Information, advice and support services Most of us would like to live independently in our own homes for as long as we can. There are many different services to help you do this. They are provided by a range of organisations, including district councils, voluntary groups, private care agencies, the NHS and Hertfordshire County Council.

With so many care services to choose from, it can be difficult sometimes to decide which is the most appropriate for you. We hope this Directory is just one of a number of tools to help you decide what is best for you.

Since its launch last year, HertsHelp has helped thousands of people across Hertfordshire.

One of the first of its kind in the country, HertsHelp is a free and confidential information service offering help to all ages. It provides a single route into the wide range of expertise, support and resources offered by a network of organisations across the county.

The experienced HertsHelp advisers can put people in touch with the right organisation to help them quickly and easily, possibly saving lots of time and energy that might otherwise be spent on a long and unnecessary search. So, whether you are a carer who needs some support or a professional trying to find the right care solution for a client, HertsHelp can help you.

A client called HertsHelp as she was concerned about her two elderly in-laws, both in their 80s, who provide care for their cousin, Frances.

Frances lives alone and needs to be given medication regularly and the client felt that her in-laws were struggling to cope. The client wasn’t aware of any support that either the elderly couple or Frances were getting from social services and also felt that all of them required greater financial support.

Services developed in partnership with the voluntary sector Health and Community Services works with and funds voluntary and community organisations to supply preventative care services. These are a vital form of support for many thousands of vulnerable people across the county and help to maintain independence, social inclusion, and delay or avoid the need for more statutory interventions.

Helping you to stay independent Hertfordshire Enablement Run in partnership with Goldsborough Homecare, Hertfordshire Enablement service aims to deliver benefits to older people with physical and/or mental health problems by helping people to live as independently as possible, preferably in their own home. This could be achieved through home care, home adaptations, Telecare or with information and advice about the range of support services available.

Enablement beds in community settings will be provided for anyone who might not be able to manage living at home.

Anyone who has been referred to adult social care services for ongoing support – for example from a hospital or a specialist mental health team, or through the council’s customer service centre – and who meets Health and Community Services’

eligibility criteria will go through enablement unless they are de-selected by the council. This will only be the case if it is believed that the person will not benefit from the service. It is expected that 80 per cent of new referrals will go through the service.

Within 24 hours of being referred, Health and Community Services aim to have a package in place for people which will help them stay independent by learning and/or re-learning the skills required for daily living.

The service is free at the point of delivery for up to six weeks, after which time it is expected that many people will have reduced or no care needs in the future.

Equipment There is a range of equipment available to make life easier and to improve safety and independence in the home, such as stair rails, raised toilet seats, shower stools etc. These simple items are often referred to as ‘Simple Aids for Daily Living’. Health and Community Services works closely with voluntary organisations such as Hertfordshire Hearing and Advisory Service, Hertfordshire Society for the Blind and Hertfordshire Action on Disability (HAD). These organisations can also give advice and information about equipment and may offer help with ordering or run a hire or loan scheme.

HAD has a permanent display of specialist equipment where you can try different pieces of equipment and it also runs a wheelchair accessible transport service.

Community alarms and telecare If you are worried about getting help after falling, you may want to get a community alarm installed.

The alarm can be worn on your wrist or as a pendant.

Just pressing a button will alert staff at a response centre who can contact your family or a friend or call an ambulance. Some services can even send someone out to help you. Contact your local district or borough council to discuss community alarms in your area.

Telecare is a range of automatic sensors which

can be provided to people who require more than a pendant alarm. These sensors raise an alert at the response centre without the person needing to push their pendant button. The range of sensors include fall detectors, smoke alarms, flood detectors, bed sensors which can report if someone has got out of bed in the night and not returned. If you feel that you would benefit from telecare, please contact Health and Community Services for more information.

Day care services These offer the chance to meet other people outside your home, share activities and have a meal. It is possible to have help getting to and from the day care centre. You can only attend some of the day centres

if you have been assessed by Health and Community Services as needing the service and meet eligibility criteria. There are other opportunities such as luncheon clubs and community cafes that are open to all.

