathroom.  the home has a policy about locking external doors.

BEDROOMS You may want to find out whether the person with dementia can have a single room and whether residents are encouraged to bring in some of their own furniture and possessions to increase familiarity.

 Are reminiscence activities available?  Do staff compile life story books, including photographs and mementoes?

STAFF It is important to note whether staff seem friendly and caring towards residents and whether they treat residents with respect.  Do they have any training and experience in dementia care?  Will the person with dementia have a member of staff particularly responsible for their care?  Is there a member of staff you can talk to about your own worries about the person with dementia?

MANAGER/HEAD OF HOME A manager who is caring as well as efficient can make all the difference to a home.  Does the manager have a knowledge of dementia and can they deal with difficulties that may arise in an understanding way?  Is there a full assessment at home before a resident is admitted?

Accommodation Wiltshire Council’s Shared Lives Scheme This service provides long-term accommodation, shortterm stays, respite and day activities to: • people with a learning disability; • people with a mental health difficulty; • older people; and • p eople with physical disabilities, head injury or sensory impairments.

The service is provided in the households of approved Shared Lives carers who offer support or care as required by the person placed with them.

Once a person has been referred to the service, usually by their care management team, the Council matches them with a Shared Lives carer who has a vacancy. A

series of introductions is arranged to help them get to know each other before deciding whether or not to set up a Shared Lives arrangement. The team then monitors each arrangement to help ensure that it is an enjoyable and fulfilling experience for all concerned.

You pay rent to your landlord for your home and service charges to your landlord for utilities and maintenance of the scheme in which you live. Your service charge includes the provision of an alarm service to access help 24 hours a day, seven days a week.

Sheltered housing can be rented or owner-occupied accommodation.

Extra care housing Extra care housing is for people who want to live independently but who may be finding it difficult to manage in their current home.

Extra care is being developed in Wiltshire so that people have more choice about where they receive their care. It means that people who need extra support have an alternative to receiving that support in a residential care home. This can be especially important to couples who want to be able to stay together even if their care needs increase.

There are a number of different types of extra care housing schemes. Properties can be rented or bought and, if the property is rented, the rent is usually covered by housing benefit.

Staff are available 24 hours a day. This means that, as well as being able to get care and support during the day, help can be available at night and there is always someone on duty in case of emergencies.

Extra care housing may also have a café or meal provision, other facilities, such as a hairdresser, and social activities taking place on-site on a regular basis.

Applications are usually considered from people who are aged 55 or over, have a need for care and have a local connection to Wiltshire.

Residential care There are two types of residential home: Care homes (personal care only) Residential care homes cater for people over the age of 65 who have no nursing needs but who may require help with personal care tasks. Personal care includes bathing, feeding, dressing and help with moving but it must be paid for if your capital/savings exceed £23,250. See page 43 for more information.

Care homes with nursing If a care home providing nursing care is the best solution for you, your social care worker will give you information to

help you find a home that meets your care requirements.

The cost of the nursing care part of your fees is paid by the NHS to the home. The current amount is £112.00 per week.

If you think you may need nursing care in a home, and will require financial assistance from the Council to pay the fees, you will need to be visited by a social worker or a customer co-ordinator to determine what care you will need. This might be in your own home, or in hospital, or in a care home. You will be fully involved in planning your care needs.

Its focus is: ‘what makes life good in care homes now, what could make them better and how might we get there?’.

Over the past four years the Council has supported more than 30 care home managers to participate in the Leadership Support Programme, which gives the skills to integrate the bestpractice themes detailed below into the day-to-day culture of their care home.

My Home Life identifies eight key themes that focus on what best-practice in care homes for older people looks like in the 21st century.

These eight themes provide a good starting point for conversations with care homes when making decisions.

Inspecting and regulating care services All care providers must be registered under a system which brings adult social care, independent healthcare and the NHS under a single set of essential standards of quality and safety.

