Brokerage Service The Brokerage Service is a telephone-based service. Workers in the team can support you to identify and purchase a range of services to meet your individual needs and help you get best value for money. They provide information about a wide range of services helping you to make the right choice about who supports you. Adult Care Services – where do I start? People finding it difficult to manage independently, and their carers, need to know where they can go for information, advice and support. This Directory is an

important source of information about the wide range of services available across the county.

Initial contact You can Call Derbyshire, our contact centre, from 8.00am to 5.00pm on 01629 533190 or out of hours in an emergency on 01629 532600. Our service is provided by staff who are specially trained to deal with Adult Care issues. They can provide advice, signposting and

practical help to enable you to continue to live your life as independently as possible. Call Derbyshire staff can also refer you through to the Brokerage team, the Welfare Benefits team and can arrange a social care assessment if needed.

Assessing your needs If required, we will assess your need for statutory Adult Care support, and if you meet the eligibility criteria, we

will work with you to develop a plan for your support which will detail how your needs will be met.

Eligibility Eligibility for Adult Care services is determined via local application of the Government’s national Fair Access to Care Services Framework (FACS). You can find more

information about the eligibility criteria in Derbyshire on our website: www.derbyshire.gov.uk.

Personalised support Once eligibility is determined, we will work with you to identify what outcomes you would like to achieve and we will draw up a support plan that details this. You and your carers will be invited to be involved in this assessment process and will help to produce a support plan. A budget will be calculated that can be used to meet your outcomes. This Personal Budget can be paid either

directly to you as a Direct Payment, or managed by us on your behalf to purchase the services and support you choose. Types of service offered by Adult Care Services to support you leaving hospital Supporting people to leave hospital safely and quickly is a key priority for Derbyshire Adult Care and health services. If the hospital staff feel that you will need Adult Care support following your discharge, they will make a referral and request an Adult Care assessment. This could recommend: • short-term re-ablement support to help you regain independence at home; • intermediate care support to help you recover from illness and provide rehabilitiation;

• re-ablement support in your own home to help maintain your safety and regain lost skills; • a short- or long-term placement in a care home or care home with nursing. An Adult Care worker will work closely with you, your family and health staff to work out what is best for you. We will use all the different services that are available to help you recover your health and independence and return home as soon as is safely possible.

Re-ablement Re-ablement is a period of short-term, intensive support that is designed to help you become as independent as possible. It is normally provided in your own home but can be delivered in residential care or other suitable locations. Re-ablement is offered for up to six weeks if, following a period of illness or a fall perhaps, you have lost some of the skills you need to manage independently. At the end of the re-ablement period a review will be carried out and many people will not require any further

assistance. However, if you do, a revised support plan will be developed detailing the new outcomes and any ongoing services. Home care services A home care service provides essential care to people in their homes, aiming to support their independence and improve their quality of life. Following your assessment it may be identified that a home care service would best meet your needs. If so, you may choose to purchase your service from a range of home care providers including Derbyshire County Council’s own home care service or you could employ a personal assistant or buy your care privately. All home care organisations that provide personal care must register with the Care Quality Commission (CQC) who are responsible for monitoring domiciliary care services to make sure they meet the required essential quality standards. This site can also be used to report any concerns you have regarding a care provider or service.

Home care agencies providing personal care must be registered and inspected by the Care Quality Commission. Ask to see a copy of their registration certificate. 1 2 3

How many carers would the agency assign to care for you and would you see the same one every day? If not, how does the staff rota operate and what happens if your carer goes on holiday or is sick? Will you be notified in advance that a different carer will be attending? 1 2 3 How can you contact the agency in an emergency or outside office hours? 1 2 3

If this is a private contract ask for a copy of the agency’s contract terms and read these carefully with someone you trust. Get as much help as you can going over it and ask any questions you may have before signing anything. Carers You should expect your personal preferences, dignity and privacy to be respected. Discuss this with the agency and ask how the most suitable carers for your particular care are chosen. Support for carers Carers provide significant levels of unpaid support for family members or friends. They provide assistance with day to day living tasks and/or personal care. Those cared for could be ill, frail, disabled, suffer from poor mental health or have a substance or alcohol misuse problem. A carer can be any age, male or female and includes parents caring for a disabled child.

