OLD AND EARTHQUAKES grab all the headlines lately in our chapter. Sometimes small pests who are left unattended spread into big problems. This issue looks at some of those pests, and follows with some important maintenance tips.

David San Filippo writes about an often-overlooked type of pest: bees. He reminds us that bees can be a nuisance and even dangerous—especially Africanized bees—and he describes how to eliminate them.

Margaret Townsend details a deeper look into bee behavior. Look at the quick do’s and don’ts list to find how to act around bees, what not to wear, and how to react when bees turn aggressive.

Leslie Jones finds the statistic to grab people’s attention. The Los Angeles area ranks as the fourth worst city in the country for bed bug population. In her article, she outlines information to help communities make informed decisions on minimizing these pests.

Our second bed bug article takes us through the science related to the treatment options. Communities going through treatment can use this as a guide regarding what their owners and residents should expect as they go through the process.

FROM THE PRESIDENT

A

S SUMMER DRAWS TO AN END and we reflect on the Chapter’s accomplishments to-date, I cannot help but feel extremely proud of where we have been and where we are going!

On August 13 we held our annual Wine Night to benefit the California Legislative Action Committee (CAICLAC) and it was a huge success!

With more than 85 in attendance at the Aquarium of the Pacific in Long Beach, our members socialized, drank great wine and nibbled on snacks while surrounded with the best of company and all for a good cause. It simply does not get better than that! Thank you all for making this event so special and profitable for CAI-CLAC. I am pleased to report that we also held our first bowling tournament!

This event was spectacular and wellattended. We look forward to making this an annual event, allowing our members to network, have fun and get competitive with their bowling skills!

We also have a lot to look forward to this coming quarter! September 17 is our Essentials of Community Leadership Workshop at the SummerWind HOA in Torrance. This special orientation is geared to association board members.

In addition, our luncheon on September 21 will be downtown at the City Club LA, and you will learn all you need to know about “Tight Budgets, Tough Choices.”

nsects greatly outnumber mammals and are beneficial to our environment. However, there are a few nuisance pests that can manage to invade your home or property and prove to be harmful with a bite or sting, especially to those who are allergic or hypersensitive. We’ve all seen movies about “killer bees” and laughed at those old Bee Movies, but Africanized honeybees (AHB) are no joke! Africanized honeybees are a hybrid, resulting from the cross of the docile western and European honeybees. Africanized bees are extremely aggressive in temperament and reproduction.

BEEHIVE & BEE REMOVAL & EXTERMINATION

The signs of a bee infestation are clear. If you see several bees hovering near your house or condo, going in and out of a small hole, there’s likely a hive inside your wall void. You’re not just in physical danger, but also in danger of property damage that can be very expensive. California gets very hot during the summer, which can cause honeycombs to melt and seep into plaster and siding. Their hives can also attract other pests such as ants, mites, termites and carpet beetles.

Bees can establish hives under empty buckets, valve boxes, in garages, roofs, eaves, and trees. A few bees, lingering in one of these areas, may be a sign of thousands more. Worst of all, Africanized bees can take over native honeybee nests, killing their queen and establishing their own.

An Africanized queen can produce as many as 2,000 eggs per day, so you can get an idea of just how many might be expanding in the space inside their tiny entrance hole.

If a hive is on your property it should be removed immediately, but control of the honeybee should be done by a professional. A professional will positively identify the bee, and then work on locating and removing the hive.

Different methods may be used, depending on the hive’s location. Your licensed pest control operator will come up with the most economical solution.

SMOKE METHOD The beekeeper or other professional will locate the hive in or around your structure and then smoke out the bees until the hive is clear. Bees leaving the hive may be vacuumed up during the process for transport to another location for eradication.

The hive is then bagged and thrown away.

How does smoke work in bee control? Each worker bee in a hive has a distinct job to perform. One of those jobs is guarding the hive. Bees on guard duty spend their time at full alert, constantly vigilant for any threats to the hive’s

security. At any indication of an intruder (that would be the bee removal expert), they decide that something is wrong and release a pheromone to alert other bees to the situation. The signal “intruder alert!” can spread very rapidly throughout the hive, making potentially thousands of bees ready to attack within just a few seconds. But smoke wafting through the hive shuts that response down. The smoke masks the alert pheromone, cutting the lines of communication. Because of the smoke, mass confusion reigns, where there otherwise might have been a mass retaliation against the intruder.

