FROM THE President Greetings GLAC!

How did I get here? It is a question I find myself asking more and more frequently.

Reflection is often one of our greatest assets in the pursuit of progress. Personally, I have been a bit more reflective of my own personal journey, likely because I am coming up on my 40th birthday. I remember distinctively, as if it were yesterday, attending a luncheon at Skirball and watching then President Matt Davidson give announcements and thinking to myself “that will never be me.” At that time, I was relatively new to the Chapter and had no idea my journey down the proverbial rabbit hole would find me as the President for 2018. This has been a journey I am truly grateful for, an opportunity I am excited to tackle, and a Chapter I can’t wait to help write the next pages of our story.

Currently we as a Chapter are asking this very question: “How did we get here?”—and for good reason. 2018 marks our 45th Anniversary as a Chapter! Milestones like a 45th Anniversary or in my case a 40th birthday are the perfect time to step back and celebrate our journey. In our immediate past, 2017 brought with it an abundance of accomplishments; breakthrough educational programs, great networking events, record-breaking numbers in our Spark of Love Toy Drive, and we saw our membership breach the 900-member mark for the first time! Also, in 2017 we had two very special Directors reach their lifetime term limits with CAIGLAC: Dick Pruess and 2017 President Joanne Peña. Thank you both for your continued dedication to our Chapter and industry.

I think there is something so special about having people reach a point of lifetime term limit in a volunteer capacity. It really does exemplify the amount of love and dedication our membership (and these two individuals) has for our Chapter.

However, by no means are we going to stand solely on our recent accomplishments. Remember, reflection like any other tool is only useful if you put the information you gain from it to work.

In 2018 we look to accomplish a great deal including a yearlong 45th Anniversary Celebration kicked off at our January Industry Awards of Excellence Luncheon. In anything you do it can be very easy to get distracted and focus on too many things at once, in which case you may find that nothing is truly completed. Chapters are no different than people in that regard.

As a Chapter we look to make tremendous strides by not trying to do everything possible, but to do only what will strengthen our mission and create the most positive impact for our membership.

We need to stay focused on the simplicity of our Chapter mission statement: “Connecting Communities through Education, Advocacy and Service.”

With the “keep it simple goal” in mind the Board has laid out some very specific goals to accomplish this year. ●● ●● ●● ●●

Sustain our rate of growth to break the 1000-member barrier Achieve a 95% membership retention rate Further the “Coaching to Credentials” mentoring program Continue to have the most relevant programs that provide high take-home value for our membership ●● Provide exceptional opportunities to connect our membership with great networking and social events ●● Strengthen our relationships with our membership, legislators and community ●● And finally CELEBRATE CAI-GLAC!!!

Upon reflection, we certainly can be proud of what we have accomplished, who we are and the exciting opportunities ahead.

A very heartfelt “Thank You” to members like Joanne Peña and Dick Pruess, and all of you who have helped, and will continue to help, make this Chapter a leader in our industry.

Focus Magazine is pleased to present on our cover, artwork by celebrated Californian artist, Gayle Garner Roski.

A native of Los Angeles, Gayle Garner Roski studied fine arts at the University of Southern California. Her vibrant watercolors with a storytelling perspective have been exhibited extensively in museums and galleries from Southern California to Scotland.

A plein-air watercolorist and avid world traveler, Roski has explored some of the most remote parts of the globe, always with paints and sketchbook in hand.

She has dived in uncharted waters off New Guinea and has climbed to the summit of Mt. Kilimanjaro.

Roski also enjoys painting subjects closer to home, and since 2000 has been creating the “Los Angeles Millennium” series to capture the historic architecture and diverse cultural offerings that represent the best of the City of the Angels.

In addition to painting, she has illustrated several books, including popular children’s books for East West Discovery Press, a Los Angeles-based publisher of multi-cultural books.

Roski bridges her fine art career with civic dedication and has headed public art projects, including A Community of Angels Sculptural Project. She serves on the executive board of the California Art Club, as well as the USC’s School of Art and Design that bears her name.

Greg Borzilleri is the Sales Manager for PCW Contracting Services. Serving his fourth year on the Board, Greg has been in our industry more than 16 years, a member of this chapter for nine years and a past Director of the Greater Inland Empire Chapter of CAI as well.

