CAPE TOWN LUXURY MARKET REMAINS BUOYANT AS STOCK SHORTAGES INTENSIFY Cape Town’s luxury residential property market continues to resist the traditional winter slowdown, with sustained strong demand, limited stock and strong international interest driving activity across the Atlantic Seaboard, City Bowl and Southern Suburbs. The market is increasingly defined by a shortage of homes for sale rather than a lack of buyers. Well-located, prime properties are often selling within days of listing, frequently attracting multiple offers and, in some cases, achieving above asking price. Recent activity includes the sale of a Constantia home for its full R48 million asking price to an international purchaser who bought the property without viewing it in person, highlighting growing confidence among foreign buyers. The strongest demand remains concentrated in the R20 million to R70 million-plus segment. Along the Atlantic Seaboard and in the City Bowl, supply continues to lag demand, particularly in Clifton, Camps Bay, Bantry Bay, Fresnaye and Higgovale. Exacerbating the stock shortages, upmarket beachfront homes, luxury villas and premium apartments remain tightly held, while the redevelopment of older properties is further reducing the supply of standalone homes. In the sought-after Southern Suburbs, Constantia and Bishopscourt continue to attract both local and international buyers, particularly from Europe and the United States. Quality, family homes in Constantia now generally start at around R20 million, while upmarket homes in Bishopscourt typically begin from R30 million to R35 million, with robust demand extending well beyond R50 million. Beyond the city, demand remains healthy along the Southern Peninsula and West Coast. Noordhoek, Kalk Bay, St James and Scarborough continue to attract strong buyer interest, with a notable proportion of luxury sales exceeding R10 million. On the West Coast, Yzerfontein and Langebaan Country Estate remain among the most sought-after locations. Against this backdrop, we expect demand to remain resilient through winter, supported by lifestyle appeal, international interest, and ongoing stock shortages across Cape Town’s prime residential markets.

Buying property in South Africa: A guide for foreign and non-resident purchasers
South Africa continues to attract international property investors seeking lifestyle, residential, and commercial opportunities in one of Africa’s most established real estate markets. While foreign nationals may generally acquire immovable property in South Africa, understanding the regulatory framework that governs property ownership and transactions is imperative. A clear understanding of these requirements can help foreign and non-resident purchasers navigate the process confidently while avoiding unnecessary delays. Can foreigners purchase property in South Africa?
FICA compliance and source of funds
There is currently no law that generally prohibits foreign nationals or non-residents from owning immovable property in South Africa. Foreign purchasers may acquire residential, commercial, and other forms of property, subject to compliance with applicable laws. Crucially, property rights in South Africa are protected by section 25 of the Constitution, while ownership of immovable property is formally transferred through registration in the Deeds Registry in accordance with the Deeds Registries Act.
Property transactions in South Africa are subject to the Financial Intelligence Centre Act (‘FICA’), which forms part of the country’s anti-money laundering and counter-terrorist financing framework. Conveyancing attorneys and estate agents that qualify as accountable institutions are required to verify the identity of their clients and apply due diligence measures. Foreign and non-resident purchasers should therefore be prepared to provide valid identification, proof of residential address, and information relating to source of funds, where the purchase price exceeds a determined threshold.
Importantly, however, purchasing property in South Africa does not confer citizenship or permanent residence.
Tax registration
Understanding exchange control requirements The Currency and Exchanges Act and accompanying Exchange Control Regulations regulate the movement of capital into and out of the Republic. While foreign nationals and non residents are free to purchase property, buyers should ensure that acquisition funds are transferred through authorised dealers, typically South African commercial banks authorised to deal in foreign exchange. Foreign purchasers should retain documentary proof of inward fund transfers, which is usually required to repatriate the proceeds of a subsequent sale.
While tax registration is not necessarily required in every case, foreign purchasers should engage with their conveyancer at an early stage to establish whether SARS registration, verification, or other tax requirements must be satisfied before transfer can proceed.
Transfer duty Transfer duty is a tax imposed under the Transfer Duty Act and is typically payable by the purchaser unless the transaction is subject to Value-Added Tax (VAT). The applicable transfer duty rates are determined by legislation and increase on a sliding scale.

Municipal compliance requirements Before a transfer can be registered, section 118 of the Local Government: Municipal Systems Act generally requires the issuing municipality to provide a rates clearance certificate confirming compliance with the statutory requirements for transfer.
Transfer costs The transfer of ownership must be registered in the Deeds Registry by a duly admitted conveyancer. Purchasers are typically responsible for conveyancing fees, deeds office charges, and related costs associated with the transfer process.
Tax considerations when selling property Foreign and non-resident purchasers should also understand the tax implications that may arise when they eventually dispose of South African property. Specifically, capital gains arising from the disposal of immovable property may be subject to capital gains tax under the Income Tax Act.

In addition, when a non-resident sells immovable property for more than R2 million, section 35A of the Income Tax Act requires the purchaser to withhold a portion of the purchase price and pay it to SARS on behalf of the seller. The current withholding rates are: ↘

15% where the seller is a trust.
This withholding is not a separate tax. Rather, it serves as an advance payment towards the seller’s potential South African tax liability and may be credited against their final tax assessment.
