To help our Chapter achieve this connection, FOCUS will continue our presentation of topics that help our members grow in their understanding of community. Often this will involve articles that mirror topics from the educational programs and luncheons. It allows us to expand our reach and share topical information. The current issue follows emerging trends in living under the microscope and expands on some of the topics from the January luncheon.

Mike Lewis gives us the introduction to drones from an enthusiast’s point-of-view with the basics on terminology, frequent uses and challenges. Knowing that this trend is only likely to increase, Mike looks at how we should expect to see drones being used in our communities.

Michael Perlof shows us the real-world uses of drones. Beyond enthusiasts, businesses are considering how to make the best use of aerial assistance to benefit their customers. Building contractors are probably the earliest adopters of this technology, and Michael offers some insight into how others see those opportunities.

Robert Hillshafer presents some quick tips on how to address the legal challenges that these drones cause.

As always, being proactive means that communities can set realistic expectations for drone enthusiasts and concerned owners.

Rickey Teems brings us his perspective as a security professional. Looking at privacy and security issues, Rickey offers his tips to manage expectations and minimize potential hazards.

Skip Daum summarizes all the latest and greatest from Sacramento. Please take time to review and see what challenges lie ahead. The California Legislative Action Committee needs our support to keep our communities strong.

I

T IS MY PLEASURE AND PRIVILEGE to have been elected to serve as this great Chapter’s President for 2016! I do have quite large and very fashionable shoes to fill from Katy Krupp who took this Chapter to a dynamic level last year. I hope to continue the success and momentum that Katy started. I am so honored to take the baton from such a dedicated member of our Chapter.

Katy is responsible for the amazing growth of our Chapter’s membership, as well as instituting regional luncheon events.

Under her watchful eye, the manager mentoring program was hatched, and she has always led by example. Thank you, Katy, for your selfless service, and I know we will continue to build on each and every one of your milestones.

Your 2016 Board of Directors consists of true leaders in our industry who bring to the board table their knowledge, education, experience and passion for CAI. I truly have never known a more cohesive, qualified and well-rounded group of individuals who I am lucky to work with as my contemporaries to guide this Chapter towards all the goals and achievements that await us in 2016!

The year is filled with educational seminars, social events, and marketing and networking opportunities that offer something wonderful for every member of our Chapter. As we move forward, my underlying goal is to remember individual accountability, starting from those creative and intelligent members that sit around the board table with me.

Being a part of such a great organization means making a difference on a personal level. It is important to me that all members do their part to contribute to the good of the whole.

I encourage Chapter board members to make themselves known at all industry events and take action that benefits our members and our communities. I am also proud to inform the membership that the Board of Directors has adopted a tagline for our Chapter that truly captures the essence of who we are. After much contemplation and consideration, our tagline is “Connecting Communities Through Education, Advocacy & Service.” This simple statement encompasses our basic goals as a Chapter, of which we must never lose sight.

Each member taking accountability to contribute in even the slightest manner can only lead to success and further growth as a Chapter. We must all strive to educate not only ourselves but those new to our industry and Chapter; we must advocate for our communities in Sacramento as well as on a local level; and most importantly, we must all be willing to serve a greater good that focuses on the whole not the individual.

A partner with Beaumont Gitlin Tashjian, Lisa has devoted her career to representing community associations, focusing on litigation, including dispute resolution, arbitration and trial work. She also supervises the firm’s attorneymanaged assessment collections department.

Lisa is currently serving her sixth year on the CAI-GLAC Board of Directors, as well as being a frequent facilitator of the Essentials of Community Leadership Workshops. She served as Chair of the CAI-GLAC Legislative Support Committee for five years, is currently Board Liaison to the Mediation Services Committee, and is also a Past President of the CAI-Channel Island Chapter. As 2016 Chapter President, Lisa is dedicated to helping the Chapter reach its goals and to providing all members with great educational, marketing and networking opportunities.

Joanne Peña has been a portfolio manager with Horizon Management Company since June 1995. Prior to joining Horizon Management Company, she served on the SummerWind Condominium Association Board of Directors and was Board President for two years. Joanne previously served on the CAI-GLAC Board of Directors (2002-2008) and was Chapter President in 2005. Joanne has served on the Executive Committee as Chapter Secretary for the past three years, and in 2016 will be serving as President Elect. In addition Joanne has co-chaired the Wine Night Committee and is Board Liaison to the Membership and Community Outreach Committees.