The Care Quality Commission (CQC) registers, inspects and reviews all adult social care and healthcare services in England in the public, private and voluntary sectors. This includes care homes, care homes with nursing, home care agencies and NHS services, amongst others.

Inspectors carry out a mixture of announced and unannounced inspections looking at the quality and safety of the care provided. They look at whether the service is: Safe, Effective, Caring, Responsive to people’s needs and Well-led.

Inspection teams are led by an experienced CQC manager and often include experts in their field. The team may also include professional or clinical staff; Experts by Experience; people who use services and carers.

Following an inspection, each care home and home care agency is given a report of how it rates against national essential standards of quality and safety. The CQC

has also started rating services as Outstanding, Good, Requires Improvement and Inadequate. By March 2016, the CQC expects to have rated every adult social care service in England.

Paying for care The information here has been developed by a group of public organisations and charities to help people make better and more informed decisions about paying for care, and to encourage people to get information and advice about the use of their money in this regard.

Before you think about the likely costs of any care and support, it is important that you get information and advice about the options open to you, both regarding the type of service that might suit you, and also whether the Council might contribute to the costs. The authority will help you to identify services and resources within your community that will help you to live at home. It will also conduct a financial assessment to see whether you are eligible for any services that are funded by the Council.

The following is intended to help you get information and advice on your personal finances and how to pay for care if you:

• are planning for retirement; • are an older person considering getting help with care and support for yourself; • have a need to fund care immediately; • are a family member, a carer or have Power of Attorney or deputyship of somebody needing to fund their care; • have a child with disabilities and want to ensure they have financial security after you die; or • are disabled and want to plan your financial future to make the best use of compensation payments, or if you think your ability to work and support yourself financially may lessen over time.

If you need nursing care you may be entitled to funding from the NHS for all or part of the cost; you should ask your local Council, your hospital or GP whether you might be entitled to this.

Financial assessments There are different ways to pay for long-term care. If you need care and support immediately or in the near future, first check with the Council about any support it gives by requesting an assessment.

If you have eligible needs and you want help to pay towards the cost of services, the Council will assess your income and capital. The value of your home is not included in your assessment unless you are moving into residential care.

If you have capital or savings of more than £23,250 you will have to pay for any care services you require, but you are still entitled to discuss your needs with someone at Wiltshire Council who is trained to advise you.

If you have capital or savings of less than £23,250 you may be entitled to funding from the Council.

After your assessment, you will also be able to get help with information about the choices you have for meeting your care needs and how to arrange care, even if you are not eligible for funded support from the Council. Many people wrongly assume that they will need residential care when there may be options available to stay at home and access existing community resources.

If you don’t qualify for financial help from the Council, you will normally have to pay the cost of care out of your own income and savings. For further information about options please visit: www.yourcareyoursupportwiltshire.org.uk or see ‘How Wiltshire Council can help’ on page 45.

Your local authority, your GP or other NHS services may also offer you help to try to regain your independence

through the use of equipment or adaptations to your home, or through programmes of rehabilitation. For more information see page 12 or call a customer adviser on: 0300 456 0111.

You should check what benefits you are entitled to. Not all benefits are means-tested and you may qualify for Disability Living Allowance (DLA) or Personal Independence Payments (PIP) if you are under 65, or Attendance Allowance (AA) if you are over 65. AA/PIP/DLA (care component) cannot normally be paid if the Council or the NHS is funding your care in a care home.

It is important to make sure you find out as much as possible before making care funding decisions.

Personal budgets A personal budget is the amount of money allocated to someone to pay for the care and support they need due to disability, frailty or vulnerability. Everyone who is eligible for funded social care will be given a personal budget once their needs are agreed. The value of your personal budget will be based on your eligible needs and your support plan.

You can choose to have your personal budget managed by the Council, or you can choose to manage it yourself through a direct payment. You can also decide to have some support managed by the Council and some by yourself.

