A hybrid application was approved

by Charnwood Borough Council’s planning committee in 2020, with the development backed by funding from Homes England to support infrastructure improvements.

The scheme will provide a boost to the local economy with significant job creation, and developers also providing substantial Section 106 contributions.

Topping Out Ceremony at Loughborough University’s £9m Sustainable Pavilion

Student flats plan approved for Leicester’s Last Plantagenet pub

A TOPPING OUT ceremony has taken place to celebrate the latest milestone in the creation of a £9 million sustainable pavilion, being built by Henry Brothers, to expand SportPark, the multi award-winning development at Loughborough University.

The 2000 sq m project on Loughborough University Science and Enterprise Park (LUSEP) is being built to Passivhaus Classic Accreditation to significantly reduce CO2 emissions and is scheduled for completion at the end of the year.

As the first Passivhaus development on the University campus, SportPark Pavilion 4 will give sports organisations the unique opportunity to secure environmentally future-proof accommodation that is tailored to their needs.

It will also enable occupants to reduce their carbon footprint due to highly efficient heat pumps, opening triple-glazed windows, solar shading to avoid summer overheating as well as a well-insulated building fabric to minimise heat loss.

SportPark Pavilion 4 will project the University’s and Henry Brothers’ forward thinking and environmentally conscious values, delivering significant benefits to its occupants.

SportPark Pavilion 4 is delivered by the Leicester and Leicestershire Enterprise Partnership (LLEP) as part of the Getting Building Fund (GBF). Funds were designated for investment in local, shovel-ready infrastructure projects to stimulate jobs and support economic recovery across the country. The LLEP was allocated £20 million, supporting the SportPark 4 project with £6 million.

A separate £1.8 million GBF allocation helped fund improvements at Junction 23 and the A512, which links the M1 with Loughborough. It makes LUSEP one of the most accessible science parks in the UK.

PLANS TO convert Leicester’s former Last Plantagenet pub into student flats have been approved.

Wetherspoons closed the pub in the five-storey former Maples furniture store, in Granby Street, in the city centre two years ago and the building has stood empty ever since.

In July, Leicester City Council voted to approve a scheme to turn its upper floors into 56 student flats.

A LACK OF INHOUSE skills is the most common challenge facing construction businesses when it comes to promoting their businesses online, reveals a new poll.

Conducted by construction digital marketing agency Koozai, the new survey found that 44% of construction industry professionals believe that their businesses lack the skills needed to properly implement an effective digital marketing strategy.

Carried out during a digital marketing webinar for construction websites with 101 registrants, the poll quizzed construction marketing and business professionals about the biggest challenges they face in digital marketing.

It also found that a third (33%) of construction industry professionals believe that their businesses lack time to oversee digital marketing activity. 17% said that a lack of budget was the biggest obstacle to digital marketing success. Just 6% said that there was a lack of buy-in in digital marketing from senior decision makers.

Just 5.5% of construction businesses ready to make sales online The new poll comes as Google searches for construction goods and online sales of construction products and services continue to rise. According to the latest Office of National Statistics (ONS) figures, online

sales in construction have grown by £1.6 billion in the last ten years.

However, the ONS figures also suggest that most construction businesses are yet to fully embrace online marketplaces. Just 5.5% of construction businesses are making ecommerce sales compared to 22.8% of manufacturing businesses, 24.3% of information and communication services businesses, 28.6% of UK businesses overall, 44.1% of wholesale businesses, and 48.3% of retail businesses.

Koozai Owner & Director Sophie Roberts said: “For decades many UK construction businesses have relied on traditional marketing practices and face-to-face relationships between contractors.

This obviously still matters, however online demand has grown significantly. The data shows that construction lags behind other industries when it comes to capitalising on ecommerce opportunities. Without a remedy for this, construction businesses risk being left behind as the buying behaviours of industry buyers and consumers continue to change.”

Memories haven’t faded of April tax hikes, say firms, as personal allowance rises to £12,570 RESPONDING to the roll-out of new income tax and national insurance contributions (NICs) thresholds from 6th July, Federation of Small Businesses (FSB) Policy Chair Tina McKenzie said: “It’s right that the Government ensures employees and sole traders can keep more of what they earn.