Joanne actively supports the Chapter’s efforts to promote professionalism within the industry, provide educational opportunities for managers and community volunteers, and offer valuable networking opportunities for our business partner members.

Michael Lewis has been active in the property management industry for more than 10 years and specializes in community associations. He is the CEO of Concept Seven, LLC, in Torrance.

Mike is serving a second three-year term on the CAI-GLAC Board of Directors. He is an active member and supporter of this chapter, previously serving as Chair of the Chapter’s South Bay Satellite education programs. Mike is currently Chair of the Finance Committee and Board Liaison to the Publications Committee.

Mike plans to continue working on the goals and aspirations that the board has implemented over the last few years. The Chapter is seeing record income, growth and member retention as compared to the prior decade, and he is committed to helping to continue these trends while developing more efficient and innovative ways of serving the membership. With the Business Partner category being the largest contingent of members, Mike strongly believes that focusing on their overall satisfaction will lead to continued success and growth for the membership as a while.

Don Campbell is the general manager at Cabrini Villas Homeowners Association in Burbank, a community of 863 homes covering 77 acres. This year’s Chapter Secretary, he was appointed to the CAIGLAC Board in early 2014 and was just elected for a three-year term.

Don served three years as Social Committee Co-chair and continues to volunteer as a Social Committee member and as Board Liaison to the Golf Committee.

Don is devoted to helping the Greater Los Angeles Chapter continue to thrive. He wants to give back some of this time to an industry that has been a personal source of inspiration to him and one that he happens to love. Don enjoys being in the company of like-minded individuals who feel the same way.

Meigan Everett has been an active member of this chapter and one of its greatest ambassadors since 2007. She is a real estate broker, philanthropist and owner of Gold Coast Property Pros in Marina del Rey. Meigan is serving a second year as Chapter Treasurer and has served as Chair of the Community Outreach Committee for more than seven years. She is also the Board Liaison to the Finance and Social Media Committees.

Dedicated to her profession for more than 16 years, Meigan believes that CAI and its network of business partners are key to professional, knowledgeable community management. She wants to continue to ensure that managers, HOA board members and business partners learn the value of membership in CAI and benefit from its resources.

He is also on the CAI-Greater Inland Empire Chapter Board of Directors.

MATT OBER, ESQ. RICHARDSON HARMAN OBER PC Matt Ober is a senior partner of Richardson Harman Ober PC, where his practice is dedicated to the exclusive representation of community associations throughout Southern California. Matt is a member of CAI’s National Faculty, a Fellow of CAI’s College of Community Association Lawyers (CCAL) and on the CCAL, a Delegate to and Secretary of CAI’s California Legislative Action Committee (CLAC) and a coauthor of CAI’s California Law Course for Community Association Managers and CAI’s Board Education Course. Matt also serves as a member of the CCAL Board of Governors and CAI National’s Government and Public Affairs Committee.

Matt has served the Chapter in many capacities, most recently as Chapter President from May 2013 through December 2014. He believes that the Chapter has a responsibility to engage all of its members at the highest level—to establish a meaningful connection, whether it be through events, education or online services. Matt is committed to strengthening chapter communication through social media and e-newsletters to enhance CAI-GLAC’s reputation as a leading source of community association support and education.

CASTLEGATE HOMEOWNERS ASSOCIATION

Dick Pruess is both the current and a past president of Castlegate Homeowners Association in Pasadena, and presently serving and has served on several committees over the past 18 years. He served as 2003 CAI-GLAC Chapter President, received the CAI Award of Excellence in Chapter Leadership for 2003-2004, the GLAC President’s Award in 2004 and the 2012 CAI National Award of Excellence in Government and Public Affairs at the 2013 CAI Annual Conference in San Diego.

Dick also served on the Executive Committee of the California Legislative Action Committee (CLAC) for seven years, is still on the board, and is a Past Chair. In 2009, he received the Volunteer of the Year Award from CLAC for his commitment to and participation in helping revise the Davis-Stirling Act. Having been very active in HOA legislative matters, as the Board Liaison to the CAI-GLAC Legislative Support Committee, Dick would like to increase our members’ awareness of legislation affecting HOAs and the importance of carrying our voice to Sacramento.

WARNER CLUB VILLAS HOMEOWNERS ASSOCIATION

Lynn Ruger is on the Warner Club Villas HOA Board of Directors in Woodland Hills. A CAI member since 2009, Lynn has enjoyed many of CAI’s activities, including Valencia Breakfasts, Essentials Workshops, HOA Marketplaces and other activities.

