250-751-1223 In parts 1-5 of this cycle we learned how to find a right Realtor , what to do and not to do looking for a new house and how to determine a right price to put into offer for the property you like. What else should you put in your offer besides the price? Completion and possession dates (when the money changes hands, and when you get the key to your new house). Of course, in an ideal world it would be the same day - really, why not get this key right after the money is paid? But in reality, because of the title office and lawyers’ hours, money transfer details, etc, it’s usually 24 or even 48 hours apart. A very important part of your offer is the subject (or condition) page. There are many more of them than you can possibly imagine (including, believe it or not, your wife’s/husband’s approval of your choice of the property) and a good Realtor will explain in detail which of them should be used for your particular situation. Below I just put the most general ones. a. A building inspection. I would strongly advise to ALWAYS use this subject and always to do an inspection with a licensed and INSURED inspector. Yes, it even applies to a brand new house which comes with a warranty. That so-called 2-5-10 year warranty doesn’t (to say the very least!) cover your brand new house “bumper-to-bumper” and believe it or not, if eventually the wall in your living room starts to curve... by just a couple of feet!... it’s not covered, because ... read the fine print in that New Home Warranty brochure. So it’s much better to do a building inspection on a brand new house too! But what about your uncle Bob, who knows everything about construction and can save you ~$400 by checking everything himself? What a good idea, except... can you imagine taking uncle Bob to court down the road, if he misses something really costly to fix in your new house? So you might consider bringing your uncle first and if he finds a major problem - cancel the deal, if not - still bring a licensed inspector. b. YOUR (!) satisfaction with the title search. This subject is very often ignored by potential buyers, because “my lawyer will check it anyway, right?”. Right, it will be checked... after it’s too late to cancel the deal if something wrong is found on the title, like an easement in the middle of your backyard, or a condition that you have to allow your next-door neighbor to drive across your front yard ... or the sky is the limit - the title may have tons of “surprises”, so check it BEFORE removing subjects. c. Property Disclosure Statement... it’s the paper when in most cases sellers will declare they don’t know anything wrong about their house... what do you need this paper for? To later take them to Court IF (!!!) you are able to prove they knew, but didn’t tell you, about a major problem. How often does it happen in real life? Let’s put it this way... not very often. d. Financing. I can’t stress enough the importance of this subject, that’s why I wrote an entire article dedicated to it (read Part 3 at www.victor-k.com)! As I mentioned above, you can add many, many other subjects, but don’t overdo it. The fewer subjects you have, the stronger your offer looks in the eyes of the sellers. And the stronger your offer, the better price you might get. OK, so you signed an offer and your Realtor sent it to the listing Realtor (who represents the seller). What happens next? The seller may either accept your offer (~10% of the time), bluntly reject it (usually when it’s insultingly low, happens in ~5% of all cases) or in most cases, counteroffer it. Not just with a different price (of course, higher than your offer!), but sometimes it’s a different completion date (you want a possession in 3 weeks and he wants it in 3 months), sometimes it’s about included items (“at this price the buyer isn’t getting my almost new high-end fridge!”) or even the size of the deposit (“I’m not going to take my house off the market for 2 weeks with a $5,000 deposit. If the buyer is serious, he will do at least $10,000”) Guess what your options are after receiving this kind of a counteroffer? They are the same: you can either accept it, or reject it... at least for now! or counteroffer again... and again... and again... until you are either happy with the price and conditions... or decide to walk away... or meanwhile find another house you like...