“That said, memories haven’t faded of the tax hikes that landed in April, which today’s changes only partially unwind. These adjustments shouldn’t be seen in isolation, we still face a higher tax burden than we did in March.

“Higher Employer NICs rates still mean less money in the economy for pay rises, let alone sustainable investment, recruitment and discretionary spending.

“Though the Employment Allowance marks a vital relief on Employer NICs, and we’d encourage all small firms to check their eligibility, we need to see government go much further in addressing the cost of doing business crisis that underlies the cost of living emergency.

“Amid surging fuel prices, spiralling energy bills, higher debt costs, a weakened pound, supply chain disruption, labour shortages and new trade paperwork, firms are still faced with the biggest tax burden since the late 1940s.

“Taxes which are levied with no regard for profitability or ability to pay – not least business rates, NICs, VAT and fuel duty – are really hurting firms at the moment.

“Doing more to alleviate their impact on margins would go a long way to helping small businesses, many of which are hanging by a thread.”

Green light for Council office move OADBY & WIGSTON Borough Council (OWBC) will swap its primary offices to Brocks Hill Country Park in an innovative, green and cost-saving move.

The move will see the council better its financial position by more than £2million over the next 10 years while also enhancing its green credentials and offering its staff a more agile and healthy workplace.

The council announced that it was making the move in 2021 after the COVID-19 pandemic led to a reassessment of the council’s current office accommodation.

Planning permission was granted in June and OWBC’s Full Council has now given the final go-ahead after revising its budget to take the project through to completion.

Bushloe House will be sold with the proceeds invested into the renovation of Brocks Hill.

Once work is complete, Brocks Hill will be fit for purpose for up to 30 years and its use as its main offices will also significantly reduce the council’s carbon footprint.

Work could start at Brocks Hill as early as next month (August) and is anticipated to be complete in Spring 2023.

UK construction redundancies fall to lowest figure since records began COMMENTING on recentlyreleased redundancy data, Dominick Sandford, Managing Director at IronmongeryDirect and ElectricalDirect, said: “During the first few months of the pandemic, the job security of construction workers was thrown into serious doubt, and sadly tens of thousands of employees lost their jobs. However, the latest ONS data shows that the situation has really turned around.

“At its peak in summer 2020, almost 30,000 workers were made redundant over a three-month period (July-September).

“In contrast, the data released this month shows that just 3,000 people in the industry lost their jobs between March and May. While this is obviously still 3,000 too many, it shows a significant improvement.

“In fact, 3,000 is the lowest that this figure has ever been, since records began thirteen years ago in 2009.

“Elsewhere, average wages are on the rise, which, in the context of a major cost of living crisis, will be a welcome relief to many, albeit slight.

Typical weekly earnings rose by £20 to £714, which is the second highest average ever recorded.

Construction slowdown continues in June. Housing activity falls for first time in more than two years.

UK CONSTRUCTION companies signalled another loss of momentum in June as total business activity expanded at the weakest pace for nine months and new orders increased to the smallest extent since last October. Worries about the near-term economic outlook led to a sharp decline in business expectations for the year ahead.

June data indicated that growth projections are now the least upbeat since July 2020.

However, the latest reading signalled only a moderate increase in construction output and the slowest rate of expansion since September 2021. Civil engineering was the most resilient sub-sector in June (index at 54.3, down only slightly from 55.5 in May).

House building was the weakestperforming area of construction activity for the fourth month running in June. Moreover, the latest index reading of 49.3 signalled an overall downturn in residential work for the first time since May 2020. June data pointed to a solid rise in total new orders, but the rate of expansion softened to its weakest since October 2021. Some construction companies noted a lack of new work to replace completed projects due to economic uncertainty and inflation concerns.

Efforts to boost capacity in response to greater overall workloads contributed to another robust rise in staffing numbers during June. Job creation has been recorded in each Weakest rise in construction output since September 2021. Survey respondents once again commented on shortages of candidates to fill vacancies, despite higher wage offers.