Direct payments If you have been assessed as needing care and support services and choose to take at least some of your personal budget as a direct payment, either with or without assistance, you will receive a payment to organise and buy services yourself. If you are not able to manage the direct payment then an authorised or nominated person may be able to manage it on your behalf.

An authorised person is anyone who agrees to manage a direct payment on behalf of a person with care needs.

An authorised person is someone who agrees to manage a direct payment for a person who lacks capacity, according to the Mental Capacity Act 2005. A nominated/ authorised person must have the capacity to manage the direct payment and be deemed appropriate by the local authority.

Direct payments can be used to arrange support designed to meet your needs in a way that makes sense to you. The Council will agree these needs with you and write them into your support plan.

Direct payments should be used to pay for the support you require to meet the eligible needs identified in your assessment.

You can choose to use your direct payment to buy care from an agency or employ your own personal assistant.

You could also decide to pool your direct payment with other people and choose support options you may not have been able to afford by yourself.

If you are a carer, you may be able to get a direct payment to pay for support or services which will help you to carry on caring, although you cannot use the payment to support the person you care for.

Direct payments cannot be used for: • health services; • permanent care in a care home or care home with nursing; or • services which are managed by the Council - such as its in-house day care service.

The amount of money you receive depends on the level of your needs and the support you require to live in your own home, taking into account what it would cost if the Council provided the services instead.

Unless you are a carer, you will usually have to pay a contribution towards your personal budget. Contributions will be based on a full financial and benefits assessment which will identify how much of your disposable income you will need to contribute towards care services. Most services are means-tested and you will need to fund all of your care if you have assets above the maximum threshold set by Government.

How Wiltshire Council can help If you need to move into a care home and you are not eligible for funding from the Council, you may be entitled to some of the following financial assistance and support: Twelve-week property disregard If your former home is included in your financial assessment, but your other capital/savings is less than £23,250, and your income is not enough to meet your care home fees, the Council may assist with the cost during the first twelve weeks of permanent care if it agrees that care is needed.

Deferred payment agreements After the twelve-week property disregard period, any financial help from the Council will be in the form of a charge placed against the value of your home which is then recovered once your house has been sold or after you pass away. However, the Council may limit how much it will pay and it may affect your entitlement to pension credit or income support if your property is not seen to be on the market, as it will be treated as capital by the Department of Work and Pensions (DWP).

Attendance Allowance/Disability Living Allowance (care component) These are non-means tested, non-taxable benefits from the DWP paid at the lower rate of £55.10 per week for those needing care by day or night, and at the higher rate of £82.30 per week for those needing care both during the day and night. Everyone in these circumstances can, and should, claim this benefit. This benefit will not be paid if your care home is funded by the Council, but can be, if the financial help provided by the Council is a ‘loan’ pending the sale of a property.

In April 2013, Disability Living Allowance for disabled people aged 16 to 64 was replaced by Personal Independence Payments. How much you’ll get depends on how your health condition or disability affects you. For further information, visit www.gov.uk/pip NHS continuing healthcare NHS continuing healthcare is the name given to a package of care which is arranged and funded solely by the NHS for individuals outside of hospital who have ongoing health care needs. You can receive NHS continuing healthcare in any setting, including your own home or in a care home. NHS continuing healthcare is free, unlike support provided by local authorities for which a financial charge may be made depending on your income and savings.

If you are found to be eligible for NHS continuing healthcare in your own home, this means that the NHS

will pay for healthcare (e.g. services from a community nurse or specialist therapist) and associated social care needs (e.g. personal care and domestic tasks, help with bathing, dressing, food preparation and shopping). In a care home, the NHS also pays for your care home fees, including board and accommodation.

Anyone over 18 years of age assessed as having a certain level of healthcare needs may be entitled to NHS continuing healthcare.

Running out of money If your capital/savings are likely to reduce to £23,250, you must let the Council know at least two months in advance as it will step in to help with your care fees. An assessment of your situation must be conducted and normally a contribution towards your care costs will be made. If the home you have chosen charges more than is considered appropriate, you will need to find someone to help pay the difference – a ‘top up’ payment. Whoever does this, whether family or a benevolent charity, they should realise that they may have to pay this for some time.