Day care services continued The range of support includes: • looking after very frail or mentally infirm older people • providing social activities and companionship for older people • helping people with physical disabilities to regain their skills and manage daily living • helping people with learning disabilities to develop their abilities • helping people with mental health problems to

regain their confidence and manage everyday life • providing day-time care for very frail and severely disabled people so that their main carers can take a break.

Day care services target those in greatest need and also provide support to carers.

If you are eligible, you may be able to have a direct payment to arrange your own services (please see below for further information about direct payments).

Personalisation ‘Personalisation’ is a term used to describe the ability to tailor a range of support services to meet an individual’s specific care needs and it is at the heart of the Government’s drive to transform social care.

Personalisation means that every person who receives support, whether from statutory services or funded by themselves, will be empowered to shape

their own lives and the services they receive in all care settings, including their own homes.

Independent living is one of the goals of personalisation. It does not mean living on your own or doing things alone, but rather it means having choice and control over the assistance and/or equipment needed to go about your daily life.

Personal budgets A central part of the personalisation agenda, personal budgets are an amount of money councils can allocate to help people who due to disability, frailty or vulnerability, get the support they want.

Councils will be working in a different way, in order to give people who use services more choice and control over how money they are entitled to is spent.

Direct payments You must be assessed by Adult Social Care to see if you eligible for services (or direct payments to buy them). If you are, you may be able to receive a direct payment to organise your own care. A direct payment could cover all or part of your care needs. A direct payment is money from a council’s social services department to cover a specific assessed need.

A direct payment must cover a specific assessed need and can be used, for example, for: • employing a personal assistant to help with care needs • employing a home care worker • employing a live-in care-worker • short stays in a care home for no more than 4 weeks • day care

• equipment to meet your care needs that would be provided by the council • or other services or items that would meet your assessed need.

Direct payments are intended to support adults in independent living, so you cannot use them to pay for permanent accommodation in a care home or care home with nursing.

If you are applying for services for the first time, your social worker should discuss the direct payments option with you when they assess your care needs.

Direct payments are paid straight into your bank, building society, Post Office or National Savings account.

Individual Service Funds (ISFs) An ISF is used when someone’s personal budget (or a proportion of that budget) is lodged with a chosen

provider on their behalf. The individual remains in ultimate control of how their money is spent.

What care services are available?

Coming out of hospital If you have been referred to adult social care services by the hospital, and you meet Health and Community Services’ eligibility criteria, you will go through Health and Community Services’ enablement service. This aims to deliver benefits to older people with physical and/or mental health problems by helping people to live as independently as possible, preferably in their own home. For more information on the Hertfordshire Enablement service please see page 6.

Intermediate care – both residential and community-based – aims to give recovery and rehabilitation support to help older people regain their independence when they come out of hospital or, just as importantly, prevent them going unnecessarily into hospital. Reducing the strain on hospitals and their therapy resources, intermediate care means older people will not have to move into

residential care (at least in the short term) or stay longer than desirable in hospital.

When it is provided through a residential service it includes care staff, occupational therapy and physiotherapy, additional support provided by the local GP surgery, social workers and community nurses. This combined resource helps older people to regain their independence so that they can move back into their own home, feeling confident in their ability to manage for themselves with any necessary additional support.

Intermediate care, including care home fees, provided by the NHS, is free. It can be provided in your own home or in a care home and is usually limited to a maximum of six weeks. Age UK Hertfordshire offers a hospital discharge support service which provides practical and emotional support. Contact details are on page 29.

Care in your own home Home care can be arranged following an assessment

by Health and Community Services to help with personal care, such as bathing, dressing and some domestic tasks. This can also be specialised, for example home care aimed at people with dementia.

All home care providers must be registered with the Care Quality Commission (CQC) who inspect agencies against the regulations and essential standards of quality and safety. The CQC regulates and inspects all care homes in the UK. Up to date information about approved home care providers is available on www.herstdirect.org.

You may wish to arrange your own care at home.

Ask your care manager about the possibility of receiving a direct payment (see page 8). You will still need to have an assessment of your needs, but then you can decide whether you would prefer to arrange the services yourself.

Home adaptations and improvements may be needed to make life easier. This may include simple adjustments or more major changes, such as installing a hoist over the bath, or making a home suitable for wheelchair access. The council may support you to make these changes if you need the adaptation to maintain independence. For major adaptations you will need an assessment by a Health and Community Services occupational therapist.