She has just been elected for a second three-year term on the CAIGLAC Board of Directors. As Board Liaison to the Membership Committee, Lynn is dedicated to spreading the word about CAI and its benefits to HOAs and to continuing to help in developing HOA education and resources.

GET INVOLVED… JOIN A CHAPTER COMMITTEE

Did you know that more than 100 of our chapter members actively participate on a volunteer committee? It is an excellent way to network and promote yourself within the community association industry and CAI. It offers opportunities to meet new people, help run an all-volunteer organization and receive a great degree of appreciation and self-gratitude. Choose to help produce a special event or join one of our other committees that are significantly important to the continued growth, well-being and mission of CAI.

BUSINESS PARTNERS This committee is active in ensuring that an appropriate array of sponsorship opportunities are available to showcase Business Partners’ companies, products and service to the membership. The Committee will also periodically evaluate the sponsorship experiences in order to give feedback to the committees and to the board. The Committee will hold two Tricks of the Trade Orientation Workshops for new Business Partner members to give them tips on strategies and etiquette to use when marketing to managers and HOA boards. The Committee will also work in conjunction with the Social Committee to hold some Happy Hour informal social gatherings that allow both managers and business partners to get to know each other better—with familiarity comes trust.

The Committee will also interface with the Membership Committee to ensure that new Business Partner members enjoy a positive experience and see the benefit of continued involvement. Time commitment: Monthly meetings.

COMMUNITY OUTREACH Dedicated to our chapter’s belief that we should give back to our communities, this committee will continue to organize at least one outreach project per quarter in Los Angeles County. 2016 projects include: L.A. Food Bank Food Drive and Day of food packing (February and March), Heal the Bay Beach Cleanup (April), Relay for Life (June), Happy Hats for Kids (September and October) and Spark of Love Toy Drive (December). EDUCATION The Education Committee updates and maintains materials for the Essentials of Community Association Leadership Workshops, CID Law Course and advanced manager workshops. Committee members also train and organize the facilitators. Additional responsibilities include overseeing and promoting the Coaching to Credentials manager mentor program and finding new ways to bring education to Community Association Volunteer Leader and Manager members. Hand-in-hand with the Programs Committee, this group works to meet managers’ educational needs and strengthen the importance of receiving CAI certifications and designations. INTRO TO DRONES

(AS DEFINED BY MERRIAM-WEBSTER) Perhaps inevitable, it only took another 40 years for these devices to work themselves into common interest life as we see it. Now, social media is filled with news stories, Instagram posts and tweets about drones affecting those who are seeking safety and privacy in their own home. Despite the media hype that drones are an issue, the real issue is those who operate them. Drones have no ability to cause damage or breach security unless the user purposely steers or programs the ship accordingly.

As the technology progresses, we are now able to type simple coordinates into a program, or even tap a location on a smartphone, and the drone will fly itself to that location, take photos or other sensor readings, then return to a landing site, all in autonomous fashion… all for less than the price of a monthly car payment. Is this a problem? Yes and no.

We can use a drone to our advantage. Does someone have a leaky roof or a clogged gutter? Send a drone up to take photos before sending out a service provider. Trying to sell your home or market portions of your common area? Take an aerial video and upload it on YouTube.

However, others may not have good intentions. Flying a camera-equipped drone over private yards, or community

Industry trends continue to suggest that we take a more proactive approach than years’ past. So here are some ideas to get the ball rolling so-to-speak, before the inevitable strikes: 1. CONTACT LOCAL AUTHORITIES and ask if there are any ordinances governing remotely-piloted aircraft, and how those ordinances can be enforced either at the government level or by your community.

2. CONTACT YOUR INSURANCE AGENT. Is your community covered in the event a drone crashes onto the clubhouse roof and catches fire? Or, if it falls onto someone’s head causing injury?

3. CONTACT YOUR ATTORNEY (of course) to inquire about the steps you should take if drones become an issue, and if your documents need any revisions to better handle the potential issues.

4. KEEP AN EYE OUT for new legislation coming both from the FAA and the State.

THE IMPACT & REGULATION OF DRONES IN COMMUNITY ASSOCIATIONS A LEGISLATION SUMMARY ■ ■ ■ By Sandra L. Gottlieb, Esq.

