High Court Judgement Threatens Self Builders’ Section 106 Exemption IN AUGUST, a High Court judgement allowed West Berkshire and Reading borough councils to challenge the implementation of Section 106 exemption for sites under 10 units.

The judgement means local authorities are once again free to force self builders to pay thousands of pounds in fees to build their own home.

Section 106 Agreements were initially designed to provide financial benefits for the local community. It was argued that they would help fund enhancement of local amenities — more houses inevitably means greater call for road improvements, schools and playgrounds.

However, the fees were often unfairly charged with some self builders being charged several thousand pounds to build just one home (one family in Dorset was charged £140,000).

Homebuilding & Renovating magazine proudly championed the exemption for self builders and was relieved to hear last Autumn that the imposition had been lifted. Then Communities Secretary Eric Pickles aided the exemption, aware of the massive boost this would bring to the self build industry (and smaller scale developments).

Editor of Homebuilding Jason Orme said “When I built back in 2006, the idea of having to pay any fees to the local authority, with the exception of the usual application fees, was not an issue. These payments were for the bigger developers, the companies who potentially made huge windfalls off the granting of planning permission on land they bought from farmers and other landowners at a fraction of the new value. Yet, since the late 2000s, local authorities exploited loopholes in guidance to begin to apply these charges to individual families looking to build their own homes usually buying building plots at full market value.”

However, cash-starved local authorities have been heavily hit by budget cuts — hence the challenge to the exemption. “Left in the middle are hundreds and perhaps thousands of self builders whose projects are in jeopardy and looking at a situation where they are trying to build their own family home and being taxed out of it by their own local representatives,” Jason concludes.

Davidsons reach their 1,000th home LEICESTERSHIRE homebuilder Davidsons have reached their 1000th legal completion with a sale at their ‘Bakers Croft’ development in Ibstock.

The purchasers, Kristina Clemons and Dean Elton, were presented with champagne and flowers to mark the occasion by Davidsons chairman David Wilson, managing director James Wilson and operations director Jason Glover.

Davidsons began in Leicestershire in 2007 and built their first home the following year, right at the beginning of the worst recession the construction industry has ever known. Since then the company has grown from two members of staff to a permanent team of nearly 100. In addition, the company provides work for around 400 sub-contractors that help to build the homes.

David Wilson, chairman of Davidsons, said: “We are very much a family business, my father Albert built his first homes in Ibstock and I built my first homes in Packington in 1967. Our aim is to produce homes that people can be proud to own.

The family ethos has always been to seek quality, and a sense of caring. Hopefully that shows in the way we do things”.

James Wilson said: “Reaching our 1,000th completion is very special, and it’s fitting that it should be in Ibstock, where my family built the first homes that started it all off. It was only two years ago that we built our 500th Davidsons home, so things are moving rapidly. The company is set to grow considerably in the near future and this is the perfect opportunity to thank all staff who have made our achievements to date possible. “Abbey Mill occupies a prominent position on Leicester’s skyline, adjacent to the Grand Union Canal, but had remained unused for many years and was in a state of increasing disrepair,” explains David McSwiney, associate at rg+p. “Our design has enabled the building’s exterior to be sympathetically restored whilst completely updating the interior to meet modern living standards. The original steel frame and timber floors were retained as well as the feature tower above the front elevation. It is particularly pleasing to be endorsed by the LABC with this award.”

Also included in rg+p’s design for Abbey Mill is a second floor link to Phase 1 of the development, The Wolsey Building. This is in the form of a glass bridge, enabling residents to access all of the communal and care facilities of this Phase 1 Extra Care scheme, which was delivered by the same project team in 2011.

Bernard Saunders, building control team manager, Leicester City Council said: “Leicester City Building Control is proud of our partnership with rg+p under the LABC Partner Authority Scheme and we are especially pleased that the work all those involved put onto this scheme, from concept to completion, was recognised and rightly acknowledged by the presentation of this award.”

Matt Cooney, chief executive, asra Housing Group added: “We are very pleased to have been able to save this landmark Edwardian Mill for the people of Leicester. Not only is it one of the best examples of regeneration in the country, it is also providing purpose built homes for people over the age of 55, as well as young people requiring support. Dating back to the mid-1880s, Abbey Mill and The Wolsey were originally factories creating hosiery and warmth-preserving clothing under the famous Wolsey brand. Today, they form a residential facility which comprises 141 purpose-built, Extra Care apartments and 40 general needs apartments, all of which are now occupied.

It was a challenging build project, not only preserving and restoring the old, but ensuring new elements of the scheme were in keeping with the heritage of the site. As a regional award winner, Abbey Mill is automatically shortlisted for the LABC Grand Finals, which will be held at the Lancaster Hotel, London on 10th November 2015.

Ray of light yet to pierce election gloom •

UK construction continues to feel the impact of the general election as activity drops for the fourth consecutive month, according to figures released on 4th August) by industry analysts Glenigan.

Glenigan Index for August The Glenigan Index for August, which covers the value of projects starting on site during the three months to July, has declined by 27% year on year as the commercial, public, industrial and civil engineering sectors all combined to drag the value of starts lower than a year earlier. The fall was prompted both by decisions on government funded projects being postponed in the immediate run-up to the election and by private developers delaying project starts until the political outlook was clearer.

Private housing saw relatively modest declines during the latest period; starts fell by 8% compared to a year ago, well above the -27% average overall and sufficient to keep the private housing sector in growth mode when viewed over 2015 so far. However a collapse in social housing starts was sufficient to pull Glenigan’s residential growth index down to -21%.

Commenting on this month’s figures, Allan Wilén, Economics Director at Glenigan, said: “It is a concern that starts have remained weak into July. However, an expanding development pipeline indicates that this appears to be a continued overhang from election related delays, rather than a weakening in client demand.