Greg’s main goal while President is to ensure we live up to our Mission Statement “Connecting Communities Through Education, Advocacy and Service.” Greg plans on fulfilling that mission in part by encouraging member participation, ensuring volunteer recognition, helping to expand education for chapter members and actively engaging our legislators on a local and state level. He believes that education is key in promoting the industry to all community association homeowner leaders, management professionals and business partners alike. Greg is a firm believer in the saying “We will not get to where we want to go by remaining who we are.”

HOA ORGANIZERS, INC.

Neda Nehouray has been a community association manager for sixteen years and is the Founder and President of HOA Organizers, Inc., a company celebrating 10 years in 2018. Her company manages more than 105 communities and offers consulting services to another dozen communities. Over the past six years, she has become more involved with CAI, authoring numerous articles for Focus Magazine, serving as a HOA Marketplace Committee member, and currently as a CEO Summit Committee member and Co-chair of the Programs Committee. She is serving as Board Liaison to the Education and Satellite Committees. Neda is also committed to our Chapter by supporting growth, as evidenced by her award of CAI's Los Angeles Chapter Recruiter of the Year in 2017.

Neda is committed to developing innovative and relevant topics for our luncheon programs. Having past experience as a portfolio manager, as an on-site manager of large-scale communities, and now as company CEO of a 25-employee management company, Neda brings a fresh perspective to our chapter while offering a global view to discussions, recommendations and decision-making.

Sascha is currently the Regional Director for FirstService Residential. A member of this chapter since 2012, she was appointed to the Board in 2016 and elected to a three-year term in 2017. Sascha presently serves on the HOA Marketplace and Publications Committees. She is also the Board Liaison to the Social Committee.

She plans to work to increase CAI membership and industry event attendance. She also aims to participate in promoting community management as a viable career choice for young adults entering the workforce, or those looking for a new career path.

Teresa Agnew is Vice President of Business Development at Roseman Law, APC and has been a member of this chapter for the past twelve years.

She is actively involved as Co-chair of the Social Media Committee, a member of the Publications Committee and Board Liaison to Golf and Publications Committees. Teresa is also a Past President of the CAI-Channel Islands Chapter.

Teresa believes in the advocacy and mission of CAI and is dedicated to ensuring that the Chapter continues to bring quality education and resources to its members. She looks forward to bringing in some fresh ideas and implementing the Chapter’s 2018 goals.

Meigan Everett has been an active member of this chapter and one of its greatest ambassadors since 2007. She is a real estate broker, philanthropist and owner of Gold Coast Property Pros in Los Angeles. Meigan is serving a second term on the Board and a fourth year as Chapter Treasurer. She served as Chair of the Community Outreach Committee for more than seven years. This year Meigan is Chair of the CEO Summit Committee and also the Board Liaison to the Finance and Social Media Committees.

Dedicated to her profession for more than 18 years, Meigan believes that CAI and its network of business partners are key to professional, knowledgeable community management. She wants to continue to ensure that managers, HOA board members and business partners learn the value of membership in CAI and benefit from its resources.

Adrian Adams is the managing partner at Adams Stirling PLC and a newly-elected Board member.

Since joining CAI-GLAC eighteen years ago, he has been an active contributor of articles to Focus Magazine, and a popular speaker at Chapter educational events.

Adrian currently serves on the Education and Programs Committees and as Board Liaison to the Mediation Services Committee.

Adrian is committed to growing the Chapter and increasing educational opportunities for managers and HOA boards.

Mulholland Heights HOA

Gary Burns is the President of Mulholland Heights HOA, a community of 168 homes in Calabasas.

Newly-appointed to the CAI-GLAC Board, Gary has attended many of CAI’s activities, including educational luncheons, workshops and HOA Marketplaces. “Our HOA has contracted with numerous vendors as a result of attending CAI-sponsored events. This has proved to be financially beneficial for both the HOA and those service providers.”

He looks forward to sharing his positive CAI experience with others in our industry, especially HOA boards of directors, so they can appreciate the benefits of membership that have proven indispensable in helping Gary govern his community.

Isaac Camacho is Sales & Marketing Director at Accurate Termite & Pest Control and a newly-appointed Board member. Since joining CAI-GLAC six years ago, he has been an active member of a number of committees, participated in educational events, accepted a speaking invitation, and contributed educational articles for the Chapter magazine, in addition to serving as board president for his 260-unit condo community.

Isaac is committed to helping HOA managers, specialized business partners, and homeowner leaders take advantage of the wealth of resources CAI-GLAC has to offer. With a background in industrial psychology, branding, and marketing, he would like to help our chapter expand its active membership and optimize educational opportunities for the greater CID community in our area. Isaac is Board Liaison to the Membership Committee.

