Welcome from the Executive Director for Education, Care and Health Services Welcome to the 2013-14 Bromley Adult Care & Support Services Directory.

If you are looking for care or support in or around Bromley for yourself, a family member or friend and whether you are paying for the support yourself or receiving social care or health funding, then this Directory contains lots of valuable information.

In the coming year Bromley Council will continue to work with its health partners through the Health and Wellbeing Board to make sure that health and social care are better integrated. An important part of this work is making sure that when you or someone you care for need support or care, because of ill health, age or disability that you can access all the information you need to make informed choices about what is right for you, what services can meet your care needs and help to improve your health, wellbeing and quality of life in general.

Also, we are working to support you to stay independent, both safely and comfortably, for as long as possible, So, with this in mind, it is also important that we provide you with information about the service you can get that will help you to remain in your own home for as long as possible.

The Directory includes information ranging from how to get aids and equipment for everyday living to help you remain independent to information

about extra care housing schemes and other supported living options, care homes and nursing home services.

You will find information about whether you may be eligible for social care funding or a financial contribution towards the care or support that you choose. There is information about Personal Budgets ‒ the amount of funding you receive if after an assessment of need is carried out, it is considered that you are entitled to state funding and Direct Payments ‒ the financial payments made to individuals to allow you greater choice and control over the services that you receive.

If you are not eligible for state funding, this Directory can also provide advice and guidance to help you identify different care and support options to meet your needs.

The Directory also provides a range of information if you want to make comments and suggestions about possible improvements to your surroundings and the services provided, or if you are concerned about the care that you, a friend or a relative are receiving. See page 39 for further details.

Helping you to stay independent Support for carers Bromley Council recognises and appreciates that carers are vital, and the value of their support incalculable, to the wellbeing of the person they are caring for.

A carer is someone who regularly cares, without payment, for a relative, partner or friend, who due to illness, disability, vulnerability or frailty cannot manage at home without help. If you look after a relative, friend or disabled child who needs support to live at home then you are a carer and eligible for help.

We provide the following help for carers over 18 and for those they care for: • the person you look after can have a Care Assessment to see if services can be provided to support or replace the care you normally give.

You are able to contribute to this discussion if the person you care for agrees to this; • you can have your own confidential Carers Assessment which will look at your caring responsibilities and your own needs; • advice and information on local services and organisations; and • leaflets and publications for carers.

• understand how your caring role is affecting you; • find out what support could make your life as a carer easier; • get information and advice; • discuss any difficulties you have; and • share your feelings about the future.

There is no cost for assessment, advice or information from Bromley Council. However, there may be a cost for some of the services that are available, which will be fully discussed before support is arranged.

Alternatively, contact Bromley Social Services Direct on 020 8461 7777 from 8.30am to 5.30pm For carers of people aged under 65 with mental ill-health, this help can be accessed through the relevant local Community Mental Health Teams. All offices are open Monday to Friday from 9.00am to 5.00pm.

To ensure that services go to those with the greatest need, who are at risk of losing their independence, we have eligibility criteria for those who are seeking help from Bromley Council, discussed on page 8. Priority for services is given to those whose needs have been assessed as meeting the criteria. Services for carers and those they care for are also provided by local voluntary organisations such as Carers Bromley.

Council help If you are disabled or ill Bromley Council can provide services, to help you and your carers get the support, needed to live as independently as possible. To make sure the services go to Bromley people in greatest need, we set eligibility criteria for adults aged 18-64 years who have a permanent disability or long-term care needs. This includes services for adults who are: • blind or partially sighted; • deaf or hard of hearing; or • older people; or have: • learning disabilities; • mental health needs; or • physical disabilities.

Priority for services is given to those whose needs have been assessed as meeting the criteria. To be eligible for social care services, you must be: • an adult aged 18 or over, living in Bromley, who needs long-term care because of difficulties related to older age, long-term illness or disability, or mental health problems; or • a carer and/or a representative who supports an adult aged 18 or over with such needs.

To make sure we offer fair access to care services for all adults who ask for our help, we use the following guidelines, which are set out by government for all local authorities. The factors to consider are:

• risks to your health and safety; • how much independence and choice you have; • how well you can manage daily routines; and • how far you can get involved in family and community life.