“Moreover confidence, which radiated out from London across the UK during the course of 2014, remains strong in the English regions, Scotland and Wales.”

London and the South East both saw approvals decline during the second quarter, but every other part of Great Britain saw the value of work approved increase during the same period.

Allan Wilén added: “Social housing starts declined by 40% over the last three months, as housing associations digest a new set of challenges to their business and funding models, including a mandated reduction in rent levels and the mooted extension of the right to buy to

The North East saw a positive 13% increase in starts during the three months to July. The South West saw starts decline by a modest 1%; most positive reading for the region since activity began to contract in April of 2014.

However there was no good news for any other of the UK’s nations or English regions. London, the South East, the West Midlands, Scotland and Northern Ireland all saw starts at just two thirds or less of the level of a year ago.

Plans Committee to Consider Application for 3,200 Homes on Sept 22 A NEW DATE has been set to consider a planning application to build 3,200 homes to the west of Loughborough.

Charnwood Borough Council’s Plans Committee will meet in the Victoria Room at Loughborough Town Hall on Tuesday, September 22 to consider the application. The meeting will start at 5pm and will be open to the public.

The meeting had been due to be held in August, but was postponed after the developer submitted new information relating to the environmental assessment of the proposal.

The application has been submitted by William Davis Ltd and Persimmon Homes and is seeking outline planning permission for: • 3,200 homes • 16 hectares of employment land • a Community Hub comprising a retail unit

1,000 sq m or other retail and business use • sites for gypsies and travellers • two primary schools • open spaces including allotments • a strategic link road • restoration of Garendon Park The report which will go to the committee is due to be published on Monday, September 14.

Builders’ Problems SOLVED

Claiming monies from a discharged bankrupt Problem: I am the managing director of a building company. The company has been trading for just over 20 years now and has been very successful during that time, although the recent recession did hit quite hard.

Since 2013 the company has seen such a significant increase in workload that my existing resources could not cope. I therefore ended up subbing-out a couple of entire projects to different main contractors in order to alleviate the pressure. One of the projects went reasonably well, but on the other project the main contractor (who was trading as a sole trader) let us down badly and failed to finish. The project was eventually completed, albeit late and we made a thumping loss.

I subsequently sent a claim for damages to the main contractor, but did not even receive an acknowledgement. I then referred the dispute to an adjudicator and received a favourable result.

However, part-way through the adjudication, the main contractor made it known that he was recently discharged from bankruptcy, having become bankrupt just after he ceased working on my company’s project.

So, my present position is that I have an adjudicator’s decision in my favour for a sum in excess of £75,000, against a discharged bankrupt who is resisting payment on the basis that the debt arose from a liability prior to him entering bankruptcy.

Any advice would be welcome.

Response: Hello Simon. I have no doubt that this matter has been very trying for you. Unfortunately, even though the main contractor (who is now a debtor) is a discharged bankrupt, he is correct insofar that you will not be able to enforce the adjudicator’s decision if the debt did arise from a liability prior to him entering bankruptcy.

Under the Insolvency Act 1986, if a debt is a bankruptcy debt or liability it cannot be pursued. To qualify as a bankruptcy debt, liability must exist at the commencement of the bankruptcy or arise from an obligation incurred before the bankruptcy order. The cause of action for your damages claim arose from the contract that you entered into with the main contractor before he entered bankruptcy and hence the debt, as evidenced via the adjudicator’s decision, is in fact a bankruptcy debt as defined under section 382(1)(b) of the Insolvency Act 1986 and therefore you are unable to pursue the debt.

That said, I am surprised that the adjudicator was allowed to progress and issue his decision, as the adjudication should have been halted once the main contractor had made known of his bankruptcy and with this in mind, you may be able to argue that the main contractor is liable for at least the adjudicator’s fees as the contract with the adjudicator came into being after the bankruptcy order was made. © Michael P. RICS UK Construction Market Survey Q2 2015

Office development and private housing drive construction workload recovery in the East Midlands CONSTRUCTION workloads in the East Midlands rose in Q2 2015 with 42% more respondents reporting higher activity, driven by office development and private house building.

The latest data shows workloads rose across all sectors and in each part of the UK and was more widespread throughout England, Wales and Scotland, while the pace of growth in Northern Ireland was more modest. At a headline level, 64% more respondents in the East Midlands expect to see their workloads rise and respondents, on average, forecast growth of 3.8%.

Half (50% net balance) of respondents in the East Midlands reported higher workloads in private housing and 57% in the private commercial sector, following a 22% rise in new orders in the first quarter of the year.

Financial constraints and issues with planning and regulation remain the other key restraints on growth in the sector with 58% more surveyors reporting difficulties in Q2. In addition, 40% of respondents reported shortages of materials, but this is substantially lower than the 60% who were having such difficulties through most of 2014.

RICS Director of the Built Environment, Alan Muse, said: “The upturn in workloads has led to a less competitive tendering environment, particularly across public sector projects, but a lack of accessible finance is now affecting a net balance of 58% of our members and while concern over labour shortages dipped slightly, the demand for cost and project management skills rose.

Also typical as workloads recover is the emergence of other impediments to growth - outside of labour and finance constraints - such as planning and regulatory barriers, which could be exacerbated if cuts are made to local authority planning departments as backlogs in planning applications could have a knock-on effect to work pipelines.”

Vision for regeneration of Waterside set to move forward AN AMBITIOUS vision for the multi-million pound regeneration of Leicester’s Waterside is set to be taken forward by the city council.