DONALD CAMPBELL,

Don Campbell is the general manager at Cabrini Villas Homeowners Association in Burbank, a community of 863 homes covering 77 acres.

He was appointed to the CAI-GLAC Board in early 2014 and is in the third year of an elected three-year term. Don served three years as Social Committee Co-chair and continues to volunteer as a Social Committee member and as Board Liaison to the Community Outreach Committee.

Don is devoted to helping the Greater Los Angeles Chapter continue to thrive. He wants to give back some of this time to an industry that has been a personal source of inspiration to him and one that he happens to love. Hermosa Surf Condominium, Inc.

Peggy Daughtry is the President of Hermosa Surf Condominium, Inc., a 72-unit complex in Hermosa Beach. Newly-elected to the Board and a CAI member since 2013, Peggy has enjoyed many of CAI’s activities, including evening educational seminars, workshops and HOA Marketplaces.

Peggy is dedicated to spreading the word about CAI and its benefits to HOAs and to continuing to help in developing HOA education and resources. She is serving as Board Liaison to the HOA Marketplace Committee.

Angel Fuerte is President of FRESHCO Painters, Inc. with headquarters in the San Gabriel Valley. A CAI member for several years, Angel has served most recently as Co-chair of the Social Committee and is currently a member of the CAI-GLAC Community Outreach Committee. He is also a member of the Greater Inland Empire and Orange County Regional Chapters.

Appointed to the CAI-GLAC Board of Directors in 2016, Angel actively contributes ideas and support in the areas of community outreach, community association education and vendor/manager relationships. He serves as Board Liaison to the Wine Night Committee

Beaumont Tashjian

A partner with Beaumont Tashjian, Lisa has devoted her career to representing community associations, focusing on litigation, including dispute resolution, arbitration and trial work.

She also supervises the firm’s attorney-managed assessment collections department.

Lisa is currently serving the second year of her second three-year term on the CAI-GLAC Board of Directors. She served as Chair of the CAI-GLAC Legislative Support Committee for five years, is currently Board Liaison to the Programs and Legislative Support Committees, and is also a Past President of the CAI-GLAC and CAI-Channel Islands Chapters. Lisa is dedicated to helping the Chapter reach its goals and to providing all members with great educational, marketing and networking opportunities.

marks our 45th anniversary, and we plan to celebrate this milestone all year long at our events and in Focus Magazine. Our January Luncheon was the kick-off with cake, champagne, music and a step-and-repeat photo op. We invited Past Presidents to join us—and 21 were able to attend. Many of them had not seen each other in years, and it was fun to watch them get reacquainted. The majority are still active members of our chapter and the common interest development industry, and there was a real sense of continuing camaraderie.

We will be recognizing past and present Chapter leaders all year long and highlighting our committees. We recognize that CAI-GLAC could not have enjoyed its current success without its amazing volunteers.

We asked a couple of Past Chapter Presidents to share memories.

As I remember…

Thinking back…

“Once upon a time in a land far, far away— a very young and handsome man found himself being asked to lead an intrepid group of individuals into the promised land of CAI-supported associations.”

At least that is how I see it in the rearview mirror of history.

But perhaps my memory of that time in 1991 when I was Chapter President has slightly faded over the ensuing 26 years.

There are a couple of accomplishments or attempts made to change the Chapter that stand out to me.

I recall meeting with Kevin Davis who was, I believe, the Programs Chair at the time to discuss the programs that we might want to do. In prior years programs were developed as needed, which of course led to some scrambling for good topics and speakers. Kevin and I decided to spend one meeting and develop all the topics, hash out an outline of what we might expect the program to look like and discuss possible speakers.

Then we were done with our one meeting and all that was left for the Programs Committee to do was to line up the speakers, which proved to be pretty easy because the list of members to choose from was excellent at that time—as it is now.

Another idea that I pushed (and got push back) was that the Chapter programs be free to owners. You would have thought I suggested that we become a bankrupt organization by giving away seats that could be sold at programs. I thought then and still think now that the Chapter is missing out on gaining associations as members by having a fee for the owners to attend programs. But what the heck—I can’t always get my way.

CAI-Greater Los Angeles Chapter

My greatest achievement during my tenure as the President of the CAI Greater Los Angeles Chapter (CAI/GLAC) was actually a failure!