We will offer help if we think there are critical or substantial risks to your independence. We do not offer services if the risks are only moderate or low but we will give advice and information about how you can help yourself and we will redirect you to other sources of support and practical help wherever possible.

The reablement service If you have had an accident or an illness or have been in hospital, or because of a long-term disability or health condition, it may be harder for you to manage in your own home.

Reablement is intensive short-term support to help people to relearn daily skills and regain confidence to live independently. Daily skills could include preparing meals, washing, dressing and toileting. It might mean that you need less help in the future.

The reablement team will talk to you about: • what you want to be able to do in the future; • what goals you need to work on, for example getting in and out of the bath, or walking to the shops; and • how they are going to help you with those goals.

Reablement takes place in your home. The team do not things for you; they help you do things for yourself. It takes about 3 to 6 weeks but can be shorter, depending on how well you are doing. The team will check your progress and change your goals if necessary.

As part of the assessment process, you will

have the chance to talk to a care manager about your needs. If the care manager agrees you need reablement, they will arrange it for you.

If we are not helping to support you, you can still get reablement. Some companies have care workers who can give you this service. You will need to organise and pay for it yourself.

After the period of reablement, you may not need any more help but if you still need help, we will talk to you about your needs and about what your choices are. Depending on your needs, you might be able to get more help from us, or you might have to organise it yourself.

There is no charge for up to six weeks reablement.

There may be a charge for any on-going support depending on your circumstances and we will talk to you about this when you contact us.

Coming out of hospital Home from hospital services provide extra support to people who have been discharged home from hospital following surgery, ill health, or an accident.

They are short term aftercare services to help people to regain confidence and re-adjust to living at home, and can offer flexible short term practical help to assist with most day-to-day tasks.

Most services last for no more than a few weeks, and are provided by different organisations such as: Age UK Bromley & Greenwich who provide short term support (although not personal care) and practical help for people aged over 60 who are being discharged from hospital and live alone in the Borough. For many people, particularly those living alone, returning home after a stay in hospital or following an accident can cause anxiety.

Referrals come from health and social care professionals, older people themselves or their relatives. Age UK Bromley also provide Take Home

and Settle from the Accident and Emergency Department - please note that referrals are only accepted from hospital staff for the Take Home and Settle service.

Coming out of hospital continued >> Carers Bromley have a hospital link worker who can provide carers with support whilst the person they care for is a patient in the Princess Royal University hospital and undergoing the hospital discharge process. The hospital link worker can: • assist with completing a carers assessment to ensure their needs are addressed within the discharge process;

• liaise with the hospital ward and the hospital care manager to ensure practical support is in place; • provide information and advice to help them in their caring role; and • signpost carers to other organisations.

Helpful equipment Adaptations and equipment There are a wide range of equipment and adaptations available to assist you with daily living, and a number of organisations that can help you to choose what would best suit your needs.

Bromley Council has accredited a number of businesses within the local area to provide advice and to sell small items of equipment, such as kitchen, toileting and bathing equipment, and washing and dressing aids. The accreditation means that they have met the Department of Health standards for the assessment and provision of small aids to daily living; as part of the standard, they have received training from us. For more information please visit the website http://www. carersbromley.org.uk You may be eligible for help from Bromley Council, but the demand for occupational therapist services is high and it might take some time for you to be seen. Initial contact should be made to Bromley Social Services Direct. If you are eligible (having a permanent, substantial physical disability) for a service, you will be offered an assessment. For shortterm conditions and rehabilitation, NHS occupational therapists will provide equipment. Telecare Telecare is a service that enables people to live independently in their own home and provides a basic community alarm service that is able to respond to an emergency and provides regular contact by telephone. The service can also provide an integrated system that includes detectors and monitors for movement, falls, fire and gas, which trigger a warning to a monitoring centre. Telecare

provides users with improved levels of safety, security and independence.

You can be considered by asking for a social care assessment yourself, which includes a Telecare assessment, or this can be done on your behalf, by a concerned family member, friend or care professional such as your doctor.

If you are been assessed as eligible for services the equipment itself is free but there is a small weekly charge while it is in your home. This is a payment to Carelink for monitoring your Telecare service.

There is no cost in getting the equipment fitted and removed from your home. To arrange for someone to meet with you to give you advice and information and discuss Telecare please contact Bromley Social Services Direct on 020 8461 7777.