FEDERAL LAW On a Federal level, the Department of Transportation and the Federal Aviation Agency (FAA) have already started the process of regulating drones. The FAA has created a registry for those who own the drones or Unmanned Aircraft Systems (UAS). Beginning February 19, 2016, the FAA Registry proposes the following:

■■ All owners of drones or UAS must register with the Federal Aviation Administration, or could face possible criminal or civil sanctions (although those penalties are not currently defined).

■■ Owners of the drones must be at least 13 years of age or older, and a U.S. Citizen. (If the owner is less than 13 years of age, a person 13 years of age or older must register the small unmanned aircraft.)

■■ A drone or UAS that weighs more than 0.55 lbs. (250 g) and less than 55 lbs. (25 kg) must be registered online.

■■ Owners whose drone or UAS weighs more than 55 lbs., is used for commercial purposes, or is intended to be operated outside of the United States must use the Paper Registry.

Those operating drones in a non-commercial capacity, are expected to limit their range to under 400 vertical feet and assure that the drones remain within sight of the operator at all times and more than five miles away from airports and air traffic. It is also possible that the Department of Transportation will continue to develop testing standards for any UAS “pilots” in addition to the registration requirements for owners.

STATE LAW On the state level, California has not created standards for owners or users, but it has moved toward defining when the use of drones is improper.

Senate Bill 142 creates liability and allows for damages when a person operates an unmanned aircraft that affects real property.

The proposed language would be located in Civil Code Section 1708.83(a), and state that: A person wrongfully occupies real property and is liable for damages pursuant to Section 3334 if, without express permission of the person or entity with the legal authority to grant access or without legal authority, he or she operates an unmanned aircraft or unmanned aircraft system less than 350 feet above ground level within the airspace overlaying the real property.

Assembly Bill 1662 would add Section 20019 to the Vehicle Code that deals specifically with injuries caused by drones. It would require the operator to immediately land of any UAS involved in an accident which results in injury to an individual or damage to property. Failure to comply with the requirements listed could result in a misdemeanor criminal charge.

There are other pending bills in the California Legislature that apply to drones and UAS, but they are mostly limited to public safety issues surrounding schools, prisons, and emergency areas (accidents, fires, etc.). There are only a few that touch on the neighbor-to-neighbor issues, but communities should expect that California’s attempts to legislate drones will continue to grow.

As the Federal and California laws attempt to regulate these activities, keep in mind that there may be some conflict between the requirements. Federal law will set minimum standards, and California may make add legislation designed to be more restrictive and protective. However, if there is any conflict, Federal Law will trump California requirements.

So how exactly are drones being professionally used in construction? Many industries including film making, real estate, professional sports, development, project management, mining, and agriculture are putting the UAV to work, but it seems like construction is leading the race.

The first and most obvious use of the UAV is the ability to include very high-resolution cameras on board. These cameras produce aerial site pictures that are used for inspecting safety, inspecting areas of a building that are too challenging to access by other means, measuring the progress of a project and even measuring inventory. Companies around the world like San Francisco-based Skycatch are putting advanced software to work where the UAVs are used to capture very high-definition images and then an overlay of the plans can be superimposed and compared to the actual construction, showing exactly what is happening with the project. Through every stage of the project, the plans can be closely compared to the real existing conditions in 3D, giving managers and project managers the ability to measure progress and accuracy of completion very closely.

DRONES IN CONSTRUCTION  By Michael Perlof

A

s I am writing this article, a small drone sits at the far left of my desk, with its red charging station light brightly projecting onto the wall in front of me, as if it is eagerly waiting for its next flight. This particular model is a smaller, less expensive version of the professional construction drone we plan to purchase in 2016. To be completely honest, I have now annihilated two of these fine machines, and my decision that it would be smart to practice on a less expensive version before I am behind the controls of a $5,000 professional construction drone has proven to be a very wise one!

Drones these days are not just for play, pestering and spying on neighbors anymore. In fact, the ability of the Unmanned Aerial Vehicle (UAV) to navigate territories in which humans and heavy equipment dare not venture is becoming so popular that the Federal Aviation Administration (FAA) and Department of Traffic (DOT) have had to introduce serious regulations regarding their use and incriminating all those that dare fly without strict adherence.