The Leicester Waterside Supplementary Planning Document (SPD), which will help guide development and investment in the 60-hectare area around the River Soar and Soar Island over the next ten to 15 years, is due to be formally adopted.

The adoption of the new guidance will mean that Leicester City Council can submit an outline planning application which, if approved, will pave the way for a first £9.5milllion phase of regeneration in the area.

This will focus on land to the west of the A50, between the Grand Union Canal and Friars Mill, and including Soar Island.

Funding available for the first phase includes £7.5milllion of Government cash from the Leicester and Leicestershire Enterprise Partnership (LLEP) Local Growth Fund, and £2milllion of council capital set aside for the Leicester Economic Action Plan.

This will enable the city council to acquire land and property in the area and prepare sites for development.

The city council is also proposing two new office buildings – providing around 1,000sqm of accommodation – at Friars Mill. The disused 18th century mill complex on the banks of the River Soar is undergoing a £6.3milllion redevelopment to bring it back into use as a base for growing local businesses.

The council plans to construct the new office buildings to support regeneration in the area and the intention would be to sell or lease them – on commercial terms – on their completion. Subject to planning permission, work on the scheme could get underway in the autumn.

City Mayor Peter Soulsby (pictured)said: “This marks an important next step in kick-starting the much-needed regeneration of Waterside.

“The area has suffered badly in recent decades, with the closure of key industries leaving many sites derelict, unused and ugly.

“The adoption of this new planning guidance, and the award of cash from the Government’s Local Growth Fund, will allow us to bring key development land into public ownership and set out the type of development we want to see in these areas.

“This will remove a great deal of risk for potential investors. It will also help us to find development partners that share our vision for Waterside as a thriving neighbourhood with great places to live and space for businesses to flourish.

“It’s our role to provide a catalyst for transformation of the area. The restoration of Friars Mill will stand as a beacon for regeneration in this area.

“Waterside has the potential to be the most exciting development opportunity in the East Midlands and is a major opportunity for the city’s growth.”

Once adopted as local planning policy, the Waterside SPD will help the city council encourage new development and attract further investment into the area and support bringing unused buildings or land back into use.

It will also set new guidelines for development in the area. This includes setting limits on the height of new buildings and types of new development, protecting the area’s heritage, green space and bio-diversity, improving the routes between the city centre and the riverside, and ensuring high standards of design in all new building.

A draft of the Waterside SPD was launched for public consultation earlier this year, giving members of the public, businesses and other stakeholders in the area a chance to comment on the proposals.

In total, around £20milllion of Government cash from the LLEP Local Growth Fund has been earmarked to kick-start the regeneration of Waterside.

George Osborne calls for more rural starter homes AS REPORTED ON the BBC news website, the government wants to extend its “starter homes” scheme to some villages Chancellor George Osborne has said he wants to reform planning laws to make it easier for villages in England to build new starter homes.

Mr Osborne said the changes would allow councils to allocate more sites for building homes specifically for people who already live or work in the area.

He said he also wanted to improve transport, schools and broadband in rural areas to boost the rural economy.

The chancellor wants to extend the government’s “starter homes” scheme, announced before the election for brownfield sites, to some villages.

The initiative offers young local first-time home buyers a 20% discount on the price of the property. As it stands, the discount will be offered on homes up to £250,000 outside London and £450,000 inside London.

Over 100 new homes to be built on site in Aylestone

MORE than 100 new homes are due to be created on land in Aylestone, connected to an area of open space and an ecology-rich nature reserve.

About 8.36 acres of Franklyn Fields – an area of land off Franklyn Road and Conaglen Road, Aylestone – are due to be sold to house builders Morris Homes (Midlands) Ltd, to create new housing, an adjoining nature reserve and open space areas.

The land is jointly owned by Leicester City Council and Leicestershire County Council, which have been working together since 2013 to market • the site for development.

Bailiff regulation reforms leave landlords exposed: BPF

COMMERCIAL landlords have raised concerns that changes made to bailiff regulation last year have made it easier for tenants to pay their rent late and remove valuable items from their premises ahead of debt collection.

The British Property Federation (BPF) has raised such concerns in a submission to a Ministry of Justice (MoJ) review of the first year of the revised Commercial Rent Arrears Recovery (CRAR) regime.

The new CRAR legislation requires an Enforcement Agent (as bailiffs are now known) to serve a notice on a late-paying tenant giving a minimum of seven clear days for a debtor to pay before it is able to enforce on goods.

This has led to a belief amongst landlords that some tenants are using the regime as a “cheap overdraft facility” to delay payment.

The BPF has submitted evidence to show that some tenants have used this notice period to delay paying overdue rent on as many as 90 occasions across their stores over the year since the introduction of CRAR. This is particularly worrying for small landlords, who risk defaulting on their own loans if their rental payments are late.

It has suggested that this could be because the statutory fee defined by the legislation to be charged by Enforcement Agents (£75 + VAT, regardless of the level of rent outstanding) is not enough of a deterrent. It recommends that the MoJ changes the fee to be 2.5% of the debt at Enforcement Notice, in order to make it more proportionate.

The BPF has also outlined further concerns that Enforcement Agents are no longer required to take an inventory when they serve notice. In some cases, this has led to tenants removing the contents of a store before Agents arrive, who are then unable to prove that there were goods within a unit.

It has recommended that the MoJ allows 24-hour notice for an inventory check once Notice is served to combat this.

Melanie Leech, chief executive of the British Property Federation, commented: “While CRAR has not been problematic for every landlord, there are some simple steps that the MoJ could take to protect those who will struggle when they receive late rental payment.

“Making the fee system more proportionate would both protect smaller landlords and act as a deterrent for tenants with particularly large arrears.