Individuals and family carers can also purchase telecare services themselves direct from providers without having to contact Bromley Council. Age UK Bromley, in conjunction with Help the Aged, offers a just-in-case 24-hour personal alarm, which will put you through to an operator when you push it.

Specialist older people day centres - dementia • MindCare - dementia support centres provide care during the day up to 6 days a week. There is a focus on offering stimulating activities in a friendly and welcoming atmosphere. The 3 centres are located in the Beckenham, Orpington and Chislehurst areas. For people who are unable to organise their own support due to inďŹ rmity, lacking capacity, having no one to support them or who have low income it may be more appropriate for them to contact Bromley Social Services Direct on 020 8461 7777 to see whether they are entitled to some help.

Home care services These aim to help those trying to cope in their own homes with daily activities such as getting in and out of bed, dressing and toileting. They can also help with daily living or domestic tasks like laundry, shopping and some meal preparation. For those with special needs, specially trained staďŹ&#x20AC; are available. Home care services can be provided by: â&#x20AC;˘ independent agencies; â&#x20AC;˘ voluntary agencies; and â&#x20AC;˘ individuals (using Direct Payments).

The amount of care you receive weekly will depend on your assessed needs (worked out with Bromley Council ďŹ rst) and will be delivered by a small team of carers. They must be specially trained in areas such as manual handling, ďŹ rst aid and food hygiene.

Agencies • What experience does the agency have in your particular field of need? Can they supply references for you to check?

• If this is a private contract ask for a copy of the agency s contract terms and read these carefully with someone you trust. Get as much help as you can going over it and ask any questions you may have before signing anything. The Citizens Advice Bureau or Bromley Age UK could help with this.

Personal assistants • You should expect your personal preferences, dignity and privacy to be respected. Discuss this with the agency and ask how the most suitable carers for your particular care are chosen.

• Can you talk to them before deciding?

• Carers should be fully trained or be in ongoing training. Ask the agency about their policies on this.

• You will have a care plan drawn up by the agency which the carers will work to. Ask how often this plan will be reviewed by the agency.

• Carers must be checked with the Criminal Records Bureau (CRB) and have a criminal records disclosure ‒ make sure this is the case.

Social care services for adults in Bromley In Bromley we believe that people who receive social care and support should have more choice and control over the care and support they receive and how this fits in with their lives. This means that people, whether Council or self-funded, will have equal access to services and support.

Over the last few years we have been working hard to modernise our approach to adult social care, this has included: • Provision of good quality information, advice and guidance where people live so that they can make good decisions.

• Providing good quality information, advice and guidance where people live to help them make informed decisions about their lives.

• Working with local communities and our partners to develop a range of services that promote independent living.

• Working together with service users and carers to plan solutions that meet their needs.

• Working within the community and with our partners to ensure that vulnerable people are safe and protected from abuse.

• Training and supporting staff so they have the right skills and approach to help people stay as independent as possible for as long as possible.

• Actively helping people manage risks so that they are able to make choices, keep control of their support and still be safe.

Personal Budgets Personal Budgets are a way of delivering social care to adults they are a way of allocating money to individuals who are eligible for state supported social care. The aim is that Personal Budgets help to ensure those using care services have choice and control over their own care.

Support Planning A Support Plan shows how someone is going to use their Personal Budget to meet their support needs to ensure everyone has choice and control over the shape of their support. This is known as Selfdirected Support.

Once people know how much money they will have from the council to meet their needs (known as a Personal Budget) they can develop their Support Plan. They can develop the plan themselves, with help from their family, or with help from an allocated worker such as a Care Manager or Care Manager Assistant. People can also choose their own format for their Support Plan if they wish, for example it can be in picture form, or on a CD. The Support Plan will consider if there are any risks and how these risks will be managed, who will provide the support, how you will stay in control of your life and how your Personal Budget will help you to do this. The Support Plan will also show other areas of support that are available to you, such as taking part in community activities, or help

provided by member of the family or friends.

People who are using their own money (self funders) may also find support planning helpful.

How Personal Budgets work Once it has been established that someone is eligible for social care support, they can be offered a Personal Budget which can be used to meet their social care needs. In order to plan support, we will usually tell them what the indicative budget is.

This is the amount that we think should be roughly enough to meet the person s needs.

