conserve our electricity, water, and waste. The advice and steps provided will not only help preserve our planet but also provide financial benefits. We investigate Pest and Wildlife control and what steps we can take to make sure we are cohabitating with the creatures we share space with. Additionally, we delve into Service Animal requests when the CC&Rs may have restrictions regarding animals.

Lastly, Jennifer and I would like to welcome the new Co-Chairs of the 2022 Publications Committee. Jocelle Maliwanag (American Heritage Landscape) and Diane Rossiter, MBA, CMCA®, AMS®, PCAM® (Bell Canyon Association) have been dedicated committee members and have brought valuable insight. Rise Together Art Contest In January the CAI-GLAC Publications Committee introduced the Rise Together Art Contest, inviting chapter members to reveal their artistic talents and submit a personal work of art suitable for print that would illustrate this year’s theme “Rise Together.” The Committee encouraged submissions that would inspire, engage our members, and provide a sense of community. The contest winner’s artwork is featured on the cover of this issue.

Here are some words from our winner:  I took this shot of Firefall in Yosemite National Park several years ago after waiting for the right conditions. Firefall is only possible when several factors come together. Enough snowfall so that melting snow creates the waterfall, the sun has to be in the right spot to illuminate the waterfall at sunset, a warm day to melt the snow, and a clear horizon at sunset so that clouds do not block the sun from hitting the granite cliff and illuminate the waterfall and spray in that warm glow that makes it look like lava. It is these factors rising together that create the scene. If any one of them is missing, the magic of Firefall cannot happen. — Robert DeNichilo, Esq. MESSAGE

FROM THE PRESIDENT

TO OUR CHAPTER MEMBERS!

T

he end of the year is two months away and as I reflect on 2021, it was truly an honor and pleasure to serve as your president and work alongside our chapter staff, Executive Director, Joan Urbaniak and Andrea Nadal. They were always there, supportive of my vision of “Rise Together” to continue to mentor, inspire, and support our leadership, chapter members and each other. It has been a humbling experience and a gratifying one this past year. “ Gratitude is the golden frame through which we can see the meaning of life” —Brendan Burchard

Brendan is one of my personal mentors who I look to for inspiration.

He has taught me that finding joy every day and embracing gratitude will provide a peace and meaning to our life journey. As I look back on the leaders of our chapter who have stepped up in service and were determined to support our chapter and members, I am so proud to work beside them. Working beside you was a source of inspiration, and purpose.

So many commented as I began my year as president how time would fly, and, oh my, they were correct! I cannot believe 2021 is coming to an end. So how did we do as a chapter?

At our 2020 strategic planning, the Board of Directors focused on three goals for 2021.

Education: “CAI – Connecting Communities through Education, Advocacy and Service.” Dealing with a virtual world and programming for months to come, our education committees were faced with ongoing challenges providing education to our members.

Flexibility was important each month. Our programs were evaluated in depth in order to update and revise them as new world events occurred and new legislation became effective. The committees introduced more interactive programming and elevated our technology. Facing “Zoom Burnout” was real, but with innovative topics, we were able to increase both manager and homeowner leader attendance, and our chapter has implemented our very own blog “HOA Community Now. “ Community: It has been a challenge to maintain a sense of community as the chapter was holding virtual events the first (8) eight months of the year. Social Media was an element of our chapter that kept us connected. Shout out to the Social Media Committee and Andrea Nadal for the creative content such as “Flat Joan” and “Instagram Live at CAI National,” (which received National recognition), collaborating with their fellow committees to provide a platform for connecting, sharing, cheering, and reuniting for our members. Our Membership Committee did a spectacular job maintaining members, and we are close to 1,150 members strong. They utilized social media with creative videos, and hosted CAI Worldwide. The Expo Committee held its first successful “Virtual Reverse Trade Show.” The event sold out and CAI-Greater Los Angeles Chapter

was a financial success for the Chapter. Our Community Outreach Committee continued its mission to connect to community with several outreach programs such as “Blood Drive” and “Valentine Cards for Seniors,” and they will be holding the annual Spark of Love Toy Drive in conjunction with our Winter Wonderland Holiday Party.

The Publication Committee elevated our chapter magazine “Focus” with quality articles, and our Legislative Support Committee helped coordinate and support its first “Virtual Townhall” for community leaders discussing new legislation.

Our quarterly committee check-ins were a success in keeping the co-chairs connected and supporting each other. The leadership was determined to work together, uphold our mission of providing quality education for our members through many different platforms and connecting its members.

Our members are excited to get back to in-person events and enjoy the camaraderie and networking with colleagues. Our first in-person educational luncheon in over 19 months was held on September 22nd outdoors at the Skirball Center to a sold-out crowd. It was a little warm but that did not stop the high energy vibe, with our DJ Eddie and panel of Past Chapter Presidents and Executive Leaders sharing their stories of success in the industry. Our sold-out golf tournament in October was a financial success. At our “Industry Excellence Awards” Gala this November, which is sold out, we will be honoring those who have been nominated for excellence in service to our chapter, to our industry, to their communities and their companies. I acknowledge each of you as winners!!

Our chapter held its Annual Election for 2022, and I would like to congratulate our new Directors to the Board: Leslie Barton (Precision Painting) and Brian Moreno, Esq. (Swedelson & Gottlieb). They will be joining Alexandria Pollock, Isaac Camacho, Matt Davidson, Gary Burns, Diane Schoolsky, Angelique Madrigal, Matt Meadors, Erik Rivera, and Kim Province. My term has ended, and I want to extend a heartfelt thank you and appreciation to my fellow directors. It was truly one of the most collaborative groups of people to work with— with thoughtful, respectful discussions. You can never say “Thank You” enough! Your support is much appreciated.