On a large jobsite, an aerial UAV captures pictures every two seconds and twenty meters, automatically controlled by advanced algorithms, and when partnered with computer software, a map is created that is essentially like “Google Earth on Steroids.” Each particular day can be logged, and the images are so high-definition that an inspector can navigate the job site, zoom in to the exact placement and even measure the spacing of rebar in a concrete slab before it is poured.

Imagine applying this same technology to roof inspections during a rain storm. Instead of the liability of a human being on a 25-story roof, in the rain, a UAV could very simply capture high-definition images of the roof that would allow you to zoom in to see the hairline cracks in the mastic that are causing a leak—while sipping coffee in your cozy office.

For me, the most exciting use of drones is now happening right in front of us. In 2011, a team of roboticists from ETH Zürich’s Institute for Dynamic Systems and Control gave us a taste of what can really be achieved. These tech geniuses built a 20-foot-tall tower constructed from 1,500 polystyrene bricks, every one of which was neatly assembled without any assistance from a human hand. One by one, a fleet of flying UAVs dropped the pieces into place, guided by mathematical algorithms that took digital design data and translated it into flight paths. Imagine those hairline cracks causing a roof leak, 25 stories above the ground in the pouring rain, and the same fleet of flying UAVs applying a temporary tarp over the area to mitigate the leak.

The research using drones to physically construct now aims to combat the problem that the small, agile machines cannot carry extreme payloads. Among the research currently underway is the Vijay Kumar Lab at the University of Pennsylvania and a project called “Cooperative Manipulation and Transport.”

This seeks to solve the problem of how autonomous robots can be made to work together to move large payloads by looking to nature. The team draws inspiration from ants and the way they collaborate to transport items of food much larger than the individual ants themselves. The fleet of UAVs would have sensors to determine the location of the neighboring robot and work together while calculating the task at hand as a team.

The possibility for the technologies they are developing now is essentially endless.

The overall benefits of the drone or UAV will rapidly continue to grow just like any technology does. Reducing liability and labor has obvious implications on reducing costs but, as the technology develops, I predict that we will see many other creative and functional uses for the UAV. Imagine an automated drone that could conduct and record a monthly landscape walk for community associations, and even recognize and highlight problem areas. Personally, I would like a small fleet of mini-drone robots to fly me to work on the mornings, hovering just about 10 feet above the traffic and stable enough to finish my morning coffee without the fear of ruining my white pressed shirt.

Dealing With Today’s HOA Challenges REGULATING DRONES IN A PLANNED COMMUNITY SETTING ■■■ By Robert D. Hillshafer, Esq. Never have we as individuals been confronted with such constant changes due to technology in our everyday lives. Smart phones, Uber, electric cars and a million other things are integral elements in our lives which impact how many people view the world and how it “should” work for them. This perception of how things are and should be has generally had a significant impact on homeowners associations and has forced boards of directors and managers (and their attorneys) to analyze new and different issues that are evolving on a daily basis and determine how the association should react from an enforcement perspective. One very timely and controversial issue involves the proliferation of inexpensive “drones,” which have a variety of purposes and potential functions that impact associations and their members.

DRONES: Nuisance, Invasion Of Privacy Or Recreation What one member of an association perceives to be a “fun” recreational activity often is perceived by another member

as an invasion of privacy, a nuisance or a safety risk. The use of drones within a common interest development certainly represents that sort of dichotomy. So what is the association and its manager to do?

Virtually every set of CC&Rs contains what is called the “anti-nuisance” provision that is intended to guarantee quiet enjoyment by owners/residents of common areas and residences and prohibits generally any activity that negatively impairs privacy or individual enjoyment. These provisions can be enforced by both members and the association. These provisions pre-date the advent of drones and the issues they create. Generally these provisions are enforced through lawsuits for injunctive relief to compel an owner to do or stop doing something after an offer of Alternative Dispute Resolution. The fundamental issue with the operation of drones is whether they negatively impact the community as a whole from a privacy or safety point-of-view.

Although use of the court system and injunctive relief can be an effective method for dealing with enforcement issues, it is very expensive and may be unnecessary if the board of directors and management adopt and publicize an operating rule that clearly outlines a policy on the operation of drones within the common interest development. Rules and regulations adopted by the board define more specifically what activities are allowed and the parameters for conducting them, such as limitations on time of day, noise and location.

However, only the association is authorized to enforce rules.

Adopting a rule means creating an expectation of enforcement in the members, so be cognizant that, if a rule is adopted, it should be uniformly enforced. Effort should be made by the board to publicize the rule over and above the required preadoption publication to the membership.