It is possible for a choice of meals to be delivered to your home if you are having difficulty in cooking for yourself. Special diets and diets based on your culture can be catered for. Frozen meals can be provided, so that you can defrost, heat and eat when you wish. This is also known as ‘meals on wheels’. Contact Health and Community Services or your district or borough council for more information.

Home care agency checklist These questions may be useful when considering using the services of a home care (domiciliary) provider to help you build up a picture of how your care needs will be met in your own home.

For care packages which have been arranged by Health and Community Services, contracts and care plans will have been completed by your care manager and the agencies used will have been accredited to work for Health and Community Services.

People arranging and funding their own care either privately or through a direct payment or a personal budget are able to choose their own worker or care agency.

Agencies  What experience does the agency have in your particular field of need?

Can they supply references for you to check?  Home care agencies providing personal care, must be registered and inspected by the Care Quality Commission. Ask to see a copy of their registration certificate.  How long has the agency been operating?  How many carers would the agency assign to care for you and would you see the same one every day? If not, how does the staff rota operate and what happens if your carer goes on holiday or is sick, will you be notified in advance that a different carer will be attending?  How can you contact the agency in an emergency or outside office hours?

 How hard or easy would it be to make a complaint and how are things then put right?  If this is a private contract ask for a copy of the agency’s contract terms and read these carefully with someone you trust. Get as much help as you can going over it and ask any questions you may have before signing anything. The Citizens Advice Bureau or Age Concern (now called Age UK in some areas) could help with this.

Carers  You should expect your personal preferences, dignity and privacy to be respected. Discuss this with the agency and ask how the most suitable carers for your particular care are chosen. Can you talk to them before deciding?  Carers should be fully trained or be in ongoing training. Ask the agency about their policies on this.  You will have a care plan drawn up by the agency which the carers will work to. Ask how often this plan will be reviewed by the agency.  Carers must be checked with the Criminal Records Bureau (CRB) and have a criminal records disclosure – make sure this is the case.

Paying  If your care needs do not meet Health and Community Services’ eligibility criteria and have been arranged privately you should check carefully the fee rates charged and exactly what the payment you make covers.

Support for carers If you are a carer or are being cared for by another person, and are eligible, Health and Community Services may be able to help you to have a short break. This could mean someone coming in to your home to take over the support of the person you care for in the home for a limited period, or a short stay being organised in a care home.

If you are a family carer, looking after your spouse, partner, parent, friend or relative, you may be entitled to assistance from social services.

Ask Health and Community Services for a Carer’s Assessment and, depending on the type and level of support you give to the person you are caring for, their needs as an individual and your needs; you may get extra support.

As part of your Carer’s Assessment we will give you an emergency card with a unique number so if you physically can’t tell us or anyone else what needs to happen, or are too distressed to remember, we can still find all the details you have given us previously.

Hopefully having this card will give you peace of mind. That emergency may never happen, but if it does we can get hold of the people you want to help you, when you really need them.

Moving and handling the person you are caring for may be physically difficult for you; it should be done correctly to prevent injury to either yourself or the person you are caring for. Carers in Hertfordshire offer back awareness training for carers. Health and Community Services has produced a back awareness DVD aimed at carers.

It is a flexible and stress-free way to book a break from your caring responsibilities. Using the web and a mobile phone, you can arrange care cover without having to handle money or deal with paperwork.

The service can be accessed by people who purchase care privately as well as those who receive support from the local authority. To start you must login using a username and password you can easily create online. You then choose a time you want to book a care worker. The system shows a list of care workers in your area who are available at that time.

You can also click on each care worker’s profile and read about them. You then request the one you have chosen. The system automatically sends a text to the care worker who will confirm the booking by text.

‘Breakaway for Carers’ This is a free service which enables people who look after a dependent adult to have a break by arranging for a volunteer to take over for a few hours.

‘Breakaway for Carers’ volunteers provide companionship for older or disabled people while you go shopping, enjoy time with friends or family or have a couple of hours to yourself. They are fully trained and vetted by Health and Community Services and have experience of looking after older

Support for carers continued or disabled people or people who are confused or have dementia.