THERE ARE FOUR ELEMENTS OF OUR ECOSYSTEM AND THE NATURAL WORLD WHICH ARE INEVITABLE: WATER, WIND, SUN, AND FIRE. ALL CIVILIZATIONS, EMPIRES, AND MAN-MADE [OR WOMAN-MADE] MONUMENTS EVENTUALLY SUCCUMB TO MOTHER NATURE’S ELEMENTS. AS A CIVIL ENGINEER FOR 39 YEARS AND HAVING TRAVELED TO SEVEN CONTINENTS, I HAVE LEARNED ONE UNIFORM LESSON: MOTHER NATURE ALWAYS WINS. OUR UNIVERSE WAS BORN 15 BILLION YEARS AGO; THE EARTH IS 4.5 BILLION YEARS OLD; HUMAN CIVILIZATION IS 50,000 TO 100,000 YEARS (GIVE OR TAKE +/- 20,000 YEARS). IN THE PAST 100 YEARS WE HAVE CREATED MORE ISSUES WITHIN OUR PLANET THAN THE PREVIOUS 4,499,999,900 YEARS. HOW IS THIS POSSIBLE? HOW DID WE GET HERE—TO THIS APOCALYPTIC STAGE? OR IS IT JUST ANOTHER HOLLYWOOD MOVIE? Our media and press have not been entirely honest and factual with us [the public]. Recall the “world emergency of Y2K?” Remember all that hullaballoo? The world was going to stop, traffic lights would fail, power outages were going to cripple civilization, nuclear missiles would be launched, banks would close, people would die, and the world will would spiral into anarchy and chaos. And then... nothing happened. I am still waiting for Ebola, SARS, and the Swine Flu to kill everyone. Where did Mad Cow disease go? What happened to those cows? Salmonella, where are you? Where is the Malaysian Airlines flight 370? Where did that plane go? In 1978, when I was in high school, we were taught that oil would run out by the year 2000 and the world economy would collapse. We were also told that overpopulation would lead to massive food shortages that would result in, you guessed it, everyone dying and collapse of the world economy. Okay, I am still waiting for the oil to run out. Do not believe everything you read in the paper or on the internet. One consistent truth among all these episodes has been that the Press never apologizes and never corrects themselves. It does not matter which channel you watch (CNN, FOX, MSNBC, PBS), you see this nonsense peddled every year.

may not have power for its casino empire. My God, is this the end?

I am unable to answer these postulations, but let us examine the situation with analytics (I.e., from the Engineer’s perspective).

My parents arrived in California in 1968 when I was 3 years old.

California’s population was 17 million at that time and a coastal property in Malibu cost $12,000. My parents bought their first house in Sierra Madre for $42,000 in 1972, when gasoline was $0.25/gallon. In 2021, California now has a population of 40 million and everyone is aware of how the cost of living has escalated. California has 1,500 reservoirs for water storage with 850 million - 1.3 billion acre-feet of storage capacity. Dam construction has all but stopped since the early 1990s with no new dams or reservoirs are on the horizon for many reasons linked to environmental regulations beyond this article, but the population continues to grow. California’s water supply is found in areas of lower population density; northern California has 60% of the water shed volume but only 10% of the population.

Areas near Bishop and Mono County are the water source for Southern California, among other locations. The Los Angeles Basin is a natural desert. The city of Los Angeles was created by bringing water from other regions to grow Southern California.

As a civil engineer, the first commandment for land development engineering is, DO NOT DIVERT THE WATER. Raw land that naturally flows south must remain flowing south on the developed plan. This rule is written into the California Water Code and applies to both surface and sub-surface runoff. The primary reason for this law is, the diversion of natural runoff will cause detrimental effects to others downstream where the water was not intended and lead to drought conditions along the natural drainage course. Imagine that we were to divert the Colorado River at Hoover Dam away from Arizona and Mexico.

Certainly, this would lead to war. Yet, the State of California and City of Los Angeles (as well as San Francisco, Sacramento, and others) have done exactly that by bringing water from their natural drainage patterns to populated areas. The results are devastating yet deemed by some to be progress.

My father put it very simply: “Your poolside event has 4 guests, and it’s a great party. But if you invite 400 people for the same pool, it’s an ecological disaster.”

We expect to continuing adding more population but fail to address the existing water supply, then complain it is “global warming” and “severe drought.” This author is not arguing against CAI-Greater Los Angeles Chapter

these two principles, as there is factual evidence that these are compelling forces impacting the planet, but we cannot ignore our own stewardship of Mother Earth which has contributed to this present condition and continues to do so. To blame everything on a sole source (e.g., Global Warming) is to conceal our own mismanagement of resources and poor planning.

The Hoover Dam was built in 1930s and created Lake Meade, with 29 million acre-feet of water supply capacity. In 1930s, the combined populations of California, Arizona, Nevada, Utah, and Colorado was under 6 million. Today this combined population is approaching 60 million. Lake Meade has not grown (the pool is the same size, but the party has grown larger). Interestingly, I travel regularly to the Colorado River at Lake Havasu, south of Hoover Dam, and the water discharge is plentiful with no change in the riverbanks or lake level. This underreported fact leads to the question of why the upstream water levels are dropping while downstream flows remain constant? Unsurprisingly, this entire issue is ignored by the media. The Colorado River is a managed river with legal agreements that guarantee flow rates to Mexico, Arizona, Nevada, California, Utah, and Colorado, and each stakeholder has legal rights to this river, but there are limits. If one party grabs more French fries at the buffet, such as California with its 40 million people, it creates a problem. The water supply is not “all you can eat.”

The San Joaquin Valley has SUNK over 32 feet since the 1930s due to ground water pumping. Water used to feed the burgeoning agricultural industry which made California the 5th largest economy in the world, but it was success that was founded on the exploitation of natural and environmental resources. The San Joaquin Valley is a natural desert with underground aquifers, and it has been artificially transformed into productive farmland. Hooray for California! But let us not hide the fact that this industrial development has posed a huge environmental cost. Water is a finite resource, and it will deplete in supply when abused.

