The City of New Westminster’s utility rates will be increasing in 2011 costing the average single family home $70.61 more per year. Council has given approval in principle to the proposed rate increases for the electrical, water, sewer and solid waste utilities. Property owners are facing an 11 per cent increase to water, a 5.4 per cent increase to sewer and a 7.5 per cent increase to solid waste, with the average single family home seeing an increase of $70.61. Utility rates are adjusted annually to pay for the operating costs of the utilities, the maintenance and replacement of utility infrastructure and equipment, and to ensure adequate reserve balances. A staff report notes that 11 per cent increases are proposed to water rates to fund the increased cost of bulk water purchases from the Greater Vancouver Water District and to address ongoing replacement of the city’s aging water system infrastructure. Water rates are expected to increase from nine to 10 per cent annually until 2015, a cost that’s driven by projected increases in purchasing water from the region and for meeting the capital replacement requirements. “We are only passing on what we absolutely have to from the GVRD,” said Coun. operating in the rail yard adjacent to the Quayside neighbourhood. The intent of that settlement was to reduce, and ultimately eliminate the unreasonable noise and vibrations being generated by nighttime operations, for the benefit of the community. In April 2010, the Quayside Community Board filed a new noise and vibration complaint. It has requested that the Canadian Transportation Agency issue an operating guide for the rail companies that restricts operations in this rail yard to between 7 a.m. and 11 p.m., as the railways were not following the mediated settlement. James Crosty, president of the Quayside

Community Board, said the residents’ association has had to contend with “overpowering legalese” presented by the railways. “We are going through the minefield of legalese in order to get a solution to the problem,” Crosty said. “We don’t care about process, we just care about results. A man and a woman in a cube van caused a head-on accident on the Queensborough Bridge on Sunday that sent two people to hospital. The incident began around noon, when a New Westminster police officer on routine patrol observed that a security gate had been rammed through at an abandoned mill on Duncan Street in Queensborough. The officer then saw a man and a woman loading items from the mill into the back of a large cube This story first appeared on www.royalcityrecord.com van which was parked with the engine running. The officer called for assistance but before help could arrive, the two got into the van and fled, clipping the back of the parked police car before exiting onto Duncan Street. According to Staff Sgt. Mike Kelly of the New Westminster Police Service, the officer continued following the van through Queensborough. “At Ewen Avenue and Howes Street,

Meanwhile, another New Westminster officer saw the van continue on Boyd Street and soon afterwards, the driver of the van drove into oncoming traffic on the southbound exit lane from the Queensborough Bridge.

The cube van drove head-on into a Mazda pick-up truck which had been travelling over the bridge. The man and woman both got out of the van and fled on foot, with the man apprehended quickly and the woman located 15 minutes later with the assistance of police dogs. The driver of the Mazda pick-up is currently in hospital in serious condition. A 75-year-old woman who was in the vehicle which was initially hit on Ewen

Avenue is also in hospital with less serious injuries. ‘Green’ vehicles get OK Neighbourhood zeroemission vehicles have lower speeds, fewer safety features

The City of New Westminster is paving the way for zero emission vehicles to drive on city streets. Council has directed staff to prepare an amendment to the street traffic bylaw that would allow the use of neighbourhood zero emission vehicles (NZEV) in New Westminster. A staff report said the low speed vehicles (LSVs) must have an attainable speed of 32 km/h but are federally regulated to travel at a maximum speed of 40 km/h. “The safety requirements for NZEVs follow the same Transport Canada standards as other LSVs,” said the report. “They are intended for short trips and have many car-like features such as brake lights, seatbelts and mirrors but are not required to meet crash safety standards of mainstream automobiles.” According to the report, the province amended the Motor Vehicle Act in 2008 to limit low speed vehicles to roads with a posted speed limit of 40 km/hour or less but also permitted municipalities to amend bylaws to allow neighbourhood zero emission vehicles on city streets with speed limits of more than 40 km/h but not