The second way that smoke works is by setting off an internal fire alarm within each bee. The bees seem to instinctively understand that smoke = fire = possible evacuation. And just as you might grab your wallet or purse on the way out of your burning home, the bees prepare to evacuate by gorging themselves on honey. If they have to abandon their hive and start anew, they will need all of the honey they can carry for subsistence and for building new comb. So between the crippled communications and the frantic engorgement upon honey, the bees are considerably less likely to respond defensively to an intrusion into their home.

The smoke is just a tool, used when working a hive to keep the bees defensive response to a minimum. Although this method does allow most of the bees to be removed, it does not always prevent against the bees from returning.

INSECTICIDE If relocation of the bee colony proves difficult, insecticides are used to eradicate the colony. There is always a possibility that the colony will resettle, so many professionals will apply a dust, liquid, or aerosol insecticide to catch any of the remaining population left behind. The hive is sprayed with insecticides inside and out. Once the hive is empty, the professional carefully removes the honeycomb and honey. If you’re worried about chemicals near kids or pets, inquire whether the bee professional can use a natural or organic compound.

The beehive area is then thoroughly cleaned with soapy water and all entry points to the home or condo sealed with caulking or expandable foam to make sure the bees cannot get back in.

Sometime screens are installed on vents and rain spouts.

As a final note, remember that western and European honeybees don’t usually congregate near humans. Always assume the hive you’ve discovered in your walls or siding is Africanized.

f only one bee made one pound of honey that bee would search out over 2 million flowers and have to fly approximately 50,000 miles to make that pound of honey. All of us enjoy honey; that sweet sugary substance that is so good for us. One pound of honey is made by up to 560 bees working all at the same time! I like to call it ‘Liquid Gold’!

A bee colony has about 60,000 bees which is made up of Drones, Workers, and Queens. All of the work in their home, also known as a hive, is performed by the female worker bees.

The female worker bee and the queen can each create a drone bee.

The guys, aka drones, get a life of leisure which main purpose is to mate with the queen. Not too shabby guys, huh?! They have larger eyes than the worker or queen bee to better find the queen during their mating flight. Drones are typically born between June to November.

The bee scouts can take anywhere from 1 hour but up to 3 days, to find a more suitable spot. The swarm only takes a 3 day supply of honey to live on so it is imperative a new location is found quickly. The other bees surround the queen keeping it safe.

Although it looks scary, remember it is only a temporary location. Based on the excitement level of returning scouts a new permanent home is determined. The bees look as if they are dancing; shaking their bodies to show the location.

She has to convince other bees to go check out the spot she found so that they come back promoting the same location.

So shake away!

To put it in perspective, 20,000 bees is about 6 pounds of bees! But do not fear!

The bees are not aggressive during this time. They will only attack if someone is directly damaging their colony. Give them the three days to see if they move on. If they don’t, live removals are perfect for this type of bee colony.

What to Know Before You Get Stun!

If you happen to see a big ball of bees hanging from a tree limb or a building, the bees are most likely swarming. One pound of bees hanging from the branch is approximately 3300 bees. A swarm happens when the original hive has gotten too crowded. Typically, 1000 to 20,000 worker bees will take a newly made queen and swarm; looking for a new, uncrowded, and safe place to build their home. Usually, the first stop is not very far from the original hive.

Who Can Sting?

Male bees cannot sting since they are not equipped with a stinger. The female worker bees do all of the stinging but that comes at a cost…her life. When a female worker bee stings something, it leaves its stinger behind in its victim, along with the barb that is attached to the stinger and the venom (apitoxin) in the sac. In

— They work during the night making honey, building comb, nursing the babies, managing the pollen, nectar & honey food supplies, all in complete darkness inside the hive.

The bees never go to the bathroom in their hive. The inside of the hives is 100% sterilized, cleaner than a hospital.

Bee population is on the decline due to drought, pesticides, and disease.

Bees can get 8 different diseases Predators that kill the bees are: humans killing swarms (unfortunately!!!), birds, skunks, raccoons, lizards, bears, varroa mites etc.

Without the bees pollinating everything, you and I will never eat fresh veggies, fruits, nuts and seeds ever again.

The bee is the only insect that produces food for humans The bees have to visit and collect pollen and nectar from 2 million flowers in order to produce a pound of honey for you!

essence, her abdomen is torn away from her. Ouch! A female’s life is not easy or for the faint of heart! Interesting side note, it is the barbs on the female worker honey bee stinger that tells the difference between the honey bee and other bee species.

The queen can also sting but only early on in her life. Queens are created by the worker bees choosing a select few larva (worm stage) in specially constructed queen cells and being fed only royal jelly, instead of royal jelly and pollen. Oh, the life of a queen! The queens’ ability to sting, before it starts to lay eggs is used when defending her throne against other queens that had been created by the worker bees. She might be born when another queen bee is also born. They will fight to determine who will be queen. This ensures the health of the hive.It is survival of the fittest at its best.

