Essential Workers What You Need To Know The HBRA has been working tirelessly to ensure that construction is on the essential businesses list that are not subject to the governor’s March 20 executive order suspending in-person operations at all nonessential businesses from 8pm, March 23 through April 22. Please find the list in it’s entirety below. We are pleased that construction and its vendors are able to remain open in these unprecedented times. 1.Essential workers in the 16 Critical Infrastructure Sectors, as defined by the federal Department of Homeland Security unless otherwise addressed in a prior or future executive order pertaining to the existing declared public health and civil preparedness emergency. 2. Healthcare and related operations including: • biotechnology therapies • consumer health products and services • doctor and dentist offices • elder care, including adult day care • health care plans and health care data • home health care workers or aides • hospitals • manufacturing, distributing, warehousing, and supplying of pharmaceuticals, including

Services necessary to maintain the safety, sanitation and essential operations of all residences and other buildings (including services necessary to secure and maintain nonessential workplaces): • building cleaners or janitors • building code enforcement • disinfection • doormen • emergency management and response • fire prevention and response • general maintenance whether employed by the entity directly or a vendor • home-related services, including real estate transactions, closings, appraisals, and moving services • landscaping services • law enforcement • outdoor maintenance, including pool service • pest control services • security and maintenance, including steps reasonably necessary to secure and maintain non-essential businesses

Defense • defense and national securityrelated business and operations supporting the U.S. Government or a contractor to the US government If the function of your business is not listed above, but you believe that it is essential or it is an entity providing essential services or functions, you may request designation as an Essential Business. Requests by businesses to be designated an essential function as described above, should ONLY be made if they are NOT covered by the guidance.

Lisa Bancroft, from Fairfield County Bank, has shared a link to the Disaster Loan Assistance program that is being offered by the U.S. Small Business Administration to small businesses. Some of you may qualify, so it is worth investigating. The SBA is currently working directly with states to provide targeted, low-interest Economic Injury Disaster Loans to businesses and not-for-profits that have been severely impacted by the COVID-19 pandemic and to help overcome the temporary loss of revenue. Small businesses can receive up to $2 million in disaster assistance loans in certain eligible areas. Click here for more details

As many of you know, St. Vincent's hospital and their affiliates are in desperate need of supplies. If anyone has any new, unused masks that they are willing to donate, please let me know. Tax Day now July 15: Treasury, IRS extend filing deadline and federal tax payments regardless of amount owed IR-2020-58, March 20, 2020 WASHINGTON – The Treasury Department and Internal Revenue Service announced today that the federal income tax filing due date is automatically extended from April 15, 2020, to July 15, 2020. Taxpayers can also defer federal income tax payments due on April 15, 2020, to July 15, 2020, without penalties and interest, regardless of the amount owed. This deferment applies to all taxpayers, including individuals, trusts and estates, corporations and other non-corporate tax filers as well as those who pay self-employment tax. Taxpayers do not need to file any additional forms or call the IRS to qualify for this automatic federal tax filing and payment relief. Individual taxpayers who need additional time to file beyond the July 15 deadline, can request a filing extension by filing Form 4868 through their tax professional, tax software or using the Free File link on IRS.gov. Businesses who need additional time must file Form 7004. The IRS urges taxpayers who are due a refund to file as soon as possible. Most tax refunds are still being issued within 21 days. “Even with the filing deadline extended, we urge taxpayers who are owed refunds to file as soon as possible and file electronically,” said IRS Commissioner Chuck Rettig. “Filing electronically with direct deposit is the quickest way to get refunds. Although we are curtailing some operations during this period, the IRS is continuing with mission-critical operations to support the nation, and that includes accepting tax returns and sending refunds. As a federal agency vital to the overall operations of our country, we ask for your personal support, your understanding – and your patience. I’m incredibly proud of our employees as we navigate through numerous different challenges in this very rapidly changing environment.” The IRS will continue to monitor issues related to the COVID-19 virus, and updated information will be posted on a special coronavirus page on IRS.gov. This announcement comes following the President’s emergency declaration last week pursuant to the Stafford Act. The Stafford Act is a federal law designed to bring an orderly and systematic means of federal natural disaster and emergency assistance for state and local governments in carrying out their responsibilities to aid citizens. It was enacted in 1988. Treasury and IRS will issue additional guidance as needed and continue working with Congress, on a bipartisan basis, on legislation to provide further relief to the American people. -30-