Campbell: Tough times for premier Ipsos-Reid poll conducted for Global TV spells disaster for Campbell at every turn. Recent polls have been troubling for him in recent months, but this one is particularly bad because it comes as a direct response to his attempt at giving it his “best shot.” The poll revealed that even the income tax cut was greeted with nearambivalence, as just 26 per cent said they “strongly supported” it. The response to questions about his explanation of the HST and of impressions of his leadership show he connected with less than 15 per cent of the audience. But, to again demonstrate the NDP’s unerring ability to make blunders even while its political opponent is in complete disarray, NDP MLA Leonard Krog goes on Shaw Cable’s Voice of B.C. program that evening and compares Kevin Krueger to

Joseph Goebbels because of his unswerving loyalty to the premier. Krueger, he says, would be the “last one out of the bunker.” The tasteless and offensive remark did not go unnoticed by the B.C. Liberals. Friday, Oct. 29: Krueger demands an apology from Krog, who duly offers one to him, as well as to Campbell and the Canadian Jewish Congress. Krog has learned what can happen when you violate a cardinal rule in politics: never, ever compare anyone or anything to the Nazis. And so the week that was came to an end. But what is not ending are the whispers within the heart of the B.C. Liberal government that some big changes are needed. And the whispers are becoming louder. Your editorial “Sounds like a good ruling – unless it hits you” (Our View, The Record, Oct. 16), is patently ignorant and erroneous, an egregious dereliction of your moral, ethical and professional duty to disseminate fact-based and informed opinions. The long awaited trilogy of Supreme Court of Canada decisions – R. V. Sinclair, 2010 SCC 35; R. V. McCrimmon, 2010 SCC 36; and R. V. Willier, 2010 SCC 37 – released simultaneously on Oct. 8, 2010, revisited the nature and limits of Section 10(b) of the Charter of Rights and Freedoms, which states in part, “Everyone has the right on arrest or detention, to retain and instruct counsel without delay.” The appellants argued for the Supreme Court of Canada to dramatically and significantly broaden the interpretation of S.10(b) to guarantee the right of an adult detainee after their initial access to counsel, to have counsel present and continued access to counsel during a custodial police interview. The court rejected the appellants’ arguments in 5/4, 5/4 and unanimous decisions (respectively), de jure placing the onus on the adult detainee to exercise their right to silence found in Section 7 of the Charter of Rights and Freedoms and to diligently exercise their right to counsel. These are rational and logical decisions affirming detainees are not only protected by inalienable rights enshrined in the Constitution, common law and case law,

but that they also have legal responsibilities. Therefore, your statement in the subheadline that the Supreme Court “ruling erodes a very important right” is wrong. And your assertion, “In fact, it’s a worrying erosion of freedom” is, at best, fearmongering. In fact, there never existed a “right” expressed or implied in the Constitution, common law or case law to have counsel present, or continued access to counsel, during a custodial police interview after the detainee has initially exercised their right to counsel. The three court decisions simply rejected a broad interpretation of S.10(b), thereby not introducing new rights. Furthermore, your statement, “A conviction based on that interrogation is perfectly valid” is false as no trier of fact will find guilt based solely on the fruits of a voluntary warned statement. Finally, your claim, “In the pursuit of a confession, police interrogators can veer into legally dubious territory (without counsel present)” is not only ambiguous, but suggests police are ignorant of the law governing this area or, worse, intentionally attempt to subvert it. Rest assured, a voluntary warned statement that is not recorded by audio or audio and video, whereby the trier of fact can determine if it was obtained legally, will likely be inadmissible as evidence. I encourage everyone to go online to the Canadian Legal Information Institute at www.canlii.org, read the reasons for judgment and formulate an individual opinion.