Work, Work, Work… It’s off to work we go!

The saying, “Busy as a bee” describes bees exactly. They are always doing something! Female bees start to work as soon as they have chewed themselves out of their cell. They turn around and immediately clean the cells they just came out of. If only we could get our kids to clean their rooms like that! As they grow they then move on to feeding the babies, otherwise known as brood. Additionally, like we drive to the grocery store to shop for food some of the bees are tasked to fly up to 5 miles to forage for nectar and pollen on flowers. Once the ‘groceries’ are

brought back to the hive there are other bees tasked to process and make the beeswax and honey. This liquid gold is then watched over by the guard bees against the bee robbers from other hives and other stinging insects. If they are not careful bee robbers can steal all of their honey causing a hive to not make it through the winter. All of this is done by the female workers.

They even have undertaker bees that take the dead bees inside and dispose of them outside of the hive!

How Not to Be Stung!

Do not shoo bees away with your hand or swat at it like a fly. That will just make it angry and it will defend itself even more. When you see a bee buzzing around you or your child, remain calm. Remember to breath! Let it fly around you. Let it land on you. When you stay calm it will soon realize you do not have any pollen or nectar and move on unless you give it a reason to do otherwise! Remember, they do not want to die but will if defending themselves or their hive.

Minimize the amount of perfume or cologne if you wear. If you are allergic to bees do not where any perfume or cologne.

When wearing fragrances that make us smell like a flower; the bee thinks we are a flower. It will be attracted to the same smell and be searching for available nectar. Minimize the amount you wear or do not wear any fragrance at all.

What to Know Before You Get Stung!

Soda cans and other sugary drinks and fruit are huge attractants for foraging bees. The sugary fruit and soda attracts both bees and wasps. It makes their job so much easier! Whenever outdoors, be sure to look at the fruit before taking a bite. Even more so, if you are working, picnicking, camping or just having a soda outside take a look into the opening of the soda can before drinking from it. Sometimes bees and wasps land on the opening of the can, fly inside and then can’t get out. You then get stung as soon as you tip the can back and the bee flows with the liquid into your mouth.

Bee aware!

Do not wear prints that make you the flower! Bright colors on your shirt will look like the bright colors of a flower. Think beige, browns, whites… think what colors bees like... and avoid wearing those colors.

Wear long pants, long sleeves and shoes when walking, especially on the grass.

If All Else Fails: If after doing all the above, you still get stung, don’t give up!

There is something more that you can do!

Bees sting what they believe are intruders. This is their defense since they believe you are attacking them or their hive. When a bee stings someone, it leaves it stinger along with the barb attached behind in its victim. The sac that holds the venom is usually attached.The bee also sends out a pheromone which calls upon the other bee members to help defend their home.

This pheromone puts the bees into an attack mode.We would do the same if our home was being invaded!

STAY CALM! There are ways to minimize the damage done.

Take a few deep breaths, calm yourself or your child down.

I usually find a popsicle at this point is a great way to calm someone down!

Then follow these steps: 1. If there are multiple bees flying around, slowly walk away from the area. Do not run. Go as far as you can until you notice the other bees are no longer following you. Bees will forage up to 5 miles from their hive so if there was only one foraging bee that you happen to be so ‘lucky’ to get stung by, it is okay to stay where you are.

to see if they recommend for you to carry a couple of Epi-Pens which contain epinephrine.

If no allergic reaction occurred, look to see where the stinger is. All worker honey bees lose their stinger (and their life) when they sting someone.

Locate the venom sac. It should be at the back end of the stinger farthest away from your skin. It looks like a small bag. Whatever you do DO NOT squeeze or grab the sac.

This sac holds the venom. If you squeeze the sac you will be pushing the venom into you. That’s a NO-NO! After locating the stinger & sac, use your fingernail, or a plastic flat card (credit or debit – it doesn’t matter in this case!) or a pocket knife and scrape it off at the base of your skin and the bottom of the stinger that you can still see. If you choose to use tweezers grab the stinger closest to your skin. Remember, your goal is to remove the stinger and sac without pushing the venom into you. The faster you remove the stinger the less venom will be released into the site of the sting. Speed is of essence.

Once the stinger has been removed it is good to wrap some ice in a towel and put it on the red area where stung for 10 minutes and off for 10 minutes. Keep the area elevated to help reduce swelling. WebMD recommends to, “take an antihistamine and use a hydrocortisone cream to relieve swelling and itching.”

>>> By Leslee Jones In recent years, Los Angeles has ranked fourth for the worst city in the nation for bed bug infestations, with the Bay Area coming in 16th place.

