T
he threat of flooding in Chilliwack came and went on the weekend with little or trouble or damage. A flood watch warning was issued Saturday evening and was maintained Sunday morning for the Fraser Valley due to heavy rains. But that warning was downgraded to a high streamflow advisory by Sunday afternoon and cancelled altogether Monday morning. Despite the torrential rains Sunday morning, as far as City of Chilliwack public works was concerned, the rainfall wasn’t as heavy as expected and things went smoothly. Seventy millimetres of rain fell on Sunday, according to Environment Canada numbers, although Chilliwack relies on data from EB IRST Agassiz as there is no First reported on monitoring station chilliwacktimes.com in the city. Ditches backed up and there were approximately 30 calls to deal with on Sunday, mainly to do with road drains blocked with leaves and a few blocked culverts, according to MacPherson. There were “a couple of flood basements,” but no real damage to private property, he said.

A
ndrew Dent came to Canada 16 months ago wanting to work, learn and eventually travel south. He ended up getting ripped off by a Chilliwack landlord and staying far longer than intended while he pursued his case through the provincial housing dispute agency. He’s gearing up to head south to the United States soon, but first Dent—who himself is a landlord back home in Australia—is urging other renters to stand up for their rights. Dent grew up on a farm in Australia and came to Canada on a two-year working holiday permit to learn about natural organic practices and to work milking cows and picking fruit. After a stint in Saskatchewan, he came back to British Columbia because it was “nice and pretty and warm.” By the time he reached Chilliwack last winter, he had met so many Canadians that his guard was down when he and his sister agreed to rent a pair of rooms at a Fraser Avenue boarding home in February. The owner, Premkaur (Bobbie) Singh, took a total of $900 from Dent; four-week’s rent along with the standard damage deposit of half-amonth’s rent. He also later met other tenants who claimed to have had similar experiences with Singh, who has since sold the building. Carla Turgeon was one of those renters. A mother of two, Turgeon moved into a Broadway apartment just down from Dent’s future home in 2005. After eight months, and a change of ownership in the apartment, she was forced out and her damage deposit wasn’t returned. Turgeon, though, fought back and after going to the residential tenancy branch and then small claims court, she was awarded $2,450—not quite the $3,600 she sought, but a victory nonetheless. Turgeon said the $50 fee charged to start dispute proceedings likely discourages claims. “People on welfare, they don’t have 50 bucks to fork out and wait four months to get back,” she said. “Ten years ago I wouldn’t have been able to do this because I was a single mom, raising my son on $1,200 a month.” But on more solid financial footing, Turgeon fought back, in large part because of a belief that “if people don’t do something about this, she is going to continue to do this.” So she went to court, won her case, then wrote letters to the editor encouraging others to take up the cause. Angered by what he saw as a pattern of deception, and encouraged by Turgeon, Dent began down the long road through the Residential Tenancy Branch’s dispute resolution procedure. ‘Crappy’ month for C real estate market
BY PAUL J. HENDERSON phenderson@chilliwacktimes.com hilliwack real estate sales are down as are rental vacancy rates but new home construction is on the rise. Over the first 11 months of 2010, housing starts rose 98 per cent in Chilliwack over 2009, according Canada Mortgage and Housing Corporation statistics. So far this year there have been 337 single detached homes started, compared to 208 in 2009. But
more dramatic is the 346 multiple starts in 2010, up from just 137 in 2009. The local starts aren’t unique and can be seen in communities across the Lower Mainland, with the City of Vancouver seeing a 197 per cent increase in starts. Abbotsford was up 42 per cent. While a lot of ground may have broken last month in Chiliwack, not many deals were signed as home sales were down 37 per cent from the same month last year. There were a total of 123 residen-
tial properties that changed hands in November, down from 195 in November 2010. That doesn’t surprise Chilliwack and District Real Estate Board president Kyle Hislop, who said the last half of 2009 was “really strong.” “Sometimes you have to call a spade a spade,” he said on a blog posting. “November was a pretty crappy month for real estate in Chilliwack if you were a home seller.” As far as rental properties go, Chilliwack’s apartment vacancy
rate was 6.4 per cent in October, a drop from 7.9 per cent in October 2009. Townhouse vacancy rates were also at 6.4 per cent but that was a move in the other direction as the number was 4.5 per cent last year. Provincewide, the vacancy rate was 2.7 per cent in October in B.C., compared to 2.8 per cent in October 2009. Average rent in B.C. for a twobedroom apartment was $1,019 per month in October. In Chilliwack it was $743.

