Product Liabitity Bill Passes House
Most of the products we buy and use work pretty well. But occasionally a product fails with serious consequences. Users can be maimed, even killed. Damages can go beyond the physical to include psychological injuries. It can be a nightmare for the buyer. But increasingly in our litigious society, it can be a nightmare for the entire chain of distribution that delivered the product to the buyer.
After the injury come the doctors. And after the doctors, just as surely as God made little green apples, come the lawyers. The lawsuits the attorneys file bring with them enormous costs in time, money, lost productivity and an apple orchard of stress. Many times the victims claims are justified. But too often they are not. But valid or not, the lawyers sue all the way up and down the distribution chain. It's not a pretty picture.
But help may be on its way. The U.S. House of Representatives has passed H.R. 2366, "The Small Business Liability Reform Act of 2000." The National Association of WholesalerDistributors has lauded the legislation, observing
that in product liability lawsuits it would "signihcantly limit the liability of non-manufacturer product sellers such as distributors, retailers, lessors, and renters only to harms caused by their own negligence or intentional wrongdoing, the product's breach of the seller's own express warranty, and for the product manufacturer's responsibility when the manufacturer is judgementproof."
The bill also eliminates joint (deep pockets) liability for "noneconomic loss" and limits punitive damage awards to $250,000 for employers with fewer than 25 full-time employees thar become defendants in civil lawsuits. Neither of these provisions would apply to lawsuits involving certain egregious misconduct and states could opt-out by statue.
NAW's vice president for government relations Jim Anderson notes "the efforts of the House...builds significant momentum for the work we need to do to move this leeislation through the Senate."

A
LTHOUGH CCA treated wood is .CLsometimes promoted as "maintenance free," treatment alone does little for appearance or dimensional stability. And, to consumers, the appearance of their deck is just as important as its long-term structural integrity.
While CCA treatment makes wood resistant to decay and insect attack, it also causes changes in the wood structure that affect its appearance, properties and finishability. Its appearance changes to a flat, greenish, less natural hue. The treating cycle of drying, saturating and redrying creates internal stresses that can result in cracking, checking, splintering and grain raising. Chemical interactions can weaken wood and make it more brittle, giving rise to splintering and cracking.
Originally, coatings manufacturers responded by shoe-horning "all-purpose" products into the deck category, with disappointing performance results. In the past few years, however, finishes have been developed that specifically address the special requirements of CCA treated wood.
In addition to the availability of user-applied surface coatings, manufacturers can now add water repellents, mildewcides and toners during the treating process. Yet, according to the Forest Products Laboratory-sponsored Joint Coatings/Forest Products Committee, such ingredients provide initial protection that may last only a few months to a few years. Eventually, surface coatings are required to provide ongoing protection.
Unlike most other wood preservatives, CCA does not adversely affect finishes. It not only readily accepts most coatings, but has been shown to enhance the service life of water repellents, paints and stains. In spite of CCA treated wood's general compatibility with most coatings, there are some potential problems:
Lack of Penetration. Many nonfilm-forming finishes such as stains and water repellents must penetrate the wood's surface to work effectively. If treated wood is not sufficiently dried, excessive moisture can impede penetration of finishes. Air dry lumber that is saturated with water before

