143.6 MAJOR schemes that make up more than £2 billion of private and public sector investment already made, or proposed in Leicester, can be seen in a new video.

The video – which uses computer generated images to take the viewer on a fly-through of the city – is being used to promote development opportunities to potential investors.

It highlights a wide range of regeneration schemes recently completed in Leicester, as well as some of those proposed or in the planning stage.

Ongoing and completed projects referenced include the City Mayor’s Connecting Leicester scheme, which has seen the transformation of the city centre thanks to improved connectivity and high-quality public realm improvements.

LATEST House Price Index News from page 1 The Royal Institution of Chartered Surveyors’ (RICS’) February 2022 UK Residential Market Survey reported that home sales strengthened in February along with a pick-up in new buyer enquiries, despite the Bank of England’s decision to increase interest rates.

The Bank of England’s Agents’ summary of business conditions 2021 Q4 reported ongoing strong demand for housing and a shortage of properties for sale, which pushed up prices.

The UK Property Transactions Statistics showed that in January 2022, on a seasonally adjusted basis, the estimated number of transactions of residential properties with a value of £40,000 or greater was 106,990. This is 10.6% lower than a year ago (January 2021). Between December 2021 and January 2022, UK transactions increased by 5.1% on a seasonally adjusted basis, following a large increase in the month prior.

The Bank of England’s Money and Credit January 2022 release reported that mortgage approvals for house purchases (an indicator of future lending) rose to 74,000 in January 2022, up from 71,000 in December 2021. This is above the pre-pandemic 12-month average up to February 2020 of 66,700 and the highest since July 2021 (75,900).

Meeting Net Zero in construction is demand-led and the removal of VAT on energy saving materials is likely to cause a significant increase in the need for low-carbon skills.

“This tax cut will help to create the confidence industry needs to invest in retrofit training.

“The Chancellor said the government will be looking at the issue of employment training in the private sector, which will be reviewed as part of the government’s new tax plan, including assessing whether the Apprenticeship Levy is “doing enough”.

“CITB will continue to work with the government on apprenticeship levy reform as apprenticeships are the main route for employers in our industry to get the skilled workforce they need in recovery. Apprenticeship starts are recovering but it’s vital that we continue to drive numbers up. Critical to this will be building on recent reforms of the Apprenticeship Levy Pledge Service to ensure unspent levy funds from larger companies can be accessed by small employers to provide more apprenticeships.”

THE CREATION of a new pedestrian space for outdoor markets and events in Marlborough Square will finally start this year after councillors voted to press ahead with the scheme.

After a number of years involving detailed design and discussion, the final plans to redesign Marlborough Square have been approved by North West Leicestershire District Council (NWLDC).

The scheme has been a key commitment for NWLDC since plans were drawn up in 2018, but it has suffered delays because of the complexity and detail involved in the project.

NWLDC Cabinet unanimously approved plans for the square in February, with Full Council agreeing the budget for the work at its recent meeting. Subject to final approval from Leicestershire County Council highways, work will start this year.

The scheme is expected to cost £2.7 million.

With contractors soon to be appointed, work should start in early summer, and it is hoped the square will be completed by early 2023.

The redesign includes: • A central outdoor market and events space • High-quality street furniture including bins and bus shelters • Bespoke seating inspired by the National Forest • Raised planting • Feature LED lighting • Granite paving • Introduction of a one-way traffic system • Limited vehicle access to the northern part of the square.

Travis Perkins hails “outstanding” 2021 financial performance

THE CEO of ­­­­­Northamptonheadquartered Travis Perkins says the company has delivered “an outstanding financial performance” for 2021.

According to full year results for the year ended 31 December 2021, revenue hit $4.6bn, up 24% versus 2020 (£3.7bn), and 10.6% ahead of 2019.

The company said this performance “reflects the extensive work undertaken to enhance the customer proposition, through investment in network capacity and technological capability, coupled with the robust recovery in both the RMI and new house building markets.”

Meanwhile the firm noted that actions taken to restructure the business and improve operational effectiveness, coupled with disciplined management of increasing inflation and product availability challenges, enabled the business to deliver an adjusted operating profit of £353m, up from £128m in 2020, and 19% ahead of 2019.

NFB comment on Spring Statement

IN HIS Spring Statement, the Chancellor of the Exchequer has today announced that the Government will reduce the VAT rate on energy saving measures (ESM) and their installation to zero for homeowners.

The National Federation of Builders has welcomed the announcement which will help to incentivise homeowners to invest in improving the energy efficiency and performance on their homes.