Input buying meanwhile increased

at a much slower pace than in May, with the latest expansion the weakest since the start of 2021. The loss of momentum was attributed to weaker new order growth and, in some cases, a smaller degree of safety stock building.

Suppliers’ delivery times lengthened again in June, but the downturn in performance remained less marked than that seen in the first quarter of 2022. Staff shortages and a lack of transport availability were the most commonly cited reasons for longer wait times for construction products and materials.

Around 71% of the survey panel reported higher purchasing prices in June, while only 1% signalled a reduction. The resulting index signalled a rapid pace of cost inflation that was slightly faster than in May, albeit still below the survey record high seen in June 2021. Higher prices paid mostly reflected rising energy, fuel and transportation costs, according to survey respondents.

Looking ahead, around 36% of construction companies anticipate a rise in business activity, compared to 17% that expect a decline.

While this highlighted positive sentiment overall in June, the degree of optimism signalled was the lowest since July 2020. Weaker business confidence has now been recorded for five months running, largely reflecting subject growth expectations for the UK economy, alongside uncertainty about the impact of higher interest rates and escalating inflationary pressures.

Tim Moore, Economics Director at S&P Global Market Intelligence, which compiles the survey said: “The gloomy UK business outlook and worsening consumer demand

due to the cost of living crisis combined to put the brakes on construction growth in June.

Commercial construction saw a considerable loss of momentum as clients exercised greater caution on new spending, while long-term infrastructure projects ensured a relatively resilient trend for civil engineering activity.

“House building has expanded more quickly than the rest of the construction sector over the course of the pandemic, but now finds itself as the worst-performing broad category so far in 2022. Moreover, the latest survey indicated an outright decline in residential work for the first time in just over two years.

“Construction companies appear braced for a difficult second half of the year as new order growth and business activity expectations fell again in June, reflecting inflation concerns, higher interest rates and less favourable domestic economic conditions. Measured overall, the degree of optimism across the construction sector is now the lowest seen since July 2020.”

Duncan Brock, Group Director at the Chartered Institute of Procurement & Supply, said: “Residential building levels fell for the first time since May 2020, and builders are getting an increasingly stark vision of the marketplace they are now operating in as overall activity growth also fell sharply.

“This is in glaring contrast to the pandemic years where the construction sector held up well compared to the other sectors, but the weakest rise in output since September 2021 and the softest increase in new orders since October shows this has now changed. The heightened competition faced for short supply raw materials as well as essential skills for the building trade is squeezing the optimism out of builders with the lowest business expectations since July 2020.

“Returning from pandemic lockdowns has not been easy as builders now face greater affordability challenges not just for staff wages but for the energyintensive materials needed to deliver the pipelines of construction work they currently have. With a downbeat economic environment, the sector will be fearful about what is round the corner during the rest of this year.”

Cancelled Contract PROBLEM: Hi. I could do with some advice if possible.

I am a builder and recently agreed a contract with a customer (husband and wife) to construct a small extension to the lounge. The contract was based on my company’s standard terms and conditions and I got both the husband and wife to sign the contract at their home, which means that there should be no argument regarding terms and conditions. At the same time, I also received a deposit, and we agreed the start date, being on the following Monday, 6 June 2022.

However, for no reason, the Sunday before the work was about to start, the husband said he wanted to cancel and have the deposit repaid. This left me and my workers with no work for 5 weeks. Please can you tell me where I stand on this?

RESPONSE: From your outline, I would strongly urge

you to see a solicitor who will explain to you how consumer contracts work and to either amend your existing terms and conditions or draft new terms and conditions.

The reason for this is that your current terms and conditions are [probably] wanting in important areas and / or you are not fully aware of the various acts and regulations that regularise contracts with consumers (as well as in contracts with other businesses).

Although one of the most important acts that you must be aware of (in consumer contracts), is The Consumer Rights Act 2015, it is The Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 (“Consumer Contracts Regulations”), that your matter centres around.

cooling off period where goods and / or services are purchased online, over the phone or from a doorstep seller and the consumer has an automatic right to a 14-day coolingoff period in most circumstances.