coating. In most cases, two to three weeks of seasoning in dry weather should bring the moisture content down to an acceptable level.
Substrate Limitations. Southern pine is the most commonly CCA treated species. Its properties enhance its treatability-but work against it as a coatings substrate. In general, southern pine has poorer finish-holding capabilities than cedar or redwood. However, the deleterious effects are somewhat offset by the performanceenhancement properties of the CCA.
Because they are film-forming coatings, they tend to peel, blister and mar when coated on horizontal substrates subject to weathering and traffic.
Clear or pigmented water repellents. wood toners and semi-transparent stains are the most common deck finishes. To work properly, they must penetrate the surface.
Improper Surface Preparation. Surface preparation is integral to the ultimate performance of coatings for any wood surface. Surfaces must be clean, dry, and free of mildew before coatings are applied. The better preparation products will remove dirt, mildew, grayed wood, loose fibers and coating particles in one step.
Weathering or Seasoning. Most new treated wood decks should be protected with a water repellent, toner or semi-transparent stain as soon after construction as possible. Research shows that exposing unprotected wood to weathering for even short periods of time can cause surface damage, reducing the wood's ability to hold onto subsequently applied coatings. Unless treated wood is still very wet. coat it as soon as possible after construction.
Color Bleed-through. As a reaction to CCA, wood takes on a color of anywhere from a light brown to a bluish-green. Since wood is tremendously variable, the color of treated wood can vary significantly from board to board, even within the same board. Clear or lightly pigmented finishes do little to mask or even out the color; the CCA green may show through. Use darker colors, more opaque finishes or a second coat.
Over-application. Many d-i-yers and contractors believe that when it comes to coating, more is better. This is untrue-and a problem for decks. Most deck finishes are designed to penetrate the wood surface. Applying too much may build up a film that can peel or crack. For water repellent products, over-application can create a surface that is waxy, sticky or slick. Over-applied stains can result in sticky surfaces, because the coating build-up interferes with proper drying.
Unlike most other preservatives, CCA does not adversely affect wood finishes.
Horizontal vs. Vertical. Solid color stains and paints can be used successfully on vertical surfaces such as siding, trim and lattice. Yet most treated wood in home construction goes into decks. Paints, varnishes, and solid color stains usually are not recommended for exposed horizontal deck surfaces, treated or untreated.
Follow the manufacturer's label suggestions on coverage. Rough sawn surfaces can absorb more coating than smooth sawn substrates. However, since most CCA treated wood has a smooth surface, take particular care against applying too much material. One coat is sufficient for most deck finishes. If two coats are desired, be sure the first coat properly penetrates the surface before applying a top coat.

designers specify, more builders use and more dealers stock engineered wood products, more questions arise, from proper installation details to selecting the right product for the right application.
At the APA Product Support Help Center in Tacoma, Wa., specialists handle hundreds of inquiries a week from dealers, builders, framers and designers who are using or planning to use engineered wood products. Here are some of the most frequently-asked questions:
Q wni"r, is stronger, plywood or oSB?
A A The two products are virtually interchangeable. That's because both products, although different in composition and appearance, are manufactured according to the same performance standards. These standards apply the same performance criteria to both products for their designated end uses-sheathing, single-layer flooring, and exterior siding. The performance standards under which plywood and OSB are qualified were developed to ensure reliable performance in service, to address a changing wood fiber supply, and to remove obstacles to innovative manufacturins technology.

Yes. Since wood is a biolosical material and can expand when it absorbs moisture, panels should be spaced at ends and edges. The "Sized For Spacing" notification is intended to facilitate proper installation and specifies that the panels may be cut less than nominal dimensions from the mill to account for any expansion that may occur. The size tolerance of a 4'x8' "Sized For Spacing" panel, therefore, may be 1/8" less than the specified length and width, e.g.,47-718"x95-718". However, since the size tolerance given in the performance standard allows up to 1/8" less than the specified length and width, a 47J/8"x 95-7/8" panel may or may not be stamped "Sized For Spacing."

A n pe trademarked panels may be produced in four exposure durability classifications: Exterior, Exposure 1, Exposure 2, and Interior. The epposure durability classification relates to glue bond, and thus to structural integrity.
Exterior panels have a fully waterproof bond and are designed for applications subject to exposure to the weather or to moisture for its entire service life. Exposure 1 panels have a fully waterproof bond and are designed for applications where construction delays may be expected prior to providing protection.
Exposure 1 panels are made with the same exterior 'adhesives used in Exterior panels. However, because other compositional factors may affect bond performance, only Exterior panels should be used for permanent exposure to the weather.
Exposure I panels may also be used when exposure to the outdoors is on the underside only, such as roof overhangs.
How long can structural wood panels be exposed to the weather?

If this is not possible, and the roof sheathing has been exposed for a period oftime, allow the roof sheathing to dry (from the underside) before closing in the roof cavity or attic.