Allowing time for an inventory check would add a further layer of protection for landlords, who are currently just relying on a tenant’s good nature.”

Cost of farmland in East Midlands falls as demand for farmland declines • • •

UK-wide supply of farmland increased sharply during the first half of 2015, as demand growth moderated Average cost of farmland in East Midland now £8,000 per acre 73% more rural surveyors more available non-residential farmland, leading to a decline in prices

DEMAND for both residential and non-residential farmland in the East Midlands dropped significantly over the last six months, and 20% more surveyors now expect the price of residential farmland to fall over the next 12 months, according to the latest RICS/ RAU Rural Land Market Survey H1 2015.

During H1 2015, a net balance of 73% of respondents reported an increase in the supply of commercial farmland – the greatest availability of acreage since the data series began in 1999 – while 33% of surveyors reported an increase in available residential farmland.

Elsewhere, Scotland and the North East of England saw a reduction in demand not just for commercial but also residential farmland, while the results for South West and the East Midlands suggests demand is still edging upwards in these areas.

At a national level, the South East saw the largest price increase over the year, with both arable and pasture land seeing sharp rises.

Andrew Houlden MRICS, Director at DDM Agriculture in Lincolnshire, commented: “There is evidence of buyers being more selective than ever.

Location is still the most important factor affecting value.”

Simon Rubinsohn, RICS Chief Economist, commented: “We are seeing a considerable divergence in the outlook for commercial farmland compared to land seeing with a significant residential component. National Maintenance Week: TV’s Neil Oliver leads the campaign BROADCASTER, author, historian and archaeologist Neil Oliver is leading this year’s campaign to make people aware of the importance of winter property maintenance.

A familiar face from popular programmes including, Coast, The Vikings, A History of Scotland and A History of Ancient Britain Neil is keenly aware of the changes that the passage of time can make to a building, but he knows that whatever the age or condition of a structure, good, regular maintenance can play a role in its future.

SPAB’s (Society for the Protection of Ancient Buildings) annual National Maintenance Week campaign encourages owners of all sorts of buildings (not just ancient ones!) to be aware of the importance of regular care. It’s a message that’s relevant to home owners and to anyone who cares for a property.

In 2015 the week takes place from November 20 to November 27, just as potential problems caused by wind, rain, frost and winter snow begin to loom.

Neil says. “When I travelled round the country for BBC’s Coast series, the importance of protecting a building against the ravages of the wind and the weather was very apparent. I could see it was a constant battle.

Maintenance makes a difference – never put it off!”

SPAB took Neil to the beautifully maintained, Christopher Wren–designed church, St Andrews, Holborn to give him a bird’s-eye view of the tricky nooks and crannies that can cause problems if leaves, twigs, nests and other seasonal debris are left uncleared.

“Even though it’s relatively modern compared to many of the places I’ve visited and written about as part of my work, it’s easy to see how vital it is to make sure it’s maintained.” he said. “As an archaeologist I’m very familiar with the care challenges faced by significant, historic buildings which don’t conform to a standard pattern. Planned and regular maintenance is vital to ensure that they have a future as well as a past. That message is equally applicable to buildings of all types and all ages.”

He adds: “ ‘Stave off decay by daily care… prop a perilous wall… mend a leaky roof ’ It’s amazing that what SPAB’s founder William Morris wrote nearly 140 years ago is still sound, practical advice. Faulty gutters and blocked drains don’t repair themselves - the longer you ignore a problem the more costly and difficult it becomes to put it right, and that’s true if the place you care for is an ancient ruined broch, a medieval church in a village, a Victorian terraced house or a modern apartment in a town or city..”

Running for the last 14 years, National Maintenance Week reminds anyone who looks after a building - regardless of its age, type or purpose - of the simple, achievable steps they can take to prepare for the worst that winter can bring. The UK’s last wet, blustery winter and the recent run of harsh, cold winters underline the importance of the regular care. Bad weather can leave a legacy of problems that need attention.

Neil is right about maintenance making economic sense. If you turn a blind eye to cracked pipes, faulty drains or broken/missing roof tiles you might as well throw hard earned cash to the winter wind.

SPAB’s annual awareness week always ends with National Gutters Day this year on Friday November 27th. National Gutters Day is a gentle, light hearted reminder for everyone to take 10 minutes to make a simple check on the condition of any property they care for. A little time spent on a basic building ‘MOT’ can save people from having to spend a great deal of money at a later date.

ONE OF THE UK’s leading financial advice firms has been confirmed as the first tenant of a new development at the site of the former New Walk Centre.

Wealth management and employee benefits business, Mattioli Woods plc, has announced it will move into offices at the planned new development on the site of the former council offices.

The firm, which has been based at Grove Park in Enderby since 2005, advises over 6,000 clients with assets under management, administration and advice in excess of £5 billion. The company employs over 300 staff in Leicester, and the move will allow it to expand and create in excess of 150 new job opportunities.

Earlier this year, Leicester City Council announced that local developer Ingleby, part of the Sowden Group, had been appointed to regenerate the site, which is currently in the process of being cleared following the demolition of New Walk Centre in February 2015.

Plans for the site include two buildings based around a central public open area on New Walk, combining office space, apartments and ground-floor retail. If planning permission is granted, work is expected to start on site before the end of 2015, with the development being completed and new tenants in place towards the beginning of 2017.

Leicester City Mayor Peter Soulsby said: “This is a real vote of confidence in the city centre that a firm with the calibre of Mattioli Woods will be setting up its office at this key development site. It is a local firm with a proven track record, which was originally based in the city until it moved out in 1998.

Developer Builds Its Workforce With Six Local Apprentices HALF A DOZEN local apprentices, some of whom are already well experienced in the construction industry, have recently been taken on by leading homebuilder David Wilson Homes East Midlands.