Using that indicative budget as a guide, individuals can plan their support. They have the choice of taking their Personal Budget as a cash amount and using that money to pay for the services they want, having the local authority manage the budget on their behalf, or a mix of the two. The money can be spent in a whole range of ways which may mean paying for traditional local authority services such as home care or day care; alternatively it may mean buying services from the private sector.

Local authorities have a lot of flexibility in how much they allocate to people as Personal Budgets.

Although everyone who receives a Personal Budget is eligible for state support with social care, many are still expected to contribute financially according to what they can afford.

Direct Payments Direct Payments are financial payments made to individuals who have been assessed as eligible to receive support from Bromley Council. We can make a Direct Payment to most people who need our support, including: • people who have been assessed as needing community care services (including those with mental health needs) aged 16 and over, incorporating short as well as longer term needs; and • carers over 16 for carer s services Instead of Bromley Council arranging or providing services directly, the individual uses these payments, either by themselves or with assistance, to purchase support that they consider most appropriate to meet their assessed social care needs. Also, if a person is looking after someone else as a carer, they could also receive Direct Payments to help them in their caring role or to have some time for themselves.

Why would I want Direct Payments?

Direct Payments allow you to have more control over the decisions that affect your life. They provide more flexibility and choice, as the individual can buy appropriate support tailored to their own needs. Another option is for Adult Social Care to source a portion of the care / support needs through services commissioned directly by Bromley Council and also provide a Direct Payment to arrange those remaining services that individuals

wish to have more control over.

What can Direct Payments be used for?

If someone receives a Direct Payment, the money is used to arrange support to meet eligible needs.

Individuals may choose to employ someone directly, to buy services from an independent or voluntary sector provider or purchase equipment to help live more independently. With Direct Payments, people or agencies employed are accountable to the individual and not to Bromley Council. Direct Payments enable more control, choice and flexibility over how someone plans their support to fit with their life.

It is important that plans meet assessed needs in the best way for the individual. Therefore, provided the money is used lawfully, and eligible needs are met, the flexibility that these payments allow means it is impracticable to outline what the money can be spent on. However, there are certain items on which these payments cannot be spent, for instance: • on services that should be provided by the health service; and • on routine living expenditures: utility and household bills for instance.

Most Direct Payments are made to meet regular ongoing support needs, however they can also be made as a single payment, for example, to purchase equipment or a short respite break.

Personal assistants in Bromley People can now choose to arrange their own social care services with a Direct Payment from the Council and many are choosing to employ their own personal assistant. The Council has commissioned RCHL to build up a register of people interested in this work in order to help our service users with recruitment.

Tasks that are often performed as part of the personal assistant role are; personal care, washing and bathing, getting dressed, leisure activities, cooking and preparing food, cleaning and housework, driving, getting around, shopping, getting into and out of bed and chairs, using the toilet, assisting with medical visits. The range of tasks required depends on the ability of the service user and varies from day to day. A personal assistant does not take over control from the service user

but provides the right assistance at the right time ensuring the service user has choices and remains in control of their life.

You do not necessarily need to have experience of social care to become a personal assistant however training is arranged if required. Service users report that the best personal assistant is someone who listens well and uses common sense , as well as respecting and working within the way the service user chooses to live.

RCHL will undertake referencing, Criminal records and eligibility to work checks. Job descriptions, salaries and suitable days and times are negotiable with the individuals needing support.

Housing with care Sheltered (or retirement) housing Sheltered housing gives older people the opportunity to live an independent life in the community with some support. There are some sheltered schemes throughout Bromley, operated by housing associations and consisting of groups of flats or houses/bungalows. In most schemes a home is rented from the association, but there are also leasehold schemes, where a home can be purchased. Some schemes offer communal facilities, such as laundries.

Support is given to residents by housing association staff, who sometimes live on site and are known by various names, such as sheltered housing officer, scheme manager or warden. The level of rent and service charge vary between schemes,

according to the standard of accommodation and the facilities and level of care provided. If you are in receipt of housing benefit, this will meet the cost of the rent, but you should seek advice as to what other costs will be met by benefits.

For further information on sheltered housing schemes in Bromley and to make an application, you should contact the Borough s Housing Options and Assessments Team. You can also contact individual housing associations (although not all accept direct applications). Extra care Extra care housing provides a range of housing and care/support services tailored to meet individual needs available 24 hours a day, 7 days a week.