ormer City of Chilliwack director of development Grant Sanborn will have to wait more than a year for his breach of trust trial to begin. Proceedings on three breach of trust charges against Sanborn are scheduled for Feb. 27, 2012, according to Neil MacKenzie, a spokesperson for the criminal justice branch

of the attorney-general’s ministry. The charges are in connection with development deals approved at Chiliwack city hall between 1991 and 2002. The long delay is due to the number of trial days needed and the scarcity of court time. On Nov. 1, Judge Kenneth Skilnick agreed with the joint request from defence and Crown for a 20-day trial. At that time Michael Shirreff was in court on behalf of special prosecu-
tor Robin McFee and told the court between 10 and 15 witnesses would be called. “Court time is scarce around here,” Skilnick told the lawyers. The three charges against Sanborn were announced June 25 after a lengthy investigation by McFee. Chilliwack MLA and former mayor John Les was cleared of criminal wrongdoing in connection with the land deals in question. Two of the three charges fac-
ing Sanborn are connected to Les’s Rosebank development. The third charge relates to a project built by prominent current developer and former township alderman Eldon Unger. The allegation is that Sanborn approved the Chilliwack Mountain subdivision The Trails at Longthorn Creek without requiring Unger to comply with Ministry of the Environment conditions. In the same courtroom back on Nov. 1, Sanborn pleaded guilty to
two unrelated charges of fraud and using a forged document from his time as a development consultant in Chilliwack. The first charge alleges that Sanborn defrauded a client out of $1,763. The second charge alleges that Sanborn “did use or deal with a document letter” from the Agricultural Land Commission “as if it were genuine knowing the said document to be forged.” On that matter Sanborn will be sentenced on Feb. 17.

Fighting back RENT, from page 3 important part. “Normally I would just leave it,” he told the Times. “But because I feel we were victimized, we were easy [targets] because we were travelling, that we would move on, I think they though they’d get away with it easy.” Dent’s sense of right and wrong had been offended and he wouldn’t let it go. “I hate prevailing evil or just not calling a spade a spade.” The process could have been completed quicker, he said, but Dent, who owns his own home and has tenants back in Australia, took his time putting his case together in order to make sure everything was in place. “I didn’t want to stuff it up,” he said. While Dent didn’t have a written agreement—he said “I met so many nice Canadians I didn’t think it was necessary”—he did produce a file of documents including long written account of his interactions with the landlord and her representatives, along with bank statements and nine appendices. Singh, along with her agent and property manager—a Mr. P and Ms. L, respectively—meanwhile maintained that no deposit had been paid, a claim that dispute resolution officer P.J. Nadler deemed unlikely given Dent’s migrant status. “That when considered in the context of [Singh’s] evasive argumentative demeanor and inconsistent versions of the events compels me to reject her evidence,” wrote Nadler. The officer sided with Dent, who “testified in a clear forthright manner and provided concise and articulate written submissions.” Last Wednesday, Dent was awarded $421—less than the $600 to which the original officer told him he was entitled—to be paid, strangely enough, in $75 installments. He is pleased with the outcome, although he would have liked to have received the full amount back immediately. “Surely if someone like myself, travelling on a budget can have to pull out that much for a damage deposit, they should be able to give it back.” While Dent is preparing to meet up with relatives in the United States, the experience hasn’t dimmed his view of the Great White North. Indeed, he says that while travelling he met people who experienced similar problems in Australia. But before he heads south, he’s encouraging others in his position to fight back. “I hope people stand up for their own rights, what they feel is right, or else it will keep on happening,” he said. “The more people who do it, the less it will happen because they know people will stand up for themselves.”