In construction contracts, such a cooling off period would not apply where say the contract was sent by the builder to the customer and the customer then signed the contract at home and then sent the signed contract back to the builder.

But if you take the contract to the customer’s home and the customer signs the contract there and then, the customer is entitled to a minimum 14-day cooling off period.

There are certain exceptions like, for example, goods that are specially made (e.g. windows), or the customer has specially requested an earlier start date before the 14 days cooling off period has ended. However, the business must inform the customer of the right to cancel otherwise the cooling off period is extended by 14 days from the date when the customer is informed.

Melton Borough Council celebrates best housing delivery in 30 years

AT THE 13th July meeting of the Cabinet, Melton Borough Council members reviewed the 2021/2022 Five-years’ Housing Land Supply and Housing Trajectory report.

The annual report provides information in relation to the current housing delivery and housing supply situation in the borough.

FOLLOWING CONSULTATION earlier this year, residents and interested parties are invited again to have their say on the latest plans for the Ratcliffe on Soar Power Station site.

A draft Local Development Order (LDO) has now been finalised by Rushcliffe Borough Council that could give the green light to new industry and business projects and the potential of thousands of permanent highlyskilled jobs at the site.

The power station, owned by international energy company Uniper, will close at the end of September 2024 in line with government policy to end coal-fired power generation.

The Council now wants to hear views on its latest proposals by Monday September 5 on our website and at two local events: •

Halifax has removed the requirement that higher LTV new build loans (above 85%) be through developers on its panel.

This will increase the availability of 5% deposit mortgages to houses constructed by Britain’s more than 2,000 small housebuilders.

Shared ownership is an increasingly attractive choice for many of those struggling to get on the housing ladder, particularly where homes are above the national average. By buying part of the property initially and increasing that share at a point in the future, shared ownership is another solution for FTBs who find the first step to home ownership difficult.

Halifax will now accept a 5% deposit on both new build flats and houses in shared ownership schemes run by housing associations. Shared Ownership is available where the share being bought is between 25% and 90% of the property’s value. Buyers can now borrow up to 95% of their share of the home with the lower deposit requirement.

News from CITB Changes to CITB Plant Standards and Grants announced CITB has announced changes to its plant standards to standardise training and testing requirements across the construction industry.

The changes will start being introduced in January and follow consultation with employers and stakeholders from across the plant sector. The new standards will ensure safe, consistent and high-quality plant operations throughout England, Scotland and Wales.

Plant operations have been identified as a priority skills area, with 1,330 new entrants needed every year to keep pace with expected demand. The changes being made to standards and the grants scheme are designed to support employers to train more employees by increasing CITB’s overall investment in plant grants. In addition, the new standards have been designed to improve the quality of the plant training available and increase the safety of everyone working on sites with plant operations. There is currently no industry-wide standard for plant operator training.

The next phase of changes is due to take place in the next financial year and more information on these changes will be published nearer the time.

Plan for 62 student flats approved

A PROPOSAL to demolish four buildings off Leicester’s Welford Road and build 62 student flats in their place has been approved.

The six buildings in the courtyard behind 100 Welford Road, near the city centre, are currently vacant and are said to be in poor condition.

The site has previously been used as offices, a light engineering premises, a car dealership, a coal merchant’s, a builder’s and carpenter’s workshop, a sawmill and needle manufacturers. However, it has not been in use since 2016.

Four of the buildings will be demolished to make way for a block of 58 studio flats which will staggered in height at three, four and five storeys. The other two buildings will be converted into the remaining four flats, which will also be studios.

The developer, Prosol Enterprises LLP, has also agreed a contribution of around £38,000 for improvements to nearby Nelson Mandela Park, including gym equipment and seating.

They will also be installing a ‘green roof’ on the building to encourage biodiversity.

Old Leicester Mercury office up for sale for £10.5m

THE FORMER home of the Leicester Mercury has been put up for sale by its owners, with a price tag of £10.5 million.

The landmark building, near the train station, is now home to a trampoline park and several other businesses.