The Bardon-based homebuilder will put their skills to good use as it seeks to expand its workforce as the homebuilding sector continues to grow.

24-year-old Ryan Taylor from Coalville is studying for an NVQ Level 1 in Bricklaying at Stephenson College after a spell working as a Sapper for the Royal Engineers. He said, “I’m adapting a lot of what I learned in the Army, like using hand tools and making concrete, into commercial, civilian use. This job has its own challenges, and I’m working with a good team.”

The company, which has trained more than 100 apprentices in the last 12 years, will be employing the new starters to work on quality developments across Leicestershire and Nottinghamshire.

35-year-old Michael Burton, from Coalville, is studying for an NVQ Level 2 in Joinery at Stephenson College after years of experience in roofing, window fitting, plumbing and other trades.

He said, “This feels like a fresh start; I’m putting everything I know into building new homes at a brand new site and David Wilson Homes are offering me a stable future.”

Each apprentice will work on an assigned development for part of their working week, as well as taking part in classroom based learning at a local college.

Matthew Allen, 22, from Leicester is doing his NVQ Level 1 in Bricklaying at Leicester College.

He said, “My dad’s a plasterer, so I’ve always been interested in working in construction. I’d like to get qualified here, stay on for

David Wilson Homes’ new intake of apprentices, outside the company’s Bardon head office experience and then maybe open my own business.”

18-year-old Scott Collins is also from Leicester and is also studying at Leicester College, to be a Joiner.

Scott said, “I’d like to work my way up through the company and maybe one day be a Site Manager and run my own development.”

Tom Cartwright, a 20-year-old apprentice Joiner from Shepshed, studying at Stephenson College, said, “David Wilson Homes is a really well known and respected local company so it’s great that I’ve managed to get on board with them.”

Macauley Tinsley, a 19-year-old apprentice joiner from Nottingham, said, “I’ve done a few kitchen fittings since I left school, but I wanted to get a proper qualification from a company like David Wilson Homes. I’d like to stay here and be able to work my way up to Contracts Manager.”

Largest timber structure in the UK A 42 METRE high arch, taking the title of the largest timber structure in the UK, was recently erected in Leeds.

The frame was supplied by German specialist HESS TIMBER, whose recent work includes the D1 tower in Dubai and the Museum of the Foundation Louis Vuitton in Paris. The glulam frame forms part of the Leeds Recycling & Energy Recovery Facility (RERF) based in the Cross Green area of the city and is designed to complement the surrounding environment. The frame is clad with translucent sheeting and incorporates a 1,800m2 living green wall to the southern façade to enhance its visual impact and provide biodiversity. The innovative design of the building, nicknamed as ‘the Greenhouse’, creates a positive landmark for the Aire Valley region of Leeds and the Cross Green industrial estate.

The building will divert more than 200,000 tonnes of household waste away from landfill, using the remaining unrecyclable material to generate electricity. The facility will also provide combined heat and power (CHP) to local businesses. The project will not only make an impressive addition to the Leeds city skyline but also generate a large influx of permanent jobs and help to create a more sustainable city.

The timber frame structure enhances the sustainability prerequisites of this project. Glulam is a renewable source that is also environmentally friendly and energy efficient. Focus Consultants trio skydive for charity THREE BRAVE employees from Focus Consultants are taking the plunge for charity with a tandem sky dive in aid of a cause close to their hearts.

The parachute jump will also be part of the celebrations to mark the 21st birthday of Focus Consultants, which is based in Nottingham and has offices in Leicester, London, Boston and Aubourn near Lincoln.

The team will be raising money for St Barnabas Lincolnshire Hospice, which gave care and support to the wife and family of Focus senior building surveyor Darren Booker. Elizabeth Booker was 47 when she passed away last year following her diagnosis of a rare form of Non Hodgkin’s Lymphoma.

Darren, who works in the Boston office of Focus, will be joined by two colleagues, 16-year-old admin apprentice Victoria Bell, who also works in the Boston office, and sustainability surveyor Gareth Morris, who is based in Leicester. Their tandem parachute jump is scheduled to take place at Langar Airfield near Nottingham on Sunday 13th September.

The intrepid trio will take part in a 10,000 feet freefall parachute jump, reaching speeds of more than 120mph as they dive through the air. Two thirds of UK building companies turn down work ‘Desperate need’ for apprentices is key factor behind skills shortage NEW RESEARCH has revealed the extent of the current skills shortage in the UK building industry – with 66 per cent of small construction firms admitting they have been forced to turn down new business due to this lack of resource. Almost half have been forced to outsource work to third parties rather than leave work unfinished.

The survey, conducted by the Federation of Master Builders (FMB), reached out to its membership of 8,500 small and medium-sized (SME) construction firms, revealed:

The main reason cited for this widespread shortage is the difficulty in finding apprentices.

Respondents claimed the lack of apprenticeships is the primary reason they believed potential candidates have been held back from joining the industry, followed by pressure from parents to stay in full-time education. Experts have estimated the industry needs around 35,000 new apprentices just to cope with demand, however in 2013, only around 7,000 apprentices completed their training.

For the 16-24 age group, perception of low wages was another significant factor in deterring interest in the trades – however, the FMB’s research shows that by the age of 23, a bricklayer with five years’ experience can earn up to £31,000 and rising in some cases

to £52,000 in London.

Tony Passmore, CEO Passmore Group, said: “The lack of experienced multi-skilled workers is a huge concern for my business, as it could affect our future growth plans. We urgently need tradespeople that are trained in more than one area, such as plumbing, tiling and joinery for bathroom installations - but we just aren’t seeing the candidates come through.”