The amount of care provided at any time can be flexible to accommodate fluctuating needs, and can be supported by in-built smart technology or Telecare (for example call alarms or sensors to alert staff to particular circumstances, explained on page 11). Schemes are specifically designed to cater for a range of needs including people with dementia, creating an environment to support independence and wellbeing, as well as individuals having choice and control over their daily lives.

Extra care housing is provided by Education, Care and Health Services in partnership with

Affinity Sutton, A2 Dominion and Hanover Housing Associations. It provides bedsit, studio and one and two-bedroom accommodation for older and disabled people who are no longer able to live in their own home even with support and who do not need the level of help given by a care home.

Extra Care Housing nominations are allocated on the basis of an applicant s needs in accordance with Bromley Council s eligibility criteria for this type of accommodation. Following a referral to Education, Care and Health Services a care manager will arrange to visit you to assess your needs. Bromley Shared Lives Shared Lives provides care and support to vulnerable adults. The scheme recruits, trains and assesses individuals and families who can provide support within their own homes to people with special needs.

The scheme is for vulnerable adults and younger adults who live in the London Borough of Bromley, meet the eligibility criteria to access our services and need support to live independently. This includes:

• people who have a diagnosed learning disability; • people with disabilities; and • people with mental health needs.

Care homes Types of care homes Care homes provide long-term care for people who can no longer remain safely at home even with support. All care homes are registered with the Care Quality Commission There are 3 types of care home: â&#x20AC;˘ care homes that provide accommodation, meals and twenty-four hour personal care and attention but do not provide care for people who need nursing support; â&#x20AC;˘ care homes with nursing that look after people who need regular nursing care, which can only be provided by a qualiďŹ ed nurse or under the direct supervision of a qualiďŹ ed nurse; and

â&#x20AC;˘ care homes that are registered to provide both residential and nursing care, which enables a wide range of services to be given.

Some people may choose a care home that provides both residential and nursing care so that if their health deteriorates, they do not need to move.

Specialist services Promoting the User Voice Advocacy A range of advocacy support is available to people living in Bromley. Advocacy can help you to access information and services, like benefit entitlement, and to explore choices and options. Learning disability Bromley Community Learning Disability Team provides help and advice to residents of the Borough who have a diagnosed learning disability and their carers. Physical disability / sensory impairment Bromley Council provides or pays for a range of services for adults with physical disabilities and sensory impairments. Services are aimed to help them and their carers to receive the care they need to live as independently as possible.

The Council can help adults who live in the Borough aged between 18 and 64 who have a physical disability and sensory impairment.

This includes people who are living with HIV, acquired brain injury, insulin dependent diabetes, uncontrolled epilepsy, neurological conditions eg multiple sclerosis, Motor Neurone disease,

Huntington s disease, hearing loss and other conditions that make it difficult for people to live independently without help.

To ensure that services go to those in greatest need, who are at risk of losing their independence, eligibility criteria exist for those who are seeking help from Bromley Council. Priority for services is given to those whose needs have been assessed as meeting the criteria. This is discussed on page 8.

Dementia As it can be best for the person with dementia to stay in their own home for as long as possible, a range of community care services is available to facilitate this. Bromley Council can provide access to: home care; meals in the home; sitting services (which provide a break for carers); advice on equipment and adaptations; day care centres and respite care.

These services can be provided directly by registered providers to those who do not require financial help from Bromley Council, however Bromley Council will still be willing to offer an assessment of need. You may have a choice of which agency you receive your care from whether or not Bromley Council assist with the funding of your service.

If you are considering a specialist care home, remember it should be able to maintain and improve your quality of life. Depending on the degree of the dementia, you should be able to live in a care home that offers quality personal care and person-centred care. It s important to consider homes that provide nursing care in case your

condition deteriorates and you require a higher level of care. Many care homes offer specialist units with experienced nursing staff and facilities adapted to the needs of residents with dementia.

Charges for care homes There are national regulations for the financial assessment of residents who require the support of the local authority to fund their care. You will be assessed on your income, savings and investments.