Fed Takes Action to Keep Credit Flowing The Federal Reserve announced today it is taking new action “to support the flow of credit to households and businesses by addressing strains in the markets for Treasury securities and agency mortgagebacked securities.” The Fed will continue to purchase Treasury securities and mortgagebacked securities in amounts necessary “to support smooth market functioning.” The Fed had previously announced it would purchase at least $500 billion of Treasury securities and at least $200 billion of mortgage-backed securities. “The coronavirus pandemic is causing tremendous hardship across the United States and around the world,” the Fed said in a statement released this morning. “Our nation’s first priority is to care for those afflicted and to limit the further spread of the virus. While great uncertainty remains, it has become clear that our economy will face severe disruptions. Aggressive efforts must be taken across the public and private sectors to limit the losses to jobs and incomes and to promote a swift recovery once the disruptions abate.” Read More

Be Prepared for Changes in the Supply Chain Caused by the Coronavirus The coronavirus pandemic has caused many disruptions and may well impact residential construction in the coming weeks or months. Last week, California issued a far-reaching “stay-at-home order” for its 40 million residents. This order is required except for those needing to get food, take care of a relative, or go to an essential job in one of 16 sectors specifically identified. Other states and cities are following suit. With this most recent development, companies should evaluate their businesses, including their contracts, and be prepared for the possibility that building materials prices may increase as a result of supply chain disruptions. As part of an overall contract assessment, one of the most efficient ways to address unexpected price increases in building materials may be to use an escalation clause. If you do not already include an escalation in your contracts, consider adding one.

Federal Regulators Urge Banks to Work with Borrowers Affected by COVID-19 Federal regulators urged banks and other institutions today to work with borrowers affected by COVID-19, stating that loan modification programs “are positive actions that can mitigate adverse affects on borrowers due to COVID-19.” Read More

Sales Data Shows Housing on Strong Footing Prior to Virus Concerns

NAHB is committed to ensuring members continue to operate their businesses throughout the coronavirus pandemic as certain states and local municipalities explore and enact “remain in place” orders. We know all jurisdictions are different, and continue to monitor the everchanging situations across the United States. “Remain in place” orders prohibit all activity and all travel, except for three categories: Essential activities Essential businesses Essential government functions Under all circumstances, including those covered under one of these three essential categories, people should maintain a social distance of 6 feet from each other. Sales of newly built, single-family homes fell 4.4% to a seasonally adjusted annual rate of 765,000 units in February, coming off a sharp upward revision in January, according to newly released data by the U.S. Department of Housing and Urban Development and the U.S. Census Bureau. The February rate is 14.3% higher than the February 2019 pace, and January and February readings mark the highest monthly sales paces since July 2007. Read More

Employers Get First Round of Guidance on New DOL Allows Employers to Weigh In on Family Leave Family Leave Law The U.S. Department of Labor (DOL) announced today its first round of published guidance to provide information to employers and employees about how each will be able to take advantage of the protections and relief offered by the Families First Coronavirus Response Act (FFCRA) when it takes effect on April 1. The guidance – provided in a Fact Sheet for Employees, a Fact Sheet for Employers and a Questions and Answers document – addresses critical questions, such as: How an employer must count the number of their employees to determine coverage; How small businesses can obtain an exemption; How to count hours for part-time employees; and How to calculate the wages employees are entitled to under this law. The FFCRA will give all American businesses with fewer than 500 employees funds to provide employees with paid leave, either for the employee’s own health needs or to care for family members. NAHB Encourages Members to Donate Masks to Fight Coronavirus Last week, Vice President Mike Pence urged construction companies to donate unused N95 respirator masks, and similar personal protective equipment, to healthcare workers on the front lines of the fight against the coronavirus. “We are asking construction companies that our president knows very well from his background — we’re asking them to donate their N95 masks to their local hospitals and also forgo making new orders,” said Vice President Pence. President Donald Trump last week also signed legislation allowing companies to sell N95 masks intended for industrial use directly to healthcare workers. N95 masks filter out small particles in the air and are very popular with painters, sanders and drywall contractors to protect against silica and other nuisance dust.