A Several iranel grades and lay-ups are suitable for use as underlayment, however, the appropriate choice depends upon the type of finish flooring. For example, only fullysanded, veneer-faced underlayment panels meet APA recommendations for applications under resilient floor coverings such as tile or sheet flooring or fully-adhered carpet.

A There are many factors that affect the durability of wood structural panels, and each situation is unique. Although subjective, one way to determine if floor panels are suitable for use after a period of exposure is to walk on them. If they feel solid compared to your previous experiences with similar panels, spans and supports, they are "OK." After bxposure to weather, panels often look rough but remain structurally serviceable. After the building is l'closed in" and protected from the weather, the floor should be allowed to dry to in-service moisture conditions.
Before installing any finish flooring, the floor deck should be inspected for flatness betweenjoists, and also for smoothness along end and edge joints between panels. Any ridges or thickness swelling at these locations should

Forestry Initiative Revised
Seeking to further revolutionize forestry practices, the American Forest & Paper Association has revised the Sustainable Forestry Initiative Standard.
The new 2000 standard includes
five sustainable forestry principles, I I objectives and 3 specific performancc measures detailing obligations that program participants must abide by. Sixteen companies have been expelled fiom AF&PA for failure to uphold the standard since it was adopted in 1994.
The program's exacting standard and conservation practices encompass wildlife and water quality protection, biodiversity conservation, harvesting practices and a range of other conservation goals. An independent panel, comprised of experts from the environmental, professional, conservation, academic and public sectors, regularly reviews the program and advises AF&PA on its progress.

Walker-Williams Cuts Back Operations
Downsizing has struck WalkerWilliams Lumber Co., Inc., the nation's fifth largest pressure treater.
In addition to cutbacks at its Columbus, Ga., headquarters and sales office, at the end of last month the company closed its unprofitable Blanchester, Oh., plant, which served south and west Ohio as well as much of Kentucky.
The Hatchechubbee, Al., plant stopped treating lumber last summer to concentrate on fencing and decking.
84 Lumber Lone Star Bound
As part of its national expansion campaign, 84 Lumber plans to open up to 40 stores in Texas in the next few years, according to chief operating officer Bill Myrick.
"We see the state as being full of growth opportunities," he said. "There's a potential for many stores there." He said the firm is scouting the Dallas and Houston areas. and has chosen sites there, although he would not reveal specific locations. "We know where physically we want our stores to be," he said, adding that San Antonio is another desirable market.
The firm will continue manufacturing and treating fencing in Falkville, Al., but has contracted another company to handle Treating Service Only operations.
Westville, In., is also switching over to TSO.
Lumber operations continue unchanged in Youngstown, Oh.
Walker-Williams' CCA treated wood production slipped 69o last year to 300 million bd. ft. (see Top 25 Treaters, p.9-12).
For a time, 84 had a significant presence in Texas, until the bottom fell out of the oil market in the late 1970s and early 1980s, forcing the closure of every Lone Star unit, save one each in El Paso, Austin, Plainview and Alvin.
The 391-unit company announced plans last December to open 150 new 84+ format stores within the next three years.
Scotty's Converts 36 More
Scotty's has converted the remainder of its larger home centers to the
Bargain Outlet format, and may introduce the concept to its smaller hardware store locations.
After converting l0 stores Jan. 15, nine more Feb. 12, and Eustis, Fl., soon after, Scotty's unveiled the new format at l8 locations March I I and l8 more March 25.
The new format divides home centers into five stores-within-a-store: a closeout store. dollar store. home fashions outlet, flooring outlet and flooring store (see Feb., p. 17).
Yet converting additional stores will be trickier; a primary reason for remaking the home centers was to better utilize excess space-a rarer commodity in the l0,OO0 to 20,000-sq. ft. hardware stores.

Higher Bid For Cameron Ashley
The management-led investment group has raised its offer to buy Cameron Ashley Building Products, Dallas, Tx., by more than 2O7o to $18.25 a share, or more than $345 million.
The group increased its initial bid after receiving unsolicited offers from distributor Bradco Supply and manufacturer/wholesaler Guardian Industries (see March, p. 20). While weighing Guardian's offer, the 165-unit distributor was accused by some shareholders of unfairly favoring the first bidders, among them about 30 senior managers.