Volunteers do not undertake personal care, although they will escort people to and from the toilet. They are not able to do any lifting or housework, but will make snacks and drinks.

Continuing care This is the name given to the care needed by an adult who requires continuing help to manage their daily life because of illness, disability or an accident.

Continuing NHS healthcare is provided if you have extensive healthcare needs. This is free of charge.

A National Framework has been drawn up by the government that sets out the level of need that decides if someone is eligible for Continuing NHS healthcare.

You can ask for an assessment by health and social care professionals if you think you may be eligible for either continuing NHS healthcare or continuing NHS health and social care. They will visit to discuss with you how your needs might be best met.

Your support will be reviewed after three months and then once a year, but if your needs change, your care and/or funding arrangements will change to meet them.

Housing with care Flexicare housing in Hertfordshire (extra care) Flexicare housing is Hertfordshire’s version of extra care, schemes where people rent their own flat, but have access to care and support as and when they need it over 24 hours a day.

Because it meets a wide range of needs, Flexicare is a positive choice for people with a range of needs, from those starting to need a little help with physical or memory problems, to those who are seeking an alternative to residential care.

Tenants are assessed by Hertfordshire County Council for their ability to contribute to costs, so these are in line with cost for home care, and for those with higher needs they are considerably less than residential care.

Because care is available 24 hours a day flexicare can relieve a lot of stress for family carers and tenants - even if you don’t need regular care it can be reassuring to know that someone is there if you fall, or feel ill or unsafe. The level of care and support provided can be changed if your needs change, for example, if you need some extra support after a hospital stay. Flexicare housing is also ideal for couples who have different care needs.

A flat or bungalow in a flexicare housing scheme

will have up to two bedrooms and many are spacious enough for wheelchair users. There are also communal facilities and social activities.

Flexicare housing may suit you if you: • are finding it hard to cope in your existing accommodation; • are already receiving home care services; • have unpredictable care needs; or • have few care needs now but want to prepare for the future.

Sheltered (or retirement) housing This housing is designed to provide independence within a secure and friendly environment. The scheme manager is a source of support and flats are designed to meet the needs of older people. Several housing associations manage schemes in the county.

In a sheltered (or retirement) housing scheme you would live independently in a flat or bungalow built

especially for older people within a larger complex, sometimes around a garden or communal facility and linked to a central control centre for security.

After your needs have been assessed, you will still be able to receive care in the home if required.

Care homes and specialist services All care providers in the country must be registered with the Care Quality Commission (CQC). All services are inspected by the CQC which reports on its findings. When selecting a care home or home care agency it is essential to discuss the type of care they provide and whether they can meet

the specific care needs of the individual. The CQC website is a valuable source when choosing a care organisation and will list past inspection reports (visit www.cqc.org.uk).

Types of care home There are two types of care home: Care homes offering personal care only Subject to a needs assessment and meeting eligibility criteria, a care home offering only personal care may be the best option if your needs cannot be met in the

community. Personal care includes bathing, feeding, dressing and help with moving and must be paid for if your capital/savings exceed £23,250.

You will be fully involved in planning your care needs.

If a care home providing nursing care is the best solution, you will be given information to help find a home which meets your care requirements. The cost of the nursing care part of your fees is paid by the NHS to the home directly. However, personal

care is chargeable. You can contact the Nurse Care Management Teams for your area at your local Primary Care Trust (PCT).

You may be eligible for continuing healthcare funding if you have extensive and ongoing nursing needs. Your assessor will discuss this with you.

When considering potential care homes, consider the following questions:

First impressions

• Are there smoking and non-smoking areas?

• Are staff warm, friendly, polite, clean and respectful?

• What arrangements are there for religious observance? For example are places of worship nearby or is there a prayer room?

• Do the residents seem happy, active and sociable?

• Does the home feel homely and welcoming?

• Is the home fresh, clean and comfortably furnished?

• Can you handle your own money?

• Does a hairdresser or chiropodist visit?

Accomodation

• Does the home provide its own transport?

• Are bedrooms single or shared? Is there a choice?

• Do staff have appropriate language skills/ knowledge?

• Can you decorate and arrange your own room?

• Can you bring your own furniture and TV? • Is there a call system for emergencies?

• Can you control the heating in your room?