Transit changes on radar screen in city

There are two major projects being considered that could significantly increase the flow of traffic along East Columbia and Front streets in New Westminster. Along with plans to replace the aging Pattullo Bridge and change the access point to the bridge by about 100 metres, from Royal Avenue to Front Street, the North Fraser Perimeter Road is another project that could impact the busy eastwest corridor. To provide information on the North Fraser Perimeter Road project, TransLink is holding a public meeting on Nov. 18, from 5:30 to 8:30 p.m., at the Justice Institute in New Westminster, and on Nov. 24, from 5:30 to 8:30 p.m., at Place des Arts in Coquitlam. The plan is to allow for better movement of goods and people along the corridor, said TransLink spokesperson Ken Hardie. “There are things New Westminster would like to see in making it a more effective corridor,” Hardie said. Creating road plans that allow goods to move efficiently helps decrease the cost of transporting goods, which helps the economy, Hardie said. The City of Coquitlam website states that key components of the North Fraser Perimeter Road project include: ◆ Intersection improvements at United Boulevard; ◆ Extending United Boulevard to connect with Brunette Avenue; ◆ A second eastbound lane along Columbia Street; ◆ A tunnel for trucks between Columbia East and Front Street. Hardie said the upcoming public meetings would provide more context and details than the Coquitlam website. The

website included an image of the plans, though Hardie cautioned that the map on Coquitlam’s website is a “very broadbrush overview” of the North Fraser Perimeter Road. “While it would give your readers a reasonably good notion of the special relationships, it doesn’t provide the fine detail on the options that we will have by the time the consultation sessions are held and, because the lines are so broad, may create needless concern over community impacts,” Hardie wrote in an e-mail. “It also doesn’t appear to integrate possible Pattullo Bridge changes into the mix.” Decisions on the North Fraser Perimeter Road project and the long-awaited Evergreen Line are facing a year-end deadline to have funding agreements in place with the provincial and federal governments, TransLink says. Last month, Metro mayors on TransLink’s advisory committee said they were not willing to raise property taxes to pay for TransLink’s portion of the projects. The TransLink board said the public will be offered two “program options” to consider: ◆ One option, which includes the Evergreen Line and Phase 1 of the North Fraser Perimeter Road, means TransLink would need to raise additional revenues of $39.3 million a year, beginning in 2011. ◆ The second option, which includes the Evergreen Line, Phase 1 of the North Fraser Perimeter Road plus additional priority projects, means TransLink would need additional revenues of $68 million a year, beginning in 2011. Through public consultation, TransLink will be able to understand the public’s appetite for proceeding with either option, as well as their preferred source of funding for the supplement, TransLink says.

Two three-storey buildings are the latest components proposed for the Port Royal Development in Queensborough. The Aragon Group has applied to rezone sites on Brookes Street to pave the way for construction of two three-storey apartments that would have 57 residential units. “The applicant has identified an area of the housing market not

Current zoning allows 45 units per acre (71 units per acre are proposed), 37 units (57 are proposed), a fourstorey building (three-storey buildings are proposed), maximum 57,000 square feet of floor space (51,960 are proposed), and 40 per cent site coverage (51.2 per cent site coverage is proposed at

215 Brooke St. and 46.4 per cent is proposed at 245 Brooke St.). “Two things to note in the comparison are that first, the unit per acre and the number of units are higher in the proposed development; however the floor space and the height are lower in the proposed development. This reflects the smaller units proposed,” according to the staff report. “The second area to highlight is site coverage. The higher site coverage reflects that the pre-

Doubt a must-see W

hile the world around me was busily preparing for Halloween evening, I took a hiatus on Sunday afternoon and went to the Vagabond Players’ production of Doubt. I came out saying to my husband: “I have got to write about this one, so more people go see it!” So here I am, to urge you to check out the production at Bernie Legge Theatre in Queen’s Park. For those not familiar with John Patrick Shanley’s Pulitzer Prizewinning drama, it tells the story of a nun, Sister Aloysius, who grows suspicious of the parish priest, Father Flynn – in particular of his behaviour towards a new male student. The compellingly written drama takes the haunting “what if” scenario and slowly builds layer upon layer of doubt, bringing a tangled web of motivations and questions to life through the characters of Father Flynn (Rob Egger), Sister Aloysius (Marianne LaRochelle), Sister James (Carline Lemire-Steel) and the student’s mother, Mrs. Muller (Nyasha Ketedza). In the hands of director Judi Price, the actors reach deep and draw out the nuances of their characters. Egger, from his opening monologue, was immediately believable as the likable, impassioned young priest out to make a difference in the post-Vatican II church in the Bronx. (In fact, he was so convincing that both my husband and I found ourselves nearly making the sign of the cross along with him as he wound up his first sermon.) As his nemesis, Sister Aloysius, LaRochelle was equally strong in her portrayal of the stern disciplinarian with the unbending moral sense. Between them, Lemire-Steel brought the required innocence and freshness to her role as the conflicted young teacher who wants to believe the best of everyone. Price has created a tense, taut drama that begins deceptively slowly and innocently, taking us