The starting salaries are much higher than many people expect and there is a great capacity for career development.

AN APPRENTICE civil engineering technician at Ibstock-based M-EC has an unusual pastime, swapping his workbook for a wetsuit to race his jet-ski.

Seventeen year old Cameron Green, from Moira in North West Leicestershire, has been racing for three years and is the current champion in the British Novice ski stock 2 stroke and 4 stroke competitions. Training twice a week at the Kingsbury Jetbike Centre as well as regularly at his local gym, Cameron has developed real flair and skill for the sport.

“A family friend introduced me to jet-skiing and while I was out practicing, an existing jet-ski racer approached me to suggest I race competitively,” explains Cameron.

“That year, I entered the last round of the British Junior Championships, won both races and never looked back!”

Apprentice civil engineer, Cameron Green is In his first full season of racing, Cameron was undefeated a jet-ski champion in his spare time. over 20 races and won the 2013 British Junior Championship as well as the Jeremy Hoyland Award for Outstanding Achievement. Since then, his ambition and passion for the sport has only intensified, particularly after achieving further successes in 2014.

Now, he is racing his Stock Kawasaki 800 SXR jet-ski in two competitions; the P1 Aqua X, an offshore coastal championship with five rounds on courses across the UK, and the JRSA (Jet Sport Racing Association) British ski stock 2 stroke Championship. With just four races remaining in the 2015 calendar, Cameron is currently leading the P1 Aqua X and second in the JRSA, meaning he is well placed to secure further titles at the end of the season.

Cameron is currently finishing the first year of his apprenticeship with M-EC Consulting Development Engineers, one of his sponsors, which helps to cover ongoing maintenance, race entry fees and fuel for practice sessions.

Cutting out van servicing could be a false economy

NEW RESEARCH from BCA, the UK and Europe’s leading vehicle marketplace, underlines the importance of a service history when it comes to selling used vans.

BCA researched price performance for a ‘basket’ of 5,000 LCVs that went through its sales earlier this year, comparing the price achieved against industry guide values for vehicles sold with a full service history to those without.

Up to ten per cent price improvements were recorded for vehicles with a full service history, with this factor increasing in importance on older vehicles.

For lower mileage vehicles, (sub-50,000 miles) BCA saw a 3.5% uplift in performance. This rose to nearly 4% for vehicles that had covered 50,000 to 100,000 and rose again significantly to a 10.4% uplift on vehicles that had covered over 100,000 miles.

Duncan Ward, BCA’s Head of Commercial Sales explains, “A van is a working tool so it makes good sense to maintain it properly, but if further evidence was needed, a service history will also add to its value when it is sold.”

He added “With many small businesses and sole traders typically running used vans there may be a temptation to extend or even ignore the recommended servicing schedules. However, regular servicing on even the oldest vehicles will make them more saleable when it is time to change.”

Ward continued “Our research shows that if a service history is missing, the seller could be potentially sacrificing up to 10% off the value. On older vehicles that may have been resold several times, even a partial history is better than none at all and can help to improve the price achieved.”

He continued: “A service history shows the vehicle has been well maintained by the previous owner and confirms that a warranted mileage is correct as declared. And it is the latter that can have a real, tangible effect on the potential price a vehicle might achieve.”

Councils should change course to boost smaller house builders, says FSB A NEW REPORT commissioned by the Federation of Small Businesses (FSB) suggests local planning authorities could inadvertently be costing small house builders millions of pounds. The FSB says that these extra costs risk blocking otherwise viable housing projects at a time when we desperately need to build new homes.

The FSB commissioned report by BCIS found that on average, smaller house building projects of 10 units or less - typical of developments run by smaller firms - had significantly higher basic building costs. The difference lifted average house building costs by 14 per cent when compared to larger developments.

The report found no evidence of councils accounting for these higher costs when stipulating the level of the Community Infrastructure Levy (CIL) – a charge that developers pay when they are granted planning permission.

BCIS calculations suggest that local authorities could be overcharging smaller house builders as much as £100,000 per project - potentially adding up to millions of pounds across the sector. This added cost acts as a significant burden to smaller house builders, and is likely to be pushing many much-needed urban brownfield housing projects beyond viability.

This ultimately leads to councils missing out on any CIL payments if the project is abandoned, and further restricts the supply of desperately needed local housing.

John Allan, Federation of Small Businesses National Chairman, says: “We are deeply concerned that an inflexible approach by local authorities could be preventing smaller house builders from taking on otherwise viable projects. It’s a lose-lose situation for everyone – smaller developers, local authorities and those in desperate need of local affordable housing.

“When considering whether to make use of the levy, councils should take a more flexible approach. They should consider the size of the proposed project when deciding how to set the levy, and ensure small house builders aren’t overburdened with unaffordable costs.

“This approach will help to deliver the houses we need in the places we need them. It will also support local small businesses and their suppliers which are at the heart of our local communities.”

The trial of the Econic mixer is part of our broader approach to road user safety.

“We are pleased to be working with vehicle manufacturers like MercedesBenz to trial this revolutionary new safety design. As an industry, it’s important that we continually explore opportunities to drive improvements in this area.”

In addition to a commitment to vehicle safety features, Tarmac is providing enhanced training for drivers and supporting its contract hauliers with the necessary technical support and education to make both adaptations to vehicles and behavioural changes.

Health & wellbeing impacts of lighting revealed in new BRE Trust report ASKING QUESTIONS such as, ‘Can LEDs keep you awake at night and damage your brain?’ and ‘Can special lighting help people with dementia?’, an international team of research scientists has reviewed recent research into the effects of lighting on people.

Several recent studies into the type, quality and patterns lighting in buildings have shown that their impacts go far beyond the obvious safety issues of providing enough light for people to see.

