Driver faces day in court
Trial for woman charged in 2008 crash that killed Alexa Middelaer, 4, begins Monday BY

The trial of the woman charged in connection with the crash that claimed the life of four-year-old Alexa Middelaer begins Monday in Surrey Provincial Court. Carol Ann Berner was charged with impaired driving causing death, impaired driving causing bodily harm, dangerous driving causing death and dangerous driving causing bodily harm following
the May 17, 2008 accident in the 4300-block of 64th Street in East Ladner. It was around 5 p.m. that day when Alexa and her aunt had stopped to feed horses while the child’s grandparents waited in a nearby car. That’s when a vehicle, allegedly driven by Berner, heading northbound on 64th Street, struck the parked car, then veered into Alexa and her aunt, killing the little girl and seriously injuring the aunt.
Berner remained at the scene and took a breathalyzer. Police at the time said speed and alcohol were factors in the crash. Later that year, after a lengthy investigation, Delta police announced that Berner would face criminal charges. Berner, through her lawyer, later admitted she caused the death of Alexa and injuries to the aunt, but has pleaded not guilty to the impaired driving and dangerous driving charges.
Berner elected to be tried by judge alone. The trial begins at 9:30 a.m. A Facebook group with over 300 members dedicated in memory of Alexa says she’s remembered by her family as a loving child who embraced life with vigour and zeal and took delight in everything she did. Since the crash, Alexa’s parents, Michael and Laurel Middelaer, have become outspoken advocates against drinking and driving.