Victor Froese of the newly-formed Vedder Mountain Preservation Group (VMPG) said he and Walter Neufeld spent the weekend culling signatories to the letter who were not Chilliwack residents or Chilliwack property owners. Froese said he also wanted to “correct the impression” that those opposed to the Kirkness Pacific Holdings (KPH) proposal were just from Yarrow. “[Yarrow] happens to be close to the development site,” he said. “The breakdown is fairly balanced: approximately 52 per cent Yarrow residents, 48 per cent Chilliwack residents.” Froese said the letter—not technically a petition, he said—was dropped off at city hall along with a copy of a report prepared by Madrone Environmental Services, which found a number of holes in the Kirkness proposal. Public relations in a freefall
T
here is much to envy in New Orleans despite the impact of Hurricane Katrina a while back. The food is absolutely spectacular. It’s home to one of the best music scenes in the world. Mardi Gras is probably the biggest party in North America and the people, most of them, are friendly to a fault. It’s a different picture when we throw in the local police however. New Orleans law enforcement has been horrifically corrupt and problematic over the years. Things were so bad that during the 1980s the tourist bureau actually put out literature warning visitors to try to avoid any and all contact with law enforcement. One brochure actually advised people who were being flagged down or pulled over by police to try to make the contact take place in a public setting with lots of potential witnesses. Police were regularly robbing and both physically and sexually assaulting citizens and tourists. Officers were paid little more than minimum wage and were routinely hired despite lengthy criminal records themselves. A famous and often referred to scenario took place in court when a prosecutor asked the jury who are they going to believe; a police officer sworn to uphold the law or a twice convicted drug dealer? Everyone in attendance burst out laughing, as

Crime Matters it was a no-brainer. The felon was automatically assumed to be trustworthier. Even the judge smirked. Despite decades of overhaul and genuine reform, the perception remains that New Orleans policing is rotten to the core. Mercifully, we’re a long ways from that situation in Canada. But perception is everything and I genuinely fear for the future of public/police relations. Not a week goes by that the media doesn’t report, often with video footage, another incident of police brutalizing an innocent citizen or dispensing street justice to a suspect who poses no threat whatsoever. The footage of Ottawa police kneeing and stripping a young woman who had done nothing more than ask why she had been stopped and questioned is particularly revolting. But it just seems to be the latest in a long line of such occurrences. There comes a tipping point where this type of behaviour can no longer be dismissed as a miscommunication or
a couple of bad apples. We’re just beginning to grasp the extent of police misconduct at the G20 Summit and it appears the stench is going to be unbearable. So what’s going on? Has this stuff always been happening but the proliferation of cellphone cameras, police detachment surveillance video and YouTube makes it appear as though it’s a new phenomenon? Are the streets so much meaner that police have become more cynical, frustrated and angry? Are police agencies having difficulty attracting and hiring quality candidates who are able to avoid bringing shame and disrepute to the profession? All of these likely factor into the equation. But the response to incidents and credible allegations of corruption, criminality and thuggish brutality must also be taken into account. Time and time again we hear of officers involved in scandalous behaviour returning to the job. This is hardly a sound strategy to regain public trust. Firing some of these out of control officers would surely result in expensive litigation and wrongful dismissal lawsuits. he killer whale judgment delivered by Justice James Russell in Vancouver last week could ultimately ensure better protection for all other endangered marine species in Canada. Essentially, the judge said that the federal government is not doing enough to protect the southern and northern resident orcas that call B.C. waters home— and anchor a large tourism industry. The southern residents comprise approximately 85 whales and the population is listed as “endangered,” while the northern residents are listed as “threatened.” Canada’s Species at Risk Act requires the Department of Fisheries and Oceans to create recovery and protection plans for such species. A coalition of nine environmental groups that include the David Suzuki Foundation, Greenpeace and the Sierra Club took issue with DFO’s 2008 and 2009 actions. In 2008, the department issued a “protection statement” that sought only voluntary guidelines, while in 2009 a “protection order” for critical killer whale habitat ignored, according to the lawsuit, the biological aspects of critical habitat including water quality, noise pollution and food supply. The government has yet to respond to the court decision, but we can hope that it will accept the verdict and do something about it. After all, there is little point in having environmental protection legislation on the books, if it is not going to be acted upon and enforced.