• Can you lock your room or is there a secure place for valuables?

• Is there a separate dining room? Bar? • Are there both adapted showers and baths?

• Does the home have the right adaptations and equipment to meet your needs?

• Are all areas safe and accessible, for example for wheelchair users?

• Is there adequate provision for sight or hearing difficulties?

• Are the grounds or gardens attractive and quiet?

Life within the home • Are there any rules and restrictions, for example going out or returning?

• Can you choose when to get up and retire every day?

• Are the staff formally trained?

• Is there an adequate number of staff on duty day and night?

• Are visitors welcome at all times?

Can they stay overnight?

• May your visitors join you at meals?

• How much choice do you get about meals?

• Is the food varied and interesting?

• Can the home cater for your dietary needs including any cultural or religious needs?

• Can you have snacks or drinks any time?

In your room?

• Can you continue to pursue your hobbies?

• What activities and entertainment are organised?

• Are outings and holidays arranged? At what cost?

Fees and contract terms • How much are the fees?

Do they cover all services available?

• Under what circumstances will the fees alter?

• Are residents involved in decisions on life in the home?

• Can you retain your own room if away?

• Can you make and take phone calls in privacy and comfort?

• Will you be given a statement of terms on admission?

• Is alcohol served or permitted?

• Can you have a short-stay or trial period?

• Are all procedures, such as for complaints, clearly explained?

Specialist care services Support and care services for people with special needs offer a range of options aimed at maintaining their independence by living in their own homes and communities.

Learning disability If you are considering moving out of your family home, there are a number of options that could be explored considering the support you need.

You may want to have your own flat with support.

There is also the option of supported living, where you can either live alone or share a property with other people with support provided for all. Support can include learning independent living skills like cooking, cleaning and money management as well as help with health needs. Any of these options can often give you greater independence and choice.

There are other alternatives too such as Adult Placement or Shared Ownership schemes that could be considered. You can learn more about these through Health and Community Services.

An important change affecting people with learning disabilities is the introduction of personal budgets (explained on page 8), putting people at the centre of how they choose and pay for their support.

This may be in their own flat or house, a supported living scheme or, if needed, a care home with or without nursing that specialises in this type of care.

Support for people with learning disabilities often needs to be specialist e.g. for people with autism, challenging behaviour or dementia. A good service will provide opportunities to learn and maintain skills and opportunities to take part in enjoyable and stimulating activities. Care managers, social workers and community nurses from Health and Community Services, who specialise in learning disability, will be able to give you information to enable you to make the right choices.

Physical disability Following an assessment of your needs, you may be eligible for help from Health and Community Services, including a personal budget, occupational therapy, adaptations to your home, supported housing or help for the person caring for you.

Day support services are available to assist and support people to take part in activities, meet with others and regain their confidence. Day services range from sheltered work to leisure activities, as well as individual provision.

Specialist care services continued A short break away from home can provide a welcome change for yourself and anyone caring for you. The respite care might also be provided in your own home (through a ‘live-in’ carer).

The support you require if you have a physical disability must be tailored to your specific needs and can be provided by the independent and not-forprofit sectors as well as by Health and Community Services. Help at home with personal care is available during the day and night, 7 days a week. There are also private agencies offering help at home with personal care and housework. See page 9 for more information.

Dementia As it can be best for the person with dementia to stay in their own home for as long as possible, a range of community care services is available to facilitate this. Health and Community Services can provide access to: home care; meals in the home; sitting services (which provide a break for carers); advice on equipment and adaptations; day care centres and respite care.

These services can be provided directly by registered providers to those who do not require financial help from Health and Community Services, however we will still be willing to offer an assessment of need. You may have a choice of which agency you receive your care from whether or not we assist with the funding of your service.

If you are considering a specialist care home, remember it should be able to maintain and improve your quality of life. Depending on the degree of the dementia, you should be able to live in a care home that offers quality personal care and person-centred care. It’s important to consider homes that provide nursing care in case your condition deteriorates and you require a higher level of care. Many care homes offer specialist units with experienced nursing staff and facilities adapted to the needs of residents with dementia.