What began as a regional device for quickly identifying properly treated wood may soon be used across the country.

Last year, the Western Wood Preservers Institute introduced the CheckMark quality assurance identification program for treated wood products.
The mark would help industry professionals easily recognize and distinguish treated products under the American Lumber Standard Committee treated wood quality assurance program. In order to comply with the Uniform Building Code, treated wood must be marked by an ALSC accredited agency.
Since the program's introduction, enthusiasm has been building fast. All five AlSC-accredited agencies in the West-Bode Inspection, Califomia Lumber Inspection Service,
AFTER BEING quic*ly inmrporated on tags from the five grading agencies in the West, the Western Wood Preseruers lnstilute's CheckMark is now being adopled by groups across the country.
Canadian Softwood Inspection, McCutchan Inspection and Timber Products-immediately signed up to use the logo. Since then, the Southern Pine Inspection Bureau and Florida Lumber Inspection Service have also requested use of the mark. What was intended to be a western only program rapidly turned into a national effort.
WWPI predicts that this year potentially all treated wood intended for structural applications could cany the mark.
"The reason for its rapid acceptance was an urgent need for it," said
Jerry Parks, director of marketing services for WWPI.
Before the CheckMark, code officials were confused about what to look for on treated wood. Since each agency has its own unique mark, and because their marks are located in different positions within the stamps or tags, they were not easy to recognize or find.
"Now, it's simple," explained Parks. "Just look for the CheckMark icon and the agency's mark is right next to it."

USG Flies While Stock Flounders
Despite recent record sales and profits, Sheetrock producer USG Corp. was ranked the Worst lO-Year Stock Performer by the Wall Street Journal's Shareholder Scoreboard.
From December 1989 to December 1999, USG posted an average annual compound total return of negative l4.4%o, placing it last among the 649 Scoreboard firms with lGyear performance histories. Shareholders who invested $1,000 in USG at the end of 1989 now would hold about $212 in stock.
Since emerging from bankruptcy six years ago, though, USG has paid down $l billion in debt, boosted profits fourfold, and is increasing sales l57o annually. Last year's wallboard shortage helped USG record net income of $421 million, up277o from 1998.
Yet investon expect a slowdown in new home construction will hinder future earnings, especially with the drywall shortage ending and USG continuing to add new $100 million plants. Two facilities opened last year and three more will be completed over the next 12 months, each to produce twice as much drywall as an old plant, but at half the cost.
USG's ranking on the list also reflects that its stock continued to trade through the bankruptcy, brought on in part by having to pay $l million in interest a day on a crushing $2.5 billion debt.
Other firms on the Worst Performing Lists included Owens Corning (#12 over the last l0 years, #14 over five years, #18 over three years), Louisiana-Pacific (#10 over five years), and Armstron g $2a over three years).
The only industry firm on the Best Performing List was Home Depot (#25 over l0 years).

Lowe's Bomber Sentenced
An electronics repairman who earlier had pleaded guilty to five charges relating to bombings at Lowe's stores in North Carolina has been sentenced to 40 years in prison (see Jan., p.25).
George Matos Rocha,5l, confessed in December to planting pipe bombs that exploded Sept. 22, 1999 at stores in Salisbury and Asheboro and an undetonated device Sept. 28 in Concord.
Rocha also admitted to mailing threats to the firm's North Wilkesboro, N.C., headquarters in which he demanded $250,000 to stop the bombing. His motive reportedly was revenge for his earlier arrest for switching price tags at Lowe's of Greensboro.
Sears & AOL Form Alliance
Sears and America Online have agreed to market each other's products and services.
As the retailer's prefened service provider, AOL will issue a new cobranded software edition with special offers and links to sears.com, which sells tools, appliances, lawn and garden equipment and other products.
In turn, Sears will promote AOL's products and services in its stores and in its media advertising, the latter, pro-
viding special offers to the service provider's subscribers.
The firms will create online home improvement content that will enable consumers to communicate with Sears' customer service in real time.
Annual Wholesalers' Meeting
A full roster of educational programs, activities and the like will be held during North American Wholesale Lumber Association's l08th annual meeting April29-May 2 at the La Costa Resort and Spa, Carlsbad. Ca.