Alternatively, you would have to find a cheaper home, although before this happens the Council will undertake a risk assessment to confirm that you are fit enough to move.

Seeking financial advice Later-life advisers Advisers specialise in the financial needs of older people. Those advisers who have taken steps to become independently accredited can offer added reassurance that they offer the practical help and guidance needed to make the right decisions at the right time.

There are three main ways of paying for advice: • f ees – by paying the adviser a fee, either at an hourly rate or a set fee; • c ommission – by paying indirectly through commission, which is deducted by the product provider from the product(s) you invest in. As well as the initial commission charged when the product is taken out, there may be annual commissions, known as ‘trail commissions’; and • f ees and commission – by paying a combination of fees and commission.

Not all advisers offer all three payment options. Make sure the adviser you choose offers the payment option that you want. Ask the adviser to explain what you’re paying for, how much it will cost and how you will pay for it. If you want to pay by commission, ask your adviser how this will be calculated and whether this has any effect on the advice you will be given. Make sure you understand and are comfortable with the payment arrangements before proceeding. If you’re getting investment advice, ask your adviser if the costs include a review of your investments from time to time or if you must pay for that service separately.

Essential information Keeping people safe Wiltshire Council and its partner agencies expect health and social care services to work in a way that respects people’s dignity, independence, choice and safety and to have a zero tolerance of abuse.

The Council and its partner agencies recognise that people can be abused physically, psychologically, financially, sexually, be discriminated against or neglected.

This abuse can take place where a person lives, within a care home or day service, in hospital, in custodial situations, in a place where support services are being provided, or in a public place.

It can be carried out by partners, relatives, friends, volunteers or someone employed to provide a health, housing or social care service.

All organisations providing health, housing and social care services in Wiltshire should follow the Policy and Procedures for Safeguarding Vulnerable Adults in Swindon and Wiltshire (2007) and report any allegations or suspicions that a vulnerable person is being abused.

How solicitors can help A solicitor can give you impartial advice about wills, making gifts, estate planning and Powers of Attorney (PoA). Some can also offer guidance on immediate and long-term care plans, ensuring (if applicable) the NHS has made the correct contribution to your fees.

Lasting Powers of Attorney (LPoA) allow you to appoint someone you trust to make decisions about your personal welfare, including healthcare and consent to medical treatment, and/or your property and financial affairs. A LPoA is only valid once registered with the Office of the Public Guardian. It allows for a person of your choice to make decisions on your behalf at a time when you may be unable.

The Court of Protection can issue Orders directing the management of a person’s property and financial affairs if they are incapable of managing their own affairs should they not have a LPoA. The Court procedure is presently very slow and the fees are quite expensive so preparing a LPoA is always advisable, providing you have somebody sufficiently trustworthy to appoint as your attorney.

An ‘advance directive’ allows you to communicate your wishes in respect of future medical treatment, but it is not legally binding. You may instead wish to make a living will, properly known as an ‘advance decision’, setting out

treatment that you do not want to receive in specified circumstances, which would legally have to be followed, even if you die as a result.

Any proposed ‘Gift’ out of your estate needs careful consideration of the benefits, risks and implications, particularly on any future liability for care costs or tax liability.

If you don’t have your own solicitor, ask family or friends for their recommendations. Contact several firms, explain your situation and ask for an estimate of cost and an idea of timescales involved. Many firms will make home visits if necessary and will adapt their communications to meet your needs. It’s important to find a solicitor who specialises in this area of the law. The Citizens Advice Bureau offers an advice service and will be able to recommend solicitors in your area. See page 52 for contact details.

Complaints, compliments and feedback If you receive care at home or in a care home you should feel able to comment on or complain about any aspect of your life there which affects your happiness or comfort.