When bed bugs arise in a property, assigning responsibility can be extremely difficult. Community managers want the issue handled quickly and discreetly, but without a known origin, it can be hard to prevent their continuation.

Since bed bug infestations are so easily spread to neighboring units, assuring clean units is both the community manager’s and the homeowner’s responsibility. There are various reasons an infestation may get out-of-control, including lack of knowledge and fear of repercussions from your homeowners.

Bed bug bites are so mild that they rarely awaken a sleeping host. Unfortunately, the bites can develop into ugly welts and even cause a mild rash. In extreme cases, the bite will fester and form boils.

Some people do not notice bites every night because bed bugs usually do not feed daily. This is problematic for community managers, as your home owners may not realize that they have a problem until it gets grows into a larger problem. In addition to this, bites sometimes take a few days to manifest themselves, which can delay the discovery of an infestation in your properties. And with females being able to lay up to 500 eggs, the infestation can escalate rapidly.

FEAR OF REPERCUSSIONS Another reason bed bug infestations may grow is fear of repercussions. Most homeowners fear telling their managers, as they do not want to or cannot pay for the eradication process. By educating homeowners on bed bug eradication, the problem may be solved quickly and efficiently.

Eliminating bed bugs completely can be an extremely difficult task. In the past, most sufferers of bed bug infestations have chosen to attack using chemical treatments. Although this is a cost-effective solution, there is another, greener option—a heat treatment.

LACK OF KNOWLEDGE The common bed bug is an extremely-fascinating and highlyaggravating insect. Resilient and tenacious, every pest control expert will tell you that it is one of the most difficult insects to eliminate from a property. Every community manager should know how to handle a bed bug infestation.

Although bed bugs are usually spotted in the nooks of your bed or dresser drawers, bed bugs prefer a human host. They simply prefer to dine on human hosts. But don’t panic over this, as they are more a nuisance than a threat to your health.

Even though they prefer a human host, most people are unaware they are being bitten. Since bed bugs don’t actually live on their human prey like lice, fleas and other pestilential insects, you will not notice them on your skin. Instead, they prefer the warmth and security of bed linens, clothes and even luggage.

Heat is an incredibly effective way to kill the bed bugs, including the eggs. It is the only non-chemical method used to successfully treat an entire structure. With chemical treatments, the resident would have to bag/remove/launder all soft goods. The chemical treatment would also have to reoccur to kill eggs that later hatch. With a heat treatment, all of the items in the residence remain inside, and residents can return immediately after treatment. Heat is also an excellent option for those who are sensitive to chemical smells. Most heat treatment companies look for a minimum kill temperature in the 120F range. A company uses 122-125F air temperature to start the “cook” process. Cook will last anywhere from 2 to 3 hours. In that time temperatures may enter the 150’s, but usually no more, since it would create issues with paint and wallpaper peeling.

When a heat treatment is selected, a company may partner with an established pest control company to ensure a maximum fighting effort. The pest control company applies chemical treatments to the wall cavities to ensure killing bed bugs that try to migrate away from the heat into a neighboring unit.

number of hours. They use an internal monitoring system to ensure proper kill temperatures are reached so the eggs, as well as the bed bugs, are killed. Prior to heating, technicians will be inside the location moving items around with the unit to create a life-sized laundry dryer in order to achieve the kill temperatures inside all areas of the residence.

Upon completion, the owner, the pest control company and/or the manager will receive a printout of the interior temperatures to support peace-of-mind that kill temperatures were achieved and for the time length required (usually one 8-hour day, depending on infestation).

If the owner or manager wants further confirmation that they are clear of their pesky problem, a dog sniffer can be hired. These dogs are trained to smell for bed bugs and are recommended before and after treatment. They will help sniff for migrating bed bugs who may not be reported by neighboring units yet, as well as confirmation once the kill treatments have been applied.

Bed Bug Basics zz Bed bugs are small insects, about the size of an apple seed. Adult bed bugs are flat, oval and reddishbrown in color. Juvenile bed bugs can be very small and hard to see. zz Bed bugs feed on human blood and can live for over a year without a meal. zz Bed bugs usually hide during the day near where people rest or sleep and then come out at night to feed.

Bed bugs do not live on our bodies. zz Some people do not react when bitten by a bed bug.