However, recognizing the need for flexibility, China said non-compliant shipments will be quarantined at the exporter's expense for up to 60 days while awaiting proper certification.
Local agencies have been given jurisdiction to assess fines for noncompliant companies that fail to present the proper certification within a reasonable period of time.

International Paper, Georgia-Pacific and Weyerhaeuser arc jointly developing a global business-to-business online marketplace to buy and sell paper and forest products.
The paper and forest products industry leaders believe that a joint electronic marketplace will benefit customers by simplifying transaction processes, improving information flow and increasing speed of delivery, thereby reducing costs. They hope it serves as a foundation for common industry standards to simplify and accelerate industrywide adoption of electronic commerce.
Providing both procurement and sales functions means the online marketplace could enable participants to streamline purchasing operations, reduce inventories, cut internal
costs and increase capital efficiency in the industry.
The business will operate as an independent entity with its own board of directors and management team. Initially, the three founding companies will hold equal equity positions, but expect additional partners to join. Based on its success, the companies eventually may take the business public. They are searching for a chief executive officer for the new operation and are assessing potential technology partners.

Injured Shopper Suing Lowe's
A man is suing Lowe's Cos., claiming he was injured in the Spartanburg, S.C., store almost three years ago.
According to the suit, Joe Ed Littlejohn was shopping in Lowe's on June 4, 1997, when he was forced to walk around a forklift that was blocking an aisle. In doing so, he allegedly walked under a delivery door which closed on his head, causing him painful and permanent injuries.
The suit is seeking actual and punitive damages and contends the store is negligent for safety-related reasons.

Carl C. Gates, 97, retired wholesale lumber broker, Dobbins Forest Products, Birmingham, Al., died March 2.
A native of Madison, Al., and a former government lumber inspector, he was honored last year for being the oldest man in the industry (see April 1999, p. 30).
He worked for Dobbins Forest Products for over a halfcentury before retiring in 1999, and reportedly had not taken a vacation in over 60 years.
James Greeley McGowin, 1I,72, retired vice president and general manager of woodlands and building products for Union Camp Corp., Chapman, Al., and current chairman of the American Lumber Standard Committee, died after a brief illness Feb. l8 at his residence in Chapman.
He was a graduate of Princeton University and Pembroke College, Oxford, England.
A longtime employee of the family business, W.T. Smith Lumber Co., Chapman, he remained with the firm after its 1966 sale to Union Camp, becoming v.p. and general mgr.-woodlands & building products, until his retirement in 1991. The firm has since been acquired by International Paper.
He was a board member and former vice chairman of the Southern Pine Inspection Bureau, a member of the Tax Sub-Committee of the American Forest and Paper Association, and a board member of the Forest Industries Council of Taxation.
Jack W. Lodge, Jr., 87, founder of Lodge Lumber Co., Inc., Houston, Tx., died of cancer Feb 1 1.
A native of Houston and member of the Lumberman's Association of Texas, he served in the U.S. Army Air Corps for five years during WW II and founded Lodge Lumber in 1944.
Robert E. Canton. 73. retired chairman of Canton Lumber Co. and former chairman of the North American Wholesale Lumber Association, died from emphysema and pneumonia March 9 in Panama.
A graduate of the University of Minnesota, he served in the Army during WW II and worked for Canton Lumber, Minneapolis, Mn., for 40 years, before retiring in 1988. He was named Twin Cities Hoo-Hoo Club Lumberman of the Year in 1972.
James H. Carr, Jr., 85, former ceo of the American Lumber Standard Committee, Inc., and retired owner, James H. Carr. Inc.. died after a stroke Feb. 17 in Wilmington, De.
A native of Hopedale, Ma., and graduate of the Massachusetts Institute of Technology, he started working for Timber Engineering Co., Washington, D.C., in 1936. He ran Washington, D.C.-based James H. Carr, Inc., from 1949 until his retirement in 1977 and served as secretary and ceo of ALSC through 1965.