Rules must be “reasonable” to be enforceable and must be focused on protecting specific interests of the membership and the association, such as privacy, noise and safety. These interests should be discussed and listed in the proposed drone rules. Regulation of privacy interests seem rather obviously within the board’s authority since one of the well-established uses of drones is a camera platform for photography and videos. The issue will be a balance between addressing privacy and safety concerns and the innocent recreational use in the context of a photographic hobby. Similarly, operation in and around a residential housing development also raises legitimate concerns for safety, based on improper operation of the devices, either within a separate interest lot or from within the common area. The association’s interest is heightened regarding the common area operation but, given the nature of the device and its uses, regulation of use even within a separate interest lot seems well within board authority.

Limitations should not be based on age of operator but rather apply equally to all to avoid allegations of discrimination.

must be reasonable and in context. And if the basic rules do not have the desired deterrent effect, the option of an injunctive relief action remains after a hearing at which fines can be imposed or common area privileges can be restricted or suspended temporarily. Use the injunctive relief path only after all other methods of dispute resolution fail because of the expense which may or may not be recovered. Although the CC&Rs provide that the prevailing party may recover fees and costs, that only happens if you actually obtain a judgment and even then, the judge decides what is reasonable. Also, an award of fees does not guarantee that you will ever collect.

Local governments are struggling to deal with these same issues for some of the same reasons, but also because drone use has been seen to interfere with law enforcement operations. There is currently a movement by cities and states to require drones to be registered and licensed with regulations about height of operation. This may ultimately provide relief to associations being forced to try to regulate these activities and serve as a template for a rule. In drafting a rule regulating the use of drones within a community it would be prudent to investigate whether and how your local government addresses these issues.

it’s a bird. It’s a plane! It’s a…what exactly is that? These days it’s cliché to say the world of technology is moving faster than a speeding bullet. How many of us have experienced removing a “new” cell phone from the packaging, only to see an advertisement seconds later, for a newer, better version of the phone? In spite of frequent buyer’s remorse, most of us agree that technological advancements work to the benefit of making everyday tasks more efficient… Anybody old enough to remember work environments prior to laptops and e-mail? But inevitably, the right technology in the wrong hands can prove to be a security risk for everyone. Say hello to attack of the drones.

Initially a UAS (unmanned aircraft system) aka drone, only conjured up a couple of different references. Either it invoked images of a military resource used to survey and bomb the mess out of bad guys (Go USA!), or a kid’s toy

that some pushy salesman tried to sell you at a mall kiosk. Now we can only wish the uses were that simple. Partly due to constant regulation challenges of not wanting to stifle growth of the industry, the misuse of drones has become increasingly widespread here in California. Here are risks that can affect everyday citizens that aren’t on military watch lists.

INVASION OF PRIVACY is the most common. Whether it is the celebrity-crazed paparazzi or enjoying the comfort of your home with the windows open, drones are equipped with the technology to capture pictures, video and audio. Recently, at one of the high-end hotels where we provide security, a drone was spotted outside the window of a popular politician. By the time the police were able to respond it was gone. Fortunately there was no compromising material/information to be gathered, but blackmail and/or public shaming seemed to be the intent.

PROPERTY SURVEILLANCE has also become a common usage for criminals with drones. Gone are the days where the suspicious man lurking around the property stood out from the residents and their guests. Drones can be used to monitor activity and routines around any given property. From assessing the types of cars that residents drive to knowing when a home is potentially unoccupied, drones provide a concealed convenience that criminals use to target homes they are interested in breaking into.

DEFENDING AGAINST CRIMINAL DRONE USAGE has become a problem for everyone.

Recently legislation was passed to prevent drones from dropping drugs and contraband into prisons. Laws against drone usage in California are more liberal than other states, so in some cases our hands are tied, but we aren’t completely defenseless. Antidrone technology is an emerging industry. There are drone detection systems that notify you when a drone

enters a set boundary or proximity.

There are drone disrupters that block the frequency between the controller and the unit, causing the drone to land or crash. There is technology that hacks the drone frequency so you can take over the controls… and even systems that detect and fire lasers at drones to shoot them out of the sky. Some of this may sound a little science fiction, but may be a necessity depending on the residents and status of your community.