In the City of Los Angeles, the retail cost of water is $9/HCF (HCF = Hundred Cubic Ft, or 748 gallons), which translates to $0.012/gallon (interesting to consider when you buy 1 liter of Evian Water for $6 at LAX, which equates to $22.68/gallon).

Power from LADWP retails at approximately $0.18 kilowatts per hour (kWh), which is among the highest power rates in the U.S. In the Las Vegas area, the cost of water = $1.50/1,000 gal, or $0.0015/gal (less than one penny per gallon). The power cost is $0.103/kWh (10 cent/kWh, or roughly 60% of California’s cost).

In Texas, the power cost is less than $0.05/kWh (5 cents per kWh).

Let’s take a journey to Aruba, the island paradise in the Caribbean with no natural water resources. On this tiny island, comprised of only 70 square miles (about twice the area of Manhattan), there are 110,000 people, not counting the 2 million tourists who visit annually! Aruba is larger than Santa Catalina Island (55 square miles) but has a much larger population (Santa Catalina has 4,000 residents). Aruba’s water supply is achieved entirely through the desalination of ocean water, and they will never run out. The retail cost of water in Aruba is $16/HCF (2.4 cents/gallon), and power is $0.25/kWh. Aruba is powered almost entirely by diesel generators and a few wind towers.

Dubai, United Arab Emirates (UAE), is on the edge of the Sahara Desert and on the coast of the Persian Gulf with a population of 2.9 million and a land area of 1600 sq. Miles. Los Angeles County, by comparison, is only 4,700 square miles. The cost of water in Dubai is $17/HCF (2.3 cents per gallon), and their water, like Aruba’s is sourced through desalination because they have no ground water source. Power is $2.40/kWh, which is among the highest rates in the world. Citizens of the UAE are not charged for power as it is considered to be a “gifted right.”

Foreigners, however, are charged for it to subsidize the local resident population. Now that’s “democracy in action!” What have learned? In my very humble opinion, the lessons are these: A. Population centers (I.e., cities) need to be grown in areas adjacent to natural resources and not “bring” the water from 1,000 miles away because in the long term, this is not sustainable.

The Romans and Greeks knew this as did the Mayans, Arabs, Hindus, Eskimos, and Native Americans. Los Angeles is one of many geographically misplaced cities, along with San Francisco (not only built in an area with no natural clean water source, but also build along the San Andreas fault) and New Orleans (built below sea level).

B. Desert areas are not appropriate for lush, green golf courses.

Sorry Palm Springs and Las Vegas, this is not your natural habitat.

Move the golf courses to rain forest areas and play in the rain!

C. Land developers need to collaborate with and assist public agencies, because they are lost when it comes to water and power infrastructure. If we are going to add another 40 million people to California, then we need to figure this out now. We cannot keep adding people to the “pool party” and not add more pools!

D. Abandon California—let’s move to Costa Rica!

On a serious note, we cannot realistically do A, B, or C and option D is already in full operation for some, whether it is to Costa Rica or elsewhere, but we do need to innovatively add to the existing water supply: Desalination is one solution. Yes, it is more expensive but if you are driving your Lamborghini and paying fuel costs of $5/gal with taxes, insurance, and picking up Starbucks at $8/coffee, then we can find funding for desalination.

California is adding wind energy and solar power plants to contribute to the power supply, but it is not happening fast enough.

Environmentalists’ concerns for tortoises, rabbits, rats, and bats veto such projects. If we do not address these issues and realize that population areas need to diversify geographically, then we will run out of water and will become a desert. Oh wait, that’s what we were to begin with, isn’t it? See? Mother Nature always wins.

projects, and there are vendors that will complete the conversions at no cost to the Association, with their payment coming from the collected rebate funds.

Additionally, areas that are lit by daylight, like outdoor parking or landscape, should have timers or photocells installed to ensure that lights are not on when the areas are naturally lit. Indoor areas like fitness centers, club rooms, restrooms, and utility rooms can have motion detector switches so that lights come on when there is activity, but remain off when the rooms are empty.

ENERGY SAVINGS WHEN ELECTRICITY IS A SHARED COST

RISING UTILITY COSTS HAVE A GREAT IMPACT ON ALL HOMEOWNERS. FOR THOSE IN OLDER CONDOMINIUMS THAT DO NOT HAVE INDIVIDUAL ELECTRICITY METERS, THIS IMPACT IS FELT DIFFERENTLY THAN FOR THOSE WHO ARE DIRECTLY PAYING FOR ELECTRICITY USAGE. UNFORTUNATELY, IN THESE SITUATIONS RESIDENTS DON’T “SEE” THE IMPACT AND COST OF THEIR INDIVIDUAL USAGE SINCE IT IS LUMPED IN WITH THEIR NEIGHBORS ON ONE BILL, AND PAID WITHOUT MOST HOMEOWNERS EVER GETTING A PEEK AT THE ENERGY COSTS. THE ALL-INCLUSIVE NATURE OF THESE UTILITIES CAN LEAD TO WASTEFUL HABITS, SUCH AS LEAVING LIGHTS ON OR HVAC SYSTEMS CONTINUALLY RUNNING.

In these situations, the Board should first look to the energy consumption that is directly controlled by the Association: the common areas. Boards and managers should walk the community and determine what common area items are drawing power. Items can include things like: ¢ Common area lighting: hallways, parking garages, outdoor common area and landscape lighting, etc. ¢ Common area HVAC systems ¢ Major building components and mechanical rooms for amenities such as pool areas and clubhouses ¢ Appliances in amenity areas, such as clubhouse refrigerators, dishwashers, etc. ¢ Appliances that serve or are used by Association staff such as breakroom refrigerators or washing machines Common area lighting is extremely important for both community aesthetics and safety, but is also generally the greatest source of common power consumption. Conversion of any incandescent or CFL lamps to LED lighting is a great first step toward significant reductions in energy consumption. Local utility companies often have rebate programs that associations can take advantage of when undertaking lighting conversion

HVAC systems serving common area hallways, amenities like club rooms or clubhouses, fitness centers, or onsite offices may also be big energy users.