Think of The Sound of Music, and chances are a picture comes to mind of seven impish children who are being raised by their widower father and who have scared away a succession of governesses. They are, of course, redeemed by the arrival of Maria, a would-be nun whose life is changed by being sent to take charge of the von Trapp family. Their story – the Broadway play and screen musical loosely based on the true-life story of Maria and Georg von Trapp – has become one of the most beloved musicals of all time. When Footlight Theatre brings it to the stage in Burnaby – it’s on at the Michael J. Fox Theatre from Nov. 5 to 20 – some Royal City talent will be helping to make the magic happen. It’s a drama well-suited to the intimate space of the Bernie Legge Theatre, and the simple staging worked effectively to take us into the world of St. Nicholas’s Parish. Douglas College’s first loss of the season proved a costly one for the former No. 1-ranked men’s soccer team in the country. The Douglas Royals were upset in the semifinals of the B.C. Colleges’ provincial championship 2-1 by fourth seed University of Northern B.C. last Saturday at Newton Athletic Park. “You have to have a bit of luck and in this game lady luck shone for the Prince George team. That’s life and we move on,” said Douglas head coach Joe Ormerod. “In the bronze game we came

out and played good soccer. We were fully worthy of the bronze.” Douglas won the third-place final game 2-1 over Thompson Rivers University on goals by Adam Bingham and Marinko Maras on the Sunday. New Westminster keeper Dylan Myers got the win in the Royals goal. Vancouver Island University defeated UNBC in the provincial final 3-0 to earn a berth into the Canadian Colleges’ national final. “Of course we are bitterly disappointed, but that’s sport,”Ormerod said. ◗Soccer Page 19

Sixth-seeded Burnaby South Rebels upset the Alpha Aztecs 5-2, while Burnaby Mountain got a late game-winning strike from Michael Anderson to get by the Moscrop Panthers 3-2 at Burnaby Lake Sports Complex-West Monday. The two winners will play off against regular season champion Burnaby Central Wildcats and runner-up Cariboo Hill Chargers today after school, (Nov. 3). Mountain will face the Chargers at Cariboo Oval, while South will tangle with the Wildcats at Burnaby Lake West. Both games are 3 p.m. starts. The BurWest banner match will be held on Friday at Burnaby LakeWest, Field 4, beginning at 4 p.m. The Rebels looked the higher seeded team throughout the match, enjoying a greater advantage of the play despite Jason Deo’s opening goal for the ’Tecs. Faisal Arif tied the score with a sure left-footed strike later in the half. The Northwest Giants fell out of first place in the B.C. Amateur major midget hockey league following a pair of weekend losses to Greater Vancouver. The Giants fell 3-2 to the Greater Vancouver Canadians at the University of B.C. Thunderbird Winter Sports Centre on Saturday. They then dropped a 2-1 decision to the Canadians in Ladner on Sunday. The losses left the Giants in third place behind both Greater Vancouver and the Cariboo Cougars. Cariboo moved into second spot with back-to-back wins over the Okanagan Rockets. In Saturday’s game, Alex

Kerfoot kept up his torrid scoring pace in the 11-team loop, tallying his leaguehigh 15th and 16th goals of the season. Kerfoot also factored in the Giants’ only goal by Jackson Houck in Sunday’s loss. Kerfoot leads all scorers with 16 goals and 32 points. Sam Reinhart, who is second in overall scoring with 22 points, 10 behind his second-year teammate, also assisted on Houck’s goal.