This might be anything from the way you are treated by the staff to the quality of the food you are served. You should also feel free to make comments and suggestions about possible improvements to your surroundings and the services provided and compliment staff when things go well.

Making a complaint should not be made difficult for you and should not affect the standard of care that you receive. Care homes are required under government regulations to have a simple and easy-to-use complaints procedure.

If you are concerned about the care that you, a friend or a relative are receiving in a residential home, it makes sense to speak to the manager of the home about your concerns before you take any further action. The problem may be resolved quite easily once they are made aware of it. However, if you need to make a formal complaint, you should initially contact the registered owners of the home.

They have a duty to respond to any complaints made.

Care Associations in Wiltshire The Wiltshire Care Association The Wiltshire Care Association (WCA) was formed in 1984 by care home owners who were determined to set and maintain standards of care and accommodation in their homes, well above the standards set by legislation in force at that time. Its memberships are now drawn from all sectors that provide all levels of care mainly for elderly persons from Wiltshire and other counties.

WCA gives active support to its membership, advising them on statutory matters such as government regulations, the Disclosure and Barring Service (DBS) checks and assisting in staff training and other activities to promote the provision of quality services.

Association members, through their elected committee nominees, liaise, meet and discuss care related matters with the Care Quality Commission, Social Services Care Managers, Local Authority Officers, Wiltshire Council, Primary Care Trust Officers, Vulnerable Adults Units and other caring agencies within the county, talking to them about their first-hand experience on the frailties of some

procedures and legislative interpretations. Committee members regularly sit on committees and meetings that plan, monitor, contract and pay for care.

WCA is affiliated to the National Care Association which enables members to have their opinions and experiences discussed and brought to the notice of central Government agencies and committees and also keeps all members fully up-to-date on a wide variety of care topics through the six-weekly newsletters.

The last few years have brought an incredible amount of changes to our routines, legislation, training requirements, standards, trading conditions and administration of our homes. Undoubtedly, there are more changes on the horizon.

Membership keeps members informed, up-to-date and prepared for the changes ahead.

Care homes are subject to statutory inspection by the Care Quality Commission. All members must, in addition to this, fulfil the stringent criteria of the Registered Nursing Home Association.

The Wiltshire Care Partnership A dedicated service for independent providers of care in Wiltshire Wiltshire Care Partnership (WCP) is a member-led organisation. Our role is to represent and support independent providers of residential, nursing and domiciliary care for older people and adults with disabilities in Wiltshire, working alongside commissioners to achieve the provision of high quality, safe services.

WCP provides a valuable channel of communication, facilitating the exchange of information and ideas and the sharing of best practice amongst our members. WCP acts as a voice for care providers and makes sure that their skills and expertise are used effectively to achieve the best outcomes.

Membership of WCP is open to all independent sector registered providers of residential, nursing and domiciliary care for older people and adults with disabilities. Our members currently provide more than 60% of all older people’s residential and nursing care in the county, and we have also been joined by a significant number of Wiltshire’s domiciliary care providers.

Key benefits of membership include: • Monthly e-bulletin with key local, national and members’ news, information, and links to events, training and publications.

• Quarterly Forum meetings exclusively for members,

focused on issues of importance to providers, and invitations to future WCP events and conferences (free or at discount to members).

• Voting power to elect the WCP Board and influence the annual work programme.

www.wdcpa.co.uk The Wiltshire Domiciliary Care Providers Association (WDCPA) was formed in 2004 to bring together registered domiciliary care providers in Wiltshire.

All our member organisations, who between them cover the whole of Wiltshire, account for thousands of hours of care each week. Our members are made up of both small and large providers, all providing high quality care and support to individuals in their own homes.

The introduction of direct payments means that individuals now have total choice in who provides their care and support. All WDCPA member organisations can assist you in putting a plan together to make the best use of funds available. Services on offer range from a short visit of 15 minutes to 24 hour live-in care.

Caring for our elderly Bassett House is a luxury care home providing accommodation for frail older people together with a specialist unit for older people with dementia.