He wants to be just like Laurie Editor: Hey Coach Smith: My name is Tristam MacKay, one of the assistant coaches of the Coquitlam Wildcats. I have felt compelled since last Sunday’s game to get in touch with you and congratulate you and the Giants (staff, players and families) on a great season that culminated in a provincial championship. Coach, your team played a great game: dominated on the line, outhit us and executed a very solid game plan. My wife said it best, “the single-wing sure is beautiful when it’s run properly.” My family has been involved with minor football for the last six years (both in Cloverdale and Coquitlam) and in that time I have never been more impressed with an organization or the team that represents them. The 2010 peewee Giants not only played like champions on the field, but acted like champions off it. I have personally never witnessed the level of respect and sportsmanship that the Giants displayed throughout the day: hitting the stuffing out of our kids and then helping them up with a pat on the shoulders, running by our bench on substitutions and giving out low-fives to the Wildcats. Following the game I ran into a number of the Giants families in the parking lot, and all of them offered congratulations and mentioned what a great team the Wildcats are. Coach, you and your staff have managed to do something that is very hard in sport: “win the right way!” I never fully understood what that expression meant, but on Sunday the 2010 Giants (players, coaches, families) showed the province a winning effort both on the field and off it. I will be moving up to JB next season and trust that the way the 2010 Giants play the game has/will greatly impact how I will coach moving forward. Misunderstood Nerbas letter Editor: In response to the letter of Dec. 10 from Edith Wallace who strongly criticized poor misunderstood Keith Nerbas’s letter of Dec.7 in regards to the new drunk driving laws: Where do you get off accusing Mr. Nerbas of “putting his children’s lives into imminent danger” and implying that “he is straddling the double yellow lines while exiting some bar?” Or that he was “well-past halfway down a bottle of vodka when he penned his virtuous epistle?” I believe that you are being very self-rightous and accusatory in your attack on Mr. Nerbas. Yes, he admitted that he had driven home at some point in the last 40 years at over .08 but he was not condoning drunk driving he was trying to point out that the new laws are out of control. Most people are nowhere near drunk at .05. This is an arbitrary decision by a provincial money-grabbing government that has no touch with reality. I agree that drunk driving is a deadly activity but the law, i.e. RCMP and provincial government, has always made drinking and driving legal otherwise there would be no such thing as a limit. Why is it that some drivers who have had several previous driving bans or convictions still drive and are far more likely to be on the front page of the newspaper for causing the death of an innocent at the wheel? Why is it that some of these same people can pay their way out of a conviction with the right lawyer? With the new laws now the average person cannot even fight a three-day car impound for a warning. If you are pulled over with a reading of .08 or more you should lose your driving privileges to the extent of the law. However, now with these new laws you can be punished for something that is not considered a crime but merely a warning. Are we now living in a police state that convicts a person when they are not breaking the law? What
gives the law, or, should I say, yourself, the right to be judge and jury on the roadside? Are we now just wallets for the establishment to keep their coffers (I mean pockets) full of taxpayer’s hard-earned money? I would like to make a comparison to the gun registry and the fact that it is honest citizens who are registering their weapons (making us feel like criminals) when in fact the criminals surely aren’t registering their weapons. Similarly, the good citizen who has a glass of wine or two at most when out for dinner is now being treated like the serial offenders who drive completely inebriated any time they feel like it. And where do you get off by using your mother’s terrible accidental death by a “sober” driver for effect. That is nothing short of fearmongering! As far as I’m concerned madam, I would be more terrified of you driving not at .05 or above but at being too tired and distracted from all your sermonizing. Elizabeth Pedersen Chilliwack
Steel containers and a windmill Editor: I propose a mixedincome, five-floor apartment building be erected on the Empress site using recycled 40-foot steel shipping containers and a windmill. My building plan would create 30 housing units and eight retail units. The low-income rental would be $300 per month per unit and the high income rentals would be $750 per month. Some of the selling points are: The steel building is fire, earthquake and vandal resistant. On the roof, of the fivefloor steel building, I propose a windmill be installed. There is always a breeze blowing through Chilliwack; why not capture that constant breeze and turn it into electricity? With a windmill on the building roof the apartment building would be self-sustainable with electricity generated by the windmill.
The excess electrical power created by the windmill could be sold back to BC Hydro, sold at a discount to local downtown merchants, donated to charity, or used by the City of Chilliwack administration to run the city. The benefit of using the steel containers, when stacked four high, they are welded together rock solid and will withstand and absorb the constant vibration of the centre-roofinstalled windmill with no effect on the tenants below. To use a wood frame, the windmill vibration would weaken the building. From a promotion perspective, for downtown Chilliwack, vision a modern windmill, high in the up air above, downtown Chilliwack, giving out the message; “Hey, look at us in Chilliwack, we are actually doing something to make our planet cleaner and sustainable.” Downtown Chilliwack will be a green energy tourist draw. A windmill providing 16 low-income housing units with free electricity and running the city’s electrical needs will be a nationwide news story and more. Cheating death at crosswalk Editor: I approach the crosswalk at Topaz and Knight in the evening. I push the button and the green “Walk” sign appears. I begin to cross but halfway across the green “Walk” sign changes to a blinking red hand (indicating “Don’t Walk.”) On my right a car turns into the crosswalk right in front of me and misses me by a foot or so. I look up to see another one bearing down on me. I begin to shout and wave my arms. The driver slams on her brakes and points to the blinking red hand. Well, it’s not my fault that the “Walk” sign changes when I’m only halfway across the crosswalk but