In a new BRE Trust funded report, Lighting and Health, researchers from BRE and from universities in Istanbul and Eindhoven have reviewed this work and summarised the factors – such as the effects on health and mood – that buildings occupiers, owners and designers should be aware of.

The report explains the scientific basis for issues such as human circadian rhythms, which can have profound effects on a person’s wellbeing. The variation of light from day to night helps to properly maintain the circadian cycle in the body, which can determine patterns of alertness, co-ordination, blood pressure, cardiovascular efficiency and other functions in a 24-hour period. It is therefore important to maintain bright light during the day and relative darkness at night.

The report’s authors also examined a number of practical solutions for improving lighting. Providing daylight in buildings, for example, is often a convenient way of regulating circadian rhythms, resulting in improved health and mood. In principle, bright artificial light could give similar benefits, but daylight provision also gives some contact with the outside which can further improve health and mood.

Fluorescent lighting with magnetic ballasts and some LEDs, on the other hand, can flicker causing headaches, eyestrain or epileptic seizures in some people, and exacerbate the symptoms of autism and agoraphobia. Switching to high frequency fluorescent lighting, or different types of LED, avoids these problems.

In addition the authors consider a number of topical questions such as whether special lighting can help people with dementia. One of the symptoms of dementia, for example, can be disrupted circadian rhythms with sufferers being awake at night more often. Exposure to bright light during the day, along with darkness at night, can help.

Lighting and Health concludes with recommendations for building managers and occupants, for designers, and for elderly or visually impaired people. The report can be purchased here.

Purpose-built supported living facility opens in Sandiacre A NEW purpose-built supported living complex, designed to enable people suffering with mental illness to live in the community with professional support, has opened in Sandiacre.

The development, known as Riverside Gardens, is the brainchild of consultant psychiatrist Dr. Ivan Bakelchev of Aspire Mental Healthcare, whose vision is to offer an alternative to long-term hospitalisation or repeated admission due to relapse. His first project, Chilwell House in Ilkeston, Derbyshire, established to provide a residential recovery and rehabilitation service, as well as respite and crisis care, has proved extremely successful and was extended last year to accommodate the rising demand for places. The clear need for further rehabilitation and re-enablement opportunities led to the investment in Riverside Gardens at Sandiacre.

The complex, which operates similarly to a social enterprise and has neither shareholders nor any related requirement for profit, includes a unique Skills & Re-enablement Centre, which offers supervised skills training to day-patients, aimed at improving independence and self-reliance, as well as supporting those in need of enablement before returning to work after a long stay in hospital.

According to Dr. Bakelchev, Riverside Gardens – like Chilwell House – offers a win-win opportunity both for patients and for the local authority. “Therapy and support in the community is a much better option for those suffering with long-term mental illness, and The new facility at Riverside Gardens (Sandiacre) it’s also a more cost-effective solution for the local authority than keeping people in hospital,” he says. “Outcomes are improved for patients, they are supported through rehabilitation back into the community and are enabled to become productive members of society, which is good for society and good for the individual’s mental health.”

The first residents to move into Riverside Gardens include former patients at Chilwell House, who have already made substantial progress towards independence.

“We are very excited about this project at Aspire,” Dr.Bakelchev concludes. “We have had excellent response from local mental healthcare professionals and we are confident that Riverside Gardens will prove as successful as Chilwell House.”

Plans are underway for further facilities across the East Midlands, including Nottingham town centre.

Westleigh to build new homes in Nottinghamshire at former factory site LECESTERSHIRE-BASED builder Westleigh has begun work to transform a former factory site in Sutton-in-Ashfield into 21 new homes for sale.

Westleigh will revive the site on Coxmoor Road, set to be named Kingfisher Gardens, by building a range of two and three bedroom properties.

Continued growth in demand and a lack of stock drive prices higher • • •

Buyer demand rises at the fastest pace since February 2014 Prices gain momentum for a sixth consecutive month Limited stock continues to act as a restraint on both transactions and new instructions

HOUSE PRICES continue to be squeezed higher by growing demand and contracting supply, according to the latest RICS UK Residential Market Survey.

While 44% more chartered surveyors saw prices rise in July, supply to the market continued the decline with 22% more surveyors reporting a drop in new instructions. Additionally, the shortage of housing inventory worsened further during July, with the average number of properties for sale per surveyor slipping to a record low.

Consequently, all areas of the UK are projected to see sizeable house price gains over the next twelve months, with confidence most elevated in East Anglia and Northern Ireland.

Near term expectations for prices also continue to reflect the imbalance between demand and supply with 41% of members expecting prices to continue to rise over the next three months. However, rising prices have not dampened interest as new buyer enquiries rose for the fourth month in succession, with 25% of respondents reporting a rise in demand. Despite this steady and sustained improvement in demand, newly agreed sales were more or less unchanged at the national level in July. Going forward, there is a little more optimism regarding the prospects for activity with 37% more respondents expecting sales to gain momentum over the next three months and 40% more taking the same view on a one year perspective.

Jeremy Blackburn, Head of Policy, said: “This government has put home ownership at the very heart of its agenda, with Starter Homes and extending Right to Buy the strongest evidence of that ambition. However, this continues to be demand driven and fails to address the real issue of supply.

A coherent and coordinated house building strategy is required across all tenures. This should include measures that will kick-start the supply-side, such as mapping brownfield, addressing planning restrictions and creating a housing observatory to assess the underlying economic and social drivers of housing and provide the impetus for solutions.

The changes brought in through Fixing the Foundations, the Chancellor’s productivity plan, were welcome and refreshingly on the supply side – such as zonal planning, dispute resolution for S106 and local plan enforcement.