In 1990, I made the decision that it was time to “take it up a notch” with our annual chapter trade show. The event had seen strong growth in attendance over the prior few years and my idea for that “next step” was to hire an outside professional speaker for the keynote luncheon address. The speaker’s fee, as I recall, was a very reasonable $750. But it turned out that our glowing “CA Day” attendance projections were overly optimistic, and the feedback on the speaker was only lukewarm.

The combination of the speaking fee and low attendance meant that the trade show, typically a strong fund-raiser for the chapter, actually yielded a slight financial loss.

But years later, our chapter is still reaping the benefits of the lessons learned from that experience. We learned that attendance projections are imprecise, and it’s better to err on the side of more conservative expectations. We also learned that “outside” speakers are not essential for the training and enrichment of our members. Our chapter includes members who are experts in their field at the state or national level. Our programs can be profitable and educational by drawing on speakers from our own rich talent pool. And perhaps partly inspired by these local speakers, our chapter continues to be a place where new talent is nurtured, developing new leaders and experts who will improve the future of our entire industry.

People are bound to make plenty of mistakes throughout their careers, but the important thing is to turn those experiences into valuable lessons. In the words of Henry Ford, “The only real mistake is the one from which we learn nothing.”

Managers devote their careers in this industry to enhancing the lives of others—whether it be managing associations, controlling pests or maintaining the pool… to name only a few. While every day is stimulating and different, this can also lead to burnout, stress and mental exhaustion.

Experiences that Recharged My Career as a Community Manager

By Shanne Ho, CCAM-HR®, PCAM® I knew when I was little girl that I wanted to be in business. I didn’t know what kind of business, just something of importance. While my friends played house or with dolls, I played customer service or banking. I remember using the Sears catalog to “take orders” over my yellow rotary phone. I also remember taking deposit and withdrawal slips from the bank and being a bank teller with my stuffed animals. At times, I would even play school and mimic my kindergarten teacher. What I didn’t know is how all this play time would eventually mold and shape my future.

’ve been blessed in my career path to have worked with great supervisors and mentors. Mind you, since college I’ve only worked with five companies. My first job was with Walt Disney Travel and it was a great learning experience about customer service the Disney way. More than just that was the company culture I enjoyed. There was laughter, camaraderie, and a sense of team. It was only a summer job, but in those three months I learned how to anticipate and deliver on the client’s needs and wants—all with a smile. After that, I was at The Irvine Company working in the marketing division.

Our concentration was Newport Center in Newport Beach as well as other business centers in Irvine, and we developed incentive programs and marketing collateral for the leasing agents and provided a concierge-type service to new tenants.

The environment was more corporate; there was structure and accountability. The customer service we extended had to be above and beyond—as the brand, image and company

name said it all. While I was on the marketing team, I was surrounded by other individuals with whom I spent time to learn about their job scope on the property management side —engineering, construction, IT and accounting. I found it all fascinating.

The rest feels like history because several years later I entered the community association industry. My initial journey started with a large well-known Mission Viejo community management company. I remember their three-phase interview process, and I thought it would be a miracle if I made the cut. I will never forget the woman who conducted my first interview. She asked me questions that really made me think about who I am and what I wanted to do. The best part was that we had a Disney connection, as she had worked there previously. When I got the call-back congratulating me, I was ecstatic. The training program and team culture were topnotch, and I’ll never forget the moment when the company president was walking down the hall and called me by name as I walked by her. I had not yet met her, but she knew my name.

Impressive! I was there for just a little less than a year. As a new inexperienced community manager, this job was difficult.

The administrative and financial side was easy, but not all the dots were connecting for me. The difficult part was working with the City on issues, easements, architectural plans, new development turnovers, etc. It was a sea of information, and tasks and knowledge that I didn’t have. I couldn’t learn fast enough to process anything, and only pieces of knowledge

were sticking. I felt like a failure, and it was something that really bothered me. I would ask myself, “What am I doing?”

I’ve never thought of myself as a quitter, but I felt like I was in over my head. Like any manager who has felt this way, I resigned. This just wasn’t for me.

She had told the owner about me and recruited me over there. You can imagine my thoughts—how am I going to do this again? Fortunately for me, the owner took me under her wing. I attribute much of what I have learned from her. She opened my eyes in this industry, not only from the capacity of a customer-service-related business but also from the perspective of a business owner. She made me see that nothing was impossible. In the first year, I will never forget when she told me to “create my own destiny.” I climbed the corporate ladder, wore many hats and was given the opportunity to create, develop and execute upon many things. Ideas that fostered in my head came to fruition and, of course, I couldn’t have done it without the collaboration of those around me with whom I had worked for so many years.