Heat coupled with your current pest control company’s chemical treatment will leave your homeowners in a clean environment and you sleeping peacefully at night.

zz Most bed bugs are found within 8 feet of a person’s resting place. As the infestation grows, bed bugs will spread further. You can find bed bugs in any of the following places: zz In mattresses, box springs, bed frames, and bedding zz In the cracks and crevices of furniture zz Behind peeling wall paper zz Behind pictures and clocks zz In curtains zz In cracks in hardwood floors zz Under carpeting zz Behind electrical outlets or switch plates

Whole Room Heat Treatments

Whole room heat treatments involve a Pest Management Professional (PMP) bringing in specially designed equipment to raise the temperature in your home to kill the bed bugs.

Bed bugs and eggs die within 90 minutes at 118°F (48°C) or immediately at 122°F (50°C).

During a heat treatment, the air temperature in the room is typically between 135°F (57.2°C) and 145°F (62.7 °C). The (PMP) will place remote thermometers throughout the home, to make sure the right temperatures are reached. The PMP watches the thermometers closely to ensure that it gets hot enough to kill bed bugs. A heat treatment typically takes between six and eight hours, depending on the condition of the area being treated.

During the heat treatment pets and any heat sensitive items that may melt or be damaged at temperatures up to 150°F degrees should be removed from the area being treated. Make sure you discuss this with your PMP as anything not treated with heat will need to be treated in another way.

Heat treatments do not offer any residual effects and your home could quickly become reinfested after a heat treatment if prevention steps are not taken.

Often, a residual insecticide will be applied to the border of the home/room being treated for bed bugs as a prevention step.

Insecticide Treatments

Insecticide treatments that are conducted thoroughly and correctly by a licensed PMP can be a very effective way of controlling bed bugs. Three different types of insecticides should be used in order to achieve the best result. There are many different brands of insecticides but one of each of the following broad categories should be used.

• A fast-acting, contact insecticide for use on surfaces that humans frequently touch, i.e. sofas.

• A residual insecticide for inside furniture, cracks and crevices and the underside of surfaces we touch.

• A dust insecticide for cracks, crevices and voids, such as electrical outlets and baseboards.

Your PMP may offer other services such as container heat treatments,

steam applications, or freezing infested items. Usually, items treated with these optional controls do not require an insecticide treatment and therefore fewer insecticides are needed.

A thorough insecticide treatment should involve 2-3 visits from the PMP, as it is unlikely all the bed bugs will be killed in the initial treatment. An insecticide treatment typically takes about 30 minutes to 2 hours per room depending on size and condition of the room. Once the treatment is complete you should wait until all the insecticides have dried before reentering your home, or until the PMP says it is safe to re-enter.

Before any treatment the PMP should provide you with a detailed list of instructions for how to prepare your home. It is very important to follow these directions closely as properly preparing the home is a very important step in any treatment process. Improper preparation is one of the main reasons that treatment for bed bugs fail.

We strongly recommend against trying to conduct an insecticide treatment for bed bugs by yourself. Controlling bed bugs with insecticides is a challenging and time consuming process which requires expertise and in many states a license is required to apply the insecticides which kill bed bugs. The insecticides that can be purchased in a hardware store, such as foggers, are not effective in controlling bed bugs and we strongly recommend against their use.

During your annual Termite Control Plan, drywood termites will be found, and often can be locally treated. One local treatment product that we are repeatedly questioned about is Orange Oil (XT-2000), and the effectiveness of this “green” product. To be clear, this is not literally “orange oil”, but rather still a chemical compound. In 2009, Dr. Lewis completed laboratory investigations at UC Berkeley using six different products, one of them being Orange Oil (XT-2000).

Compared to a controlled group of water, Orange Oil yielded the same results. Therefore, the results were proven that orange oil was not effective.

Few companies in the industry still use Orange Oil (XT-2000), but when they do, they are coupling it with other products to achieve successful results. The consumer is often unaware that this is happening, as they are uneducated in the products disclosed. The chemical Termidor is commonly used, as this was proven in the same UC Berkeley study to be the most effective, with success rates upwards of 95%. This means that companies still selling Orange Oil (XT-2000) are charging to use a more expensive product, but are also charging for the more traditional products to achieve desired results.

Unfortunately, not all pest control companies are equipped to be successful in the HOA world. Outside the industry, it will be hard to judge the quality of work you will receive. A good start would be checking the status of the company’s business

license, reliability of the company’s reputation with HOA board member referrals, or any complaints with the Structural Pest Control Board (the body who governs all pest control companies). Inviting your pest management professional to a board meeting is one of the best ways of getting the correct education to your board members!

OUR NEW LANDSCAPE RENOVATION PROJECT is installed and it’s time to gear up for project final walk-thru completion, including landscaping and HOA takeover. More management companies currently are having the contractor warranty/carry the project, in some cases as long as 90 days, to “test the water” for plant health of the parkways, maintenance districts or HOA common area landscaping and slopes.