Short term and respite care Short breaks, respite or short term care is for people who require assistance with personal care because of disability, frailty, mental ill health or who are recovering from a period of ill health or family difficulty. In addition, the service gives carers, who provide a substantial amount of support, the chance to take a break. If you wish to take short term care and do not already receive Adult Care services, the first point of contact would be Call Derbyshire on 01629 533190. Then a visit from a social worker will assess your eligibility for short break or respite services. The length and frequency of the planned break would be discussed within the assessment process and agreed with yourself and your carers. There are charges for these services and how much you pay will be subject to a financial assessment. If your stay is three weeks or less you will normally pay a standard rate. From April 2014 the standard rate is £123.95 per week if you are over pension age, or £79.85 per week if you are under pension age. If you are under 25 years of age the rate will be £64.80 per week. If your stay exceeds three weeks, or you wish to extend your stay for over three weeks whilst in your placement, you will need to have a financial assessment. These charges apply to anyone who has capital or savings of less than £23,250. If you have more than this amount then you will have to pay for respite or short term care charges in full as you would be self-funding. However, you are still entitled to an assessment and assistance with choosing the most appropriate placement to meet your needs. Please note: figures mentioned here may change over the life of this Directory.

Carer’s Emergency Card This scheme provides carers with peace of mind so if they are suddenly not able to provide care due to an accident or illness, the emergency services will raise the alert that assistance is required for someone. To obtain a Carers’ Emergency Card contact Call Derbyshire on 01629 533190 or complete the form in the ‘Guide to Carers Services’ leaflet. Derbyshire Carers Association (DCA) This is a leading organisation that is commissioned by Derbyshire County Council to provide support for carers in Derbyshire. Derbyshire Young Carers’ Service This organisation can provide support to young carers individually or in groups. Support can range from activity groups, meeting other young carers in a safe environment, and information about support for the home situation. The service also offers whole family

Residential care Residential care homes cater for people who can no longer manage in independent accommodation. Homes are registered with the Care Quality Commission and provide personal care and support for people with a variety of complex needs including dementia. Derbyshire County Council provides a number of care

homes directly. Others, including a number with nursing beds, are provided in the independent sector. Details of the homes available are listed in this Directory starting on page 36 and further information about the different types of homes is on page 21.

Community Care Centres Over the last few years Derbyshire County Council has developed a number of Community Care Centres. These provide community hubs for the provision of specialist care for older people, including those with dementia. The purpose-built centres offer long- and short-term

residential care beds, day care and host a number of support groups and other services. Community Care Centres also provide facilities such as a bistro and hair salon which can be used by the local community.

Telecare services Telecare equipment provides peace of mind for someone living in their own home by generating an automatic alert if assistance is required. Telecare services can be purchased privately or can be provided (for eligible clients) as part of an Adult Care support package where it meets particular identified needs, such as a risk of falls. To access the telecare service a telephone line and a nearby mains socket for the Lifeline unit are required. Most sensors are wireless and battery

powered and will be provided and installed for you. When a sensor detects a problem, there is an automatic dial to a response centre, where trained staff can either speak to the user via the speaker on the Lifeline, or arrange for a home visit by carers, mobile warden or the emergency services. Services provided by the NHS NHS fully-funded Continuing Health Care National Health Service Continuing Health Care (NHS CHC) is a package of continuing care arranged and funded solely by the NHS, for people with on-going health care needs. To establish if you are eligible for NHS CHC your care needs will be assessed by a health professional. If you are eligible, you can receive NHS CHC in any setting, either in your own home, with services from a community nurse or specialist therapist, or in a care home, whichever is most

appropriate for your needs. People who are eligible are likely to: • have a complex medical condition that requires a lot of care and support; and • need highly specialised nursing support. Someone nearing the end of their life may also be eligible if they have a condition that is rapidly getting worse and may be terminal.