Commenting, Richard Beresford, Chief Executive of the NFB said: “The NFB, along with many others in the industry, has repeatedly, over many years, called on the Treasury to remove the VAT on measures which improve energy efficiency.

To us it always seemed like a ‘nobrainer’ to help incentivise the public to ‘green’ their homes and meet our country’s Net Zero ambitions and today we can finally welcome the decision the Chancellor has taken, it is long overdue but at last it is here.”

However, the NFB was disappointed that the Chancellor did not take the opportunity to postpone the changes to the construction sector’s entitlement to use Red Diesel.

PROBLEM: I own a joinery business which over the years has built a reputation in producing high quality bespoke furniture.

A little while back, I was approached by a couple seeking to fit out the master bedroom of their house. The bedroom had recently been added to their already substantial house, as a loft conversion, so the area was quite big and involved a lot of work and detail.

The price I submitted, including VAT, was just under £30,000, and I asked if the quotation was acceptable, for a 20% deposit. I also stated in the quotation that the lead-in time was 6 months.

The customer accepted the quotation and duly paid the deposit, at which point I prepared a cutting list and ordered all of the materials, of which the type of hardwood specified (Walnut and Ash), made purchasing very expensive.

About one month later, the customer emailed me to say that they had second thoughts and wanted to cut costs and requested me to come up with a new and simpler design, with the wood now being an oak veneer. I responded that I could come up with a new design, but I would still require a substantial amount from the original order, given that I had already completed the design work and cutting details and had purchased the materials.

The customer replied saying that there should be no costs incurred given that the installation date was still so far away, and if I have purchased the materials, this was done too early and at my risk. They have also asked for their deposit back.

What is your opinion on the matter?

RESPONSE:

Your problem is going to be more of a problem for your customer.

Your customer has entered into a binding contract with your business for it to design, manufacture and install bespoke bedroom furniture for the sum of [about] £30,000, and your customer cannot then unilaterally decide post contract that they want ‘out’, without incurring costs. You therefore have a few options.

You can make a without prejudice offer to your customer that would enable the initial agreement to end on mutual terms. From your perspective, you would need to consider what you would be prepared to accept as appropriate compensation, which I suggest would at least include your time in designing and the purchase of the materials (albeit you would need to give credit if any of the materials could be used elsewhere or alternatively, offer the materials to your customer).

If your customer refuses your without prejudice offer, then you will need to consider whether your customer has wrongly repudiated the contract and if so, you can either elect to affirm the contract or accept the wrongful repudiation and claim damages (which will include all of your costs to date plus any loss of profit).

Whatever you decide, I would have thought that the deposit paid will be less than what your claim will be. LATE NEWS Part Z-inspired plans put on ice four days before scheduled second reading AS REPORTED BY BUILDING MAGAZINE, proposals to limit carbon emissions in construction projects by amending building regulations have been shelved because the MP behind them has been appointed to a new job at the housing department.

The Carbon Emissions (Buildings) Bill was withdrawn in March, four days before its scheduled second reading. It will now need to start its progress through parliament from scratch if another MP chooses to revive it.

It follows the appointment of Duncan Baker, the backbench Conservative MP who proposed the 10-minute rule bill in February, as a parliamentary private secretary (PPS) to three ministers at the Department for Levelling Up, Housing and Communities.

New research finds Leicester best positioned city for economic growth in the East Midlands LEICESTER has placed as the highest ranked East Midlands city in the the Demos-PwC Good Growth for Cities Index, which ranks 50 of the UK’s largest towns and cities (plus the London boroughs as a whole), based on people’s assessment of 12 key economic wellbeing factors.

It achieved a ranking of 14th out of 50 and is followed by Derby (ranked 23rd), Nottingham (ranked 34th) and Lincoln (ranked 35th).

The index uses a series of indicators including safety, income distribution, income, health, work-life balance, environment, transport, jobs, high street & shops, housing, skills and new businesses. among the highest in the country.

NET Zero is a big topic of conversation at the moment and recently, the government set a target of lifting the minimum energy efficiency standard in to let non-domestic buildings to ‘B’, as part of the government’s target for the UK being net zero by 2050.

Martin Jinks, commercial property law consultant at Nelsons, discusses the new minimum energy efficiency standard and examines what still needs to be considered to make it possible.

Currently, subject to exceptions, a landlord must not let a building that does not comply with the minimum required energy efficiency standard, originally set at an ‘E’ rating on a valid Energy Performance Certificate (EPC). Many landlords may be relaxed, knowing their buildings are rated ‘E’ or better for energy efficiency but they could be sitting on a time-bomb as the government has recently set a target of lifting the minimum energy efficiency standard in relation to let non-domestic buildings to ‘B’ by 2030.