The Leicester Mercury and LeicestershireLive, which used to take up the entire building with the printing press on the ground floor, moved out five years ago for a new home in New Walk.

The building - well known for its rooftop clock and temperature dial - remains owned by HPPUT, part of the Mercury’s former owners, the Daily Mail & General Trust pensions scheme.

The Mercury has since become part of the Reach Plc group, which owns The Mirror, The Express and The Star, as well as local papers up and down the country. THE NEW Chancellor Nadhim Zahawi should make re-introducing tax cuts on diesel a priority if he’s serious about tackling construction inflation, claims the National Federation of Builders, NFB. The trade body said it was renewing its campaign to press for red diesel on building sites where the fuel used to receive a 47 pence per litre rebate.

NFB’s housing and planning policy head Rico Wojtulewicz said: “With fuel thefts rising and diesel now at over £2 a litre, the chancellor must look at giving industry access to red diesel again for a minimum period of twelve months.”

It has been easier to steal fuel now that it is no longer dyed red since the tax rebate was scrapped on the 1st of April.

Mr Wojtulewicz added the pandemic had meant non-fossil fuel machinery had not come on stream and alternative fuels were not widely available.

“The cost-of-living crisis is pushing businesses into closure.

The government doesn’t have many energy-based levers at its disposal but rolling back the awful decision to remove construction and others from accessing red diesel is not only sensible but can be decided overnight through a ministerial statement.”

Finance brokers Hank Zarihs Associates said development finance lenders agreed that reducing fuel prices was a key to helping control soaring building costs.

Treasury news desk head Sam Clark said: “We recognise too there are unique circumstances currently pushing up prices, which is why in March we introduced the biggest ever cut to all fuel duty rates and we increased the employment allowance.”

He added that for firms transitioning away from diesel there is £40m of support available via the department’s red diesel replacement competition.

The 47 pence per litre tax rebate on red diesel still applies for certain types of vehicles and machines used for specific purposes in agriculture, horticulture, fish farming and forestry.

RENTAL SECTOR REFORM: THE END OF ‘NO-FAULT’ EVICTIONS? A GOVERNMENT white paper has confirmed a radical re-shaping of the rental sector in England, after statistics from the English Housing Survey 2019 to 2020 revealed that 22 percent of tenancies are being ended forcefully.

The Renters Reform Bill (the Bill), which was outlined in the Queen’s Speech last month, will recommit to scrapping Section 21 notices, or ‘no-fault’ evictions. Currently, these allow landlords to evict tenants in England without giving a reason.

Paula Haverkamp, associate and litigation executive, specialising in landlord and tenant issues and property disputes at Nelsons, said: “The Bill has been introduced to help provide a fairer private sector for both landlords and tenants.

For example, currently, if a tenant wishes to vacate at the end of the fixed term, or if the tenancy has reverted to a periodic tenancy, a tenant only has to give one month’s notice to the landlord. However,

under the Bill, tenants will have to give the landlord two months’ notice.

with 12 months between the stages.”

“It is hoped that the Bill will help to tackle repeated rent arrears or antisocial behaviour among tenants.

As well as this, the Bill will end blanket bans on benefit claimants, or families with children, and will see landlords having to consider requests to allow pets.

“The Bill will allow landlords to increase rent once a year, if the tenants are given two months’ notice of the increase, which will abolish the rent review clauses.

Landlords will also be limited on the amount of rent they can ask for in advance and the notice period in relation to rent arrears, which equate to two months or more, will increase from two to four weeks.

“A new Ombudsman for private rented landlords will also be put in place, to ensure disputes can be easily resolved without having to take matters through the courts.”

How will it work?

“While the details of how the scrapping of Section 21 will work in England are not clear yet, we do know that assured and assured shorthold tenancies will be made periodic. The government has confirmed the new system will be implemented in two stages to allow a smooth transition. Although no dates have been provided for the first stage, it confirms that at least six months’ notice will be provided

Keep It Out Of Court: Avoiding Commercial Dilapidation Disputes THE FIRST quarter of 2022 has seen accelerated growth for both occupiers and investors as the commercial property market gains momentum, according to the Royal Institute of Chartered Surveyors’ (RICS) UK Commercial Property Survey.