ith their best defenceman in the press box, their best forward auditioning for the national junior team and their starting goaltender on the bench, the Chilliwack Bruins needed something special if they were to knock off the Medicine Hat Tigers. They got as much, with special teams goals book-ending a convincing 4-1 win over the Tigers (20-9-2-0) Saturday night. Kevin Sundher scored a shorthanded goal eight minutes into the second period to open the scoring and put the Tigers on their back paws. Three minutes later Curt Gogol scored his third of the year, followed shortly thereafter by Sundher’s second of the game. Medicine Hat sniper Emerson Etem narrowed the score to 3-1 with a power play goal, prompting the sellout crowd of 4,006 to flood the ice with teddy bears. But that was all the home side could muster against Chilliwack backup Braden Gamble, who stopped 31 of 32 shots in his first start since losing to the Tigers back on Oct. 30. The Bruins sealed the victory with a power play goal from Robin Soudek. The Bruins played the second straight game without captain Brandon Manning, who is out with a groin injury. Manning currently sits third in scoring among WHL defencemen. Ryan Howse was also absent, having

He didn’t leave without giving his teammates a fond memory of what they will be missing. Howse launched two rockets past Hurricanes goalie Brandon Anderson in the first period of Friday’s game to give the Bruins an early lead. Both goals were on the power play. Lethbridge rallied with two power play markers of their own, to send the game into the third period tied at two. But Chilliwack took advantage of a Lethbridge defensive implosion to grab the lead. With seven minutes left in the game, two Hurricanes defencemen collided with each other at the Chilliwack blue line, allowing three Bruins to race in on Anderson, 3-on-0. Soudek and Sundher played catch with the puck before Soudek slammed it passed the stranded Anderson. Sports Attack shocks unbeaten South Surrey rivals with 2-0 win The Chilliwack U 15 Attack travelled to South Surrey Sunday for a first-place clash with the undefeated SCC Semi U-15 Shock. A fierce wind was blowing in from Semiahmoo Bay which had a significant impact on the game. Two minutes into the game the Attack was awarded a free kick 30metres out from the Shock goal. With the wind at her back, Kristy Ricard blasted a low shot that skidded on the turf and found its way through the legs on the Semi keeper and into the net. Seven minutes later MacKenzie Graham kicked the ball high toward the Shock goal. The wind caught the ball and carried it over the outstretched hands of the shocked keeper. In the second half the Shock had the wind advantage and pressed forward, however Attack defenders Emma Jessop, Karyn Yakemchuk, Jody Brown and Dani Cherniwchan withstood several challenges, and keeper Janae Hildebrandt proved unbeatable. Home side finds net three times for final win this year The Chilliwack U-15 Strikers stormed on to the home pitch this weekend for their last game before the