To B or not to B The government estimates that the implementation of the EPC B target will cover around 85 per cent of the UK’s non-domestic rented stock and will help the UK achieve its target of net zero carbon emissions by 2050.

The Department for Business, Energy & Industrial Strategy has now published an open consultation on changes to the Minimum Energy Efficiency Standards (MEES) Regulations in the commercial sector, entitled ‘Non-domestic Private Rented Sector minimum energy efficiency standards: EPC B implementation’.

As stated in the open consultation report, the government proposes a phased implementation of the ‘B’ minimum standard by setting an interim milestone in 2027 for a minimum standard of ‘C’, but the way in which it proposes to do this needs to be analysed.

The government currently estimates that around 10 per cent of non-do-

mestic let buildings are below the ‘E’ rating. As from 1 April 2023, a landlord can only lawfully continue to let a non-domestic building if the building has an energy rating of ‘E’.

It is possible that in the period after 2023, the landlord’s building does not have a valid EPC because, although one was obtained when the lease was granted, it has expired EPCs only have a 10-year lifespan.

As part of its package of measures, the government intends to alter this so that a building must always have an up-to-date EPC during the whole time that it is let. This would cover cases of lease renewal where current guidance suggests that an EPC is not necessary where an existing tenant is renewing its lease.

Compliance Windows The government is proposing two ‘Compliance Windows’ in the second half of this decade, which are as follows: The first Compliance Window from 2025 to 2027 From 1 April 2025, all non-domestic rented buildings within the scope of the MEES regulations would have to have a valid EPC, meaning that if one had expired, a new one must be obtained.

The paper talks about a requirement for a landlord to “present” a valid EPC by 1 April 2025. This means that the landlord will have to submit its EPC to an online Private Rented Sector compliance and exemptions database.

From 1 April 2027 the minimum required rating would increase to ‘C’, so that landlords must have improved the building by then, or have registered a valid exemption. If the building already possessed a ‘C’ rating at April 2025, the landlord would be in compliance with the regulations. However, if not, the landlord would have to present a new EPC with its ‘C’ rating by 1 April 2027, or register an exemption.

The second Compliance Window from 2028 to 2030 A landlord would have to present a valid EPC by 1 April 2028 and from 1 April 2030, the minimum rating

would increase to ‘B’. If the building already possessed a ‘B’ rating at April 2028, the landlord would be in compliance. However, if not, the landlord would have to present a new EPC with its ‘B’ rating by 1 April 2030, or register an exemption.

Looking ahead This ‘four juncture’ approach is a move away from enforcement at the point of letting. Dispensing with compliance at the point of letting will assist with the ‘shell and core’ problem.

In new ‘shell and core’ lettings, where a landlord lets a unit in a stripped-out condition, with the tenant to fit out, including installation of heating and lighting, at the point of letting, an EPC for the building is likely to give an ‘F’ or ‘G’ rating, thereby making it unlawful for the landlord to let.

Options for compliance would include either the tenant obtaining early access to fit out, or the landlord installing items which the tenant then replaces. While the proposed new framework for compliance would still require a landlord to hold a valid EPC at the point of letting, for the purposes of complying with the MEES Regulations, the building would simply need to achieve a ‘C’ rating by 2027 and a ‘B’ rating by 2030, regardless of when it was let.

For those lettings occurring close to a compliance date, a specific exemption could be introduced.

Hence, the government is proposing to enforce MEES only once a unit is fully operational and has been occupied for at least six months.

However, the tenant’s fit out may have a significant impact on the final EPC rating, and thus on compliance. The government is therefore considering ways in which tenants can take on a share of the legal responsibilities in relation to MEES by imposing duties upon them.

The consultation ran until 9 June 2021. The government aimed to publish a response at the end of 2021, but this has yet to be done as they are still analysing feedback, and propose for the regulations to take effect from April 2025.

Nick and Ian confess to being ordinary runners, having never attempted anything like this before. Nick and Ian will be travelling as a team of 4, with Dave Orton, physio, and Lewis Moses, coach. Both Dave and Lewis have been instrumental in getting Nick and Ian ready for this challenge of a lifetime and will be supporting them in person for the whole journey.

To add to the challenge, all flights will be on standard scheduled airline flying, economy class; this is where the team will also sleep for 3 of the nights (and 3 of the team members are over 6ft tall!). There will be one opportunity to sleep in a hotel bed whilst travelling, by which point, the pair will have ran 104.8 miles, ahead of leg 5. As a team, Nick, Ian, Dave and Lewis will be planting 24 trees to offset the carbon footprint of the flights, making the challenge as carbon neutral as possible.