People with dementia can benefit from a range of group or individual therapies involving social interaction and mental stimulation, including reminiscence. Activity co-ordinators and occupational therapists can provide people with dementia with reality orientation, reminiscence and validation therapy. Music therapy, art therapy approaches and other creative therapies can also be helpful.

Behaviour management approaches that promote understanding of the behaviour of the person with dementia can also be beneficial and trained staff can offer this service within many care establishments.

Residents The best indication of a good home is that the residents appear happy and responsive.  Are there rummage boxes around the home to stimulate residents?

Access If the person with dementia needs or is likely to need equipment or adaptations you may want to check:  There is adequate signage and cues for different parts of the home such as dining room and bathroom.  The home’s policy about locking external doors.

Bedrooms You may want to find out whether the person with dementia can have a single room and whether:  Residents are encouraged to bring in some of their own furniture and possessions to increase familiarity.

Activities Residents should be stimulated without feeling stressed.  Are reminiscence activities available?  Are residents able to compile memory boxes?  Do staff compile life story books including photographs and mementoes?

Staff It is important to note whether staff seem friendly and caring towards residents and whether they treat residents with respect.  Do they have any training and experience in dementia care?  Will the person with dementia have a member of staff particularly responsible for their care?  Is there a member of staff you can talk to about your own worries about the person with dementia?

Manager/head of home A manager who is caring as well as efficient can make all the difference to a home.  Does the manager have a knowledge of dementia and can they deal with difficulties that may arise in an understanding way?  Is there a full assessment at home before a resident is admitted?

Paying for residential care Self-funding advice If you have more than £23,250 in capital or savings you will have to pay for any care services you require, although if you need care in your own home or are considering moving into a care home, you still qualify for a Social Care Assessment by Health and Community Services. The assessment will make sure that your needs will be met. Also, if you expect your capital to fall below £23,250 as a result of paying for care, Health and Community Services may then help you with the cost.

If you are moving into a care home, you may be entitled to some of the following financial assistance and support: Twelve-week property disregard This applies if: • your former home is included in your financial assessment • your other capital is less than £23,250, and • your income is not enough to meet your care home fees.

Health and Community Services will help with the cost during the first twelve weeks of permanent care in a home, provided their assessment has shown that this is the kind of care you need. This is called the ‘property disregard’ period.

Deferred payment agreements After the twelve-week property disregard period, Health and Community Services may be able to help you while your property is being sold. They will charge any financial help they give against the value of your home. This means they will take back the amount they have paid once your property has been sold.

However, they may limit how much they will pay.

It may affect your entitlement to Pension Credit if your property is not seen to be on the market and becomes treated as capital by the Department for Work and Pensions (DWP).

NHS Nursing Care Contribution Whether you are a temporary or permanent resident, if you live in a care home that provides nursing care you may be entitled to NHS Nursing Care Contribution towards the cost. It is not meanstested. This is paid directly to the home.

What if you run out of money?

If your capital is likely to reduce to £23,250 as a result of paying for care, you must tell Health and Community Services well in advance that this is going to happen. They will then be able to help with your care fees (provided your care needs assessment has shown that you need residential care). They will carry out a financial assessment to confirm the date from which your funds fell below £23,250, and the amount they will contribute towards your care.

If the home you have chosen charges more than Health and Community Services will pay, you must find someone to pay the difference – a ‘top-up’ payment. Whoever does this, whether a family member or a charity, they should understand that the cost could increase, and that they will have to pay the top-up for as long as necessary.

Alternatively, you may have to find a cheaper home.

Understanding your rights before moving into care is essential. There are a number of financial products and specialist companies who may be able to help. It is important to seek advice before committing yourself.

Attendance Allowance This is a non-means-tested, non-taxable benefit from the DWP. It’s paid at the lower rate of £51.85 a week if you need care by day or night, and at the higher rate of £77.45 a week if you need care during

The value of your home is included in the assessment of your capital unless one of the following still lives there: • Your partner (that is, your husband, wife or civil partner, or someone you live with as if they were your husband, wife or civil partner) or • A relative who is over 60 or disabled or • A child under 16 who you, or a former partner, are responsible for.

Your local authority will contribute financially towards your care costs after they have carried out an assessment of your care needs.

How much?