Your landscaping is starting to be fairly established, but what about the long-range effects, such as plant/tree replacement and the possibilities of landscape/slope failure?

The people with the ultimate responsibility for approving landscaped areas are becoming more critical in granting final sign-offs. In some cases, the individuals in charge for the

HOAs are not veterans of the landscape industry; therefore, you will find them more unsure of giving that final approval to the contractor.

It is important that you take time to work closely with your design consultant on plant palettes, nurse crop (fast-growing vegetation) vs. permanent landscape and, most important, the compatibility of soils and plant material. If you do not, you could be left “holding the bag.” Your landscaping could go from a temporary nurse crop to a permanent landscaping of weeds, possibly due to soils or a bad selection of plant material long-term.

Our office is constantly experimenting to find more effective plant material, especially for slopes and turf replacement.

Good initial planting combined with proper irrigation practices can result in a project that is complete and ready for approval when the time comes. The interrelation of shrubs,

Maintenance Blues trees and ground cover — of how they compete and grow with each other —is vital. There can be a mix that looks great for six months, but all the permanent growth is eradicated or stunted due to overcrowding by early vegetation. Imagine a fix to 10 acres of slopes and common areas that need to be re-landscaped because the short-term vegetation dies out and there is not enough permanent vegetation to ensure good long-term coverage.

We see “final approval” becoming an increasing area of concern for our clients. HOA managers should be aware of ever-changing rules and ordinances within the municipalities and HOAs —especially regarding any new water restrictions. By selecting a good overall plant palette and acquiring an accurate set of as-built plans, you can rest assured that the project has a good chance of being finalized for maintenance responsibilities. You also will then have documentation for any subsequent problems, such

as irrigation, mainline breaks, unknown irrigation system sleeve locations, poor plant installation and tampering. And lastly, get the new landscape plans digitized and keep safely filed. Too many times HOAs do not have the original plans when it is necessary to locate and determine the problem areas. Scaled plans are most important for any future work or renovation procedures.

If renovation landscaping is needed years down the road and previous recommendations are needed for the relandscaping request, the HOA management company has a lot at stake to prepare a new landscape installation that, from that point on, and will last for many years to come, including lower water use.

❚ ❚ ❚ By Timothy Cline, CIRMS™ MYTH: SPECIAL ASSESSMENT COVERAGE WILL PAY THE UNIT OWNERS PORTION OF ANY SPECIAL ASSESSMENT THAT ARISES FROM AN EARTHQUAKE LOSS MINUS THE POLICY’S DEDUCTIBLE. Fact: Not all special assessments will be covered by the CEA policy. For example, the CEA will not cover special assessments for earthquake damage to: recreational buildings, clubhouses, pools, spas, tennis courts, streets, curbs, sidewalks, other detached common areas and buildings not containing dwellings. It will also not pay for bad debt (the portion of a special assessment that is higher because one or more unit owners chose to walk away from his/her investment).

MYTH: MOST HOMEOWNERS HAVE EARTHQUAKE COVERAGE. Fact: The California Department of Insurance (“Earthquake Premium and Policy Count Data Call: Summary of 2014 Residential & Commercial market Totals”) indicates that only 15.39 % of California condominium unit owners who buy homeowners insurance obtain protection for the peril of earthquake. This means that 84.61% of condo residents have NO earthquake coverage.

MYTH: ANYONE CAN PURCHASE AN INDIVIDUAL CEA POLICY. Fact: Not all owners can buy CEA coverage. In order to obtain CEA coverage, the owner must meet two important criteria: they must purchase an underlying Condominium Unit Owner Policy (HO6); and the HO6 must be purchased from an insurance carrier that participates with the CEA. If only a couple of buildings in the complex are damaged, the percentage deductible is applied to the values of only those structures, resulting in a far lower deductible.

MYTH: THE CARRIER WILL NOT PAY THEIR PORTION OF THE CLAIM UNTIL THE MONEY FOR THE ASSOCIATION’S DEDUCTIBLE IS RAISED. Fact: The Association’s carrier is obligated to meet their contractual obligation to pay their portion of the loss regardless of whether the Board has successfully raised the money for the deductible or not.

MYTH: THE UNIT OWNER IS LIABLE FOR PART OF THE MASTER POLICY DEDUCTIBLE. Fact: The Association, not the unit owner, has the “liability” for the deductible. This exposure rests of the Board of Director’s shoulders as the governing body for the Association. The exposure for the unit owner is not the deductible, but the special assessment levied by the Board to address the deductible.