The persistence paid off in the 34th minute, when Mainse was sprung on yet another breakaway. She chipped the ball neatly into the far corner past the outstretched hands of the Ladner keeper to give the strkiers the lead. Led by the midfield play of Kiana Thiessen, Brett Karcioglu, and Elena Schroots, Chilliwack continued to press in the second half and a neat passing play allowed Haagensen to tap the ball into the gaping net. Three minutes later Thiessen blasted a ball that the keeper could only deflect into the upper corner of her net to cap a 3-0 victory for Chilliwack.
Lunachicks down Islanders despite lack of player depth The Chilliwack Lunachicks eked out a narrow 3-2 victory against the Fort Langley Islanders Sunday, despite playing with just 10 players because of the holiday season. Chilliwack struck first at the 13-minute mark when Janelle Cavanaugh converted an Andrea Feaver pass. Cavanaugh returned the favor setting up Feaver at the 25-minute mark to give Chilliwack a 2-0 lead. The Islanders pressed and scored twice in the final five minutes of the first half knotting the game at two. Chilliwack keeper Leigh Roberton made a great save early in the second half on an Islander breakaway to keep the game tied and the Lunachicks regained the lead 11 minutes into the second half when Trudy Hall stole the ball from an Islander midfielder and pushed a nice through ball to Feaver, who converted to give Chilliwack a 3-2 victory. Launa Perry had an outstanding game on defence as the Islanders were continuously pressing the tiring Lunachick squad throughout the second half. The Lunachicks go into the Christmas break leading in the standings.

Big truck rant way off base Editor: This letter is in response to the letter from Chris Janzen of Chilliwack regarding “Get Big Trucks off the Road.” It is regretful that he had to witness an accident that involved a “jacked-up truck” and a pedestrian. But why blame it on the truck? Have you watched some of the pedestrians out there? The newspaper report does not make it the truck’s fault. So why do you? People die getting hit by cars, SUVs, mini-vans, and motorcycles. It does not say you are a doctor, so how dare you assume that the person would have lived in hit by something else? I am a 54-year-old woman who drives one of those “jacked up trucks.” It is mine, yes we are farmers, yes it has a farm plate on it, and yes it is jacked up —18inch overall lift. Yes, I feel safer in that truck than anything else I have ever driven. Why you ask? Because I, many, many years ago, used to drive a full-sized car. Thanks to the stupidity of an 18-year-old who thought that he owned the road, our car ended up wrapped around a telephone pole and by the grace of God, I survived. (Not our fault.) If I had died that day I would have left behind three young children. You question why we drive these trucks, you have an answer. The other answer is because we can afford to. Now I have a question for you? Why do you care if we drive these trucks? Are you jealous because you can’t

I’m not about to let her hit me just to prove the point. I finally make it to the other side in one piece. Whew! I have cheated death in a crosswalk one more time. I’d like to ask the city why the green “Walk” signs change to blinking red hands when you’re only halfway across? And how could a senior ever survive those crosswalks? Robert Anstey Chilliwack

Yes, many of my family are also truck drivers. Want to see stupid? Go ride with a truck driver and watch the moronic things that people do. I truly think that everyone should have to go spend a week with a semi driver before being allowed to get a driver’s licence. Then you have the nerve to tell the farmers in Chilliwack not to drive their trucks around town? Are you serious? The farmers in this town are the backbone of this town. Think about those “stupid farmers in their jacked-up trucks” the next time you buy milk, eggs, beef, pork, chicken and almost anything else you eat. As for your suggestion of walking out in our driveway and checking out where we are in comparison to the height of our truck. I am a grandmother of 11 grandchildren and I take grandkids in that truck with me. The parents like to borrow it too. Everyone feels safer in that truck. (This includes grandkids under the age of one.) I do not think that because I drive this truck that I own the road, nor do I think that I will not get hurt or killed because I drive a jacked up truck. But I certainly stand a better chance at not getting hurt when someone else does something stupid. As for do I really need this truck? Yes, I feel that I do. That you doubt it really doesn’t matter. I think that complaint says envy all over it. I pay for insurance—probably more than you do—as my vehicle is worth so much. So if you can afford it—drive it.