You will need to ask Health and Community Services for a Social Care Assessment. This will define your care needs and how they will be best met. Any care homes you consider must be able to meet these needs. Health and Community Services will also make an assessment of your financial situation. This determines how much they will pay and how much you will have to pay.

Your choice of care home will be limited to those that accept your local authority’s funding level. If you want to choose a more expensive home you would have to arrange for a third party – such as a family member or charity – to ‘top-up’ the difference. You are not allowed to do this yourself if your capital is below £23,250.

If you have capital between £14,250 and £23,250 you will pay £1 a week for every £250 you have above £14,250.

Yes...

Ask Health and Community Services for an assessment. Any care homes you consider must be able to meet your assessed care needs.

If, apart from your property, your savings are less than £23,250, your local authority can help with your care costs for the first twelve weeks. After this time you can apply for a loan to help you whilst your property is being sold.

Whatever your circumstances: Remember: • It is just your own financial circumstances that are assessed, not your partner’s • Your assessment will be made up of two elements, a care needs assessment and a financial one • A care home with nursing will generally be more expensive than a care home providing personal care only.

Consider claiming: • Income Support or Employment and Support Allowance (ESA) if under women’s pension age • Pension Credit if over women’s pension age.

Definitely claim: • Attendance Allowance, worth £51.85 a week.

Third party payments If the care home you eventually choose costs more than the rate Health and Community Services will contribute, someone will have to make up the difference. This extra payment is often referred to as a ‘top-up’ or ‘third party payment’.

Except in limited circumstances, the law states that you are not allowed to make this additional payment yourself. The responsibility for this often falls to a member of your family or a benevolent sponsor such as a charity. Once this person or organisation has been confirmed, they must sign an

agreement formalising the arrangement.

It is important that whoever agrees to do this for you is made aware that the amount could increase in the future and they must be confident any increases will be met. Should payments stop for any reason, you should seek help and advice from Health and Community Services immediately.

As the financing of care is a complex area, you are advised to contact Health and Community Services for specific advice and individual guidance and/or to seek your own independent financial advice.

Essential information Inspection and registration of care services The Care Quality Commission (CQC) registers, inspects and reviews all adult social care and healthcare services in England in the public, private and voluntary sectors. This includes care homes, care homes with nursing, home care agencies and NHS services, amongst others.

Since October 2010, all care providers are now registered under a system introduced by the Health and Social Care Act 2008, which brings adult social care, independent healthcare and the NHS under a single set of essential standards of quality and safety for the first time.

CQC holds and publishes up to date information about the compliance of adult social care providers with essential standards of safety and quality.

Following an inspection, each care home and home care agency is given a report of how it rates against national essential standards of quality and

safety. Each service’s report can be seen on the CQC website: www.cqc.org.uk.

The focus of an inspection is on the standards of care that people who use the service receive and whether they are happy with their care. Virtually all inspections are unannounced.

Report abuse or neglect of a vulnerable adult A vulnerable adult is any person aged 18 years or over • who is or may be in need of community services because of mental or other illness, disability or age, and; • who is, or may be, unable to take care of themselves against significant harm or serious exploitation.

• You can also share your concerns with a public service professional, such as a social worker, community nurse, GP, probation officer or district nurse who will be able to offer advice and support.

Abuse and neglect is a violation of an individual’s human and civil rights and may consist of a single act or repeated actions. It may be physical, sexual, financial, psychological or institutional, or may relate to neglect or discrimination.

Compliments, comments and complaints All organisations need to know how they are performing. They are happy to receive your feedback on their service whether they are compliments or complaints. Feel free to tell them what you think and your comments can be used constructively to improve the service.

If you do need to make a complaint you should feel able to complain about any aspect of your care that affects your happiness or comfort. This could be about the way you are treated by a staff member or the quality of the food you are served. You can also make comments and suggestions about possible improvements to your surroundings and the services provided.

Providers are required under the National Minimum Standards to have a simple and easy to use complaints procedure that they will be happy to give you. If you are concerned about the care that you, a friend or a relative is receiving, it makes sense to speak to the manager before you take any further action. The problem may be resolved quite easily once they are made aware of it.

However, if you need to make a formal complaint, you should initially contact the registered owners of the service. They have a duty to respond to any complaints made. If your complaint is about a breach of regulations, contact your local office of the Care Quality Commission, see page 26 for contact details.