Depending on your family circumstances, the value of your former home may be included in the assessment of your contribution towards the care home fees. If the council is helping you to pay for your care fees your Attendance Allowance or Disability Living Allowance (care component) will be stopped after the first 28 days in the home. You

will continue to receive Disability Living Allowance (mobility component) if you were getting it before you entered the care home.

If you have more than £23,250 in savings or other capital you will have to pay the full cost of your care home. Your care manager will give you an information pack which tells you more about this in a booklet called Paying for your Care Home . Whoever does this, whether family or a benevolent charity, they should realise that they may have to pay this for some time. Alternatively, you would have to find a cheaper home.

Understanding your rights before moving into care is essential. There are a number of financial products and specialist companies who may be able to help. It is important to seek advice before committing yourself.

Third party top-up payments Some people want a wider choice of care homes than Bromley Council can offer at their standard fee rates. You can choose to go into a more expensive home if someone else like a relative, friend or charity is willing to pay the difference between the Council s rate and your chosen home s fees. This is called a third party top-up arrangement. The person making the additional top-up payment will have a separate legal agreement with the Council and must understand that: • they must be able to keep up the payments or you could be asked to move into a cheaper home; • they must be prepared to meet the cost of future

increases in the payment when fees are reviewed; • the Council reserves the right to terminate the contract if the care home breaches the terms and conditions of the contract.

The charging regulations do not allow you to make this additional payment from your own money except in very limited circumstances, because the council has already assessed your contribution according to the rules as the maximum you can pay.

Self-funding advice If you have capital or savings of more than £23,250 you will have to pay for any care services you require but you are still entitled to an assessment of your needs by Social Services. You may also benefit from Age Concern Bromley s Support Planning and Brokerage Service. If you are arranging your own care home placement, it would be sensible to discuss (with the home) what will happen if/ when your savings have run down to below £23,250, to gain a commitment from the home that they will be willing to accept the local authority funding rates. Otherwise, you may have to move home at a time that you are feeling more vulnerable.

If you have assets of less than £14,250, your contribution will be assessed only on your income and Bromley Council meets the shortfall subject to local funding limits (see chart on page 33). Between these two figures, a sliding scale operates whereby you must pay £1 per week for each £250 you have above the lower figure.

Assuming you will be moving into care, you may be entitled to some of the following financial assistance and support, subject to an assessment of need:

Twelve-week property disregard If your former home is included in your financial assessment but your other capital is less than £23,250, and your income is not enough to meet your care home fees, Bromley Council will help with the cost during the first twelve weeks of permanent care provided they agree that care is needed.

Deferred Payment Agreements After the twelve-week property disregard period, any financial help from Bromley Council will be charged against the value of your home and recovered once your house has been sold.

However, the council may limit how much they will pay and it may affect your entitlement to pension credit if your property is not seen to be on the market and becomes treated as capital by the Department of Work and Pensions (DWP).

Attendance Allowance This is a non-means tested, non-taxable benefit from the DWP paid at the lower rate of £53.00 per week for those needing care by day or night, >>

Everyone can, and should, claim this benefit.

NHS Nursing Care Contribution Whether you are a temporary or permanent resident, if you live in a care home that provides nursing care you may be entitled to a non-meanstested NHS Nursing Care Contribution towards the cost of your nursing care. This is paid directly to the home.

NHS Continuing Care Funding You can receive continuing healthcare services in any setting, including your own home or in a care home. The NHS will pay if you need healthcare from a community nurse or a therapist as well as personal care to help you at home like having a bath or dressing.

If you live in a care home with nursing (traditionally called a nursing home ), you may qualify for the full cost of your care home fees, including board and accommodation, under the National Framework for NHS Continuing Healthcare. If you live in a residential home and need help from a registered nurse, this will be free, covered by the NHS again.

Useful information Inspection and registration of care services All care providers must be registered under a system introduced by the Health and Social Care Act 2008, which brings adult social care, independent healthcare and the NHS under a single set of essential standards of quality and safety for the first time.

The Care Quality Commission (CQC) is the independent regulator of health and social care in England. They regulate care provided through a range of methods including: • registering providers to ensure they are meeting the essential standards of quality and safety; • monitoring how providers comply with the standards; • promoting improvement in services; • using enforcement powers where necessary; and • publishing up to date information about the compliance of adult social care providers with essential standards of safety and quality.