Intermediate care Intermediate care is a health-funded service that provides therapist intervention to support someone’s recovery after illness or to prevent admission to hospital. To access intermediate care a referral is usually made by your GP or other social care or health professional. Initial referrals will be assessed by a multidisciplinary team which may include occupational therapists, physiotherapists, nurses and social workers, who can provide specialist support short-term treatments to get you back to health. Services are designed to maximise your independence and aim to help you stay living at home, but can also be delivered in a care home or similar setting where appropriate.

To be eligible you must be: • medically stable and supported by your GP in the community; and • able to benefit from time-limited assessment or rehabilitation, in order to improve your level of independence. If it is considered that you are not suitable for intermediate care you will be given the reasons for this decision. You may also be signposted to a more appropriate service if required.

Housing options Extra Care housing Extra Care housing gives you the security and privacy of a home of your own, but with 24-hour care and support services available if you need them. There are frequently one and two bedroom flats available as well as a range of communal facilities on-site such as a restaurant, IT suite and an activity room. The schemes generally offer the choice of properties for rent, sale or shared ownership. Choosing Extra Care housing means that you are living in your own accommodation and can usually remain there if your care or support needs change. The schemes aim to house people with differing levels of need so that the community is balanced. Residents being considered for the accommodation are assessed to determine what support they need. Unless someone requires long-term nursing care, it could offer you a home for life. Extra Care housing is normally available to people aged 55 years or over, although it may be suitable for certain younger people with disabilities where appropriate.

Extra Care differs from care homes in the following ways: • you are living at home - not in a home; • you have your own front door so you can decide who comes in; • couples and friends can stay together; • it offers a safe and secure home for people who need support, including people with learning disabilities; • 24 hour care and support services are available; • you can join in social activities if you wish; and • residents generally have a mixture of support needs. Derbyshire Adult Care is currently working with housing association partners to develop a range of Extra Care housing schemes throughout Derbyshire. Sheltered housing Sheltered housing is suitable for older people who wish to live independently but want the reassurance of knowing that assistance is available if there is an emergency. There are many different types of sheltered schemes, available both to rent and to buy. Schemes usually consist of between 15 and 40 dwellings. These may be bedsitting rooms, self-contained flats, or bungalows. Some schemes are simply housing designed to meet the needs of older people and linked to a community alarm. Some schemes have access to a floating support worker for those who need it and a community alarm service. There may be some communal facilities such as a lounge, laundry, guest flat and garden. Meals are not

normally provided. Sheltered housing for rent is provided by local district/ borough councils or housing associations. People who are interested in being considered for accommodation of this kind need to register with their local district/borough council who have information about all the social housing vacancies in their area. Specialist care services There are a wide range of services provided in Derbyshire to meet the needs of specific client groups, such as people with a learning disability, physical disability, or mental health conditions including dementia, for example. Most people who need a service will come initially through Call Derbyshire or will be referred to Adult Care by another organisation. The assessment process (discussed on page 8) will look in detail at the support needs that a person has and work will be done to identify the options for meeting these. The services that might be considered include: • specialist accommodation; • day care/day opportunities; • supported employment; • specialist equipment or adaptations; • home care; • re-ablement; • respite care; • social work support; and • support groups. Where someone is eligible for Adult Care assistance, a support plan will be drawn up to identify the outcomes they wish to achieve and a personal budget will be provided to meet these. Care homes for those with dementia If you are considering a care home for someone with dementia it is particularly important that it offers a person-centred service that can be tailored to meet individual needs and provides support to maintain and improve quality of life. Some homes can offer an environment which has been designed specifically for people with dementia and can aid orientation. People with dementia can also benefit from a range of group or individual therapies involving social interaction and mental stimulation, including reminiscence. Activity co-ordinators and occupational therapists can offer reality orientation, reminiscence and validation therapy. Music therapy, art therapy approaches and other creative therapies can also be helpful. Behaviour management approaches that promote understanding of the behaviour of the person with dementia can also be beneficial in reducing the use of