Upgrading to programmable thermostats, and ensuring thermostats are turned off when rooms are unoccupied, will aid in reducing energy consumption. Regular preventative maintenance service and filter changes will also increase overall system efficiency.

In addition to HVAC systems, other major building components may be a significant draw on power. Elevators, mechanical equipment such as pumps, motors, pool equipment, etc. all require power to operate.

Associations seeking to move toward greener systems and practices can have an ASHRAE (American Society of Heating, Refrigerating and Air Conditioning Engineers) audit performed. This engineering study provides the Board and Management with guidelines for replacing components with energy-efficient ones and often includes rebate and incentive details for the Board’s consideration.

Many Associations also have appliances that are part of the common areas, management, or maintenance of the Association. Older appliances such as refrigerators or washing machines should be replaced with energy efficient models. Often there are rebates available for trading in older models for energy efficient replacements.

Many of the above steps will have a short return on investment period in the energy savings that will be realized by the Association along with reducing the overall energy footprint. In conjunction CAI-Greater Los Angeles Chapter

with tackling energy savings in the common areas, associations can also encourage energy conservation from the individual residents.

One option that associations have is to install individual sub-meters and bill each unit back for their electricity usage. This is a costly endeavor up front, especially for larger communities. However, in the long run it is a large reduction in the overall energy budget for a community as each unit pays for their own consumption. This in turn encourages conservation because residents see the direct correlation between their energy use and the price they pay.

For associations that do not wish to go that route, there are still ways to encourage conservation. The key is COMMUNICATION. Below are a few simple steps that associations may take to educate residents and encourage conservation: 1. SHOW residents the overall community consumption. Your utility company’s online portal has tools

to view consumption and compare month over month or year over year information. Create a monthly one-page posting with the data and whether Association consumption is trending up or down. Use visual cues like a green thumbs up to show reduced consumption or a red thumbs down if consumption has increased.

Include information regarding using things like washing machines and vacuums during lower-tier times.

1. TELL homeowners how they can conserve electricity. Talk about it in your Board meetings. Have conversations with the residents. If you see a unit that has their lights on 24/7, consider giving them a call to encourage them to conserve.

1. PROVIDE OPTIONS AND RESOURCES. Homeowners are much more likely to convert their individual lighting to LED, upgrade to a programmable thermostat, replace appliances with energy-efficient models, or utilize advanced power

strips if the resources are presented to them. Contact vendors for bulk rates or rebate options. Schedule HVAC service or dryer duct cleaning for the community. The easier it is, the more likely residents are to take advantage of the offer, and in turn overall community energy consumption will be reduced.

The age of a community should not have an impact on the ability of the community to implement energy efficiency improvements. Even small changes will reduce electricity consumption and move the association toward savings.

ATER IS AN INTEGRAL PART OF OUR LIVES, yet we often take for granted the journey our water takes from the source to our faucets.

With many areas experiencing changes in precipitation patterns and increased dryness, some sources of water are becoming less reliable. As a result, water agencies are looking to diversify their portfolios of water resources to meet their community’s needs. This may mean going beyond the typical sources of surface water and groundwater to include making arrangements to bank extra water in wet years for use in dry years, participating in water exchange programs with other water providers, and recycling water to

ways we can make a difference in our own yards. We can start by periodically inspecting our irrigation systems and making the following adjustments as necessary: replace broken components, adjust the spray/flow to prevent runoff, set timers to water early in the morning, and reevaluate the amount of time you water each season. When you wash your car, make sure you have a nozzle with a shut-off function or take your car to a car wash that recycles its water. Trade your hose for a broom when cleaning off your driveway, sidewalk, or patio and use pool covers to reduce evaporation. There are also people who are looking to reduce their water usage to simply save on their water bill each month.

The good news is that there are many ways that we can take action to reduce our water usage both indoors and outdoors.

For homeowners, most of the water that is used each month is for outdoor irrigation, and there are a variety of

programs if these are offered through your local water agency. Rebate programs may offer reimbursements for: lawns converted to drought-tolerant and native plants, sprinkler systems that include drip irrigation and/or high efficiency nozzles, weather-based sprinkler system controllers, soil moisture sensors, rain barrels, pool covers, and variable speed pool pumps. Furthermore, many water agencies offer gardening classes that encourage water smart landscaping tips on how to incorporate drought-tolerant and native plants into your gardens. The bonus of adding plants that are native to your area is that you are helping to protect biodiversity by providing food and shelter

for the local pollinators, birds, and other wildlife who depend on those plants.

There are ways to save water indoors as well. A good place to start is by checking to see if your local water agency offers free home checks for water efficiency and leak detection. As you replace appliances, opt for high efficiency dishwashers and clothes washing machines since they use less water and energy, and run them when they’re full to maximize efficiency. High efficiency toilets will also save you water each day, as will reducing your time in the shower.

HOMEOWNERS ASSOCIATIONS (HOAS) may also be able to take advantage of education on cost-effective water management strategies and rebate programs offered by local water agencies specifically for HOAs. Some offer rebates for lawn replacement, weather-based irrigation controllers, drip irrigation/ high efficiency nozzle replacement, as well as offer landscape irrigation surveys.

Water agencies are eager to partner with homeowners, so reach out to your local water agency to find out what programs are available to you to start saving water and money. Pay attention to rebate requirements and prerequisite documentation so you can maximize your ability to receive the rebates, and spread the word with friends and neighbors. The saying “it doesn’t matter where you start, only that you begin” applies nicely here.

Start with the strategies that are easy, and work towards others that you feel you can take on. If you have already started or are even an experienced water saver, please know that your efforts are appreciated and have probably inspired others to also be responsible stewards of our water resources.