But these alone are not a strategy for increasing housing supply across all tenures.”

In the lettings market, tenant demand continued to rise while landlord instructions, despite increasing slightly, failed to keep pace once more.

Consequently, 34 % of respondents expect rents to increase right across the UK with members in the West Midlands (4%) and the South East (3.3%), projecting the sharpest growth over the next twelve months.

Simon Rubinsohn, RICS Chief Economist, said: “A renewed acceleration in house price inflation allied to a fairly flat trend in sales activity highlights the very real challenges being presented by the housing market. More worrying still is the suspicion that the imbalance between supply and demand will lead to even strong price gains over the next twelve months.

This is also visible in the firmer pattern in the buyer enquiries series which has now risen for four months in succession reflecting in part, a further modest easing in credit conditions.

This trend could be brought to a halt when base rates do eventually begin to rise but the dovish tone to the latest Bank of England Inflation Report suggests the first move will come a little later than previously thought likely and that subsequent increases will be very gradual indeed.’’

A SURVEY conducted by plumbing, heating, and bathroom specialist City Plumbing Supplies has shown that styleconscious homeowners prefer to conduct independent, in-depth research when making the decision to purchase a new bathroom. As a result, plumbers are much more likely to recommend the use of a showroom or accompany consumers during the purchase process.

69% of home owners stated they would research bathroom products independently, whilst an overwhelming 85% agreed that they would prefer to visit a showroom to make an informed decision rather than rely solely on a brochure. This reflects that homeowners still view bathroom replacements as an expensive and serious investment, whilst the role of the plumber must focus heavily on ensuring practicality and functionality is prioritised alongside style and design.

Eco World Ballymore reveals designs for a 35m high suspended swimming pool at Embassy Gardens PLANS for a breathtaking, suspended swimming pool named ‘Sky Pool’ have been unveiled for Embassy Gardens – the residential heart of London’s newest neighbourhood, Nine Elms on the South Bank.

The stunning outdoor pool will link two residential buildings at the 10th storey – a world first – and allow residents to swim from one building to the next. The sky deck at the top of the two buildings incorporates a spa, summer bar and Orangery for residents to relax and take in the views of London icons which include the Houses of Parliament, London Eye and new US Embassy located next door. The pool is entirely transparent and structure free, 25m long, 5m wide and 3m deep with a water depth of 1.2m. The pool is the vision of Sean Mulryan, Chairman and CEO of Ballymore Group, working with the scheme’s architects Arup Associates. Ballymore are responsible for the development of Embassy Gardens with their development partners Eco World. Together they are developing the second phase as Eco World Ballymore. Ballymore has a reputation for creating places and spaces that are more than just bricks and mortar, and this pool is testimony to this philosophy - creating an inspiring environment and giving a unique character to the development.

Embassy Gardens takes design inspiration from the Meatpacking District of New York with floor to ceiling windows and brick facades. Survey results support positive outlook in the East Midlands economy Vanarama, the UK’s largest independent commercial vehicle broker and the leading supplier of new vans to professional trades have recently conducted their annual survey of customers.

The headline results reveal tradesmen are optimistic about the UK economy contrasting sharply with the credit crunch in 2007 when confidence was at an all time low.

Vanarama customers were asked 10 key questions including how they felt about the current Government in its first 100 days of office, their optimism for the future and whether cash flow had improved through a reduction in bad debts.

Out of the 600 responses, 45% said they felt more optimistic for the future under the new government, with only 19% less optimistic. On the contentious subject of the EU a not insignificant 55% said they would leave it tomorrow. 47% of respondents said their experience of bad debt had improved this year with only 7% saying it had worsened.

Explaining why he is not surprised by the survey results Andy Reynolds, Vanarama’s representative for Leicester said: “At a local level we have been aware of the growing positivity in the economy for some time now.

Our survey simply confirmed at a national level what my local customers have been telling me, namely that the good times are coming back. Our customers hail from all trades including the construction sector which was badly hit by the credit crunch. It’s great to see confidence and growth returning across the board locally and nationally.”

A RUN DOWN conservation area in Mansfield Woodhouse is being restored to its former glory with help from local house builder, Rippon Homes.

The Mansfield Woodhouse Millennium Green (MWMG) was for many generations a place for the whole community to enjoy, but after years of neglect and abandonment, it became an eyesore.

The house builder, who has a selection of three-bedroom homes for sale nearby at its Heathside Gardens development in Mansfield, was approached by Trustee and Treasurer of MWMG, Bob Thacker, following the decision to finally restore the area.

Bob said: “I wrote to Rippon last year asking for their assistance and a few days later Dave Mitchell got in touch saying they’d be happy to help… and the rest is history!

“Since 2013, we have been working on restoring the Green to its former glory and thanks to Rippon, we’ve been able to redevelop the main gateway which was in a very poor state of repair.

“We are extremely grateful for Rippon’s generosity. Their consistent help and support has provided an access for the local community to now enjoy again.

“Although there is still minor work to be done, all in all we’ve got a main gateway to be proud of and a feature that enhances the location.”

As well as putting the foundations in to the entrance of the Green, Rippon has also assisted with the tarmac re-surfacing, creating an attractive walkthrough for the community including people who use mobility scooters and wheelchairs.

Dave Mitchell, Construction Manager for Rippon Homes, said: “We are pleased to have been involved in this renovation project and are happy to have supported the local community. It’s great that this respected piece of land has now been brought back to life.”

Volunteers involved in the project have helped re-instate the paths, repaired the seats and planted trees. To complete the project, the Green will eventually see decorative finials for the tops of the pillars to the front, as well as additional hedge laying along the boundary.