anti-psychotic medication and trained staff can offer this service within many care establishments. Many care homes can offer places to someone with dementia. Carers should discuss their requirements with individual care home managers. RESIDENTS The best indication of a good home is that the residents appear happy and responsive. • Are there rummage boxes around the home to stimulate residents? ACCESS If the person with dementia needs or is likely to need equipment or adaptations you may want to check: • There is adequate signage and cues for different parts of the home such as dining room and bathroom. • The home’s policy about locking external doors. BEDROOMS You may want to find out whether the person with dementia can have a single room and whether: • Residents are encouraged to bring in some of their own furniture and possessions to increase familiarity. ACTIVITIES Residents should be stimulated without feeling stressed. • Are reminiscence activities available?

• Are residents able to compile memory boxes? • Do staff compile life story books including photographs and mementoes? MANAGER / HEAD OF HOME A manager who is caring as well as efficient can make all the difference to a home. • Does the manager have a knowledge of dementia and can they deal with difficulties that may arise in an understanding way? • Is there a full assessment at home before a resident is admitted?

Good quality end of life care ‘How we care for the dying is an indicator of how we care for all sick and vulnerable people. It is a measure of society as a whole and it is a litmus test for health and social care services.’ 1 Although the subject of dying is often painful to contemplate and as a society we do not discuss death and dying openly, the way care professionals approach the process is incredibly important for the client, their family and carers. The Department of Health has published a strategy for every organisation involved in providing end of life care. Enabling residents to die in comfort and with dignity is a core function of care homes. When choosing a care home you should consider their end of life care philosophy and policies.It is essential that you and your relatives discuss and plan for your wishes as you need the end of your life. Care homes should have an open approach to end of life care and should initiate conversation with you

and your family to ensure your needs and wishes are discussed and planned for and written into your care plan. Care homes should work with your GP to ensure your medical needs are met as you approach the end of your life. Good planning for all your needs should mean that you can (if that is your choice) remain in your care home in your last days and not have to be admitted to hospital. All health and social care staff should be trained in communication regarding end of life care and will be trained accordingly in assessing the needs of clients and carers. Despite general reluctance to broach this sensitive area, it is worthwhile asking potential care providers their approach to end of life care and whether they are following national strategies for implementing best practice within their home. 1 ‘End of Life Care Strategy - promoting high quality care for all adults at the end of life’ DH 2008.

This includes care homes, care homes with nursing, home care agencies and NHS services, amongst others. Safeguarding adults Ensuring vulnerable adults who use services are protected from abuse and neglect is our top priority. All providers of services to vulnerable adults have a zero tolerance towards abuse and neglect. Derbyshire Adults at Risk Policy and Procedures aim to ensure that help is provided to those where age, illness or disability affects their ability to protect themselves against serious harm or exploitation. Deprivation of Liberty The Deprivation of Liberty Safeguards (DOLS) came into force in April 2009 as an amendment to the 2005 Mental Capacity Act (MCA). This law aims to safeguard the most vulnerable people who lack capacity to consent to the care or treatment they receive and who are being cared for in hospitals, care homes or nursing homes registered under the Care Standards Act 2000, whether placed under public or private arrangements, but who are not detained under the Mental Health Act. Under DOLS, there is a legal requirement for the Managing Authority (care home or hospital) to apply to the Supervisory Body (local authority) to have someone assessed where it is believed that it is in their best interests that they should be deprived of their liberty to prevent them from harm. Within Derbyshire the supervisory body is Derbyshire County Council. The Supervisory Body arranges assessments and either grants or declines the Managing Authority’s request for authorisation to deprive the person of their liberty.

• who suffers from a mental condition – such as dementia or a profound learning disability; • who lacks the capacity to give informed consent to the arrangements made for their care and/or treatment; and • for whom deprivation of liberty (within the meaning of Article 5 of the European Convention on Human Rights) is considered, after an independent assessment, to be necessary in their best interests to protect them from harm. The safeguards are designed to ensure that a person’s loss of liberty is lawful. There are three elements to the safeguards: • to provide the person with a representative; • to allow a right of challenge to the Court of Protection against the unlawful deprivation of liberty; and • to provide a right for deprivation of liberty to be reviewed and monitored regularly.