The forums enable the continued development of partnership working between the Council and external providers with the intention of raising standards of care. The Council s Commissioners,

Safeguarding vulnerable adults In Bromley safeguarding is everybody s business A vulnerable adult is a person aged 18 years or over who may be unable to take care of themselves, or protect themselves from harm or from being exploited.

This may be because they have: • a mental health problem; • a disability; • a sensory impairment; • are old and frail; or • some form of illness.

What is adult abuse?

Abuse is mistreatment by any other person or persons that violates a person s human and civil rights. The abuse can vary from treating someone with disrespect in a way which significantly affects the person s quality of life, to causing actual physical suffering.

It can happen anywhere - in a care home or a care home with nursing, a hospital, in the workplace, at a day centre or educational establishment, in supported housing or in the street.

Forms of abuse could be physical, sexual, psychological, emotional or financial. It could also cover the issues of neglect and institutional abuse ‒ where the abuse affects more than one person within an organisation and is not addressed by the service s management.

Who might be causing the abuse?

The person who is responsible for the abuse is very often well known to the person abused and could be: • a paid carer or volunteer; • a health worker, social care or other worker; • a relative, friend or neighbour; • another resident or service user; • an occasional visitor or someone who is providing a service; or

• someone who deliberately exploits vulnerable people.

Complaints about care services If you use a home care agency or move into a care home you should feel able to complain about any aspect of your life which affects your happiness or comfort. This might be anything from the way you are treated by staff to the quality of the food you are served. You should also feel free to make comments and suggestions about possible improvements to your surroundings and the services provided.

Making a complaint should not be made difficult for you and should not affect the standard of care that you receive whether in your own home or in a care home or care home with nursing. Care services are required under national essential standards of quality and safety to have a simple and easy to use complaints procedure.

If you are concerned about the care that you, a friend or a relative are receiving, it makes sense to speak to the manager of the service about your concerns before you take any further action. The

problem may be resolved quite easily once they are made aware of it. However, if you need to make a formal complaint, you should initially contact the registered owners of the service. They have a duty to respond to any complaints made.

Healthwatch The Health and Social Care Act 2012 introduced the requirement for a local Healthwatch in every local authority area to act as the local consumer champion across health and social care from 1st April 2013.

How solicitors can help continued >> managing their own affairs should they not have a LPA. The Court procedure is presently very slow and the fees are quite expensive so preparing a LPA is always advisable, providing you have somebody sufficiently trustworthy to appoint as your attorney.

An advance directive allows you to communicate your wishes in respect of future medical treatment but it is not legally binding.

You may instead wish to make a living will, properly known as an advance decision setting out treatment that you do not want to receive in specified circumstances, which would legally have to be followed, even if you die as a result.

Any proposed Gift out of your estate needs careful consideration of the benefits, risks and implications, particularly on any future liability for care costs or tax liability.

Long-term care: whether you remain in your own home or move into sheltered or residential care, you may qualify for financial assistance in the form of social care and NHS-funded care and welfare benefits.

If you don t have your own solicitor, ask family or friends for their recommendations. Contact several firms, explain your situation and ask for an estimate of cost and an idea of time scales involved. Many firms will make home visits if necessary and will adapt their communications to meet your needs.

It s important to find a solicitor who specialises in this area of the law. The Citizen s Advice Bureau offers an advice service and will be able to recommend solicitors in your area.

Mental capacity Some people find making decisions difficult either all of the time or some of the time. This may be due to: • a learning disability; • dementia; • a mental health issue; or • a brain injury or a stroke.

The Mental Capacity Act 2005 is there to protect people over 16 who find it difficult to make decisions due to a learning disability or a mental health condition, or for any other reason. When someone is no longer able to decide, the Act intends to protect people who lose the capacity to make their own decisions. Specifically, it: • allows the person, while they are able to do so, to appoint someone - for example a trusted relative or friend - to make decisions on their behalf once they lose the ability to do so themselves. This includes decisions on the person s health and personal welfare. Previously, the law only covered financial matters;

• provides a checklist for decision makers. This ensures that decisions are in the best interests of the person on whose behalf they are made; and • introduces a Code of Practice for people such as healthcare workers who support people who have lost the capacity to make their own decisions.

People with no one to act for them will also be able to leave instructions for their care under the new provisions.
