Court rejects public trustee scammer’s appeal Jane Seyd

A panel of appeal court judges has rejected the appeal of a man sentenced to six years in jail for scamming elderly clients out of more than a million dollars while he was supposed to be taking care of their financial affairs. On Tuesday, the B.C. Court of Appeal rejected Bryan Tickell’s sentence appeal, saying nothing had convinced the court Tickell’s six-year jail term was too long. “I am not persuaded that the length of sentence was excessive in the circumstances,” wrote Madam Justice Pamela Kirkpatrick. “These offences were, as the sentencing judge found, ‘profoundly dishonest and manipulative.’ “Mr. Tickell embarked on a devious scheme to defraud one of the most vulnerable segments of society and abused his position of trust to effect his objective. In doing so, he harmed both his victims and his employer, whose very core rests on trust and integrity, values which he had sworn to uphold.” Tickell, 31, a former caseworker with the Office of the Public Trustee, was handed the jail sentence a year ago by Judge Tony Dohm of the North Vancouver provincial court after pleading guilty to fraud, breach of trust and forgery. A man who opened fire with a handgun on a crowded West Vancouver street while fleeing from a jewelry store robbery has been sentenced to six years in jail. Jeremy Winger, 25, pleaded guilty to using a restricted firearm in the commission of a robbery and to unlawfully discharging a firearm while being reckless to the safety of another person.

Both offences carry a mandatory minimum five-year sentence. Just after 11 a.m. on Jan. 19 of this year, Winger and two other men entered Absolute Star Design on the 2400-block of Marine Drive. Winger produced a 9-mm semi-automatic handgun, pointed it at owner Gino Giragosian and ordered him to the floor. The trio smashed the store’s display cases, stuffed roughly $300,000 worth of jewelry into their bags and then ran back to

their getaway car, parked nearby in the busy Dundarave shopping district. Giragosian grabbed a can of bear spray and chased the robbers into the street. The owner wasn’t able to spray them — he took the worst effects of it himself — but his determined pursuit so alarmed the three that Winger turned and fired two shots. In an interview with West Vancouver police, Winger later said “I just wanted to scare him. I didn’t want him to spray us. I could have shot him; I didn’t. I didn’t want to hurt anyone.” See Robber page 3