This broadened my horizon as I networked with other community managers nationwide, sharing best management practices and making new friends. It was also during my time there that I started to get involved in the Orange County Chapter of CAI. Over the years, I had the opportunity to serve as Chair of the Membership Committee and also be an active participant on the Social and Education Committees. I was honored to receive the Outstanding Service Award from the Chapter in 1997. I felt accomplished in my 20 years and am forever thankful for the opportunities.

Feeling it was time to move on and start a new chapter in my life, I was asked to consider joining a smaller management company.

There was a need for leadership in the property management division, and it was felt that my background and experience would be an asset in developing that part of the organization. I was humbled by the opportunity because working alongside the husband and wife owners took me back to the sense of family.

I’m grateful to have been there for two years. The graciousness and love shown to their staff was overwhelming, and it was about how they made you feel. At a busy time where a lot was

aving been in the industry for almost 25 years, I have been fortunate on my professional career path to have been surrounded by people who brought different things to my table. Let’s Get Organized in 2018!

I

n the office, your desk is your command center. And experts say—how well your desk organized can help set the tone and productivity level at work.

As we begin a new year, organization is at the top of most resolution lists. Organizing your work space will help provide clear start and stop points with projects. In the community association industry, the lines of start or stop are blurred at best. You may find yourself hopping from one fire to the next, with an ever-changing list of priorities.

You may think that you do not have time to organize your office, but, if you really knew how much time that disorganization cost you, you would reconsider. Rearranging and moving piles occasionally does not count. Neither does clearing off your desk, if you swipe the mess into a bin, or a desk drawer. A relatively neat and orderly office space clears the way for higher productivity and less wasted time.

Organizing your office does not have to take days; it can be done a little at a time. In fact, maintaining an organized office is much more effective if you treat it like an ongoing project, instead of a massive assault. So, if you are ready to get started, the following tips will help you transform your office into an efficient workspace.

Great Tips to Organize Your Office Space ¦ Purge Your Office

De-clutter, empty, shred, get rid of everything that you don’t need or want. Look around. What haven’t you used in a while?

Take one area at a time. If it doesn’t work, send it out for repair or toss it. If you haven’t used it in months and can’t think of when you’ll actually need it, out it goes. This goes for furniture, equipment, supplies, etc. Don’t forget about knick-knacks, plants (real or artificial), and decorations —if they’re covered with dust and make your office look shabby, they’re fair game.

¦ Gather and Redistribute

Gather up every item that isn’t where it belongs and put it where it does.

¦ Establish Work “Zones”

Decide what type of activity happens in each area of your office. You’ll probably have a main workspace (most likely your desk), a reference area (filing cabinet, shelves, binders),

Re-Focus | Re-Charge | Re-Fresh and a supply area (closet, shelves or drawers). Place the appropriate equipment and supplies in the proper area as much as possible.

¦ Place in Close Proximity

Position the equipment and supplies that you use most within reach. Things that you rarely use can be stored or put away.

¦ Get a Good Labeler

Choose a label maker that’s simple to use. Take the time to label shelves, bins, baskets and drawers. Not only will it remind you where things go, but it will also help others who may have a need to find, use, or put away anything in your workspace.

¦ Revise Your Filing System

As we move fully into the digital age, the need to store paper files has decreased. What can you store digitally? Are you duplicating files? You may be able to eliminate some of the files and folders you’ve used in the past. If you’re storing files on your computer, make sure you are doing regular back-ups.

Here are some quick tips for creating a smooth filing system: ¡¡ Create a meeting folder. Put all “items to be discussed” in there along with items that need to be handed off, reports that need to be given, etc. It’ll help you be prepared for meetings and save you stress in the event that a meeting is moved up. ¡¡ Create a WOR (Waiting on Response) folder. So much of our messy papers are things that are on hold until someone else responds or acts. Corral them in a WOR folder. Set up a tickler on your computer with reminders for outstanding items you may need to revisit.

¦ Clear Off Your Desk

Remove everything, clean it thoroughly and put back only those items that are essential for daily use.

¦ Organize Your Desktop

Now that you have streamlined your desktop, it is a good idea to organize it. Use desktop organizers or containers to organize the items on your desk. Use trays for papers and containers for smaller items.