Comments, compliments and complaints All organisations need to know how they are performing. They are happy to receive your feedback on their service whether they are compliments or complaints. Feel free to tell them what you think and your comments can be used constructively to improve the service. If you do need to make a complaint you should feel able to complain about any aspect of your care that affects your happiness or comfort. This could be about the way you are treated by a staff member or the quality of the food you are served. You can also make comments and suggestions about possible improvements to your surroundings and the services provided. Making a complaint should not be difficult for you. Providers are required under national standards to have a simple and easy to use complaints procedure that they will be happy to give you. If you are concerned about the care that you, a friend or a relative is receiving, it is normally best to speak to the manager before you take any further action. The problem may be resolved quite easily once they are made aware of it.

However, if you need to make a formal complaint, you should initially contact the registered owners of the service. They have a duty to respond to any complaints made. If your complaint is about a breach of regulations you can contact the Care Quality Commission. Whether you remain in your own home or move into sheltered or residential care, you may qualify for financial assistance in the form of social care and NHS-funded care and welfare benefits. If you are self-funding your care and have a contract with your care provider, it is important to speak to solicitors with experience in this field. Any contract should explain the cost of care, what services are included in the

price and how often this is reviewed; what complaints procedure is in place; what your rights are and the obligations of the care provider under the contract; the procedure for cancelling a contract and the administering of medication. The Citizen’s Advice Bureau offer an advice service and will be able to recommend solicitors in your area.

Derbyshire Care Providers Association (formerly the Derbyshire Care Homes Association) This publication provides you with a lot of information regarding care homes and their services within the county. The Derbyshire Care Providers Association (DCPA) represents the independent sector and supports care providers to enable them to improve the quality of life for residents in care homes. The DCPA managing committee meet regularly throughout the year and also meet with local authorities, councillors, MPs, NHS and the regulators, the Care Quality Commission, to lobby and consult on behalf of care providers and their residents. The last year has seen much exposure in the media regarding abuse, neglect and poor standards in some hospitals. The media report this as well as issues in care homes, but the vast majority of care providers provide an excellent caring service carrying out their work quietly in an effective way promoting choice, dignity, privacy and independence in an individualised manner. Bad news is nearly always reported by the media. Good news and good practice are rarely mentioned.

It is common for people moving into a care home to rediscover what life has to offer, making new friends and to start enjoying life again. The help that a person receives in a care home will be planned to meet their specific needs in such a way that privacy, dignity, independence and individuality are recognised and maintained at the highest level. As well as having rights within the home, there is also a legal right to choose which care home you wish to live in. If you receive funding support from the local authority to pay for care home fees, you may need a relative or friend to pay a ‘top-up’ charge to the care home on top of what the local authority contributes.

The Derbyshire Home Care Association The Derbyshire Home Care Association (DHCA) is the official representative body for all independent providers of care at home in Derbyshire. Membership is open to all home care providers who are registered with the Care Quality Commission and who are on Derbyshire County Council’s approved list. The primary objectives of the DHCA are: • to promote excellence in home care in Derbyshire through shared knowledge and awareness; • to encourage dialogue between members and provide a forum for exchange of information on topics of common interest; and • to consult with Derbyshire County Council and represent the collective points of view of the members on any matters of concern to the membership. By means of regular consultation meetings with staff, the Director and with the elected cabinet member for Adult Care Services, we keep abreast of the County Council’s thinking and planning and we have an active role in discussing and influencing the policies which affect the future of home care provision in Derbyshire.

The main business of the Association takes place at meetings held every three months, which are open to all members. From time to time, guest speakers are invited to present topics of interest. These include areas such as training provision, quality standards, CQC, changes in registration, inspection and legislation. The home care sector is undergoing massive changes and the DHCA is still active in working in partnership with the County Council in assisting in the implementation and development of these key changes to the provision of personal and social care. Because of the importance of the role that the DHCA plays, we feel that it is important that all agencies share our voice and are keen to encourage membership from all home care agencies in Derbyshire.