This increased momentum will inevitably result in more people entering commercial tenancies.

Now is the time therefore for commercial landlords to make sure they know their legal rights.

Oliver Maxwell, legal director and solicitor specialising in commercial property disputes at Nelsons, discusses how a landlord can seek to reduce the risk of a dilapidations dispute arising.

Introduction In the commercial property context, dilapidations is a term given to the process of identifying items of damage or disrepair to commercial premises that ought to be rectified by the tenant under the terms of their lease.

They are a common area of dispute both during and at the end of a lease, arising when there is a difference in opinion between the landlord and tenant over the condition that the premises should be maintained during or left in at the end of the tenancy.

Since a tenant’s obligations are rarely the same from lease to lease, each case and dispute will be decided upon its own specific facts and documents. The situation can also be complicated further if alterations made by the tenant during their lease term are not properly authorised or documented. This is because, usually, the Licence for Alterations, or other appropriate documents granting consent, will include a provision that the tenant is to reinstate the premises to its original condition at the end of the lease.

Maintain an open dialogue Communication between all parties, both throughout and towards the end of the tenancy, can be the key to avoiding commercial dilapidation disputes.

If the landlord has any concerns within the term that the tenant may not be complying with their repairing obligations, it would be sensible to consider having an Interim Schedule of Dilapidations prepared and served. This document serves as a timely reminder as to what the landlord will expect with regards to the nature and extent of repairing obligations, but it is important it is served in good time so that the tenant can regulate their conduct accordingly.

If the tenant does not take notice of that early warning, the landlord, if the lease allows, may be able to utilise some self-help options by entering and completing the works themselves.

However, it would always be prudent to seek advice on the terms of the lease before doing so.

Record the property’s condition Establishing the property’s previous condition can be crucial if a tenant is looking to raise a dispute. The most common way this can be documented is through a Schedule of Condition, which is a detailed recording of a premises’ condition.

These can act as a useful starting point for the parties’ surveyors in determining whether any given obligation has been complied with or not. In cases where there is no Schedule of Condition, there is no official reference point meaning that both parties, usually via their surveyors, are left trying to agree on the original condition of the premises.

Not only can this be contentious, but it is also time-consuming and that, by implication, can lead to increased costs. As such, the creation and insertion of a Schedule of Condition can be created and inserted into a lease and can make all the difference to the outcome of a dispute.

Know the process

Dilapidation disputes are governed by the Pre-Action Protocol for Claims for Damages in Relation to the Physical State of Commercial Property at Termination of a Tenancy. This protocol imposes a structure for parties seeking to settle dilapidations disputes without the need to involve the court via the early exchange of information.

Each claim will be different, but the protocol expects the landlord to prepare and serve a Terminal Schedule of Dilapidations and Quantified Demand within 56 days of the termination of the tenancy. That document should set out what the landlord considers to be the breaches of the lease, the works required to be done to remedy those breaches, and the landlord’s estimated costs.

The protocol also says that the landlord may send a schedule before the termination of the tenancy. However, if they do, they should also advise the tenant at the end of the tenancy that either the situation remains the same, or a new up-to-date schedule should be served to confirm the extent of the work on the date

the tenancy expires. Under the protocol, the tenant is expected to reply to each of the quantified demands in sufficient detail within 56 days of receipt to enable the landlord to clearly understand the tenant’s views on each item within the schedule.

After the initial landlord service and tenant reply, the parties are expected to negotiate to see if an agreement can be reached. The protocol expects a meeting to occur between the parties’ surveyors within 28 days of the tenant’s response being served. At all stages, the parties are encouraged to consider alternative forms of dispute resolution to avoid civil proceedings.

Taking it to court If an agreement isn’t able to be reached by both parties, it may be that civil proceedings need to be instigated. To do this, the landlord must first quantify its loss by providing a detailed breakdown of the issues and consequential losses, based on either a formal diminution valuation or an account of the actual expenditure, or a combination of both, to the tenant.