CALIFORNIA IS THE MOST POPULOUS STATE WITH 39.7 MILLION PEOPLE, EXPORTING MORE THAN 42 MILLION TONS OF WASTE OUT OF STATE OR TO STATE LANDFILLS. IN CALIFORNIA THERE HAS BEEN A DRAMATIC INCREASE OF MULTI-RESIDENT PROPERTIES. YOU MAY HAVE FOUR PEOPLE LIVING IN A TWO-BEDROOM CONDOMINIUM AND, IF EACH RESIDENT DISPOSES OF SIX POUNDS OF WASTE EACH DAY, IT ADDS UP. WASTE GOES SOMEWHERE, WHETHER WE SEE IT OR NOT. CALIFORNIA WAS AT THE FOREFRONT WHEN IT CAME TO ECOLOGY. WE BENEFIT IF WE ARE GOOD TO ONE ANOTHER AND ALSO CARE ENOUGH TO ACT. RECYCLING WAS INTRODUCED AND ENCOURAGED BECAUSE EXPERTS COULD SEE WHAT WOULD HAPPEN IF THE POPULATION INCREASED AND THIS ISSUE WAS NOT ADDRESSED.

ecycling worked for a little while and then we began using plastics and disposing of them in the trash, perhaps not knowing that plastics do not break down as organic matter does. Since plastic was cheaper than paper, most businesses began using it. Now we are all aware of the impact that plastics and other nonbiodegradable items have on the planet.

California’s goal was to have 75% recycling (this includes separating organic matter from nonorganic, composting and recycling) output by 2019. While we did not achieve the 75% recycling rate, it was a step in the right direction.

There are many benefits of recycling; it just takes a little effort.

The most obvious benefit is for future generations, but it is enough to just care for our planet.

Thankfully, recycling has now become easy and takes minimal effort, especially in homeowners associations.

Associations have been hit hard with the astronomical charges for refuse removal. Some associations are struggling to afford trash services altogether. This has been eye-

opening for many communities. On the bright side, professional property management can explore options for associations to cut back on the rates. Volunteers can even join forces to find creative solutions. Some associations have relocated their bins so that they are closer to the front of the community since rates are sometimes calculated by yardage. Others have reduced the number of regular trash bins and increased the number of recycle bins to save. Go-Reusable! If there are elderly within the community, perhaps offering to take their recyclables to the blue bin would enable them to participate in the effort. As a community it is important to find out what may be keeping members from doing so. Are the recycle bins too far? Are they always full? Is the area in need of better lighting? Open communication about these issues can result in surprising revelations for the Board and Management. There is no sign of this issue going away, so we should do our best to get ahead of it by being open to unconventional options.

By eliminating the need to manufacture new products from raw materials, recycling reduces energy use, in turn reducing carbon dioxide and other greenhouse gasses in the air.

EVERINCREASING UTILITY COSTS? UTILITY CHARGES ARE ON AN UPWARD TREND WITH NO END IN SIGHT. THE GOOD NEWS: YOU CAN HOLD BACK AND EVEN REVERSE INCREASES IN ELECTRIC, WATER, SEWER, GAS, TELEPHONE AND TRASH BILLS.

ith extreme weather and severe droughts grabbing headlines, rising utility costs seem unavoidable. In California, utility costs have been on an upward trend for the last quarter century, going back as far as the previous California droughts in the late 1980s and early 1990s, when water became scarce and a precious commodity.

charges, incorrect meter multipliers, sewer fees billed for irrigation water, tax errors, and many other overcharges to give you back money now. A utility audit can also find you lower-cost utility rate schedules available through your existing utility provider to lower your future per-unit costs for water, sewer, gas, electricity, telephone and trash.

Coupled with cost increases resulting from deregulation, trash franchising, tiered and penalty rate pricing and other utility industry issues, utility costs continue to grow every year—draining the reserve funds of community associations and prompting them to look for ways to reduce their utility bills.

Generally, a utility audit can decrease a community’s annual utility budget by 20% with no equipment expenditures and no change in use or consumption! A utility audit may put money into an association’s reserves, with no out of pocket cost to the association.

With extra reserve money, any association is better prepared to deal with disasters.

The reduction of common-area utility bills seem to be one area where many boards feel confused or powerless, delegate this responsibility to landscape committees, managers or others, or attempt to reduce these costs by energy management or conservation techniques alone. Since utilities are usually the top three budget expenses, these should be delegated to a professional.

ENERGY AUDIT VS. UTILITY AUDIT

CUT COSTS WITH UTILITY AUDITING Utilities now rank among the top budget cost for almost all associations and communities in California. As associations and businesses have increased their utility budgets each year to accommodate rate increases, many have lost sight of exactly how much utilities are truly costing them. Is it possible to fight these ever-increasing costs?

Communities do have an ally in the battle against rising utility rates: a utility audit.

A utility audit is an in-depth examination of your organization’s utility bills, and includes a visit to your property to inspect all the onsite utility services (e.g., water, sewer, gas, electric, telephone, trash) that are billed to your community. Not to be confused with an energy audit, a utility audit looks at all of the common-area utility bills and what is actually being charged per sewer unit, per gallon of water, per kilowatt hour of electricity, per gas therm, in addition to telephone and trash costs.

This in-depth utility audit can locate utility billing errors such as decimal point errors, wrong rates, incorrect service

What’s the difference? An energy audit examines and recommends ways that an association can reduce the overall usage of their utility consumption by installing energy efficient equipment, retrofitting existing equipment to be more energy-efficient or changing increase utility conservation and reduce the total number of units used. An energy audit will recommend the use of energy conservation devices and methods, such as LED lighting, light timers, drought-tolerant landscaping, low-flow toilets and showerheads, smart irrigation controllers, energy efficient boilers, timer switches for laundry room lights, reduced hours of use for pool pumps or tennis court lighting, etc.

A utility audit determines if there are any billing errors or overcharges that would entitle the utility customer to a refund from the utility company and/or obtain lower utility rates from the utility company. In most instances, associations are overpaying simply because they are not aware of how their utility bills are calculated. This type of audit reduces the rates that you actually pay per unit of utility and eliminates any utility overcharges that most associations are not even aware of! In addition to obtaining refunds from your utility providers for past overcharges, the future utility costs are lowered through either the correction of these utility billing errors or the application of new, lower rate schedules from your utility providers.