Paying for care Self-funding advice If you have income in excess of the weekly fee charged by the care home, or capital assets worth more than £23,250, you will be responsible for any long term residential care services you require. Regardless of your assets, however, you are still entitled to an assessment of your needs by the Adult Care Department. If your income is less than the weekly fee charged by the care home, or your capital assets are under £23,250, you may be entitled to financial assistance from us. You will be required to make a contribution towards the cost of your care from your income and if you have savings between £14,250 and £23,250 you will also make a contribution from your capital. If your savings are less than £14,250, your contribution will be assessed only on your income and the local authority meets the shortfall subject to local funding limits (see chart on page 32). If the care home you choose charges a fee in excess of the local authority funding limit you will need to find someone else to meet the additional amount, often referred to as a ‘third party’ or ‘top-up’ payment (explained further on page 32). When you move into a care home you may be entitled to some of the following assistance and support, subject to a needs assessment. Twelve-week property disregard If your former home is included in your financial assessment but your other capital is less than £23,250, and your income is not enough to meet your care home fees, we will share the cost during the first twelve weeks of permanent care provided we agree that care is needed. For more information on paying for care if you own a property, please see our factsheet ‘Your property and paying for care’. Deferred Payment Agreements After the twelve-week property disregard period, any financial help from Adult Care will be charged against the value of your home. Subject to certain conditions, we may offer you a Deferred Payment Agreement which will allow you to delay selling your former home. Any fees loaned under the agreement must be repaid once the house is sold or from your estate. Interest is not payable on the loan whilst you remain in care but does become payable 56 days after you pass away. We may limit the amount of the loan depending on the equity held. Your entitlement to Pension Credit or Income Support will also be affected

if your property is not seen to be on the market and becomes treated as capital by the Department of Work and Pensions (DWP). Attendance Allowance, Disability Living Allowance and Personal Independence Payments These benefits are non-means tested, non-taxable benefits from the DWP. There are two rates depending on the level of your needs. The lower rate from April 2014 is £54.45 per week and the higher rate is £81.30 per week. Everyone who needs care can, and should, claim these benefits but they will only remain in payment if you are funding your own care. If we are making a contribution towards your care then these payments will cease. If you are entitled to the Mobility component for help with getting around, these payments do not stop once you are in a care home and are not included in your financial assessment. NHS Nursing Care Contribution Whether you are a temporary or permanent resident, if you live in a care home that provides nursing care you may be entitled to a non-means-tested NHS Nursing Care Contribution (currently £110.89 per week for the standard rate) towards the cost of your nursing care. This is usually paid directly to the home and is used as payment towards the overall fee. NHS Continuing Care Funding You can receive Continuing Health Care services in any setting, including your own home or in a care home. The NHS will pay if you need healthcare from a community nurse or a therapist as well as personal care to help you at home. If you live in a care home with nursing (traditionally called a ‘nursing home’), you may qualify for the full cost of your care home fees, including board and accommodation, under the National Framework for NHS Continuing Health Care if you meet the criteria. If you live in a care home providing only personal care and need help from a registered nurse, this help will be free, covered by the NHS. To find out whether you are eligible you must ask for a Continuing Health Care Assessment. Running out of money If your capital is likely to reduce to £23,250 through

Self-funding advice continued >> payment of care home fees, you must let us know well in advance. We must undertake an assessment of your circumstances before deciding if we will make a contribution, explained on page 8. If the home you have chosen charges more than Derbyshire County Council’s fee levels, as shown in the table on page 32, you must find someone to help pay the difference which is known as a ‘top-up’ or ‘third party payment’. Whoever does this, whether family or a

benevolent charity, they should realise that they will have to pay this for the duration of your time in care and the cost could rise. Alternatively, if funds for a top-up are not available, you will need to find accommodation which can meet your needs at the local authority fee level. Understanding your rights before moving into care is essential. There are a number of financial products and specialist companies who may be able to help. It is important to seek advice before committing yourself.