After the landlord has quantified its losses, the parties are expected to see if an agreement can be reached. The parties should consider the state of the papers and evidence in order to see if proceedings can be avoided and at least narrow the issues between them. If no agreement can be reached, the landlord can then issue legal proceedings to recover their alleged losses.

The court will then be asked to consider the lease and each of the parties’ evidence before deciding whether to award damages to the landlord and will also penalise parties who did not properly engage with the protocol.

Throughout the duration of a tenancy, it is of paramount importance for both parties to maintain communication and report on the condition of the property to try and prevent any disputes. However, on the occasions where they do arise, it is necessary for both parties to make sure they’re familiar with, and follow, the protocol in order to avoid taking the dispute to court, as well as not being penalised if legal proceedings do start.

The Council initially refused permission on its officers’ advice as the site was in an ‘Area of Local Separation’ (ALS) between Sileby and nearby Cossington and that Sileby had already met the target growth as set out in the Council’s Development Plan.

However, David Wilson Homes appealed, and its case was bolstered by Fisher German’s expertise in planning matters.

Angela Brooks, associate director at Fisher German, was called as an expert planning witness by Paul Tucker QC, acting for David Wilson Homes, at the public inquiry.

The presumption in favour of sustainable development was engaged as the council were unable to demonstrate a five-year supply of housing.

Angela was able to successfully demonstrate that any negative effects of the proposed development in terms of character and appearance and the conflict with the development plan were outweighed by the clear benefits.

Despite the Council‘s disagreement, she argued that the development was in a sustainable location, would make provision for affordable housing and other infrastructure requirements as well as a significant over provision of open space ensuring that incursion into the ALS was minimised.

The Planning Inspector agreed with her submissions and David Wilson Homes’ case and allowed the appeal.

100 ‘affordable’ homes proposed next to River Soar Queniborough earmarked for 125 new homes, park and nature in Leicester sanctuary QUENIBOROUGH could soon be the site of 125 new homes.

New plans submitted by developer Bloor Homes have outlined the partdemolition and conversion of an 18th century Georgian farmstead resting on derelict land.

OWL PARTNERSHIPS wants to build 100 homes next to the River Soar in Leicester The proposed development, off Loughborough Road, Rushey Mead, will comprise a mix of 59 flats and 41 houses.

All the homes are described as ‘affordable’, and will be a mixture of ‘shared ownership’.

The site, which includes the brownfield site behind the Bestway Cash and Carry and the green space along the River Soar was allocated in the 2006 Leicester Local Plan – a document which sets out which land can be built on – for up to 140 homes.

The homes will be predominantly built on the brownfield, however, with the existing green space retained and enhanced through landscaping to become a new public open space. A decision is expected by September.

Outline planning permission for the land in Queniborough was granted back in 2015, but the permission eventually expired before the work was carried out. The industrial buildings on the site have all become vacant since then and residents were asked for their views in a public consultation earlier this year. The land in Melton Road would include a “sympathetic restoration” of Queniborough Lodge and its outbuildings, as well as the creation of a park and a nature reserve.

If given the green light, a new park - set to be named Wreake Valley Park - will include a community orchard, allotments and children’s play area.

A nature reserve, to be called Wreake Nature Sanctuary, is also on the cards. A portion of the land would be set away for “rewilding” in order to create a nature refuge. According to the timeline on the public consultation, if the plans are granted, work will begin at the end of this year with a predicted completion date of 2025.

Public inquiry dates announced for proposed prison at Gartree

THE PLANNING Inspectorate has confirmed a public inquiry will be held to decide the Ministry of Justice’s planning appeal to build a new prison at Gartree.

In April 2022, Harborough District Council’s planning committee unanimously refused the application; an appeal from the Ministry of Justice against the decision was received this month.

The public inquiry will be held at the Harborough District Council offices, in Adam and Eve Street, Market Harborough, starting on Tuesday 4 October and continuing 5, 6, 7 and 10 October 2022.

The public, or other interested parties, can attend the inquiry.

The Council will forward all public and consultants’ comments, previously made on the planning application, to the Inspectorate.