REDUCE OVERALL UTILITY CONSUMPTION AND REDUCE PER UNIT COST OF UTILITIES: All communities should have both types of audits, in addition to rebates, conservation and possibly brokering. This would ensure that the community is managing its utility consumption in the most efficient manner (energy audit) AND paying the lowest per unit cost for all utility consumption (utility audit). These services should be no different than scheduling the annual financial audit or reserve study.

To make the biggest impact on overall reduction in all common-area utility expenses, an association should explore all of the following: 1. UTILITY AUDIT: Do this first so that if utility billing undercharges are discovered (which happens), then the association is alerted to these undercharges by the utility auditor - without incurring a large backbill for these billing undercharges from their utility company!!

2. REBATES: Explore all available rebates or retrofitting programs available with your existing utility providers and/ or cities and counties by visiting their websites or contacting them directly. At this time, LADWP has over 12 rebates and conservation programs available for communities.

3. ENERGY AUDIT: Hire an energy management company to conduct an energy audit of the property to discover additional ways that the association can reduce utility consumption, such as new equipment, energy efficient lighting, drought tolerant landscaping, etc.

4. BROKERING: If the association uses a significant amount of electricity or gas, purchasing gas through a gas broker may be a good option to reduce the cost of electricity or gas.

HERE ARE SOME EXAMPLES OF COST SAVINGS: Harbor Gate Homeowners Association, a community with 179 condominiums located in San Pedro, has received refunds of $7,694.26 from LADWP for solid waste overcharges, $1,309.57 for electric overcharges, and $7,673.74 for water overcharges.

Their annual utility expenses have been reduced by $2,094.00 for telephone expenses, $1,500.00 for solid waste fees, $4,800.00 for electricity costs and $9,000.00 for water charges.

California Place Homeowners Association is a community with 212 condominiums, located in Tarzana. By reducing their sewer service charges through LADWP, a utility audit resulted in a refund of $34,079.94 for them earlier this year. In addition, they will now reduce their annual sewer service charges by approximately $17,000.00 or more!

Let’s face it; living in an HOA has its challenges. While there is quite a bit that an association is financially obligated to maintain, there are many things owners can do to be proactive about the components they are responsible for. There are days that it is hard to slow down enough to make a conscious effort to conserve, but more than ever it is becoming critical. Like anything else, conservation begins with being aware of where high utility use occurs in your household. It has been proven that in as little as 30 days a lifestyle change can be adopted simply by focusing your intentions on mindful use. Maintenance is equally as important and inter-related.

Conservation and maintenance may look different, depending on whether you live in a townhome, condo or single-family home. Understanding your association’s governing documents and analyzing how your household uses utilities and HOA components is the first step to understanding the areas on which you can focus with little impact to your daily routine. Following recommendations provided by utility companies is a simple start.

These tips have already been verified and reflect positive results.

The Los Angeles Department of Water and Power (LADWP) has a number of established programs that help reduce water and power usage, with beautification and improvements that yield huge returns. Here are some examples of ways you can conserve and be proactive.

¢ Test all water fixtures and toilets for leaks. Remember, keeping your fixtures in optimum shape ensures that your HOA and you are not paying for wasted water. ¢ Request free water reduction aerators from LADWP. They save about 20% of water used when showering or using the sink. A typical shower uses five to ten gallons of water per minute. Limiting your shower time, turning off the faucet while brushing your teeth, and taking a bath in lieu of a shower will result in immediate results. ¢ Regardless if it is a dishwasher, washer, Dryer or A/C system, maintenance is the key to optimal use. ¢ Use a broom to clean driveways, sidewalks and steps instead of water or a blower.

Consider adding mulch to help delay evaporation.

Investigate options to dethatch or core aerate lawns so water will reach the roots unobstructed. ¢ Explore options for the installation of trees and plants that will provide shade and promote less water use once established.

ELECTRICITY ¢ Wash clothes in cold water if they are not heavily soiled. It is less harsh on your garments and uses far less energy. ¢ Clean out your dryer ducts. Hang clothes to dry. ¢ Gradually switch to LED. ¢ Let the sun shine in! Allow natural light into your home as frequently as possible. ¢ Challenge your household to hold a “Powerless Hour” at peak times. ¢ Set your thermostat at a reasonable temperature.

¢ Opt for online purchases to be delivered with multiple items, not individually. ¢ Store food in glass jars. This prolongs their life and reduces food waste.

At every turn there is opportunity for each of us to make a difference. The best part about conserving is that you will benefit firsthand by reducing expenses and exercising mindful choices.

Living in an association can actually make it easier for owners to budget. A plan can be prepared to service appliances annually.

Your HOA may even welcome suggestions of group installation of water reduction aerators or plumbing inspections to ensure there are no leaks that the owners are unaware of. These types of proactive measures are beneficial to both the association and owners. Offer to help your HOA investigate group pricing for maintenance of a range of things. Remember, member support is crucial to community success. Whether your aim is to start small or decide to roll out a full-on maintenance and conservation plan, the effort will be greatly appreciated—so get started and challenge yourself to make a difference in your community!

FURRY FRIENDS: How Boards and Managers Can Handle Service Animal Requests  By A.J. Jahanian, Esq.

T

he Humane Society of the United States estimates that sixty-seven percent (67%) of American households have at least one pet. That amounts to approximately 85 million households with a furry friend of some nature. Couple that with the tens of thousands of homeowners associations in California alone, many of which have some sort of pet restriction in their governing documents, and you have a conflict on your hands: How do board members and managers handle an owner’s request for an exception to those pet restrictions?

Pet restrictions can be a positive tool to keep property values up, maintain some semblance of order and cleanliness and prevent nuisance complaints. Of course, boards have an obligation to enforce the governing documents, and management plays a prominent role in upholding that obligation. However, associations

also may have a legal duty to accommodate an owner’s service animal, even if it violates the CC&Rs, rules and regulations, etc.