There was a recent lawsuit of a man shooting a drone in the airspace of his backyard. However, that was in the South and not recommended in California. Of course, you can always notify the police, stating AB 856, which expanded “physical invasion of privacy” to include drones going into the airspace of private residence or business (Section 1708.8 of the Civil Code). Even though the drone and its user will probably be long gone by the time the authorities arrive, it is still good to make local law enforcement aware of the

increased usage, and potentially scare off the user from returning.

Although policy may be slow in keeping up with technology, we don’t have to be.

Remind your neighbors and security team to look up as much as they look around. As in most cases, the more eyes you have checking for suspicious activity, the more likely you are to prevent situations from escalating. Speak to your local police liaison. Make them alert to drone usage in your area, even if you aren’t sure whether it is a hobbyist or a criminal. You have a right to your privacy and safety, so don’t be embarrassed to speak up about it. As the drone technology continues to advance, so must our awareness and responsiveness.

FROM SACRAMENTO

HERE’S THE LATEST FROM SACRAMENTO TWO NEW BILLS HAVE BEEN INTRODUCED AS OF THE LAST WEEK IN JANUARY. Assembly Bill 1720 permits an attorney who represents a member to attend any board meeting that the member is permitted to attend, regardless of whether the member attends. It is sponsored by the California Association of County Bar Associations and is authored by Republican Assemblyman Don Wagner who represents Santa Ana, Orange and Irvine.

Senate Bill 918, authored by Senator Andy Vidak, also Republican, and he represents the Fresno-Bakersfield Central Valley. It is merely “intent language” now, but will be amended to address the process serving procedure that creates problems when an owner is missing or not located for personal service. This is particularly problematic in delinquent assessment matters. This is a second attempt by the California Trustees Association to improve the notification process.

OTHER NEWS At our recent “HOA Round Table” of industry lobbyists in Sacramento, we learned that the California Association of Realtors does not intend to sponsor a bill affecting associations, and neither do the developers, lenders, managers, title companies or the Bureau of Real Estate. However, some noncontroversial amendments to existing Code may be appearing in March or April.

The California Legislative Action Committee (CLAC) is deciding whether to introduce a bill in the second half of the legislative session. In addition to being somewhat limited on time, many legislators are reluctant to carry a bill that will create controversy in an election year. CLAC has always had excellent authors of our bills, usually committee chairpersons or those with industry knowledge. However, this year’s crop of legislators is 80% new from 2012, and finding the best candidate is difficult.

Several more bills will appear by the end of February, and we will alert you about them as they are introduced and amended.

Some will require your direct involvement so please stay tuned to CLAC.

Our Chapters are organizing local visits to key legislators and inviting them to tour associations. Grassroots, face-to-face contact is a tried-and-true advocacy tool that we absolutely need to practice, especially with so many new legislators, some of whom may be in office until 2024 thanks to the voter-approved ballot initiative that recently passed. COMMUNITY ASSOCIATIONS INSTITUTE ANNOUNCES 2016 FEDERAL PRIORITIES A KEY DEVELOPMENT AND HIGHLIGHT FOR CAI GOVERNMENT AFFAIRS IN 2015 was the increasing number of CAI members advocating on federal government issues. CAI members responded in record numbers to federal legislative alerts, contacting members of Congress at critical times. CAI member phone calls, e-mails, and letters had a significant impact, amplifying CAI lobbying activities in the Congress.

In one instance, CAI members flooded key Senate offices with more than 1,400 messages over the course of two critical days.

Importantly, 2015 saw growth in CAI’s Federal Issues Summit. In October, more than 45 CAI members traveled to Washington, DC to discuss CAI’s federal policy issues and spend a day lobbying on Capitol Hill. In just one day, CAI member advocates met with the offices of almost 80 U.S. Representatives and U.S. Senators.

CAI federal advocacy faced critical challenges in 2015, which will continue in 2016. Looking ahead, CAI Government Affairs will be actively lobbying in the following areas— zz Qualifying all community associations for federal disaster assistance zz Preserving association governance over HAM radio towers and antennas zz Federal Housing Administration (FHA) approval rules for condominiums zz Preserving state association lien priority statutes

■ DISASTER ASSISTANCE FOR ASSOCIATIONS A highlight for CAI member advocacy in 2015 was the introduction of legislation ensuring all community associations qualify for federal disaster assistance. U.S. Rep. Steve Israel (D-NY) has emerged as the leader in Congress in the fight for equity in disaster assistance for community associations.