If Hertfordshire County Council has arranged your care, you can make a comment about the service you have received, or a complaint, or pay a compliment to Health and Community Services.

How solicitors can help A solicitor can give you impartial advice about wills, making gifts, estate planning and Powers of Attorney. Some can also offer guidance on immediate and long-term care plans, ensuring (if applicable) the NHS has made the correct contribution to your fees.

Lasting Powers of Attorney (LPA) allow you to appoint someone you trust to make decisions about your personal welfare, including healthcare and consent to medical treatment, and/ or your property and financial affairs. A LPA is only valid once registered with the Office of the Public Guardian. It allows for a person of your choice to make decisions on your behalf at a time when you may be unable to.

The Court of Protection can issue Orders directing the management of a person’s property and financial affairs if they are incapable of

managing their own affairs should they not have a LPA. The Court procedure is presently very slow and the fees are quite expensive so preparing a LPA is always advisable, providing you have somebody sufficiently trustworthy to appoint as your attorney.

An ‘advance directive’ allows you to communicate your wishes in respect of future medical treatment but it is not legally binding.

You may instead wish to make a living will, properly known as an ‘advance decision’ setting out treatment that you do not want to receive in specified circumstances, which would legally have to be followed, even if you die as a result.

Any proposed gift out of your estate needs careful consideration of the benefits, risks and implications, particularly on any future liability for care costs or tax liability.

Long-term care: whether you remain in your own home or move into sheltered or residential care, you may qualify for financial assistance in the form of social care and NHS-funded care and welfare benefits.

If you don’t have your own solicitor, ask family or friends for their recommendations. Contact several firms, explain your situation and ask for an estimate of cost and an idea of time scales involved. Many firms will make home visits if necessary and will adapt their communications to meet your needs.

Mental capacity People’s capacity to make decisions for themselves is sometimes impaired by illness, accident or age related memory loss. The Mental Capacity Act 2005 allows people to prepare for such a time. It also lays out the way capacity should be assessed and how decisions should be made in the best interests of people who are unable to make their own decisions.

The Act says that a person lacks capacity if, at the time a decision needs to be made, he or she is unable to make the decision because of an impairment of, or a disturbance in the functioning

of, the mind or brain. This could be people with dementia, learning disabilities, mental health problems, stroke or head injuries.

The Act also gives people with capacity the opportunity to prepare for a time when they may lack capacity to make their own decisions. In addition, it makes provision for people to make an Advanced Decision to Refuse Treatment.

Hertfordshire Care Providers Association (HCPA) Hertfordshire Care Providers Association (HCPA) is a membership body open to all independent providers of social care (private, not-for-profit and charitable organisations) delivering care to people in their own homes, in a residential, supported or a nursing setting within Hertfordshire.

We are extremely proud of our mission statement: ‘Sharing best practice in care through partnership’ because we have used partnership working to ensure that Hertfordshire is one of the best counties in which to find excellent care for vulnerable people.

With the right training, staff can offer personcentred activities that are stimulating and fun. We are proud of our activities project funded by Hertfordshire County Council which aims to put a fully trained activities organiser in every care home in the county.

Membership of HCPA is considered a sign of a progressive organisation, committed to delivering the highest standards of care and keen to play an active part in the county’s wider social care community. HCPA believes in personalisation as the way forward with care and we actively encourage membership for anyone receiving direct payments or those working with them; we can offer information, advice, guidance and funding for a number of initiatives.

HCPA has excellent partnership links to the local authority, NHS and representatives of the Hertfordshire Care Providers Association attend regular strategic and liaison meetings with Health and Community Services, to discuss and review

contracts, procedures and other issues, as well as working on a variety of initiatives aimed both at tackling immediate issues facing vulnerable people and designing better ways of working for the future.

We set up a memorandum of understanding with the local authority over four years ago and our relationship has gone from strength to strength enabling Health and Community Services to talk to member organisations through HCPA and enabling us to act as a ‘voice’ for care providers on important issues.

We also act as a hub for funding in the county which enables us to ensure that there is a fully trained workforce offering the best of care with the most upto-date practices, and celebrate excellence in care by hosting the annual Hertfordshire Care Awards.