MYTH: THE TOTAL AMOUNT OF EARTHQUAKE COVERAGE MAINTAINED BY THE ASSOCIATION WILL BE SUFFICIENT AND REFLECTS THE MAXIMUM TOTAL REPLACEMENT COST. Fact: No one truly knows the actual replacement cost for a building until a loss occurs and the Board of Directors begins receiving bids for replacement/repair. So even though an Association maintains $7,000,000 of earthquake coverage, for example, the reality is the cost to rebuild still may be even higher.

due to a shortage of labor and construction materials after any catastrophe). Demand Surge could result in the replacement cost for the Associations actually be $8,000,000, $9,000,000 or even higher. This would substantially increase the special assessment levied by the Board against each owner in the community.

MYTH: IF THE ASSOCIATION CHOOSES A VERY LOW DEDUCTIBLE (5%), THERE IS NO NEED TO BUY A CEA LOSS ASSESSMENT POLICY BECAUSE THE AMOUNT THE INDIVIDUAL IS RESPONSIBLE FOR IS RELATIVELY LOW. Fact: As discussed in the response to myth #7 above, the coverage limit maintained by the Association may be inadequate to replace the HOA’s improvements, resulting in a special assessment to cover the shortfall. Furthermore, if the Master Policy carrier goes insolvent, the Association may have no alternative but to levy a special assessment. Finally, if the Master Policy carrier does go insolvent and there is a decision not to rebuild, the CEA policy affords a unit owner the opportunity to use the Loss Assessment coverage to apply to the balance of the unit owner’s mortgage.

As a result, Earthquake Loss Assessment Coverage should be considered to be a mandatory purchase regardless of the size of the deductible on the Association’s master earthquake policy.

ugust is the last month in a two-year legislative session.

It’s a hectic time as hundreds of remaining bills are pressed up against the deadline for hearings and floor votes. Bills that pass to Governor Brown will be signed or vetoed by September 30. Most bills take effect January 1, 2017, unless there is a different date specified in the bill, such as urgent measures which become effective upon signing.

In our last advocacy update we were pleased to relate that CAICLAC led the fight to defeat Assembly Bill 1720, which was officially sponsored by the Conference of County Bar Associations and the Center for California Homeowners Association Law. The measure initially required association boards to open their meetings to members’ attorneys, and then was further amended to allow “any person” to attend, and presumably take notes or tape the discourse. This amendment would have also ushered the media into our private corporate board meetings.

CAI-CLAC delivered in excess of 1,000 email letters, and the bill easily passed the Assembly Housing Committee and Assembly floor votes. It got much tougher in the Senate Housing Committee and was eventually halted by the Chair of the Senate Judiciary Committee. The lesson? Get more grassroots sprouting among association members.

The Governor signed AB 1963 which extended the current construction defect remedy provisions in law from July 2017 to January 2025. That bill was unopposed.

We amended AB 2362 to allow signage to be placed in areas where unlicensed pest control operators applied chemicals. The measure initially required individual notices.

Three bills dealing with sober living and drug treatment housing were denied passage.

A positive outcome in 2016 has been the dialogue that we initiated with the California Bankers Association on the topics of association solvency, delinquent assessments and foreclosures.

SETTING UP A MAINTENANCE PROGRAM A maintenance program has two areas of responsibility: 1. SCHEDULING ROOF INSPECTIONS. At least two inspections should be made every year. Ideally, inspections should take place in the spring to check on damage that may have occurred in the winter, so repairs can be scheduled during the fair weather, summer months. The second inspection should be in the fall to be sure that the roof is in good condition for the upcoming winter months.

Inspection should also be made after any other occurrences that might affect the roof. (Example: storms, construction activities, fires, etc.)

Protecting Your Investment ■ ■ ■ By Ruben Quezada History has proven that many roof damages are the result of individuals or companies performing maintenance or construction on a building during or after the installation of your roofing system. These persons are liable for any damages to your roofing system. If emergency repairs are required, the board of directors should take immediate action to prevent entry of water into the roofing system and building interior.

2. CONDUCTING INSPECTIONS. All components of the roofing system should be closely inspected and a record made of any signs of deterioration, unusual traffic patterns, poor drainage, accumulated debris, displacement or loss of ballast, or other conditions.

SEALANTS The primary area of maintenance is the sealants on the roofing system. All pitch pan fillers, caulking, and sealants must be examined during all regular inspections. Sealants are a major item in any maintenance program due to the extreme stresses created in these areas. Sealants are susceptible to cracking, pulling away from the walls or other surfaces, and splitting.

Sealant replacement should take place at the first sign of deterioration.