A “Service Animal” is defined under California state law as a dog individually trained to do work or perform tasks for people with disabilities, including physical, sensory, psychiatric, sensory, or other mental disability. Tasks performed might include pulling a wheelchair, retrieving dropped items, alerting a person to a sound, etc. A common example is a guide dog, helping an individual with impaired vision.

On the other hand, an emotional support animal or comfort animal (such as a therapy dog) is one that isn’t necessarily trained to perform a task, but provides therapeutic help to improve the individual’s social, cognitive, or emotional functioning (i.e., depression, anxiety, loneliness, certain phobias, etc.).

Federal law prohibits housing discrimination on the basis of a disability and requires associations to make reasonable exceptions in their rules, regulations and policies, to afford people with disabilities equal opportunities. For example, a rule that says “no pets over 50 pounds allowed,” or “no pets in the pool area,” may be subject to an exception, if the animal is a service animal for the resident. Similarly, the California Fair

Employment and Housing Act requires associations to make reasonable accommodations to its rules, to ensure people with disabilities have fair access to housing.

o, community association leaders are required to make exceptions for disabled persons, within reason, to the association’s pet restrictions. Boards and managers are entitled to obtain the following information from a resident who is requesting an accommodation to the rules and policies: a) a statement affirming that the person suffers from a legal defined disability; b) a description of the requested accommodation; c) a description of the reason for the accommodation and how it relates to the disability (i.e., “I need an exception to the association’s pet restriction because…”); and d) written verification from a treating health practitioner/professional or other reliable third party, who is in a position to know about the individual’s disability and the related need for the accommodation sought. When it comes to a service animal in particular, the board may also ask for proof that the dog has been properly trained for the type of task that it performs on behalf of the disabled resident.

It’s important to note that the association should not be asking for the specifics about the person’s particular diagnosis or medical condition, the severity of the disability, medical records or medical history, etc.

Also, all information concerning the individual’s disability and their request for an accommodation must be kept confidential.

Remember, the association is not required to provide the resident with the “best” accommodation or an accommodation that would cause an undue burden on the association; rather, it only needs

to provide a “reasonable” accommodation. This means that an exception which would create a health or safety hazard does not need to be granted (i.e., allowing the animal to roam without a leash, exceptions to rules that prohibit vicious or violent animals, cleaning up after the animal, etc.). Additionally, the individual should also remain liable for any provable damage done to the premises or facilities by the service or emotional support animal.

To ensure compliance with federal and state law, associations should always remain sensitive to the rights of a disabled person.

Pet restrictions in your CC&Rs may be enforced to the extent that the rights of a disabled person are not infringed upon. Whenever reasonable accommodations are made (i.e. by allowing residents to keep a service animal in violation of CC&Rs) associations have the right to ask for documentation of a disability. To create a common understanding amongst owners and community association leaders about this process, boards should adopt reasonable accommodation policies that outline the procedures and protocols that a resident must go through, to obtain an exception to the rules. Such a policy may also include a sample request form, wherein a resident can fill in the necessary information that the board is required to review, before approving a request for a reasonable accommodation.

Traditional pest control methods commonly used today are under a microscope due to damage to non-target animals and the environment. But our homes and HOAs need pest control to maintain a safe and healthy environment. What can we do?

Pest control is most effective before an infestation; with minor planning, homeowners can protect their property by eliminating enticing environments. Physical alterations to your property such as plant placement and maintenance is an effective physical IPM technique. Thinning out plants and keeping them 3 feet away from the building removes shelter and access; skirting up plants by removing the lower branches and foliage can also help prevent pests from entering your home.

Integrated Pest Management, or IPM, is the answer. IPM focuses on developing ethical and effective pest management strategies that reduce the use of pesticides and prioritize a variety of non-pesticide solutions. IPM is most effective when used as preventative measures to limit pest infestations before they begin. These strategies include cultural, mechanical, biological, and chemical control methods.

The most common forms of cultural pest control are to keep trash cans closed, prevent trash from overflowing, and periodically cleaning trash cans; many types of pests are attracted to garbage as a food source. By eliminating the food source, pests will not be attracted to the area, and even if they do arrive, they won’t have the food source to sustain themselves.

Another common issue is residents leaving pet food and water out. Like garbage, pet food attracts pests; don’t provide a food source. Actively practicing cleanliness/ sanitation and preventative cultural habits can reduce unwanted pest infestations.

It is understandable wanting to eradicate pests as quickly as possible—rodents or bugs in your home can be unsettling. However, a “spray everywhere” pesticide treatment is not the right approach. IPM methods limit pesticide usage and emphasize alternative ways to reduce pest populations. Pests need three staples to succeed in becoming established: food, water, and shelter. Removing any, or all, of those essential elements reduces pest populations. IPM provides tactics to address those three staples.

Obviously, holes in a structure of any size provide easy entry points for pests. Rats can fit through an opening the size a quarter and mice can squeeze through openings as small as a dime, seal holes any larger than a dime. Do not leave garage doors open—not even 1 inch. Caulking around window and door trim will help limit insect access.

in many scenarios but can be cumbersome and cost prohibitive on a large scale. However, a well-trained technician can use these tools to identify the problem location and recommend solutions prior to using a pesticide.

The third phase of IPM is biological. In other words, use nature to fight back. The type of plants you grow around your property can play a big part in attracting or repelling pest populations.

In some cases, plants such as basil or bay leaf can help deter certain pests. Attracting predators to the area can cut down on pest activity, such as pests that affect gardens or crops. Consider installing raptor poles or owl boxes. Other options are the use of ladybugs to control aphids on plants, or the use of mosquito fish in water to control mosquito larvae. There are also biological methods that can be utilized to reduce the pest population and prevent or reduce the need for pesticides.