Due to Rep. Israel’s tireless efforts, the U.S. House Committee on Transportation approved disaster assistance reform legislation that included a provision requiring that FEMA work to qualify community associations for disaster assistance. Rep. Israel also successfully included a similar requirement in legislation funding FEMA operations in 2016.

Most important was Rep. Israel’s introduction of H.R. 3863, the Disaster Assistance Equity Act of 2015. H.R. 3863 qualifies community associations for federal debris removal assistance following a disaster and allows condominiums and cooperatives access to federal disaster funds to repair critical common infrastructure.

In 2016, CAI members will press Congress to approve H.R. 3863. By speaking with one voice, CAI members can ensure all community associations have access to federal disaster recovery resources.

■ HAM RADIO IN COMMUNITY ASSOCIATIONS U.S. Representatives Adam Kinzinger (R-IL) and Greg Walden (R-OR) have introduced legislation, H.R. 1301, that voids community association rules applying to HAM radio towers and antennas. Reps. Kinzinger and Walden have been joined in this effort by U.S. Senator Roger Wicker (R-MS), who is championing identical legislation, S. 1685, in the U.S. Senate.

CAI opposes federal legislation that needlessly interferes with the community association governance process.

H.R. 1301 and S. 1685 replace association rules governing HAM radio towers and antennas with a federal standard that currently applies to county and municipal governments.

Under this federal standard, it would be difficult for a community association to establish uniform height, placement, and size restrictions on HAM radio towers and antennas that could withstand a legal challenge.

Over CAI’s objections, on November 18th, the U.S. Senate Commerce Committee approved S. 1685. As a direct result of CAI member advocacy, U.S. Senator Bill Nelson (D-FL) and U.S. Senator Brian Schatz (D-HI) opposed S. 1685.

Senator Nelson and Senator Schatz are senior members of the Commerce Committee and serve in leadership positions.

With Senator Nelson and Senator Schatz actively opposed to S. 1685, it is unlikely the legislation will be approved in its current form by the full U.S. Senate.

CAI will continue to pursue a compromise that respects the right of community associations to set standards concerning HAM radio towers and antennas, but also ensures amateur radio licensees can pursue their hobby. According to CAI member research, a super majority of community associations permit HAM radio broadcasting, but require prior approval of external towers and antennas. Preserving these rules and procedures is a key federal priority for CAI in 2016.

■ FEDERAL HOUSING ADMINISTRATION CONDOMINIUM STANDARDS Following the financial crisis, the Federal Housing Administration revamped its approval process for condominiums. This new approach has resulted in a substantial decline in the number of condominiums approved to participate in FHA’s mortgage insurance program. With FHA’s participation in the condominium market now at historic lows, qualified condominium unit owners are being denied access to FHA-insured mortgages.

U.S. Rep. Blaine Leutekeymer (R-MO) has introduced legislation, H.R. 3700, to reverse FHA condominium policies such as the agency’s prohibition on transfer fees, CAI-Greater Los Angeles Chapter

limits on commercial space in condominiums, and owner occupancy requirements. H.R. 3700 also requires FHA to extend the current 2-year project certification and streamline the recertification process. These reforms will allow more condominiums to receive FHA approval.

CAI strongly supports H.R. 3700. CAI members can support a healthy and vibrant condominium market by contacting their federal representatives to urge support for this critical legislation.

■ PRESERVING ASSOCIATION LIEN PRIORITY STATUTES The Federal Housing Finance Agency (FHFA), a powerful independent federal agency, is working to overturn association lien priority statutes. To illustrate the agency’s scorched-earth approach, FHFA has sued community associations in Nevada that lawfully foreclosed association liens. The agency also threatened Nevada lawmakers, stating FHFA believed that lenders may reasonably refuse to issue mortgages in the state unless legislators repeal Nevada’s priority lien statute.

CAI’s Amicus Committee has filed numerous briefs countering FHFA’s arguments against lien priority in courts across the country. In Washington DC, CAI members have met with senior FHFA officials, including the Director of FHFA, the Honorable Mel Watt. Director Watt has stated FHFA will continue to oppose association lien priority and will actively seek federal preemption of lien priority statutes.

In 2016, CAI anticipates FHFA will support a campaign by mortgage bankers to repeal or substantially revise association lien priority laws in the various state legislatures. While CAI will continue to urge FHFA to drop its misguided campaign against community associations, CAI members in priority lien states should prepare for a coordinated campaign to eliminate lien priority statutes.