DRAINAGE The roof structure should provide for positive drainage to eliminate ponding water whenever possible. The weight of ponding water may deflect the decking and framing members, causing damage to the structure and the roofing system. Proper roof drainage is a very important item in a maintenance program. These structural issues should be addressed with your engineering and architectural advisors.

WHY REGULAR INSPECTIONS & MAINTENANCE?

Drains should be kept clear, and any debris that may clog a drain such as tennis balls, baseballs, beverage cans, etc. should be removed during each inspection. Every drain should have a clean “leaf” grate present to prevent clogging of the drainpipes.

Roofs are constantly under attack by weather, structural movement, and stresses, as well as chemicals present in the atmosphere. While normal aging will occur on all roofs, small problems stemming from neglect, abuse, contamination, error or accident can result in costly repairs or premature failure of the roofing system, if not detected. A regular program of inspection and repairs will help detect minor problems before they become serious, avoiding interruptions of the internal functions within the building, and most importantly, protecting the owner’s investment by adding years to the life of the roof.

A roof inspection in the late fall should also include the removal of leaves. A clean industrial broom can be used to sweep the leaves from the drainage path(s). Another way of removing leaves and other debris as well as observing drainage patterns and activity, is to “wash” the roof. Washing also removes the dirt from the roof surface, which is helpful for reviewing typical membrane wear during the roof inspection.

Washing will also help maintain white membrane’s solar reflectivity. When cleaning the membrane surface, use a nonsudsing, non-abrasive, powdered cleanser (Ex. “Spic-n-Span”).

PARAPET WALLS Parapet walls should be inspected for deteriorating copings, cracked or open mortar joints or other signs of wear and tear.

Degradation of the parapet wall can lead to water penetration into the structure, which is not only harmful to a structure, it may also cause the failure of parts of the roofing system.

Insulation, decking, framing members, and the fasteners in a mechanically-attached roofing system may all be adversely affected by moisture penetration.

BUILDING STRUCTURE The condition of the interior and exterior of the building structure should be visually checked during your regularly scheduled inspections. Defects within a structure can affect the roofing system because of the interactions between the structure and the roofing system.

Building Structure: Interior If a drop ceiling is present, the interior can be viewed by removing ceiling tiles. The walls should be viewed for settling, cracking or movement. The decking should not be rusted (if metal) or deteriorating (if wood). Any water stains that become evident after the installation of the roofing system will require research to determine the entry point of the water/moisture. A concrete deck should be checked for spalling, cracking and/or distortion of the deck to reveal possible structural defects. Any or all of these items can affect the roofing system because of the stresses revealed. Contact a professional roofer for an evaluation when encountering any of these items.

the access panels are properly fastened in place, and that the drainage lines are functioning properly. Clogged drain lines and missing panels are items that create leakage into the structure.

BALLAST If a ballasted system has been installed, make sure the ballast is evenly distributed. Extreme care should be taken when inspecting the ballast, reviewing the corners, perimeter, and around penetrations for bare spots due to the increased wind effects in these areas. The ballast should be redistributed, taking care to not damage the membrane. If your inspections reveal that the ballast is being moved repeatedly, it may be necessary to place an interlocking paver system in these areas.

The even distribution of ballast can have a direct correlation to the longevity of a roofing system.

GOOD HOUSEKEEPING The final area of inspection is the general appearance of the roof and the surface conditions of the membrane. General appearance is primarily a function of housekeeping. Debris, poor drainage or ponding water can directly affect the roofing system. An effective maintenance program will address these items and prevent damages to the roofing system.

Building Structure: Exterior The exterior of the structure should be inspected for open mortar joints, poor laps in siding, concrete spalling, loose fascia or general degradation. Any of these items will allow water and moisture penetration, which may affect the longevity of the roofing system, and the structure itself.

New water stains on exterior walls may indicate that the coping or other terminations are leaking.

ROOF TIE-INS Tie-in areas should be thoroughly inspected for any sign of failure. Tie-ins have different materials in contact, which may create an area of stress. The sealants and other items in these areas should be reviewed for cracking, splitting or gaps.

Degradation of the other roofing system may have direct impact on the performance of the roofing system.

AIR CONDITIONING UNITS Care must be taken to insure that any small, sharp debris is removed from the roof. Check around air conditioning equipment, other penetrations and elevation changes, and areas of access. Air conditioners should be checked to insure that

We convey our readiness (or not) to be considered a professional manager who can work with many owners, boards and real estate professionals by acting professionally at all times in the public arena. We never know when another manager or lawyer makes a mental note of meeting us at an event or in a class. Are they impressed with your appropriate “business dress” at a class…or by the questions you

ask…or by watching you interact with other attendees?