What will you have to pay for your care? The value of your home is included when assessing capital unless it is occupied by your partner, a relative who is aged over 60 or is incapacitated or a dependent child under 16 who lives there with your partner or former partner. Do you have capital or savings in excess of £23,250? Yes... Arrange for a Community Care assessment with Adult Care to define your care needs. Whichever home you consider must be able to meet your assessed care needs. If, apart from your property, your savings are less than £23,250, we can help with your care costs for the first twelve weeks. After this time, any money from us will be regarded as a loan and will need to be repaid once your house is sold. No... We will share the costs with you. How much will we contribute? To work out how much we will contribute, you must arrange a Community Care assessment to define your care needs and how they will best be met. We will also have to assess your financial situation. Any homes which you consider must be able to meet your needs. Your choice of care home will be limited to those that accept our funding rate. More expensive homes

will expect you to arrange a third party to top-up the difference. You are not allowed to do this yourself if your capital is below £23,250. If your capital is less than £14,250, and the home you choose charges fees that are within our funding rate, your contribution will be assessed only on your income. With capital between £14,250 and £23,250 you will be expected to contribute £1 per week for every £250 you have above £14,250 in addition to your income. For more detailed information on paying for care please ask for our leaflet ‘Paying for care in a care home’. Whatever your circumstances... • If your partner still lives at home, they will not be meanstested. If you have a private pension, only half will be considered when you are assessed if you are passing this on to your partner. However, you will need to consider the effect this would have on any benefit claim your partner makes after your move into care, as it may reduce their entitlement to other financial help. • Your assessment will be made up of two elements, a care part and a financial one. • A nursing home will generally be more expensive than a residential home offering personal care only. Remember to seek benefits advice and consider claiming: • Universal Credit (if you are under pension age);

Local authority contribution towards care in private sector care homes We appreciate that the current financial climate in the care sector is challenging. It is recognised that considerable pressure exists for both those who purchase and those who provide care home placements. Where we can assist with funding support for an individual, the fee rates payable to care homes throughout the County are listed on page 32. Complex or variable needs are assessed individually and can attract additional funding. Fees charged by some homes may be higher than the maximum rates that we can pay for reasons other than complex or variable needs. Please see the section on third party payments on page 32. Where individuals are meeting their full fees without funding from us, the level of fee we will pay will be subject to the agreement we reach with the care provider. People who are liable to pay the full cost of their care are also entitled to an assessment of their care needs. It is important to appreciate that care homes not owned or managed by us are run as private businesses and as such they are able to decide how much they want to charge for accommodation and care. Funding arrangements can be complex so potential

residents are advised to seek advice from one of our local offices. See page 32 for contact details. Whilst we can offer help in negotiating a fee on your behalf, the care home can decide to change their charges from time to time, such as if you decide to move rooms or when you sell your house and become a ‘self-funding’ resident. If you are concerned about any potential future changes in the amount you may have to pay you should discuss this with your social worker at the earliest opportunity.

Quality Premium payments We currently operate a local scheme to reinforce quality standards in care homes and home care agencies. Each organisation has been given the opportunity to apply to become a Quality Premium Provider and those who have qualified have demonstrated that they have met

standards in staff training and competence, for which an additional payment is then made by us. People choosing a home are advised to ask if the home is a Quality Premium provider.

Third party payments If the home you choose costs more that the rate paid by us for someone with your needs, you will have the choice to ask someone else to make an additional payment. This means that they will have to pay the difference between our rate and the amount the home charges. This additional payment is often referred to as a ‘top-up’ or ‘third party payment’. The law says that you are not allowed to make this additional payment yourself, except in limited circumstances, such as when you have a Deferred Payment Agreement (explained on page 29). Therefore,

the additional payment normally has to be made by someone else, for example, a family member or charity. Before anyone agrees to make additional payments on your behalf they should be aware that the amount could increase and they need to be confident that they can sustain the payments for as long as they are required. If the additional payments stop being paid, for any reason, then you should seek help and advice from us. Once it has been established that someone is willing and able to make these payments they will be asked to sign an agreement to formalise the arrangement.