¦ Organize Your Drawers

Put items used together in the same drawer space, stamps with envelopes, sticky pads with notepads, etc. Use drawer organizers for little items, such as paper clips, tacks, etc. Use a separate drawer for personal items.

¦ Separate Inboxes

If you work regularly with multiple communities, create a folder, tray, or inbox for each.

¦ Clear Your Piles

Hopefully, with your new organized office, you will not create piles of paper anymore, but you still have to sort through the old ones. Go through the pile (a little at a time, if necessary) and put it in the appropriate place or dump it.

¦ Assign Discard Dates

You do not need to keep every piece of paper indefinitely. Mark on files or documents when they can be tossed or shredded. Some legal or financial documents must be kept for specified length of time. Make sure you know what those requirements are.

¦ Use Storage Boxes

Buy inexpensive storage boxes to hold archived files and get them out of your current file space.

¦ Straighten Your Desk

Use one tip or try them all. The amount of effort you put into creating and maintaining an efficient work area will pay off in a big way. Instead of spending time looking for things and shuffling piles, you’ll be able to spend your time… well…working.

Albert Einstein said, “If a cluttered desk is a sign of a cluttered mind, we can’t help wondering what an empty desk indicates.”

Do a quick straighten at the end of the day so you have a clean start the next day.

Recordkeeping Are You Meeting Retention Requirements?

By Aaron T. Schwarzkopf, Esq. No matter what their specialty might be, it is a good bet that any lawyer will tell you the most common piece of advice they give their clients is: “get it in writing.”

Perhaps nowhere is the importance of this advice more palpable than in the world of HOAs. As quasi-governmental entities, HOAs are expected to operate with the utmost degree of transparency because members (like taxpayers) have a right to know their hard-earned money is being used properly. At the same time, HOAs are also corporations that regularly make decisions which could result in legal disputes.

Because of this unique dynamic, every HOA should have a comprehensive records retention policy and make sure it follows that policy as closely as it can.

Under Civil Code §5210, HOAs only need to keep most of these records from the current fiscal year and the previous two fiscal years. The one exception to this are meeting minutes, which HOAs must make permanently available. This includes minutes from member meetings, open board meetings, and any executive committee meetings. While there is some debate as to whether an HOA’s architectural committee records fall into this exception, the safest strategy would be to keep them just like any other committee’s minutes, as there is no telling when someone might claim selective enforcement of an HOA’s architectural restrictions. Finally, HOAs should also permanently retain executive session minutes for their own reference even though members have no right to inspect them.

Any such policy must first ensure the HOA keeps all records which it legally must make available for inspection by members. Most of these can be found in Civil Code §5200, which lists 13 categories of such records. These include general business records like meeting minutes, the governing documents, membership lists, and approved vendor invoices along with financial records like the HOA’s annual budget report, interim financial statements, and reserve summaries.

HOAs also have a duty to retain election records for member inspection. Under Civil Code §5125, the Inspector of Elections must retain custody of ballots and ballot envelopes for one year (which is the period during which a member can bring an election challenge). After that, the Inspector of Elections turns them over to the HOA who is then free to either keep or dispose of them.

If a member requests any of these records and an HOA is unable to produce them, that member can then sue the HOA and the court can penalize HOAs up to $500 for each improperly-denied request. Additionally, the California Court of Appeals ruled just this past year in Retzloff v. Moulton Parkway Residents’ Association, No. One that while an owner can recover attorneys’ fees if he/ she prevails in a suit involving the failure to disclose these records, a prevailing HOA cannot (even if the underlying lawsuit is frivolous). Therefore, the best strategy for HOAs is to simply minimize the chances of litigation by adopting an easy-to-follow records retention policy so it can efficiently provide these records to members upon request.

However, this only covers records which members are entitled to review. In reality, any records retention policy should generally err on the side of retaining records. Among other things, this can make it easier to understand decisions by previous boards, increase HOA transparency by allowing boards to disclose documents which they otherwise have no duty to make available (which is especially valuable when it comes to things like releasing rejected contract bids if a member accuses a director of having a conflict of interest), and ensure HOAs have all the records which might it defend itself in a lawsuit. Having said that, courts will regularly order HOAs to turn over records which members

are not legally entitled to if they see no harm in doing so. To limit the potential of the HOA being cast in a negative light, any records retention policy should operate under the assumption that any record will be made public. If a board needs help in

putting together such a policy, it should reach out to the HOA’s attorney. This will help ensure the HOA retains the documents required by law while also limiting its risk of liability.