The final phase of IPM is the use of chemicals with the intent to reduce overall pesticide usage. Health and safety are the priority when controlling pests and if the pest population doesn’t react to the earlier phases of IPM, targeted pesticide usage is recommended. This phase most definitely must be combined with other methods of IPM; if the recommended changes are not implemented, the problem will most likely return, continuing the need for pesticides.

Rat bait stations must be secured, locked, labeled, and maintained regularly. Sprays cannot be used if there is wind over 10 mph, or rain is in the immediate forecast. Technicians must have specific licenses. Landscape pest services require a Qualified Applicators License (QAC), termite treatments require a Structural Pest Control Board (SPCB) Branch 3, and insect or rodent treatments require a SPCB Branch 2.

Ultimately, is the IPM approach right for you? The simple answer is yes—all homeowners, HOAs, businesses, etc., can effectively limit or even resolve their pest issues by using IPM measures.

Integrated pest management techniques help prevent pest problems before they develop, lower pesticide usage, are better for the environment, and are highly effective.

In IPM, the chemical phase does NOT mean “spray everywhere.”

By Denys Hemen Urban and suburban parts of Los Angeles allow for both positive and negative interactions with local wildlife. With a little work and understanding, humans and wild animals can coexist. In this article, we explore methods for sharing space with wildlife we may encounter.

Northern Raccoons and Virginia Opossums are active at night. To help keep them out of your yard, remove their reasons for being there. Do not leave any fallen fruit on the ground and never leave cat or dog food outside at night. Close up all entryways into your home both underneath, such as basement windows, and on your roof. These are some easy ways to deter nocturnal wildlife from coming around.

A common misunderstanding about Virginia Opossums is that they are vicious. These creatures are not aggressive and do not want anything to do with you. Virginia Opossums will sleep in sheds and areas like wood piles. To keep them out, make sure all entry ways in sheds are sealed and do not leave piles of “things” in your yard for them to take shelter under. Raccoons are curious and will test their limits. By nature, they want nothing to do with us but when fed by humans, they can get a little close for comfort. Usually, a quick squirt with a water hose will deter them from exploring the area.

2021 Final Legislative Update ¢¢¢ By Thomas M. Ware II, Esq. CCAL

W

hat a busy legislative session attempting to fend off the barbarians at the gate! Here are the CID highlights.

AB 502 – Election by Acclamation AB 502 deletes the 6,000-unit limitation for election by acclamation. It authorizes uncontested elections if the number of candidates are less than or equal to the number of vacancies.

However, the Legislature extended the initial election notice and mandated an additional reminder notice.

AB 1101 – AB 2912 Clean Up In 2018, AB 2912 was enacted to protect HOA finances by requiring: Boards pre-approve all transfers of greater than $10,000 or “5% of the HOAs total combined reserve and operating accounts, whichever is lower;” and obtain “fidelity bond” coverage to insure against theft by directors, officers, management agents, and management employees.

AB 1101 clarifies that “crime insurance” or “employee dishonesty policies,” in addition to fidelity bonds, satisfy the insurance requirements. AB 1101 eliminates confusion as to when preapproval of transfers is needed by eliminating the amorphous 5% transfer threshold. Written approval of transfers of $10,000 or more will be required for HOAs with 51 or more units. A lower threshold of $5,000 or more is required for smaller CIDs. AB 1101 also permits Managers to deposit HOA funds in credit union accounts protected by the National Credit Union Insurance Fund. No management company may comingle association’s funds with its own money or other association funds.

SB 9 – Lot Splitting – Duplexes SB 9 requires a municipality to treat a proposed housing development containing “no more than 2 residential units” as “single family residential housing.” The municipality must approve ministerially a duplex in a single family housing zone.

SB 9 is silent as to the impact of pre-existing CC&R restrictions prohibiting such a subdivision. There were concerns that SB 9 could be construed as constituting public policy in favor of permitting duplex construction. Senator Atkins, the author, represented in a journal letter that SB 9 is not intended to invalidate CC&R restrictions.

SB 10 - Lot Splitting - Ten Units Or Less SB 10 permits ministerial municipal authorization of ten unit or less developments in single family housing zones. At one point, the bill sought to amend the Davis-Stirling Act to invalidate

CC&R restrictions that prohibit or unreasonably restrict such construction. The Davis-Stirling amendment was deleted.

SB 391 – Emergency Powers SB 391 authorizes CID boards to meet by teleconference, without a physical location where members may attend, in an area affected by a disaster or emergency which makes an in person meetings impossible. This bill is an urgency bill, i.e., effective immediately.

SB 432 – Elections SB 432 addresses technical issues created by the passage of 2019 election legislation. It authorizes term limits, clarifies that a Board candidate must be in compliance with an assessment payment plan (rather than simply entering a payment plan), specifies that requirements placed on nominees must also apply to existing directors, amends the Corporations Code for recall elections to be consistent with the election timelines in the Civil Code, and requires an HOA to retain election materials for one year after the election.

AB 611 – Safe At Home Pursuant to the Safe at Home program, victims of domestic violence, sexual assault, stalking, human trafficking, or elder or dependent adult abuse may designate the Secretary of State as their agent for service of process and receipt of mail. The person’s actual address is confidential. This bill requires CIDs to use the Secretary of State address for association communications and to withhold or redact the person’s actual email and property address from membership lists.

SB 392 – Document Delivery This bill initially mandated providing owners’ documents digitally instead of by mail, unless an owner opted out of doing so. Initially, it also required all CIDs with 50 or more homes to maintain a website. This website requirement was deleted in late June. Subsequent amendments diluted the bill so much that it now does not do much of anything except allow an owner to choose a preferred alternate way of receiving (e.g., email) documents. The delivery designation procedure is not significantly different than the current law.

AB 1584 – Omnibus Bill - AB 3812 Clean Up AB 3182 created new rental restrictions on associations, which required, among other things, amending governing documents to comply by January 1, 2022. AB 1584 permits such amendments to be made without member approval pursuant to a process similar to adopting an operating rule. The Association will have until July 1, 2022 to conform its governing documents.
